  1. Introducing THE PHILOSOPHY OF CREATIVITY.Elliot Samuel Paul & Scott Barry Kaufman - 2014 - In Elliot Samuel Paul & Scott Barry Kaufman (eds.), The Philosophy of Creativity. New York: Oxford University Press. pp. 3-14.
Creativity pervades human life. It is the mark of individuality, the vehicle of self-expression, and the engine of progress in every human endeavor. It also raises a wealth of neglected and yet evocative philosophical questions: What is the role of consciousness in the creative process? How does the audience for a work for art influence its creation? How can creativity emerge through childhood pretending? Do great works of literature give us insight into human nature? Can a computer program really be (...)

  3. Normative monism and radical deflationism.Samuele Chilovi - 2024 - Jurisprudence 15 (2):182-193.
Scott Hershovitz’s Law is a Moral Practice develops a bold, novel, and comprehensive account of law: the moral practice picture. Its central thesis is that legal relations (rights, duties, powers, etc.) are moral. They are real, full-fledged normative relations, connected to genuine reasons for action, and endowed with robust normativity. Nothing less than ordinary moral relations. The account is compounded with a deflationary view of theories in general jurisprudence and of the debates about them. In this vein, Hershovitz recommends (...)

According to the moral standards most of us accept and live by, morality generally permits us to refrain from promoting the good of others and instead engage in non-harmful projects of our own choice. This aspect of so-called ‘ordinary morality’ has turned out to be very difficult to justify. Recently, though, various authors, including Bernard Williams and Samuel Scheffler, have proposed “Integrity Theories” that would vindicate this aspect of ordinary morality, at least in part. They are generated by treating (...)

Scott Kretchmar recently put forth a new definition of what it is to play a game. Unfortunately, it must be rejected. In this paper, I show that this new definition is far too broad by discussing an activity that is not an instance of playing a game but is wrongfully ruled as one on this new definition.

Phenomenal Illusionists suppose that things do seem this way, even though things are not this way. They attempt to explain how it is that we are subject to a pervasive phenomenal illusion. More recently, Cognitive Error Theorists have argued that our experiences do not seem that way; rather, we are subject to an error that leads us mistakenly (...)

Dispositional Essentialism is a unified anti-Humean account of the metaphysics of low-level physical properties and laws of nature. In this paper, I articulate the view that I label Canonical Dispositional Essentialism, which comprises a structuralist metaphysics of properties and an account of laws as relations in the property structure. I then present an alternative anti-Humean account of properties and laws. This account rejects CDE’s structuralist metaphysics of properties in favour of a view of properties as qualitative grounds of dispositions and (...)

Theories of free will are often measured against how well they capture everyday intuitions about free will. But what are these everyday intuitions, and what theoretical commitments do they express? Empirical methods have delivered mixed messages. In response, some free will theorists have developed error theories to undermine the credentials of countervailing intuitions. These efforts are predicated on the idea that people might misunderstand determinism in any of several ways. This paper sheds light on the comprehension problem. We first discuss (...)

This paper shows how a niche account of the metaphysics of laws of nature and physical properties—the Powers-BSA—can underpin both a sense in which the laws are metaphysically necessary and a sense in which it is true that the laws could have been different. The ability to reconcile entrenched disagreement should count in favour of a philosophical theory, so this paper constitutes a novel argument for the Powers-BSA by showing how it can reconcile disagreement about the laws’ modal status. The present studies investigate how the intentions of third parties influence judgments of moral responsibility for other agents who commit immoral acts. Using cases in which an agent acts under some situational constraint brought about by a third party, we ask whether the agent is blamed less for the immoral act when the third party intended for that act to occur. Study 1 demonstrates that third-party intentions do influence judgments of blame. Study 2 finds that third-party intentions only influence moral (...)

Hardcore actualism (HA) grounds all modal truths in the concrete constituents of the actual world (see, e.g., Borghini and Williams (2008), Jacobs (2010), Vetter (2015)). I bolster HA, and elucidate the very nature of possibility (and necessity) according to HA, by considering if it can validate S5 modal logic. Interestingly, different considerations pull in different directions on this issue. To resolve the tension, we are forced to think hard about the nature of the hardcore actualist's modal reality and how radically (...)

Attribution theorists assume that character information informs judgments of blame. But there is disagreement over why. One camp holds that character information is a fundamental determinant of blame. Another camp holds that character information merely provides evidence about the mental states and processes that determine responsibility. We argue for a two-channel view, where character simultaneously has fundamental and evidential effects on blame. In general, claims to the effect that some proposition is impossible/necessary require significant argumentative support and, in general, claims to the effect that some proposition is possible/contingent are thought to be justified freely or by default. Call this the possibility bias. In this paper, I argue that the possibility bias is not epistemically justified. We (...)

  43. Debating Powers: Where the Real Puzzle Lies.Samuel Kimpton-Nye - forthcoming - Inquiry: An Interdisciplinary Journal of Philosophy.
Stephen Mumford and Alexander Bird disagree about which properties are powers and, correspondingly, about the extent of the philosophical work to which powers may be put. Unfortunately, there is an important respect in which these authors are talking past each other and so the reason for their disagreement remains obscured. I highlight what has gone wrong in their recent exchange, attempt to clear up the confusion and pinpoint the true source of their disagreement. My hope is to redirect the efforts (...)

  45. OS EFEITOS DA GLOBALIZAÇÃO NOS DISCURSOS DE FORMAÇÃO DE PROFESSORES NO BRASIL.Alex Pereira De Araújo - 2009 - Anais Do I Colóquio Discurso e Práticas Culturais (Dipracs) 1 (1):1-9.

This study takes up the discussion held by Philippe Sabot in Foucault, Sade and the Enlightenment when it came the Marquis de Sade's work uses in studies conducted by Michel Foucault from Madness and Civilization to The Will to Knowledge. What interests us know of this relationship? This is the main question that guided our study.

This comment text brings, at the end, a part of Surveiller et Punir (Discipline and Punish), which has not been translated into Portuguese and does not appear in more than 40 editions of the Brazilian translation. It is on the back cover of the original in French, as if it were an afterword, signed by the author himself, Michel Foucault, which more than 40 years ago published by Editions Gallimard, his first copies in February 1975. Two years later, the Brazilian (...)

  49. What ‘Just Culture’ doesn’t understand about just punishment.Samuel Reis-Dennis - 2018 - Journal of Medical Ethics 44 (11):739-742.
Recent years have seen the rise of ‘Just Culture’ as an ideal in the patient safety movement, with numerous hospitals and professional organisations adopting a Just Culture response to incidents ranging from non-culpable human error to intentional misconduct. This paper argues that there is a deep problem with the Just Culture model, resulting from its impoverished understanding of the value of punitive, fundamentally backward-looking, practices of holding people accountable. I show that the kind of ‘accountability’ and ‘punishment’ contemporary Just Culture (...)

The growing range of methods for statistical model selection is inspiring new debates about how to handle the potential for conflicting results when different methods are applied to the same data. While many factors enter into choosing a model selection method, we focus on the implications of disagreements among scientists about whether, and in what sense, the true probability distribution is included in the candidate set of models. While this question can be addressed empirically, the data often provide inconclusive results (...)
