The study is focused on analysing formalism which is a strategy of applying laws by stressing the formal features of the law, even if the consequences of the strategy like that are difficult to accept in light of legal principles and the general requirement of equity. Contrary to the common view presented in the legal literature, the study sets out arguments that the formalism is neither justified in the tradition of legal positivism, neither in the idea of the rule of (...)

Metaphysics and psychology are two of Brentano’s main areas of interest in philosophy. His first writings, the dissertation On the Several Senses of Being in Aristotle (1862) and the habilitation thesis, The Psychology of Aristotle (1867), bear witness to the duality of his concerns. As such, these works were not only significant contributions to the German Aristotelianism of the second half of the XIXth century, but they also played an important role in the development of Brentano’s later philosophy and in (...)

This article explores the use of model organisms in studying the cognitive phenomenon of decision-making. Drawing on the framework of biological control to develop a skeletal conception of decision-making, we show that two core features of decision-making mechanisms can be identified by studying model organisms, such as E. coli, jellyfish, C. elegans, lamprey, and so on. First, decision mechanisms are distributed and heterarchically structured. Second, they depend heavily on chemical information processing, such as that involving neuromodulators. We end by discussing (...)

However, such algorithmic decision systems can have prevalent biases against marginalized social groups and undermine social justice. The movement called Experimental Philosophy (‘x-Phi’) has now passed its tenth anniversary. Its central insight is compelling: When an argument hinges on accepting certain ‘facts’ about human perception, knowledge, or judging, the evoking of relevant intuitions by thought experiments is intended to make those facts seem obvious. But these intuitions may not be shared universally. Experimentalists propose testing claims that traditionally were intuition-based using real experiments, with real samples. Demanding that empirical claims be empirically supported is certainly reasonable; though experiments (...)

The main finding in our study is that, while we may assume that everyone understands these concepts and their relationship in the same way, this assumption may be unwarranted. For example, we may assume that if ‘x is y’s father’, it follows that ‘y is x’s child’. However, the participants in our study did not necessarily agree that it does follow. This (...)

But if perceptual representation is probabilistic, why doesn't normal conscious perception reflect the full probability distributions that the probabilistic point of view endorses? For example, neurons in MT/V5 that respond to the direction of motion are broadly tuned: a patch of cortex that is tuned to vertical motion also responds to horizontal motion, but when we see vertical motion, foveally, in good conditions, it does not look at all (...)

I develop and defend the view that subjects are necessarily psychologically able to revise their beliefs in response to relevant counter-evidence. Specifically, subjects can revise their beliefs in response to relevant counter-evidence, given their current psychological mechanisms and skills. If a subject lacks this ability, then the mental state in question is not a belief, though it may be some other kind of cognitive attitude, such as a supposition, an entertained thought, or a pretense. The result is a moderately revisionary (...)

  44. If P, Then P!Matthew Mandelkern - 2021 - Journal of Philosophy 118 (12):645-679.
The Identity principle says that conditionals with the form 'If p, then p' are logical truths. Identity is overwhelmingly plausible, and has rarely been explicitly challenged. But a wide range of conditionals nonetheless invalidate it. I explain the problem, and argue that the culprit is the principle known as Import-Export, which we must thus reject. I then explore how we can reject Import-Export in a way that still makes sense of the intuitions that support it, arguing that the differences between (...)

If Nudges Treat their Targets as Rational Agents, Nonconsensual Neurointerventions Can Too.Thomas Douglas - 2022 - Ethical Theory and Moral Practice 25 (2):369-384.
Andreas Schmidt and Neil Levy have recently defended nudging against the objection that nudges fail to treat nudgees as rational agents. Schmidt rejects two theses that have been taken to support the objection: that nudges harness irrational processes in the nudgee, and that they subvert the nudgee’s rationality. Levy rejects a third thesis that may support the objection: that nudges fail to give reasons. I argue that these defences can be extrapolated from nudges to some nonconsensual neurointerventions; if Schmidt’s and (...)

  46. Fearing Spouses in Aristotle's Ta Oikonomika.Daniel Nolan - 2010 - British Journal for the History of Philosophy 18 (1):1-8.
The work which the Loeb Classical Library classifies as book 3 of the Oikonomika attributed to Aristotle is a curious piece. It has come down to us only via medieval translations into Latin. (I will be quoting the Loeb text and translation except where noted.) It is not certain that it is by Aristotle: and it is not certain whether it is even a part of the work attributed to Aristotle in ancient times. For want of a better name, let (...)

  47. If We Can’t Tell What Theism Predicts, We Can’t Tell Whether God Exists: Skeptical Theism and Bayesian Arguments from Evil.Nevin Climenhaga - forthcoming - Oxford Studies in Philosophy of Religion.
According to a simple Bayesian argument from evil, the evil we observe is less likely given theism than given atheism, and therefore lowers the probability of theism. I consider the most common skeptical theist response to this argument, according to which our cognitive limitations make the probability of evil given theism inscrutable. I argue that if skeptical theists are right about this, then the probability of theism given evil is itself largely inscrutable, and that if this is so, we ought (...)

  48. If Anyone Should Be an Agent-Causalist, then Everyone Should Be an Agent-Causalist.Christopher Evan Franklin - 2016 - Mind 125 (500):1101-1131.
Nearly all defences of the agent-causal theory of free will portray the theory as a distinctively libertarian one — a theory that only libertarians have reason to accept. According to what I call ‘the standard argument for the agent-causal theory of free will’, the reason to embrace agent-causal libertarianism is that libertarians can solve the problem of enhanced control only if they furnish agents with the agent-causal power. In this way it is assumed that there is only reason to accept (...)

  49. And If It Takes Lying: The Ethics of Blood Donor Non-Compliance.Kurt Blankschaen - 2021 - Kennedy Institute of Ethics Journal 31 (4):373-404.
Sometimes, people who are otherwise eligible to donate blood are unduly deferred from donating. “Unduly” indicates a gap where a deferral policy misstates what exposes potential donors to risk and so defers more donors than is justified. Since the error is at the policy-level, it’s natural and understandable to focus criticism on reformulating or eliminating the offending policies. Policy change is undoubtedly the right goal because the policy is what prevents otherwise safe eligible donors from donating needed blood. But focusing (...)

  50. What if every subconscious brain module is really an independent consciousness?Robert Vermeulen - manuscript
What if subconscious brain processes are actually independent consciousnesses, each resembling an independent advisor whispering advice to the main consciousness, or “I”? This multi-consciousness model would support free will, as our choices are informed by other consciousnesses, not the subconscious. Each independent consciousness allows a movable perspective through its rich representation of the world and constantly seeks harmony and resonance between its internal concepts, other consciousnesses, external reality, and the genetic worm hole to the evolutionary past.
