Introduzione alla raccolta di saggi di Rahel Jaeggi "Forme di vita e capitalismo", curata e tradotta da Marco Solinas. L'introduzione presenta una breve panoramica del pensiero dell'autrice e si sofferma sul suo progetto incentrato sulla critica immanente del capitalismo come forma di vita.

Jürgen Habermas (Düsseldorf, 18 giugno 1929) è tra gli studiosi più importanti nel campo delle scienze sociali e della filosofia. La reputazione internazionale si accompagna all’influenza degli interventi politici sulla formazione delle opinioni pubbliche, soprattutto nel riformismo liberal-socialista europeo e americano. Licenziarne in poche pagine l’itinerario intellettuale è un’impresa ardua, considerando che non si riduce alle pubblicazioni ma rimanda a un contesto storico e culturale a cui l’opera e la biografia sono intessute a doppio filo. Proviamo a dare conto della (...) vastità e ricchezza dei suoi interessi, nell’intento di mostrare l’originalità della riflessione teorica, delle analisi sociali e dell’impegno critico di Habermas, ben oltre l’etichetta impropria di maggior esponente della seconda generazione della scuola di Francoforte. «The world is about to get rid of morality, becoming total organization that is total destruction. Progress tends to culminate in a catastrophe». This few words sum up the fears of the late Horkheimer, who is increasingly worried about the effects of the dialectic of enlightenment. The fatal outcome of such dialectic has led the world to the brink of annihilation. According to Horkheimer, the root of the dialectic of enlightenment is an instrumental reason tending to the dominion (the dominion (...) of man over nature and the dominion of man over man). With his theoretical production, Horkheimer has tried to prevent the disastrous effects of this instrumental reason, ending up framing the longing for the Totally Other. In our opinion, the Totally Other plays an anti-dialectic function over enlightenment, having the triple meaning of transcendence as other than immanence; of utopia as an other society than the present one; and of an other reason than the instrumental reason, as a promise of a thought that is not anymore allied to the dominion. A new interpretation of the Totally Other would free its critical power, and it would be a “negative” attempt (in the sense of negative theology) to prevent the catastrophe towards which we all are pushed by what Horkheimer calls the immanent logic of history. This article addresses the questions “why do we still have to read Kant today?”, “what kind of responses can he give us in the era of global terrorism?”. In other terms, today, “What does it mean to orient oneself in thinking?”. Because his concept of renewed religious laity, distant from both fanatic fundamentalism and indifferent secularism, becomes the compass we can only rely on and authentically trust in the relationship with the other. The essay gives an account of the aesthetics of the Graz school, focusing on the standpoint of the object as well as on that of emotions. Meinong’s reflection on aesthetics stems from a psychological background and comes subsequently to an ontological grounding. After examining the notions of imagination, phantasy-representation, relation and complexion, I show how the theory of production of representations, as well as that of higher-order objects, develops under the impulse of Ehrenfels’ concept of Gestalt qualities; both these theories (...) may be applied to aesthetics in the explanation of artistic creation and of aesthetic objects. Meinong identifies the specific object of aesthetics with the “objective” and distinguishes aesthetic feelings, which are true feelings, from imaginary ones. Witasek develops a psychological aesthetics built on the conceptual framework of Meinongian philosophy: aesthetic properties are ideal and extra-objective, they connect the aesthetic object to the subject’s mental attitude; an aesthetic object is an object endowed with aesthetic properties, such as beauty, which depends on the degree of pleasure or displeasure the object may induce in the subject. Witasek, though, parts from Meinong on both the conception of aesthetic objects and of imaginary feelings. In the last sections, I review the reactions to Witasek’s aesthetics, both positive and negative, within the Graz school itself (in particular Schwarz’ and Saxinger’s ideas on phantasy-feelings, and Ameseder’s on value beauty), and I sketch Ehrenfels’ and Veber’s aesthetic views. From the second half of the 16th century the question about Platonis Aristotelisque Concordia is no more a merely doctrinal problem, but it involves a discussion about methodus and ordo, according to the importance given to them in the coeval philosophical debate. In many cases underscoring Plato’s scientific merits, not only about inventio but also about the transmission of knowledge, meant promoting Platonism as a philosophy suitable for University. In this context the need for Platonic handbooks is perceived as compelling, (...) due to the recognised didactic superiority of Aristotle’s writings. The Compendio and the Vere Conclusioni are the specific contribution of Francesco Verino secondo, who gave holiday lectures on Plato at the Florentine Studium from 1576 to 1579. The present study focuses on the platonism of Francesco Verino, covering nearly all his works, printed and manuscript, in a constant comparison with his noble predecessors Marsilio Ficino, Giovanni Pico della Mirandola and Francesco Cattani da Diacceto. In order to give light to Verino’s lectureship, particular attention is paid to glosses in his working and teaching copy of Platonis Opera. (shrink)

Carlo Colombo è un teologo italiano, che insegnò a Venegono (diocesi di Milano) dal 1935 al 1965. Egli promosse un incontro tra il tomismo e le nuove correnti teologiche, ispirate a Blondel e al rinnovamento neo-patristico, cercando di salvaguardare sia l'oggettività della conoscenza concettuale, sia l'importanza dell'affettività e della ricerca di felicità che animano il soggetto umano. Il suo pensiero ha contribuito alla formazione di don Luigi Giussani, fondatore del movimento ecclesiale di Comunione e Liberzazione.

Rifacendosi alle riflessioni di filosofi come Hadot e Foucault, si sottolinea il carattere pratico (...) della filosofia antica, fondata non solo sulla teoria ma anche su esercizi spirituali e pratiche di cura di sé. -/- L'articolo discute il cambiamento nell'insegnamento della filosofia nelle scuole secondarie italiane, passando da una prospettiva storicista a un approccio che favorisce il confronto diretto con i testi della tradizione filosofica. Vengono esplorate anche esperienze educative alternative, come la pedagogia proposta da Danilo Dolci e la Scuola di Barbiana, che enfatizzano il dialogo, la cooperazione e la promozione della creatività. -/- Inoltre, si esamina il ruolo della Philosophy for Children (P4C) nel promuovere il pensiero complesso e la partecipazione attiva degli studenti attraverso il dialogo filosofico. Si illustrano le sfide e i successi dell'implementazione della P4C in Italia, evidenziando l'importanza della formazione dei docenti e delle pratiche di ricerca filosofica nelle comunità educative. -/- Infine, si introduce il concetto di Filosofia Ludica e il Curriculum Noria, sottolineando il loro approccio ludico e multiculturale alla promozione del pensiero critico e della cittadinanza creativa. Nella Premessa al "Discorso filosofico della modernità" (1985) Habermas scrive, in maniera enfatica, che il tema, ricco di sfaccettature, della “modernità come progetto in-compiuto” segna l’inizio la sua riflessione e dagli anni ’80 “non gli ha dato più pace”. In effetti, la “modernità” si presenta come un “oggetto d’analisi obbligato” anche solo dal punto di vista del necessario auto-chiarimento disciplinare. È con la formazione delle società moderne che si differenziano come “forme del sapere specialistico”, la scienza politica, l’economia politica, l’antropologia (...) culturale e la sociologia. Ed è, ancora, dalla prospettiva della “riflessione filosofica” che si avvia dal tardo secolo XVIII una rinnovata consapevolezza intellettuale intorno alla coscienza storica del tempo moderno, ai principi costitutivi del “nuovo mondo” e alle “cesure” rispetto alla cultura passata. Non si deve, però, ridurre il concetto di modernità alla visione filosofica del mondo. Anche questa prospettiva – peraltro presente negli scritti di Habermas –, deve essere ricondotta all’interno del programma di ricerca della “teoria dell’evoluzione sociale”, considerando assieme i processi di “razionalizzazione culturale” del mondo vitale e la “differenziazione” di nuovi “principi di organizzazione sociale” rispetto a quelli con cui si erano riprodotte le formazioni tradizionali. Il merito dei suoi studi, una volta ricondotti a unità, è di seguire la trasformazione delle sfere culturali di valore alla luce dei problemi che coinvolgono la riproduzione delle strutture sociali e delle forme di vita tradizionali, mediando le esigenze della teorizzazione astratta e le vicende della storia con-creta. In tal senso, egli segue la tradizione di ricerca dei classici del pensiero sociale, da Comte sino alla scuola di Parsons, attraverso Marx, Durkheim e Weber. Dopo aver esposto in che cosa consiste, secondo il nostro Autore, il “razionalismo occidentale”, qui, ci limitiamo a fornire un indice ragionato dei temi con cui Habermas ha ricostruito il concetto “formazione sociale moderna” attraverso l'analisi degli “albori della modernità”, delle “società capitalistico-liberali” e delle “società contemporanee”. Nel presente lavoro si tenta di analizzare, a un livello piuttosto semplice ed elementare, le relazioni che eventualmente esistano tra Bonaventura di Bagnoregio e Bernardo di Chiaravalle. L’analisi si svolge attorno un aspetto particolare del pensiero di questi autori, cioè quello della conoscenza de Dio e l’unione con Lui. Lo studio viene incorniciato nell’ambito della scuola francescana di Parigi nel tredicesimo secolo, giacché in quell’ambito è vissuto Bonaventura —l’autore sul quale si vuole approfondire—. Anche se il confronto viene effettuato (...) principalmente fra Bernardo e Bonaventura, appaiono nel percorso del lavoro alcuni altri autori il cui influsso non può essere dimenticato se si desidera ottenere delle conclusioni valide sulla teologia mistica bonaventuriana. Più precisamente, ricostruisco come Wilhelm von Humboldt teorizzi il progresso del singolo individuo, del cittadino e del genere umano. Secondo la mia ricostruzione, l’idea humboldtiana di (...) progresso presenta un intreccio di motivi illuministi, storicisti e antirazionalisti, ed esige una riforma dello stato in senso liberale. La mia tesi è che, tuttavia, il pensiero politico di Humboldt sfoci in un conservatorismo non liberale che in quanto tale spalanca uno iato tra il sistema istituzionale auspicato e la possibilità di progresso. One of the most mature achievements of the Cartesian philosophy is the aim to diffuse Descartes’ thought among a wider audience by presenting his philosophy in an encyclopedic way. A relevant contribution in this field is Pierre Sylvain Régis’s Système. Régis’s contribution consists both in reconciling the new scientific discoveries with les principes de Monsieur Descartes by combining them into a scholarly manual whose aim is to stimulate the ars inveniendi and in recognizing the relevance of Arnauld’s and Nicole’s L’art (...) de penser as manual of Cartesian logic. In an article published on the «Annali della Scuola Normale Superiore di Pisa», pp. 517-55: L’«Art de penser» nella logica del «Système» di Régis) I analysed Régis’s logic in order to point out that, even if L’art de penser represents its only source, La logique of the Système has not to be considered as a mere compendium of the Port-Royal Logique, but as a revision of the latter according to a specific philosophical system, characterized by the empirical interpretation of Descartes’s philosophy. In this paper I provide a synopsis of the comparison between the logic of the Système and the Logique of Port-Royal, in order to resume in a schematic way the results of my research. (shrink)

After noting the absence of a mutual confrontation, the aim of this research has been redefined in reconstructing the influence of Habermas’ writings on the work of Zygmunt Bauman – an aspect known to scholars of the Polish sociologist but not very well recognized in the international sociological community. Following a philological and critical literary approach, the Baumanian interpretations – selective, discontinuous and, often, erroneous – have been systematized into two main topics: 1) the epistemological foundations of social theory; 2) (...) the normative foundations of critical theory (and the relationship with praxis). La definizione di un’etica professionale dell’insegnante e l’adozione di un codice di condotta specifico sono due elementi rilevanti del processo di professionalizzazione dell’insegnamento. Una professione si differenzia infatti da una mera occupazione per certi valori che la caratterizzano. Essi si distinguono in valori interni (determinati dalle caratteristiche intrinseche della professione) e in valori esterni (ricavati da un’interpretazione appropriata del contesto sociale e politico entro cui si esercita la professione). La relazione identifica due valori fondamentali della professione insegnante: l’uno interno, la (...) credibilità dell’insegnante; l’altro esterno, la neutralità dell’insegnante. La credibilità è ricavata dal rapporto di dipendenza epistemica che caratterizza la relazione tra insegnante e allievo. La neutralità si fonda su un’interpretazione appropriata della funzione pubblica nel contesto pluralistico della società contemporanea. Questi valori devono trovare adeguata applicazione nelle norme del codice di condotta dell’insegnante. (shrink)

The essay deals with the question whether Fichte’s socio-economic model which based both on the experiences and ideas of his time. Additionally, it explores how his socio-economic theorems stood out against cameralistic and feudal-conservative discussions and to what extent they can be described as an early critique of capitalism. Is the essence of Fichte’s socio-economic ideas to be seen in his model of state regulation or rather in his methodological claim of genetically developing the phenomena by showing their mediating links? (...) What is however still relevant today is Fichte’s idea that human beings are not the objects or means of social relations but their subjects and aims. For this purpose, Fichte developed a concept of justice that is constitutive for his notion of society. Democracy aiming at an active use of reason and social justice are the two moments which depend on each other. (shrink)

In questo saggio sono espresse alcune riflessioni concernenti l’orizzonte etico-morale proprio della scuola di materialismo indiana nota con il nome di Cārvāka/Lokāyata. La discussione si sviluppa secondo i seguenti punti: 1. Gli assunti ontologico-psicologici; 2. Gli assunti epistemologici; 3. L’etica e la morale; 4. Conclusioni.

La Genealogia della morale si presenta al lettore come un compatto ma articolato crocevia di temi e di problematiche del pensiero di Friedrich Nietzsche. L'opera è certo caratterizzata da una particolare unità tematica, ma è al tempo stesso ricca di spunti che offrono accessi a questioni di non secondaria importanza e che, nel loro complesso, definiscono la trama di un pensiero che manifesta la propria ricchezza e originalità al lettore più accorto. Di tale ricchezza si è cercato di rendere conto (...) nel presente volume, che raccoglie una serie di incursioni nel testo di Nietzsche a firma di studiosi italiani e stranieri, alcune delle quali sono state originariamente discusse nel corso di un seminario di ricerca svoltosi nell’ambito della Scuola di Dottorato in Filosofia dell’Università di Padova. Questi contributi affrontano, ciascuno a suo modo, la Genealogia della morale, illuminandone alcuni passaggi cruciali e intervenendo nella discussione di aspetti che si dimostrano significativi non solamente per approfondire ulteriormente la qualità e la rilevanza filosofiche dell'opera di Nietzsche, ma anche per valutarne il ruolo nella storia del pensiero occidentale contemporaneo. Ciò che qui chiamo Materialismo indiano non deve intendersi come scuola filosofica unica ed univocamente impostata, bensì come insieme di correnti di pensiero, propugnanti differenti punti di vista, ma tutte collocate entro l’orizzonte concettuale che nega ciò che in Occidente si usa chiamare Trascendente. Inoltre, com’è ovvio, bisogna distinguere tra un Materialismo filosofico – che prenderò in considerazione qui – ed un Materialismo, per così dire, popolare – al quale mi riferirò solo se necessario. Due sono le impostazioni materialiste (...) che intendo trattare: l’una riguarda i sostenitori dell’esistenza di cinque elementi materiali (bhūtapañcakavādin) che chiamerò, seguendo Ramkrishna Bhattacharya, proto-Materialisti, l’altra concerne i sostenitori dell’esistenza di quattro elementi materiali (bhūtacatuṣṭayavādin), tra cui i Cārvāka. Luca Corchia esamina gli indirizzi normativi, la programmazione e il coordinamento delle strategie della Regione Toscana in merito alla promozione di una cultura di pace e nel quadro di un sistema integrato regionale che include altresì la promozione dell’attività di cooperazione e partenariato internazionale. Pace e cooperazione sono i due assi di una politica che assume come finalità il ripudio della guerra, la tutela dei diritti umani, la democrazia politica, la giustizia economica e la solidarietà sociale. Tutti i documenti della (...) Regione Toscana, per coerenza esterna “verticale” ed “orizzontale”, disciplinano in forma integrata i due settori tanto nei contenuti quanto nell’iter delle loro procedure. Un aspetto rilevante di tale orientamento concerne il processo partecipativo, esteso a Comuni, Province, Comunità montane, mondo della scuola e associazioni, con la costituzione di “Conferenze regionali”, “Forum territoriali della cooperazione e della pace”, “Tavoli di coordinamento di area geografica”; sedi di concertazione degli obiettivi generali, specifici e delle scelte di allocazione delle risorse dedicate agli “Interventi dei soggetti terzi” e ai “Progetti di Interesse Regionale” (PIR). La partecipazione come metodo decisionale ex ante ma anche come strumento di trasparenza, controllo e valutazione ex post. L’elemento fondante delle azioni regionali è il riconoscimento e la valorizzazione delle comunità locali quali promotrici della cultura della pace, anzitutto attraverso la comunità scolastica. La scuola, infatti, è presente in massima misura nell’articolato ventaglio di progetti di cui si fa menzione in questo scritto. (shrink)

Nāgārjuna, vissuto in India attorno al primo secolo dopo Cristo, è certamente una delle figure più importanti del pensiero buddhista. In una delle sue opere principali, le ‘Strofe sulla via di mezzo ’, egli elabora in modo compiuto la nozione di ‘vuoto’, che diverrà uno dei concetti fondamentali di tutto il buddhismo successivo, dando vita alla ‘scuola del vuoto’, la quale avrà grande fortuna in Tibet, Cina e Giappone. Per vuoto non si intende certo il nulla, bensì l’inconsistenza rivelata (...) dal reale quando considerato alla luce della critica di Nāgārjuna. Tale critica si esplica innanzitutto sul piano del linguaggio, e possiede quindi una evidente dimensione pragmatica. Il ‘vuoto’ nāgārjuniano sarà allora non solo una non-ontologia, ma anche una non-predicazione, che ammetterà però il giudizio, e quindi la determinazione, solo ed esclusivamente dal punto di vista della prassi del dire. Al linguaggio non è richiesto di parlare dell’essere, bensì di testimoniare, attraverso la propria inconsistenza, dell’assoluta coincidenza di essere e non-essere. (shrink)

In juxtaposition with the myth and tragedy of Ovid’s Medea, this paper investigates the possibility within the Kantian conception of agency of understanding moral evil as acting against one’s better judgment. It defends the thesis that in Kant self-deception, i. e. the intentional untruthfulness to oneself, provides the fundamental structure for choosing against the moral law. I argue that, as Kant’s thought progresses, self-deception slowly proceeds to become the paradigmatic case of moral evil. This is discussed with regard to two (...) important topics in his later moral philosophy: the doctrine of radical evil and the crucial role of the duty of truthfulness in ethics. The inquiry into Kant’s theory of conscience unfolds both against this theoretical background and in light of its historical roots in the polemic against casuistry and probabilism. This contribution closes with a brief look at the tools Kant implements to counter this tendency to self-deception in moral judgment and particularly at the role casuistry plays within his conception of moral education. Some of the manuscripts once part of Giovanni Pico della Mirandola’s collection transmit autograph notes, which have been useful to reconstruct his library. A peculiar case is represented by the notes transmitted in a codex containing the Latin translation of Moses Maimonides’ Guide of the Perplexed. These notes are actual corrections to the translation made mostly on the basis of a comparison with the Hebrew text, while in some other cases they derive from a specific interpretation. The aim of this (...) paper is to present some characteristics of the textual revisions, in particular with reference to the Hebrew source. The palaeographic data demonstrate Pico’s direct involvement, which leads to the question of the authorship of these notes, namely if they were the result of an autonomous work or of a collaboration with some other scholar. In epoca medievale si è molto discusso su alcuni concetti chiave come prova o giustificazione. La teoria della prova contenuta nei trattati di logica medievale prende il nome tecnico di consequentia, che è un tipo di ragionamento fondato sul passaggio dalla concessione (o negazione) di uno o più enunciati denominati antecedenti alla concessione (o negazione) di uno o più enunciati denominati conseguenti. Questo tipo di teoria ha avuto un correlato a livello dei singoli termini che compongono l’enunciato all'interno della teoria (...) nota come suppositio terminorum. Prende, infatti, il nome di descensus, la regola che permette la verifica del passaggio da un termine maggiore (un termine comune) ad un termine minore (che denota individui). La stessa definizione di alcune ramificazioni della teoria della suppositio è col-legata alla possibilità di ammettere o meno il descensus cioè questa "discesa" da un termine comune ad una congiunzione o disgiunzione di termini singolari. Il presente lavoro intende descrivere la teoria del descensus come un tipo particolare di consequentia mostrandone le connessioni con le moderne tecniche logiche. I trattati che si affronteranno appartengono al XIV e al XV secolo, cioè ad un periodo caratterizzato da una sistemazione della materia che li rende confrontabili con un quadro teorico unitario. This paper reconstructs Sartre’s account of the “circuit of ipseity” as an integral theory of the experiential, agentive and normative aspects of self-consciousness. At the core of this theory is a conception of human (self-)consciousness as lacking, and the correlation between lacking and ideal. In Section 1, I show how this theory manages to satisfy the apparently incompatible requirements generated by the idea of a pre-reflective cogito. Can Marxist-Leninist philosophy disregard dialectical materialism, the analysis of material and social contradictions, the need to overcome and resolve them in the service of revolutionary transformation? ‘Does the lecturer acknowledge that the philosophy of Marxism is dialectical materialism’, as Lenin asked Bogdanov one day in May 1908? What had 'official Soviet Marxism' really become, capable of combining ideological dictatorship with militant philosophical ignorance, in turn justified by the achievements of modern science, skilfully used as an instrument of domination and preservation (...) of the established order? How can one conceptually dominate reality and its contradictions, knowing well that knowledge is never neutral but is class-based? These questions are answered by Evald Ilyenkov, one of the greatest Marxist philosophers of the 20th century, re-examining Lenin's Materialism and Empiriocriticism at the end of the 1970s with a text entitled Leninist Dialectics and the Metaphysics of Positivism, still unpublished in Italy, and identifying in the revolutionary leader an exceptional theoretical ally. Just as Lenin had had to fight the attacks promoted by the theories of Bogdanov, who approached the empirio-criticism of Mach, Avenarius and Berman, seeing it as dogmatic and reactionary materialism directed against the natural sciences, so Ilyenkov fought against the penetration of positivism into Soviet politics and philosophy, criticizing the rejection of the dialectic only functional to the technocratic project of building 'socialism' in the Brezhnev era, a disguised heir of the empirio-criticism denounced by Lenin as the natural metaphysical conclusion to the logic of positivism. Balancing a hermeneutic of trust with a hermeneutic of suspicion, this article develops a phenomenological description of imagination that highlights its alethic ambiguity. Imagination is an act of disclosure, without which the world of fiction and pure possibility cannot be constituted. Imagination is also an act of self-indulgence and narcissism, the source of much concealment and untruth. It is not the one or the other, but both at the same time, essentially ambiguous because of its phenomenological constitution. In this article, (...) I will take some steps towards clarifying this essential ambiguity of the imagination by drawing on the insights of Husserl and Sartre. Beginning with Husserl’s parallel treatment of imagination and perception as intuitive, objectifying acts, I will argue, drawing on insights from Sartre, that there is an important discrepancy between them with respect to the role of desire. While the constitution of perceptual presence is inseparable from a desire for truth, the desire involved in the constitution of imaginary presence has an ambiguous character, both epistemic and magical. This duplicity of desire partly accounts for the ambiguity of imagination, which is all the more pronounced the more the imagination demands the full emotional involvement of the imagining subject. This paper is meant as a contribution to the longstanding debate among Husserl scholars regarding the relationship between time-consciousness and the I. From a genetic-phenomenological perspective, the I lives in the tension between passivity and activity. Exploring how the I relates to time-consciousness thus involves thematizing the interplay of passivity and activity at the most fundamental level of constitution. Specifically, it is necessary to determine whether there is an active form of temporalization. Acknowledging the ambiguities in Husserl’s late manuscripts on (...) time, this paper takes an indirect approach to this question. Relying primarily on Husserl’s analysis of active synthesis in his transcendental logic, I argue that being intellectually active requires an active form of temporalization, which establishes the specific rhythm of egoic activity. In this article, I analyze the evolution of Husserl's view on the normativity of logic and the corresponding changes in his phenomenological analysis of judgment. Initially, in the Prolegomena, Husserl claimed that the laws of pure logic are ideal and acquire normative status only as a result of application. Later, however, he revised this position and claimed that the same laws are at once ideal and normative. Sections 1 and 2 present textual evidence for attributing such a change of position (...) to Husserl, which is not generally acknowledged in the literature. Section 3 critically examines Husserl's early position, with specific attention to the model of instantiation. Sections 4–6 identify three key stages in the development of Husserl's theory of judgment that lead to the normative conception of pure logic: (1) the critique of the dissociation of ideal content and assertive force; (2) the rejection of the instantiation model of proposition and the development of a new account in terms of identification; (3) the genetic‐phenomenological interpretation of proposition and the elaboration of the three‐layer structure of pure logic. The literature on algorithmic fairness has examined exogenous sources of biases such as shortcomings in the data and structural injustices in society. It has also examined internal sources of bias as evidenced by a number of impossibility theorems showing that no algorithm can concurrently satisfy multiple criteria of fairness. This paper contributes to the literature stemming from the impossibility theorems by examining how informational richness affects the accuracy and fairness of predictive algorithms. With the aid of a computer simulation, we (...) show that informational richness is the engine that drives improvements in the performance of a predictive algorithm, in terms of both accuracy and fairness. The centrality of informational richness suggests that classification parity, a popular criterion of algorithmic fairness, should be given relatively little weight. But we caution that the centrality of informational richness should be taken with a grain of salt in light of practical limitations, in particular, the so-called bias-variance trade off. (shrink)

Advances in neuroscience implicate reentrant signaling as the predominant form of communication between brain areas. This principle was used in a series of masking experiments that defy explanation by feed-forward theories. The masking occurs when a brief display of target plus mask is continued with the mask alone. Two masking processes were found: an early process affected by physical factors such as adapting luminance and a later process affected by attentional factors such as set size. This later process is called (...) masking by object substitution, because it occurs whenever there is a mismatch between the reentrant visual representation and the ongoing lower level activity. Iterative reentrant processing was formalized in a computational model that provides an excellent fit to the data. The model provides a more comprehensive account of all forms of visual masking than do the long-held feed-forward views based on inhibitory contour interactions. (shrink)

I argue that the empirical literature on priming effects does not warrant nor suggest the conclusion, drawn by prominent psychologists such as J. A. Bargh, that we have no free will or less free will than we might think. I focus on a particular experiment by Bargh – the ‘elderly’ stereotype case in which subjects that have been primed with words that remind them of the stereotype of the elderly walk on average slower out of the experiment’s room than control (...) subjects – and I show that we cannot say that subjects cannot help walking slower or that they are not free in doing do. I then illustrate how these cases can be reconciled and normalized within a Davidsonian theory of action to show that, in walking slower, subjects are acting intentionally. My argument applies across various experiments, including those of goal priming. In the final section I argue that the only cases in which priming effects are efficacious are so-called Buridan cases. Consultations are key to gather evidence that informs rulemaking. When analysing the feedback received, it is essential for the regulator to appropriately cluster stakeholders’ opinions, as misclustering may alter the representativeness of the positions, making some of them appear majoritarian when they might not be. The European Commission (EC)’s approach to clustering opinions in consultations lacks a standardized methodology, leading to reduced procedural transparency, while making use of computational tools only sporadically. This paper explores how natural language processing (NLP) technologies (...) may enhance the way opinion clustering is currently conducted by the EC. We examine 830 responses to three legislative proposals (the Artificial Intelligence Act, the Digital Markets Act and the Digital Services Act) using both a lexical and semantic approach. We find that some groups (like small and medium companies) have low similarity across all datasets and methodologies despite being clustered in one opinion group by the EC. The same happens for citizens and consumer associations for the consultation run over the DSA. These results suggest that computational tools actually help reduce misclustering of stakeholders’ opinions and consequently allow greater representativeness of the different positions expressed in consultations. They further suggest that the EC could identify a convergent methodology for all its consultations, where such tools are employed in a consistent and replicable rather than occasionally. Ideally, it should also explain when one methodology is preferred to another. This effort should find its way into the Better Regulation toolbox (EC 2023). Our analysis also paves the way for further research to reach a transparent and consistent methodology for group clustering. (shrink)

The argument for the moral permissibility of killing newborns is a challenge to liberal positions on abortion because it can be considered a reductio of their defence of abortion. Here I defend the liberal stance on abortion by arguing that the argument for the moral permissibility of killing newborns on ground of the social, psychological and economic burden on the parents recently put forward by Giubilini and Minerva is not valid; this is because they fail to show that newborns cannot (...) be harmed and because there are morally relevant differences between fetuses and newborns. Thinking is overrated: golfers perform best when distracted and under pressure; firefighters make the right calls without a clue as to why; and you are yourself ill advised to look at your steps as you go down the stairs, or to try and remember your pin number before typing it in. Just do it, mindlessly. Both empirical psychologists and the common man have long worked out that thinking is often a bad idea, but philosophers still hang on to an intellectualist (...) picture of human action. This book challenges that picture and calls on philosophers to wake up to the power of mindlessness: it is our habits, skills and conventions that help us cope with a world way too diverse for us to hope to always reinterpret it. The book presents the empirical evidence that has been accumulating over the last few decades and offers a philosophical analysis of mindless phenomena such as habits, skilled activity, automatic actions, emotional and spontaneous reactions and social conventions, arguing that traditional philosophical theories of action should be revised to do justice to this forgotten but important part of our lives: when we act mindlessly, we are free and fully rational even though we neither deliberate nor are aware of what we are doing. Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. We also show why admitting other (...) forms of evidence, such as eyewitness, trace, and motive evidence, does not violate equal protection. (shrink)

I argue that it is possible for prospective mothers to wrong prospective fathers by bearing their child; and that lifting paternal liability for child support does not correct the wrong inflicted to fathers. It is therefore sometimes wrong for prospective mothers to bear a child, or so I argue here. I show that my argument for considering the legitimate interests of prospective fathers is not a unique exception to an obvious right to procreate. It is, rather, part of a growing (...) consensus that procreation can be morally problematic and that generally talking of rights in this context might not be warranted. Finally, I argue that giving up a right to procreate does not imply nor suggest giving up on women’s absolute right to abort, which I defend. (shrink)

This article reconstructs Sartre’s theory of selfhood against the background of the contemporary debate between minimal-self theories and narrative-self theories. I argue that Sartre’s theory incorporates both an emphasis on the singular first-person perspective, which is characteristic of minimal-self theories, and an emphasis on the practical intelligibility of experience, which is characteristic of narrative-self theories. The distinctiveness of the Sartrean combination of these motifs consists in its idea of the necessary ideal-relatedness of consciousness. According to Sartre, the logical structure of (...) the pre-reflective cogito requires the haunting presence of an ideal of self-coincidence, which determines for consciousness the meaning of its lived experiences. Consciousness exists as a question to itself due to this ideal-relatedness, and it answers this question by projecting its possibilities as creative and symbolic realizations of this ideal. Establishing the connection between Sartre’s theory of imagination and his theory of selfhood, I suggest that both the ideal and the possibility of consciousness are lived in the manner of the imaginary. Judith Jarvis Thomson has recently proposed a new argument for the thesis that killing the one in the Trolley Problem is not permissible. Her argument relies on the introduction of a new scenario, in which the bystander may also sacrifice herself to save the five. Thomson argues that those not willing to sacrifice themselves if they could may not kill the one to save the five. Bryce Huebner and Marc Hauser have recently put Thomson's argument to empirical test by asking (...) people what they should do in the new trilemma case, in which they may also sacrifice themselves. They found that the majority judge that they should either kill the one or sacrifice themselves; Huebner and Hauser argue that those numbers speak against Thomson's argument. But Thomson's argument was about the dialectical effect of the new trilemma on the traditional dilemma, rather than about the trilemma itself. Here I present the results of a study in which I asked subjects first what they should do in the trilemma and then what they should do in the traditional Trolley Problem. I found that, if asked first about the trilemma, subjects then have the intuition that killing the one in the traditional Bystander at the Switch is not permissible?exactly what Thomson's argument had predicted. I argue against Appel's recent proposal – in this JOURNAL – that there is a fundamental human right to sexual pleasure, and that therefore the sexual pleasure of severely disabled people should be publicly funded – by thereby partially legalizing prostitution. I propose an alternative that does not need to pose a new positive human right; does not need public funding; does not need the legalization of prostitution; and that would offer a better experience to the severely disabled: charitable non-profit (...) organizations whose members would voluntarily and freely provide sexual pleasure to the severely disabled. I defend the argument that if embryo loss in stem cell research is morally problematic, then embryo loss in in vivo conception is similarly morally problematic. According to a recent challenge to this argument, we can distinguish between in vivo embryo loss and the in vitro embryo loss of stem cell research by appealing to the doctrine of double effect. I argue that this challenge fails to show that in vivo embryo loss is a mere unintended side effect while in (...) vitro embryo loss is an intended means and that, even if we refine the challenge by appealing to Michael Bratman's three roles of intention, the distinction is still unwarranted. Ought parents, in general, to value being biologically tied to their children? Is it important, in particular, that both parents be biologically tied to their children? I will address these fundamental questions by looking at a fairly new practice within IVF treatments, so-called IVF-with-ROPA ( Reception of Oocytes from Partner ), which allows lesbian couples to „share motherhood‟ with one partner providing the eggs while the other becomes pregnant. I believe that IVF-with-ROPA is, just like other IVF treatments, morally permissible; (...) but here I argue that the increased biological ties which IVF-with-ROPA allows for do not have any particular value beside the satisfaction of a legitimate wish, because there is no intrinsic value in a biological tie between parents and children; further, I argue that equality within parental projects cannot be achieved by redistributing biological ties. Smith argues that, unlike other forms of evidence, naked statistical evidence fails to satisfy normic support. This is his solution to the puzzles of statistical evidence in legal proof. This paper focuses on Smith’s claim that DNA evidence in cold-hit cases does not satisfy normic support. I argue that if this claim is correct, virtually no other form of evidence used at trial can satisfy normic support. This is troublesome. I discuss a few ways in which Smith can respond.

In this paper I argue that there is an important anomaly to the causalist/compatibilist paradigm in the philosophy of action and free will. This anomaly, which to my knowledge has gone unnoticed so far, can be found in the philosophy of Harry Frankfurt. Two of his most important contributions to the field – his influential counterexample to the Principle of Alternate Possibilities and his ‘guidance’ view of action – are incompatible. The importance of this inconsistency goes far beyond the issue (...) of coherence within Frankfurt’s philosophy. I shall argue that this inconsistency represents an important anomaly within the causalist/compatibilist framework; so that we should start to seriously consider having to move on from the established paradigm.
