Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

In this article, I examine the moral dimensions of gender affirmation. I argue that the moral value of gender affirmation is rooted in what Iris Murdoch called loving attention. Loving attention is central to the moral value of gender affirmation because such affirmation is otherwise too fragile or insincere to have such value. Moral reasons to engage in acts that gender affirm derive from the commitment to give and express loving attention to trans people as a way of challenging their (...) marginalization. In the latter part of the paper, I will discuss how my arguments bear on recent arguments by Robin Dembroff and Daniel Wodak (2018) on the use of gender-neutral language. They argue that we have a duty not to use gender-specific pronouns for anyone. Their conclusion turns, in part, on a rejection of gender affirmation as a moral duty. The value of gender affirmation, rooted in our moral perception of trans people, should make us skeptical of this conclusion, in favor of a more nuanced and pluralistic approach to the ethics of gendering. The paper defends the argument that the Resemblance Paradox (RP), or the problem of the ‘under-determination of meaning’, and the Rule-Following Paradox (RFP) are two sides of the same paradox threatening meaning from opposite extremes. After presenting the case, the paradox is reconsidered anew and the supposition that the threat is a pervasive one is challenged.

This paper attempts to be a contribution to the epistemological project of explaining complex conceptual structures departing from more basic ones. The central thesis of the paper is that there are what I call “functionally structured concepts”, these are non-harmonic concepts in Dummett’s sense that might be legitimized if there is a function that justifies the tie between the inferential connection the concept allows us to trace. Proving this requires enhancing the russellian existential analysis of definite descriptions to apply to (...) functions and using this in proving the legitimacy of such concepts. The utility of the proposal is shown for the case of thick ethical terms and an attempt is made to use it in explaining the development of natural numbers. This last move could allow us to go one step lower in explaining the genesis of natural numbers while maintaining the notion of abstract numbers as higher order entities. (shrink)

Boghossian’s (2003) proposal to conditionalize concepts as a way to secure their legitimacy in disputable cases applies well, not just to pejoratives – on whose account Boghossian first proposed it – but also to thick ethical concepts. It actually has important advantages when dealing with some worries raised by the application of thick ethical terms, and the truth and facticity of corresponding statements. In this paper, I will try to show, however, that thick ethical concepts present a specific case, whose (...) analysis requires a somewhat different reconstruction from that which Boghossian offers. A proper account of thick ethical concepts should be able to explain how ‘evaluated’ and ‘evaluation’ are connected. (shrink)

Humans and AI systems are usually portrayed as separate sys- tems that we need to align in values and goals. However, there is a great deal of AI technology found in non-autonomous systems that are used as cognitive tools by humans. Under the extended mind thesis, the functional contributions of these tools become as essential to our cognition as our brains. But AI can take cognitive extension towards totally new capabil- ities, posing new philosophical, ethical and technical chal- lenges. To (...) analyse these challenges better, we define and place AI extenders in a continuum between fully-externalized systems, loosely coupled with humans, and fully-internalized processes, with operations ultimately performed by the brain, making the tool redundant. We dissect the landscape of cog- nitive capabilities that can foreseeably be extended by AI and examine their ethical implications. We suggest that cognitive extenders using AI be treated as distinct from other cognitive enhancers by all relevant stakeholders, including developers, policy makers, and human users. (shrink)

In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. There are two aims of this paper: (1) to explore the affective dimensions of moral shock and how it relates to normative marginalization of those furthest from dominant society, but also, more specifically; (2) to articulate the trans experience of constantly being under moral attack because the dominant “world” normatively defines you out of existence. Toward these ends, I build on Katie Stockdale’s recent work on moral shock, arguing that moral shock needs to be contextualized to “worlds” of sense to (...) understand how marginalized people affectively experience shocking events. My focus is the trans experience of moral shock due to the way trans people are positioned outside of dominant society, creating the conditions to experience cyclical, chronic shock. These affective conditions point to a collective responsibility to ease the affective stress that the most marginalized experience. (shrink)

Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. There is a close relationship between education and citizenship. Liberal political theorists tend to spend much of their work justifying the role of educational institutions in political communities. However, the development of these proposals is usually thought for subjects who do not have disabilities, arbitrarily excluding a significant proportion of society. This not only happens at an educational level, it is replicated in various areas of social life. In this sense, in the present work I am going to propose that (...) the adequacy approach proposed by Debra Satz is extremely valuable to think about the educational equity of people with disabilities. The choice is not accidental or arbitrary. Satz is a renowned philosopher whose interest in education and its importance in forming citizens for diverse and plural societies. To do this, I will begin by presenting three possible models of special education: the special school, integration and inclusion. Then the two paradigms that prevail in the characterization of disability will be addressed: the social model and the medical model. Instead, I will reconstruct the third proposal elaborated by Satz in order to evaluate with which inclusive education model and disability paradigm it is compatible and why it is presented as a valuable proposal in this field. The aim of this article is to outline a pragmatist image of science following Rorty’s discussions and critics of epistemology and to develop some consequences of it in the philosophical analysis and its relations to culture. I will deal with some aspects of how scientific practice is construed and understood, and also outline the shift in Philosophy of Science from epistemological to ethical-political concerns that are implied in his proposal. I will contend that this perspective suggests an interesting way of (...) analysing scientific practices, theories, and public policies of it. Furthermore, I will suggest that it successfully connects the most interesting proposals of contemporary scientific views in philosophy. Finally, I will use some examples in physics and biology to illustrate my assertions. (shrink)

In this paper I provide a preliminary account of weakness of political will (political akrasia). My aim is to use theories from the weakness of will literature as a guide to develop a model of the same phenomenon as it occurs in collective agents. Though the account will parallel the traditional view of weakness of will in individuals, weakness of political will is a distinctly political concept that will apply to group agents such as governments, institutional actors, and other political (...) collectives. I further argue that blaming inaction by collective political agents on a “lack of political will” should be understood as blaming a kind of akratic break within the deliberative process, leading to an inability of the collective agent to capitalize on existing group attitudes in order to translate them into policy or legislation. My primary example throughout will be U.S. political inaction with respect to the climate crisis. (shrink)

Abstracts The aim of the paper is to propose an alternative model to realist and non-cognitive explanations of the rule-guided use of thick ethical concepts and to examine the implications that may be drawn from this and similar cases for our general understanding of rule-following and the relation between criteria of application, truth and correctness. It addresses McDowell’s non-cognitivism critique and challenges his defence of the entanglement thesis for thick ethical concepts. Contrary to non-cognitivists, however, I propose to view the (...) relation between the two terms of the entanglement as resulting from the satisfaction of a previously applied moral function. El artículo tiene como objetivo describir las competencias informacionales a desarrollar durante la formación profesional. Se presenta los referentes teóricos a partir del empleo de un enfoque de sistema que supone el análisis y la síntesis, la inducción y la deducción como métodos de investigación, con el propósito de dar conocer los hitos en las universidades y organizaciones internacionales relacionadas. La modelación fue empleada para la construcción de un nuevo proyecto de desarrollo de competencias informacionales desde la perspectiva de la (...) formación profesional universitaria ajustada a las necesidades de la educación superior en Cuba. El nuevo proyecto se configura en tres unidades básicas (acceso, procesamiento y comunicación), con sus respectivos elementos de competencia, saberes esenciales e indicadores para la evaluación del desempeño. El artículo fundamenta la tesis de que el desarrollo de competencias informacionales debe ser sistemáticamente estructurado, planificado y ejecutado como parte integral de la formación curricular en interacción con los contenidos de las disciplinas docentes, bajo la dirección del profesor y la participación protagónica de los profesionales en formación. -/- ABSTRACT -/- The article aims at describing the competence to be developed during professional training. It presents the theoretical referents by means of an approach system that includes synthesis and analysis, induction and deduction as research methods in order to reveal the milestones of information skills development in universities and related international organizations. Modeling was used for the construction of a new skills development project from the perspective of university professional training according to the needs of Higher Education in Cuba. The new project is composed of three basic units (access, processing and communication), with their respective competence elements, essential knowledge and indicators for the evaluation of the performance. The article supports the theory that information development skills must be systematically structured, planned and implemented as an integral part of the curricular training in interaction with the contents of subjects, under the teacher´s guidance and the active participation of profesionals in training. -/- . There is a curious phenomenon where people from marginalized populations are taken to be arrogant when they show no signs of superiority. In effect, their actions are misconstrued, and their attitudes are rendered unintelligible. Given that arrogance is standardly taken to be a flaw in one’s moral character, understanding such misattributions should give us insight into the affective marginalization many people face. This talk aims to give a thorough exploration of arrogance under oppression. I argue that arrogance is a kind (...) of self-preoccupation that involves projecting one’s values, goals, and concerns onto others as if they were objective values, goals, and concerns. When the affectively marginalized communicate their self-respect through things like protest, people mistake that self-respect as self-preoccupation given how the affectively marginalized are constructed. Furthermore, given how affective marginalization not only inhibits how the marginalized are understood by others, but inhibits their own affective lives, I argue that taking up an arrogant attitude is not always morally vicious, but can be a beautiful form of political resistance but all things considered good. Philosophers of race and other writers in the Black and Latinx intellectual traditions have remarked on what it is like to live under “the racial gaze,” to be shaped and limited by the way whites perceive us. However, little work has been spent developing how the racial gaze functions in whites’, and other racially privileged people’s, moral psychology. I argue in this paper that there is a morally objectionable way of perceiving people of color. This claim builds on an insight (...) from Iris Murdoch that our perception can be morally evaluable and extends it to issues of race. I articulate how racial stereotypes and misvaluing distort one’s perception of people of color and that these distortions are organizing around a dominant conception for race that plays an important role in the oppression of people of color. I believe understanding racist perception lays a foundation for understanding the moral dimensions of interpersonal (as opposed to structural) racism. (shrink)

“Love hurts”—as the saying goes—and a certain amount of pain and difficulty in intimate relationships is unavoidable. Sometimes it may even be beneficial, since adversity can lead to personal growth, self-discovery, and a range of other components of a life well-lived. But other times, love can be downright dangerous. It may bind a spouse to her domestic abuser, draw an unscrupulous adult toward sexual involvement with a child, put someone under the insidious spell of a cult leader, and even inspire (...) jealousy-fueled homicide. How might these perilous devotions be diminished? The ancients thought that treatments such as phlebotomy, exercise, or bloodletting could “cure” an individual of love. But modern neuroscience and emerging developments in psychopharmacology open up a range of possible interventions that might actually work. These developments raise profound moral questions about the potential uses—and misuses—of such anti-love biotechnology. In this article, we describe a number of prospective love-diminishing interventions, and offer a preliminary ethical framework for dealing with them responsibly should they arise. (shrink)

En este artículo analizamos la argumentación de van Parijs mostrando cómo la efectividad política de sus tesis sólo se sostiene a costa de reducir el debate sobre la renta básica a los términos de su propia concepción de la ética. Ponemos en duda, por (...) nuestra parte, el alcance de esta reducción sobre un doble plano: diluye por completo la dimensión prudencial de toda argumentación política, y no deja más alternativa que la educación sentimental para quienes no se dejen convencer por el equilibrio reflexivo. 'Computationalism' is a relatively vague term used to describe attempts to apply Turing's model of computation to phenomena outside its original purview: in modelling the human mind, in physics, mathematics, etc. Early versions of computationalism faced strong objections from many (and varied) quarters, from philosophers to practitioners of the aforementioned disciplines. Here we will not address the fundamental question of whether computational models are appropriate for describing some or all of the wide range of processes that they have been applied (...) to, but will focus instead on whether `renovated' versions of the \textit{new computationalism} shed any new light on or resolve previous tensions between proponents and skeptics. We find this, however, not to be the case, because the 'new computationalism' falls short by using limited versions of "traditional computation", or proposing computational models that easily fall within the scope of Turing's original model, or else proffering versions of hypercomputation with its many pitfalls. With increased visibility of trans people comes increased philosophical interest in gendered language. This chapter aims to look at the research on gendered language in analytic philosophy of language so far, which has focused on two concerns: (1) determining how to define gender terms like ‘man’ and ‘woman’ such that they are trans inclusive and (2) if, or to what extent, we should use gendered language at all. We argue that the literature has focused too heavily on how gendered language (...) can harm trans people, and has not considered how trans people use gendered language to create meaning and joy for ourselves. Pulling from the literature in sociolinguistics, we look at examples of how trans people use language to make their lives better by gaining recognition, playing with gendered language, finding joy in gendered language, and taking control of definitional power, concluding that debates about gendered language need to consider not only how such language harms trans people but also how trans people use it for our own liberation. I will relate some social and epistemic aspects involved in the conceptual development of the genetic model in the early Molecular Biology. I will use the link between Biology and Physics as a framework, which supports such assumptions, providing new methodologies, but mainly as a framework that provides a model of objectivity developed within Modern Tradition. Finally, I will interpret this relationship from the pragmatist perspective to embrace Rorty’s thesis on «the ontological priority of the social» which implies understanding biology (...) as a part of a general cultural politics. When asked which of our concepts are normative concepts, metaethicists would be quick to list such concepts as GOOD, OUGHT, and REASON. When asked why such concepts belong on the list, metaethicists would be much slower to respond. Matti Eklund is a notable exception. In his recent book, Choosing Normative Concepts, Eklund argues by elimination for “the Normative Role view” that normative concepts are normative in virtue of having a “normative role” or being “used normatively”. One view that Eklund aims (...) to eliminate is “the Metaphysical view” that normative concepts are normative in virtue of referring to normative properties. In addition to arguing that Eklund’s objection looks doubtful by its own lights, we argue that there are several plausible versions of the Metaphysical view that Eklund doesn’t eliminate, defending various claims about normative concepts and their relationships to deliberation, competence, reference, and possession along the way. ABSTRACT‘Exaltation views’ of humility are grounded on a kenotic view of humility, such that divine blessing comes proportionate to the extent to which an agent humbles herself. This article rejects exaltation views of humility which define humility kenotically, justify their arguments from a divine hiddenness perspective, and which conclude that divine concurrence with evil is justified as long as all humble believers eventually are exalted and blessed. Rather, I will contend that exaltation views misunderstand the meaning of both ‘humility’ and (...) ‘exaltation,’ even from their own Christian standpoint. I ultimately offer an alternate response to the problem of evil based on an existentially grounded conception of ‘humility’, which provides for a transmuted turn away from individual kenotic acts and toward community to transform those who suffer from atrocities. This paper is an attempt to understand metaphors in themselves and in our cognitive economy. Steinhart (2001) characterized metaphors in terms of processes of analogical transference. Metaphors, so considered, appear to respond to a natural tendency of the mind that would be common to both necessary and inductive processes and, apparently, even to insane ones. However, it is important to understand these analogical transference processes as a whole and in their similitudes and differences in the various cases. I first analyze (...) necessary and inductive transference processes and consider different models for their explanation. Then, I focus chiefly on metaphors and their peculiarities. I consider a potential rule-following explanation; I differentiate between the process of creation and of understanding metaphors from the author’s and the reader’s perspectives and how this impinges on our explanatory models. From here, I connect back to the question of analogical transference and reconsider the extent to which it applies to metaphors. Finally, I address a related problem concerning the potential risks that are also tied to our dispositional metaphorical capacities. (shrink)

This paper argues that, although Margaret Cavendish’s main philosophical contributions are not in philosophy of religion, she makes a case for a defense of God, in spite of the worst sorts of harms being present in the world. Her arguments about those harms actually presage those of contemporary feminist ethicists, which positions Cavendish’s scholarship in a unique position: it makes a positive theodical contribution, by relying on evils that contemporary atheists think are the best evidence against the existence of God. To demonstrate that Cavendish’s work should be considered as early modern feminist theodicy, this paper will briefly introduce the contemporary feminist worry about theodicy as a project, show that Cavendish shares the contemporary feminist view about situated evil, and argue that her theodicy aims for agreement about how to eradicate great moral evils while preserving free will—and so, carves out a space for future female philosophers of religion who aim to be agents of healing in the face of such evil. Abstract Nowadays, there is a deep and widespread feeling of discomfort among academics due to the psychological and labor pressures that universities exert upon their researchers by demanding endless publications. In this paper, I offer numerous pieces of evidence of this crisis, which affects primarily those who inhabit academic ecologies. First, I argue that it is convenient to understand the current situation as an expression of technologies and individual apparatuses shaped by subjectivizing ideologies, and mechanisms of exclusion, stigmatization, and replacement. (...) Second, I examine two proposals against the crisis produced by the pace of academic production framed by the Slow movement. Lastly, after making explicit some of the assumptions that undergird the university’s epistemological machine, I propose to complement Ulmer and Mountz’s project with two suggestions. On the one hand, I extend an invitation to reflect on and with students as a means to redirect the university’s teleology. On the other hand, I suggest incorporating an ontogogic approach as a resistance apparatus against the pressure from the university’s production machine. The article’s point of departure is anti-dicotonegative because it is based on a summative approach rather than in an agonistic procedure. In other words, I propose two additional tools that can be put to the test to contribute to solving the university publication crisis. (shrink)

In this work, a general framework for the analysis of governance of artificial intelligence is presented. A dashboard developed for this analysis comes from the perspective of political theory. This dashboard allows eventual comparisons between democratic and non democratic regimes, useful for countries in the global south and western countries. The dashboard allows us to assess the key features that determine the governance model for artificial intelligence at the national level, for local governments and for other participant actors. The dashboard (...) allows us to appraise aims of AI strategy and aims left aside in alternative strategies. The work shows the theoretical framework could be of use to advance case studies globally, and comparative endeavors. Applying the theoretical dashboard, the case study on China is undertaken. These are the main points the study tackles in the final discussion, conclusion and further recommendations: 1) the complex reality of AI command and control 2) uncertainties about future society and the polity against AI development and 3) particular cultural values enshrined in countries' AI development. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. En el presente texto me propongo mostrar cómo puede entenderse el concepto de ‘metafísica’, no como el estudio de algo “sobrenatural” o “más allá de lo físico”, sino como un estudio de segundo orden que tendría por objeto de análisis los hipotéticos principios fundamentales y modelos de dependencia de la realidad. En este sentido, más que sostener juicios taxativos acerca de lo que las cosas son o qué tipo de entidades existen, las reflexiones de la metafísica podrían entenderse como análisis (...) acerca de las condiciones necesarias y suficientes para que una teoría de primer orden explique un aspecto de la realidad —o toda ella en su conjunto— de la mejor manera posible. The problem of identity is central to epistemic transference. However, relative identity appears to be the only way to work out an epistemic useful notion of identity. Relative identity, on its part, is either parasitic on strict identity or not identity at all. If, on the contrary, we ought for a strict concept of identity capable of satisfying its requirements, we end up with a tautologic and epistemic worthless category. The paper provides an answer to this problem, which, while working (...) with a strict notion, shows how it might still serve epistemic purposes. In doing so, it shows how a formal reconstruction of our objectual world and the identities we refer to poses a workable model upon which our messy epistemic one acquires stability. The present paper 1departs from the discussion on the foundation of morality in Discourse Ethics (DE) and the criticism raised against it, coming to reconstruct in a somewhat different way the foundational process. A first section is dedicated to analysing the difficulties of Habermas distinction between morality and ethics and the criticism raised against it, questioning a) the possibility to set the difference in the distinction between norms and values and b) the presumed neutrality of DE regarding ethical evaluations. A (...) second section revisits the foundational proposal of DE. First of all, it provi- des an interpretation of the Kantian proposal that makes the universalization of norms subservient to the idea of human beings as ends in themselves. It then considers a) the subsistence of Kantian moral reasoning in its architectonic and b) suggests a formal structure in practical thinking that integrates in hierarchical modus Kantian, discursive and contextually determined evaluative conceptions. Using the two cases of the Icelandic Health Sector Database and Russian initiatives in biobanking, the article criticizes the view of narratives and imaginaries as a sufficient and unproblematic means of shaping public understanding of genetics and justifying population-wide projects. Narrative representations of national biobanking engage particular imaginaries that are not bound by the universal normative framework of human rights, promote affective thinking, distract the public from recognizing and discussing tangible ethical and socioeconomic issues, and harm trust in science and (...) technology. In the Icelandic case, the presentation of the project in association with national imaginaries concealed its market identity and could lead to the commodification of biodata. In the Russian case, framing in terms of "genetic sovereignty" and "civilizational code" offers pretexts for state securitization. Adherence to normative framework of human rights and public discussion of genetics in an argumentative and factual mode can counter these trends. (shrink)

The paper attempts to conciliate the important distinction between what-is, or exists, and what-is-not _thereby supporting Russell’s existential analysis_ with some Meinongian insights. For this purpose, it surveys the varied inhabitants of the realm of ‘non-being’ and tries to clarify their diverse statuses. The position that results makes it possible to rescue them back in surprising but non-threatening form, leaving our ontology safe from contradiction.

The article is focused on the phenomenon of the early Ukrainian decadent cinema, in particular, in relation to filmings of Volodymyr Vynnychenko’s dramaturgy. One of the brightest examples of ‘film decadence’ in Vynnychenko’s oevre is “The Lie” directed by Vyacheslav Vyskovs’ky in 1918, discovered recently in the film archives. This film displays the principles of ‘ethical symbolism’, ‘dark’ expressionist aesthetics and remains the unique masterpiece of specifically Ukranian film decadence.

У статті здійснено концептуальний аналіз політичної практики франкістського авторитарного режиму, його ідеологічних засад та суспільно-політичних доктрин, розглянуто їхні історичні витоки, фактори та причини формування, складники, сутність, еволюцію та трансформацію ідеологічних принципів і доктрин відповідно до історичних етапів, які пройшов у своєму розвитку іспанський франкістський режим упродовж 1939–1975 років. Доведено відсутність у франкістській Іспанії уніфікованої ідеології, на кшталт націонал-соціалістичного чи фашистського режимів, використання франкізмом розмаїтого консервативного політико-ідеологічного спектра, репрезентованого націоналістичними, традиціоналістськими, конфесійними рухами, коріння яких часто сягає давнього історичного минулого Іспанії. Вивчено (...) їхні історичні, політико-філософські, соціальні витоки та складники, простежено особливості їхнього становлення, розвитку, модифікації та еволюції відповідно до трансформації політичної, соціально-економічної та зовнішньополітичної практики франкізму. Досліджено правові основи режиму, сутність теорії та практики «органічної демократії», шляхи та механізми організації державної влади, становлення та еволюцію універсального статусу глави держави, який забезпечив ефективність і спадковість королівської влади і мирний перехід до демократичних реформ. Авторка статті акцентує увагу на прямій взаємозалежності розвитку й еволюції стабілізаційно-реформаторської франкістської авторитарної політичної системи та унікальної моделі переходу Іспанії до повноцінної демократії, набуття нею в короткі терміни суб’єктності в міжнародних відносинах і членства в євроатлантичних структурах. Блеймана вміщено в контекст дискусії про поетичне і прозаїчне кіно, яку систематизовано щодо двох підходів: нормативного, який вважає лише один із напрямів кіно релевантним його природі (йому відповідає сполучник «чи»), і плюралістичного, який розглядає обидва напрями як актуалізації різних кінематографічних потенцій згідно з тими завданнями, що ставлять режисери (йому відповідає сполучник (...) «і»). This doctoral thesis examines the phenomenon of Filipinization, specifically understood as the ideological construction of a “Filipino identity” or ‘Filipino subject-consciousness” within the highly determinate context provided by the Filipino ilustrado nationalists such as José Rizal, Marcelo H. del Pilar and their fellow propagandists inasmuch as it leads to the nineteenth (19th) century construction of the modern Philippine nation. Utilizing Jacques Derrida’s deconstructive thinking, this study undertakes a genealogical critique engaged on the concrete historical examination of what is meant by (...) the term “Filipino” across a select historical timeline (1864-1898) and the various notions of Filipino identity implied by the different contexts within which the term “Filipino” has been employed. More specifically, it undertakes a selective philosophical excavation of three seminal texts in the history of Filipinization, viz.: 1) the Manifiesto of Padre Jose Burgos; 2) the writings of the Filipino ilustrados in La Solidaridad; and 3) Jose Rizal’s Annotations on Dr. Antonio de Morga’s Sucesos de las Islas Filipinas. -/- The philosophical claim of this work is the idea that Filipinization, taken as the differential construction of Filipino identity, is the effective translation of the colonial epistemic violence of Eurocentric racism and its consequent “horror of absolutism” into the homo-hegemony of Filipino nationalisms. By fetishizing the notion of a carefully constructed and essential “Filipino-identity,” Filipinization and the current nationalist discourses that utilize them, unwittingly, stands complicit with the same colonial violence and hegemony that they wish to combat. This happens precisely when the very structures of colonial oppression, on the ideological and practical levels, are transmogrified into nationalist ideals that assume legal and political power unto themselves in a self-referential and self-legitimating fashion. -/- Three processes will demonstrate the above thesis: first, by examining historical texts and setting itself against established nationalist historiographies, a genealogical analysis of the term “Filipino” reveals it as a pliable signifier whose semantics have evolved through time. From its originary referent in the Spanish criollo (creole), it has come to refer to people who would have been otherwise entirely alien to this class, viz., the mestizos (both Spanish and Chinese), the principalia (native elite), and eventually, the lowland Catholicized natives themselves. The historical hermeneutic of this identity-discourse in Padre José Burgos’ Manifiesto yields the fact that what gives the term “Filipino” its semantic consistency as a class concept is its essential constitution as a Hispanic and Catholic identity. -/- Second, from this semantic identification of the term “Filipino” as a Hispano-Catholic identity, we proceed to clarify the meaning of Filipinization in terms of the nationalist propaganda carried out by the Filipino ilustrados in the fortnightly periodical La Solidaridad. Here, the specific ilustrado construction of Filipino identity as a Spanish citizen (ciudadano Español) is revealed precisely as a political and legal construct that served as the basis for their own politics of social inclusion/exclusion. Filipinization can only be applied to those who have been hispanized and Christianized and never to those tribes who have resisted and remained outside Spanish colonial authority. Filipinization is thus revealed as a process of Hispanization and Christianization whereby the recipients of Spanish colonial hegemony are transformed into the religiously docile bodies of the Spanish Empire. -/- From this highly determinate context, the study proceeds to examine Rizal’s ontological grounding of collective Filipino-ness in the mythological construction of the pre-hispanic past as the source of a unique Filipino ancestrality. In his work on de Morga’s Sucesos, what is revealed is a mythologization that grounds a native, essential Filipino identity within a past unscathed by the Spanish colonial experience. Such mythologization, however, can only be possible through an anachronistic nationalist interpretation of historical data. Here, Filipinization is revealed as an exclusive prerogative, a nationalist program by which Rizal and the ilustrado class can combat the evils and excesses of the Spanish colonial enterprise. Ironically, though, this same struggle for emancipation also became an instrument by which the ilustrado class can retain their unjustified position of power over those who belonged to the colonial underside, thus, securing the possibility of perpetuating their own ilustrado bourgeois class interests. -/- Such discursive complicity is the essence of the myth of Filipinization: it presents nationalist identity discourse as an anti-colonial enterprise while being underlined by an economy of motives designed to cater primarily to the exclusive interests of the elite and ilustrado class. Thus, instead of securing the genuine, inclusive emancipation of all colonial subjects and a more humane existence for the poor and suffering majority, ilustrado nationalism has, ironically, merely reinforced those operative structures of colonial discrimination and oppression when the ilustrados: 1) grounded their racial theory upon the very same discourse of Eurocentric superiority that they are precisely supposed to question and 2) claimed a patrimony over Filipinas as their exclusive sovereign inheritance. These two factors illustrate how the manifest transfer of power from the Spanish Empire to the Philippine sovereign nation (and later as a nation-state) illustrate how Filipinization merely has transmogrified the face of Spanish colonialism into its new, subtle, and worse form in Filipino nationalism. -/- In this vein, the existence of the 19th century modern Philippine nation merely masked and deferred the crisis that was supposed to transfer power from the Spanish Empire to the multitude of the poor and suffering native indio majority. This crisis became all the more difficult to address be-cause of the duplicitous character of the discourse of Filipinization itself. It has not only effectively transferred power into the hands of the nationalist elite but also captured authentic emancipatory discourse within the identity-trap against which it can only hope to get out. This study concludes with the claim about the impossibility of ever escaping and overcoming the epistemic and practical violence necessarily contained within the historical discourse of colonialism. Or simply, we have no language or discourse that would enable us to overcome the complicity of Filipinization with the very (epistemic) violence against which it has set itself. (shrink)

Resumen: Este trabajo tiene como principal objetivo el de lograr una comprensión de la la filosofía en cuanto fundamento insoslayable para la teología. Sostiene, en primer lugar, la necesidad de desarrollar una teología más autocosciente en el sentido racional del σὺν λόγω, es decir, desde el programa plenamente actual de la fides quarens intellectum. Defiende, en segundo lugar, que la filosofía solo puede entenderse partiendo de la pretensión que la ha animado desde el comienzo de su andadura: la búsqueda de (...) la verdad de las cosas (veritas rerum). Y para este fin tendrá necesariamente que dotarse de densidad metafísica suficiente y apostar por las tesis de un sano realismo cognoscitivo. Este estudio concluye con una reflexión, en tercer lugar, sobre el uso teológico de la filosofía. La tesis que se defiende es que sin el fundamento filosófico, la fe y la teología pierden lo más nuclear de su misión, la posibilidad misma de presentarse todavía con algún rastro de significatividad para el hombre de hoy. It sustains, in the first place, the need to develop a more self-aware theology in the rational sense of the σὺν λόγω, that is to say, from the fully current program of the fides quarens intellectum. It defends, in the second place, that philosophy can only be understood parting from the pretension that has animated it from its outset: a search for the truth of things (veritas rerum). El propósito de Levinas coincide con el intento moderno de recuperación de la verdad y del sentido aunque en una dirección y contenidos distintos. Si en Hegel la Aufhebung tendía a la Totalidad y lo Mismo , para Husserl será esencial la apertura de Mundo que tiene lugar ya en la experiencia de conciencia del ego trascendental, mientras que Heidegger, por su parte, primará la pregunta por el Ser. El intento de Levinas, en cambio, no será recomponer la relación entre (...) el yo, por un lado, y el mundo, lo absoluto, las cosas o el ser, por el otro, sino la recuperación de la relación entre yo-y-otro. No es un simple cambio en la dirección o en el contenido del sentido de la reflexión filosófica, sino un intento serio de encontrar una nueva significación, «otra manera que ser» que no termine siendo otro proyecto más de integración y síntesis. Lo que propone Levinas es una auténtica salida para la que traza el itinerario que va del ser al otro, recurriendo sencillamente a la experiencia que cotidianamente se nos impone a cada uno de nosotros con un peso incontestable, a saber: la presencia de las diferencias, de lo asimétrico, en definitiva, la manifestación del otro en tanto que otro. Es esta experiencia heterónoma ordinaria, esta vivencia diaria de la alteridad como dato primordial del fenómeno de la intersubjetividad el ámbito que ha intentado explorar nuestro autor. ¿Acaso es esta responsabilidad así sentida conjugable con una experiencia filosófica universal? ¿La responsabilidad puede llevarse hasta el límite de la substitución por el otro, hasta la de-posición del Yo sin identidad? ¿Qué tipo de relación puede darse con algo absolutamente asimétrico, exterior, previo e irreductible? ¿De dónde viene esa asignación apremiante de responsabilidad que llega hasta arrojarme en la obsesión y el asedio? ¿Cómo puede ser éticamente plausible un mandato tan traumatizante y violento que termina por convertir al sujeto en rehén, sustituido ya por los otros? ¿Es posible conciliar la libertad y la autónoma decisión del sujeto con una consideración de la subjetividad como «heme aquí», absoluta pasividad expuesta a los otros y vulnerabilidad de una piel que se ofrece al ultraje y la herida?. En definitiva: ¿es la subjetividad algo de lo que partimos o a lo que llegamos? (shrink)

E n el Complejo Regional Nororiental imparten clases docentes que pertenecen al Sistema Nacional de Investigadores del CONACyT, los cuales tienen diversos intereses académicos y científicos a través de los que contribuyen al desarrollo de la ciencia de la BUAP en un contexto regional, así lo resaltó el Dr. Sergio Díaz Carranza director de esta sede académica al resaltar su labor impulsa el interés de los estudiantes por participar activamente en los proyectos científicos que benefician a su comunidad.

La cuestión principal que se plantea pretende averigüar si la tecnocracia en nuestra sociedad postsecular es un elemento que contribuye o dificulta el desarrollo integral del hombre del que hablaba Popolurum progressio. Divido mi exposición en tres partes recogiendo los mismos términos que aparecen en el título que la encabeza. Hablaré, en primer lugar, de la tecnocracia o de la cultura tecnológica, es decir, el modo en el que es la técnica es vivida y aplicada en los contextos sociales actuales. (...) Situaré después la cuestión en el marco postsecular de nuestra sociedad intentando profundizar en la relación entre ambas magnitudes, la tecnocracia y la postsecularidad. Concluiré mi reflexión analizando las consecuencias, y las oportunidades también, de un nuevo humanismo en continuidad con la propuesta levinasiana, o sea, orientando mi valoración final hacia posibilidad de un humanismo de otro hombre. The main question that is tackled is to find out whether the technocracy in our postsecular society is contributing to the integral development that Populorum Progressio talked about, or it is making it difficult. The paper is divided into three parts. First of all, it talks about technocracy or technological culture, that is to say the way in which technique is lived and applied in current social contexts. Secondly, the question is placed in the postsecular framework of our society, trying to deepen the relationship between both issues: technocracy and postsecularity. The reflection concludes by analyzing the consequences, and also the opportunities, of a new humanism in continuity with the Levinasian proposal, that is, orienting the final assessment towards the possibility of a humanism of another man. -/- . This study focuses on nuclear tourism, which flourished a decade ago in the Exclusion Zone, a regimented area around the Chornobyl Nuclear Power Plant (Ukraine) established in 1986, where the largest recorded nuclear explosion in human history occurred. The mass pilgrimage movement transformed the place into an open air museum, a space that preserves the remnants of Soviet culture, revealing human tragedies of displacement and deaths, and the nature of state nuclear power. This study examines the impact of the site (...) on its visitors and the motivations for their persistence and activities in the Zone, and argues that through photography, cartography, exploration, and discovery, the pilgrims attempt to decode the historical and ideological meaning of Chornobyl and its significance for future generations. Ultimately, the aesthetic and political space of the Zone helps them establish a conceptual and mnemonic connection between the Soviet past and Ukraine’s present and future. Their practices, in turn, help maintain the Zone’s spatial and epistemological continuity. Importantly, Chornobyl seems to be polysemic in nature, inviting interpretations and shaping people’s national and intellectual identities. (shrink)

El artículo comienza destacando cómo la filosofía y la religión han procurado desbordar la contingencia y la finitud de la vida individual tratando de engullir a la muerte en la noche una y universal de la nada mediante el pensamiento del Todo (Franz Rosenzweig). Hegel simboliza el relevo más sobresaliente en esta dilatada carrera de la filosofía como fuga mortis. Nuestra época se presenta, en cambio, como el período histórico que ha preferido vivir el miedo antes que evanescerse en nada. (...) La idea central que defiende este trabajo es la conexión, aparentemente inconciliable, entre muerte y metafísica. Analizar dicha unidad y sus implicaciones para la realidad sustantiva humana en el núcleo mismo de la filosofía de Zubiri constituye el objetivo principal de este artículo. PALABRAS CLAVE Zubiri, Heidegger, Scheler, Levinas, muerte, metafísica, fenomenología. ABSTRACT The article starts by emphasizing how philosophy and religion have tried to exceed the contingency and the finitud of the individual life trying to devour the death in the night one and universally of nothing ness by means of the thought completely (Franz Rosenzweig). Hegel symbolizes the most brilliant relief in this extensive race of the philosophy as fuga mortis. Our time appears, on the other hand, as the historical period that has preferred living through the fear before dissappearing in to nothing ness. The main idea that defends this work is the connection, seemingly irreconcilably, between death and metaphysics. To analyze this mentioned unit and its implications for the substantival human reality in the core itself of Zubiri's philosophy constitutes the principal aim of this article. The objective of the research is to carry out a review of the literature about suicide risk factors in young university students. The methodology used is quantitative descriptive with a bibliometric approach, under the PRISMA method. The search was carried out in three databases: Clarivate Web of Science, MDPI and Taylor and Francis that had the variables of suicide risk factors. Inclusion criteria were used such as: study variables, years 2019 to 2022, published in Spanish and English,scientific reports research results, (...) research with clinical and non-clinical population. After the application of the Boolean operators, the total sample is (n=10360) and after screening with the PRISMA method (n=45). Results: The United States, followed by China and Bangladesh, are the countries that produce the most on the subject. The most frequent risk factors are: depression, anxiety, stress, academic commitments, lack of opportunities, low income and race. The students with the highest suicide rates are in the health area such as medicine and nursing, in addition, there is more suicide intent in women than in men. (shrink)
