The Report presents insights which illuminates the intertwinements of European regulatory policies and global governance arrangements. By pinning down the exact nature of the interaction between these two levels, the EU’s dilemma becomes obvious: On the one hand, stronger global governance can be a chance, through which the EU can clarify its own raison d’être of increased integration to the wider world. On the other hand, the design of the European project is being challenged by more assertive global structures. This (...) is especially the case in relation to the WTO regime, which is constraining the decisional autonomy of the EU, regarding the appropriateness of its content and its external effects. Thus, the regulation of services in the EU and the WTO are discussed in the first section of this report. The KenoNitroProject (KNP) is a philosophical project aimed at decrypting the natural source code, seen as the language of nature, in order to connect mind and matter and integrate energy as a third component in a cybernetic organism. The core statements of KNP are: 1) Nature is a cybernetic organism, 2) Energy is Matter is Consciousness in the Infinite (EMC8), 3) The aim of KNP is to decrypt the natural source code, 4) KNP tries to connect mind and matter, 5) (...) KNP intends to decrypt the atom code to reprogram matter on a nuclear level, 6) KNP sees evolution as intelligent, learning from random and error, 7) KNP aims to connect nature, human, and machine in the natural source code, 8) Decrypting the atom code could lead to the creation of artificial molecules and DNA strings to create artificial life, 9) Using the energy metabolism in the atom nucleus is an effective way to transform energy into creative processes, and 10) The concepts of time and space are human-made constructs that can be understood by the interaction of matter, energy, and consciousness. Many scholars claim that Frege's theory of colouring is committed to a radical form of subjectivism or emotivism. Some other scholars claim that Frege's concept of colouring is a precursor to Grice's notion of conventional implicature. I argue that both of these claims are mistaken. Finally, I propose a taxonomy of Fregean colourings: for Frege, there are purely aesthetic colourings, communicative colourings or hints, non-communicative colourings.

This paper offers a detailed reconstruction of Frege’s theory of side-thoughts and its relation to other parts of his pragmatics, most notably to the notion of colouring, to the notion of presupposition, and to his implicit notion of multi-propositionality. I also highlight some important differences between the subsemantic categories employed by Frege and those used in contemporary pragmatics.

The author argues that there is no such thing as a unique and general taxonomy of non-at-issue contents. Accordingly, we ought to shun large categories such as “conventional implicature”, “F-implicature”, “CI”, “Class B” or the like. As an alternative, we may, first, describe the “semantic profile” of linguistic devices as accurately as possible. Second, we may explicitly tailor our categories to particular theoretical purposes.

What, exactly, is the difference between words such as ‘dead’ and ‘deceased’? In this paper, I argue that such differences in register, or style, ought to be construed as genuine differences in non-truth-conditional meaning. I also show that register cannot plausibly accounted for in terms of either presupposition or conventional implicature. Register is, rather, an instance of what I call pure use-conditional meaning. In the case of register, a difference in meaning does not correspond to a difference in the contents (...) speakers intend to convey. (shrink)

Frege's mature writings apparently contain two different criteria of sense identity. While in "Über Sinn und Bedeutung" (1892) and in "Kurze Übersicht meiner logischen Lehren" (1906?) he seems to advocate a psychological criterion, his letter to Husserl of December 12, 1906 offers a thoroughly logical criterion of sense identity. It is argued that the latter proposal is not a "momentary aberration", but rather Frege's official criterion; his psychological criteria only serve as a way of illustrating questions of sense identity by (...) appealing to the thoughts of completely rational thinkers. What exactly do we mean when we refer to disability as a social construction? How viable are the justifications for this? These questions are explored in this paper. To this end, various theories that are influential in German-language disability studies are examined and criticised. These include Oliver's social model, furthermore the "Thomas theorem", Berger and Luckmann's sociology of knowledge, Foucault's discourse theory and Waldschmidt's theory. Subsequently, social constructivist approaches of Watzlawick and Gergen and Gergen are discussed. It is shown that (...) a relativistic understanding of social construction can be used to deny facticity and thus undermines the foundations of scientific knowledge. This danger must be taken seriously when defending the scientificity of disability studies. (shrink)

This paper is partly exegetical, partly systematic. I argue that Frege's account of what he called “colouring” contains some important insights on how communication is related to mental states such as mental images or emotions. I also show that the Fregean perspective is supported by current research in psycholinguistics and that a full understanding of some linguistic phenomena that scholars have accounted for in terms of either semantics or pragmatics need involve psycholinguistic elements.

Why did Frege offer only proper names as examples of presupposition triggers? Some scholars claim that Frege simply did not care about the full range of presuppositional phenomena. This paper argues, in contrast, that he had good reasons for employing an extremely narrow notion of ‘Voraussetzung’. On Frege’s view, many devices that are now construed as presupposition triggers either express several thoughts at once or merely ‘illuminate’ a thought in a particular way. Fregean presuppositions, in contrast, are essentially tied to (...) names. (shrink)

Expressive-Assertivism, a metaethical theory championed by Daniel Boisvert, is sometimes considered to be a particularly promising form of hybrid expressivism. One of the main virtues of Expressive-Assertivism is that it seems to offer a simple solution to the Frege-Geach problem. I argue, in contrast, that Expressive-Assertivism faces much the same challenges as pure expressivism.

Das Buch versucht, diese These auf der Grundlage einer genauen Untersuchung der Abfolge einzelner sprachlicher Handlungen zu verteidigen. Die orthodoxe Sprechakttheorie hat sich bislang weitgehend auf die Gelingensbedingungen einzelner sprachlicher Vollzüge konzentriert. Isolierte Redehandlungen stellen allerdings in der kommunikativen Praxis einen Ausnahmefall dar: Ein kompetenter Sprecher muss nicht nur die vom sprachlichen Kontext unabhängigen Korrektheitsstandards kennen; vielmehr muss er auch in der Lage sein, die eigenen Sprechakte im (...) Rahmen eines Textes kohärent miteinander zu verknüpfen und auf Redehandlungen anderer so zu reagieren, dass ein genuiner Diskurs zwischen den Parteien entsteht – im Gegensatz zu einer bloßen Aneinanderreihung “für sich” korrekter Äußerungen. Quite a few scholars claim that many implicata are propositions about the speaker's epistemic or doxastic states. I argue, on the contrary, that implicata are generally non-epistemic. Some alleged cases of epistemic implicature are not implicatures in the first place because they do not meet Grice's non-triviality requirement, and epistemic implicata in general would infringe on the maxim of quantity. Epistemic implicatures ought to be construed as members of a larger family of implicature-like phenomena.

According to judgment internalism, there is a conceptual connection between moral judgment and motivation. This paper offers an argument against that kind of internalism that does not involve counterexamples of the amoralist sort. Instead, it is argued that these forms of judgment internalism fall prey to a Frege-Geach type argument.

Dem "Manifestationsargument" zufolge steht eine realistische Semantik der Wahrheitsbedingungen im Widerspruch zu dem Gedanken, dass das Verstehen von Sätzen eine Fähigkeit ist, die sich im Handeln manifestieren können muss. – Der Aufsatz zeigt, dass sowohl Realisten als auch Anti-Realisten die These aufzugeben haben, dass das Verstehen eines Satzes im Erfassen der jeweiligen Wahrheitsbedingungenbesteht. Die realistische Annahme der Existenz verifikationstranszendenter Wahrheiten steht – unabhängig vom Manifestationsprinzip – im Widerspruch zu einer wahrheitskonditionalen Semantik. Die von heutigen Anti-Realisten vertretenen Theorien des Verstehens sind (...) allerdings einem ähnlichen Einwand ausgesetzt, insofern sie gleichfalls nicht unsere Fähigkeit, unentscheidbare Sätze zu verstehen, erklären können. According to the “paradox of knowability”, the moderate thesis that all truths are knowable – ... – implies the seemingly preposterous claim that all truths are actually known – ... –, i.e. that we are omniscient. If Fitch’s argument were successful, it would amount to a knockdown rebuttal of anti-realism by reductio. In the paper I defend the nowadays rather neglected strategy of intuitionistic revisionism. Employing only intuitionistically acceptable rules of inference, the conclusion of the argument is, firstly, not ..., (...) but .... Secondly, even if there were an intuitionistically acceptable proof of ..., i.e. an argument based on a different set of premises, the conclusion would have to be interpreted in accordance with Heyting semantics, and read in this way, the apparently preposterous conclusion would be true on conceptual grounds and acceptable even from a realist point of view. Fitch’s argument, understood as an immanent critique of verificationism, fails because in a debate dealing with the justification of deduction there can be no interpreted formal language on which realists and anti-realists could agree. Thus, the underlying problem is that a satisfactory solution to the “problem of shared content” is not available. I conclude with some remarks on the proposals by J. Salerno and N. Tennant to reconstruct certain arguments in the debate on anti-realism by establishing aporias. (shrink)

The idea that Eastern and Western societies should do everything together because they're exactly the same and their interests are identical is not, as some would have it, a sign of evolutionary maturity or scientific insight, but a desperate form of political manipulation, new Western imperialism, and, yes, wishful thinking. Surely our cultural differences and identities make the world more colorful." Thorsten Pattberg's East-West Dichotomy discusses the philosophical concept that two diametrically opposed hemispheres exist - East and West. As (...) the Peking University scholar demonstrates with numerous examples, their cultures and way of thinking differ radically; one could say they are 180 degrees apart. Pattberg's underlying argument is that because of the dichotomy Westerners, who are mostly rugged individualists, are more analytic and deductive in their thinking, while Easterners, who are more focused on the collective, favor a more intuitive, inductive, "holistic" approach to life. Moreover, he explores the origin and the future of the dichotomy, and shows how it has shaped the West's and the East's different attitudes towards nature, philosophy (both epistemology and ethics), as well as gender and society. Pattberg also shows his willingness to take on any potential critic of his theory in his chapter "Problems with the Dichotomy." This book is a valuable resource for those eager to gain a better understanding of the "Western" and "Eastern" psyches and of how they both harmonize and clash. (shrink)

Max Weber examined Chinese society and European Puritanism at the beginning of the Twentieth Century in order to find out why capitalism did not develop in China. He found that Confucianism and Puritanism are mutually exclusive, which enabled him to oppose both in the form of two different kinds of rationalism. I attempt neither to refute nor to confirm the Weberian thought model. Instead I show that a similar model applies to Jean Baudrillard’s vision of American culture, a culture that (...) he determined in terms of hyperreality. Instead of rejecting Weber’s thoughts right away, I give Weber’s model a further push and show that through a further twist that “Western culture” has received within particular American constellations, Weber’s understanding of Confucianism and Baudrillard’s understanding of American civilization manifest amazing similarities. A minimal truthmaker for a given proposition is the smallest portion of reality which makes this proposition true. Minimal truthmakers are frequently mentioned in the literature, but there has been no systematic account of what they are or of their importance. In this article we shall clarify the notion of a minimal truthmaker and argue that there is reason to think that at least some propositions have minimal truthmakers. We shall then argue that the notion can play a useful role (...) in truthmaker theory, by helping to explain the truth of certain propositions as precisely as possible. (shrink)

This essay asks what it is about the practice of trade that grounds duties of justice between states as trade partners. The answer advanced is that such duties are grounded in the dependence that trade generates. The essay puts forward four conditions that a plausible account of grounding in trade must meet: it must admit of degrees, explain the distinctly international character of trade justice, ground both procedural and distributive duties, and it must be a necessary feature of all trade (...) relationships which generate duties of justice. A dependence account of grounding meets all four conditions, and does so in an intuitively compelling way. While other accounts of what grounds duties of trade justice can meet some of the conditions, none can meet all of them. Relative to rival candidates, then, the dependence account provides a firmer foundation for the ongoing attempts to develop a comprehensive theory of trade justice. (shrink)

This article uses sim-max games to model perceptual categorization with the goal of answering the following question: To what degree should we expect the perceptual categories of biological actors to track properties of the world around them? I argue that an analysis of these games suggests that the relationship between real-world structure and evolved perceptual categories is mediated by successful action in the sense that organisms evolve to categorize together states of nature for which similar actions lead to similar results. To hold an environmental ethic is to hold that non-human beings and states of affairs in the natural world have intrinsic value. This seemingly straightforward claim has been the focus of much recent philosophical discussion of environmental issues. Its clarity is, however, illusory. The term ‘intrinsic value’ has a variety of senses and many arguments on environmental ethics suffer from a conflation of these different senses: specimen hunters for the fallacy of equivocation will find rich pickings in the area. This (...) paper is largely the work of the underlabourer. I distinguish different senses of the concept of intrinsic value, and, relatedly, of the claim that non-human beings in the natural world have intrinsic value; I exhibit the logical relations between these claims and examine the distinct motivations for holding them. The paper is not however merely an exercise in conceptual underlabouring. It also defends one substantive thesis: that while it is the case that natural entities have intrinsic value in the strongest sense of the term, i.e., in the sense of value that exists independently of human valuations, such value does not as such entail any obligations on the part of human beings. The defender of nature’s intrinsic value still needs to show that such value contributes to the well-being of human agents. (shrink)

Looks into evaluation of information provision probability from different sources, based on use of linguistic variables. Formation of functions appurtenant for its unclear variables provides for adoption of decisions by the decision maker, in conditions of nonprobabilistic equivocation. The development of market relations in Ukraine increases the independence and responsibility of enterprises in justifying and making management decisions that ensure their effective, competitive activities. As a result of the analysis, it is determined that the condition of economic facilities can be (...) described and determined by the decision-maker, in the presence of the necessary information. The confidence of the decision-maker in the information received is different and the decisions made have a correspondingly different level of information risk. It is important to substantiate the procedure for assessing the numerical extent of information risk in decision-making based on the information obtained in conditions of uncertainty. The use of a linguistic variable in the processing of expert data presented in the form of a matrix of binary relations of values of the membership function, which allowed to move to further processing of knowledge to support decision-making in the management of industrial, commercial, financial and other activities. As a mathematical model for estimating the numerical measure of information risk when making decisions based on the information obtained in conditions of non-stochastic uncertainty, a model has been developed to model natural language uncertainties, which differs from existing ones by formalizing knowledge taking into account uncertainty of input information. Making such a clear decision in a fuzzy environment has appropriate values of effectiveness and risk. The paper proposes all the functions and accessories of indicators of both quantitative nature and qualitative nature to bring their values in the field of definition to one scale. Then the indicator of the effectiveness of decision-making will be a measure of the clarity of the cross-section of fuzzy subsets, which correspond to the introduced indicators of information risk. The condition of economic facilities can be described and determined by the decision-maker, if the necessary information is available. Decision-making on thenumerical measure of information risk must be determined by a set of basic indicators, which can be both quantitative and qualitative in nature. Predictive values of indicators should be determined in conditions of nonstochastic uncertainty. In this case, the indicators of a quantitative nature can be determined by fuzzy triangular numbers, which implement a high level of confidence in the subjective judgments of experts. Indicators of qualitative nature should be presented in linguistic variables. The values of the indicators of qualitative nature that are predicted must be considered for all fuzzy variable terms-sets of linguistic variables introduced into consideration. For any fuzzy variable, the introduction to the consideration of a clear set of values as carriers of the α-level of its membership function allows to reduce to a single interpretation of the predicted values of indicators of quantitative and qualitative nature in terms of non-stochastic uncertainty. Many corporations are large, powerful, and wealthy. There are massive shortfalls of global justice, with hundreds of millions of people in the world living below the threshold of extreme poverty, and billions more living not far above that threshold. Where injustice and needs shortfalls must be remediated, we often look towards agents’ capabilities to determine who ought to bear the costs of rectifying the situation. The combination of these three claims grounds what I call a ‘linkage-based’ account of why corporations (...) have demanding positive duties to the global poor. In this paper, I put forward a distinctive linkage-based account of corporations’ positive duties centred on the idea of dependence and the importance of meeting agents’ core needs. In addition to outlining and defending this account, I will show that we can utilise its basic conceptual components to make headway on questions that have received insufficient attention in the business ethics literature; specifically, we can say something substantive about the weighting of needy agents’ competing claims to assistance, and about the limits to the demands that can be lodged against corporations on the basis of others' unmet needs. Having integrated considerations of duties' grounding, their comparative weight, and the limits of their demandingness into a single account of corporate positive duty, I conclude by discussing a challenge to attributing to corporations duties owed to the worst-off amongst the global poor. Observers inspected normal, high quality color displays of everyday visual scenes while their eye movements were recorded. A large display change occurred each time an eye blink occurred. Display changes could either involve "Central Interest" or "Marginal Interest" locations, as determined from descriptions obtained from independent judges in a prior pilot experiment. Visual salience, as determined by luminance, color, and position of the Central and Marginal interest changes were equalized. -/- The results obtained were very similar to those obtained in (...) prior experiments showing failure to detect changes occurring simultaneously with saccades, flicker, or “mudsplashes” in the visual scene: Many changes were very hard to detect, and Marginal Interest changes were harder to detect than Central Interest changes. -/- Analysis of eye movements showed, as expected, that the probability of detecting a change depended on the eye’s distance from the change location. However a surprising finding was that both for Central and Marginal Interest changes, evenwhen observers were directly fixating the change locations (within 1 degree),more than 40% of the time they still failed to see the changes. It seems that looking at something does not guarantee you “ see” it. (shrink)

Despite being a staple of liberal-democratic politicians’ and theorists’ rhetorical arsenal, ‘openness’ as a political commitment has yet to receive sustained philosophical analysis. My aim in this paper is to provide such an analysis. I will argue that political openness involves a readiness by an agent to engage with others forthrightly and receptively, and to recognise their authoritative standing in political domains. I demonstrate the explanatory value of this account by showing that it provides an insightful explanation of what’s at (...) stake in the emerging political cleavage between ‘open’ and ‘closed’ politics, explains the appeal of ‘the open society’ as an epithet for liberal democracies, and provides a compelling interpretation of openness’ contribution to social dynamism and progressive reform, one which diverges favourably from the emphasis others have put on social experimentation and trial and error learning. Purpose: The modern development of mass culture is characterized by the growth of the market for graphic narratives, the rapid increase in the segment of digital comics, and the active use of comics as a communication tool in various industries and disciplinary areas. The purpose of the study: to determine the media capabilities of the comics in presenting educational, cross-cultural, problematic, and ethical content of modern organizational culture. Design / Method / Approach: The review nature of the article involves the (...) use of traditional general scientific methods (description, comparison, abstraction, and specification). The interdisciplinary nature of the study actualized the comparative method in presenting the cross-cultural features of organizational/office/corporate comics. Findings: The influence of visual mass culture and the spread of interdisciplinary research tools made it possible to analyze three areas within the stated problematic: adaptive and audience-oriented comics techniques popularized their use for training and educational purposes; the possibility of comparing the typology of world comics with cross-cultural global studies (we relied on the methodology and results of the GLOBE (Global Leadership and Organizational Behavior Effectiveness) project); the ability of the comics to reproduce, maintain, and spread the tradition of a particular organizational culture. Theoretical value of the study: The work has expanded: (1) the possibilities of a multidisciplinary approach to comics culture in order to clarify the interdisciplinary methodology; (2) the idea of forming and maintaining an authentic organizational culture using comics techniques; (3) the possibilities of using graphic narratives in the process of educational and professional communication. Practical value of the study: The possibilities of using comics in modern organizational culture at the level of self-presentation, training, and maintaining traditions. Originality/value of the study: A multidirectional analysis of the influence of mass culture (comics as a part of it) on the representation of everyday modern business processes is presented. Research limitations / Future research: Analyzing business processes in the language of graphic culture requires valid methods. Further research requires a larger statistical sample and improved interdisciplinary methods. -/- Мета роботи: Сучасний розвиток масової культури характеризується зростанням ринку графічних наративів, стрімким збільшенням сегмента цифрових коміксів, активним використанням коміксу як інструменту комунікації в різних галузях і дисциплінарних напрямах. Мета дослідження: визначити медійні можливості коміксу в представленні освітньо-навчального, кроскультурного та проблемно-етичного контенту сучасної організаційної культури. Дизайн / Метод / Підхід дослідження: Оглядовий характер статті передбачає залучення традиційних загальнонаукових методів (опис, порівняння, абстрагування та конкретизація). Міждисциплінарність дослідження актуалізувала компаративний метод у представленні крос-культурних особливостей організаційних/офісних/корпоративних коміксів. Результати дослідження: Вплив візуальної масової культури та поширення міждисциплінарних інструментів дослідження уможливили в межах заявленої проблематики аналіз трьох напрямів: адаптивні та аудиторноспрямовані коміксові техніки популяризували їх використання з навчальною та освітньою метою; можливість зіставлення типології світових коміксів з кроскультурними глобальними дослідженнями (ми спиралися на методику та результати проєкту GLOBE (Global Leadership and Organizational Behavior Effectiveness); можливості коміксу відтворювати, підтримувати та поширювати традицію певної організаційної культури. Теоретична цінність дослідження: Робота розширила: (1) можливості різновекторного підходу до коміксової культури з метою уточнення міждисциплінарної методики; (2) уявлення щодо формування та підтримки автентичної організаційної культури за допомогою коміксових технік; (3) можливості використання графічних наративів в процесі навчально-освітньої та професійної комунікації. Практична цінність дослідження: Можливості використання коміксу в сучасній організаційній культурі на рівні самопрезентації, навчання та підтримки традицій. Оригінальність/цінність дослідження: Презентовано різновекторний аналіз впливу масової культури (коміксової як її частини) на представлення повсякдення сучасних бізнес-процесів. Обмеження дослідження / Майбутні дослідження: Аналіз бізнес-процесів мовою графічної культури вимагає валідних методів. China’s rise to global power status is set to be amongst the primary shapers of politics and life more broadly in the 21st century. Yet despite its immense significance, political philosophers have been surprisingly quiet on the normative implications of China’s rise. This, I will argue, is a mistake. Not only does China’s rise generate interesting normative questions in its own right; it also upends some basic assumptions that many of us have hitherto adopted in our thinking about international distributive (...) justice. In the philosophical literature, the international order is often characterised by two sorts of states – developed and developing – with the former owing demanding duties and the latter having expansive permissions to further their own development. China’s status as both a genuine superpower and a middle-income country facing significant development challenges calls into question the continued functionality of such simplifying assumptions. Against the backdrop of China’s rise – and, to a lesser extent, that of other large emerging economies – this paper develops a more fine-grained account of how to conceive of states’ differential levels of advantage, distinguishing between states that are incapable, precariously capable, and robustly capable of realizing a minimally decent standard of domestic justice. This account reaffirms the assignment of the most onerous international duties to developed states, but also assigns duties and claims to developing states in a scalar fashion, with the upshot that better-off developing states in particular bear positive duties of international justice, owed to least-developed countries (LDCs). It is widely thought that functionalism and the qualia theory are better positioned to accommodate the ‘affective’ aspect of pain phenomenology than representationalism. In this paper, we attempt to overturn this opinion by raising problems for both functionalism and the qualia theory on this score. With regard to functionalism, we argue that it gets the order of explanation wrong: pain experience gives rise to the effects it does because it hurts, and not the other way around. With regard to the (...) qualia theory, we argue that it fails to capture the sense in which pain 's affective phenomenology rationalises various bodily-directed beliefs, desires, and behaviours. Representationalism, in contrast, escapes both of these problems: it gets the order of explanation right and it explains how pain 's affective phenomenology can rationalise bodily-directed beliefs, desires, and behaviours. For this reason, we argue that representationalism has a significant advantage in the debates about pain 's affective phenomenology. We end the paper by examining objections, including the question of what representationalists should say about so-called ‘disassociation cases’, such as pain asymbolia. (shrink)

This paper canvasses the various dimensions along which theories of truth may disagree about the extent to which truth is minimal.

Over 1000 companies have either curtailed or else completely ceased operations in Russia as a response to its invasion of Ukraine, a mass corporate exodus of a speed and scale which we’ve never seen. While corporate withdrawal appears to have considerable public support, it’s not obvious that it has done anything to hamper the Russian war effort, nor is it clear what the long-run effects of corporate withdrawal as a regularised response to war might be. Given this, it’s important the (...) evaluate the ethical merits of such a response. In this paper I critique what I take to be the two most common arguments given in favour of voluntary corporate withdrawal, which I label ‘the instrumental argument’ and ‘the clean hands argument’ respectively. After illustrating their shortcomings, I reframe corporations’ predicament as a ‘spattered hands’ case—one where they may do good by remaining in a war-waging state, but where they contribute indirectly to grave wrongdoing by doing so. Drawing on ideas from the ‘Business for Peace’ and ‘Business and Human Rights’ literature, I highlight the potentially positive role of corporate presence within war-waging countries, before highlighting four considerations which corporations ought to bear in mind when determining whether to withdraw, or whether it is the lesser evil to stay and to let their hands be spattered. Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. We also show why admitting other (...) forms of evidence, such as eyewitness, trace, and motive evidence, does not violate equal protection. (shrink)

This paper explains what an infinite regress argument is. Part 1 contains some examples of infinite regress arguments. Part 2 presents a schema for all such arguments an defines an infinite regress argument as one that approximates to the schema. Part 3 tests the schema on the examples. Part 4 contrasts my account of infinite regress arguments with that given by Passmore and shows that Passmore's theory succumbs to objections. Part 5 distinguishes an infinite regress argument from an infinite regress (...) and defines an infinite regress. Part 6 explains the dyslogistic force of 'infinite regress'. (shrink)

Kết quả nghiên cứu cho thấy, hoạt động tái cấu trúc ngân hàng đã diễn ra mạnh mẽ với chỉ đạo quyết liệt của Chính phủ và Ngân hàng nhà nước, đặc biệt trong phê duyệt chủ trương chuyển giao bắt buộc 4 ngân hàng diện kiểm soát đặc (...) biệt nhằm lành mạnh và ổn định hệ thống ngân hàng. Tuy nhiên, với thực trạng nền kinh tế suy thoái, những vấn đề về nợ xấu gia tăng vượt qua ngưỡng an toàn 3%, tỷ lệ bao phủ nợ xấu giảm xuống dưới 100%, tín dụng tăng trưởng chậm, biên lợi nhuận thu hẹp đang trở thành nguy cơ dẫn dến rủi ro hoạt động của hệ thống ngân hàng Việt Nam. Trước thực trạng đó, tác giả đưa ra một số khuyến nghị chính sách nhằm nâng cao hiệu quả tái cơ cấu hệ thống ngân hàng. (shrink)

Despite their centrality to medicine, drugs are not easily defined. We introduce two desiderata for a basic definition of medical drugs. It should: (a) capture everything considered to be a drug in medical contexts and (b) rule out anything that is not considered to be a drug. After canvassing a range of options, we find that no single definition of drugs can satisfy both desiderata. We conclude with three responses to our exploration of the drug concept: maintain a monistic concept, (...) or choose one of two pluralistic outcomes. Notably, the distinction between drugs and other substances is placed under pressure by the most plausible of the options available. (shrink)

The representational theory of phenomenal experience is often stated in terms of a supervenience thesis: Byrne recently characterises it as the thesis that “there can be no difference in phenomenal character without a difference in content”, while according to Tye, “[a]t a minimum, the thesis is one of supervenience: necessarily, experiences that are alike in their representational contents are alike in their phenomenal character.” Consequently, much of the debate over whether representationalism is true centres on purported counter-examples – that is (...) to say, purported failures of supervenience. The refutation of putative counter-examples has been, it seems to me, by and large successful. But there is a certain class of these for which the representationalist response has been something less than completely convincing. These are the cross-modality cases. I will explain what I mean, and then argue that the response in question is not only unconvincing but actually undermines the representationalist position. (shrink)

The Cyrenaics assert that (1) particular pleasure is the highest good, and happiness is valued not for its own sake, but only for the sake of the particular pleasures that compose it; (2) we should not forego present pleasures for the sake of obtaining greater pleasure in the future. Their anti-eudaimonism and lack of future-concern do not follow from their hedonism. So why do they assert (1) and (2)? After reviewing and criticizing the proposals put forward by Annas, Irwin and (...) Tsouna, I offer two possible reconstructions. In the first reconstruction, I explain claim (1) as follows: happiness has no value above and beyond the value of the particular pleasures that compose it. Also, there is no "structure" to happiness. The Cyrenaics are targeting the thesis that happiness involves having the activities of one's life forming an organized whole, the value of which cannot be reduced to the value of the experiences within that life. I explain claim (2) as follows: a maximally pleasant life is valuable, but the best way to achieve it is to concentrate heedlessly on the present. In the second reconstruction, the good is radically relativized to one's present preferences. The Cyrenaics assert that we desire some particular pleasure, e.g., the pleasure that results from having this drink now. Thus, our telos -- which is based upon our desires -- is this particular pleasure, not (generic) 'pleasure' or the maximization of pleasure over our lifetime. As our desires change, so does our telos. I conclude that the scanty texts we have do not allow us to decide conclusively between these reconstructions, but I give some reasons to support the second over the first. (shrink)

Epicurus is strongly committed to psychological and ethical egoism and hedonism. However, these commitments do not square easily with many of the claims made by Epicureans about friendship: for instance, that the wise man will sometimes die for his friend, that the wise man will love his friend as much as himself, feel exactly the same toward his friend as toward himself, and exert himself as much for his friend's pleasure as for his own, and that every friendship is worth (...) choosing for its own sake. These claims have led some scholars to assert that Epicurus inconsistently affirms that friendship has an altruistic element. I argue that the Epicurean claims about friendship can be reconciled with egoism and hedonism in psychology and ethics. Friendship is valuable because having friends provides one with security more effectively than any other means, and having confidence that one will be secure in the future either is identical to ataraxia, or the grounds on which one has it. Abstract: The study aimed to determine the strategic flexibility and its relationship to the level of quality of services provided, from the viewpoint of the internal beneficiary in non-governmental hospitals in Gaza Strip. The study relied on the descriptive and analytical approach, and the questionnaire was designed as a tool to collect data and consisted of (39) items, and the researchers used the comprehensive survey method, and the number of the study population was (536) individuals, where (434) questionnaires were retrieved, (...) and the recovery rate was (80.97%). The study revealed many results, the most important of which were: the existence of a moderate degree of approval by the study sample individuals on strategic flexibility, as it was evident through the area of strategic flexibility as a whole having a relative weight (60.44%). The study is on the quality of services, as it became clear through the field of service quality obtaining a relative weight (79.90%). The results of the study revealed a statistically significant relationship between strategic flexibility and the quality of services in non-governmental hospitals in Gaza Strip, with a correlation coefficient of 0.490. The study reached many recommendations, the most important of which were: the need to work on appointing young people and those with potentials, because jobs are vacant in the hospitals under study, and the need to seek the help of an administrative staff with scientific and practical qualifications, and to work on updating information systems, archiving and networks through which data and information are transferred between departments And the creation of mechanisms by which stored information can be used to enhance the decision-making process, and an effective system to receive patients' complaints in a manner that ensures rapid response and treatment, to achieve continuous communication between patients and the hospital management, and to notify patients of dealing with the complaints they submit, and work to provide all Medical and health specialties in the hospitals under study, by making use of the medical delegations that visit Gaza Strip, involving them in the treatment processes, bringing in doctors and specialists from abroad, updating the standards related to measuring the services provided to patients on an ongoing basis, based on the suggestions and complaints of patients, and developing facilities in hospitals As well as updating the medical devices and equipment used in hospitals periodically. In this article, I consider the role of institutions in Jacques Derrida’s political engagement. In spite of Derrida’s significant involvement with political causes throughout his life, his engagements have received little sustained attention, and this is particularly true of his work with institutions. I turn to two such cases, the Collège international de philosophie and the Parlement international des écrivains and argue that these represent an alternative mode of institutionalisation. These institutions seek to destabilise other institutions as well as themselves.Looking (...) closely at the institutions that Derrida founded, we see three common characteristics emerge. These institutions are anti-hegemonic,self-reflexive and international. I then connect these to Derrida’s thought, offering a reading of the undecidable, which brings forth the importance of conventions in the decision. Finally, I demonstrate that the three shared characteristics of Derrida’s institutions form part of an effort to open up space for the possibility of alterity. Through this, and beyond a distinction between theory/practice, we come to see Derrida’s institutional engagements as an active form of critique, both of other institutions and themselves. (shrink)

Abstract: This research paper presents a novel approach to predict audit risks using a neural network model. The dataset used for this study was obtained from Kaggle and comprises 774 samples with 18 features, including Sector_score, PARA_A, SCORE_A, PARA_B, SCORE_B, TOTAL, numbers, marks, Money_Value, District, Loss, Loss_SCORE, History, History_score, score, and Risk. The proposed neural network architecture consists of three layers, including one input layer, one hidden layer, and one output layer. The neural network model was trained and validated, achieving (...) an impressive accuracy of 100% and an average error of 0.000015, indicating its robust predictive capability. Moreover, we conducted feature importance analysis to identify the most influential features for predicting audit risk. The key features found to be critical for classifying fraudulent activities in audit risk prediction are Sector_score, PARA_A, SCORE_A, PARA_B, SCORE_B, TOTAL, numbers, marks, Money_Value, District, Loss, Loss_SCORE, History, and History_score. This research contributes to the field of audit risk prediction by demonstrating the effectiveness of a neural network-based approach and highlighting the importance of specific features in detecting fraudulent activities. The findings have significant implications for auditors and organizations seeking to enhance their audit risk assessment processes, ultimately leading to improved financial transparency and fraud detection. One striking oddity about Democritus and Epicurus is that, even though Epicurus' theory of perception is largely the same as that of Democritus, Democritus and his followers draw skeptical conclusions from this theory of perception, whereas Epicurus declares that all perceptions are true or real. I believe that the dispute between Democritus and Epicurus stems from a question over what sort of ontological status should be assigned to sensible qualities. In this paper, I address three questions: 1) Why were Democritus (...) and his followers skeptical? 2) How did Epicurus modify Democritus' metaphysics in order to avoid these skeptical conclusions? and 3) How successful was he? -/- 1) I argue that Democritus allows only the intrinsic properties of atoms into his ontology, and then runs into skeptical difficulties because of the relativity of perception. 2) I propose that Epicurus modifies Democritus' ontology by allowing dispositional and relational properties as real properties of bodies. Sensible qualities are conceptualized as dispositional properties of bodies to cause certain experiences in percipients. 3) I argue that Epicurus does not run into the same problems as Democritus. Finally, I consider how my interpretation of Epicurus' ontology helps to make sense of his claim that all perceptions are alethes--'true' or 'real.'. (shrink)
