This paper aims to answer the question: what does the realism of laws of nature consist of? To achieve this, in the first part, three philosophical accounts of laws of nature are presented and examined: the universalist, the dispositionalist and the counter-factualist. The presentation and examination focuses on the answer given by each of these accounts to the question: what is a law of nature? Later, in the second part, convergences and divergences between these three accounts are shown. Finally, in (...) the third section, the points of agreement between them are put together to advance the fundamental thesis that encompasses each of these accounts as realist accounts of laws of nature. This thesis, I argue, is at the end the core of the general realist stance on laws of nature that I name “Realism of Laws of Nature”. (shrink)

En este trabajo intentamos hacer una aproximación a la problemática de la llamada singularidad del Holocausto. Tomamos como disparador inicial un suceso alusivo relativamente reciente que acaba de causar revuelo en la opinión pública, en el que una política Africana (Helen Zille) se declaró defensora de la singularidad del genocidio perpetrado por el régimen nazi. Desde allí intentamos aproximarnos a distintas articulaciones en favor y en contra de la tesis singularista ¿Fue el Holocausto un hecho único, sin precedentes, o (...) apenas otra manifestación de la violencia occidental, o quizás un poco las dos cosas? ¿Tiene la discusión sólo un sentido “objetivo” o también uno “subjetivo”, y en este último caso, cuál de los dos es más fundamental? En este sentido abordamos de manera sucinta las articulaciones elaboradas tanto por los defensores de la formulación extrema de la tesis singularista (específicamente Goldhagen, Katz, y Genwarth) como de sus objetores relativos (como, a nuestro entender, E. Traverso) y absolutos (por ejemplo Stannard). Intentamos mostrar que la aproximación a la problemática no resiste satisfactoriamente la adopción de posturas binarias a diferencia de lo que ocurre con acercamientos más tendientes a la conciliación como el de E. Traverso, cuyo acento en el estatus doble del Holocausto (como emergente histórico en el plano fáctico-objetivo e irrupción sin precedentes en términos del proceso de comprensión y auto-comprensión occidental del ejercicio de violencia) podría suponer antes que una resignificación del debate reciente, la inauguración, casi, de todo un nuevo horizonte de investigación. Nietzsche criticizes Stoicism for overstating the significance of its ethical ideal of rational self-sufficiency and for undervaluing pain and passion when pursuing an unconditional acceptance of fate. Apparent affinities between Stoicism and Nietzsche’s philosophy, especially his celebration of self-mastery and his pursuit of amor fati, lead some scholars to conclude that Nietzsche cannot advance these criticisms without contradicting himself. In this article, I narrow the target and scope of Nietzsche’s complaints against Stoicism before showing how they follow from his other (...) philosophic commitments. I suggest that the first line of criticism follows from his denial of teleology and his skepticism toward moral values’ descriptive objectivity. I then suggest that the second line of criticism follows from Nietzsche’s account of overcoming as bestowing contributory value upon pain and suffering. Explaining Nietzsche’s criticisms of Stoicism in this way substantially qualifies similarities between his philosophy and that of Stoicism while absolving him of the charge of inconsistency. The conference abstracts deal with the issue of relations between science and religion, which started in the Medieval Age during the High Scholasticism of the XIII century. Thus, Thomas Aquinas worked out the concept of harmony or a bridge between faith and reason and constructed the Scholastic ideal of rational faith. Aquinas' “Five Ways to Prove the Existence of God” demonstrates the being of the First Principle of reality. It found its continuation in the concept of Divine's Logos or the (...) Mind of the Universe. This concept is a critical review of the concept of Intelligent Design, which uses the metaphor of the Watchmaker or the Great Designer of the Universe. (shrink)

I argue that Kripke’s construal of the distinction between speaker’s reference and semantic reference, in ‘Speaker’s reference and semantic reference’ (Kripke in Midwest Stud Philos 2:255–276, 1977), in conjunction with an intuitive view of the nature of conventions, implies a theory of semantic reference that is distinct from his causal theory. On this theory, semantic reference is conventionalized speaker’s reference. The argument concerning Kripke has two general implications. First, any theory that features a notion of speaker’s reference will have great (...) difficulty in avoiding the view that semantic reference is conventionalized speaker’s reference. Second, theories that deny that there is a viable notion of speaker’s reference, and thereby deny that semantic reference is conventionalized speaker’s reference, will face an uphill battle in meeting certain general constraints originating in the theory of conventions. In the Prolegomena to De Jure Belli ac Pacis, Hugo Grotius expounds his theory of natural law by way of reply to a skeptical challenge from the Greek Academic Carneades. Though this dialectical context is undeniably important for understanding Grotian natural law, commentators disagree about the substance of Carneades’s challenge. This paper aims to give a definitive reading of Carneades’s skeptical argument, and, by reconstructing Grotius’s reply, to settle some longstanding debates about Grotius’s conception of natural law. I argue that (...) Grotius held a Stoic view of natural law, endorsing both the doctrine of eudaimonism and the claim that moral obligations are natural, not grounded in divine command. Consequently, Grotius’s view of natural law has more continuity with pre-modern, indeed ancient, morality than is usually supposed. However, I argue that we can still understand Grotius as a founder of modern moral philosophy. (shrink)

Goethe carried out an enormous number of experiments before criticizing Newton's theory of light and colours in the Farbenlehre (1810). He managed to show that Newton's reasoning is based on a rather narrow choice of experiments, in which parameters such as the distance between the prism and the screen are fixed arbitrarily: Newton's famous spectrum (with its green centre) occurs only at a specific distance. Once you reduce the distance, the green centre disappears, and you see the two border spectra (...) instead. Newton can of course explain these border spectra; but things can be explained just as well the other way around: Then you start with a theory based on the two border spectra in order to derive the Newtonian spectrum. Both accounts fit many data (available in Newton and Goethe's days) equally well. Thus by insisting that the step to theory is not forced upon us by "reason and experiments" alone (as Newton would have it), Goethe revealed our own free, creative contribution to theory construction. And surprisingly, his theory of the prismatic colours seems no worse off than Newton's, even taking into account additional criteria of theory choice, such as simplicity or elegance. (shrink)

Son varias las posturas que sostienen que la relación de Jean-Paul Sartre y Simone de Beauvoir en el campo filosófico no encuentra mayores coincidencias, por lo que se sugiere la interpretación de que no realizaron un trabajo en conjunto en la construcción del existencialismo. Sin embargo, también son muchas las posiciones que otorgan un sentido de estrecho trabajo filosófico entre él y ella. A pesar de las distintas posturas, podemos encontrar claramente ciertas coincidencias en sus trabajos que ayudaron a la (...) construcción de esta postura filosófica. Este texto se propone analizar la defensa del existencialismo realizada por Sartre y Beauvoir en contra del pensamiento dogmático del siglo XX. A partir del existencialismo propuesto por ambos autores se intenta mostrar al hombre de manera abierta, sin adornos que lo definan de manera absoluta, negando entidades trascendentes que guíen su destino: el destino del hombre es lo que éste hace de sí mismo. Así pues, se busca presentar al existencialismo en contravía de cualquier rasgo de mistificación que se genere en el terreno de la existencia humana. (shrink)

In the course of his philosophy, in various contexts, Kant comes to reject three theses about existence: (i) that the thoroughgoing determination of a thing implies its existence, (ii) that existence is a real predicate or determination of a thing, and (iii) that existence is the complement of inner possibility or essence. Kant’s target here is Baumgarten, who advocates these theses as the criterion, classification, and definition of existence. In this article I seek to clarify Kant’s elusive theory of existence (...) through its opposition to Baumgarten. I will show that Kant’s refutation of (i)–(iii) does not stand alone but is grounded on his own definition of existence as (absolute) positing. Thus contrary to common practice, Kant’s negative claims about what existence is not cannot be understood in isolation but must be taken as jointly dependent on Kant’s positive claim of what existence is. I will show that the theses (i)–(iii) fail because they presuppose that existence contributes to the intension or content of a concept, whereas according to Kant existence in fact posits a (non-empty) extension to the concept. Part of Plato’s complaint about the cognitive status of art cites the pollution of aesthetic cognition by the affective side of our natures. Schopenhauer, by contrast, takes aesthetic cognition to transcend (some of) the limitations of everyday cognition precisely because in it agents become the “pure, will-less subject of cognition” (WWR I 219). On the orthodox reading of his later philosophy, Nietzsche scorns Plato and (...) Schopenhauer’s association of the value of art with its truthfulness. I challenge the orthodox reading and argue that one strand of art’s value is its penetrative cognitive power. In contrast to Schopenhauer, Nietzsche understands this cognitive power to result from the embracing and exploitation of the affects in the artistic process rather than their extirpation. (shrink)

In this paper we suggest a revisionist perspective on two significant figures in early modern life science and philosophy: William Harvey and John Locke. Harvey, the discoverer of the circulation of the blood, is often named as one of the rare representatives of the ‘life sciences’ who was a major figure in the Scientific Revolution. While this status itself is problematic, we would like to call attention to a different kind of problem: Harvey dislikes abstraction and controlled experiments (aside from (...) the ligature experiment in De Motu Cordis), tends to dismiss the value of instruments such as the microscope, and emphasizes instead the privileged status of ‘observed experience’. To use a contemporary term, Harvey appears to rely on, and chiefly value, ‘tacit knowledge’. Secondly, Locke’s project is often explained with reference to the image he uses in the Epistle to the Reader of his Essay, that he was an “underlabourer” of the sciences. In fact, despite the significant medical phase of his career, Locke’s ‘empiricism’ turns out to be above all a practical (i.e. ‘moral’) project, which focuses on the delimitation of our powers in order to achieve happiness, and rejects the possibility of naturalizing knowledge. When combined, these two cases suggest a different view of some canonical moments in early modern natural philosophy. (shrink)

Many commentators have claimed that Nietzsche views the “sublimation” (Sublimierung) of drives as a positive achievement. Against this tradition, I argue that, on the dominant if not universal Nietzschean use of Sublimierung and its cognates, sublimation is just a broad psychological analogue of the traditional (al)chemical process: the “vaporization” of drives into a finer or lighter state, figuratively if not literally. This can yield ennobling elevation, or purity in a positive sense—the intensified “sublimate” of an unrefined original sample. But it (...) can also yield drives that are attenuated or otherworldly, in a pejorative sense. One (but only one) kind of Nietzschean sublimation is the “translation” of drives to “imaginative and spiritual” (Imaginative und Seelische) modes of expression. I con­clude that, despite certain appearances to the contrary, Nietzsche ultimately values basic drives’ powerful expression, without preferring either that this occur specifically as “higher culture” or as “savage” natural impulse. Cognitive science of religion is sometimes portrayed as having no bearing on the theological doctrines of particular religious traditions, such as Christianity. In this paper, I argue that the naturalistic account of the etiology of religious beliefs offered by the cognitive science of religion undermines the important Christian doctrine of the grace of faith, which teaches that the special gift of divine grace is a necessary precondition for coming to faith. This has some far-reaching ramifications for Christian theology. -/- .

Nietzsche’s name has become almost synonymous with militant atheism. Born into a pious Christian family, this son of a Lutheran pastor declared himself the Antichrist. But could this have been yet another of his masks of hardness? Nietzsche rarely revealed his innermost self in the published writings, and this can be gleaned mainly from his private letters and the accounts of friends. These sources bring to light the philosopher’s inner struggle with his own, deeply religious nature.Losing his father at a (...) young age was a calamity from which Nietzsche never recovered, and I argue that his famous thought-image “God is dead” was a transfiguration of the painful memory of this loss. In this essay, I trace Nietzsche’s tortuous path from an ardent devotee of God to a vociferous critic of Christianity, a path that was punctuated with veiled longings for a loving deity. Deep in his heart, he remained faithful to Christian ideals. Rather like Cordelia, the only truly loving daughter of King Lear, Nietzsche refused to utter words of intense affection and reverence, as these had been blatantly devalued and corrupted. Instead, he adopted a mask of a wrongdoer and a blasphemer who took not the punishment but the guilt.Nietzsche’s attitude to religion is discussed from the perspective of his life, his personality, and his mental condition. The discussion draws on psychoanalytical concepts of Freud, Erikson, Winnicott and Kohut. This is not an exclusive reading, but complementary to other studies in this field. (shrink)

At the turn of the nineteenth century, Friedrich Schlegel developed an influential theory of irony that anticipated some of the central concerns of postmodernity. His most vocal contemporary critic, the philosopher Hegel, sought to demonstrate that Schlegel’s theory of irony tacitly relied on certain problematic aspects of Fichte’s philosophy. While Schlegel’s theory of irony has generated seemingly endless commentary in recent critical discourse, Hegel’s critique of Schlegelian irony has gone neglected. This essay’s primary aim is to defend Hegel’s critique of (...) Schlegel by isolating irony’s underlying Fichtean epistemology. Drawing on Søren Kierkegaard’s The Concept of Irony in the final section of this essay, I argue that Hegel’s critique of irony can motivate a dialectical hermeneutics that offers a powerful alternative both to Paul de Man’s poststructuralist hermeneutics and to recent cultural-studies-oriented criticism that tends to reduce literary texts to sociohistorical epiphenomena. In this article, I channel the autobiography of Black Panther cofounder Huey P. Newton, entitled Revolutionary Suicide, against the misogyny of the alt-right movement today. Both Newton and the alt-right have been powerfully influenced by Nietzsche, but one way of grasping the central difference between them is by comparing their conceptions of Dionysus. While the alt-right sticks closer to Nietzsche’s conception, which minimizes the god’s androgyny, Newton’s thought resonates with that androgyny, thereby bringing him closer to the most influential Dionysus (...) scholar since Nietzsche, Walter Otto. I therefore turn to the latter’s Dionysus: Myth and Cult, whose analyses I synthesize into the following image inspired by the god’s closest animal familiar: the dancingly-graceful panther as aqueous-androgynous soul-hunter. Reimagining Newton’s Black Panther in this way, finally, can help us overcome the alt-right. (shrink)

Esta sección se titula: “La libertad de indiferencia no sólo es innecesaria para la virtud, sino que es completamente inconsistente con ella; y todas las inclinaciones y los hábitos, ya sean virtuosos o viciosos, son inconsistentes con las nociones arminianas de (...) la libertad y de la agencia moral”. En ella JEdwards hace una dura crítica a lo que él denomina la “libertad de indiferencia”. El estudio introductorio pone este escrito en un contexto más contemporáneo, identificando como este tipo de libertad a propuestas como el libertarismo de Robert Kane. (shrink)

En este trabajo, se propone una clasificación epistemológica teórica para el discurso astrológico a partir de evidencia empírica a fin de abordar el problema de cómo determinar específicamente qué es lo que lo hace ilegítimo. A partir de esta clasificación, se diseñó una intervención didáctica, enmarcada en el enfoque de Enseñanza de las Ciencias Naturales en Contexto (ECNC), con el objetivo de fomentar, en estudiantes de nivel secundario, la capacidad de distinguir enunciados cognoscitivamente ilegítimos -por infalsables o por falsos- respecto (...) de aquellos que pueden constituir genuino conocimiento científico. La secuencia didáctica se implementó con un grupo de 51 estudiantes de 14 a 17 años. Se evaluó su impacto por comparación entre un pretest y un postest. Los resultados mostraron que su capacidad de discernimiento entre enunciados falsables y no falsables se incrementó apreciablemente. (shrink)

En este texto retomo una pregunta importante que había quedado abierta al final del segundo capítulo de mi (2019): ¿cuáles son los límites del análisis? Sabemos que por obvias limitaciones materiales, todo análisis siempre será incompleto y por lo tanto, limitado. A estos límites les hemos llamado “metodológicos”, para distinguirlos de los metafísicos. Si el análisis tiene límites en este segundo sentido, aun si termináramos de analizar por completo un concepto, no podremos estar seguros de conocer todas sus propiedades esenciales (...) (ya que hay propiedades de este tipo que no las capta ningún análisis) o de ser capaces de distinguirlo de todos los conceptos (pues lo que lo distingue de otros conceptos puede ser inanalizable). Comúnmente se dice que el análisis no nos da todo el contenido de los conceptos, sino sólo su forma lógica o estructura semántica. Por lo tanto, otra manera de reformular la pregunta por los límites del análisis es ¿cuál es la relación entre forma y contenido? (shrink)

ABSTRACT A restricted interpretation of Humean methodology understands his experimentalism solely in terms of reducing epistemic statements to private sensory impressions accessible via introspection. My aim is to revise this interpretation by means of criticizing the connection it establishes between the maxim of not going beyond experience and the copy principle. I will show that this interpretation is inconsistent with the way Hume conceives the experimental method, since there is textual evidence to affirm that experience should not be understood in (...) terms of sensory impressions only, and that the science of human nature is not restricted to the study of the mental contents only, but it is nourished in the same way by the observation of social interaction. Finally, I will argue that the method Hume proposes does not prevent intersubjective verification of the empirical evidence, since the principle of sympathy enables the communication of mental states, which makes them devoid of their private character. En su artículo clásico, Gould y Lewontin (1979) han esgrimido críticas no siempre claras - contra el así llamado "programa adaptacionista". Puesto que una "adaptación" en uno de los sentidos más utilizados del vocablo - refiere a un rasgo cuya fijación en una población se explica por selección natural, el encuentro de adaptaciones ha sido considerado una heurística que guía a los biólogos en la aplicación de la teoría de la evolución por selección natural, procurando extender el campo de (...) aplicación de la teoría a priori, y sin restricción alguna, al mejor estilo kuhneano. Este trabajo procura elucidar, breve, pero integralmente, las críticas contenidas en el artículo aludido, donde se reconocen objeciones de diversa índole, a saber: empíricas, metodológicas, conceptuales, y pragmáticas, aunque con solapamientos. Se evalúa el filo de algunas de ellas, y se estipula la utilidad potencial que elucidaciones conceptuales como las que se ofrecen aquí pueden tener para con la filosofía de la biología. (shrink)

En este texto reconstruyo una concepción decolonial de la belleza, a partir del pensamiento de Robin Wall Kimmerer y Édouard Glissant, de acuerdo con la cual la belleza constituye una condición del mundo que, no obstante, debemos cuidar. En estos dos pensamientos, provenientes de tradiciones diferentes, la belleza es tanto lo que se ve amenazado por el proyecto colonial occidental, como lo que permite su resistencia decolonial. Reconstruir la belleza del mundo es necesario y, sin embargo, imposible: su búsqueda implica (...) no solo atender al llamado de las diferencias, sino también a las instancias en las que se niegan a ser escuchadas. Se le llama ‘psiquiatría biológica’ a la vertiente de la investigación psiquiátrica que busca establecer asociaciones estables entre condiciones psiquiátricas y factores biológicos específicos. La búsqueda de tales asociaciones está motivada por lo que llamo el “compromiso causal” de la psiquiatría biológica, que es la presunción de que factores biológicos específicos son las causas principales de las condiciones psiquiátricas. En este artículo argüiré que dicho compromiso es una presunción implausible sobre esas condiciones, pues la mejor evidencia psiquiátrico-biológica disponible no lo (...) respalda y es dudoso que la evidencia futura lo hará. While much has been made of the similarities between the work of Nietzsche and Freud, insufficient attention has been paid to their differences. Even where they have been noted, the degree of these differences, which sometimes approaches direct opposition, has often been underestimated. In the following essay, I will suggest that on the topic of conscience Nietzsche and Freud have radically opposed views, with profoundly different moral consequences. Despite superficial similarities, Nietzsche’s conception of conscience is opposed to that of Freud (...) in almost every conceivable way. For Freud, conscience is primarily associated with bad will, repression, subordination to social prohibition, and the feeling of guilt. For Nietzsche, conscience is primarily related to affirmation, memory, individual sovereignty, and the feelings of pride and power. To be sure, Freudian “bad conscience” has its parallel in Nietzsche’s philosophy—but only as a modality of conscience, not as its foundation. Freudian conscience is, on the contrary, an essentially bad conscience. (shrink)

Michael Slote’s Moral Sentimentalism is a wonderful model of a particular, under-appreciated philosophical method. It demonstrates that exciting, original work can be created by putting old ideas to new uses, proving once again that the classics of moral and political philosophy offer too rich an array of intellectual resources to leave to historians alone. Whenever one is reclaiming old ideas, however, the most important decision is which ideas to reclaim, and which to leave in the dustbin of history. Slote makes (...) use of many ideas drawn from history’s greatest moral sentimentalist, David Hume, but he rejects many others. The work of Hume’s closest friend and greatest sentimentalist ally, Adam Smith, is rejected without adequate explanation. Smith is mentioned, but quickly dismissed. Yet even though Smith makes little contribution to Slote’s own version of sentimentalism, I think he deserved greater discussion in this book. Smith and Slote address many of the same subjects, using the same basic sentimentalist approach, but they come to very different conclusions. It is thus possible to construct a fruitful debate between them—a debate in which, since he can no longer speak on his own behalf, I will be taking Smith’s side. (shrink)

No es común el tratamiento de los temas de derecho penal internacional en los manuales tradicionales de derecho penal, como tampoco en los referidos al derecho internacional público. Habitualmente se considera que el individuo no es sujeto de derecho internacional público, y por lo tanto sus actos quedan sometidos al derecho penal de cada Estado. “Sin embargo, sin duda existen bienes jurídicos e intereses que trascienden los límites (penales) nacionales” (Ambos, 200:26). Así, no se puede desconocer que la protección de (...) los Derechos Humanos es un punto de conexión. La incorporación al ordenamiento jurídico interno, por ley 26.200, del Estatuto de Roma (aprobado previamente por ley 25.390) por el cual se regulan las relaciones de cooperación entre el Estado Argentino y la Corte Penal Internacional, produjo consecuencias que afectan a todo el ordenamiento jurídico penal nacional. El objetivo de esta ponencia es abordar diversas temáticas propias de la filosofía wittgensteiniana desde una interpretación netamente pragmatista de las mismas. Concretamente, este será el caso del largamente debatido “argumento del lenguaje privado” (que desde una interpretación pragmatista no sólo conseguirá una mayor plausibilidad como tal argumento, sino que además será capaz de aportar luz sobre otros debates filosóficos contemporáneos en los que no siempre se detecta su íntima conexión con las cuitas wittgensteinianas); o la idea de parecidos de (...) familia (que sólo en un sentido pragmatista logrará escapar tanto de la vaguedad que le han achacado ciertas lecturas, como de cierta rigidez poco acorde, a todas luces, con las intenciones originarias de Wittgenstein); o la noción de “forma de vida” (que, por ejemplo, en la exégesis que el neopragmatista Richard Rorty hace de la misma, puede conectar así con otra de las nociones claves de otro pensador crucial del siglo XX, Martin Heidegger: se trata, en efecto, de la reflexión heideggeriana en torno a la Lichtung, a su vez conectable por parte de Rorty a la idea kuhniana de paradigma). Para finalizar, debatiremos brevemente la cuestión de hasta qué punto estas lecturas pragmatistas de Wittgenstein casarían con la imagen que el propio filósofo austríaco tenía de sí mismo como pensador. Nietzsche, in his work On the Genealogy of Morals, argues that human cognition is analogous in certain significant respects to the perspectival nature of optical vision. Because of this analogy, his account of human cognition is often referred to as perspectivism. Brian Leiter argues that Nietzsche’s use of this optical perspective metaphor undermines interpretations that take perspectivism to have radically skeptical implications. In this paper, I examine Leiter’s argument and show that the considerations he raises based on the optical perspective (...) metaphor are insufficient to undermine the claim that perspectivism entails radical skepticism. In this paper, I contrast two approaches to political legitimacy, both influenced by Rawls. One is the classic political liberal picture, according to which a state is legitimate if its “constitutional essentials” could be endorsed by reasonable citizens. The alternative is the idea that what makes a state legitimate is primarily its success at organizing the basic structure in a way that is demonstrably favorable to the governed. Specifically, I suggest that a state is legitimate insofar as it organizes the (...) basic structure in a manner that makes it easier for citizens to behave justly towards one another and adopt autonomous choices. I then move to demonstrate the superiority of this normative impact solution to the problem of legitimacy vis-à-vis political liberalism, even when reasonable disagreement about justice is factored in. Amplifying Bernard Williams’ critique of the Nietzschean project of a revaluation of values, this paper mounts a critique of the idea that whether values will help us to live can serve as a criterion for choosing which values to live by. I explore why it might not serve as a criterion and highlight a number of further difficulties faced by the Nietzschean project. I then come to Nietzsche's defence, arguing that if we distinguish valuations from values, there is at least (...) one form of the project which overcomes those difficulties. Finally, however, I show that even on this reading, the project must either fall prey to ‘Saint-Just's illusion’ or fall back into the problems it was supposed to escape. This highlights important difficulties faced by the Nietzschean project and its descendants while also explaining why Williams, who was so Nietzschean in other respects, remained wary of the revaluation of values as a project. In this article, I present a two-pronged argument for the immorality of contemporary, asymmetric drone warfare, based on my new interpretations of the just war principles of “proportionality” and “moral equivalence of combatants” (MEC). The justification for these new interpretations is that drone warfare continues to this day, having survived despite arguments against it that are based on traditional interpretations of just war theory (including one from Michael Walzer). On the basis of my argument, I echo Harry Van der Linden’s (...) call for “an international treaty banning all weaponized UAV [uninhabited aerial vehicles].”. (shrink)

In this paper, I study the relation between arguments against the person (aka ad hominem or personal attack arguments) and disqualifications for conflicts of interests. I show that both types of arguments share a similar logical structure and that they can be considered to be acceptable in similar circumstances.

Este artigo tem como objetivo fornecer uma visão ampla acerca da complexidade do xenotransplante, técnica que consiste no uso de animais não-humanos como fornecedores de órgãos para seres humanos. Nesse sentido, pretende-se auxiliar na análise ética dos potenciais benefícios da técnica, à luz dos questionamentos inerentes à sua pesquisa e possível implementação. Por um lado, o xenotransplante apresenta o potencial de solucionar a escassez crônica de órgãos humanos para transplantes, reduzindo as mortes decorrentes da falta de órgãos e as filas (...) de espera. Por outro lado, levanta várias questões que devem ser amplamente analisadas e democraticamente debatidas pela sociedade, tais como: o risco de xenozoonoses, o uso de animais não-humanos, a limitação da privacidade dos receptores de órgãos de origem animal, os protocolos de captação do consentimento livre e informado e o uso de pacientes com morte cerebral em experimentos. Desse modo, conclui-se que, mesmo que no futuro sejam superados os obstáculos clínicos e seja possível realizar xenotransplantes de órgãos com sucesso, é imprescindível avaliar cuidadosamente os prós e contras antes de decidirmos sobre sua continuidade. In my "The Providential Advantage of Divine Foreknowledge" (2009) I respond to John Sanders' defense of the claim, made by many open theists, that foreknowledge of future contingents provides God with no providential advantage over a God who lacks such knowledge. William Hasker responded to that paper with a defense of Sanders, and the current paper is a response to Hasker's response.

Recently, Charles Goldhaber (2019) has argued that Tyler Burge’s (2005, 2010, 2011) arguments against disjunctivism in the philosophy of perception fail when juxtaposed with the literature in perceptual psychology. In addition, Goldhaber traces Burge’s motives for dismissing disjunctivism: his underlying theoretical assumptions vis-à-vis human rationality virtually force him to maintain that there is a genuine inconsistency between disjunctivism and perceptual psychology. While Goldhaber aims to defend epistemological disjunctivism à la John McDowell, my concern will be the other target of Burge’s (...) attack, namely John Campbell’s (2002a, 2002b, 2011a) relationism. I will reexamine the Burge/Campbell debate concerning the role of perceptual psychology in theorizing about the nature of perception and the status of perceptual beliefs so that I can support Goldhaber’s stance that Burge’s plan to put the kibosh on disjunctivism backfires in the end. Finally, by using the challenge of cognitive penetrability, I show how Burge’s argumentation strategy can be turned against him. (shrink)

This essay identifies salient points of affinity and divergence in the monistic metaphysics and skeptical methodologies of the German idealist Hegel and the Indian Advaitin Śrī Harṣa. Remarkably, both Śrī Harṣa’s Khaṇḍanakhaṇḍakhādya (c. 1170) and Hegel’s Phänomenologie des Geistes (1807) attempt to defend a monistic standpoint exclusively by means of a sustained critique of non-monistic philosophical positions. I will argue, however, that Śrī Harṣa and Hegel diverge sharply in their specific views on the powers and limits of philosophy and on (...) the precise nature of monistic reality. In stark contrast to Hegel, Śrī Harṣa rejects the very possibility of a philosophical justification of monism, since he claims that the non-dual reality of Brahman lies beyond reason. Moreover, while Hegel drives a wedge between thought and empirical praxis, Śrī Harṣa insists that how we think and reason depends on the nature of our mind, which is itself conditioned by how we live. Os direitos subjetivos são direitos e, em primeiro lugar, dos homens. Mas os "homens" também não conseguiriam coligar muito bem as energias. Acreditamos cada vez menos na humanidade. As reivindicações proliferam porque são irredutivelmente singulares. Essa é a diferença que vale e importa. Como diz Marcel Gauchet: em oposição ao ideal democrático original (de Rousseau, por exemplo), em que se exigia de: [...] cada cidadão que se apropriasse do ponto de vista do conjunto a partir de seu próprio ponto de (...) vista, na nova configuração que se desenha o que prevalece é a disjunção, e que cada um faça valer sua particularidade diante de uma instância do geral do qual não se pede em nenhum momento que ele abrace o ponto de vista. (GAUCHET, 1998). O homem nunca aparece no horizonte de nossas mobilizações, porque está sufocado nas novas formas de fazer o nós. É verdade que o homem, a humanidade, o humanismo nunca se deram bem com as utopias. Nem com as utopias literárias nem com as utopias em ação. As primeiras se apoiavam em certa concepção do ser humano: bom em si mesmo, mas vivendo em comunidades políticas que precisavam ser refundadas. As utopias em ação se apoiavam em uma visão geral da humanidade na história (raça contra raça, classe contra classe), mas a revolução que conduziria à libertação e à saída da história deveria ser realizada no interior de um país, de uma nação ou de um povo, mensageiro do destino de toda a humanidade. Foi assim com o nazismo. O ariano é o Prometeu da humanidade [...]; ele sempre mostrou ao homem o caminho que deveria percorrer para tornar-se o mestre dos outros seres vivos sobre a terra; se o fizessem desaparecer, uma escuridão profunda desceria sobre a terra, em alguns séculos a civilização humana acabaria e o mundo se tornaria um deserto (HITLER, 1939). E preciso acabar com o humanismo e o cosmopolitismo. E partir a história humana ao meio: ela sempre foi a história da luta da raça ariana contra seus inimigos, em particular contra a raça judia. E necessário recorrer a uma solução final: livrar a terra para sempre dos judeus para finalmente assegurar o triunfo da raça ariana: a Alemanha é a detentora desse papel predestinado. Foi assim com o "socialismo real". Mais uma vez era necessário partir a história humana ao meio. Ela sempre foi a história da luta de classes: não pode mais haver classes. Desde sempre houve propriedade privada. Ela deve ser abolida. Mas o fim definitivo das classes e da propriedade deve passar primeiro pela exacerbação da luta de classes no interior de um país: o proletariado e o campesinato são herdeiros desse papel histórico. Assim, na época em que o marxismo era considerado um horizonte intelectual intransponível, e a revolução proletária era vista como o horizonte intransponível desse horizonte, "o homem" do "humanismo" era desprezado porque supunha uma unidade de essência além das comunidades verdadeiras, definidas em si mesmas por um antagonismo fundamental: antagonismo interno das classes (exploradoras/exploradas), antagonismo externo dos povos (opressores/oprimidos) ou das culturas (dominantes/minoritárias) etc. Não se podia conceber uma causa comum à humanidade nem preparar ou defender uma revolução hipotética dos humanos. E, além do mais, contra quem e contra o quê? "Não vejo homem", dizia-se após Marx, "vejo apenas operários, burgueses, intelectuais." O homem não era a medida de todas as coisas, o verdadeiro padrão de medida era menor: por exemplo, os burgueses ou os proletários. A humanidade, ou melhor dizendo, a realidade da história definia-se em um nível inferior. As utopias revolucionárias parecem ter abandonado o horizonte ideológico de nossa Modernidade. Em todo caso, as utopias políticas. Mas pode ser que nossa época ainda tenha o poder de conceber novas utopias. Pois não nos livramos delas tão facilmente. Expulsas pela porta da história, elas retornam pela janela da imaginação. Expulsas de nosso ideal político, serão pós-políticas. Podemos vislumbrar essas novas utopias revolucionárias nos dois traços que definem o contemporâneo, através da ambiguidade da expressão "direitos humanos". Se vivemos juntos apenas porque temos direitos e para termos mais direitos, então não temos nenhum motivo para imaginar uma salvação comum: a salvação não está no comum, mas no próprio. Por oposição ao Direito (em inglês, Law) que, impondo-se a todos de cima para baixo, normatiza objetivamente as relações entre cidadãos, há agora o império crescente dos direitos subjetivos (em inglês, rights) reivindicações particulares que tentam impor-se a todos de baixo para cima. Esses direitos costumam ser descritos como sendo (...) de dois tipos ou duas gerações. De um lado, há, ou houve em um primeiro momento depois da Revolução Francesa, o reconhecimento dos direitos-liberdades (direitos de fazer alguma coisa: ir e vir, associar-se, reunir-se, manifestar opiniões, praticar uma religião etc.); de outro lado, há, ou houve em um segundo momento depois da Segunda Guerra Mundial, os direitos sociais, os chamados direitos-créditos, os direitos ao beneficio de certa prestação da parte de um poder público (direitos a alguma coisa: educação, saúde, trabalho etc.). Eles se fundamentam em dois sentidos opostos da ideia de direitos. Os direitos-liberdades definem um território de igual independência de todos e cada um com relação às ingerências do poder público; os direitos-créditos definem um horizonte de expectativa de todos e cada um com relação às ações desse mesmo poder público. De um lado, impedem o Estado de agir em certas esferas de ação dos indivíduos; de outro, obrigam o Estado a agir em certas esferas a favor dos indivíduos. No entanto, do ponto de vista da perda do ideal de uma salvação comum, estes e aqueles vão no mesmo sentido. Tornamo-nos duplamente liberais. Liberais porque apreciamos viver em uma sociedade de liberdade igual, assegurando por direitos negativos a esfera de autonomia de cada um de nós. Liberais porque, gostando ou não, vivemos em uma sociedade de mercado e esperamos ações do Estado que corrijam os efeitos das desigualdades econômica e social gerados por esse sistema. Queremos um Estado que nos faça menos desiguais e ao mesmo tempo garanta nossa independência dele e dos outros. A demanda preocupada de menos injustiça substituiu mais uma vez a vontade do Bem. Em todos os lugares do mundo onde essas duas condições da autonomia individual (liberdades fundamentais e prestações sociais) não são satisfeitas, os povos aspiram a elas. Em muitos casos, a Cidade ideal desses povos é semelhante à nossa pobre Cidade real, que, no entanto, não nos satisfaz. Não tentamos mais nos realizar por e na comunidade política e não aspiramos mais a nos fundir nela. O que esperamos do Estado é que nos permita viver sem ele. É pelo fato de não acreditarmos mais no político que nossos sonhos tomam a forma lúcida e prosaica de demanda sem fim de novos direitos individuais. E pelo fato de não acreditarmos mais na Cidade justa, na Cidade e na Justiça, que multiplicamos os focos de reivindicação. Queremos não só mais direitos de (fazer) e mais direitos a (serviços), como queremos esses direitos a outros seres além de nós. Assim, há dois movimentos paralelos: de um lado, uma multiplicação de tipos de direitos (liberdades, mas sobretudo créditos); de outro, uma proliferação de detentores de direitos; em última instância, todo grupo de interesses real ou supostamente real é considerado um detentor de direitos. Em vez de ser outro nome para a igualdade de todos — o que eram originalmente —, os direitos se tornaram sinônimo de interesses particulares. Contra as desigualdades entre homens e mulheres, reivindicamos paradoxalmente os "direitos das mulheres"; contra os maus-tratos e a carência de educação, apelamos aos "direitos da criança"; contra as discriminações, defendemos os "direitos dos homossexuais"; contra a medicina invasiva, exigimos respeito aos "direitos dos doentes"; contra as falhas dos transportes públicos, reivindicamos o reconhecimento dos "direitos dos usuários" etc. O "direito ao trabalho" é invocado tanto pelo desempregado que exige do poder público que lhe dê emprego quanto pelo não grevista que exige acesso ao seu posto de trabalho, contrapondo-se aos piquetes. Exigimos do Estado que reconheça o direito dos fumantes de fumar e o dos não fumantes de não ser expostos à fumaça, o dos não crentes de blasfemar e o dos crentes de não ser ofendidos; queremos que o Estado conceda aos solteiros o direito aos filhos, e às crianças, o direito "a um papai e a uma mamãe". E, finalmente, onde antes se impunham deveres morais ou normas jurídicas, hoje surgem inesperados beneficiários putativos de novos direitos: as culturas autóctones, os animais, os robôs, a Natureza, a biosfera, a Terra- mãe etc. — de tal forma a palavra "direito" se tornou mobilizadora e coligadora de energias em torno de uma causa, graças à sua extraordinária ambiguidade (Vantagem? Habilitação? Permissão? Privilégio? Não ingerência? Poder? Reivindicação? Imunidade?). Tudo isso, no fundo, é prazeroso e marca a vitória (para nossa infelicidade, geograficamente parcial e socialmente frágil) da autonomia individual sobre a onipotência dos Estados, as sociedades fechadas, as culturas fusionais ou os integrismos religiosos. A filosofia do direito internacional de Hegel tem recebido certa atenção nos últimos anos. As pesquisas mais recentes têm buscado apresentar uma visão diferente daquela, apresentada no século XIX e primeira metade do século XX, que retratava Hegel como um entusiasta do estado de guerra. Com efeito, também se passou a reavaliar a relação de Hegel com Kant no que diz respeito às questões do direito internacional, sobretudo, a possibilidade da paz. Meu objetivo nesse artigo é, primeiramente, apresentar os aspectos (...) gerais da filosofia do direito internacional de Hegel, enfatizando seu diálogo com Kant. Tento mostrar como Hegel está, em sua discussão, em referência a importantes aspectos do texto kantiano sobre a paz perpétua. Em segunda instância, partindo desse diálogo, argumento que, embora Hegel seja certamente muito mais um crítico do projeto kantiano do que um simpatizante, as implicações últimas de seu pensamento mostram-se, em alguma medida, alinhadas com as da filosofia de Kant. Meu objetivo neste texto é apresentar uma resposta cética ao argumento ontológico tal como aparece em algumas de suas principais variações. O que todas essas variações têm em comum é tentar provar a existência de Deus a priori. Sustentarei que o sucesso de qualquer argumento desse tipo depende de dois pressupostos fundamentais, o primeiro é que existência é uma propriedade e o segundo que é uma perfeição. Mesmo aceitando que existência seja uma propriedade, recusarei que possamos saber se ela é (...) uma perfeição e, portanto, que possamos saber se devemos atribuí-la a um ser perfeito. Serão trabalhadas quatro formulações diferentes desse argumento, começando por Anselmo, Descartes, e a formulação que Norman Malcom acredita haver em Anselmo. Por fim, considerarei a versão de Alvin Plantinga, que defende o argumento ontológico sem sustentar que existência é uma perfeição. Sustentarei que seu argumento falha em provar que Deus existe, pois é inválido. (shrink)

This paper deals with prolegomenal stances necessary for a proper understanding of the paradoxical nature of Heidegger’s Being and Time. It shall be argued that Heidegger’s magnum opus does not inquire into the sense of being in order to render an answer to the so called Seinsfrage. In fact, several answers have already been given traditionally, which are founded on the being/entity indifferentiation (being as God, substance, nature, subject and so forth), that is, being has been turned into a topic, (...) whilst it is essentially non-topical, for only an entity can be accounted for as topical or thematic. This is the reason why assessing Heidegger as the “thinker of being” can be misleading, if not overtly wrong, when by this is meant that being be conceived of as something that can be thematized.
