Recent accounts of coercion can be mapped onto two different axes: whether they focus on the situation of the coercee or the activities of the coercer; and whether or not they depend upon moral judgments in their analysis of coercion. Using this analysis, I suggest that almost no recent theories have seriously explored a non-moralized, coercer-focused approach to coercion. I offer some reasons to think that a theory in this underexplored quadrant offers some important advantages over theories confined to the (...) other quadrants. In particular I suggest that much of our interest in coercion depends on facts about the coercer, such as the sorts of powers coercers must possess to be able to coerce, and on the coercer's intention in using those powers to constrain or alter the coercee's activities. A plausible explanation of the wrongfulness of threatening, advanced most explicitly by Mitchell Berman, is that the wrongfulness of threatening derives from the wrongfulness of the act threatened. This essay argues that this explanation is inadequate. We can learn something important about the wrongfulness of threatening (with implications for thinking about coercion) by comparing credible threats to some other claims of impending harm. A credible bluff threat to do harm is likely to be more and differently wrongful than making intentionally (...) false warnings about other sources of harm. This essay surveys some examples to secure this point, shows that Berman's moralized account of their wrongfulness is wanting, and offers the outline of an approach better suited to explain the wrongfulness of threatening.1. Several prominent theorists have recently advocated reconceptualizing rape as “nonconsensual sex,” omitting the traditional “force” element of the crime. I argue that such a conceptualization fails to capture what is distinctively problematic about rape for women and why rape is pivotal in supporting women’s gender oppression. I argue that conceptualizing rape as coerced sex can replace both the force and nonconsent elements and thereby remedies some of the main difficulties with extant definitions, especially in recognizing “acquaintance” rape as such. In this paper, I try to make sense of the possibility of several forms of voluntarily undertaken “sexual obligation.” The claim that there can be sexual obligations is liable to generate worries with respect to concerns for gender justice, sexual freedom, and autonomy, especially if such obligations arise in a context of unjust background conditions. This paper takes such concerns seriously but holds that, despite unjust background circumstances, some practices that give rise to ethical sexual obligations can actually ameliorate some (...) of the problems caused by such background conditions. Similarly, despite a surface appearance that sexual obligation and sexual autonomy are in tension, this need not be the case. By understanding how practices and conventions regulate the way such obligations can arise, this paper shows how supporting the possibility of sexual obligation can actually facilitate individual efforts to achieve sexual autonomy. Pressuring someone into having sex would seem to differ in significant ways from pressuring someone into investing in one’s business or buying an expensive bauble. In affirming this claim, I take issue with a recent essay by Sarah Conly (‘Seduction, Rape, and Coercion’, Ethics, October 2004), who thinks that pressuring into sex can be helpfully evaluated by analogy to these other instances of using pressure. Drawing upon work by Alan Wertheimer, the leading theorist of coercion, she argues that so long (...) as pressuring does not amount to coercing someone into having sex, her consent to sex answers the important ethical questions about it. In this essay, I argue that to understand the real significance of pressuring into sex, we need to appeal to background considerations, especially the male-dominant gender hierarchy, which renders sexual pressuring different from its non-sexual analogues. Treating pressure to have sex like any other sort of interpersonal pressure obscures the role such sexual pressure might play in supporting gender hierarchy, and fails to explain why pressure by men against women is more problematic than pressure by women against men. I suggest that men pressuring women to have sex differs from the reverse case because of at least two factors: (1) gendered social institutions which add to the pressures against women, and (2) the greater likelihood that men, not women, will use violence if denied, and the lesser ability of women compared to men to resist such violence without harm. One of the questions raised by this important and thought-provoking collection of essays on torture is how and why the consensus that torture is wrong - a consensus enshrined in international law for decade - has become so fragile. As Scott Anderson writes in the introduction to this volume, "[h]ow did abusing and torturing prisoners suddenly become so popular?” The chapters in this volume offer insights into this question from the perspectives of history, psychology, law, philosophy, and sociology. (...) This interdisciplinary approach highlights important and often overlooked aspects of the torture debate. Yet, the questions that the authors take to be important (for example, about whether the justification of torture should even be contemplated) reflect different and sometimes incompatible normative assumptions about what torture is and about what matters in the torture debate. These assumptions, I shall argue, are shaped by, and play a role in shaping, the moral, political, and social narratives that contribute to or resist the toleration of torture in the US and elsewhere. Thus, while the disparate nature of the contributions (perhaps inevitably) undermine the cohesiveness of the volume as a whole, it illuminates, even if it does not resolve, larger questions about the place and function of academic debate in the history and use of torture. RESUMO A bovinocultura sempre esteve atrelada ao desenvolvimento do Brasil e, pensando no avanço, as exigências da máxima eficiência nos sistemas de criação foi pautada na forma de como conseguir realizar a reprodução de bovinos com ênfase na eficiência econômica e reprodutiva. O objetivo deste trabalho é elucidar as principais biotecnologias que auxiliam na maior produtividade reprodutiva de bovinos. Dessa forma, o estudo foi realizado usando artigos do banco de dados do Google acadêmico e SciELO, além de livros do acervo (...) pessoal e sites oficiais. Com o manejo reprodutivo aplicado na bovinocultura, é possível identificar pontos a serem melhorados e implantação de práticas que auxiliam no incremento da eficiência reprodutiva como a estação de monta, que concentra a fertilização dos animais em uma determinada época do ano, o uso do índice de escore corporal, o qual consegue determinar a viabilidade da vaca a ser fertilizada, e a identificação da idade a puberdade, na qual a novilha com 60% de peso vivo quando adulta pode estar apta para reprodução, indicando que a nutrição é um fator importante para reduzir o intervalo entre partos, bem como na indução da precocidade, que ainda pode ser maximizada por uso de bioestimuladores. Assim como a implantação do uso de biotecnologias, que podem adicionar aos planteis, indivíduos geneticamente superiores, saudáveis e eficientes. Dentre as biotecnologias, a inseminação artificial é a mais usada no Brasil, com capacidade de fertilizar vacas com sêmen de touros de genética superior, nacional ou importado. Podem ser citadas ainda as técnicas de transferência de embriões e produção in vitro de embriões como tecnologias a serviço do desenvolvimento da eficiência reprodutiva. A utilização de protocolos hormonais no ciclo estral objetiva a sincronização do estro das vacas para facilitar o emprego das biotecnologias. São vários os protocolos usados para essa finalidade, sendo Ovsynch a base de GnRH e prostaglandina com até 50% de eficácia, protocolos à base de estradiol e progesterona com eficácia de até 86,6%, e protocolos que usam gonadotrofina coriônica equina (eCG), indicados para animais magros por condicionar maior diâmetro folicular, o qual é relacionado com aumento na taxa de prenhez. Dessa maneira, as práticas e tecnologias citadas neste estudo são usadas na reprodução assistida de bovinos. PALAVRAS-CHAVE: Criopreservação. Estro. Gestação. Hipófise. Nutrição. ABSTRACT Cattle farming has always been linked to Brazil’s development and, thinking about advancement, the requirements for maximum efficiency in breeding systems was based on how to achieve the reproduction of cattle with an emphasis on economic and reproductive efficiency. The objective of this work is to elucidate the main biotechnologies that help in the greater reproductive productivity of cattle. Thus, the study was done using articles from the Academic Google and SciELO databases, as well as books from the personal collection and official websites. With the reproductive management applied in cattle farming, it is possible to identify points to be improved and implement practices that help to increase reproductive efficiency, such as the breeding season, which concentrates the fertilization of animals at a certain time of year, use of the body score index, which can determine the viability of the cow to be fertilized, identification of age at puberty, in which the heifer with 60% live weight as an adult may be suitable for reproduction, indicating that nutrition is an important factor in reducing the interval between births, as well as in inducing precocity, which can still be maximized by the use of biostimulators. As well as the implementation of the use of biotechnology, which can add genetically superior, healthy and efficient individuals to the breeding stock. Among the biotechnologies, artificial insemination is the most used in Brazil, with the capacity to fertilize cows with superior genetic bull semen, whether national or imported. Embryo transfer techniques and in vitro embryo production can also be cited as technologies in the service of the development of reproductive efficiency. The use of hormonal protocols in the estrous cycle aims at synchronizing the estrus of cows to facilitate the use of biotechnologies. There are several protocols used for this purpose, with Ovsynch being based on GnRH and prostaglandin with up to 50% efficacy, protocols based on estradiol and progesterone with efficacy of up to 86.6%, and protocols that use equine chorionic gonadotropin (eCG), indicated for lean animals because they condition larger follicular diameter, which is related to an increase in the pregnancy rate. No presente artigo argumentamos que os fatos morais dependem da realidade da consciência. Por esse viés, abordamos, então, que apenas seres sencientes dotados de razão estão aptos a conhecer os valores objetivamente. Considerando a teoria do Pampsiquismo, que afirma ser a consciência uma propriedade essencial da matéria, analisamos a possibilidade de que se organismos subjetivos evoluírem em outros sistemas solares alcançando a racionalidade, poderiam ter a mesma percepção das leis naturais que o homem tem. Nesse contexto, a existência de um (...) direito natural cosmológico é viável. Analisamos, portanto, o realismo moral sob a ótica do Pampsiquismo, segundo Thomas Nagel. Em contraste, examinamos também o Biopsiquismo. Concluímos que o conhecimento do valor terá interpretações distintas para cada uma das teorias da mente. (shrink)

The essay has been written to contribute to the debate on Dooyeweerd’s social philosophy. The goal is to argue that the central focus of his social philosophy is the “problem of order,” not communitarian issues. This article emphasizes that Dooyeweerd’s social theory was not oriented by communitarian concerns, but in comprehending the relation between creational order and social order.

Strawsonian accounts of moral responsibility are widely associated with opposition to hard determinism. However, it is only an historical accident that these views are bundled together. I show that Strawson’s deepest commitments are perfectly consistent with, and even support, a new and improved form of hard determinism. The resulting view is not revisionist about our practices in the way that extant versions of hard determinism are. After setting out my view, I then turn to Latham and Tierney’s (2022) objection to (...) manipulation arguments. I make two points about their objection. First, while extant versions of hard determinism are vulnerable to Latham and Tierney’s objection, my version of hard determinism is not. Second, I argue that their objection raises important questions about what it is for two cases to be morally equivalent. I defend a principle about when cases are morally equivalent. My principle suggests a way to improve Latham and Tierny’s objection to manipulation arguments that are paired with extant variants of hard determinism. However, when paired with my version of hard determinism, manipulation arguments may accommodate Latham and Tierney’s objection. (shrink)

This study of Ralph Pred’s Onflow (MIT Press, 2005) expands on Pred’s arguments and raises doubts about the viability of phenomenology. Showing that Pred’s method is indeed phenomenological, I validate his interpretations of William James as phenomenologist and his critique of John Searle in light of James, which documents the extent to which the role of habit in the constitution of experience is neglected by philosophers. In explaining habit, however, Pred himself reverts to non-phenomenological models drawn from James’ postulate of (...) psycho-physical parallelism. Habit, like causation, poses an unmet challenge to phenomenological methods. In his critique of Gerald Edelman, Pred notes that Edelman falls prey to a metaphysical bias inherent in modern Indo-European languages. But Pred’s acuity in exposing a latent linguistic bias in phenomenological data is a two-edged sword. Revealing an invisible dependence of appearance on language, it casts doubt on the project of getting beyond language to "appearances-in-themselves.". (shrink)

Discussions of sexual ethics often focus on the wrong of treating another as a mere object instead of as a person worthy of respect. On this view, the task of sexual ethics becomes putting the other’s subjectivity above their status as erotic object so as to avoid the harms of objectification. Ward and Anderson argue that such a view disregards the crucial, moral role that erotic objecthood plays in sexual encounters. Important moral features of intimacy are disclosed through the (...) experience of being an erotic object for another, as well as in perceiving another as an erotic object. Drawing on phenomenology, especially the insights of Simone de Beauvoir, Ward and Anderson argue that erotic encounters are shaped by the human condition of ambiguity, where being an object for others is intertwined with bodily agency. Because sexual agency is complex in this way, theories of sexual ethics and responsibility must widen their focus beyond transparent communication and authoritative expressions of will. (shrink)

A história da filosofia é a história das ideias. Porém, para Herman Dooyeweerd, a história da filosofia imanentista é a história de antíteses teóricas radicadas em dialéticas religiosas insolúveis. O objetivo do presente artigo é apresentar o conceito de “motivos básicos religiosos” no pensamento de Herman Dooyeweerd. Em primeiro lugar, será apresentado a concepção de religião em Dooyeweerd e, em seguida, serão apresentados o conceito e o desenvolvimento dos “motivos básicos religiosos” no pensamento ocidental. As conclusões do texto são que (...) esse conceito contribui em demonstrar que há uma dimensão tácita e comunitária na reflexão filosófica e que a impossibilidade de síntese teórica entre polos de “motivos básicos religiosos” imanentistas diz respeito à “dialética religiosa”. O quarto volume da obra "Ordem e História" de Eric Voegelin, intitulado de "A Era Ecumênica", marca a última mudança no pensamento do filósofo alemão. Voegelin rejeita uma concepção linear da história e sugere que as "irrupções espirituais" das civilizações se tornem o objeto de análise para identificar a "ordem da história". A partir disso, Voegelin rejeita os sistemas imanentistas da modernidade, notadamente, ideologias, como "revoltas egofânicas" que trazem desequilíbrio no Intermédio ou "metaxia" entre o cosmos e o além. O (...) objetivo do presente artigo é identificar a concepção de história e a crítica às ideologias modernas na obra "A Era Ecumênica" de Eric Voegelin. Adota-se metodologia exploratória e abordagem qualitativa na investigação do objetivo proposto. O trabalho conclui que, apesar da importante crítica voegiliniana à perda de fundamento transcendente da política moderna, a filosofia política do "último Voegelin" de "A Era Ecumênica" tem pouco a dizer sobre a política concreta, revelando-se uma filosofia da consciência apolítica em sentido normativo. O presente texto tem o objetivo de apresentar a caracterização e crítica de Alasdair MacIntyre ao emotivismo moral, como também as posteriores controvérsias entre Waller-Unwin e John Lemos. Busca-se apresentar a leitura de MacIntyre sobre o emotivismo moral presente no último capítulo de A Short History of Ethics, suas críticas a essa concepção ética nos capítulos dois e três de After Virtue, os argumentos de Bruce Waller e Nicholas Unwin em defesa de uma reformulação do emotivismo moral e as críticas (...) de John Lemos a essa sugestão. Espera-se que o texto contribua na apresentação dos principais argumentos do debate entre MacIntyre e o emotivismo moral, a fim de servir de orientação para outras discussões na área da metaética. In the Foundations of Mathematics, Ramsey attempted to amend Principia Mathematica’s logicism to meet serious objections raised against it. While Ramsey’s paper is well known, some questions concerning Ramsey’s motivations to write it and its reception still remain. This paper considers these questions afresh. First, an account is provided for why Ramsey decided to work on his paper instead of simply accepting Wittgenstein’s account of mathematics as presented in the Tractatus. Secondly, evidence is given supporting that Wittgenstein was not moved (...) by Ramsey’s objection against the Tractarian account of arithmetic, and a suggestion is made to explain why Wittgenstein reconsidered Ramsey’s account in the early thirties on several occasions. Finally, a reading is formulated to understand the basis on which Wittgenstein argues against Ramsey’s definition of identity in his 1927 letter to Ramsey. (shrink)

Esse livro é uma introdução ao pensamento de Abraham Kuyper. O texto se destina àqueles que desejam começar a compreender o pensamento de Kuyper. A primeira parte do livro se dedica à vida e obra de Kuyper, como também à sua articulação do calvinismo como um sistema de vida e pensamento todo abrangente. Na segunda unidade, apresenta-se a relação feita por Kuyper entre calvinismo, ciência e filosofia política. Por fim, na última unidade, expõe-se a articulação entre calvinismo, cultura e artes. (...) Kuyper continua a ser um personagem muito importante para o cristianismo contemporâneo. A filosofia político-social de Herman Dooyeweerd (1894-1977) ainda é pouco conhecida no Brasil. Esse livro, resultado de minhas pesquisas no Mestrado de Filosofia da Universidade Federal da Paraíba, apresenta e discute a perspectiva teórica dooyeweerdiana sobre a ordem de uma sociedade complexa. A filosofia de Herman Dooyeweerd pode contribuir para a reflexão e ação cristã em uma sociedade moderna e plural. Em Dooyeweerd, é possível encontrar uma teoria política e social abrangente para pensar e atuar no ambiente público, rejeitando orientações (...) ideológicas secularistas. Herman Dooyeweerd pode nos ajudar a refletir sobre política e sociedade na medida em que nos faz reconhecer princípios estruturais na realidade criada por Deus que estruturam cada esfera e relação social em seu âmbito de soberania. Em contraponto ao positivismo e ao historicismo, Dooyeweerd nos indica caminhos para compreender as normas divinas para cada centímetro quadrado da existência. Além de denunciar o comprometimento religioso do imanentismo das ideologias políticas, Dooyeweerd tem muito a dizer sobre como pensar política e sociedade na ordem da história. (shrink)

Introduction to the Special Volume, “Method, Science and Mathematics: Neo-Kantianism and Analytic Philosophy,” edited by Scott Edgar and Lydia Patton. At its core, analytic philosophy concerns urgent questions about philosophy’s relation to the formal and empirical sciences, questions about philosophy’s relation to psychology and the social sciences, and ultimately questions about philosophy’s place in a broader cultural landscape. This picture of analytic philosophy shapes this collection’s focus on the history of the philosophy of mathematics, physics, and psychology. The following (...) essays uncover, reflect on, and exemplify modes of philosophy that are engaged with these allied disciplines. They make the case that, to the extent that analytic philosophers are still concerned with philosophy’s ties to these disciplines, we would do well to pay attention to neo-Kantian views on those ties. People who report believing in God fear death. They also experience grief when someone they love dies. Philosophers and social scientists sometimes claim that this can only be plausibly explained by the hypothesis that people who claim to believe in God do not really believe in God. I show that this is mistaken. I identify three independently plausible explanations of why people who genuinely believe in God would have these behaviors and attitudes. First, there is an evolutionary explanation of why (...) the fear of death would be resilient even if one genuinely believes God has good things in store for us after death. Second, people often fear low probability outcomes. It may be that religious people are afraid of hell or the cessation of existence even if they judge those outcomes to have a low probability. Third, belief in God is typically combined with views according to which death is accompanied by the permanent loss and radical transformation of important relationships. (shrink)

Dr Miranda Anderson is an Honorary Fellow in History, Classics and Archaeology at the University of Edinburgh and an Associate Lecturer at the Open University. She has held several prestigious fellowships and was principal investigator of an AHRC-funded project, titled ‘The Art of Distributed Cognition’, which involved collaboration with the Talbot Rice Gallery. Her work has investigated the relations between cognition and culture, particularly literary works, challenging the boundaries between disciplines and engaging with numerous contemporary science, technology and society (...) (STS) questions. In this perspective article, she evokes the ‘fission-fusion’ concept on which she has been working for some years now – a concept that contributes to debates surrounding the issue of identity by drawing on the arts, humanities, social sciences, and natural sciences. In this article, I identify some good-making features of a deliberative democratic theory. The article will proceed as follows: First, I present both some important insights and some shortcomings of Rawls’ theory. I then present Robert Talisse’s account, focusing on how Talisse both accommodates what is right about Rawls while avoiding some of Rawls’ weaknesses. Finally, some positive claims are made about what an adequate deliberative theory might look like.

In this article I seek to come to some understanding of the interlocutors in the first book of Plato’s Republic, particularly Cephalus. A more complete view of Cephalus not only provides some interesting ways to think about Plato and the Republic, but also suggests an interesting alternative to Plato’s view of justice. The article will progress as follows: First, I discuss Plato’s allegory of the cave. I, then, critique the cave allegory by applying the same kind of reasoning that O. (...) K. Bouwsma used to criticize Descartes’ evil genius. Next, I present what I think is a fruitful way to understand Cephalus. Finally, I draw some important conclusions regarding justice and offer some interesting critiques of Plato and Platonism. (shrink)

Alvin Plantinga has famously argued that the naturalist who accepts evolutionary theory has a defeater for all of her beliefs, including her belief in naturalism and evolution. Hence, he says, naturalism, when conjoined with evolution, is self defeating and cannot be rationally accepted. This is known as the evolutionary argument against naturalism (EAAN). However, Tyler Wunder (Religious Studies 51:391– 399, 2015) has recently shown that if the EAAN is framed in terms of objective probability and theism is assumed to be (...) non-contingent, then either theism is necessarily false or the EAAN is unsound. Neither option is attractive to the proponent of the EAAN. Perry Hendricks (Religious Studies 1–5, 2018) has responded to Wunder’s criticism, showing that the EAAN can be salvaged and, indeed, strengthened, by framing it in terms not of naturalism (N), but of a proposition that is entailed by N that is also consistent with theism. We will show that once Hendricks’ solution to Wunder’s objection is accepted, a puzzle ensues: if the EAAN provides the naturalist with a defeater for all of her beliefs, then an extension of it appears to provide God with a defeater for all of his beliefs. After bringing out this puzzle, we suggest several ways in which the proponent of the EAAN might solve it, but also show some potential weaknesses in these purported solutions. Whether the solutions to the puzzle that we consider ultimately succeed is unclear to us. (Translation: the authors disagree. One author thinks that the solutions (or,at least, some of them) that we consider do solve the puzzle while the other author does not.) However, it is clear to us that this is an issue that proponents of the EAAN need to address. (shrink)

There are two ways to characterize symmetric relations. One is intensional: necessarily, _Rxy_ iff _Ryx_. In some discussions of relations, however, what is important is whether or not a relation gives rise to the same completion of a given type (fact, state of affairs, or proposition) for each of its possible applications to some fixed relata. Kit Fine calls relations that do ‘strictly symmetric’. Is there is a difference between the notions of necessary and strict symmetry that would prevent them (...) from being used interchangeably in such discussions? I show that there is. While the notions coincide assuming an intensional account of relations and their completions, according to which relations/completions are identical if they are necessarily coinstantiated/equivalent, they come apart assuming a hyperintensional account, which individuates relations and completions more finely on the basis of relations’ real definitions. I establish this by identifying two definable relations, each of which is necessarily symmetric but nonetheless results in distinct facts when it applies to the same objects in opposite orders. In each case, I argue that these facts are distinct because they have different grounds. (shrink)

Many philosophers, psychologists, and medical practitioners believe that killing is no worse than letting die on the basis of James Rachels's Bare-Difference Argument. I show that his argument is unsound. In particular, a premise of the argument is that his examples are as similar as is consistent with one being a case of killing and the other being a case of letting die. However, the subject who lets die has both the ability to kill and the ability to let die (...) while the subject who kills lacks the ability to let die. Modifying the latter example so that the killer has both abilities yields a pair of cases with morally different acts. The hypothesis that killing is worse than letting die is the best explanation of this difference. (shrink)

O objetivo do presente artigo é comparar as perspectivas de Friedrich von Hayek e Hannah Arendt sobre a relação entre liberdade e política. A perspectiva de Hayek é chamada de liberdade da política devido a seu pessimismo quanto à capacidade da ação política estatal ampliar a liberdade individual. E a perspectiva de Arendt é chamada de liberdade na política devido a sua aceitação positiva do espaço político enquanto campo para o exercício da ação e da liberdade dos indivíduos. A conclusão (...) é que a liberdade na política pressupõe alguma liberdade da política, mas não se contenta com a liberdade negativa. A concretização da liberdade exige participação nos assuntos públicos e vida ativa na esfera pública. (shrink)

Objetiva-se expor o pensamento de Herman Dooyeweerd (1894-1977), prolífico jusfilósofo holandês, no que diz respeito à maneira como destaca o aspecto jurídico da realidade e formula sua concepção de enciclopédia da ciência do Direito. Problematiza-se em que medida a teoria dooyeweerdiana permite o desenvolvimento de um conceito de Direito relevante para a teoria da decisão judicial. Neste afã, após exposição sintética das bases de seu pensamento, verticaliza-se o estudo do aspecto jurídico da realidade e da noção-base de sua Enciclopédia da (...) Ciência do Direito. Explora-se a original perspectiva filosófica dooyeweerdiana sobre a positivação do direito e a interpretação jurídica, ambas limitadas seja pelo inafastável núcleo distintivo do aspecto jurídico (a retribuição), seja pelo dever de considerar o todo dos aspectos da experiência humana e das esferas sociais envolvidas. Conclui-se que o conceito de enciclopédia jurídica em Dooyeweerd, à luz de uma densa e intrigante filosofia cosmonômica, enriquece sobremaneira a clássica discussão jusfilosófica que envolve o papel do direito positivo e os limites da interpretação jurídica, na medida em que oferece valioso prisma integrativo do aspecto jurídico frente aos demais aspectos da experiência humana, colaborando para uma visão jurídica não reducionista, preservadora da irredutibilidade do Direito e conferidora de limites mais claros à decisão judicial. A pesquisa é qualitativa, eminentemente bibliográfica, tendo sido utilizado o método hipotético dedutivo. (shrink)

I defend a new version of the non-identity theodicy. After presenting the theodicy, I reply to a series of objections. I then argue that my approach improves upon similar approaches in the literature.

Some recent psychological studies suggest that the belief that humans matter more than other animals can be strengthened by cognitive dissonance. Jaquet (forthcom- ing) argues that some of these studies also show that the relevant belief is primar- ily caused by cognitive dissonance and is therefore subject to a debunking argument. We offer an alternative hypothesis according to which we are already speciesist but cognitive dissonance merely enhances our speciesism. We argue that our hypothesis explains the results of the studies (...) at least as well as Jaquet’s. We then respond to a series of objections. Along the way, we highlight various respects in which further stud- ies are needed to decide between Jaquet’s hypothesis and ours. (shrink)

Introdução: Hans Kelsen (1881-1973), juspositivista austríaco, e Herman Dooyeweerd (1894-1977), jusfilósofo neerlandês, foram pensadores contemporâneos que presenciaram o avanço do poder totalitário do Estado expresso por meio de normas jurídicas. Ambos se preocuparam em discutir sobre a relação entre Estado e direito, mas se afastaram na formulação de suas jusfilosofias: Kelsen defendeu uma concepção em que o Estado se tornou a personificação da ordem jurídica, Dooyeweerd distinguiu o direito da estrutura do Estado. Objetivo: analisar os comprometimentos teóricos e os problemas (...) político-jurídicos do pensamento de Hans Kelsen a partir da filosofia de Herman Dooyeweerd. Problemáticas: 1) A relação entre Estado e direito em Hans Kelsen é incapaz de proteger a sociedade civil e os indivíduos do poder do Estado, como afirmam os jusnaturalistas?; 2) Toda filosofia que postula princípios normativos limitadores à produção do direito é uma metafísica atemporal que resulta em uma concepção política antipluralista, como defende Hans Kelsen?. Hipóteses: 1) Jusnaturalistas estão corretos ao afirmarem que a Teoria Pura do Direito de Kelsen possibilita um ilimitado poder ao ente estatal face à sociedade civil, sendo incapaz de oferecer-lhe subsídios teóricos para sua proteção; 2) Kelsen não está certo ao entender que toda filosofia que postula princípios normativos limitadores à produção do direito é uma metafísica atemporal que resulta em uma concepção política antipluralista. Justificativas da pesquisa: 1) Analisa, a partir da crítica transcendental dooyeweerdiana, se os compromissos assumidos por Kelsen acerca da realidade o levaram a uma teoria reducionista capaz de tornar a sociedade desprotegida diante do poder do Estado; 2) Investiga se a teoria dooyeweerdiana tem capacidade de superar a tópica jusnaturalismo e juspositivismo. Resultados: 1) Como alegam os jusnaturalistas, a perspectiva política e jurídica de Kelsen, que reduz o direito ao aspecto lógico e delega as discussões de justiça ao âmbito político, não possibilita à sociedade uma proteção jurídica ao poder normativo do Estado; 2) A concepção político-jurídica dooyeweerdiana demonstra ser possível uma filosofia que encontra princípios limitadores à produção do direito na ordem da realidade e reconhece a pluralidadesocial devido à abertura da experiência histórica. Conclusão: sociedades democráticas profundamente polarizadas precisam descobrir normas objetivamente dispostas na realidade capazes de gerar consenso político e positivação legitimada, não por uma metafísica atemporal ou pela vontade impositiva de uma elite, mas pelo reconhecimento de que há uma ordem capaz de gerar mais benefícios para o bem comum. Since the publication of the Remarks on the Foundations of Mathematics, Wittgenstein’s interpreters have endeavored to reconcile his general constructivist/anti-realist attitude towards mathematics with his confessed anti-revisionary philosophy. In this article, the author revisits the issue and presents a solution. The basic idea consists in exploring the fact that the so-called “non-constructive results” could be interpreted so that they do not appear non-constructive at all. The author substantiates this solution by showing how the translation of mathematical results, given by the (...) possibility of translation between logics, can be seen as a tool for partially implementing the solution Wittgenstein had in mind. One might think that if the majority of virtue signallers judge that a proposition is true, then there is significant evidence for the truth of that proposition. Given the Condorcet Jury Theorem, individual virtue signallers need not be very reliable for the majority judgment to be very likely to be correct. Thus, even people who are skeptical of the judgments of individual virtue signallers should think that if a majority of them judge that a proposition is true, then that provides (...) significant evidence that the proposition is true. We argue that this is mistaken. Various empirical studies converge on the following point: humans are very conformist in the contexts in which virtue signalling occurs. And stereotypical virtue signallers are even more conformist in such contexts. So we should be skeptical of the claim that virtue signallers are sufficiently independent for the Condorcet Jury Theorem to apply. We do not seek to decisively rule out the relevant application of the Condorcet Jury Theorem. But we do show that careful consideration of the available evidence should make us very skeptical of that application. Consequently, a defense of virtue signalling would need to engage with these findings and show that despite our strong tendencies for conformism, our judgements are sufficiently independent for the Condorcet Jury Theorem to apply. This suggests new directions for the debate about the epistemology of virtue signalling. (shrink)

Although their contributions to the history of economic thought and their scholarly reputations are firmly established, relatively little is known about the relationship between Carl Menger, founder of the Austrian School of economics, and his son, Karl Menger, the mathematician, geometer, logician, and philosopher of science, whose famous Mathematical Colloquium at the University of Vienna was central to the early literature on the existence of general equilibrium and the concomitant development of mathematical economics. The present paper begins to fill this (...) gap. Karl Menger’s diaries, held in the David M. Rubenstein Rare Book and Manuscript Library at Duke University, offer insight into the intimate relationships within the Menger clan, Karl’s work and study habits, and the development of his uncommonly broad intellect, as well as on life in a vanquished city, Vienna, in the immediate wake of the humiliating defeat of the First World War and the disintegration of the Habsburg Empire. In his Groundwork of the Metaphysics of Morals, Kant’s desiderata for a supreme principle of practical reasoning and morality require that the subjective conditions under which some action is thought of as justified via some maxim be sufficient for judging the same action as justified by any agent in those conditions. This describes the kind of universalization conditions now known as moral supervenience. But when he specifies his “formula of universal law” (FUL) Kant replaces this condition with a quite different (...) kind of universality: the judgment that some agent could rationally (i.e., without willing the frustration of his own valued ends) will his adoption of some maxim under the condition that this would cause all agents in his world to adopt it as well. Our wills typically lack this efficacy, so requiring that our wills conform to what would be rational for a hypothetical agent in this situation to will is a heteronomous requirement. Several intuitively wrong maxims pass Kant’s test but fail the test of supervenience, because they generate no contradiction in a world of universal compliance but do so in non-ideal worlds, demonstrating the inadequacy of the FUL and the logical superiority of moral supervenience. -/- Note that in the published version the title of this article incorrectly had the word "become" instead "became.". In this paper we offer a new argument for the existence of God. We contend that the laws of logic are metaphysically dependent on the existence of God, understood as a necessarily existent, personal, spiritual being; thus anyone who grants that there are laws of logic should also accept that there is a God. We argue that if our most natural intuitions about them are correct, and if they are to play the role in our intellectual activities that we take (...) them to play, then the laws of logic are best construed as necessarily existent thoughts -- more specifically, as divine thoughts about divine thoughts. We conclude by highlighting some implications for both theistic arguments and antitheistic arguments. (shrink)

In Bertrand Russell's 1903 Principles of Mathematics, he offers an apparently devastating criticism of the neo-Kantian Hermann Cohen's Principle of the Infinitesimal Method and its History (PIM). Russell's criticism is motivated by his concern that Cohen's account of the foundations of calculus saddles mathematics with the paradoxes of the infinitesimal and continuum, and thus threatens the very idea of mathematical truth. This paper defends Cohen against that objection of Russell's, and argues that properly understood, Cohen's views of limits and infinitesimals (...) do not entail the paradoxes of the infinitesimal and continuum. Essential to that defense is an interpretation, developed in the paper, of Cohen's positions in the PIM as deeply rationalist. The interest in developing this interpretation is not just that it reveals how Cohen's views in the PIM avoid the paradoxes of the infinitesimal and continuum. It also reveals some of what is at stake, both historically and philosophically, in Russell's criticism of Cohen. (shrink)

The paper considers the significance of F. A. Hayek’s writings on the study of complex phenomena for the study of the very complex phenom- ena of Hayek’s own life and career. It is argued that the methodological principle which Hayek recommended for the investigation of complex phenomena is applicable to explanations of his own intellectual develop- ment. Indeed, it is argued that the extent to which a Hayek scholar re- spects this principle in their attempts to explain Hayek’s life and (...) career is the first criterion by which such attempts should be evaluated. As Hayek himself might have put it, an explanation of some part of his career that neglects its inherent complexity is “probably merely of necessity false” (Hayek, [1964] 2014, 263). (shrink)

If moral properties lacked causal powers, would moral skepticism be true? I argue that it would. Along the way I respond to various arguments that it would not.

Some commentators on Hermann Cohen have remarked on what they take to be a puzzle about the origins of his mature anti-psychologism. When Cohen was young, he studied a kind of psychology, the Völkerpsychologie of Moritz Lazarus and Heymann Steinthal, and wrote apparently psycholgistic accounts of knowledge almost up until the moment he first articulated his anti-psychologistic neo-Kantianism. To be sure, Cohen's mature anti psycholgism does constitute a rejection of certain central commitments of Völkerpsychologie. However, the relation between Völkerpsychologie and (...) Cohen's mature anti-psychologism is not one of straightforward opposition. This paper argues that Cohen had significantly less distance to travel than it appears to get from his early Völkerpsychologie to his mature anti-psychologism. In particular, this paper argues that Cohen always had an anti-psychologistic account of knowledge, even during the period when he was studying Völkerpsychologie, and further, that key features of his Völkerpsychologie partly shaped his mature account of knowledge. Finally, the paper identifies how Cohen’s views did change over the transition from his völkerpsychological period to his later anti-psychologism. It thus identifies what changes in Cohen’s views do need to be explained. (shrink)
