In the context of climate change, this study uncovers the role of green airlines’ social responsibility in conjunction with the consumers’ switching behavior while considering the effects of latent variables, including green psychology, airline corporate image, green experimental behavior, green service fairness, green alternative attractiveness and switching intention, were examined in the study.

Intelligent neurotechnology is an emerging field that combines neurotechnologies like brain-computer interface (BCI) with artificial intelligence. This paper introduces a capability framework to assess the responsible use of intelligent BCI systems and provide practical ethical guidance. It proposes two tests, the threshold and flourishing tests, that BCI applications must meet, and illustrates them in a series of cases. After a brief introduction (Section 1), Section 2 sets forth the capability view and the two tests. It illustrates the threshold test using (...) examples from clinical medicine of BCI applications that enable patients with profound disabilities to function at a threshold level through computer mediation. Section 3 illustrates the flourishing test by exploring possible future applications of BCI involving neuroenhancements for healthy people, using examples adapted from research currently underway in the US military. Section 3 applies a capability lens to a complex case involving dual effects, both therapeutic and non-therapeutic, showing how the threshold and flourishing tests resolve the case. Section 4 replies to three objections: neurorights are the best tool for assessing BCI; the two tests are moving targets; and the analysis utilizes a capability view to do work it is not designed for. The paper concludes that a capability view offers unique advantages and gives practical guidance for evaluating the responsible use of present and future BCI applications. Extrapolating from our analysis may help guide other emerging technologies, such as germline gene editing, expected to impact central human capabilities. (shrink)

Previously, we introduced a capability approach to assess the responsible use of brain-computer interface. In this commentary, we say more about the ethical basis of our capability view and respond to three objections. The first objection holds that by stressing that capability lists are provisional and subject to change, we threaten the persistence of human dignity, which is tied to capabilities. The second objection states that we conflate capabilities and abilities. This is a preliminary essay on the rhetoric of ‘obosen’ of President Rodrigo Duterte. The essay discusses how the President employed the term ‘obosen’ to show his leadership quality characterized by strenght, firmness, patriotism and courage. He used ‘obosen’ as a way to persuade his target audience. The essay explicates how he was able to excellently manipulate and control the Philippine social consciousness. Parmenides may fairly be said to have undertaken two parallel efforts: first, to offer a persuasive account of the nature of ‘what-is’ (to eon); and second, to establish ‘it is’ as the only true and trustworthy way of speaking and thinking about what-is. Fragment 7.3-6 plays a crucial role in this latter effort when Parmenides’ goddess directs the youth to put aside all information obtained through sense perception and instead ‘judge by reason the poludêris elenchos spoken by me.’ Although the (...) meaning of the phrase has been variously understood, I argue that it is properly taken to mean ‘a much-contested testing’ (of the possible ways of inquiry). In characterizing the elenchos as poludêris or ‘much contested’ the goddess is asserting that the decision to follow the ‘it is’ route of inquiry must be continually reaffirmed against the pull of custom and sense experience. When doubts were first raised about the veracity of the dramatic advances in stem cell research announced by Professor Hwang Woo-Suk, a significant minority response was to question the qualifications of journalists to investigate the matter. In this paper I examine the contemporary relationships between science, scientists, the public, and the media. In the modern context the progress of science often relies on the media to mobilise public support for research and also for the purpose of communication within the scientific (...) community. As a result, attempts to counterpose "science" and "the media" should be treated with some caution. I argue that because of the essential role played by ethics in good science, journalists may in fact sometimes be well placed to investigate scientists. At the conclusion of my paper I draw out some of the implications of my analysis for the ethics of investigative journalism directed towards scientific research. (shrink)

This paper revisits the “Hwang case,” which shook Korean society and the world of stem cell research in 2005 with the fraudulent claim of creating patient-specific embryonic stem cells. My goal is to overcome a human-centered, Korea-oriented narrative, by illustrating how materials can have an integral role in the construction and judgment of fraud. To this end, I pay attention to Woo Suk Hwang’s lab at Seoul National University as a whole, including human and nonhuman agents, that functioned as what (...) I call sociomaterial technology, and Gerald P. Schatten at the University of Pittsburgh, Hwang’s collaborator, who played a crucial role in demonstrating the potency of this technology to the members of the scientific community. By recasting the whole event as the “case of Hwang and Schatten,” I argue that fraud is, like all knowledge claims, a sociotechnical construct, and that matters of fraud are locally judged. Fraud leaves its mark on materials, but I show that material evidence alone never tells the whole story and instead can be used to limit the range of responsibility. (shrink)

The aim of the study is to spell out and consider Plato' s views on perceptual cog­nition. It is argued that Plato is cornrnitted to the view that perceptual cognition can be rational, and that beliefs about the sensible world need not be confused or ill-founded. Plato' s interest in the matter arises from worries over the way in which his fore­runners and contemporaries conceived of perceptual cognition. They conceived of cognitive processes in terms of corporeal changes and attempted to (...) explain perceptual cognition in causal terms. The problem with such accounts, according to Plato, is that they make perceptual cognition an entirely passive process, and seem incapable of accommodating the freedom of reason. Plato's main target is Protagoras' view on cognition and he accuses him of con­flating different cognitive phenomena that ought to be kept apart. More particularly, he suggests that Protagoras' 'man the measure' thesis is based on the conflation of sen se perception, belief and appearing, and that Protagoras is cornmitted to the view that beliefs are arrived at in a non-rational way. It is shown how Plato takes issue with Protagoras by disentangling these three cognitive phenomena. It is argued that Plato' s way of understanding these notions leaves room for the possibility that reason plays apart in perceptual cognition and that we arrive at beliefs in a rational way. In the course of spelling out the argument, Plato' s views on a number of topics are scrutinised: the perceptual mechanism; the objects of sense perception; perceptual content; the nature of belief; the eon trast between belief and appearing; the nation of reason. The mythical bronze creature Talos (Greek: Τάλως) was worshiped initially as the god of light or the sun in the Hellenic Island of Crete. He is supposed to have lived in the peak Kouloukona of the Tallaia Mountains in the Gerontospelio cave. His relation towards bronze and fire and his continuous voyage circling the island of Crete most probably introduces the concept of the change of the four seasons. The sun was considered in the area of the South-East Mediterranean nations (...) as just judge, a guardian who monitors and judges from above all the actions of the commoners, a controller for the faithful application of laws in Crete [1]. Hesychios in his Lexicon notes that talos means sun and that the name Tallaios was initially attributed to Zeus [2]. The birth of the Olympian gods forged a new Pantheon and nomenclature forcing some of the old gods to fell into lower deities. This happened to Talos who soon became a mythical hero [1]. According to Apollodorus, the bronze creature was forged by the magnificent constructor Hephaestus as a gift to the mythical King Minoa to help him guard the island [3]. Although the verb “peritrohazo” (Greek: περιτροχαζω) was used, meaning a movement in a steady orbit (track), some depictions image him as a winged being. To protect the island, he was throwing rocks into unknown ships or in the case of a foreign landing he was burning with fire or with his flamed bronze body the intruders. He was holding copper plates with the laws of the island and his circle allowed him to pass all island sores three times daily [1,4-6]. Plato, speaks of him as a real person, suggesting he was the brother of King Rhadamanthys, thus a son of Zeus [5]. Talos may be considered as the token of the Cretan power, a symbol of technological development in the field of metalworking in prehistoric and Minoan times. An animated, programmed gigantic android to enforce its will. A primitive robot for basic actions having a power source, fire and ichor (Greek: ιχώρ) the sacred fluid in the vessels of the gods. The first manufactured being with his individual intelligence, a primary concept of artificial intelligence (AI) [7]. -/- Homer was the first to introduce the term automata (Greek: αυτόματα), to describe ingenious machines built by the supreme blacksmith god of invention and technology, God of metal and fire, Hephaestus, manufactured devices “acting of one’s own will” as the Hellenic word indicates [8]. Eons later, the humanoid automaton the “Automa cavaliere” (English: Automaton knight) appeared in the court of the nobleman and Duke of Milan Ludovico Maria Sforza. It was the year 1495, when Leonardo da Vinci presented his robotic knight, an innovative construction operated by a series of pulleys and cables, presenting though no individual mind. Although it was manufactured by a highly intelligent polymath, it could only be operated through an outer intelligence [9]. Advancements made during the Fourth Industrial Revolution allowed modern technology to manufacture intelligent machines to aid the field of invasive surgery. One of those most sophisticated devises is the da Vince Surgical Tower. -/- Launched in the setting of the 21st century, the DaVinci System is one of the most commonly employed tools/systems, which has prevailed in the field of robotic-assisted surgery [10]. One could claim that it practically reshaped the concept of surgery, providing doctors with immense capabilities, aiming towards the optimal post-operative outcome. Through visual augmentation, high resolution 3D video, enhanced precision and reduced complication rates [11] the DaVinci Si and the latest DaVinci Xi system have been implemented in a variety of surgeries, including but not limited to general, urologic, gynecologic, thoracic and even cardiac procedures; valve and coronary artery bypass graft operations [12,13]. Da Vinci is cleared globally for cardiosurgery and came in vogue to fulfill the dream of cardiac surgeons to operate in closet chest. It offers in patients the same benefits as those that open chest incision surgery procedures do [14]. -/- The more recent DaVinci Xi model was introduced to counteract commonly known drawbacks of the Si system, such as the inability to simultaneously manipulate the different abdominal quadrants [10]. It consists of four boom mounted robotic arms along with a mobile platform and a master console. The latter with the adaptable intraocular distance, the cushioned headrest, the modifiable arm bars and the flexible finger loops, is meticulously designed to meet the surgeon´s “demands” [12]. Every robotic arm has three degrees of freedom, which combined with the EndoWrist technology to imitate the delicate motion of the surgeon´s hand, acquires an extra seven degrees of freedom. Evidently, the combination of the user-friendly interface, the high-quality 3D intraoperative images, the multiple joints and sensors, as well as the surgeon himself, who can learn to handle the DaVinci Xi Surgical System in a relatively short period of time, has established the model in the surgical armamentarium, paving the way towards a continuously progressive future of minimally invasive and robotic surgery (Figure 1) [12]. -/- History testifies that the nomination of the AI surgical tower as da Vinci was wrongfully given to commemorate a majestic historical figure. The History of Ideas is presently enjoying a certain renaissance after a long period of disrepute. Increasing quantities of digitally available historical texts and the availability of computational tools for the exploration of such masses of sources, it is suggested, can be of invaluable help to historians of ideas. The question is: how exactly? In this paper, we argue that a computational history of ideas is possible if the following two conditions are satisfied: (i) Sound Method . A computational history (...) of ideas must be built upon a sound theoretical foundation for its methodology, and the only such foundation is given by the use of models , i.e., fully explicit and revisable interpretive frameworks or networks of concepts developed by the historians of ideas themselves. (ii) Data Organisation. Interpretive models in our sense must be seen as topic-specific knowledge organisation systems (KOS) implementable (i.e. formalisable) as e.g. computer science ontologies. We thus require historians of ideas to provide explicitly structured semantic framing of domain knowledge before investigating texts computationally, and to constantly re-input findings from the interpretive point of view. In this way, a computational history of ideas maximally profits from computer methods while also keeping humanities experts in the loop. We elucidate our proposal with reference to a model of the notion of axiomatic science in 18th -19th century Europe. (shrink)

Aworkshop was held August 26–28, 2015, by the Earth- Life Science Institute (ELSI) Origins Network (EON, see Appendix I) at the Tokyo Institute of Technology. This meeting gathered a diverse group of around 40 scholars researching the origins of life (OoL) from various perspectives with the intent to find common ground, identify key questions and investigations for progress, and guide EON by suggesting a roadmap of activities. Specific challenges that the attendees were encouraged to address included the following: What key (...) questions, ideas, and investigations should the OoL research community address in the near and long term? How can this community better organize itself and prioritize its efforts? What roles can particular subfields play, and what can ELSI and EON do to facilitate research progress? (See also Appendix II.) The present document is a product of that workshop; a white paper that serves as a record of the discussion that took place and a guide and stimulus to the solution of the most urgent and important issues in the study of the OoL. This paper is not intended to be comprehensive or a balanced representation of the opinions of the entire OoL research community. It is intended to present a number of important position statements that contain many aspirational goals and suggestions as to how progress can be made in understanding the OoL. The key role played in the field by current societies and recurring meetings over the past many decades is fully acknowledged, including the International Society for the Study of the Origin of Life (ISSOL) and its official journal Origins of Life and Evolution of Biospheres, as well as the International Society for Artificial Life (ISAL). We introduce such a notion, decidability in (or d- ) for any measure , which is particularly appropriate for physics and in some ways more intuitive than Ko's (1991) recursive approximability (r.a.). For Lebesgue measure , d- implies r.a. Sets with positive -measure that are sufficiently "riddled" with holes are never d- but are often r.a. This explicates Sommerer (...) and Ott's (1996) claim of uncomputable behavior in a system with riddled basins of attraction. Furthermore, it clarifies speculations that the stability of the solar system (and similar systems) may be undecidable, for the invariant tori established by KAM theory form sets that are not d-. This chapter analyzes traditional archetypes of divan literature—‘āşık (lover), ma‘şūk (beloved), and rakīb (opponent)—to show the presence of a dialectical discourse in classical Ottoman divan love poems. In both style and content divan poems display a comprehensive understanding of the postclassical Islamic philosophical conception of dialectic and argumentation theory, known as ādāb al-baḥth wa al-munāẓara. The focus on Ottoman love poetry and argumentation theory in this paper aims to demonstrate how the love poetry that developed in Ottoman culture is more (...) dialectical in form and content than Ottoman literary studies have recognized. Nancy Jecker and Andrew Ko (2017) wish to present an account of personal identity which captures what matters to the patient and places the patient at the center of medical decisions. They focus particularly on medical interventions in the brain that can cause drastic changes in personality; under what circumstances should we say the patient has 'survived' these changes? More specifically, how can we best understand the notion of survival in a way that captures what is of concern to the (...) patient? This goal is laudable, however, their chosen account of narrative identity is ill-suited to this task for one reason in particular; it does not give sufficient guidance in predicting which medical decisions are likely to be experienced as disruptive to identity. Merriam-Webster dictionary defines an apostle as a person who initiates a great moral reform or who first advocates an important belief and system [1]. Similarly, the Cambridge Dictionary states that an apostle is someone who strongly supports a particular belief or political movement [2]. The Free Dictionary by Farlex describes an apostle as a person who pioneers an important reform movement, cause, or belief; a passionate adherent; or a strong supporter. In the light of the above meanings of the term (...) ‘apostle’, one can easily say that Guru Nanak was an apostle as he initiated great moral and social reforms in the Indian society of his times, as is evident from his life and works. He promoted an important belief system (moral code) of truthful living [4]. He states: Sacẖahu orai sabẖ ko upar sacẖ ācẖār. Truth is the highest virtue, but higher still is truthful living. (M. 1, SGGS, p. 62) The second part of the current topic is related to the term “Peace.” Peace has always been among humanity's highest values. The most popular (Western) view of peace is an absence of dissension, violence, or war. But peace is also seen as concord, or harmony and tranquility. It is viewed as peace of mind or serenity, especially in the East [5]. Peace of mind (also called inner peace) indicates a state of being mentally and spiritually at peace. It refers to having enough knowledge and understanding to keep oneself firm during discord or stress. We need some degree of inner peace in our own lives to be effective in helping to build peace in our organizations, communities, societies, and the world. (shrink)

Sci. 70(2) (2003) 359–382], which we abbreviate d.m.z.; recursive approximability [or r.a.; K.-I. Ko, Complexity Theory of Real Functions, Birkhäuser, Boston, 1991]; and decidability ignoring boundaries [d.i.b.; W.C. Myrvold, The decision problem for entanglement, in: R.S. (...) Cohen et al. (Eds.), Potentiality, Entanglement, and Passion-at-a-Distance: Quantum Mechanical Studies fo Abner Shimony, Vol. 2, Kluwer Academic Publishers, Great Britain, 1997, pp. 177–190]. Unlike some others in the literature, these notions apply not only to certain nice sets, but to general sets in Rn and other appropriate spaces. We consider some motivations for these concepts and the logical relations between them. It has been argued that d.m.z. is especially appropriate for physical applications, and on Rn with the standard measure, it is strictly stronger than r.a. [M.W. Parker, Undecidability in Rn: Riddled basins, the KAM tori, and the stability of the solar system, Phil. Sci. 70(2) (2003) 359–382]. Here we show that this is the only implication that holds among our three decidabilities in that setting. Under arbitrary measures, even this implication fails. Dieser Verlust könnte in Zukunft gewaltige negative Auswirkungen auf die Nahrungsmittelsicherheit haben, da die Biodiversität eine zentrale Rolle bei der Absorbierung biotischer und abiotischer Stressfaktoren spielt, die auf die Pflanzen wirken. Darüber hinaus stellt der Verlust eine bedeutende Verarmung nicht nur des Pools genetischer Ressourcen dar, die zukünftigen Generationen zur (...) Verfügung stehen, sondern auch der kulturellen Diversität, indem die Nahrungsmittelvielfalt der Landesküchen eingeschränkt und sowohl Kulturlandschaften als auch Stadtgärten vereinheitlicht werden. The composition of a timeline depends on purpose, perspective, and scale – and of the very understanding of the word, the phenomenon referred to, and whether the focus is the idea or concept, an instance of an idea or a phenomenon, a process, or an event and so forth. The main function of timelines is to provide an overview over a long history, it is a kind of a mnemotechnic device or a particular kind of Knowledge Organization System (KOS).b The (...) entries in the timeline should be brief and indisputable. Therefore, timelines often identify the first occurrences rather than the most widespread or most qualified instances leaving the fuller and more complex, and possibly disputable story out. But even first occurrences are often difficult to establish. The first occurrence is most often only the first finding of an instance. Older instances may be found and competing definitions develop either within a field or in different fields. This is further complicated since the phenomena, their names, and their meanings may change over time. Former meanings may become redundant, or they must accommodate and coexist with new meanings. Die gegenwärtig unter dem Titel ›Realismus‹ geführten Debatten in der Philosophie befinden sich nach allgemeiner Ansicht in einem Zustand größter Verwirrung, so daß es nützlich erscheint, ein wenig Ordnung in die theoretischen Optionen zu bringen bevor man für die eine oder andere Auffassung Partei ergreift. In der vorliegenden Arbeit wird dafür argumentiert, daß sich ein systematisch zusammenhängendes Zentrum dieser Debatten mit Hilfe des Begriffes der Referenz ordnen läßt. Nach der Analyse einiger klassischer Positionen soll ein Rahmen erstellt werden, innerhalb dessen (...) die Positionen eingeordnet und die zentralen Probleme fruchtbar diskutiert werden können. Zu diesem Zwecke ist es erforderlich, für die Einordnung der Positionen theoretische Kriterien zu benennen, die sich an den Problemen orientieren von denen hier argumentiert wird, das sie zentral seien. Sehr knapp ausgedrückt wird hier die Auffassung vertreten, Realismus sei als metaphysische These aufzufassen, welche eine von menschlichen epistemischen und semantischen Möglichkeiten unabhängige Existenz behauptet; in den gegenwärtigen Debatten typischerweise die Existenz einer Art von Dingen, nicht die eines individuellen Gegenstandes. Diese metaphysische These wird jedoch in der gegenwärtigen Debatte mit semantischen Argumenten untermauert, bzw. angegriffen und jene semantischen Argumente wiederum verwenden epistemische Erwägungen – die Frage betreffend, was man wissen kann und was nicht. Der Beginn der gegenwärtigen Realismusdebatten mit der soeben skizzierten zentralen Stellung semantischer Argumente ist, der hier vertretenen Auffassung zufolge, die Kritik am traditionellen Fregeschen Referenzbegriff durch Kripke und den frühen Putnam um 1970 (Kap. 2). Aus dieser neu zu bewertenden Kritik und der von den Autoren daraus entwickelten externalistischen realistischen Semantik für Artausdrücke läßt sich das erste Kriterium für eine Position in einer Realismusdebatte ableiten und klären (Kap. 3): Hält man die fragliche Art für eine natürliche Art und meint also, sie habe ihren ›Zusammenhalt‹ von Natur aus? Wenn ja, dann ist die fragliche Position eine realistische (das Kriterium ist dank des engen Zusammenhangs von Realismus und Externalismus sowohl hinreichend als auch notwendig). Hält man die Art nicht für eine natürliche Art, ist man Antirealist. Damit geht jeweils not- wendig eine bestimmte Semantik für den auf die Art referierenden Ausdruck einher. Es zeigt sich zugleich, daß es zwei Varianten des Realismus zu unterscheiden gilt, die hier als klassischer bzw. als moderater Realismus bezeichnet werden. Im folgenden (Kap. 4.1) wird argumentiert, daß der Begriff der Wahrheit nicht eigentlich der zentrale Punkt in den in Frage stehenden Realismusdebatten sein sollte, wie vielfach behauptet wurde, sondern seine Brisanz vielmehr aus zugrundeliegenden semantischen Fragen gewinnt die also in der weiteren Aufdeckung der Kriterien die zentrale Rolle spielen müssen. In der Analyse der Kritik an der in Kap. 3 entwickelten Position des ›klassischen Realismus‹ läßt sich ein zweites unterscheidendes Kriterium für Positionen in Realismusdebatten entwickeln: begriffliche Relativität. Nach der Ablehnung von Putnams Auffassungen zu diesem Thema, werden zwei Varianten vorgeschlagen, starke und schwache begriffliche Relativität (Kap. 4.2). Die Anwendung dieses Merkmals zwingt, so wird argumentiert, in einigen Fällen zu einer Kombination einer realistischen Auffassung von Arten als natürliche mit begrifflicher Relativität. Diese mittlere Position zwischen klassischem Realismus und Antirealismus wird als »moderater Realismus« bezeichnet. Der im ersten Kriterium verwendete Begriff der natürlichen Art, und damit die Optionen in den Debatten, wird schließlich mittels einer Dis- kussion des Phänomens der Vagheit noch weiter verdeutlicht (Kap. 4.3). All languages have unique morphemes as distinguishing features from other languages. Unique morpheme is a morpheme with typical features divergent from other morphemes or language morpheme in general. This study aims to explain the unique morphemes in Malay Language of Makassar dialect. The finding is useful for linguistic studies especially morphological studies of morphemes. This study used descriptive method data collection method used was listening method. The techniques were listening and engaged in conversation and notes-taking. The role of researcher in (...) listening and engaged in conversation technique was not only as listener but also took part in the conversation. In note-taking techniques the researcher recorded the conversations from the research objects. The results found that the The Malay language of Makassar dialect has unique morphemes, such as ka, ta, nu, ki. Na, ko-, etc. Unique morphemes in form of words are such as pale (only), sedeng (again), bela (that’s it), and so on. More unique morphemes of particles are mine-, ji-, pi-, pa-, mo-, etc. Using these unique morphemes before words would make different in sense of the words from using them after words. (shrink)

Purpose – The purpose of the research reported here is to improve comprehension of the socially-negotiated identity of concepts in the domain of knowledge organization. Because knowledge organization as a domain has as its focus the order of concepts, both from a theoretical perspective and from an applied perspective, it is important to understand how the domain itself understands the meaning of a concept. Design/methodology/approach – The paper provides an empirical demonstration of how the domain itself understands the meaning of (...) a concept. The paper employs content analysis to demonstrate the ways in which concepts are portrayed in KO concept maps as signs, and they are subjected to evaluative semiotic analysis as a way to understand their meaning. The frame was the entire population of formal proceedings in knowledge organization – all proceedings of the International Society for Knowledge Organization’s international conferences (1990-2010) and those of the annual classification workshops of the Special Interest Group for Classification Research of the American Society for Information Science and Technology (SIG/CR). Findings – A total of 344 concept maps were analyzed. There was no discernible chronological pattern. Most concept maps were created by authors who were professors from the USA, Germany, France, or Canada. Roughly half were judged to contain semiotic content. Peirceian semiotics predominated, and tended to convey greater granularity and complexity in conceptual terminology. Nodes could be identified as anchors of conceptual clusters in the domain; the arcs were identifiable as verbal relationship indicators. Saussurian concept maps were more applied than theoretical; Peirceian concept maps had more theoretical content. Originality/value – The paper demonstrates important empirical evidence about the coherence of the domain of knowledge organization. Core values are conveyed across time through the concept maps in this population of conference papers. (shrink)

본 논문은 개혁개방정책을 통하여 체제 내 개혁을 시도하였던 베 트남의 체제변화 요인에 관한 연구이다. 경제개혁을 통한 베트남의 체제변화가 지속될 수 있을 것인지 그리고 이런 경제개혁이 정치체 제 개혁에 영향을 미칠 수 있을 것인지에 대한 관심에서 연구가 시 작되었다. 또한 베트남 사회주의가 어떤 길을 걷게 될 것인지에 대 한 해답을 찾기 위해서는 베트남 체제변화의 영향요인 파악이 우선 적으로 이루어져야 한다고 보았다.

이 연구는 현재까지 성공적이라 평할 수 있는 베트남의 코로나19 대응 상황 을 파악하고 그 원인을 찾는 데 목적이 있다. 첫째, 베트남의 코로나19 대응이 성공적일 수 있었던 이유와 코로나19 대응과정에서 나타나는 여러 특징을 살 펴봤다. 베트남의 코로나19 대응은 국경 봉쇄로 이야기되는데, 극단적이리만 큼 강력한 대처를 어떻게 진행할 수 있었는지 대응과정을 짚어봤다. 베트남의 코로나19 대응과정을 좀 더 면밀하게 살펴보면서, 전시상황과 견줄 정도로 빠 르고 강력한 봉쇄를 어떻게 진행할 수 있었고, 국민적 동의는 어떻게 얻을 수 있 었는지 분석했다. 메타포, 과학적 사실 공유, 애국을 (...) 위한 사회적 격리와 감시 는 베트남의 코로나19 대응에서 중요한 지점이었다. 둘째, 강력한 국경 봉쇄로 대변되는 베트남의 코로나19 대응전략이 사회경제적으로 어떤 영향을 미쳤으 며, 이러한 영향이 베트남의 코로나19 대응에 어떻게 반영되고 있는지를 살펴 봤다. 베트남의 코로나19 대응 방식과 관련해서 첨예한 갈등이 촉발되었던 사 건인 베트남의 ‘대구발(發) 비행기 탑승객 격리조치’가 베트남 내 한국 및 한국 기업에 대한 부정적인 반응을 확산시켰고, 이 문제를 해소하는데 베트남 현지 기업과 교민사회의 민간 연대가 중요한 역할을 하였다. 이 연구에서는 이러한 내용을 중심으로 국가 차원에서의 봉쇄가 국민적 합의를 얻어냈고, 그것은 베 트남 정부의 권위주의적 성향에 동조한다는 단순한 논리로 설명될 수 없음을 밝히고 있다. 이는 코로나19 상황을 해결하기 위한 국가의 리더십과 사회적 신 뢰가 바탕이 된 국가의 역량은 ‘감시’와 ‘통제’라는 권위주의적 성향의 아이디 어로만 평가되기에는 부족하다는 것을 의미한다. [English abstract] In his last metaethical statement, Parfit revisits his earlier arguments for non-metaphysical normative non-naturalism , and points to the possibility of convergence between his view and Railton's non-analytical normative naturalism. I examine the basis of this convergence claim and find it unpersuasive, mainly because if their views converge on the same position, Parfit's non-natural norms exist only as predicates. In order to avoid this consequence, he needs to present a reason for believing in the existence of normative properties (...) . There is an indispensability argument implicit in his text, with concepts of sui generis normative ground and necessity at its centre. At the time in which quantum mechanics engages in talks of multiverses and quantum technologies helps to realize a concept of metaverse, the so-called ‘virtual life’ has become the extended reality. Chalmers in his book rejects a dichotomy of reality and illusion and consctructs a trichotomy by adding virtuality in order to offer a proposition that a virtual world is a part of the extended reality. The author sees new philosophical challenges in this new reality. For an example, as we (...) are bound to allow some form of consciousness to a robot in a context of simulation there are questions of status of personal agency or personal identity. Traditional subjects of ontology, knowledge, and value come to us as new challenges. The Western intellectual tradition is accustomed to the separation between the human sphere and the sphere of nature, whereas in the East Asian intellectual tradition the two are considered continuous. For good or bad, the Western dualist outlook, which considers mind and matter to be fundamentally distinct, received much philosophical attention in modern times. But how is the East Asian tradition of non-separation to be philosophically expounded? The idea that the human sphere and the sphere of nature are fundamentally connected (...) is attractive on many levels, but it appears to be in need of philosophical scrutiny. One of the key notions which any attempt to provide an adequate elucidation of the East Asian integrative outlook would have had to address is the notion of intentionality. For the idea of intentionality is placed at the center of discussions regarding the continuity — or lack thereof — of minds and bodies, and of nature and humanity. The present paper claims that the dualistic thesis according to which intentionality serves as a delineative mark which separates the mental from the physical and the human sphere from the sphere of nature is implausible (1st section). It further argues that the concept of intention, cheng(誠) of Zhungyong, can be taken to reflect the idea that all things have a mind as a capacity to process information at the appropriate level where they are placed (2nd section). Finally, it develops the view that the capacity for integration sustains a picture according to which integration is a case of yinyang intentionality (3rd section). (shrink)

Then, I seek to connect the anthropological notion and the holistic notion via cheng(誠) or integration. Zhungyong-The Doctrine of the (...) Mean, one of 4 Confucian texts, says that the ultimate integration(至誠) is to reflect the total nature of objects involved (盡性) so that it will show that self realization and all other realizations are one and not two(成己成物) and it will ultimately reach the stage of holiness(聖). Important elements of cheng intentionality can be read out of the two thinker’s various conceptual aspects. YU’s interpretation of history to be internalistic, his view of Hangul(Korean written language) as a revelational medium, his hermeneutics of Christian God as the emptiness cannot be understood on the dichotomous model of human-nature. HAM’s seed holism, his beliefs that humans’s minds are the heavenly mind and that all things under the heaven should come to be unified are best to be understood on the model of cheng intentionality of integration. The paper also discusses influential arguments such as the "No Miracle Argument" put forth by realists and the "pessimistic induction" raised by anti-realists, shedding light on the historical context of scientific theories and their empirical success. As the study unfolds, it provides a nuanced perspective that transcends the dichotomy of scientific realism and anti-realism, emphasizing selective skepticism as a middle ground. By delving into the ontological and epistemological nuances of these philosophical positions, this paper seeks to contribute to the Korean philosophical discourse by presenting a comprehensive overview of scientific realism and anti-realism. The philosopher and professor Tudor Cătineanu proposes to "seekers of metaphysical reason" a volume of studies on Rhetoric and Metaphysics. Entitled Rhetoric and Metaphysics: In Search of Metaphysical Reason (Romanian Academy Publishing House, 2019, 571 p.), the book is the result of elaborate studies, therefore pre- and post-December 1989. The work, as the author points out, “is organized by combining two major perspectives, historical and systematic” (p. 7), and the predominant method of work used is the „interdisciplinary methods” called “matrix (...) of levels”. But the researcher uses, also, “the matrix of functors” and "the matrix of stylistic". (shrink)

The theory of universals faces two opposing demands. On the one hand, it must be explanatory. That is, certain kinds of statements found in our everyday discourse and the theories used to explain them seem to require the existence of universals for their understanding or acceptance. On the other hand, it must be ontologically appropriate. This means that theories that intervene ontologically without sufficient reasons for the existence of implausible entities or theories that result in an excessive proliferation of new (...) entities should not be embraced as theories of universals. The problem is that a theoretically sound theory of universals appears to inevitably involve a tension between explanatory and ontological appropriateness. This dilemma arises from the two aforementioned demands, and it is a genuine dilemma in that it is difficult to give up either demand. Philosophy, or metaphysics, fundamentally aims to explain the facts of the experiential world. If a philosophical theory fails to adequately satisfy our explanatory demands regarding the experiential world, it is not suitable as a philosophical theory. Conversely, it is also undesirable for a philosophical theory to impose excessive ontological burdens. The justification of a philosophical theory is a priori, and any a priori claims about the existence of entities should not be arbitrarily adopted. This article resolves this dilemma as follows: If the explanatory demand requires reduction from an ontological standpoint, it can be adequately addressed through unproblematic means. On the other hand, the apparent conflict between the explanatory demand and appropriate ontology only arises when it is understood as a demand for explanatory priority. However, such a demand does not necessarily require the introduction of any ontological priority. Therefore, there was no need for the dilemma to arise. Finally, I attempt to respond to the demands from natural kind predicates. (shrink)

It is natural to suppose the following three: factivity of knowledge, alda-know synonymy, and the univocity of alda. However, rago-knowledge attribution, expressed by “rago alda” sentences, seems to defeat to hold them at once. In this paper, I try to dissolve this predicament, analyzing “rago alda” sentence as a kind of hybrid language expression. And the theoretical advantages, which my analysis has over other possible, alternative approaches, are to be shown.

The paper aims at rethinking the traditional understanding of commercial law, and tentatively provides its cosmopolitan concept under the backdrop of extended commercial exchange and corresponding development of the transnational trade laws. Given the influence of legal positivism over the source of law debate, the commercial law would be defined in a relatively narrower focus, which principally presumes the sovereign nature of legal community. The phenomenon and interactive reality in this global sphere through the mid-20th century and new millennium have (...) driven us to experience new ways of dealings, sometimes blurring or otherwise encroaching upon a conventional discourse about the true nature of laws. In one way of efforts to accommodate such new phenomena, the author likes to present a possibility of more systemic, comprehensive, reality-oriented construction of commercial law concept concerning the current wave of legal pluralism. It became increasingly pervasive in our daily experiences that the norms of various nature have a potential to govern the commercial relationship. These norms, unlike the traditional state laws, are observed to poses a distinctive feature requiring a coherent understanding among another. This conceptual work also could mater with the traditional concept of sovereignty-driven commercial law. The paper will begin with the theoretical essence of legal positivism propounded by Hart and Raz. Particularly, the five strands of legal system would provide the basis of analysis, and could be compared to the narrative of legal positivists. For the purpose of this thesis, they would be contested to favor the strengths of cosmopolitan concept of commercial law. For an illustration,the author would argue that the shared agency element as well as recognition process of norms can give us more genuine understanding of the commercial law and practices. In this way, the author discuses and proposes a new concept focusing on the contemporary commercial law. Finally, he pointed out the critical needs of this kind of definitional work notwithstanding the legal plane or global diversity. In many ways, the paper would be found tentative, epitomizing, less exhaustive as trade-offs for a comprehensive build-up. The author also regrets to curtail much potentials of opposing arguments against the cosmopolitan understanding of commercial law. It is hoped that this work would later be developed, which could be realized by the complimentary as well as critical followers. (shrink)

The paper aims to briefly look into the civil law remedies of CISG from the perspective of economic efficiency. It mainly illustrates the basic tools of remedies in CISG, and discusses its strengths and flaws from the standpoint of economic deals normally present in most of commercial transactions. As many literature have long contributed to the legal economic discourse, our discussion, as a matter of course, largely depends on the current stronghold, or prospect that those theories espouse. Generally, the remedies (...) in CISG have two basic pathways addressing or penalizing the breach of contract from one party, namely specific performance and damages award. Other instruments to deal with the breach of contract cover a cure of defect, repudiation to perform a contract, additional period to perform a contractual duty, avoidance of contract and etc. This group of instruments can be classed as a privately administered remedies for our purpose of analysis. On this assumption, we can find many aspects of strengths in economic terms, but some paucity that the prescribed approach cannot properly address the best of economics between the contracting parties. This paucity comes mainly because the lawmakers normally could not pre-consider all circumstances among the individual contracting parties. For this reason, this paper argues in favor of privately administered remedies to fill the paucity of two typical remedies. Moreover, the contractual negotiation or design of contract is considered very important as the contracting parties are most informed about their best of economics besides the official lawmakers. The paper concludes with a short discussion of the electronic commerce in comparison with the traditional domestic and international commerce. (shrink)

[Author's note: although this paper is written in Korean, it is archived here in the hope of bringing it to the attention of a wider audience including scholars of pragmatics and of Korean linguistics.] Recently, Korean linguists and philosophers of language have engaged in discussions on the meaning and usage of the Korean determiner ‘uri’ as in such phrases as ‘uri manura [our wife]’ which might seem strange given the monogamous marital institution of Korea. The aim of this paper is (...) to provide a new interpretation of such expressions as ‘uri manura’. To that end, various proposals concerning the meaning and usage of the determiner ‘uri’ in those expressions will be critically examined first. Then it will be argued that ‘uri manura’ is a polite form of ‘nae manura [my wife]’ and is used when one needs, or wants, to speak in a polite tone in deference to the hearer or the wider audience. The upshot will be that the ubiquitous use of ‘uri’ in Korean is not due to the collectivist nature of the Korean society, as has often been claimed, but rather results from the linguistic embodiment of the Confucian tradition in Korea that values courteous words and behavior. This paper considers the aporia in Dialectic of Enlightenment in two aspects of the self-destruction and self-critique of enlightenment and then emphasizes the dual vision which Horkheimer and Adorno hold on rationality. Firstly, it traces the explanation of the self-destruction of enlightenment so as to make explicit that it results in another form of the aporia, the self-critique of enlightenment. This is followed by formulating the criticism into two aspects, that Horkheimer and Adorno’s aporia leads them to be confronted by (...) a self-contradiction. I argue that the criticism neglects their narrative strategy of history as critique and the methodology of immanent critique of Horkheimer and Adorno. In conclusion, it is elucidated that Horkheimer and Adorno rightly posit their aporia and suggest a proper solution, by which we could take the dual vision on rationality and their own model of immanent critique as its significances. 그동안 많은 전문서적을 출간한 경험을 가지고 있지만, 이번 출간하는 법과 생활은 생활 현장에서 느낀 바를 진솔하게 담고 있어 독자들이 쉽게 읽을 수 있게 하였다. 항상 법이 무엇인가를 생각하면서 단조로운 일상을 살아야 하는 변호사, 법학교수로서, 우리 주변의 이야기는 빈곤한 사고의 저변을 넓혀 준다. 조선대학교 법사회대학에서 학생들을 가르치는 백면서생이지만, 서울과 광주를 오가면서 한국 사회를 객관적으로 바라볼 수 있는 시간을 가질 수 있었던 것은 본서 출간을 가능하게 한 동인이었다. 본 서는 정밀한 법이론이나 사례 분석, 또는 판례에 대한 학술적 비평을 담고 있지 않다. 다만 (...) 지난 수년간 느껴온 바를 일상의 시간에 연결한 천학비재한 한 법학도의 단상과 에세이 모음집이라 할 수 있다. 페이스북을 통하여 발표된 글들을 정리하여 학술적 외관을 씌운 부끄러운 졸작이다. 그러나 저자로서 작은 소망이 있다면, 그것은 독자들이 함께 살아 온 시간들을 반추하면서, 민주주의와 법치주의의 가치를 조금이라도 음미할 수 있었으면 하는 것이다. This paper is a study on the factors affecting the changes of the political system of Vietnam that has attempted a reform within the system through its reform and open-door policy. The study originates in the interest in whether Vietnam could continue its changes of system via economic reform, and whether the economic reform could affect the reform of the political system.
