The article explores novel directions in the phenomenology of economics. It analyzes how the approaches of Till Düppe and Alfred Schütz, both inspired by Edmund Husserl, may shed light on the historical development of economics. I examine the substance and meaning of economics in the context of the forceful criticism of the whole discipline recently raised by Düppe. This examination uncovers important weaknesses and omissions inherent in Düppe’s argument against the economists’ scientific aspirations. The analysis of the social scientific endeavors (...) by Alfred Schütz who develops a phenomenologically informed ‘telescopic’ concept of an ideal type is then shown to be a more fruitful and methodologically rigorous way towards understanding the developments within economics. The Schützian view permits us to see how abstract economic models originate in the experience of the life-world and are continuous with it. Accordingly, the historical development of economic science may be viewed as consisting from two broadly defined phases, where at first the formalism is steadily increasing (the ‘zooming out’ phase) and later the discipline converges back to context-specific empirical examinations (the ‘zooming in’ phase). A case study concentrating on the economic theory of politics illustrates that both the drive towards abstraction that has culminated around 1950s and the more recent ‘zooming in’ is methodologically legitimate from the phenomenological point of view. I conclude that economics has never been completely severed from the paramount reality of the everyday life and for decades the interconnection has been growing stronger by the day. (shrink)

This chapter provides a historical reconstruction of how Alfred Schutz’s American writings were critically engaged by the feminist sociologists Dorothy E. Smith and Patricia Hill Collins. Schutz’s articulation of a phenomenological sociology in relation to, among others, the sociology of Talcott Parsons and the philosophies of science of Ernest Nagel and Carl G. Hempel proved fruitful to Smith in the development of her feminist standpoint theory in her 1987 The Everyday World as Problematic: A Feminist Sociology. Collins likewise (...) draws on Schutz’s writing in the development of her own standpoint theory in her 1986 paper “Learning from the Outsider Within: The Sociological Significance of Black Feminist Thought,” but in a way that addresses some of her own concerns with Smith’s feminist sociology. As I hope to show with the recovery of this underappreciated history, the critical insights of Smith and Collins with regard to the possible uses and limits of phenomenology for feminist theorizing, are still valuable today. This paper focuses on the concept of symbol and tries to outline its function as a means of communication. In order to describe the communicative qualities of symbol, it is necessary to show its ethical nature. The paper analyses the role symbols play in intersubjective relations, in the construction of the individual’s reality, and in the human ability to attribute meanings and assign functions.The conceptual frame- work for the understanding of what symbol is, how it works, and how it is (...) made is a particular combination of phenomenology and pragmatism, which lies on the theory of ‘appresentation’, as we can find it in Alfred Schütz’s viewpoint. This work is a critical introduction to Alfred Schutz’s sociology of the multiple reality and an enterprise that seeks to reassess and reconstruct the Schutzian project. In the first part of the study, I inquire into Schutz’s biographical con- text that surrounds the germination of this conception and I analyse the main texts of Schutz where he has dealt directly with ‘finite provinces of meaning.’ On the basis of this analysis, I suggest and discuss, in Part II, (...) several solutions to the shortcomings of the theoretical system that Schutz drew upon the sociological problem of multiple reality. Specifically, I discuss problems related to the struc- ture, the dynamics, and the interrelationing of finite provinces of meaning as well as the way they relate to the questions of narrativity, experience, space, time, and identity. Menschenrechtsverletzungen aufgrund sexueller Orientierung und Geschlechtsidentität (SOGI) wurden auf internationaler Ebene lange Zeit kaum zur Kenntnis genommen. Doch seit einigen Jahren wird dem Thema in den Vereinten Nationen breiterer Raum eingeräumt. Die Yogyakarta-Prinzipien und eine Studie des Amtes des Hohen Kommissars für Menschenrechte stellen nur die ersten Schritte auf dem Weg zu einem umfassenderen Schutzansatz dar. Er muss gegen den Widerstand vieler Staaten weiterverfolgt werden.

Previous work in Game Studies has centered on several loci of investigation in seeking to understand virtual gameworlds. First, researchers have scrutinized the concept of the virtual world itself and how it relates to the idea of “the magic circle”. Second, the field has outlined various forms of experienced “presence”. Third, scholarship has noted that the boundaries between the world of everyday life and virtual worlds are porous, and that this fosters a multiplicity of identities as players identify both with (...) themselves-offline and themselves-in-game. Despite widespread agreement that these topics are targets for research, so far those working on these topics do not have mutually agreed-upon framework. Here we draw upon the work of Alfred Schutz to take up this call. We provide a phenomenological framework which can be used to describe the phenomena of interest to Game Studies, as well as open new avenues of inquiry, in a way acceptable and useful to all. This helps to distinguish the core of the field from the supplemental theoretical and critical commitments which characterize diverse approaches within the field. (shrink)

It is a widely held view that lying is defined in the traditional tripartite model as the conjunction of a statement, the false belief, and the intended deception. Much of the criticisms have been levelled at the third condition—intended deception—with contemporary counterexamples. My main criticism of the traditional and contemporary model of lying centres on that philosophers discard the social existence of the hearer. Schutz‘s phenomenological sociology gives a sheer inspiration to redefine the third condition by taking the hearer (...) as a consciously social being into account. Lying should be an intersubjective action for the Other from the perspective of the liar; it might be, thus, reasonable to assume that there should be commonsense awareness between the speaker and the hearer. This paper, by focusing on this commonsenseness and its typifications, introduces a new approach to the third condition: S must intend that H be induced to believe that p, where p is false. In this regard, once you lie, by being subjected to the taken-for-granted commonsenseness in our daily life, you must try as hard as possible to succeed in deceiving the hearer by stating that p. You, as a typical person, tell a typical lie in typical contexts for typical Others. The focus of attention, therefore, is on the hearer and it is the key to understanding that mere intent to deceive is too broad and unpragmatic for a social human being who always intends to flee the negative consequences of the context in which she has to lie. Making the extension narrower necessitates a new term, anti-social bullshit generally being replied rhetorically as "how can you expect me to believe that?" comprises the excluded cases. (shrink)

This article is a study on Paul’s mystical experiences using an interpretive framework that relies on multiple grounds: Alfred Schutz’s phenomenology of the “multiple realities” applied to the problem of religion, political anthropology and general scholarship on Paul. The aim of this study is also multiple: I seek to draw an interpretive insight into those mystical experiences that have been traditionally attributed to Paul by using a hermeneutic lens provided by Schutzian phenomenology, to clarify this hermeneutic method as such (...) and explore its interpretive potential for the phenomenology of religion in general, and to interpret the results of this analysis from the reflexive-historical perspective of political anthropology. The Gathas, a corpus of seventeen poems in Old Avestan composed by the ancient Iranian poet-priest Zarathushtra (Zoroaster) ca. 1200 B.C.E., is the foundation document of Zoroastrian religion. Even though the dualistic axiology of the Gathas has been widely noted, it has proved very difficult to understand the meaning and genre of the corpus or the position of Zarathushtra’s ideas with regard to other religious philosophies. Relying on recent advances in translation and decryptions of Gathic poetry, I shall here develop (...) a philosophical interpretation of the Gathas, including, as shall be discussed here in detail, explication of the revelation he reports in the poem known as Yasna 30. I argue that, similarly to Marx, Henry, and Schutz, Zarathushtra connects social criticism with an original philosophy of (inter)subjectivity and existential reflection, placing his account in the context of a fully developed metaphysics which includes the human-divine sharing of mental properties. I show that in order to accommodate this complicated problematic, Zarathushtra uses the vehicle of multiple realities. Reflecting the spontaneity of life, the dynamics of various ontological modes in the text create a reference to subjectivity. A description of the dream in Yasna 30 is sufficiently within the limits of possibility for a dream experience, and thereby delivers three original phenomenological reductions. The reductions initiate a genetic account of the phenomenalization of invisible impulses which give rise to moral choices, and define the human-divine relationship. The opposing moral choices open into a reverse axiological intentionality in the sphere of intersubjectivity, and are said to plot life for the rightful and lifelessness for the wrongful. It can be concluded that Zarathushtra’s theism and views of the social world are “the first philosophy”, with a unique and original phenomenological ontology of intersubjectivity at its core. The aim of this paper is to argue in favor of the idea that it is possible not only to give a special place to reason in our life and in society, but also to offer an integrative rational framework, in in which human ends and goals find their rational expression. The text has three parts. The first describes Alfred Schutz's practical-hermeneutical approach to law and normativity, while making room for a subjective practice of reason. The second proposes to (...) reveal, through the description of knowledge in the world of ordinary life, a form of rationality which offers us practical but consistent ways of making a decision. Ultimately, the third aims at the practical-hermeneutical reconstruction of the law, in order to integrate into the core of legal reasoning references to ends and purposes without prejudicing the objectivity of the reasoning itself. The study aims to make a contribution to the problem of dedifferentiation and positivism of practice in the modern world. Le but de ce papier est d’argumenter en la faveur de l’idée qu’il est possible non seulement de donner une place particulière à la raison dans notre vie et dans la société, mais aussi d’offrir un cadre rationnel intégratif, dans lequel les fins et buts humains trouvent leur expression rationnelle. Le texte comporte trois parties. La première décrit l’approche pratique-herméneutique d’Alfred Schutz à l’égard de la loi et de la normativité, tout en faisant place à une pratique subjective de la raison. La deuxième se propose de dévoiler, à travers la description de la connaissance dans le monde de la vie ordinaire, une forme de rationalité qui nous offre des voies pratiques mais consistantes de prendre une décision. En fin de compte, la troisième vise la reconstruction pratique-herméneutique de la loi, afin d’intégrer dans le noyau du raisonnement légal des références à des fins et buts sans porter préjudice à l’objectivité du raisonnement lui-même. The development of nuclear energy technologies in the second half of the 20th century came with great hopes of rebuilding nations recovering from the devasta-tion of the Second World War or recently released from colonial rule. In coun-tries like France, India, the USA, Canada, Russia, and the United Kingdom, nuclear energy became the symbol of development towards a modern and technologically advanced future. However, after more than six decades of experi-ence with nuclear energy production, and in the aftermath of the (...) Fukushima nuclear disaster, it is safe to say that nuclear energy production is not without its problems.Some of these problems have their origins in the very materiality of the technolo-gies involved. For example, not only does the use of highly radioactive materials give rise to risks for the current generation (e.g., in the potential for disaster when reactors melt down) but high-level radioactive waste from nuclear energy production presents a serious intergenerational problem for which an acceptable final solution or its implementation remains elusive. Moreover, nuclear energy technologies have specific social and political consequences. For example, they have been said to be authoritarian technologies (Winner, 1980), requiring cen-tralized authority, secrecy, and technocratic decision-making. While some of these problems could have been foreseen before nuclear energy technologies were introduced, others only arose after these technologies were already integrated into the social and infrastructural fabric of our lives. Addition-ally, new technologies (e.g., Generation III, III+ and IV reactors) are still being developed, bringing with them new and uncertain hazards and risks. Ignorance and uncertainty about the possible deleterious effects of introducing a new technology are inevitable, especially if the technology is complex, large time-scales are involved, or risks depend on social or political factors unforeseen in the design stage. However, this should not deter us from developing and intro-ducing new technologies. Rather, it should motivate us to organize these ‘exper-iments’ with new technologies in society in such a way that we can learn about their possible hazards and risks as effectively and responsibly as possible (van de Poel, 2011, 2015). In this way, it is possible to minimize risks and avoid unwant-ed moral, social or political developments. However, organizing such experi-ments responsibly also means that one could come to the conclusion that continuing an experiment is no longer responsible or desirable. Should we be prepared for such a scenario, and if so, how could we do that? One possible strategy to tackle this issue is that the technology and its introduction should be reversible. The aim of this thesis is to further explore this strategy by answering the following main research question (RQ) and accompanying subquestions (SQ):RQ: What are the implications of reversibility for the responsible develop-ment and implementation of nuclear energy technologies?SQ1: Under what conditions can nuclear energy technologies be considered reversible?SQ2: Why should nuclear energy technologies be reversible?SQ3: If so, how could the reversibility of nuclear energy technologies be achieved?After the introductory chapter 1, the chapters that form the main body of this dissertation each provide a distinct contribution to answering the three subques-tions and, by extension, the main research question. Guided by three historical case studies of nuclear energy technology development (i.e., India, France and the USA), chapter 2 answers the first subquestion by formulating the two condi-tions under which it can be considered reversible, i.e., 1) the ability to stop the further development and deployment of a that technology in society, and 2) the ability to undo the undesirable outcomes (material, institutional or symbolic) of the development and deployment of the technology. Chapter 3 subsequently tackles the second subquestion by establishing the general desirability of technological reversibility by virtue of its relation to responsibility in Emmanuel Levinas’ ethical phenomenology. It argues that technology development is a legitimate response to responsibility but inevitably falls short of the responsibility that inspires it, incessantly calling for technological and political change in the process. Having thus argued that nuclear energy technologies should ideally be reversible, chap-ters 4 and 5 work towards specific strategies to achieve technological reversibil-ity. Chapter 4 first investigates the processes that make it difficult to stop the further development and implementation of a nuclear energy technology in society, thus provid-ing input on how to fulfill the first condition for the reversibility of nuclear energy technologies. To do so, it presents a phenomenological perspective on technology and its adoption based on the work of Alfred Schutz. It also explores different ways in which technology adoption drives the processes of path depend-ence towards technological lock-in. Chapter 5 examines the history of geological disposal of high-level radioactive waste in the USA. It identifies a number of concrete policy pitfalls that could lead to lock-in and that should consequently be avoided. It also presents a number of general design strategies that could facilitate the undoing of undesirable consequences of a technology, thus providing input on how to fulfill the second condition for the reversibility of nuclear energy technol-ogies.Chapter 6 summarizes the central findings of the thesis and explains how these help to answer the research questions. On top of this, it reflects on a number of complications connected to reversibility considerations. Based on this, it is concluded that the question of irreversibility and reversibility is context- and technology-specific and a matter of degree. The chapter concludes with a reflec-tion on generalizations and limitations of the results. Finally, chapter 7 discusses the implications of this dissertation’s results for responsibly experimenting with nuclear energy technologies in society. (shrink)

In his pioneering sociological theory, which makes phenomenological concepts fruitful for the social sciences, Alfred Schütz has laid foundations for a characterization of an manifold of distinct domains of experience. My aim here is to further develop this pluralist theory of experience by buttressing and extending the elements of diversity that it includes, and by eliminating or minimizing lingering imbalances among the domains of experience. After a critical discussion of the criterion-catalogue Schütz develops for the purpose of characterizing different cognitive (...) styles, I move on to examine its application to one special style, the lifeworld. I appeal, on the one hand, to Husserl's characterization of the lifeworld as a world of perception, and on the other hand to the layer-model of the lifeworld developed by Schütz and Thomas Luckmann. A consequence of this approach is that the lifeworld appears as a socially definable context that is detached from other experiences but on an equal footing with them with respect to their claim of validity. The term "lifeworld" does not denote a category that encompasses culture or nature but refers to a delimited action-space. Finally, I draw upon Schütz' s criterion-catalogue to characterize two domains of experience outside of the lifeworld, which play a central role for the process of differentiation of experience in modernity and for the phenomenological analysis of types of experience: experimental science and subjectivity. Als Vertreter der historischen Anthropologie hat Christoph Wulf die philosophische Anthropologie von Max Scheler, Helmuth Plessner und Arnold Gehlen kritisiert: Mit ihrem Interesse an einer einheitlichen Bestimmung des Menschen entgehe ihr die Pluralität von menschlichen Kulturen. Meiner Auffassung nach stellt diese Kritik für die philosophische Lehre vom Menschen eine Herausforderung dar (1.). Um ihr zu begegnen, möchte ich prüfen, ob Ernst Cassirers Kulturphilosophie die Vielfalt menschlicher Erfahrungsweisen angemessener berücksichtigt. Dass dies nicht in hinreichendem Umfang der Fall ist, lässt sich auf (...) eine bei Cassirer vorherrschende Einheitsorientierung zurückführen, die bezeichnende Berührungspunkte zu Hegels Idealismus aufweist. Der von Kant über Hegel zu Cassirer führende philosophische Diskurs über den Menschen hat zwar der Thematisierung einer irreduziblen Erfahrungspluralität zunehmend Raum verschafft, ist aber zugleich auf eine einheitliche Verfassung des Geistes bezogen geblieben (2.). Will die philosophische Anthropologie der kulturellen Vielfalt gerechter werden, muss sie über Cassirers Ansatz hinausgehen und ihre Fokussierung auf eine die menschliche Welt durchdringende Bestimmung des Geistes weiter abschwächen, wenn nicht sogar aufgeben. Als einen hierfür förderlichen Ausgangspunkt, betrachte ich die Sozialphänomenologie von Alfred Schütz. Sie erlaubt die Begründung einer nicht hierarchisch strukturierten Pluralität der Erfahrung. Im Anschluss an Schütz' Konzeption muss der Philosophie mit ihrem legitimen Interesse an dem Menschen nicht die Vielfalt der Menschen abhanden kommen. Pluralität ist dem Menschen vielmehr als Bestimmung eingeschrieben (3.). (shrink)

Denn kein Frieden kann von Dauer sein, in dem ein solcher Schutz nicht gewährleistet wird und in dem sich Menschen vor anderen Menschen fürchten müssen. Dies gilt umso mehr für eine Auffassung des gerechten Friedens, die nicht nur vor Gewalt, sondern auch vor Not zu schützen beansprucht. Games Studies reveals the performative nature of playing a character in a virtual-game-world (Nitsche 2008, p.205; Pearce 2006, p.1; Taylor 2002, p.48). Tbe Player/Character relationship is typically understood in terms of the player’s in-game “presence” (Boellstorff 2008, p.89; Schroeder 2002, p.6). This gives the appearance that living-into a game-world is an all-or- nothing affair: either the player is “present” in the game-world, or they are not. I argue that, in fact, a constitutive phenomenology reveals the Player/Character relationship to be a (...) multi-dimensional matter of empathy. I advance a broadly Schutzian framework, drawing on his 1932 discussions of “face-to-face encounters” and ”historical predecessors,” showing how at- tention to empathy reveals a variety of “presences” that different kinds of Player/Character relationships afford. The central determinants of empathetic affordances which I focus on here are (i) how much players know about a character (especially the character’s past) and (ii) how players learn this information.The purpose of this discussion will be to show that a phenomenological analysis reveals that the relationship between a player and their character is complex, highly variable, and inherently social. Furthermore, it will add to the growing body of scholarship that demonstrates that video games are rich social objects deserving of study. (shrink)

Recent years have seen a burgeoning in phenomenological research on sport, physical cultures and exercise. As editors and reviewers, however, we frequently and consistently see social science articles that claim to be ‘phenomenological’ or to use phenomenology, but the reasons for such claims are not always evident. Indeed, on closer reading, many such claims can often turn out to be highly problematic. At this point, we should clarify that our ‘terrain de sport’ constitutes what has been termed ‘empirical phenomenology’ (Martínková (...) & Parry, 2011) and more specifically from our own ‘home’ discipline, a phenomenologically inspired form of sociology. This latter tradition was developed in North America by Alfred Schütz (1972). By this, we do not mean philosophical phenomenology in all its rich and varied strands, the modern form of which was inspired by Edmund Husserl’s (1913/2002) descriptive and/or transcendental phenomenology. The term itself is derived from the Greek phainomenon, from the root phôs, meaning ‘light’, thus referring to something that is placed in the light, made apparent or shown. Phenomenology is therefore the study of phenomena, things as they present themselves to, and are perceived in consciousness. Importantly, it is not just another form of qualitative research; a point which we discuss later. (shrink)

What kinds of mental states can be based on epistemic reasons? The standard answer is only beliefs. I argue that perceptual states can also be based on reasons, as the result of crossmodal interactions. A perceptual state from one modality can provide a reason on which an experience in another modality is based. My argument identifies key markers of the basing relation and locates them in the crossmodal Marimba Illusion (Schutz & Kubovy 2009). The subject’s auditory experience of musical (...) tone duration is based on the reason provided by her visual representation of the length of the musician’s gesture and other stored perceptual principles. Das deutsche Gesundheitswesen steht durch die schnell steigende Anzahl an CO- VID-19-Erkrankten vor erheblichen Herausforderungen. In dieser Krisensituation sind alle Beteiligten mit ethischen Fragen konfrontiert, beispielsweise nach gerech- ten Verteilungskriterien bei begrenzten Ressourcen und dem gesundheitlichen Schutz des Personals angesichts einer bisher nicht therapierbaren Erkrankung. Daher werden schon jetzt klinische und ambulante Ethikberatungsangebote verstärkt mit Anfragen nach Unterstützung konfrontiert. Wie können Ethikberater*innen Entscheidungen in der Krankenversorgung im Rahmen der COVID-19-Pandemie unterstützen? Welche Grenzen von Ethikberatung sind zu beachten? Bislang liegen (...) hierzu noch wenige praktische Erfahrungen vor. Angesichts der dynamischen Entwicklung erscheint es der Akademie für Ethik in der Medizin (AEM) wichtig, einen Diskurs über die angemessene Rolle der Ethikberatung bei der Bewältigung der vielfachen Heraus- forderungen durch die COVID-19-Pandemie zu führen und professionelle Hinweise zu geben. Mit dem vorliegenden Diskussionspapier möchte die AEM einen Beitrag zur Beantwortung wesentlicher Fragen leisten, die sich für die Ethikberatung in den verschiedenen Bereichen des Gesundheitswesens stellen. Sie regt an, diesen Dis- kurs weiter zu führen und hat ein Online-Forum (s. unten) eingerichtet, in dem Ethikberater*innen ihre Erfahrungen teilen und die professionelle Selbstreflexion der Ethikberatung in Pandemiezeiten mit Anregungen fördern können. In this paper, I reference a Paradigm Case Core Conception of Violence, which each individual has, and can share with others to various degrees. This is shown to imply that because we cannot get at violence itself, and can only interpret violence in relationships that involve humans, we cannot avoid politicizing our conceptions of violence in our empathic, intersubjective relationships. This is demonstrated by outlining various claims concerning violence, and by utilizing Edith Stein's phenomenological account on empathy and intersubjectivity, and (...) Suppose that you are at a live jazz show. The drummer begins a solo. You see the cymbal jolt and you hear the clang. But in addition seeing the cymbal jolt and hearing the clang, you are also aware that the jolt and the clang are part of the same event. Casey O’Callaghan (forthcoming) calls this awareness “intermodal feature binding awareness.” Psychologists have long assumed that multimodal perceptions such as this one are the result of a subpersonal feature binding mechanism (...) (see Vatakis and Spence, 2007, Kubovy and Schutz, 2010, Pourtois et al., 2000, and Navarra et al., 2012). I present new evidence against this. I argue that there is no automatic feature binding mechanism that couples features like the jolt and the clang together. Instead, when you experience the jolt and the clang as part of the same event, this is the result of an associative learning process. The cymbal’s jolt and the clang are best understood as a single learned perceptual unit, rather than as automatically bound. I outline the specific learning process in perception called “unitization,” whereby we come to “chunk” the world into multimodal units. Unitization has never before been applied to multimodal cases. Yet I argue that this learning process can do the same work that intermodal binding would do, and that this issue has important philosophical implications. Specifically, whether we take multimodal cases to involve a binding mechanism or an associative process will have impact on philosophical issues from Molyneux’s question to the question of how active or passive we consider perception to be. An axiological analysis of the basis of the 1997 Constitution of the Republic of Poland, determined mainly in the Preamble, makes it possible to put forward a thesis that this axiology is not, at least in reference to the principle, eclectic. In respect of the meta-axiological settlements, this is a tradition of natural-law type, recognizing the objective grounding of values and law. The accepted solutions are also convergent with the axiology typical of the international protection of human rights. -/- Résumé (...) L’analyse des fondements axiologiques de la Constitution polonaise de 1997, inscrits avant tout dans le préambule, permet de formuler la thèse selon laquelle cette axiologie n’est pas, en principe, éclectique. La réflexion sur les valeurs s’inscrit dans la vision classique des fondements du droit, remontant à l’antiquité. Partant de là, se dégage une tradition juridique appuyée sur le droit naturel, reconnaissant la force objective des valeurs et du droit. Ces conclusions rejoignent l’axiologie classique de la protection internationale des droits de l’Homme. -/- Zusammenfassung Die Analyse der vor allem durch die Präambel definierten axiologischen Grundlagen der Verfassung der Republik Polen von 1997 ermöglicht die Aufstellung der These, dass diese Axiologie nicht eklektisch ist, zumindest nicht prinzipiell. Hier enthüllt sich ein Denken von den Werten, das sich in die klassische, bis in die Antike zurückreichende Reflexion über die Grundlagen des Rechts einfügt. Wegen der metaaxiologischen Entscheidungen ist das eine Tradition naturrechtlichen Typs, die die objektive Begründung der Werte und des Rechts anerkennt. The study analyzes Mises‘s approach to the question of apriorism in a broader methodological context. It shows that it is not inevitable to advocate the aprioristic character of economics (resp. science of human action), as Mises does, to maintain the subjectivist-individualist methodology and the effort to adequately grasp the general laws of human action from its perspective. The present redefinition of apriorism is developed on the basis of thoughts of Barry Smith and Alfred Schutz. It suggests abandoning the apodictic (...) character of apriori (which is untenable) and move closer to a broadly defined empiricism. The methodological insights developed in the paper are finally used to contribute to the debate between the behavioral economists and the proponents of rational choice theory. (shrink)

Dieter Schmidtchen hat mein institutionenökonomisch-evolutionäres Wettbewerbsleitbild einer kritischen Würdigung unterzogen. In dieser Replik werden drei Arten von Argumenten zugunsten meines Wettbewerbsleitbildes vorgetragen. Zunächst wird mit Hilfe von wissenschaftstheoretischen Argumenten gezeigt, dass die Konkurrenz von Erkenntnisprogrammen auch im Fall der Wettbewerbstheorie durchaus wünscheswert ist. Dann werden die normativen Grundlagen des Leitbildes erläutert und gezeigt, wie das Prinzip der kritischen Prüfung zum Tragen kommt. Schließlich wird für eine regelgeleitete Wettbewerbspolitik plädiert, die den Schutz des Wettbewerbs als minimalistisches Ziel anstrebt.

This article explores the relationship between the bodily presence of other humans in the lived urban world and the experience of everyday architecture. We suggest, from the perspectives of phenomenology and architecture, that being in the company of others changes the way the built environment appears to subjects, and that this enables us to perform simple daily tasks while still attending to the built environment. Our analysis shows that in mundane urban settings attending to the environment involves a unique attentional (...) mode, which does not rely on concentrating on, or appreciating the architectural objects, but rather on social attention and on the subject’s kinesthesis in relation to the built environment. of “Reason and the structure of Davidson’s ‘Desire-Belief-Model’ ” by Henk bij de Weg In the present discussion in the analytic theory of action, broadly two models for the explanation or justification of actions can be distinguished: the internalist and the externalist model. Against this background, I discuss Davidson’s version of the internalist Desire-Belief Model . First, I show that what Davidson calls “pro attitude” has two distinct meanings. An implication of this is that Davidson’s DBM actually comprises two different (...) models: the “classical” DBM and a model that has an extra premise, the “nonclassical” model. However, from another point of view one can say that the classical DBM is the nonclassical model in which a premise is missing. In order to determine which viewpoint is correct, I introduce Schütz’s distinction between “because-motives” and “in-order-to-motives”. With the help of this distinction, I can show that the classical DBM is an incomplete version of the nonclassical model. Besides of the premise that refers to the agent’s pro attitude, we need this extra premise in order to refer to the occasion as experienced by the agent that makes him or her act. This essay wants to rescue the concept of phaneroscopy, created by Charles Sanders Peirce, to adapt it in a phenomenological condition of multiple realities. Therefore, in addition to review the reflection of Peirce, we visited the approach of phenomenology of multiple realities proposed by Alfred Schutz in his reading of William James. The idea is to seek a phenomenology that goes beyond the human consciousness to other research subjects.

Moral value as it was understood by Nicolai Hartmann and by Max Scheler belongs uniquely to volitions or willings, to dispositions to will and to persons as beings capable of willing. Moreover, as understood in this paper as well as by Hartmann, Scheler, and Husserl, every volition necessarily involves if not actual valuings then reference to retained valuings and potential valuings as well as to cognitive mental phenomena. As used here, the terms 'volition' and 'willing' denote mental traits, such as (...) lived experiences and habits insofar as they either do or can occur actively. A trait of a mind or "monad" can have moral value — in contrast to utility, for example — only (would belong) insofar as it is or can be or could have been engaged in and so performed by the person or ego to whose mind the trait belongs . The classification of lived experiences as voluntary or not voluntary cuts across the three-fold classification of mental processes as cognitive, affective, or conative. This seems to be the most appropriate way of distinguishing the voluntary from the involuntary. Voluntary mental phenomena are characterized by the engagement of the ego in some lived experience occurring in the flux of its lived experiences, i.e., by taking position. Dark Tourism represents the intersection of reflections on mortality with the commodification and consumption of death as a tourist experience. It is a complex and contested concept that has been approached from a variety of theoretical standpoints. In this paper, I suggest that a phenomenological analysis of the experiences of those who engage in dark tourism can provide a means of approaching the subject that can both accommodate the diversity of experiences sought by the dark tourist, and deepen our understanding (...) of the nature and purpose of dark tourism. More specifically, I repurpose Cohen’s (Sociology 13(2):179–201, 1979) typology of tourist experience to suggest a phenomenological typology of dark tourist experiences. Following Cohen, I suggest that we can chart the dark tourist experience as a continuum ranging from a pleasure-seeking experience to a meaning-seeking experience, qualified by authenticity-seeking or alienation-avoiding motivations, and the individual tourist’s proximity to or distance from the “centre” of their worldview. Such an analysis allows us to differentiate between tourists whose motivations are more recreational in nature and those whose motivations are more existential. A phenomenological analysis also enables us to further differentiate amongst the different modes of existential experience sought by the “pure” dark tourist and to consider the conditions of possibility necessary for their realisation. Die Coronapandemie stellt die Gesellschaft vor große Herausforderungen. Vielen Menschen mangelt es an (elementaren) naturwissenschaftlichen Kenntnissen. Sie sind skeptisch und misstrauen grundlegenden Prinzipien und Konzepten der Forschung. Esoterik und (Aber-) Glaube ersetzen ihnen den Zugang zur Wirklichkeit. -/- Nicht nur Fakten sind neuerdings "alternativ". Auch pseudowissenschaftliche Heilmethoden und okkulte Verfahren wurden der Bevölkerung trotz fehlender Wirksamkeitsnachweise lange als gleichwertige Alternativen zur modernen Medizin präsentiert. Ganz so, als wären Vernunft oder Unsinn eben eine Frage des persönlichen Geschmacks, einer anderen Weltanschauung. Sekundiert (...) durch das Gerede von einem "übertrieben szientistischen Weltbild", wurden Empirie und Logik systematisch diffamiert. -/- Infolge dieses Zerrbilds grassieren nun allerhand Verschwörungstheorien. Geistheiler, Seher, Schamanen, Scharlatane, Quacksalber, Sektierer, und Eiferer aller Richtungen und Couleur haben Konjunktur. Ein diffuses Pandemiemanagement und eine miserable Kommunikation tun ihr Übriges und tragen dazu bei, dass Infektionsschutzmaßnahmen oft rundweg abgelehnt und Impfquoten sich nun kaum noch signifikant steigern lassen. -/- The corona pandemic poses major challenges for society. Many people lack (basic) scientific knowledge. They are skeptical and distrust fundamental research principles and concepts. Esotericism and superstition replace them access to reality. -/- Not only facts are recently considered "alternative". Pseudo-scientific healing methods and occult procedures have long been presented to the public as equivalent alternatives to modern medicine, despite the lack of evidence of their effectiveness. Just as if reason or nonsense were just a question of personal taste, a different world view. Seconded by talk of an "exaggeratedly scientific world view", empiricism and logic were systematically defamed. -/- As a result of this distorted picture, all kinds of conspiracy theories are now rampant. Spiritual healers, seers, shamans, charlatans, quacks, sectarians, and zealots of all stripes and persuasions are in demand. Diffuse pandemic management and miserable communication do the rest and contribute to the fact that infection control measures are often flatly rejected and vaccination rates can hardly be increased significantly. -/- . »Aber wenn ich höre, alles andere habe vor dem Schutz des Lebens zurückzutreten, dann muss ich sagen: Das ist in dieser Absolutheit nicht richtig. Grundrechte beschränken sich gegenseitig. Wenn es überhaupt einen absoluten Wert in unserem Grundgesetz gibt, dann ist das die Würde des Menschen. Die ist unantastbar. Aber sie schließt nicht aus, dass wir sterben müssen.« So äußerte sich Wolfgang Schäuble im April 2020 im Zusammenhang mit den Maßnahmen gegen die Corona-Pandemie. Die fundamentale Stellung der Menschenwürde, die Schäuble (...) in seiner Aussage hervorhob, steht außer Streit. Der Schutz der Würde des Menschen bildet so etwas wie den Ankerpunkt, das Umwillen der Rechtsordnung. Was die Menschenwürde genau bedeutet, ist jedoch alles andere als klar. In der juristischen Literatur kommt die Schwierigkeit, die bei der Bestimmung des Begriffs besteht, vielfach zum Ausdruck. In den Kommentaren zum Grundgesetz wird etwa festgestellt, dass es einen allgemein akzeptierten, dogmatisch präzisen Rechtsbegriff der Menschenwürde nicht gebe. Ein operabler Begriff der Menschenwürde harre immer noch der Entwicklung. Das Zusammentreffen von fundamentaler Bedeutung und inhaltlicher Unbestimmtheit ruft nach theoretischer Reflexion. Dabei ist klar, dass gerade in der relativen Unschärfe und Offenheit des Begriffs der Menschenwürde auch ein Vorzug liegt. Gerade weil dieses Konzept so vage ist, kann es einen konsensfähigen Grund kollektiver Ordnung bilden. Die folgenden Überlegungen wollen dem Rechnung tragen und sind nicht von der Absicht geleitet, den Begriff abschließend zu definieren. Eher liegt das Ziel der Studie in einer Annäherung an den begrifflichen Gehalt der Menschenwürde. Disziplinär ist die folgende Untersuchung in erster Linie der Philosophie zuzuordnen, insbesondere der Rechts- und Moralphilosophie. Es handelt sich nicht um eine rechtswissenschaftlich-dogmatische Arbeit. Das Ziel der Arbeit besteht mithin nicht darin, den Rechtsbegriff der Menschenwürde auszulegen. Jedoch hat die Studie auch eine rechtlich-praktische Zielrichtung. Sie soll, auf philosophischer Grundlage, auch den Rechtsbegriff der Menschenwürde besser verstehen helfen und damit auch der juristischen Interpretation dienlich sein. Im dritten Teil wird die Arbeit daher Bezüge zum positiven Recht herstellen und eine juristische Interpretation des Begriffs vorschlagen. Bevor die Untersuchung einsetzt, ist eine kurze Verständigung darüber nötig, von welchem Begriff der Menschenwürde im Folgenden ausgegangen wird. Der Begriff kann unterschiedlich verstanden werden. Insbesondere bestehen Vorstellungen einer (wie man sagen kann) inhärenten und einer kontingenten Würde. Nach der ersten Vorstellung hat jeder Mensch eine Würde, die er nicht verlieren kann. Nach der zweiten Vorstellung ist Würde dagegen etwas, das ein Mensch je nachdem in größerem oder kleinerem Ausmaß besitzt. Die folgenden Überlegungen gehen von der Idee der inhärenten Würde aus. Diese Würde kann verletzt oder missachtet werden, sie kann dem Menschen aber nie eigentlich genommen werden. Die Menschenwürde auch in diesem Sinn basiert jedoch auf einer Zuschreibung. Der Mensch hat Würde nicht, wie er zwei Beine hat. Die menschliche Gemeinschaft schreibt sie ihm als unverlierbar zu. Es handelt sich bei dieser Zuschreibung mithin nicht um eine deskriptive, sondern um eine präskriptive Aussage. Gerade darin manifestiert sich der unverlierbare Gehalt der menschlichen Würde – denn in einem deskriptiven Sinn verstanden, kann diese durchaus verloren gehen. Ein Mensch kann faktisch unwürdig leben, entwürdigt werden, seiner Würde verlustig gehen. Das präskriptive Verständnis dagegen statuiert eine Würde, die alle faktischen Gegebenheiten überdauert und in jedem Fall besteht. Die folgenden Untersuchungen wollen diese Würde erläutern, aber nicht begründen. Denn nach hier vertretenem Verständnis bildet die Menschenwürde selbst den Grund der normativen Forderungen von Moral und Recht. Es gibt insoweit nichts weiter zu begründen – während die Würde, wie aufgezeigt werden soll, tatsächlich den Grund der Menschenrechte bildet. Insoweit – beim Verhältnis zwischen Menschenwürde und Menschenrechten – liegt ein Begründungsverhältnis vor. Dieses wird vor allem im zweiten Teil der Arbeit näher diskutiert. Im ersten Teil soll versucht werden, in einem allgemeinen, moralphilosophischen Sinn ein Verständnis der menschlichen Würde zu gewinnen. Dazu ist es zunächst nötig, sich die wichtigsten bestehenden Theorien zur Menschenwürde zu vergegenwärtigen. Die Auseinandersetzung mit diesen Theorien wird ein Defizit aufzeigen. Diesen Analysen schließt sich eine eigene Interpretation an, die am Schluss des ersten Teils mit einigen möglichen Gegenargumenten konfrontiert werden soll. (shrink)

Der normative Gehalt des Subsidiaritätsprinzips und seine Bedeutung für die Politische und Soziale Union Europas (S. 201-203) 1. Die Entwicklung des Maßstabs normativer Subsidiarität im ersten Kapitel beruht auf der Erkenntnis, dass dem Subsidiaritätsprinzip insbesondere von seinen protestantischen Wurzeln und seiner Ausprägung in der katholischen Soziallehre her ein spezifisch normativer Kerngehalt innewohnt, der als Idee auch dem Grundgesetzt als zwar weltanschaulich neutraler, aber nicht wertneutraler politischer Ordnung zugrunde liegt. Ausgehend von einem Menschenbild, das christliche Personalität und gesellschaftliche Solidarität umfasst, setzt (...) der materiale Gehalt des Subsidiaritätsprinzip insofern Grenzen, "als die Legitimation einer politischen Gemeinschaft nur von der Einzelperson im Sinne des individualistischen Liberalismus erfolgen kann und als die Anwendung des Subsidiaritätspinzips der Solidarität sozialer Einheiten bedarf. 2. Das ursprünglich von den deutschen Ländern anvisierte Ziel einer Verankerung des Strukturprinzips des Föderalismus im Vorfeld des Maastrichter Vertrages, ergänzt um das Subsidiaritätsprinzip als Prinzip der Kompetenzausübung, scheiterte am Widerstand Großbritanniens. Die Briten setzten das föderative Prinzip mit einem zentralistischen Bundesstaat gleich, den sie auf jeden Fall verhindern wollten. Fortan verbanden die Deutschen, insbesondere die deutschen Länder und Bundesregierung mit Unterstützung der beiden großen Kirchen einschließlich der kirchlichen Wohlfahrtsverbände, mit dem Subsidiaritätsprinzip neben einer Föderalisierung der Europäischen Union auch das Ziel, die Gesundheits- und Sozialpolitik auf europäischer Ebene auszubauen. Wenig später, schon im Verlauf der der Ratifikation des Vertrages, wird das Subsidiaritätsprinzip seitens der Bundesregierung und der deutschen Länder auf den Vorrang der der unteren Ebene umgemünzt. 3. Parallel zum Subsidiaritätsstreit in den 60er Jahren wird die Nähe zur Person bzw. zum Bürger instrumentalisiert, um dem Subsidiaritätsbegriff den Inhalt zu geben, der aus machtpolitischen Interessen opportun erscheint. Im innerdeutschen Subsidiaritätssstreit der 60er Jahre wurde die funktionale Dimension des Prinzips in den Vordergrund gedrängt, wohingegen seit 1993 seitens der Bundesregierung und der deutschen Länder im europäischen Kontext die territoriale Dimension des Prinzips, die sich gegen europäische Institutionen als Inbegriff bürgerferner, nicht demokratisch legitimierter Politik richtet, hervorgehoben wird. In beiden Fällen geht die aus Gründen normativer Subsidiarität gebotene Balance zwischen Identität und Funktion, zwischen Demokratie und Effizienz, verloren. 4. In den 60er Jahren haben die Verbände der freien Wohlfahrtspflege ihre Freiheit gegen Staatsnähe eingetauscht. Daraus entstanden neo-korporatistische Strukturen, die die Verbände zu mächtigen Trägern sozialer Dienstleistungen werden ließen. Die Rolle der Verbände als intermediäres Bindeglied zwischen Bürger und Staat wurde vernachlässigt. 5. In den 90er Jahren im europäischen Kontext die funktionale Dimension des Subsidiaritätsprinzip auf den territorialen Rahmen der Mitgliedstaaten zurecht gestutzt. Im Vordergrund steht nicht die bestmögliche Lösung eines Problems. Man gibt sich mit der vermeintlich "ausreichenden" Lösung auf mitgliedsstaatlicher Ebene zufrieden. Die systematische Auslegung, die im Hinblick auf die Sicherung der Funktionsfähigkeit der Gemeinschaft von besonderer Bedeutung ist, ergibt hingegen, "dass das Subsidiaritätspinzip als Kompetenzausübungsprinzip verfasst ist und zweitens, dass eine Entscheidung sowohl auf der Ebene der Gemeinschaft als auch auf Ebene der Mitgliedstaaten bürgernah sein kann." Deutlich tritt hier die Kluft zwischen rechtlicher Konzeption, die Ausdruck universeller Geltung des Prinzips ist, und verfolgten politischen Eigeninteressen der Akteure hervor. 6. Wenngleich bei den Verbänden der freien Wohlfahrtspflege, insbesondere den kirchlichen, der Territorialaspekt des Subsidiaritätsprinzips dominiert, gibt es Anzeichen dafür, dass die Überzeugung wächst, dass ohne eine sachbezogene, auf weitere Integration gerichtete Europapolitik auch die drei Wohlfahrtspflege in Deutschland nicht aufrechtzuerhalten ist. So vertreten die kirchlichen Verbände im Rahmen einer von der Kommission initiierten Konsultation zu Armut und Ausgrenzung in Europa die Ansicht, dass eine Lösung auf mitgliedsstaatlicher Ebene nicht ausreichend sei. In welcher Form die sozialpolitische Verantwortung auf europäischer Ebene wahrgenommen werden soll, bleibt offen. 7. Weder das Hervorheben der Nation als die maßgebliche territoriale Größe, die ihren Bürgern Schutz und Sicherheit bieten kann, noch die Vorstellung, Europas Vielfalt durch die Mobilisierung der Selbstregulierungskräfte der Gesellschaft erhalten zu können, bieten Perspektiven, das Demokratie-Effizienz-Dilemma zu überwinden. 8. Der Erhalt europäischer Demokratien ist ohne das Herausbilden transnationaler Formen von Demokratie nicht denkbar. Denn der Nationalstaat allein kann die Substanz der Demokratie nicht gewährleisten. Der nationale Wohlfahrtsstaat wird ausgehöhlt. Übrig bleibt die leere Hülle nationaler Souveränität. 9. Aussicht bietet eine zivilgesellschaftliche Verschränkung von Politik und Gesellschaft. Repräsentative nationale Akteure kooperieren zur Erfüllung einer europäischen Aufgabe und entwickeln daraus eine europäische Identität. Aufgrund ihrer assoziativen Funktion sind hier vor allem zivilgesellschaftliche Akteure gefragt. Hier eröffnet sich den Wohlfahrtsverbänden die Chance, sich auf ihre Wurzeln zu besinnen und verstärkt ihre Rolle in der Gesellschaft wahrzunehmen, um sich so die Position der Repräsentativität nachhaltig zu sichern. 10. Eine gleichgewichtige funktionale Repräsentation wirtschaftlicher, sozialer und kultureller Interessen einschließlich Repräsentationsmonopol und Mitverantwortung für die ausgehandelten Ergebnisse kann einen Beitrag zur Behebung des europäischen Demokratiedefizit leisten. Dies setzt voraus, dass die Europäische Union staatsähnliche Eigenschaften ausbildet, die sie dazu befähigt, Verhandlungsgleichgewichte zwischen den Repräsentanten der verschiedenen Interessen herzustellen und autonom über Umverteilungsfragen zu entscheiden und eine entsprechende Politik auch durchzusetzen.
