Differenti sono i modi di conoscere che sono emersi nel corso della storia umana. Ian Hacking ha proposto una nozione, quella di "stile di pensiero" ("style of reasoning"), che fornisce un modello per caratterizzarli ed esaminare la loro genesi e il loro sviluppo. L'articolo mette in luce alcune implicazioni di questa nozione concernenti l'evoluzione del nostro sapere.

In epoca medievale si è molto discusso su alcuni concetti chiave come prova o giustificazione. La teoria della prova contenuta nei trattati di logica medievale prende il nome tecnico di consequentia, che è un tipo di ragionamento fondato sul passaggio dalla concessione (o negazione) di uno o più enunciati denominati antecedenti alla concessione (o negazione) di uno o più enunciati denominati conseguenti. Questo tipo di teoria ha avuto un correlato a livello dei singoli termini che compongono l’enunciato all'interno della (...) teoria nota come suppositio terminorum. Prende, infatti, il nome di descensus, la regola che permette la verifica del passaggio da un termine maggiore (un termine comune) ad un termine minore (che denota individui). La stessa definizione di alcune ramificazioni della teoria della suppositio è col-legata alla possibilità di ammettere o meno il descensus cioè questa "discesa" da un termine comune ad una congiunzione o disgiunzione di termini singolari. Il presente lavoro intende descrivere la teoria del descensus come un tipo particolare di consequentia mostrandone le connessioni con le moderne tecniche logiche. I trattati che si affronteranno appartengono al XIV e al XV secolo, cioè ad un periodo caratterizzato da una sistemazione della materia che li rende confrontabili con un quadro teorico unitario. Poiché i miei interessi di ricerca si concentrano sul rapporto tra spazio e rappresentazione, nel presente articolo commenterò un lavoro di Achille C. Varzi pubblicato nel 2008 e intitolato, nella sua versione italiana, «Configurazioni, regole e inferenze». Accennerò anche a un secondo articolo scritto da Varzi e Massimo Warglien e pubblicato nel 2003, intitolato «The Geometry of Negation». Mi rivolgerò poi alla psicologia sperimentale, collegando alcuni aspetti delle osservazioni di Varzi a un articolo di Johnson- Laird del 2005 intitolato «The (...) Shape of Problems». Nelle conclusioni, farò un ultimo riferimento a un articolo di Varzi pubblicato nel 2000, scritto con Philip Kitcher e intitolato «Some Pictures Are Worth 2 אo Sentences». Le parole configurazioni, geometry, shape e picture nei titoli degli articoli di cui mi occuperò sono dei buoni indizi per capire quale sia il filo rosso che lega a mio avviso tutti questi lavori. E 'sia sorprendente e appropriato che questo enorme, gergo-carico (questo libro ha davvero bisogno di un glossario!), lavoro pesantemente accademico è diventato un best seller nel mondo degli istruiti. Bisogna dedicarsi a imparare il gergo e poi ad arare attraverso 551 pagine di testo e 238 pagine di note. Meanwhile, ci viene detto più e più volte che questo è solo un contorno di ciò che verrà! Anche se critica severamente gli eccessi dei tre movimenti, si tratta di un'interpretazione mistica (...) e postmoderna decostruttiva e New Age della religione, della filosofia e delle scienze comportamentali da un punto di vista molto liberale e spirituale, cioè senza il peggior decon, pm e Vietnam gergo, egualitarismo rabbioso e anti-intellettualismo. Si ottiene un fantastico campionamento di scritte sbagliate, idee confuse e obsolete e gergo obsoleto. Se uno ha una buona istruzione attuale, è doppiamente doloroso leggere questo libro (e la maggior parte della scrittura sul comportamento umano). Doloroso perché è così torturato e confuso, e poi di nuovo quando ti rendi conto di quanto sia semplice con la psicologia moderna e la filosofia. La terminologia e le idee sono orribilmente confuse e datate (ma meno nell'analisi di Wilber che nelle sue fonti). Questo libro e la maggior parte delle sue fonti sono testi di psicologia aspiranti, anche se la maggior parte degli autori non se ne rese conto. Si tratta del comportamento umano e del ragionamento sul perché pensiamo e agiamo come facciamo e come potremmo cambiare in futuro. Ma (come tutte queste discussioni fino a poco tempo fa) nessuna delle esplicazionisono davvero spiegazioni, e quindi non danno alcuna comprensione del comportamento umano. Nessuno discute i meccanismi mentali coinvolti. È come descrivere come funziona un'auto discutendoil volante e il metallo e vernice senza alcuna conoscenza del motore, del carburante o del treno a trazione. Infatti, come la maggior parte delle più vecchie spiegazioni di comportamento, i testi citatiqui e i comments di Wilber sono spesso più interessanti per che tipo di cose che accettano (eomettere!) come spiegazioni, e il tipo di ragionamento they uso, che per il contenuto effettivo. Se si è sulla filosofia e la psicologia cognitiva ed evolutiva, la maggior parte di questo è arcaico. Come quasi tutti (studiosi e pubblico allo stesso modo-e.g. vedi la mia recensione di Freedom Evolves di Dennett e di altri libri), non capisce che le basi della religione e dell'etica, in realtà tutti i comportamenti umani, sono programmati nei nostri geni. Una rivoluzione nella comprensione di noi stessi stava avvenendo mentre scriveva i suoi numerosi libri e lo passava davanti. Il materialismo, il riduzionismo, il comportamentalismo, il funzionalismo, la teoria dei sistemi dinamici e il computazionalismo sono punti di vista popolari, ma sono stati mostrati da Wittgenstein come incoerenti. Lo studio del comportamento comprende tutta la vitaumana, ma il comportamento è in gran parte automatico e inconscio e anche la parte cosciente, per lo più espressa nel linguaggio (che Wittgenstein equivale alla mente), non è perspicua, quindi è fondamentale avere un quadro che Searle chiama la struttura logica della razionalità (LSR) (...) e io chiamo la psicologia descrittiva del pensiero dell'ordine superiore (DPHOT). Dopo aver riassunto il quadro elaborato da Wittgenstein e Searle, come esteso dalla ricerca di ragionamento moderno, mostro le inadeguatezze nelle opinioni di Carruther, che pervadono la maggior parte delle discussioni sul comportamento, comprese le scienze comportamentali contemporanee. Io sostengo che il suo libro è un amalgama di due libri, uno una sintesi della psicologia cognitiva e l'altro una sintesi delle confusioni filosofiche standard sulla mente con qualche nuovo gergo aggiunto. Suggerisco che quest'ultimo dovrebbe essere considerato incoerente o come una visione dei cartoni animati della vita e che prendendo Wittgenstein alla sua parola, possiamo praticare l'autoterapia di successo per quanto riguarda il problema della mente / corpo come un problema di lingua / corpo. Questo lavoro propone un confronto tra diversi strumenti utilizzabili per modellare la conoscenza di dominio in ambito didattico: le mappa concettuali, Novak e Cañas (2006), (uno strumento tradizionalmente utilizzato nelle scuole) e le ontologie computazionali (dei sistemi formali di modellazione concettuale, attualmente molto usati nei sistemi di intelligenza artificiale per le loro capacità di “ragionamento automatico”, si veda Guarino, (1995)). Nello specifico, questo articolo presenta il risultato di un un doppio esperimento sul campo condotto presso il Liceo Scientifico “Guido (...) Parodi” di Acqui Terme in cui gruppi di studenti paragonano lo strumento della mappa concettuale e quello dell’ontologia nella risoluzione di due problemi di “misconcezione” (o errata concettualizzazione): uno indotto attraverso la consegna di appunti e materiali didattici contenenti informazioni volontariamente contraddittorie tra loro (caso che potrebbe corrispondere alla situazione in cui uno studente prende - per qualche motivo - degli appunti in modo scorretto) e l’altro legato ad una complessità concettuale intrinseca all’argomento. Secondo Antonio Rosmini-Serbati, l’idea dell’essere è unicamente innata e forma fondamentale dell’esperienza. Provando a dimostrare l’origine dell’idea di similitudine nel rapporto tra cose reali e loro rappresentazioni mentali, Rosmini involontariamente lascia pensare che forse anche quest’idea sia innata. In modo platonico respinge “il terzo uomo” (regresso infinito), cioè la nota critica di Aristotele per quanto riguarda l’idea di similitudine. Il suo è un ragionamento circolare. Perciò in questa analisi concludiamo che l’idea di similitudine dovrebbe essere considerata innata e forma (...) epistemologica nella stessa misura dell’idea di essere. (shrink)

Mostrando le analogie tra il modello di Homo oeconomicus e quello che chiameremo Animal oeconomicum, nonché la genealogia del ragionamento “economico” applicato al comportamento animale, vengono messi in risalto gli impliciti e le debolezze di alcuni ragionamenti etologici frequenti; revisioni e critiche che hanno ridimensionato il concetto di Homo oeconomicus sono applicabili anche all’interpretazione raziocinante e calcolatrice del comportamento animale.

In «Mancanze, omissioni, e descrizioni negative»,55 Achille Varzi esplora le conseguenze di una forma comune di ragionamento causale, quella in cui citiamo mancanze od omissioni nel fornire una spiegazione delle cause degli eventi. Tale forma appare di comune uso nei contesti normativi del diritto, nelle spiegazioni tipiche delle scienze sociali e, più in generale, nel ragionamento ordinario. Ciò che accomuna questi casi è l’idea intuitiva secondo cui le cause possono anche consistere in eventi negativi. L’intuizione non è però (...) metafisicamente innocua, poiché per affermare che una spiegazione come "C’è stata un’esplosione perché Gianni non ha spento il gas" sia una buona spiegazione, occorre assumere che gli eventi negativi come “il non aver spento il gas da parte di Gianni” esistano al pari di eventi come l’esplosione e dal momento che, solo se sono entrambi eventi, può tra questi sussistere una relazione casuale. Dovremmo pertanto concludere che (1) è perfettamente intellegibile e rispecchia le nostre pratiche linguistiche. Spesso parliamo assumendo che ci siano cose che le persone non fanno: il gas che Gianni non ha spento, la passeggiata che non abbiamo fatto, il treno che non è arrivato, ecc. La sensatezza di questi usi esige pertanto il dover riconoscere una certa legittimità al vocabolario delle omissioni e delle descrizioni negative. Varzi sostiene che questo modo di parlare solleva tuttavia degli scrupoli ontologici,56 poiché non è possibile assumersi alcun serio impegno ontologico nei confronti di eventi negativi, ancor meno quando le nostre asserzioni richiedono di quantificare su eventi “inesistenti”. Una strategia per ovviare a questo scrupolo è sostenere che queste pratiche linguistiche sono analoghe a quelle in cui parliamo di oggetti “inesistenti”, ossia di oggetti che è come se ci fossero, ma che riconosciamo esistere soltanto in un contesto finzionale. Dunque l’analogia con gli oggetti finzionali può rendere in qualche modo espliciti i vincoli ontologici, giustificando quegli usi linguistici. Sebbene questo argomento abbia la sua plausibilità, Varzi nota che «ad un esame più attento, gli eventi non accaduti si rivelano ben più resistenti al rasoio di Occam di quanto l’analogia con gli oggetti non esistenti suggerisca » poiché il nostro linguaggio causale ci induce spesso a ritenere che «il riferimento o la quantificazione nei confronti di eventi non accaduti sia da intendersi in senso stretto e letterale»,57 in contrasto con quanto suggerisce l’analogia con gli oggetti finzionali. La difficoltà nasce dall’argomento per cui, se la causazione è una relazione tra eventi, occorre prendere sul serio l’idea che gli eventi negativi siano negativi stricto sensu. La tesi di Varzi è che questa tesi sia una contraddizione genuina e che l’unico modo di risolverla sia di rinunciare all’idea che gli eventi negativi esistano in un qualsiasi senso. In questo articolo intendo analizzare un aspetto di questa forma di parsimonia ontologica. Il mio intento è di valutare le conseguenze della tesi di Varzi dal punto di vista della spiegazione causale in contesti controfattuali e nei casi di omissione del diritto. (shrink)

La logica modale è nata per studiare i ragionamenti su ciò che è possibile e ciò che è necessario. Negli ultimi decenni, a partire dal lavoro di logici e filosofi quali Rudolf Carnap, Saul Kripke e David Lewis, la sua applicazione è stata progressivamente estesa ad altri ambiti, quali il ragionamento sul tempo, sulla conoscenza e sui sistemi di norme. Queste ricerche hanno condotto a un complesso e intrigante dialogo con alcune fondamentali branche della filosofia: la metafisica, l’epistemologia, la (...) filosofia del linguaggio. Lo scopo del volume è offrire una panoramica di questo dialogo al contempo accessibile e rigorosa, pensata sia per gli studenti di un corso universitario, sia per il lettore non specialista. Se da un lato tutte le necessarie nozioni tecniche sono rese accessibili ai non addetti ai lavori, dall'altro si restituisce un'immagine fedele delle sfide concettuali che la ricerca in questi settori è oggi chiamata ad affrontare. Articolo divulgativo pubblicato su L'Indiscreto il 6 ottobre 2021. Il ragionamento dello scienziato e quello del mistico paiono essere agli antipodi. Seguendo un noto paragone di Badcock, lo scienziato tende a ipomentalizzare (interpreta come un meccanismo anche ciò che ha esprienze soggettive), il mistico a ipermentalizzare (assegna una volontà anche a ciò che non ha una mente). Eppure, in alcuni personaggi famosi, questi due diversi modi di pensare si fondono, rivelando una possibile unità tra i due modi di vedere (...) il mondo. Badcock immagina che Newton tendesse prima a ipermentalizzare (da cui la grande creatività) e poi a ipomentalizzare (per riportare i sogni entro i limiti della razionalità). Io propongo l'ipotesi che certi scienziati-mistici come Swedenborg attuassero un processo opposto, prima ipomentalizzando, e poi ipermentalizzando. (shrink)

Gli approcci della tradizione filosofica alla morale si fondano prevalentemente su concetti e teorie metafisiche e teologiche. Tra i concetti etici tradizionali, il più importante è la Teoria del Comando Divino (DCT). Secondo la DCT, Dio dà fondamenti morali all’umanità attraverso la sua creazione e attraverso la Rivelazione. Moralità e Divinità sono inseparabili fin dalle civiltà più remote. Questi concetti si inseriscono in un quadro teologico e sono accettati principalmente dalla maggior parte dei seguaci delle tre tradizioni abramitiche: ebraismo, cristianesimo (...) e islam: la parte più considerevole della popolazione umana. Tenendo come fondamento la fede e la Rivelazione, le Teorie del Comando Divino non sono strettamente soggette alla dimostrazione. Gli oppositori alla concezione della morale del Comando Divino, fondata sull'impossibilità di dimostrare i suoi presupposti metafisici e religiosi, hanno tentato per molti secoli (anche se senza successo) di sminuirne l'importanza. Sostenevano che esso non presenta prove materiali e coerenza logica e, per questo motivo, non può essere preso in considerazione per scopi scientifici o filosofici. È solo una convinzione e, come tale, dovrebbe essere intesa. Oltre a queste opposizioni estreme, molti altri concetti contravvengono alle teorie del Comando Divino, in un modo o nell'altro, in parte o del tutto. Dalla filosofia greca classica fino ai giorni nostri, molti filosofi e scienziati sociali sostengono che la moralità è solo un costrutto e quindi culturalmente relativo e culturalmente determinato. Tuttavia, ciò apre la strada a molte altre discussioni e impone la sfida di determinare il significato della cultura, quali elementi della cultura siano moralmente determinanti e, infine, i confini di tale relatività. I deterministi morali affermano che tutto ciò che riguarda il comportamento umano, inclusa la moralità, è determinato una volta che il libero arbitrio non esiste. Più recentemente, i pensatori moderni hanno sostenuto che esiste una scienza rigorosa della moralità. Tuttavia, pur spiegando numerosi fatti e prove, il metodo scientifico da solo non può illuminare l’intero contenuto e il pieno significato dell’etica. La comprensione della morale richiede una percezione più ampia e un accordo tra i filosofi, cosa che essi non hanno mai raggiunto. Queste domande hanno molte configurazioni diverse a seconda di ciascun filone filosofico e danno origine ad analisi complesse e dibattiti infiniti finché molti di essi sono reciprocamente conflittuali. L'universo e l'atmosfera che coinvolgono questa ricerca sono i domini di tutti questi conflitti concettuali, osservati da un punto di vista oggettivo ed evolutivo. Indipendentemente da questa circostanza e dalla sua intrinseca importanza; tuttavia, queste domande sono lontane dall’approccio metodologico di una discussione analitica sulla morale oggettiva, che è, in effetti, lo scopo e la portata di questo lavoro. Dovremmo rivisitare brevemente queste importanti teorie tradizionali perché questo lavoro ospita uno studio comparativo e i suoi presupposti differiscono profondamente da tutte le teorie tradizionali. -/- Diventa quindi necessario offrire al lettore elementi di confronto diretti e specifici per una critica valida, dispensando ricerche interruttive. Tuttavia, anche rivisitando le teorie tradizionali, a questo scopo di esposizione comparativa e critica, esse verranno tenute ai margini delle nostre preoccupazioni primarie come “aliena materia”. Indipendentemente dalla validità di alcuni o tutti gli elementi di questa discussione e dal loro significato come universo filosofico della nostra ricerca, lo scopo di questo lavoro è dimostrare e giustificare l’esistenza e il significato degli archetipi morali preistorici sorti direttamente dal contesto sociale fondamentale e corrispondenti bisogni e sforzi per la sopravvivenza. Tali archetipi sono la definizione del fondamento essenziale dell'etica, la sua aggregazione all'inconscio collettivo e la corrispondente logica di organizzazione e trasmissione agli stadi evolutivi del genoma umano e dei diversi rapporti spazio-temporali, indipendentemente da qualsiasi esperienza contemporanea dei singoli individui. Il sistema definito da questi archetipi compone un modello sociale umano evolutivo. È questa una posizione meta etica? Sì. Inoltre, come in ogni ragionamento meta etico, bisognerebbe cercare attentamente i percorsi migliori e più coerenti, come offre la Filosofia Analitica. Pertanto, questo lavoro dovrebbe ragionevolmente dimostrare che la morale non è un prodotto culturale degli uomini civilizzati o delle società moderne. Pur essendo soggetto a molteplici aggregazioni e sottrazioni culturali, i suoi fondamenti essenziali sono archetipici e non sono mai strutturalmente mutati. Questo ragionamento induce che la moralità sia un primo attributo dell'“homo sapiens”; non è una proprietà né un accidente: integra l'essenza umana e appartiene all'identità ontologica umana. I fenomeni umani sono un processo continuo, che gioca il suo ruolo tra determinazione casuale e libero arbitrio, e dobbiamo chiederci come è iniziata la moralità e come è arrivata a noi nel presente. Aquinas’s thought is often considered an exemplary balance between Christian faith and natural reason. However, it is not always sufficiently clear what such balance consists of. With respect to the relation between philosophical topics and the Christian faith, various scholars have advanced perspectives that, although supported by Aquinas’s texts, contrast one another. Some maintain that Aquinas elaborated his philosophical view without being under the influence of faith. Others believe that the Christian faith constitutes an indispensable component of Aquinas’s view; at (...) least when Aquinas focused on those statements that, though maintainable by mere reason, belong to the Christian revelation. In this essay I intend to show that the aforementioned perspectives can be reconciled on the basis of Aquinas’s concept of faith. If we do not limit ourselves to considering faith as the assent to the revealed truth, but also look at what leads the believer to assent—i.e., charity that unites the believer with God and is gratuitously conceded by God himself—then the relation between faith and reason appears to be twofold. On the one hand, the truths of faith cannot participate in the rational inquiry, because according to Aquinas faith lacks the evidence searched for by natural reason. On the other hand, since Aquinas holds that faith is the assent to the revelation due to the love for God that is granted by God himself, the believer will take faith as more certain than intellect and science, and the truths of faith will constitute the orientation and criterion of her/his rational investigation. The truths shall constitute orientation because the believer aims to confirm by reason what she/he already believes. They will also be criterion, because in case of a contradiction between rational arguments and revealed truths, reason must be considered mistaken and the rational investigation must start anew from the beginning. In juxtaposition with the myth and tragedy of Ovid’s Medea, this paper investigates the possibility within the Kantian conception of agency of understanding moral evil as acting against one’s better judgment. It defends the thesis that in Kant self-deception, i. e. the intentional untruthfulness to oneself, provides the fundamental structure for choosing against the moral law. I argue that, as Kant’s thought progresses, self-deception slowly proceeds to become the paradigmatic case of moral evil. This is discussed with regard to two (...) important topics in his later moral philosophy: the doctrine of radical evil and the crucial role of the duty of truthfulness in ethics. The inquiry into Kant’s theory of conscience unfolds both against this theoretical background and in light of its historical roots in the polemic against casuistry and probabilism. This contribution closes with a brief look at the tools Kant implements to counter this tendency to self-deception in moral judgment and particularly at the role casuistry plays within his conception of moral education. Advances in neuroscience implicate reentrant signaling as the predominant form of communication between brain areas. This principle was used in a series of masking experiments that defy explanation by feed-forward theories. The masking occurs when a brief display of target plus mask is continued with the mask alone. Two masking processes were found: an early process affected by physical factors such as adapting luminance and a later process affected by attentional factors such as set size. This later process is called (...) masking by object substitution, because it occurs whenever there is a mismatch between the reentrant visual representation and the ongoing lower level activity. Iterative reentrant processing was formalized in a computational model that provides an excellent fit to the data. The model provides a more comprehensive account of all forms of visual masking than do the long-held feed-forward views based on inhibitory contour interactions. (shrink)

This paper reconstructs Sartre’s account of the “circuit of ipseity” as an integral theory of the experiential, agentive and normative aspects of self-consciousness. At the core of this theory is a conception of human (self-)consciousness as lacking, and the correlation between lacking and ideal. In Section 1, I show how this theory manages to satisfy the apparently incompatible requirements generated by the idea of a pre-reflective cogito. Section 2 discusses practical self-consciousness, in particular the agent’s consciousness of herself as self-determined (...) in the projection and pursuit of ends, and how this is accounted for in Sartre’s theory by the correlation of lack and ideal. Section 3 first clarifies the Sartrean conception of the ideal by comparing it with Korsgaard’s, and then reconstructs Sartre’s account of practical normativity by showing how it can be read as emerging from a critical engagement with Heidegger. In this paper I argue that there is an important anomaly to the causalist/compatibilist paradigm in the philosophy of action and free will. This anomaly, which to my knowledge has gone unnoticed so far, can be found in the philosophy of Harry Frankfurt. Two of his most important contributions to the field – his influential counterexample to the Principle of Alternate Possibilities and his ‘guidance’ view of action – are incompatible. The importance of this inconsistency goes far beyond the issue (...) of coherence within Frankfurt’s philosophy. I shall argue that this inconsistency represents an important anomaly within the causalist/compatibilist framework; so that we should start to seriously consider having to move on from the established paradigm. Ought parents, in general, to value being biologically tied to their children? Is it important, in particular, that both parents be biologically tied to their children? I will address these fundamental questions by looking at a fairly new practice within IVF treatments, so-called IVF-with-ROPA ( Reception of Oocytes from Partner ), which allows lesbian couples to „share motherhood‟ with one partner providing the eggs while the other becomes pregnant. I believe that IVF-with-ROPA is, just like other IVF treatments, morally permissible; (...) but here I argue that the increased biological ties which IVF-with-ROPA allows for do not have any particular value beside the satisfaction of a legitimate wish, because there is no intrinsic value in a biological tie between parents and children; further, I argue that equality within parental projects cannot be achieved by redistributing biological ties. Thinking is overrated: golfers perform best when distracted and under pressure; firefighters make the right calls without a clue as to why; and you are yourself ill advised to look at your steps as you go down the stairs, or to try and remember your pin number before typing it in. Just do it, mindlessly. Both empirical psychologists and the common man have long worked out that thinking is often a bad idea, but philosophers still hang on to an intellectualist (...) picture of human action. This book challenges that picture and calls on philosophers to wake up to the power of mindlessness: it is our habits, skills and conventions that help us cope with a world way too diverse for us to hope to always reinterpret it. The book presents the empirical evidence that has been accumulating over the last few decades and offers a philosophical analysis of mindless phenomena such as habits, skilled activity, automatic actions, emotional and spontaneous reactions and social conventions, arguing that traditional philosophical theories of action should be revised to do justice to this forgotten but important part of our lives: when we act mindlessly, we are free and fully rational even though we neither deliberate nor are aware of what we are doing. I argue that the right to sexual satisfaction of severely physically and mentally disabled people and elderly people who suffer from neurodegenerative diseases can be fulfilled by deploying sex robots; this would enable us to satisfy the sexual needs of many who cannot provide for their own sexual satisfaction; without at the same time violating anybody’s right to sexual self-determination. I don’t offer a full-blown moral justification of deploying sex robots in such cases, as not all morally relevant concerns can (...) be addressed here; rather, I put forward a plausible way of fulfilling acute sexual needs without thereby violating anybody’s sexual rights. Judith Jarvis Thomson has recently proposed a new argument for the thesis that killing the one in the Trolley Problem is not permissible. Her argument relies on the introduction of a new scenario, in which the bystander may also sacrifice herself to save the five. Thomson argues that those not willing to sacrifice themselves if they could may not kill the one to save the five. Bryce Huebner and Marc Hauser have recently put Thomson's argument to empirical test by asking (...) people what they should do in the new trilemma case, in which they may also sacrifice themselves. They found that the majority judge that they should either kill the one or sacrifice themselves; Huebner and Hauser argue that those numbers speak against Thomson's argument. But Thomson's argument was about the dialectical effect of the new trilemma on the traditional dilemma, rather than about the trilemma itself. Here I present the results of a study in which I asked subjects first what they should do in the trilemma and then what they should do in the traditional Trolley Problem. I found that, if asked first about the trilemma, subjects then have the intuition that killing the one in the traditional Bystander at the Switch is not permissible?exactly what Thomson's argument had predicted. I show that Pickard’s argument against the irresistibility of addiction fails because her proposed dilemma, according to which either drug-seeking does not count as action or addiction is resistible, is flawed; and that is the case whether or not one endorses Pickard’s controversial definition of action. Briefly, we can easily imagine cases in which drug-seeking meets Pickard’s conditions for agency without thereby implying that the addiction was not irresistible, as when the drug addict may take more than one route to (...) go meet her dealer. This article reconstructs Sartre’s theory of selfhood against the background of the contemporary debate between minimal-self theories and narrative-self theories. I argue that Sartre’s theory incorporates both an emphasis on the singular first-person perspective, which is characteristic of minimal-self theories, and an emphasis on the practical intelligibility of experience, which is characteristic of narrative-self theories. The distinctiveness of the Sartrean combination of these motifs consists in its idea of the necessary ideal-relatedness of consciousness. According to Sartre, the logical structure of (...) the pre-reflective cogito requires the haunting presence of an ideal of self-coincidence, which determines for consciousness the meaning of its lived experiences. Consciousness exists as a question to itself due to this ideal-relatedness, and it answers this question by projecting its possibilities as creative and symbolic realizations of this ideal. Establishing the connection between Sartre’s theory of imagination and his theory of selfhood, I suggest that both the ideal and the possibility of consciousness are lived in the manner of the imaginary. I argue that the arguments brought by Counsel for M to the English Court of Protection are morally problematic in prioritising subjective interests that are the result of ‘consistent autonomous thought’ over subjective interests that are the result of a more limited cognitive perspective.

I argue that it is possible for prospective mothers to wrong prospective fathers by bearing their child; and that lifting paternal liability for child support does not correct the wrong inflicted to fathers. It is therefore sometimes wrong for prospective mothers to bear a child, or so I argue here. I show that my argument for considering the legitimate interests of prospective fathers is not a unique exception to an obvious right to procreate. It is, rather, part of a growing (...) consensus that procreation can be morally problematic and that generally talking of rights in this context might not be warranted. Finally, I argue that giving up a right to procreate does not imply nor suggest giving up on women’s absolute right to abort, which I defend. (shrink)

Balancing a hermeneutic of trust with a hermeneutic of suspicion, this article develops a phenomenological description of imagination that highlights its alethic ambiguity. Imagination is an act of disclosure, without which the world of fiction and pure possibility cannot be constituted. Imagination is also an act of self-indulgence and narcissism, the source of much concealment and untruth. It is not the one or the other, but both at the same time, essentially ambiguous because of its phenomenological constitution. In this article, (...) I will take some steps towards clarifying this essential ambiguity of the imagination by drawing on the insights of Husserl and Sartre. Beginning with Husserl’s parallel treatment of imagination and perception as intuitive, objectifying acts, I will argue, drawing on insights from Sartre, that there is an important discrepancy between them with respect to the role of desire. While the constitution of perceptual presence is inseparable from a desire for truth, the desire involved in the constitution of imaginary presence has an ambiguous character, both epistemic and magical. This duplicity of desire partly accounts for the ambiguity of imagination, which is all the more pronounced the more the imagination demands the full emotional involvement of the imagining subject. I argue that the empirical literature on priming effects does not warrant nor suggest the conclusion, drawn by prominent psychologists such as J. A. Bargh, that we have no free will or less free will than we might think. I focus on a particular experiment by Bargh – the ‘elderly’ stereotype case in which subjects that have been primed with words that remind them of the stereotype of the elderly walk on average slower out of the experiment’s room than control (...) subjects – and I show that we cannot say that subjects cannot help walking slower or that they are not free in doing do. I then illustrate how these cases can be reconciled and normalized within a Davidsonian theory of action to show that, in walking slower, subjects are acting intentionally. My argument applies across various experiments, including those of goal priming. In the final section I argue that the only cases in which priming effects are efficacious are so-called Buridan cases. Both Husserl and Sartre speak of quasi-presence in their descriptions of the lived experience of imagination, and for both philosophers, accounting for quasi-presence means developing an account of the hyle proper to imagination. Guided by the perspective of fulfillment, Husserl’s theory of imaginary quasi-presence goes through three stages. Having experimented first with a depiction-model and then a perception-model, Husserl’s mature theory appeals to his innovative conception of inner consciousness. This elegant account nevertheless fails to do justice to the facticity and (...) bodily involvement of our imaginary experience. Sartre’s theory of analogon, based on his conception of imaginary quasi-presence as ‘magical’ self-affection, embodies important insights on these issues. Kinesthetic sensations and feelings are the modes in which we make use of own body to possess and be possessed by the imaginary object, thus lending it a semblance of bodily presence. (shrink)

I argue that we should give up the fight to rescue causal theories of action from fundamental challenges such as the problem of deviant causal chains; and that we should rather pursue an account of action based on the basic intuition that control identifies agency. In Section 1 I introduce causalism about action explanation. In Section 2 I present an alternative, Frankfurt’s idea of guidance. In Section 3 I argue that the problem of deviant causal chains challenges causalism in two (...) important respects: first, it emphasizes that causalism fails to do justice to our basic intuition that control is necessary for agency. Second, it provides countless counterexamples to causalism, which many recent firemen have failed to extinguish – as I argue in some detail. Finally, in Section 4 I argue, contra Al Mele, that control does not require the attribution of psychological states as causes. (shrink)

I defend the argument that if embryo loss in stem cell research is morally problematic, then embryo loss in in vivo conception is similarly morally problematic. According to a recent challenge to this argument, we can distinguish between in vivo embryo loss and the in vitro embryo loss of stem cell research by appealing to the doctrine of double effect. I argue that this challenge fails to show that in vivo embryo loss is a mere unintended side effect while in (...) vitro embryo loss is an intended means and that, even if we refine the challenge by appealing to Michael Bratman's three roles of intention, the distinction is still unwarranted. Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. We also show why admitting other (...) forms of evidence, such as eyewitness, trace, and motive evidence, does not violate equal protection. (shrink)

I argue against the Doctrine of Double Effect’s explanation of the moral difference between terror bombing and strategic bombing. I show that the standard thought-experiment of Terror Bomber and Strategic Bomber which dominates this debate is underdetermined in three crucial respects: (1) the non-psychological worlds of Terror Bomber and Strategic Bomber; (2) the psychologies of Terror Bomber and Strategic Bomber; and (3) the structure of the thought-experiment, especially in relation to its similarity with the Trolley Problem. (1) If the two (...) worlds are not identical, then it may be these differences between the two worlds and not the Doctrine of Double Effect to explain the moral difference; (2a) if Terror Bomber and Strategic Bomber have the same causal beliefs, then why does Terror Bomber set out to kill the children? It may then be this unwarranted and immoral choice and not the Doctrine of Double Effect that explains the moral difference; (2b) if the two have different causal beliefs, then we can’t rule out the counterfactual that, had Strategic Bomber had the same beliefs as Terror Bomber, she would have also acted as Terror Bomber did. Finally, (3) the Strategic Bomber scenario could also be constructed so as to be structurally equivalent to the Fat Man scenario in the Trolley Problem: but then the Doctrine of Double Effect would give different answers to two symmetrical cases. I distinguish between 'hard nudges' and 'soft nudges', arguing that it is possible to show that the latter can be compatible with informed consent - as Cohen has recently suggested; but that the real challenge is the compatibility of the former. Hard nudges are the more effective nudges because they work on less than conscious mechanisms such as those underlying our habits: whether those influences - which are often beyond the subject's awareness - can be reconciled with informed consent in (...) health care is the more challenging question. I suggest two directions for possible answers: on the one hand, looking at the growing empirical literature on mindless judgement and behaviour; and on the other hand considering a more diversified conception of consent, which I sketch. I offer eight arguments against the Doctrine of Double Effect, a normative principle according to which in pursuing the good it is sometimes morally permissible to bring about some evil as a side-effect or merely foreseen consequence: the same evil would not be morally justified as an intended means or end.

The literature on algorithmic fairness has examined exogenous sources of biases such as shortcomings in the data and structural injustices in society. It has also examined internal sources of bias as evidenced by a number of impossibility theorems showing that no algorithm can concurrently satisfy multiple criteria of fairness. This paper contributes to the literature stemming from the impossibility theorems by examining how informational richness affects the accuracy and fairness of predictive algorithms. With the aid of a computer simulation, we (...) show that informational richness is the engine that drives improvements in the performance of a predictive algorithm, in terms of both accuracy and fairness. The centrality of informational richness suggests that classification parity, a popular criterion of algorithmic fairness, should be given relatively little weight. But we caution that the centrality of informational richness should be taken with a grain of salt in light of practical limitations, in particular, the so-called bias-variance trade off. (shrink)

Smith argues that, unlike other forms of evidence, naked statistical evidence fails to satisfy normic support. This is his solution to the puzzles of statistical evidence in legal proof. This paper focuses on Smith’s claim that DNA evidence in cold-hit cases does not satisfy normic support. I argue that if this claim is correct, virtually no other form of evidence used at trial can satisfy normic support. This is troublesome. I discuss a few ways in which Smith can respond.

Excerpt: In this essay I explore the nature of the necessity of historical development in Nietzsche’s genealogy of Judeo-Christian moral values. I argue that the progression of moral stages in Nietzsche’s study is ordered in such a way that the failure of each stage is logically and structurally necessary, that each failure structures the resultant system or paradigm, but that the historical manifestation of moral paradigms coinciding with predicted or projected theoretical structures is contingent upon a multitude of other historical (...) factors. Frente a quienes sostienen una incompatibilidad entre historia de la filosofía y filosofía, en cuanto plantean una disyuntiva entre una práctica descriptiva y una argumentativa, en este trabajo nos proponemos mostrar, examinando la labor histórico-filosófica de Aris- tóteles, que esa disyuntiva no es excluyente. Para ello, en primer lugar, examinaremos algunos pasajes de su obra en los que ofrece indicaciones metodológicas que permiten comprender la doble función que cumplen las exposiciones críticas de los filósofos precedentes en la constitución misma de (...) su filosofía. En segundo lugar, ilustraremos el tipo de argumentación aristotélica a través del análisis de las críticas que dirige a las Ideas platónicas como causas. Contra Platón, Aristóteles establece que, para dar cuenta de la ingenerabilidad e incorruptibilidad de las formas, no es necesario caracterizarlas como entidades separadas de la materia y del movimiento. Basta asegurar la eternidad de la forma a través de su reproducción en otros individuos de la misma especie. Tal análisis nos permite concluir, finalmente, que filosofía o historia de la filosofía constitu- yen una falsa disyuntiva en Aristóteles, por lo que el examen dialéctico de las doctrinas precedentes es un método adecuado de indagación filosófica. The argument for the moral permissibility of killing newborns is a challenge to liberal positions on abortion because it can be considered a reductio of their defence of abortion. Here I defend the liberal stance on abortion by arguing that the argument for the moral permissibility of killing newborns on ground of the social, psychological and economic burden on the parents recently put forward by Giubilini and Minerva is not valid; this is because they fail to show that newborns cannot (...) be harmed and because there are morally relevant differences between fetuses and newborns. The use of writing or journaling as a tool toward healing is becoming increasingly accepted in the vernacular of healing litanies. Reference books, personal narratives, and research on the effects of writing on healing psychological discomfort are abundant. Heal Yourself with Writing, written by screenwriter Catherine Ann Jones, and published in 2013, won a Nautilus Book Award for 2014. The following review reflects a book that is a well-thought journey through the steps of intentional or focused writing for the express (...) purpose of moving from living from beliefs and thoughts that do not serve healthy wholeness or fullness of life, into living more freely and more authentically. Some of the manuscripts once part of Giovanni Pico della Mirandola’s collection transmit autograph notes, which have been useful to reconstruct his library. A peculiar case is represented by the notes transmitted in a codex containing the Latin translation of Moses Maimonides’ Guide of the Perplexed. These notes are actual corrections to the translation made mostly on the basis of a comparison with the Hebrew text, while in some other cases they derive from a specific interpretation. The aim of this (...) paper is to present some characteristics of the textual revisions, in particular with reference to the Hebrew source. The palaeographic data demonstrate Pico’s direct involvement, which leads to the question of the authorship of these notes, namely if they were the result of an autonomous work or of a collaboration with some other scholar. I argue against various versions of the ‘attitude’ view of consent and of the ‘action’ view of consent: I show that neither an attitude nor an action is either necessary or sufficient for consent. I then put forward a different view of consent based on the idea that, given a legitimate epistemic context, absence of dissent is sufficient for consent: what is crucial is having access to dissent. In the latter part of the paper I illustrate my view of consent (...) by applying it to the case of consenting to being an organ donor. (shrink)

Greg Janzen has recently criticised my defence of Frankfurt’s counterexample to the Principle of Alternate Possibilities by arguing that Jones avoids killing Smith in the counterfactual scenario. Janzen’s argument consists in introducing a new thought-experiment which is supposed to be analogous to Frankfurt’s and where the agent is supposed to avoid A-ing. Here I argue that Janzen’s argument fails on two counts, because his new scenario is not analogous to Frankfurt’s and because the agent in his new scenario does not (...) avoid A-ing. (shrink)

I analyse the relationship between the Doctrine of Double Effect and the Trolley Problem: the former offers a solution for the latter only on the premise that killing the one in Bystander at the Switch is permissible. Here I offer both empirical and theoretical arguments against the permissibility of killing the one: firstly, I present data from my own empirical studies according to which the intuition that killing the one is permissible is neither widespread nor stable; secondly, I defend a (...) normative principle according to which killing the one in Bystander at the Switch is not permissible. Can Marxist-Leninist philosophy disregard dialectical materialism, the analysis of material and social contradictions, the need to overcome and resolve them in the service of revolutionary transformation? ‘Does the lecturer acknowledge that the philosophy of Marxism is dialectical materialism’, as Lenin asked Bogdanov one day in May 1908? What had 'official Soviet Marxism' really become, capable of combining ideological dictatorship with militant philosophical ignorance, in turn justified by the achievements of modern science, skilfully used as an instrument of domination and preservation (...) of the established order? How can one conceptually dominate reality and its contradictions, knowing well that knowledge is never neutral but is class-based? These questions are answered by Evald Ilyenkov, one of the greatest Marxist philosophers of the 20th century, re-examining Lenin's Materialism and Empiriocriticism at the end of the 1970s with a text entitled Leninist Dialectics and the Metaphysics of Positivism, still unpublished in Italy, and identifying in the revolutionary leader an exceptional theoretical ally. Just as Lenin had had to fight the attacks promoted by the theories of Bogdanov, who approached the empirio-criticism of Mach, Avenarius and Berman, seeing it as dogmatic and reactionary materialism directed against the natural sciences, so Ilyenkov fought against the penetration of positivism into Soviet politics and philosophy, criticizing the rejection of the dialectic only functional to the technocratic project of building 'socialism' in the Brezhnev era, a disguised heir of the empirio-criticism denounced by Lenin as the natural metaphysical conclusion to the logic of positivism. In 1931, Evgeny Pashukanis, the distinguished Soviet jurist, author of “The General Theory of Law and Marxism”, following an invitation to celebrate the centenary of Hegel’s death, published an assay entitled “Hegel, the State and Law” (Гегель. Государство и право) aimed to demistify, through a brief retrospective of Hegelian’s philosophy, its specific use, something achieved through the bourgeois ideology which, at some point in history, abandoned Kantism and its followers to embrace Neo-Hegelianism as a philosophy of domination and social control. (...) In this unpublished text, Pashukanis reflects, from a Marxist and Leninist point of view, on the ability to use Hegel as a bourgeois defense tool, when a particular society, specifically the one from the 1920s to the 1930s, began to be affected by the fear of communism and by the crises that endanger its very survival. From this angle, the capitalist interest - following Pashukanisian interpretation of Hegel - will only develop in the terms of a scientific elimination of all those subversive potentials that the economic crisis is destined to produce, thus reformulating the notions of State and Law which, in between obedience, discipline and defense of the homeland, come to assert the official recognition of the inexorably crushed proletariat in a condition in which all relations of production and social reproduction are transferred to the realm of exploitation, as its definitive subsumption to capital.
