The purpose of this paper is to assess the emergence of the pirate movements in the European Union. Our goal is to sketch the steps towards a research agenda for this grassroots political movement which gained momentum since 2009. To attain our goal we showed the re-signification of the concept of piracy in the debate around intellectual property and its institutional settlement. Afterwards we analysed the big political themes of several European Pirate Parties and their struggle to follow the preferences (...) of the median voter. We concluded with a set of hypotheses of which the most important is that the pirates will inscribe neither to the left nor to the right part of the political spectrum. (shrink)

The purpose of the following study is that of providing a critical anal‑ ysis of Intellectual Property (IP), with a closer look on copyright, in the context of human rights. My main conjecture is the following : the legal infrastructure stemming from the implications of copyrights which states created has nega‑ tive consequences if we have a closer look at some human rights specified by The Universal Declaration of Human Rights (UDHR). For example, copyrights are, in my view, incompatible with (...) the human rights which specify that (1) hu‑ man beings have a right to freely take part in the cultural and scientific life of the communities which they inhabit and (2) human beings have a right to own property. My main hypothesis is the following : if copyrights are, in fact, more difficult to ground from a moral perspective, then this considerations must trump the provision of the 27th article of the UDHR, which states that creators, be they artists or researchers, have a human right to have their moral and mate‑ rial interests protected with regard to their intellectual products, if this amounts to a justification for a copyright. Accountability for corporate social responsibility (CSR) and its societal challenges is undetermined, and it is unclear whether business or society should carry these responsibilities. Despite severe criticism from some, many organizations continue to invest in and promote CSR. The purpose of this multiple-case study was to increase the understanding of the phenomenon from the perspective of a purposeful sample of participants who contribute to CSR execution and who were representatives of the 10 organizations identified as active promoters. The participant corporations (...) (case studies), in Europe and North America, were mainly in the telecommunications industry. Study data came from 11 face-to-face, semistructured interviews with chief executive officers (CEOs) and other CSR key participants, a review of corporate archival records, and a review of other sources regarding the effective implementation of CSR in these organizations. The conceptual framework consisted of Carroll’s constructs of CSR based on economic, legal, social, and discretionary elements. The constant comparative method was used to analyze the interview data and identify factors leading corporations to continue to engage in CSR. These factors were economic, social impact, legal compliance, or good reputation, sponsored by transformational or adaptive leaderships and endorsed by visionary CEOs. The findings may enlighten and motivate other organizations to engage in CSR programs and connect stakeholders’ contribution to a broadened positive social change. (shrink)

This Article draws attention to a conceptual point that has been overlooked in recent discussions about the theoretical foundations of contract law. I argue that, rather than enforcing the obligations of promises, contract law concerns complaints against promissory wrongs. This conceptual distinction is easy to miss. If one assumes that complaints arise whenever an obligation has been violated, then the distinction does not seem meaningful. I show, however, that an obligation can be breached without giving rise to a valid complaint. (...) This Article illustrates the importance of this conceptual distinction by focusing first on the doctrine of substantive unconscionability. I claim that the doctrine can be best explained by the way in which a party who engages in exploitative behavior may lose her moral standing to complain. It is because such a party has lost her moral standing to complain that the law, through unconscionability doctrine, bars her from bringing a legal complaint. This explanation avoids the oft-issued charge of paternalism and it also offers benefits over an alternative state-oriented account developed recently by Seana Shiffrin. Using the conceptual distinction behind this account of unconscionability, this Article further argues that recent theoretical debates about the relationship between contract law and morality have been largely misconceived. Those debates have focused on whether contract law and morality impose parallel obligations. Once one appreciates the difference between imposing obligations and recognizing complaints, the comparison looks quite different. Contract law recognizes valid complaints against broken promises, much as morality recognizes moral complaints. (shrink)

This Article describes a jurisprudential puzzle—what I call the puzzle of the beneficiary’s bargain—and contends that adequately resolving this puzzle will require significant revisions to basic premises of contract law. The puzzle arises when one party enters into two contracts requiring the same performance, and the promisee of the second contract is the third-party beneficiary of the first. For example, a taxi driver contracts with a woman to transport her parents from the airport next week, and then the driver separately (...) enters a contract with the parents to transport them when the time comes. Is the second contract valid and enforceable, or does it fail for lack of consideration? This specific question—on which courts have split—implicates several important contract law doctrines. Moreover, it highlights a deep tension in our modern understanding of contractual obligation. This Article argues that adequately resolving the puzzle necessitates a general reconsideration of the relationship between rights and liability in contract law. Surprisingly, the best solution requires abandoning the foundational understanding that contract liability arises out of breach of a promisee’s right to performance. The puzzle thus offers a lens through which to examine—and even revise—the central concepts of modern contract law. (shrink)

There are two main questions that any account of corporate lawyers’ moral obligations needs to answer: (1) Do corporate lawyers have moral obligations to third parties? and (2) In cases of conflict between obligations to the corporation and obligations to third parties, which should prevail? This Article offers answers to these questions in the context of lawyers working in medical corporations. I argue that lawyers do have moral obligations to third parties, and that in cases where patients’ rights are being (...) violated by a medical company, patients’ rights should prevail. Consequently, attorney–client confidentiality rules should be relaxed to allow for attorney disclosures in egregious cases of potential harm to third parties. (shrink)

Many of the problems we face can usefully be modeled as prisoners’ dilemmas. All the standard game-theoretic solutions to prisoners’ dilemmas lead, in the real world, to assurance games. But too often some aspects of our social interaction are as much obscured by, as illuminated by, game theory. Removing some of the epistemic constraints often accepted by game theorists will enable us to distinguish between productive and destructive prisoners’ dilemmas. With recent advancements in systems engineering and artificial intelligence, autonomous agents are increasingly being called upon to execute tasks that have normative relevance. These are tasks that directly—and potentially adversely—affect human well-being and demand of the agent a degree of normative-sensitivity and -compliance. Such norms and normative principles are typically of a social, legal, ethical, empathetic, or cultural (‘SLEEC’) nature. Whereas norms of this type are often framed in the abstract, or as high-level principles, addressing normative concerns in concrete applications (...) of autonomous agents requires the refinement of normative principles into explicitly formulated practical rules. This paper develops a process for deriving specification rules from a set of high-level norms, thereby bridging the gap between normative principles and operational practice. This enables autonomous agents to select and execute the most normatively favourable action in the intended context premised on a range of underlying relevant normative principles. In the translation and reduction of normative principles to SLEEC rules, we present an iterative process that uncovers normative principles, addresses SLEEC concerns, identifies and resolves SLEEC conflicts, and generates both preliminary and complex normatively-relevant rules, thereby guiding the development of autonomous agents and better positioning them as normatively SLEEC-sensitive or SLEEC-compliant. With AI permeating our lives, there is widespread concern regarding the proper framework needed to morally assess and regulate it. This has given rise to many attempts to devise ethical guidelines that infuse guidance for both AI development and deployment. Our main concern is that, instead of a genuine ethical interest for AI, we are witnessing moral diplomacies resulting in moral bureaucracies battling for moral supremacy and political domination. After providing a short overview of what we term ‘ethics washing’ in (...) the AI industry, we analyze the 2021 UNESCO Intergovernmental Meeting of Experts (Category II) tasked with drafting the Recommendation on the Ethics of Artificial Intelligence and show why the term ‘moral diplomacy’ is better suited to explain what is happening in the field of the ethics of AI. Within the Computer Science community, many ethical issues have emerged as significant and critical concerns. Computer ethics is an academic field in its own right and there are unique ethical issues associated with information technology. It encompasses a range of issues and concerns including privacy and agency around personal information, Artificial Intelligence and pervasive technology, the Internet of Things and surveillance applications. As computing technology impacts society at an ever growing pace, there are growing calls for more computer ethics content (...) to be included in Computer Science curricula. In this paper we present the results of a survey that polled faculty from Computer Science and related disciplines about teaching practices for computer ethics at their institutions. The survey was completed by respondents from 61 universities across 23 European countries. Participants were surveyed on whether or not computer ethics is taught to Computer Science students at each institution, the reasons why computer ethics is or is not taught, how computer ethics is taught, the background of staff who teach computer ethics and the scope of computer ethics curricula. The claim that ordinary ethical discourse is typically true and that ethical facts are typically knowable seems in tension with the claim that ordinary ethical discourse is about features of reality friendly to a scientific worldview. Cornell Realism attempts to dispel this tension by claiming that ordinary ethical discourse is, in fact, discourse about the same kinds of things that scientific discourse is about: natural properties. We offer two novel arguments in reply. First, we identify a key assumption that we (...) find unlikely to be true. Second, we identify two features of typical natural properties that ethical properties lack. We conclude that Cornell Realism falls short of dispelling the tension between ethical conservativism and ethical naturalism. (shrink)

Predmet istraživanja su izazovi nastavnika u radu sa učenicima iz osetljivih socijalnih grupa, tokom nastave u vanrednim okolnostima, uslovljenim pandemijom koronavirusa. U radu su prikazani rezultati kvalitativnog istraživanja, sprovedenog krajem 2021. godine, u okviru projekta Pravo na obrazovanje u periodu krize izazvane pandemijom virusa COVID-19 u Srbiji. U polustrukturisanim individualnim intervjuima učestvovalo je 50 nastavnika osnovnih, srednjih i škola za obrazovanje učenika sa smetnjama u razvoju i invaliditetom, iz 14 gradova u Srbiji. Tokom obrazovno-vaspitnog procesa sa učenicima iz (...) osetljivih socijalnih grupa, nastavnici su suočeni sa brojnim izazovima: digitalni jaz prvog i drugog nivoa, diskontinuitet u procesu obrazovanja, neodgovarajuća podrška u učenju od strane roditelja, nemotivisanost učenika za učenje, otežana komunikacija, teškoće u praćenju nastave, nemogućnost sprovođenja epidemioloških mera i individualnih tretmana itd. Sudeći na osnovu izazova nastavnika, učenici iz osetljivih grupa više su pogođeni obrazovnom krizom nego njihovi vršnjaci iz privilegovanih grupa. Neophodno je sprovođenje sistemskih mera podrške u cilju obezbeđivanja inkluzivnog pristupa obrazovanju. (shrink)

Cornell realism (CR), a prominent meta-ethical position that has emerged since the last decades of the twentieth century, proposes a non-reductionist naturalistic account of moral properties and facts. This paper argues that the best version of CR’s chosen methodology for arriving at justified moral beliefs must be seen as a variant of reflective equilibrium. In comparison to the traditional versions, our proposal offers a ‘social’ reinterpretation of reflective equilibrium in delineating CR’s epistemology. We argue that it satisfactorily accounts for objectivity (...) and calls for the inclusion of the social nature of both moral and scientific inquiries. Emphasising the social dimension of their epistemological account also nudges debates in metaethics into incorporating the much-needed social dimension while dealing with questions of moral beliefs and facts that have been of CR’s concern. A report on Cornel West's Edinburgh Gifford Lectures 2024: "A Jazz-soaked Philosophy for our Catastrophic Times: From Socrates to Coltrane".

Cornell realists maintain that irreducible moral properties have earned a place in our ontology in virtue of the indispensable role they play in a variety of explanations. These explanations can be divided into two groups: those that employ thin ethical concepts and those that employ thick ethical concepts. Recent work on thick concepts suggests that they are not inherently evaluative in their meaning. If correct, this creates problems for the moral explanations of Cornell realists, since the most persuasive moral explanations (...) are those that employ thick concepts. If thick concepts are not inherently evaluative, then the most plausible explanations on offer cannot support Cornell realism. Moral explanations employing thin concepts, however, are too flimsy to support the view. Unless proponents can develop a compelling story about thick concepts or thin explanations, Cornell realism is in trouble. (shrink)

Jason Springs’s Healthy Conflict in Contemporary American Society is a masterful attempt to practice productive conflict and democratic dialogue in the face of static antagonisms and deep‐seated divisions. In my response, I underscore Springs’s insistence on mediating between the moral imagination of Richard Rorty and the prophetic critique of Cornel West. For the author of Healthy Conflict, any hope in the survival of democracy relies on balancing critique of domination with constructive proposals for a more just and equitable world. (...) On the one hand, Springs rejects any strong distinction between moral imagination and socio‐political critique; in fact, he argues for their intertwinement, especially in the work of West. At the same time, there are moments when he suggests an opposition between expanding the moral imagination and engaging in the critical enterprise, especially as he identifies the limits in Foucault regarding normativity and democratic struggle. I respond to this slippage by arguing that Foucault, and critical theory more broadly, open up possibilities for rethinking ethics, politics, and our relationship to the violence that sustains the order of things. Moral realism and ethical naturalism are both highly attractive ethical positions but historically they have often been thought to be irreconcilable. Since the late 1980s defenders of Cornell Realism have argued that the two positions can consistently be combined. They make three constitutive claims: (i) Moral properties are natural kind properties that (ii) are identical to (or supervene) on descriptive functional properties, which (iii) causally regulate our use of moral terms. We offer new arguments against the feasibility of Cornell realism (...) and then show that there is a way to be a naturalistic realist that avoids internal inconsistency and uniquely provides for moral normativity. This article makes the case for the necessity of a multi-focal conception of violence in religion and peacebuilding. I first trace the emergence and development of the analytical concepts of structural and cultural violence in peace studies, demonstrating how these lenses both draw central insights from, but also differ from and improve upon, critical theory and reflexive sociology. I argue that addressing structural and cultural forms of violence are concerns as central as addressing direct (explicit, personal) forms of violence for (...) purposes of building just and sustainable peace. Moreover, religiously informed and/or motivated peacebuilders are especially well-appointed and equipped to identify and address violence in its structural and cultural manifestations. I the examine how concepts of structural and cultural violence, in effect, centrally inform the efforts of Martin Luther King and Cornel West to cultivate just and sustainable peace in a context as putatively peaceful and prosperous as the United States. U ovom radu dat je kratak pregled osnivanja Instituta za filozofiju i drustvenu teoriju kao institucionalne osnove za postanak i izlazenje casopisa Filozofija i drustvo. On je prvobitno, 1987. godine, poceo da izlazi kao zbornik, jednom godisnje, da bi od 2005. postao casopis, sa ritmom publiciranja tri puta godisnje, a od 2011. izlazi kvartalno. Takodje je dat i pregled svih tematskih celina, i to do kraja 2012. godine. Analiziran je detaljno jedan broj FiD-a, kao vazan dokument za promenu drustvene (...) atmosfere u negdanjoj Jugoslaviji i sa nagovestajima njenog raspada: naucni skup je odrzan 2. i 3. jula 1991. Pojem filosofie nabyl v průběhu historie řadu podob a významů. Kromě tradičního teoretického zaměření se lze setkat s přístupem, který vyzdvihuje praktický dopad filosofování na život člověka. Příspěvek představuje koncept filosofické praxe a reflektuje její současný stav na území České republiky. Autoři vymezují filosofickou praxi jako disciplínu filosofie, a načrtávají její možné dělení na dílčí oblasti. Nastíněny jsou její historické kořeny, které autoři identifikují v antickém Řecku. Dále se věnují systematickému představení doposud sepsaných materiálů k filosofické praxi a přehledu její (...) realizace na území České republiky. Detailní pozornost věnují autoři popisu tří jejích oblastí, mezi které patří filosofie pro děti, filosofický workshop a filosofická konzultace. Kromě teoretického vymezení reflektují rovněž své vlastní postupy v uvedených oblastech. Článek čerpá především ze zahraniční odborné literatury, konkrétně z textů a dalších materiálů filosofických praktikantů. Jeho cílem je představit českému čtenáři doposud podrobněji neřešený koncept filosofické praxe a připravit tak pole pro možnou debatu na akademické rovině. -------- The concept of philosophy has had several forms and meanings throughout the history. Besides the traditional theoretical focus, we may also encounter the approach that highlights a practical impact of philosophizing on one’s life. This text introduces the concept of philosophical practice and reflects its current situation in the Czech Republic. Authors characterize philosophical practice as a discipline of philosophy and present its possible division into subsections. They also present its historical roots, which can be found in ancient Greece. Moreover, authors introduce available sources dealing with the philosophical practice and describe how this discipline is actually practiced in the Czech Republic. Detailed attention is given to three of its sections, namely philosophy for children (P4C), philosophical workshop, and philosophical consultation. Authors present theoretical background and also reflect their own methods in these sections. The text draws primarily from scholarly literature from abroad, particularly from the manuscripts and other sources produced by philosophical practitioners. The aim of this text is to introduce the concept of philosophical practice to the Czech reader and prepare the field for further academic discussion. (shrink)

U ovom radu analizira se rešenje skeptičkog paradoksa koje pruža teorija relevantnih alternativa. Ispituju se i upoređuju dve verzije ovog rešenja: nekontekstualistič- ka čiji je tvorac i zastupnik Fred Drecke, i kontekstualistička koju zastupaju autori poput Kita Dirouza i Stjuarta Koena. Uporednom analizom nekontekstualističkog i kontekstuali- stičkog rešenja, dolazi se do zaključka da, iako oba rešenja imaju i povoljne i nepovoljne implikacije, Dreckeova teorija relevantnih alternativa nudi uverljivije objašnjenje, a zatim i rešenje skeptičkog paradoksa.

Nemali broj interpretatora Platonove Države smatra kako Sokratova argumentacija protiv Trasimaha u prvoj knjizi Države nije zadovoljavajuća, valjana i uverljiva. U ovom radu autorka nastoji da pokaže u čemu leže smisao, snaga i validnost Sokratovih argumenata protiv imoralističkog stanovišta o prirodi pravednosti. Njegovi argumenti nemaju samo elenktičku, pobijajuću vrednost, nego nam daju i uvid u neka načelna pitanja, poput prirode umeća, pleoneksije, funkcije, vrline, eudajmonije, te pružaju putokaz u kojem pravcu će se kretati dalja rasprava u Državi.

Jedno od najznačajnijih pitanja u filozofiji morala jest predstavljaju li moralni zahtjevi ujedno i razloge za djelovanje prema kojima se trebaju ravnati sve racionalne osobe. Prema jednoj koncepciji, moralni apsolutizam tvrdi da sve racionalne osobe imaju dovoljan razlog da poštuju moralne zahtjeve. Prema tom shvaćanju, moralni relativizam je tvrdnja da neće svi racionalni djelatnici imati dovoljan razlog da poštuju iste moralne zahtjeve. manje je istraženo pitanje što se događa ako pokušamo povezati filozofski naturalizam s pitanjem daju li moralni zahtjevi razloge (...) za djelovanje svim racionalnim djelatnicima. u ovom radu bavimo se potonjim pitanjem. neki autori smatraju da prihvaćanje filozofskog naturalizma nije važno za ovo pi- tanje. Drugi autori smatraju da filozofski naturalizam implicira relativizam u pogledu praktičnih razloga koji nije spojiv s moralnim apsolutizmom. u radu argumentiramo za to da su oba gledišta donekle ispravna. tvrdimo da ako se naturalizam shvati kao ontološka tvrdnja onda se možemo složiti s time da naturalizam ne igra ulogu u razrješenju debate između relativista i apsolutista. međutim, ako se naturalizam shvati kao metodološko gledište, onda smatramo da naturalizam podržava relativizam u pogledu praktičnih razloga, tj. ideju da moralni zahtjevi ne pružaju razloge za djelovanje svim racionalnim djelatnicima. Přibližně od druhé poloviny devadesátých let můžeme v sociálních vědách rozpoznat řadu tendencí, které nás opravňují hovořit o digitálním obratu v sociálněvědné praxi. Ačkoli důsledky digitalizace jsou pozorovatelné v mnoha oblastech sociálních věd, nejvýrazněji jsou zřejmě patrné ve znovuoživení očekávání spojovaných s tzv. dialogickým obratem a v diskusi rozpoutané kolem konceptu veřejné vědy. Vydání Galileova Hvězdného posla vyvolalo okamžitou reakci mnoha evropských učenců, s jednou důležitou výjimkou, kterou tvořili jezuitští matematici Římské koleje pod vedením uznávaného matematika Christophora Clavia. Cílem článku je prozkoumat možné důvody opožděné reakce římských jezuitů, kteří se k nebeským objevům vyjádřili více než rok po vydání Galileovy knihy. Existují důkazy nasvědčující tomu, že i když byli římští matematici nakloněni uznání novinek odhalených teleskopem, nástrojem, který ještě musel dokázat svou důvěryhodnost, byli omezeni přísnými pravidly, která měla za úkol udržet jednotu (...) jezuitského řádu. Stať se zabývá diskusemi o epistemologicko-metodologické roli simulací v soudobé vědě. Soustředí se nejprve na aktuálnost těchto diskusí v současné metodologii vědy a následně na její návaznost na určitou myšlenkovou tradici z osmdesátých let 20. století, kdy diskuse kolem modelování vyvolaly řadu otázek zpochybňujících tradiční pojmové distinkce, především mezi experimentem a teorií. Stať se přiklání v rámci těchto diskusí k názorům, které řadí simulace k novým a specifickým nástrojům vědy, jež také vyžadují novou a specifickou metodologii a epistemologické postavení. Pro (...) podporu této názorové pozice jsou uvedeny některé aktuální analýzy konkrétních příkladů simulací a jejich specifického postavení v moderní vědě. (shrink)

Ovaj rad se bavi metodološkim aspektima obnovljenih pravno-filozofskih nastojanja da se preispita pojam međunarodnog prava. Posle kratkog osvrta na istoriju pravne filozofije i ključne tačke Hartovog i Kelzenovog pozitivističkog stanovišta, u radu se dalje ispituje na koji način se savremene pravne teorije, kako u pozitivističkoj, tako i u ne-pozitivističkoj tradiciji, bave međunarodnim pravom. Poslednji deo rada predstavlja pokušaj da se skiciraju određene smernice za novi početak u filozofskoj obradi međunarodnog prava. Prvo, istorija rasprava u ovoj oblasti svedoči o tome (...) da su metodološki pravni teoretičari u pravu kada tvrde da nam utvrđivanje odgovarajućeg metoda pomaže u odgovoru na pitanje šta je pravo. Drugo, imajući na umu stalno promenjivu prirodu međunarodnog prava, odgovarajući metodološki pristup zahteva „evolucionarnu epistemologiju“ (D’Amato), koja teško da se može nazvati obeležjem analitičke jurisprudencije. Najzad, takva epistemologija je na kompleksan način povezana sa našim istraživanjem šta međunarodna pravda ili, bar, šta međunarodna „unutrašnja moralnost“ zahteva. (shrink)

Thomas Kuhn ve svých pozdějších pracích ostře napadá tzv. silný program sociologie vědění a důsledně se vůči němu vymezuje. Tato skutečnost je zajímavá z toho důvodu, že představitelé silného programu se naopak ke Kuhnovi otevřeně hlásí a vydatně čerpají z jeho díla, neboť v něm spatřují řadu klíčových myšlenek, které implikují možnost sociologické analýzy vědeckého poznání. Cílem této studie je kriticky přezkoumat Kuhnovu kritiku silného programu a zhodnotit její oprávněnost. V první části je za tímto účelem nejprve rekonstruováno Kuhnovo pojetí (...) silného programu, jež je posléze porovnáno s pracemi jeho zakladatelů Davida Bloora a Barryho Barnese, v nichž je silný program teoreticky rozvíjen. V další části jsou Kuhnovy argumenty proti silnému programu konfrontovány s vybranou historickou studií, v níž je silný program aplikován v praxi. Třetí část pak obrací pozornost ke Kuhnovu vlastnímu pojetí vědy, které je v ní porovnáno se silným programem právě v těch aspektech, jež na něm Kuhn kritizuje. (shrink)

Petrus Nigri (Schwarz) se narodil západočeské Kadani (něm. Kaaden) kolem roku 1435 a spolu se svými třemi bratry vstoupil v Německu do dominikánského řádu. Během svého studia prošel velkou část Evropy (Německo, Itálii, Španělsko, Čechy a Maďarsko) a nakonec se stal rektorem generálního studia v Budíně (1481). Obecně je znám spíše jako význačný středověký hebraista. Do dějin filosofie se zapsal zvláště jako autor Clipeus thomsitarum (před r. 1474), což je filosofický komentář na Porfýriův Úvod (Isagoge) a na aristotelovské Kategorie, formou (...) otázek. Třebaže Nigriho práce není originální, představuje v zaalpských zemích významnou recepci pojetí pomyslného jsoucna (Clipeus, část I, ot. 3-4) tak, jak ho koncipoval Hervaeus Natalis († 1323) ve svém traktátu De secundis intentionisbus. -/- Petrus Nigri (Peter Schwarz, born in Kadaň/Kaaden before 1435, died in Buda 1483), is author of Clipeus thomistarum (printed 1481), a philosophical commentary on Porphyry's Introduction (Isagoge), and on Aristotle's Categories in the form of questions. While Nigri's discussion of the concept of being of reason (Clipeus thomistarum, part I, qq. 3-4) is not original, his work is important for contributing to this concept’s reception, and with it the teaching of Hervaeus Natalis (died 1323) in his treatise De secundis intentionibus, in the transalpine countries. Being of reason (ens rationis) is conceived as not a categorial being, nor is it an intellectual operation, nor is it caused, but is only identifiable by the human intellect. Rad se bavi temom tiranije u Platonovoj filozofiji koja je neraskidivno vezana za Platonovu kritiku demokratije. Stoga, da bi se uopšte moglo govoriti o njegovoj kritici tiranije, u radu će biti prikazana i sva druga društvena uređenja koja on pominje i čija smjenjivanja bivaju odslikana kroz živopisnu paralelu smjene generacija. Izložiću njegov argument zašto su tiranin i tiranija u potpunom opozitu sa njegovom idealnom državom i kraljem filozofom, ali takođe i postaviti mnogobrojna ključna pitanja koja će u radu (...) biti podijeljena u pet cjelina. U prvoj i drugoj cjelini ću govoriti o onome što dovodi do same promjene društvenih uređenja u Platonovoj „Državi“, stavljajući akcenat na prelaz demokratije u tiraniju. U trećem dijelu biće prikazan dopadljivi početak tiranije, da bi potom u četvrtom dijelu bilo riječi o već sasvim uspostavljenoj tiraniji i onome što prof. dr Irina Deretić naziva „povlačenje logosa ili psihopatologija nepravednog tiranina“. Peti dio će poslužiti kao osvrt na razmišljanje o tome da tiranina možda treba i sažaljevati, kako i sam Sokrat govori, a zatim i razmatranje teze Čincia Aruze (engl. Cinzia Arruzza) da je Platonova kritika tiranije zapravo njegova kritika demokratije. (shrink)

Keith Donnellan wrote his paper on definite descriptions in 1966 at Cornell University, an environment where nearly everybody was discussing Wittgenstein’s ideas of meaning as use. However, his idea of different uses of definite descriptions became one of the fundamental tenets against descriptivism, which was considered one of the main legacies of the Frege–Russell– Wittgenstein view; and I wonder whether a more Wittgensteinian interpretation of Donnellan’s work is possible.

Romania and the United States of America share some history that is similar in many respects. Both states have struggled to gain their independence, their sovereignty, and historical recognition. That in which they have followed a different path was about the civilization pattern in which each of the two states was established. Filozofski vodič je stručna monografija namijenjena prvenstveno učenicima srednjih škola i studentima, koji se trebaju upustiti u pripremu ili maturskog rada ili pisanja seminarskog rada iz filozofije. Knjigu je recenzirao dr Predrag Krstić, istraživač saradnik na Institutu za filozofiju i društvenu teoriju Univerziteta u Beogradu i redovni profesor na Fakultetu za medije i komunikaciju Univerziteta Singidunum u Beogradu, sa iskustvom od trinaest godina u radu kao gimnazijski profesor filozofije, kao i prof. dr Miodrag Živanović redovni profesor u penziji Filozofskog (...) fakulteta Univerziteta u Banjoj Luci. This paper will reflect on the possibility of epistemic decolonization, particularly in terms of curriculum, as a transformative educational process in the context of the South African university, and with respect to my own positionality. The argument will centre around two difficult interdependent positions. On the one hand I will argue for the university’s task as transformational, even offering, via Cornel West, the ‘salvific’ possibility that knowledge offers those who seek it. To develop this claim, I will draw on (...) and develop the notion of paideia though the work of Plato and Heidegger.On the other hand, within the postcolonial African university, the question of decolonization in the tertiary space cannot be elided, particularly since the 2015 #RhodesMustFall and #FeesMustFall movements. The university is a powerful colonial relic, and it can be used to reinforce and perpetuate epistemic violence through unreflective or unconscious pedagogical and curriculum decisions. Here I draw on decolonial thinkers such as Santos, Mignolo, Maldonado-Torres, and Mbembe: I argue for a reckoning with the forces of coloniality, and advocate for epistemic justice and criticality, as part of the decolonizing project. In conclusion, working with ideas from Cornel West, I argue to reconcile paideia, as the ‘turning of the soul’, with the decolonizing African university. (shrink)

In his 1998 postscript to ‘The Possibility of Resurrection’ Peter van Inwagen argues that the scenario he describes by which God might resurrect a human organism, even though probably not true, is still conceivable and, consequently, ‘serves to establish a possibility’, namely, the metaphysical possibility of the resurrection of material beings. Van Inwagen, however, has also argued in favour of ‘modal scepticism’ [van Inwagen in, God, knowledge and mystery: essays in philosophical theology, Cornell University Press, Ithaca 1995b, pp. 11–12; van (...) Inwagen in, Philos Stud 92:67–84, 1998a]. That is, he thinks that we should limit all our claims about what is possible to ‘ordinary propositions about everyday matters’, 1998a). In this paper I argue that van Inwagen’s modal argument as found in ‘The Possibility of Resurrection’ is inconsistent with his modal scepticism as found in ‘Modal Epistemology’. In consequence, I argue that, given his modal scepticism, the task van Inwagen set himself in ‘The Possibility of Resurrection’ has not been achieved. (shrink)

Did the pragmatic turn encompass the linguistic turn in the history of philosophy? Or was the linguistic turn a turn away from pragmatism? Some commentators identify the so-called “eclipse” of pragmatism by analytic philosophy, especially during the Cold War era, as a turn away from pragmatist thinking. However, the historical evidence suggests that this narrative is little more than a myth. Pragmatism persisted, transforming into a more analytic variety under the influence of Quine and Putnam and, more recently, a continental (...) version in the hands of Richard Rorty and Cornel West. In this paper, I argue that proof of the linguistic turn’s presence as a moment in a broader pragmatic turn in philosophy can be garnered from close examination of a single article, W. V. O. Quine’s “Two Dogmas of Empiricism,” and a single issue: whether the analytic-synthetic distinction is philosophically defensible. (shrink)

Kate A. Manne is an associate professor at the Sage School of Philosophy at Cornell University, where she has been teaching since 2013. Before that, she was a junior fellow at the Harvard Society of Fellows (2011–2013), did her graduate work at MIT (2006–2011), and was an undergraduate at the University of Melbourne (2001–2005), where she studied philosophy, logic, and computer science. Her current research is primarily in moral, feminist, and social philosophy. She is the author of two books, including (...) her first book Down Girl: The Logic of Misogyny and her latest book Entitled: How Male Privilege Hurts Women. Kako u svakodnevnom životu, tako i u pravu većinu ljudi smatramo odgovornim za postupke pretpostavljajući da su to njihovi postupci u smislu da nad njima imaju kontrolu. Pretpostavka koja dominira tradicionalnim filozofskim raspravama o moralnoj odgovornosti i teorijama kazne jeste da se osoba smatra moralno (pravno) odgovornom za počinjeni postupak ako taj postupak zavisi od nje na takav način da bi zaslužila osudu (kaznu) odnosno pohvalu (nagradu). Izazov koji prirodne nauke postavljaju pred ovakvo razumevanje moralne odgovornosti ne zaustavlja se na (...) klasičnoj mehanici već svoj novi, kompleksniji oblik zadobija pojavom kvantne mehanike, ali i razvojem neuronauke i psihologije. Relevantnost istraživanja prirodnih nauka za filozofske probleme objašnjavamo činjenicom da su drugu polovinu XX veka obeležila naturalistička metafizička i epistemološka nastojanja. Na ovaj način je otvoreno novo poglavlje odnosa filozofije i prirodnih nauka, a mi ga u ovom radu ispitujemo kroz razmatranje problema kompatibilnosti determinizma i moralne odgovornosti. Cilj rada je da ispitivanjem kako empirijskih argumenata kojima se u pitanje dovodi moralna odgovornost, tako i filozofskih argumenata koji figuriraju u ovim diskusijama ukažemo da rezultati naučnih istraživanja mogu biti plodonosni u kontekstu rasprava o slobodi volje, moralne odgovornosti i teorija kazne, isključivo ako na adekvatan način komuniciraju sa rezultatima filozofskih istraživanja zasnovanim na primeni filozofskih metoda poput metoda pojmovne analize. Any treatment of the relationship between pragmatism and politics would be incomplete without considering the multiple areas in which pragmatist thought and political studies intersect. Extensive scholarly work on pragmatism and politics can be found in the broad literature on political science, democratic theory, global political theory, public administration, and public policy. To a lesser extent, scholarship employing a pragmatist approach can be found in other subfields of political studies, including American politics and international relations. Unfortunately, the few works in (...) these subfi elds tend to appeal to a generic form of pragmatism (e.g., pragmatism as brute instrumentalism or pragmatism as vicious opportunism), not the robust version associated with classic and contemporary philosophical pragmatism.1 Most works on classic pragmatism and politics draw heavily on John Dewey’s political writings. Pragmatism’s two other founders remained relatively silent on the subject; in Robert Talisse’s words, “neither [Charles Sanders] Peirce nor [William] James wrote systematically about politics.” Neo-pragmatist treatments of politics can be found in the works of the late Richard Rorty, Cornell West, and Richard Posner. Mogućnost samouništenja čovečanstva čini stalnu prateću temu u svim knjigama Svetozara Stojanovića napisanim posle njegovog doktorata o metaetici. Kakve god da su teme inače obrađivane, našlo bi se ponešto i o ovome, isprva kao usputno zapažanje i mogući ugao gledanja na glavnu temu, a kasnije, sve više kao posebna oblast razmatranja ili čak kao vodeća perspektiva. U ovom radu rekonstruišem Stojanovićevo tretiranje ove teme. Pošto je kod Stojanovića reč o apokalipsi u sekularnom smislu, ja za nju predlažem, u otvorenoj (...) protivrečnosti sa izvornim značenjem reči, izraz apokalipsa bez otkrivenja. Reč je o apokalipsi u kojoj je preostao samo još kataklizmički aspekt, i utoliko ovaj izraz dobro sledi Stojanovićeve izvorne intencije. U radu izlažem i komentarišem sve faze Stojanovićevog rada na ovoj temi tvrdeći da ona čini jedinu konstantu u filozofskim i političkim menama njegovog mišljenja. (shrink)

Kierkegaardovo misaono nadahnuće motivirano je dvama nezadovoljstvima: prvo se tiče spekulativne filozofije i njezine nemogućnosti da zahvati zbiljnost pojedinca u njegovoj egzistencijalnoj danosti, a drugo se tiče građansko-kršćanskog svijeta njegova doba koji je u rasulu i gdje je »individua« posve dokinuta prevlašću »gomile«. Kako postati samim sobom, »jedan jedini«, odnosno »individua« , pitanje je koje Kierkegaard postavlja u središte svog filozofskog interesa. Put od običnog opstanka do zbiljskog egzistiranja, odnosno od »gomile« do »individue« ostvaruje se kroz tri stadija. To su (...) estetski, etički i religiozni stadij egzistiranja. U ovom se radu analiziraju njihovi ključni konstituensi i suodnos iščitavanjem primarno tri Kierkegaardova djela: Ili-ili, Bolest na smrt, Strah i drhtanje. I dok je odnos između estetskog i etičkog stadija dijalektički, religiozno stoji naspram estetskog i etičkog u naddijalektičkom odnosu. Taj se nad-dijalektički odnos pokazuje ključnim za interpretaciju Kierkegaardova mišljenja. -/- Kierkegaard’s philosophical inspiration was motivated by two displeasures: The first one concerns speculative philosophy and its incapability to grasp the reality of an individual in their existential givenness, and the second one has to do with the contemporary bourgeois-Christian world that had been falling apart and in which the “individual” was quite abrogated by the domination of the “crowd”. How to become one’s self, “unique”, or an “individual”, is the question Kierkegaard places into the center of his philosophical interest. The path from a common survival to a real existence, i. e., from the “crowd” to the “ndividual” is realized in three stages, through the esthetic, ethical, and the religious stages of exiastence. This paper analyzes their key constituents and their interrelation with an analysis of thre of Kierkegaard’s works: Either/Or, The Sickness unto Death, and Fear and Trembling. While the relation between the esthetic and ethical stages is a dialectical one, the religious is in a supradialectical relation to the esthetic and the ethical. This supradialectical relation is the key to the interpretation of Kierkegaard’s thought. (shrink)

The book opens by describing the author's life-changing encounter with a Zen Buddhist monk in 1977, over a cup of tea. Returning to his beginnings, Goodman recounts his coming-of-age, from participating the 1960’s U.S. protests and Vietnam-War resistance, to finally settling down in Canada. He describes his role in a supporting, silent vigil (...) around Willard Straight Hall at Cornell University, the night after it had been occupied by protestors, and his later application for Conscientious Objector status, following the U.S. draft lottery in 1969. He reflects on the challenges and changes on his road taken, in his career and personal relationships, and in spiritual searches, to share some insights about the seamless nature of chance, and about seeing a Both/And perspective in life that encourages openness to possibilities. -/- .
