It is becoming more common that the decision-makers in private and public institutions are predictive algorithmic systems, not humans. This article argues that relying on algorithmic systems is procedurally unjust in contexts involving background conditions of structural injustice. Under such nonideal conditions, algorithmic systems, if left to their own devices, cannot meet a necessary condition of procedural justice, because they fail to provide a sufficiently nuanced model of which cases count as relevantly similar. Resolving this problem requires deliberative capacities uniquely (...) available to human agents. After exploring the limitations of existing formal algorithmic fairness strategies, the article argues that procedural justice requires that human agents relying wholly or in part on algorithmic systems proceed with caution: by avoiding doxastic negligence about algorithmic outputs, by exercising deliberative capacities when making similarity judgments, and by suspending belief and gathering additional information in light of higher-order uncertainty. In this paper, I identify a theoretical and political role for ‘white ignorance’, present three alternative accounts of white ignorance, and assess how well each fulfils this role. On the Willful Ignorance View, white ignorance refers to white individuals’ willful ignorance about racial injustice. On the Cognitivist View, white ignorance refers to ignorance resulting from social practices that distribute faulty cognitive resources. On the Structuralist View, white ignorance refers to ignorance that (1) results as part of a social process that (...) systematically gives rise to racial injustice, and (2) is an active player in the process. I argue that, because of its greater power and flexibility, the Structuralist View better explains the patterns of ignorance that we observe, better illuminates the connection to white racial domination, and is overall better suited to the project of ameliorating racial injustice. Bettina Schöne-Seifert and Marco Stier present a host of detailed and intriguing arguments to the effect that potentiality arguments have to be viewed as outdated due to developments in stem cell research, in particular the possibility of re-setting the development potential of differentiated cells, such as skin cells. However, their argument leaves them without an explanation of the intuitive difference between skin cells and human beings, which seems to be based on the assumption that a skin cell is merely part (...) of a human organism, while an embryo is at some point a human organism. An appropriately designed concept of the human organism can explain the difference, but also has the potential of re-dividing the argumentative landscape along familiar lines. (shrink)

The democratic boundary problem raises the question of who has democratic participation rights in a given polity and why. One possible solution to this problem is the all-affected principle, according to which a polity ought to enfranchise all persons whose interests are affected by the polity’s decisions in a morally significant way. While AAP offers a plausible principle of democratic enfranchisement, its supporters have so far not paid sufficient attention to economic participation rights. I argue that if one commits oneself (...) to AAP, one must also commit oneself to the view that political participation rights are not necessarily the only, and not necessarily the best, way to protect morally weighty interests. I also argue that economic participation rights raise important worries about democratic accountability, which is why their exercise must be constrained by a number of moral duties. (shrink)

Dans cette contribution, j'examinerai l'argument qui renvoie dos à dos le théisme et l'athéisme et qui structure la présentation de l'alternative que constitue le Dieu à venir. N'étant ni adhérant, ni sympathisant du réalisme spéculatif, je ne proposerai pourtant pas de critique externe de la philosophie de la religion proposée par Meillassoux. De manière heuristique, je vais tenir pour acquis Après la finitude et je montrerai ce qui me semble être les faiblesses de l'argument, critiques rendant finalement peu crédible l'affirmation (...) que peut encore venir un Dieu qui ne serait ni le Dieu métaphysique, ni le Dieu du sentiment religieux. Pour cela, je vais reprendre le dilemme spectral (Meillassoux) et discuter la cohérence du concept de Dieu à venir ainsi que sa pertinence pour résoudre le dilemme. Il apparaitra alors que si l'on admet la contingence absolue, on ne peut croire raisonnablement en un Dieu, même à venir. D'où le désespoir absolu. (shrink)

The paper investigates whether it is plausible to hold the late stage demented criminally responsible for past actions. The concern is based on the fact that policy makers in the United States and in Britain are starting to wonder what to do with prison inmates in the later stages of dementia who do not remember their crimes anymore. The problem has to be expected to become more urgent as the population ages and the number of dementia patients increases. This paper (...) argues that the late-stage demented should not be punished for past crimes. Applicable theories of punishment, especially theories with an appropriate expressivist, or communicative element, fail to justify the imprisonment of the late-stage demented. Further imprisonment would require a capacity for comprehension on the part of the punished, and, under certain narrowly specified conditions, even a capacity to be at least in principle capable of recalling the crime again. Cette refondation s’appuie sur ses propres travaux empiriques, notamment sur le religieux, sur l’usage de méthodes plus pointillistes comme la photographie ou la description des détails, ainsi que sur des hypothèses relatives à la différence entre Sapiens et Néandertal. Les nouvelles propositions de travail qu’il avance empruntent souvent à la philosophie comme moyen d’une réflexion épistémologique, mais aussi parfois à la métaphysique. Why do we so often care about the outcomes of games when nothing is at stake? There is a paradox here, much like the paradox of fiction, which concerns why we care about the fates and threats of merely fictional beings. I argue that the paradox threatens to overturn a great deal of what philosophers have thought about caring, severing its connection to value and undermining its moral weight. I defend a solution to the paradox that draws on Kendall Walton's (...) solution to the paradox of fiction, developing his idea that it be extended to games. The solution takes games to involve make‐believe: in particular, players and spectators make‐believe that the outcome of the game matters. I also explore how the phenomenon extends beyond games. And I explore some moral implications: in particular, my view preserves the idea that we have reason not to impede others in their pursuit of what they care about. (shrink)

L’épistémologie des croyances religieuses qui pose la question de la rationalité des croyances peut être mise en question en introduisant des éléments de sciences sociales des religions et vice-versa. Un modèle épistémologique souligne que les croyances peuvent être garanties sans examen réflexif de la part du croyant. Mais dans un contexte pluraliste où la croyance particulière est mise en débat, l’exigence critique d’examen est une condition nécessaire de rationalité. En cela, l’épistémologie retrouve certains aspects de la sociologie de la critique (...) dans sa compréhension des manières de croire. Cependant, l’épistémologie dépasse l’approche de la sociologie pragma- tique car elle ne renonce pas à l’évaluation de la rationalité des croyances religieuses en évaluant les arguments pro et contra. There is a widespread consensus that a commodification of body parts is to be prevented. Numerous policy papers by international organizations extend this view to the blood supply and recommend a system of uncompensated volunteers in this area—often, however, without making the arguments for this view explicit. This situation seems to indicate that a relevant source of justified worry or unease about the blood supply system has to do with the issue of commodification. As a result, the current health minister (...) of Ontario is proposing a ban on compensation even for blood plasma—despite the fact that Canada can only generate 30 % of the plasma needed for fractionation into important plasma protein products and has to purchase the rest abroad. In the following, I am going to suggest a number of alternative perspectives on the debate in order to facilitate a less dogmatic and more differentiated debate about the matter. Especially in light of the often over-simplified notions of altruism and commodification, I conclude that the debate has not conclusively established that it would be morally objectionable to provide blood plasma donors with monetary compensation or with other forms of explicit social recognition as an incentive. This is especially true of donations for fractionation into medicinal products by profit-oriented pharmaceutical companies. (shrink)

According to orthodoxy, the most fundamental kind of causation involves one event causing another event. I argue against this event‐causal view. Instead, the most fundamental kind of causation is thing causation, which involves a thing causing a thing to do something. Event causation is reducible to thing causation, but thing causation is not reducible to event causation, because event causation cannot accommodate cases of fine‐grained causation. Michael Quante’s book Person offers a systematic and argumentative assessment of the question what a person is and accounts for the multiple aspects that play a role in our everyday understanding of the term. Quante is skeptical about the possibility of constructing a purely psychological account of the person and proposes to base the diachronic unity conditions of persons on the human organism. At the same time he acknowledges that psychological considerations, including the notion of a person’s personality, are important (...) for practical purposes. However, one may wonder why he proposes the human organism as the remedy for the alleged shortcomings of the psychological approach, rather than introducing an additional physical continuity requirement of the cerebrum or other parts of the brain. We argue that supererogation cannot be understood just in terms of reasons for action. In addition to reasons, a theory of supererogation must include prerogatives, which can make an action permissible without counting in favor of doing it.

Some theists have adopted materialism for human persons. They associate this metaphysics with their belief in resurrection and focus on problems arising from personal identity, temporal gaps or material constitution, but, in this paper, I argue that being a materialist for human persons leads to an epistemological problem regarding our knowledge of God’s life. The only way to avoid this problem is to choose a particular materialist metaphysics for human persons, that is, a constitution theory that emphasizes the irreducibility of (...) the first-person perspective. When it comes to evaluating reductive hypotheses in metaphysics, supervenience arguments are the tools of the trade. Jaegwon Kim and Frank Jackson have argued, respectively, that strong and global supervenience are sufficient for reduction, and others have argued that supervenience theses stand in need of the kind of explanation that reductive hypotheses are particularly suited to provide. Simon Blackburn's arguments about what he claims are the specifically problematic features of the supervenience of the moral on the natural have also been (...) influential. But most discussions of these arguments have proceeded under the strong and restrictive assumptions of the S5 modal logic. In this paper we aim to remedy that defect, by illustrating in an accessible way what happens to these arguments under relaxed assumptions and why. The occasion is recent work by Ralph Wedgwood, who seeks to defend non-reductive accounts of moral and mental properties together with strong supervenience, but to evade both the arguments of Kim and Jackson and the explanatory challenge by accepting only the weaker, B, modal logic. In addition to drawing general lessons about what happens to supervenience arguments under relaxed assumptions, our goal is therefore to shed some light on both the virtues and costs of Wedgwood's proposal. When, if ever, do we wrong ourselves? The Self-Other Symmetric answer is: when we do to ourselves what would wrong a consenting other. The standard objection, which has gone unchallenged for decades, is that Symmetry seems to imply that we wrong ourselves in too many cases—where rights are unwaivable, or “self-consent” is lacking. We argue that Symmetry not only survives these would-be counterexamples; it explains and unifies them. The key to Symmetry is not, as critics have supposed, the bizarre claim (...) that we must literally give ourselves consent if we are to avoid wronging ourselves. Instead, it is that we authorize ourselves simply by making decisions, just as we can authorize others by making decisions jointly. (shrink)

In this article, I explain how and why different attempts to defend absolute divine simplicity fail. A proponent of absolute divine simplicity has to explain why different attributions do not suppose a metaphysical complexity in God but just one superproperty, why there is no difference between God and His super-property and finally how a absolute simple entity can be the truthmaker of different intrinsic predications. It does not necessarily lead to a rejection of divine simplicity but it shows that we (...) may consider another conception of divine simplicity compatible with some metaphysical complexity in God. L’objectif de cet article est de comprendre l’importance de la métaphysique analytique pour le travail philosophique et pour l’enseignement dans le contexte français. Pour cela, je commencerai par exposer ce qu’il faut entendre par métaphysique analytique, puis j’examinerai plusieurs conditions de possibilité de la métaphysique analytique en France : la relecture de l’histoire de la métaphysique, des découvertes en logique, une réflexion sur l’objectif et un examen rapide des conditions matérielles et sociales d’enseignement et de recherche.

Pour penser philosophiquement les attitudes religieuses, le concept de croyance est parfois considéré comme inadéquat. Un des reproches souvent développés est qu’une croyance propositionnelle, croire que p, est une attitude trop théorique qui ne peut rendre compte de la foi et de la vie religieuse en général. Il est possible de répondre à ces objections mais cet article évalue la pertinence d’un concept apparemment plus fructueux : l’acceptation. On peut inscrire les travaux de Engel dans le sillage rationaliste des Pères de la philosophie analytique, mais après le tournant naturaliste opéré par Quine. Ce sont les diverses bonnes raisons, exposées de manière non systématique par Engel, d’associer naturalisme et rationalisme que je souhaite présenter tout en cherchant à identifier la difficulté constitutive de ce programme qui ne reçoit pas de solution complète: la normativité épistémique ne semble ni éliminable, ni correctement intégrée à ce programme.

On conçoit assez souvent l’espace public des discussions comme devant être neutre et par conséquent sans mention des croyances religieuses comme raisons justifiant une décision. La neutralité vise à garantir l’acceptabilité par tous d’une décision pouvant être contraignante. On montrera que l’on peut articuler raisons neutres et raisons religieuses à condition que les raisons neutres restent les raisons ultimes. Cela implique que les raisons religieuses correctement liées à des raisons neutres sont parfaitement légitimes pour justifier une décision politique ou publique.

Complex problem solving (CPS) and related topics such as dynamic decision-making (DDM) and complex dynamic control (CDC) represent multifaceted psychological phenomena. In a broad sense, CPS encompasses learning, decision-making, and acting in complex and dynamic situations. Moreover, solutions to problems that people face in such situations are often generated in teams or groups. In turn, this adds another layer of complexity to the situation itself because of the emerging issues that arise from the social dynamics of group interactions. This framing (...) of CPS means that it is not a single construct that can be measured by using a particular type of CPS task (e.g. minimal complex system tests), which is a view taken by the psychometric community. The proposed approach taken here is that because CPS is multifaceted, multiple approaches need to be taken to fully capture and understand what it is and how the different cognitive processes associated with it complement each other. The current ethical and regulatory framework for research is often charged with burdening investigators and impeding socially valuable research. To address these concerns, a growing number of research ethicists argue that informed consent should be adapted to the risks of research participation. This would require less rigorous consent standards in low-risk research than in high-risk research. However, the current discussion is restricted to cases of research in which the risks of research participation are outweighed by the potential clinical benefits for (...) the individual research participant. Furthermore, current proposals do not address the worry that risk-adapted informed consent may result in enrolling participants into research without their autonomous authorization. In this paper, we show how the standard view of informed consent – consent as autonomous authorization – can be adapted to risk even when the research does not have a favourable risk-benefit profile for the participant. Our argument has two important implications: first, it implies that current and proposed consent standards are not adequately calibrated to risk and, second, that consent standards also need to be adapted to factors other than risk. Some philosophers of fiction – most famously Jerold Levinson1 - have tried to argue that fictional narrators can never be identified with real authors. This argument relies on the claim that narration involves genuine assertion (not just the pretense of assertion that lacks truthfulness) and that real authors are not in a position to assert anything about beings on the fictional plain - given that they don’t rationally believe in their existence. This debate on the status of narrators depends on (...) the idea that fictional beings and beings in the real worlds reside, as it were, at different levels. The assumption that there is a gap separating the levels of fiction and reality serves as a rationale for the claim that real authors could not possibly be en rapport with the fictional characters that they create (e.g. entertain beliefs about them, etc.). Bien que dénuées de toute systématicité, les publications de Lewis sur le religieux défendent un athéisme très argumenté. L'article vise à montrer comment son athéisme s'articule à l'existence d'une pluralité de dieux.

In this paper, we propose a framework for fostering argumentative skills in a systematic way in Philosophy and Ethics classes. We start with a review of curricula and teaching materials from the German-speaking world to show that there is an urgent need for standards for the teaching and learning of argumentation. Against this backdrop, we present a framework for such standards that is intended to tackle these difficulties. The spiral-curricular model of argumentative competences we sketch helps teachers introduce the relevant (...) concepts and skills to students early on in their school career. The focus is on secondary schools, but the proposal can also be of use for learning and teaching in universities, especially in introductory classes. (shrink)

Anscombe famously said that there are some act types that can only be done intentionally. We defend this claim: some act types are essentially intentional. We argue that Ving intentionally is itself essentially intentional: it is not possible to be non-intentionally Ving intentionally. And we show how this explains why various other act types—such as trying, lying, and thanking—are essentially intentional. Finally, building on Piñeros Glassock (2020) and Beddor & Pavese (2022), we explain how this makes trouble for the thesis (...) that if I am Ving intentionally, I know that I am Ving. (shrink)

Based on the Aristotelian dynamis-energeia-differentiation, a concept issuing dynamic coherence providers as the sub-level of individual realizations. This logical sub-level is given for any kind of realizations. Based on this two-level approach, to some degree similar to the two-level approach developed by Polanyi, model of biopsychosocial interaction is established. It is suggested as the theoretical basis for a person-centered approach in healthcare, integrating science and humanitites.

We defend a new constraint on the progressive that says that what you are doing is always specific in an important sense. This principle is Progressive Specificity: if you are Ving and to V is to X or to Y, then you are Xing or you are Ying. We offer three arguments for Progressive Specificity. We then extend those arguments to an analogous principle governing the futurative progressive. Although other animals can make simple tools, the expanded and complex material culture of humans is unprecedented in the animal kingdom. Tool making is a slow and late-developing ability in humans, and preschool children find making tools to solve problems very challenging. This difficulty in tool making might be related to the lack of familiarity with the tools and may be overcome by children's long term perceptual-motor knowledge. Thus, in this study, the effect of tool familiarity on tool making was (...) investigated with a task in which 5-to-6-year-old children (n = 75) were asked to remove a small bucket from a vertical tube. The results show that children are better at tool making if the tool and its relation to the task are familiar to them (e.g., soda straw). Moreover, we also replicated the finding that hierarchical complexity and tool making were significantly related. Results are discussed in light of the ideomotor approach. (shrink)

Das deutsche Gesundheitswesen steht durch die schnell steigende Anzahl an CO- VID-19-Erkrankten vor erheblichen Herausforderungen. In dieser Krisensituation sind alle Beteiligten mit ethischen Fragen konfrontiert, beispielsweise nach gerech- ten Verteilungskriterien bei begrenzten Ressourcen und dem gesundheitlichen Schutz des Personals angesichts einer bisher nicht therapierbaren Erkrankung. Daher werden schon jetzt klinische und ambulante Ethikberatungsangebote verstärkt mit Anfragen nach Unterstützung konfrontiert. Wie können Ethikberater*innen Entscheidungen in der Krankenversorgung im Rahmen der COVID-19-Pandemie unterstützen? Welche Grenzen von Ethikberatung sind zu beachten? Bislang liegen hierzu (...) noch wenige praktische Erfahrungen vor. Angesichts der dynamischen Entwicklung erscheint es der Akademie für Ethik in der Medizin (AEM) wichtig, einen Diskurs über die angemessene Rolle der Ethikberatung bei der Bewältigung der vielfachen Heraus- forderungen durch die COVID-19-Pandemie zu führen und professionelle Hinweise zu geben. Mit dem vorliegenden Diskussionspapier möchte die AEM einen Beitrag zur Beantwortung wesentlicher Fragen leisten, die sich für die Ethikberatung in den verschiedenen Bereichen des Gesundheitswesens stellen. Sie regt an, diesen Dis- kurs weiter zu führen und hat ein Online-Forum (s. unten) eingerichtet, in dem Ethikberater*innen ihre Erfahrungen teilen und die professionelle Selbstreflexion der Ethikberatung in Pandemiezeiten mit Anregungen fördern können. In this paper, I argue that sportspersonship is a means of performing fundamental sociality; it is about the conversion of a foe (inimicus) into an enemy (hostis). Drawing on Carl Schmitt’s distinction between enemy and foe – inimicus and hostis – as well as his discussion of the ius publicum Europaeum, I suggest a model of sportspersonship that sees it as expressing the competitive relations between equals that undergird the most minimal form of sociality; relations that any deeper union (...) takes as its foundation. It is the performance of this fundamental sociality, I argue, that grounds the value of sport in general (though this does not mean that there cannot be other, contingent values in sport). (shrink)

In this essay, I attempt to measure various prevailing democratic theories against an argument that Carl Schmitt advances in the first chapter of his ‘Crisis of Parliamentary Democracy’. In practice, he claims there, democratic politics is compelled to introduce a distinction between ‘the will of the people’ and the behaviour of the empirical people, thus justifying the bracketing and unlimited suspension of the latter in the name of the former, even to the point of dictatorship. I argue that no (...) contemporary approach to democracy as a fundamental value is able to mount a compelling response to this critique and that we should therefore reconsider the status of democracy as a normative commitment. I proceed by carefully and closely reading Schmitt’s chapter and then by juxtaposing various currents of democratic theory (including liberal, deliberative, epistemic and various hybrids thereof) with the trajectory of Schmitt’s argument. This essay is therefore less of a contribution to Schmitt scholarship, in the sense that it does not take a panoramic view of his corpus to determine his final stance on democracy, and more of an intervention into contemporary democratic theory using Schmitt’s argument as a kind of lever. There is a particular ressonance between the thinking of Walter Benjamin and that of the German jurist Carl Schmitt, including the fact that both analyse the 16th and 17th centuries in order to understand the 20th. Regarding this fact, the article attempts to clarify some themes that lead Schmitt’s work, i.e that of State of Exception, that of theologization of politics, the critique of parliamentarism as support of the Modern State, the tension between democracy and dictatorship, to explain (...) how the dialog between the two thinkers occurs, seeking thus for a better understanding of key works of Benjamin, specially The Origin of German Tragic Drama. The concept of the exception has heavily shaped modern political theory. In modernity, Kierkegaard was one of the first philosophers to propound the exception as a facilitator of metaphysical transcendence. Merging Kierkegaard’s metaphysical exception with early modern political theorist Jean Bodin’s theory of sovereignty, Carl Schmitt introduced sovereignty to metaphysics. He thereby made an early modern concept usable in a post-metaphysical world. This essay carries Schmitt’s appropriation one step further. Drawing on Walter Benjamin’s replacement of transcendental metaphysics with (...) contingent creaturehood, it reintroduces the anti-foundationalist concept of repetition that was implicit in Kierkegaard’s paradigm but which was not made lucid until Benjamin crafted from the Schmittian exception a vision of political life grounded in creaturely existence. -/- . Bu amaçla Weimar dönemi hukukçuları üzerinde önemli etkisi olan Carl Friedrich Wilhelm von Gerber ve Paul Laband'ın anayasa düşünceleri ekseninde Alman İmparatorluğu'nun hukuk mirası incelenmiştir. Weimar Cumhuriyeti'nin krizlerle şekillenen politik atmosferi, politik felsefe açısından verimli tartışmaların ortaya çıkmasını sağlamıştır. Bu tartışmaların izi; dönemin hukukçularından Gerhard Anschütz, Richard Thoma, Georg Jellinek, Hans Kelsen ve Hermann Heller'ın demokrasi ve (...) diktatörlük tartışmasına kaynaklık eden düşünceleri üzerinden sürülmüştür. Schmitt, çoğunluğu 1920'li yıllara denk gelen anayasa hukuku çalışmaları ile Weimar dönemi hukuk tartışmaları arasında belirleyici bir yerde durmaktadır. Schmitt ile anayasanın koruyuculuğu ve parlamentarizm hakkında polemiğe giren düşünürler, kitabın ayrı bir bölümünün konusunu oluşturmaktadır. Politik felsefenin güncel bir uğrağı olmayı sürdüren Schmitt'in demokrasi ve diktatörlük üzerine düşünceleri, çağdaş dünyanın karşı karşıya kaldığı demokrasi sorunlarının derinleştirilmesinde verimli bir kaynaktır. Bu kitabın amaçları arasında, kendi tarihsel bağlamı içerisinde Schmitt'in devlet düşüncesinin spesifik bir incelemesini yapmanın yanında, kendisini diktatörlüğün karşısında konumlandıran liberal demokrasi anlayışını tartışmaya açmak da bulunmaktadır. Carl Schmitt suele ser considerado un crítico de la modernidad por sostener que los principales conceptos de la teoría del Estado son conceptos teológicos secularizados. En este trabajo pretendemos poner de manifiesto que la importancia que Schmitt concede a la teología es aún mayor. En efecto, la secularización se refiere a los conceptos claves de la teoría del Estado, pero la política es previa al Estado. Y para establecer sus categorías, Schmitt se sirve de la teología: el (...) carácter conflictivo o pacífico del hombre remite al pecado original; el dilema amigo/enemigo a la elección entre Dios y el diablo, etc. Exploraremos el .alcance de estas analogías, intentando mostrar el carácter inerradicablemente teológico del pensamiento de Schmitt.
