Este trabajo pretende comparar ambas alternativas concretadas cada una en un caso. En representación de la estrategia de la explicación (1), se usa un artículo de Weber quien defiende la estrategia de la inferencia de la mejor explicación. Humean compatibilism is the combination of a Humean position on laws of nature and the thesis that free will is compatible with determinism. This article's aim is to situate Humean compatibilism in the current debate among libertarians, traditional compatibilists, and semicompatibilists about free will. We argue that a Humean about laws can hold that there is a sense in which the laws of nature are 'up to us' and hence that the leading style of argument for incompatibilism?the consequence argument?has a (...) false premiss. We also display some striking similarities between Humean compatibilism and libertarianism, an incompatibilist view. For example, standard libertarians face a problem about luck, and we show that Humean compatibilists face a very similar problem. (shrink)

My central question in this paper is how delusional beliefs are related to self-deception. In section 1, I summarize my position on what self-deception is and how representative instances of it are to be explained. I turn to delusions in section 2, where I focus on the Capgras delusion, delusional jealousy (or the Othello syndrome), and the reverse Othello syndrome.

This article‘s point of departure is a proto-analysis that I have suggested of entering self-deception in acquiring a belief and an associated set of jointly sufficient conditions for self-deception that I have proposed. Partly with the aim of fleshing out an important member of the proposed set of conditions, I provide a sketch of my view about how selfdeception happens. I then return to the proposed set of jointly sufficient conditions and offer a pair of amendments.

This paper argues, through conceptual analysis, against an objection to the disapproval of banks for the 2007-8 crisis: the idea that they could not have acted otherwise (at least not rationally) and that no one should be blamed for a fact one could not have avoided. If true, it would threaten the justification of corporate social responsibility and the legal liability of managers. Identified as the ‘inevitability thesis’, this objection is illustrated by an analysis of the film Margin Call (2011) (...) and associated with other investigations on ethics and responsibility. The target thesis stems from a confusion between different notions of responsibility (for a task, for a decision, for causing an event and for repairing it) and leads to an incoherent form of fatalism. Finally, it is suggested that the invocation of ‘inevitability’ may be a way of rationalizing the decision, obscuring reasons to the contrary. (shrink)

This paper reviews debates related to the social cost of carbon (SCC) and the challenge of pricing uncertain damages that will occur only in the future. They often revolve around the pure time preference rate, which reflects how much one favors present over future well-being. The SCC measures the marginal cost of the impact on economic growth caused by the emission of a quantity of greenhouse gases equivalent to an additional ton of carbon dioxide (tCO2eq). There is significant variance among (...) estimates of the SCC; one of the reasons for it is a disagreement on how to bring future damages to present values, especially over the so-called "delta parameter" – the pure time preference rate – of the corresponding discount function. On the one hand, the descriptive approach, associated with William Nordhaus, proposes to use the time preference empirically observed among individuals, which would result in a significant limitation of the present value attributed to the distant future. On the other hand, the normative approach, associated with Nicholas Stern, proposes to treat everyone impartially, in every generation, and so implies transferring more resources to future generations. In the limit, assuming exponential population growth, it would lead to a philosophical stance akin to the so-called "longtermism" (as defended by William MacAskill in What we owe the future). In addition, the analysis points out obstacles to using the SCC to price carbon for climate policies. These include aspects related to economic methodology (such as ecological economics critiques of welfarist accounts of intergenerational allocations) as well as political philosophy. Thus, challenges related to uncertainty about socioeconomic development trajectories, intergenerational justice, and public reason become key. Finally, we present the target-consistent pricing approach, where one calculates a carbon price compatible with specific mitigation targets – an alternative to SCC methodologies. This approach is advocated as a way to avoid the uncertainty and the disagreements associated with the SCC, emphasizing the importance of meeting goals set by binding political decisions – such as the Paris Agreement. Abstract: Using a critical review of the literature, we study a challenge from philosophical anarchism to J. Raz's theory of legal authority: it would be irrational to follow an order with which one disagrees, since it would mean acting against what is considered more justified. Through references from decision theory and epistemology, and deploying examples about tools for assisting in routine decision-making, we sketch two possible answers: first, it may be justifiable to put yourself in a situation that leads to (...) irrationally acting; second, according to the “blindspots” theory, we outline some restrictions from a theory of rationality to the authority. A pair of compatibilists, John Fischer (2012: ch. 6; n.d.) and Manuel Vargas (2012) have responded to a problem about luck that Alfred Mele (2005, 2006) posed for incompatibilist believers in free will and moral responsibility. They offer assistance to libertarians - at least on this front. In this paper, we assess their responses and explain why what they offer is inadequate for libertarian purposes.

This dialogue between Achilles and the Tortoise – in the spirit of those of Carroll and Hofstadter – argues against the idea, identified with the “traditional” interpretation of Aristotle’s “sea battle argument”, that future contingents are an exception to the Principle of Bivalence. It presents examples of correct everyday predictions, without which one would not be able to decide and to act; however, doing this is incompatible with the belief that the content of these predictions lacks a truth-value. The cost (...) of using a non-classical logic to cope with that may be too high for Stagirite’s defenders, and they would still need to explain why our ordinary predictions seem to have a binary truth-value. In the end, the paper suggests that the problem of future contingents – and of free will – is not a logical problem at all, but rather a limit on what an agent can believe before taking a decision. O Judiciário moderno constitui um sistema hierarquizado e centralizado, em que cortes superiores, com um número pequeno de membros, têm a função de “dar a última palavra” para resolver desacordos doutrinários entre instâncias inferiores – e inclusive rever decisões das demais autoridades. Essa estrutura hierárquica implica uma fonte peculiar de instabilidade: o tribunal superior se torna como que um “ponto único de falha” suscetível à captura, à pressão indevida, à sobrecarga, e até a súbitas mudanças doutrinárias – pondo em risco (...) seu alegado papel de estabilizador do regime democrático. Isso é salientado quando tais cortes sofrem pressão, ou quando há reviravoltas decorrentes de uma maioria frágil no tribunal – a exemplo do debate sobre a prisão em segunda instância no Brasil. Analiso como o desenvolvimento tecnologias de informação e comunicação (TICs) poderia mitigar este problema por meio de um sistema que agregue decisões judiciais de instâncias inferiores a fim de resolver conflitos de jurisprudência numa determinada jurisdição; isso equivaleria a um sistema de votação que substituiria a atuação da corte de última instância na unificação de jurisprudência – como se a última instância fosse, na realidade, composta pelo judiciário como um todo. Isso alteraria a estrutura de decisão hierarquizada do judiciário, no que diz respeito a divergências entre magistrados, aumentando a descentralização do sistema – associada ao ideal da tradição de common law. Embora original, a proposta é modesta, e poderia ser atingida por meio de mudanças incrementais, sem ruptura institucional, a partir de práticas e tecnologias já existentes – e uso como exemplo ferramentas de legal analytics e o sistema de “repercussão geral de recursos extraordinários” do Brasil, no qual se utiliza processamento de linguagem natural para filtrar e classificar processos de acordo com o tema. Ao final, discutem-se possíveis vantagens e desvantagens dessa proposta, como características epistêmicas da descentralização e o risco de “rigidez” na evolução da doutrina jurídica – em especial no que se refere aos longos mandatos de membros de tribunais superiores. Concluímos que a descentralização da unificação da jurisprudência pode contribuir para mitigar o risco de, com o desenvolvimento da tecnologia, maior concentração de poder. (shrink)

Abstract: We face objections against punishing financial firms and managers for producing risks for the financial system – that it’s either paternalistic or inefficient. Against the first: financial crises are so damaging that governments and deposit insurance funds have to intervene – an implicit guarantee to creditors. This is controversial from the perspective of political morality: it implies using resources from the public for the benefit of better-off people who willingly incur risks. So, we begin by studying a possible justification (...) for this arrangement from the ‘incentives argument’ derived from the Rawls difference principle, in the light of G. Cohen’s criticisms. Against the second: we cannot completely dispense with coercive instruments - mainly for the moral hazard entailed by the implicit guarantee. Therefore, we conclude the threat of liability must have a punitive and a preventive character, extending to non-compliance with norms on risk even before generating major economic effects. From a critical review of the literature, we analyze the incompatibility between the possibility of incorporating moral principles to the law and its authoritative nature, as argued by exclusive positivists, such as J. Raz. After presenting his argument in second section, we argue in the third section that it is incompatible with commonly accepted (even by Raz) premises of the theory of legal interpretation, or else it would lead to contradiction - unless one presupposes, within the premises, a strong version (...) of the sources thesis (which is what Raz intends to prove). In conclusion, we return to the arguments presented, concluding with a possible difficulty for the adoption of exclusive positivism by people inside a legal practice. (shrink)

Jacobs (2018) decidiu agradecer todas os envolvidas na preparação de seu cafezinho diário; isso o levou a uma jornada épica para contatar milhares de pessoas, desde a barista que lhe vendia o expresso matinal, passando por designers e inventores, até os agricultores que plantaram e colheram o grão em outro continente. Não existe um único indivíduo ou grupo responsável pelo seu café: é preciso um mundo para produzi-lo; é resultado de uma cadeia produtiva, uma rede decentralizada (...) que envolve diversos serviços espalhados internacionalmente – e todas essas pessoas, por sua vez, consomem outros produtos, com outras cadeias. Como este livro. Contraste esse exemplo com a anedota do diplomata soviético que, visitando Londres, fica maravilhado com as padarias – e então pergunta pelo encarregado da distribuição de pães na cidade (Harari, 2016, p. 372). Para seu espanto, os economistas ingleses respondem que ninguém tem esse cargo: o fornecimento de pães é resultado de um agregado de decisões individuais, em que cada fornecedor de matéria-prima (como farinha, sal, fermento) e serviços (transporte, padaria, limpeza) regula sua oferta a partir do que espera que os consumidores querem consumir – e o quanto estes estão dispostos a pagar. É o caso clássico do funcionamento de uma economia de mercado – em contraste com uma economia de comando, onde um grupo de pessoas, conscientemente, toma decisões sobre produção e distribuição. Esses exemplos ressaltam as “vantagens” dos mercados; pode ser tentador pensar, a partir deles, que todos os bens e serviços deveriam ser fornecidos dessa forma, porque isso maximiza a liberdade individual ou tende a 553 levar ao bem-estar coletivo, e que o melhor a fazer é evitar interferências nesse sistema – ideias associadas ao liberalismo econômico, uma teoria política e econômica que tem por patrono Adam Smith (o primeiro economista clássico). No entanto, mesmo economistas liberais reconhecem que há falhas de mercado (como bens públicos e monopólios129). Voltemos a A. J. Jacobs, o qual frisa seu agradecimento ao serviço de fornecimento de água, um “milagre moderno”: ao longo da história, a imensa maioria das pessoas não teve acesso a água encanada – mesmo hoje, 2 bilhões de pessoas ainda carecem de condições sanitárias adequadas (água e esgoto), o que causa doenças que matam 829 mil por ano (WHO, 2015). É um problema que não pode ser resolvido só por mercados, nem por associações filantrópicas; na maior parte do mundo, é um serviço público, geralmente fornecido ou regulado por estados – e sua ausência decorre de falhas de governo. One of the explanations for the Great Crisis of 2007-2008 was that financial authorities should have issued stricter regulations to prevent the housing bubble. However, according to Alan Greenspan, President of the Federal Reserve System (FED) from 1987 to 2006, this is to judge with hindsight. No one can guess when a “bubble” begins, nor when it ends; they happen because of the “irrational exuberance” in investors’ behavior, which causes boom and bust cycles. Regulators are not in a better situation (...) for assessing risks, though: since market participants supposedly know their own risks better than the regulator (a kind of informational asymmetry), an intervention (except to ensure law-enforcement) would imply unjustified paternalism. However, a regulator does not have to be conceived as a paternalistic authority. We sketch an objection to Greenspan's argument, arguing that crises don’t require a defective reasoning such as the “irrational exuberance” – our usual bounded rationality might be enough to provide the kind of “self-fulfilling prophecy” observed in the rise and fall of bubble assets value. Given the possibility of grave externalities, authorities are justified in adopting measures to ensure investors behave in a prudent way, even if they supposedly know better their own risks. Social decisions are often made under great uncertainty – in situations where political principles, and even standard subjective expected utility, do not apply smoothly. In the first section, we argue that the core of this problem lies in decision theory itself – it is about how to act when we do not have an adequate representation of the context of the action and of its possible consequences. Thus, we distinguish two criteria to complement decision theory under ignorance – Laplace’s principle (...) of insufficient reason and Wald’s maximin criterion. After that, we apply this analysis to political philosophy, by contrasting Harsanyi’s and Rawls’s theories of justice, respectively based on Laplace’s principle of insufficient reason and Wald’s maximin rule – and we end up highlighting the virtues of Rawls’s principle on practical grounds (it is intuitively attractive because of its computational simplicity, so providing a salient point for convergence) – and connect this argument to our moral intuitions and social norms requiring prudence in the case of decisions made for the sake of others. After the 2008 crisis, there were several debates on the bail-out and the lack of accountability of financial institutions; this supposedly affects politica l values such as equality and responsibility: it implies transferring resources from the public (for instance, poor people) to specific economic agents who have chosen to incur certain risks. On the other hand, it is arguable that it would not be up to the regulators to protect investors’ interests, and that there would be more efficient and less (...) burdensome instruments associated with prudential regulation. Our goal is to provide a justification for the bail-out and for holding bankers accountable. In section 2, we present a brief description of the problem in the context of the crisis, followed by a justification for the bail-out through the incentives argument, based on Rawls’s difference principle. In section 3, we provide an ethical discussion over the corresponding moral hazards, and investigate how to mitigate it through coercive measures. (shrink)

Preface for Festschrift for Asher Peres's 70th Birthday, Foundations of Physics, issues 35(11), 35(12), and 36(1). -/- “All my friends!” These were nearly the first words I ever heard come from Asher Peres’s mouth. It was at a conference in Maryland in 1994 honoring the 83rd birthday of John Wheeler. The first morning of the meeting I spied Asher walk out of the lecture hall and into a long hallway where, in the distance, he saw a group of old colleagues. (...) His words came out so spontaneously and so lovingly it left a mark on me. I thought, “What a wonderful way to lead a life!—to have results that effect the world over, to travel the world reporting them, to see each conference as a family reunion.” Asher was a man of family—his blood family in Israel and his family of physicist colleagues throughout the world. The book, Autonomous Agents: From Self-Control to Autonomy (1995), by Alfred R. Mele, deals primarily with two main concepts, “self-control” and “individual autonomy,” and the relationship between them. The book is divided into two parts: (1) a view of self-control, the self-controlled person, and behaviour manifesting self-control, and (2) a view of personal autonomy, the autonomous person, and autonomous behaviour. Mele (Ibid.) defines self-control as the opposite of the Aristotelian concept of akrasia, or the contrary of akrasia, which implies weakness (...) of will, incontinence, or lack of self-control—the state of mind in which one acts against one’s better judgement. According to Mele, the concept of self-control can be approached from two perspectives: (a) how self-control affects human behaviour, and (b) how self-control-associated behavior can enhance our understanding of ‘personal autonomy’ and ‘autonomous behaviour’—personal autonomy requires self-control, and autonomous persons and autonomous behaviour are naturally found together. Therefore, I might say that self-control is essential to enhancing one’s autonomy. -/- In part I, we find an account of self-control where Mele argues that even an ideally self-controlled person might lack autonomy. In part II, Mele gives an explicit account of autonomy and explains what must be added to self-control to achieve autonomy. This is the pivotal claim made by Mele (dismantling the intuitively connected notions of self-control and autonomy). (shrink)

Alfred Mele’s zygote argument for incompatibilism is based on a case involving an agent in a deterministic world whose entire life is planned by someone else. Mele’s contention is that Ernie (the agent) is unfree and that normal determined agents are relevantly similar to him with regards to free will. In this paper, I examine four different ways of understanding this argument and then criticize each interpretation. I then extend my criticism to manipulation arguments in general. I conclude that the (...) zygote argument is no threat to compatibilism. (shrink)

Al Mele’s Manipulated Agents: A Window to Moral Responsibility (OUP 2019) is an extraordinarily careful and clear little book. A central recurring element is the use of examples of radical value reversals due to manipulation. In this commentary, I discuss the relevance of these examples to a simple quality of will account of blameworthiness without explicit historical conditions. Such an account, I suggest, can fairly straightforwardly explain how value reversals might mitigate blameworthiness. But I also suggest that the intuition that (...) they completely remove blameworthiness should instead be explained away. (shrink)

This is an extension of my earlier work, The Coast is Not Clear. This paper offers an alternative view in the discussion of passive action between Harry Frankfurt (1978) and Alfred Mele (1997). First, I will describe Frankfurt’s noncausal account of action. Second, I will present counterexamples on behalf of Mele’s causal account. Then, I will introduce the Frankfurt-friendly View (FFV) which captures Frankfurt’s judgments about action while rejecting Frankfurt-style cases. I will explore what constitutes and explains actions in each (...) view. I will then analyze the counterexamples using Mele’s view and the FFV. Abstract -/- Libertarians typically believe that we are morally responsible for the choices (or decisions) we make only if those choices are free, and our choices are free only if they are neither caused nor nomically necessitated by antecedent events. Recently, there have been a number of attempts by philosophers to refute libertarianism by arguing that because a libertarianly free decision (choice) is both causally and nomically undetermined, which decision an agent makes in a deliberative situation is a matter of (...) luck, which implies (due to the way these philosophers use 'luck') that the agent does not have control over which decision he makes. This argument has been dubbed "the Argument from Luck" or "the Luck Objection" against libertarianism – henceforth 'LO'. In this paper, we examine some versions of LO as reflected in the works of Alfred Mele (2006), Neil Levy (2011), and Peter van Inwagen (2000, 2011). We argue that libertarians have nothing to fear from LO. Deep down the objection reflects a failure, on the part of its proponents, really to come to grips with the libertarian position. (shrink)

Abstract: In Chapter 4 of his "Self-Deception Unmasked" (SDU), Al Mele considers several (attempted) empirical demonstrations of self-deception. These empirical demonstrations work under the conception of what Mele refers to as the 'dual-belief requirement', in which an agent simultaneously holds a belief p and a belief ~p. Toward the end of this chapter, Mele considers the argument of one biologist and anthropologist, Robert Trivers, who describes what he takes to be an evolutionary explanation for coming to form false beliefs. Mele (...) argues briefly that Trivers's account is no more explanatory than a similar one that does not include the dual-belief requirement. I present a case describing Trivers' analysis, show how Mele might reply to it. After briefly explaining Mele's sufficient conditions for entering self-deception from Chapter 3 of SDU, I'll consider what it means to hold the dual-belief. I'll then consider what I take to be a class of cases of self-deception which rely on genetic determinism, which I take to satisfy the dual-belief condition. (shrink)

This paper offers an alternative view within the discussion of passive action between Harry Frankfurt (1978) and Alfred Mele (1997). The so-called new view presented here is unique in that it captures Frankfurt's judgments on action while, at the same time, denying Frankfurt-style cases. Though Mele's 'coasting' counterexamples severely threaten Frankfurt's view, the new view manages to avoid these objections. I leave it open to which view best characterizes passive action. Alfred Mele’s zygote argument is widely considered to be the strongest version of the manipulation argument against compatibilism (about free will and determinism). Opponents have focused largely on the first of its two premises and on the overall dialectic. My focus here will be on the underlying thought experiment—the Diana scenario—and on the second premise of the argument. I will argue that reflection on the Diana scenario shows that the second premise does not hold, and we will see that my (...) objection to the second premise helps to defend the claim that manipulation arguments face, in general, a dilemma. Alfred Mele's deflationary account of self-deception has frequently been criticised for being unable to explain the “tension” inherent in self-deception. These critics maintain that rival theories can better account for this tension, such as theories which suppose self-deceivers to have contradictory beliefs. However, there are two ways in which the tension idea has been understood. In this article, it is argued that on one such understanding, Mele's deflationism can account for this tension better than its rivals, but only if we (...) reconceptualize the self-deceiver's attitude in terms of unwarranted degrees of conviction rather than unwarranted belief. This new way of viewing the self-deceiver's attitude will be informed by observations on experimental work done on the biasing influence of desire on belief, which suggests that self-deceivers don’t manage to fully convince themselves of what they want to be true. On another way in which this tension has been understood, this account would not manage so well, since on this understanding the self-deceiver is best interpreted as knowing, but wishing to avoid, the truth. However, it is argued that we are under no obligation to account for this since it is a characteristic of a different phenomenon than self-deception, namely, escapism. (shrink)

‘Attempted negligence’ is a category of criminal offense that many jurists and philosophers have law have deemed conceptually incoherent. In his Attempts: In the Philosophy of Action and the Criminal Law, Gideon Yaffe challenges this dismissal, anchoring his argument in cases of what he calls ‘mental self-management’ in which agents plan to bring about that they perform unintentional actions at a later time. He plausibly argues that mental self-management-type attempted negligence is possible. However, his account raises the question whether such (...) attempts can be successful: whether, in other words, attempts to perform unintentional actions at a later time could issue in actions that are, indeed, unintentional. Intuitively, at least, it would seem that we should answer in the affirmative. However, that answer poses problems for a plausible and widely-held account of intentional action. Al Mele, responding to Yaffe’s account, has pointed out this problem without, I think, providing a satisfactory resolution. I propose another way of vindicating the possibility of successful attempted negligence with small, if significant, revision to the standard view of intentional action. In these cases, I argue, agents fail to act intentionally because they render themselves, through their acts of self-management, unaware that they are successfully executing their intentions. Moreover, I argue that these agents’ intentions to bring about that they perform unintentional actions do not commit them to acting intentionally because of the nature of intentions to bring about actions. I offer an account of the intention to bring about that one A’s and defend it against some objections. (shrink)

Le Père Ignace Carbonnelle, l'un des principaux fondateurs de la Société scientifique de Bruxelles en 1875 et son secrétaire général depuis cette époque, décède inopinément en 1889 après une quin­zaine d'années durant lesquelles il fut «l'homme fort» de ladite Société. Aussitôt, la Revue des questions scienti­fiques annonce la triste nouvelle, promettant, pour un prochain numéro, une étude détaillée de sa vie et de son œuvre. Elle ne paraîtra jamais, de sorte que sa mort ne fut pas saluée avec l'ampleur qu'on (...) était en droit d'attendre. Et pour cause ! Au ter­me d'une enquête digne d'un roman policier, cette étude révèle que Rome, agacée par l'atomisme de Carbonnelle, profita de sa mort pour rappeler à l'ordre la Société en l'invitant à marcher dans les pas de l'Aquinate. After a detailed investigation, worthy of Agatha Christie herself, it would appear that Rome had been rather alarmed by the “atomism” present in Fr. Carbonnelle's reflections, and had taken the opportunity of his death to invite the Scientific Society to opinions more in line with those of St Thomas. In response to this firmly worded invitation, and with overzealous spontaneity, the Society elected the celebrated French Thomiste Edmond Domet de Vorges as their new President. At the same time the mathematician Paul Mansion relied on the publications of Pierre Duhem, which advocated a stronger adhesion to a physics of an object's qualities, to establish that the Society was, in fact, well aligned with the desires of Rome. We study whether robots can satisfy the conditions for agents fit to be held responsible in a normative sense, with a focus on autonomy and self-control. An analogy between robots and human groups enables us to modify arguments concerning collective responsibility for studying questions of robot responsibility. On the basis of Alfred R. Mele’s history-sensitive account of autonomy and responsibility it can be argued that even if robots were to have all the capacities usually required of moral agency, their history (...) as products of engineering would undermine their autonomy and thus responsibility. In “The Zygote Argument is Invalid: Now What?” (2015), Kristin Mickelson published an objection to the Zygote Argument that she first presented in 2012 as workshop comments on a draft of Mele's "Manipulation, Moral Responsibility, and Bullet-Biting" (2013). Assuming that the phrase "determinism precludes free will" means something like determinism-related causal factors are what prevent people from acting freely when determinism is true, Mele's original Zygote Argument was invalid. At the workshop, Mickelson presented Mele with two options to address the (...) problem, a premise-preserving option and a conclusion-preserving option. That is, Mele could change the conclusion of the original argument to the negative, non-explanatory thesis entailed by its original two premises, or find a way to add premises that would support the positive, explanatory conclusion of the original argument (which, notably, is the conclusion that Pereboom supports using best-explanation reasoning in his Four-Case Argument). Mickelson used this as an opportunity to explain the key contribution that best-explanation reasoning makes to manipulation arguments -- and why the best variant of the manipulation argument might conclude that incompatibilism is FALSE. In response to Mickelson's objection, Mele changed the conclusion of the argument before "Manipulation, Moral Responsibility, and Bullet-Biting" went to print, choosing Mickelson's proposal to change its conclusion over the suggestion to change its premises. However, Mele failed to mention Mickelson's invalidity objection in print and that he changed the conclusion of his argument as a direct response to it; nor did Mele mention the costs that Mickelson outlined for the premise-preserving solution that he adopted or the benefits of a conclusion-preserving solution. At the same time, Mele began using the term 'incompatibilism' to pick out the negative, non-explanatory claim supported by the newly revised Zygote Argument--and also started to claim (without providing evidence) that those who use the term 'incompatibilism' to denote the explanatory claim deterministic causal factors *make it the case* that no one acts freely when determinism is true" is guilty of using the term in a nonstandard and nontraditional way that he had "never had any use for"--failing to mention that he clearly used the term in this explanatory sense in his 2005 critique of the Four-Case Argument, which is to be expected give that Derk Pereboom uses the explanatory definition (as do Kadri Vihvelin, Carolina Sartorio, and *most* other contributors to the free-will literature). In THIS reply essay, Mickelson responds to an attempt by Gabriel De Marco (FSU, advisor Alfred Mele) to defend the original Zygote Argument from Mickelson's 2012/2015 critique. Unfortunately, both of De Marco's proposed "solutions" are non-starters. The first is a non-starter because De Marco merely repeats the premise-preserving solution that Mickelson offered to Mele in 2012 and that Mele adopted in print in 2013. In other words, De Marco took credit for the premise-preserving solution to the invalidity objection that Mickelson developed (although he does *redescribe* Mickelson's solution in his own idiosyncratic jargon) and Mele had already adopted in print. De Marco's second solution is a non-starter because it is constituted by a patently invalid argument. Contrary to De Marco's proposal, it's not true that the conjunction of possibilism and incompossibilism deductively entails the positive, diagnostic claim that deterministic causal factors beyond one's control preclude (destroy, undermine, is antagonistically relevant to) free will when determinism is true. *My thanks to the editors of Philosophia for publishing this reply when PhilStudies would not. On peut inscrire les travaux de Engel dans le sillage rationaliste des Pères de la philosophie analytique, mais après le tournant naturaliste opéré par Quine. Ce sont les diverses bonnes raisons, exposées de manière non systématique par Engel, d’associer naturalisme et rationalisme que je souhaite présenter tout en cherchant à identifier la difficulté constitutive de ce programme qui ne reçoit pas de solution complète: la normativité épistémique ne semble ni éliminable, ni correctement intégrée à ce programme.

This essay is an investigation into the sense of ‘able’ relevant to free will, where free will is understood as requiring the ability to do otherwise. I argue that van Inwagen's recent functional specification of the relevant sense of ‘able’ is flawed, and that explicating the powers involved in free will shall likely require paying detailed attention to the semantics and pragmatics of ‘can’ and ‘able’. Further, I argue that van Inwagen's promise-level ability requirement on free will is too strong. (...) I also argue that Mele's conjecture that the strength of the ability to perform the ‘alternative’ action be no higher than the strength of the ability exercised in performing an action is mistaken. I suggest there is an asymmetry in the strengths of the abilities which make up the n-way power that comprises free will, and that this looks to have some interesting consequences for the connection between the abilities required for free will and, e.g. the ‘up to us’ locution. The temporal structure for motivating, monitoring, and making sense of agency depends on encoding, maintaining, and accessing the right contents at the right times. These functions are facilitated by memory. Moreover, in informing action, memory is itself often active. That remembering is essential to and an expression of agency and is often active suggests that it is a type of action. Despite this, Galen Strawson (Proceedings of the Aristotelian Society, 103, 227–257, 2003) and Alfred Mele (2009) deny that remembering is (...) an action. They claim that memory fails to admit of control. Remembering is automatic—once remembering starts, the process can neither be stopped nor intervened on. Moreover, the agent does not initiate remembering. An agent has control over an event or process if and only if she has the capacity and opportunity to initiate and intervene on that event or process. Actions are events over which an agent has control. Since it is automatic, we fail to have control over remembering. Thus, remembering is not an action. In this paper, I draw out an assumption of Strawson’s and Mele’s accounts: an event-type whose tokens exhibit automaticity cannot, for that reason, be an action (§2). Against this assumption, I draw parallels between skilled bodily action and memory. I show that memory exhibits two defining features of skill: it can be learned with practice and it admits of attributions of excellence (§3). These features reveal how intelligent control is exerted in the exercise of skill despite apparent automaticity—control is gained over time (§4). Since exercises of skill are by definition actions and since memory exemplifies the defining features of skill, memory is a skill and instances of remembering are actions too. (shrink)

Some compatibilists are internalists. On their view, whether an agent is morally responsible for an action depends only on her psychological structure at that time. Other compatibilists are externalists. On their view, an agent’s history can make a difference as to whether or not she is morally responsible. In response to worries about manipulation, some internalists have claimed that compatibilism requires internalism. Recently, Alfred Mele has argued that this internalist response is untenable. The aim of this paper is to vindicate (...) the claim that compatibilism requires internalism, showing where Mele’s argument goes wrong along the way. (shrink)

I argue that we should give up the fight to rescue causal theories of action from fundamental challenges such as the problem of deviant causal chains; and that we should rather pursue an account of action based on the basic intuition that control identifies agency. In Section 1 I introduce causalism about action explanation. In Section 2 I present an alternative, Frankfurt’s idea of guidance. In Section 3 I argue that the problem of deviant causal chains challenges causalism in two (...) important respects: first, it emphasizes that causalism fails to do justice to our basic intuition that control is necessary for agency. Second, it provides countless counterexamples to causalism, which many recent firemen have failed to extinguish – as I argue in some detail. Finally, in Section 4 I argue, contra Al Mele, that control does not require the attribution of psychological states as causes. (shrink)

Stubborn belief, like self-deception, is a species of motivated irrationality. The nature of stubborn belief, however, has not been investigated by philosophers, and it is something that poses a challenge to some prominent accounts of self-deception. In this paper, I argue that the case of stubborn belief constitutes a counterexample to Alfred Mele’s proposed set of sufficient conditions for self-deception, and I attempt to distinguish between the two. The recognition of this phenomenon should force an amendment in this account, and (...) should also make a Mele-style deflationist think more carefully about the kinds of motivational factors operating in self-deception. This paper argues that self-deception cannot be explained without employing a depth-psychological ("psychodynamic") notion of the unconscious, and therefore that mainstream academic psychology must make space for such approaches. The paper begins by explicating the notion of a dynamic unconscious. Then a brief account is given of the "paradoxes" of self-deception. It is shown that a depth-psychological self of parts and subceptive agency removes any such paradoxes. Next, several competing accounts of self-deception are considered: an attentional account, a constructivist account, (...) and a neo-Sartrean account. Such accounts are shown to face a general dilemma: either they are able only to explain unmotivated errors of self-perception--in which case they are inadequate for their intended purpose--or they are able to explain motivated self-deception, but do so only by being instantiation mechanisms for depth-psychological processes. The major challenge to this argument comes from the claim that self-deception has a "logic" different to other-deception--the position of Alfred Mele. In an extended discussion it is shown that any such account is explanatorily adequate only for some cases of self-deception--not by any means all. Concluding remarks leave open to further empirical work the scope and importance of depth-psychological approaches. (shrink)
