Global challenges such as climate change, food security, or public health have become dominant concerns in research and innovation policy. The EDPS Ethics Advisory Group (EAG) has carried out its work against the backdrop of two significant social-political moments: a growing interest in ethical issues, both in the public and in the private spheres and the imminent entry into force of the General Data Protection Regulation (GDPR) in May 2018. For some, this may nourish a perception that the work of the EAG represents a challenge to data protection professionals, particularly to lawyers in the field, as well as to companies (...) struggling to adapt their processes and routines to the requirements of the GDPR. What is the purpose of a report on digital ethics, if the GDPR already provides all regulatory requirements to protect European citizens with regard to the processing of their personal data? Does the existence of this EAG mean that a new normative ethics of data protection will be expected to fill regulatory gaps in data protection law with more flexible, and thus less easily enforceable ethical rules? Does the work of the EAG signal a weakening of the foundation of legal doctrine, such as the rule of law, the theory of justice, or the fundamental values supporting human rights, and a strengthening of a more cultural approach to data protection? Not at all. The reflections of the EAG contained in this report are not intended as the continuation of policy by other means. It neither supersedes nor supplements the law or the work of legal practitioners. Its aims and means are different. On the one hand, the report seeks to map and analyse current and future paradigm shifts which are characterised by a general shift from analogue experience of human life to a digital one. On the other hand, and in light of this shift, it seeks to re-evaluate our understanding of the fundamental values most crucial to the well-being of people, those taken for granted in a data-driven society and those most at risk. The objective of this report is thus not to generate definitive answers, nor to articulate new norms for present and future digital societies but to identify and describe the most crucial questions for the urgent conversation to come. This requires a conversation between legislators and data protection experts, but also society at large - because the issues identified in this report concern us all, not only as citizens but also as individuals. They concern us in our daily lives, whether at home or at work and there isn’t a place we could travel to where they would cease to concern us as members of the human species. (shrink)

Neste artigo, pretendo oferecer algumas razões para se dizer que Aristóteles sustenta a tese de que a εὐδαιμονία não apenas oferece o critério normativo que orienta a instituição e a reforma de regimes que estão aquém do melhor regime, como também é aquilo que é visado pela instituição e pela reforma destes regimes, pois o melhor regime não é, para Aristóteles, senão o regime no qual a εὐδαιμονία pode ser alcançada em máximo grau (cf. Pol. VII.13 1332a4-7).

El presente ensayo fue publicado por su amigo ı́ntimo y editor Richard Royston mientras el autor vivı́a en 1652 y republicado en la emergencia sucedida por la fama de Patriarcha a partir de 1679. Las Observaciones... es un ensayo derivado del Patriarcha en los que reelabora y afirma sus comentarios sobre Aristóteles; se establecen ası́ numerosas citas y argumentos paralelos entre los dos textos, sobre todo en los capı́tulos IX, XI, XV, pero en especial en el XII del Patriarcha. Sin embargo, puede hacerse notar otra división. En primer lugar, desde 90-119 se ocupará de investigar sobre los términos aristotélicos; y en segundo lugar, desde 120-150, en refutar la tesis de Jean Bodin que establecı́a que el pueblo romano tuvo un gobierno popular, con el fin de evidenciar la imposibilidad de existencia de cualquier forma de gobierno a excepción de la monárquica, para concluir con una extensa cita del mismo Bodin a favor de la tesis central de Filmer. The main thesis of this book is one which the author acknowledges to be scandalous in the eyes of many contemporary philosophers: our rationality has the capacity to achieve direct knowledge of independent reality. This thesis implies a critique of what Pols calls the "linguistic consensus," according to which all human knowledge is mediated by "language-cum-theory." More importantly, this thesis subserves Pols' constructive purpose in this book: to draw attention to our direct rational awareness of independent reality, and (...) to develop some important epistemological and metaphysical implications of such awareness. Es un lugar común afirmar que Hannah Arendt es una filósofa difı́cilmente encasillable en una sola tradición polı́tica. Menos arduo es advertir la gran influencia que ha ejercido el mundo grecolatino a lo largo de su filosofı́a. La polis griega y la república romana son imágenes recurrentes para ilustrar instancias donde se ha ejercido con plenitud la polı́tica. Aunque es patente la influencia de los clásicos en su filosofı́a, existe un elemento ausente que es, no obstante, ampliamente trabajado por los (...) antiguos: la virtud. Por lo anterior el presente trabajo se propone explorar los vı́nculos que existen entre una doctrina de la virtud y la filosofı́a polı́tica de Arendt, tratando de responder la siguiente pregunta: ¿cómo se relaciona la virtud con el ejercicio de la libertad? Se concluye que, si bien Arendt no trabaja un concepto de virtud, esta puede asimilarse al concepto de principio, tal como lo expone en su ensayo Revisión de la Tradición por Montesquieu. Además, el ejercicio de virtudes polı́ticas particulares, como la valentı́a y la prudencia, son prácticas que protegen la libertad. (shrink)

Za „ojca” filozoficznej kategorii „godności”, która legła u podstaw kategorii prawnej, uznawany jest powszechnie Immanuel Kant. Przypomnieć jednak trzeba, że w bardzo podobny sposób, choć w zasadniczo odmiennym kontekście systemowym, charakteryzował godność Tomasz z Akwinu, pół tysiąca lat wcześniej, uznając ją za fundament bycia osobą. Stąd najistotniejszym i centralnym elementem, tytułowej, klasycznej koncepcji człowieka jest koncepcja godności. Akwinata jest autorem bodaj najbardziej rozbudowanej koncepcji osoby w tradycji filozofii klasycznej. Co więcej zmierzać będę do wykazania, że jego koncepcja lepiej nadaje się (...) do teoretycznego ugruntowania praw człowieka niż koncepcja Kanta. Rekonstruując propozycję Kanta ograniczam się, zasadniczo rzecz biorąc, do analizy Uzasadnienia metafizyki moralności. Interesować będą mnie zagadnienia podstawowe, przede wszystkim – wynikające z różnicy kontekstów systemowych – różnice w pojmowaniu bycia celem samym w sobie. W perspektywie ontologicznej koncentrować się będę na powiązaniu godności z indywidualnością; w perspektywie antropologicznej – na tym, jakiego typu działania stanowią o doskonałości człowieka, jakie działania (czym określone) realizują człowieka jako cel sam w sobie. W szczególności interesować się będę miejscem rozumu i woli w określaniu treści działań (w perspektywie kantowskiej będzie to pytanie o określenie treści powinności; w perspektywie Tomasza – pytanie o treść realizowanego dobra). Zasadnicze pytanie, które leży u podłoża podjętej problematyki antropologicznej, jest pytaniem o to, na ile dla pojmowania godności istotne jest uznanie woli jako w sposób wolny współokreślającej treść powinności (Kant) lub dobra (Akwinata), a na ile woli jedynie podążającej za poznaną powinnością lub poznanym dobrem. Zmierzać będę do uzasadnienia tezy, że koncepcja Akwinaty w ugruntowaniu godności akcentuje wprost indywidualność opartą na wyborze czegoś, co nie jest jednoznacznie treściowo obiektywnie zdeterminowane i co wykracza poza to, co powszechne, poza to, co gatunkowe; natomiast koncepcja Kanta godność wiąże przede wszystkim z tym, co powszechne, gatunkowe i zapoznaje doniosłość indywidualności dla pojmowania godności. El estallido social en Chile desafı́a a las humanidades a abordar un fenómeno social inédito por sus formas, a través de un ejercicio reflexivo situado más allá de las tomas de posición en el debate público. Si bien, ha habido un sinnúmero de académicos del espectro nacional que han asumido posturas claras en esta coyuntura, las respuestas y justificaciones contingentes dejan incólumes otras dudas sobre cuestiones de principio. Sabı́amos que Chile vivı́a en una democracia de baja intensidad, con instituciones ancladas (...) al orden constitucional diseñado durante la dictadura cı́vico-militar y continuado por los gobiernos democráticos, con enormes áreas institucionales corrompidas por el fuero de la impunidad, con una clase polı́tica acostumbrada a los privilegios y bajo un modelo estructuralmente desigual en lo económico, social y cultural. Sabı́amos que todo lo anterior, en alguna medida, fue horadando las bases de las instituciones democráticas. Por eso, para muchos, las protestas que comenzaron en octubre son la continuidad de un dilatado proceso de acumulación del malestar que, debido a lo agudas de sus causas, tardaron más de lo que muchos imaginaron en llegar. Aristotle’s Politicsis not only famous for its theory of constitutions, but for its statements about human nature. According to the central claim of Aristotle’s political anthropology, man is by nature a political animal (phusei politikon zôon). This famous statement is presented as the conclusion of the first set of arguments that Aristotle develops in the second chapter of book I of the Politics(Pol.,I, 2, 1252a24–1253a3). Aristotle’s statement is inextricably linked with the claim that the polisexists by nature (phusei), which he (...) mentions in the same phrase, as part of his conclusion: “From these considerations it is evident that the polisis one of the things that exist by nature, and that man is by nature a political animal”(Pol.,I, 2, 1253a1–3). Evidently, the claims that the polisexists by nature and that man is by nature a political animal are complementary. This article presents an interpretation of the two complementary claims or theses arguing that in Pol.,I, 2 Aristotle conceives exclusively of human beings as political animals because the whole chapter focuses on theanalysisof the polis,a community peculiar to humans. Italso examines Aristotle’sclaim that the polis“is by nature prior (proteron) to the household and to the individual”(Pol.,I, 2, 1253a18–19). The paperdisagrees withscholars whounderstand this claim as an independent third thesis and theoremand argues that Aristotle’s claim functions as a strong argument for the thesis that man is by nature a political animal. Przed skomentowaniem książki, oferuję uwagi na temat Wittgenstein i Searle i logicznej struktury racjonalności. Eseje tutaj są w większości już opublikowane w ciągu ostatniej dekady (choć niektóre zostały zaktualizowane), wraz z jednym niepublikowanym elementem, i nic tutaj nie będzie zaskoczeniem dla tych, którzy nadążyli za jego pracą. Podobnie jak W, jest uważany za najlepszego filozofa standupu swoich czasów, a jego twórczość pisemna jest solidna jak skała i przełomowa w całym. Jednak jego brak podjęcia później W wystarczająco poważnie prowadzi do pewnych (...) błędów i zamieszania. It is argued (a) that laws are assurances of protections of rights and (b) that governments are protectors of rights. Lest those assurances be empty and thus not really be assurances at all, laws must be enforced and governments must therefore have the power to coerce. For this reason, the government of a given region tends to have, as Max Weber put it, a "monopoly on power" in that region. And because governments are power-monopolizers, it is tempting to think that (...) the concepts of government and law are to be understood in terms of the concept of power. In actuality, the first two concepts are to be understood primarily in terms of the concept of morality--of rights-protection, to be specific--and only secondarily in terms of the concept of power. Contentions (a) and (b) appear to be inconsistent with obvious facts (e.g. the fact that Pol Pot's regime violated the rights of those over whom it had power). But (a) and (b) are compatible with those facts. This is a consequence of two principles. First, moral requirements have a "dimension of weight," as Dworkin put it, meaning that one moral imperative can be outweighed, without being obliterated, by another moral imperative. Second, sentential operators can have different degrees of scope. "It is hereby assured that" is such an operator. Linguistic surface structure may obfuscate the degree of scope that it has in a given sentence. That fact compatibilizes our analysis with the fact that there are evil laws and evil governments. This paper aims to elucidate the case of the vulgar craftsmen who are excluded from the citizen body, a case which evidently challenged Aristotle’s conception of citizenship, as we find it presented in Pol. III,5. I argue that Aristotle’s exclusion of vulgar craftsmen from citizenship in his best city, based on their habits, activities, and ways of life, lacks justification, even when evaluated against his own criteria.

At least since Foster (2002), scholars interested in Aristotle’s views about environmental ethics have focused primarily upon his teleological account of non-human animals as the basis for an Aristotelian environmental virtue ethics. But although Aristotle’s scientific account of non-human animals can serve as the basis for a form of environmental ethics akin to “nature preservation,” one finds in his account of “household management” (or oikonomikē) a very different sort of environmental ethic, one that looks much more like a form of (...) “nature conservation.” My paper argues that for Aristotle, oikonomikē is indeed both “environmental” and an “ethic.” The first part of my chapter shows that oikonomikē is fundamentally environmental insofar as it concerns what Aristotle in Politics 1.8 calls “property acquisition in accord with nature” or “true wealth” (Pol. 1.8.1256b26–27, 30–31), namely the prudential use of natural resources in a way that recognizes the dependence of ways of life upon different habitats or environments. The second part of my chapter shows that oikonomikē is also an “ethic” insofar as it embeds three different kinds of limit on the use of animate and inanimate natural resources, namely that natural resource use is subordinate to expertise about the happiness of the political community (or what Aristotle calls “politics” [πολιτική]); that natural resource use, as an instrumental good, is limited and governed by the craft or expertise of oikonomikē; and that notions of unlimited commercial “wealth acquisition” (χρηματιστική) are based on ethically problematic ways of life. After showing that Aristotle’s account of oikonomikē is indeed an environmental ethic, the third part of my chapter considers the objection that oikonomikē is a weak environmental ethic insofar as it is exploitatively or axiological anthropocentric. I respond that Aristotle’s account of non-human animal domestication provides conceptual resources for thinking about non-human animals as subordinate members in one’s ecological-political community, especially with respect to his invocation of the craft analogy (in the example of shepherds) and inter-species utility friendships. Although Aristotle has multiple sources relevant for understanding environmental ethics, his account of oikonomikē is both a neglected source and a potentially fruitful one. (shrink)

In this short article, my aim is to introduce readers to some debates about religious freedom and constitutional law in the United States. I highlight a few of the enduring questions debated by political philosophers and legal scholars. For example, does the Constitution require special religious exemptions for citizens whose religious convictions put them at odds with otherwise neutral and legitimate state pol- icy? Should the Constitution be interpreted as supporting a strict secularism or a multicultural egalitarian liberal position? What (...) are the limits to religious freedom? To illustrate how these and related questions are debated I consider some recent work on religious freedom jurisprudence in the United States. (shrink)

My chapter explores Aristotle’s account of Greek democracy in three parts. The first part examines the notion of democracy taxonomically, namely as a kind of political organization that Aristotle classifies as a deviant politeia that admits of a number of species that are differentiated by the socio-economic classifications of its people (or δῆμος). The second part provides an overview of Aristotle’s historical remarks on prominent subjects of Athenian democracy in the Politics (Pol.) and the Athenian Constitution (Ath. Pol.) and then (...) focuses on his analysis of the political reforms that Solon introduced to Athens in the early 6th century, a form of political organization that Aristotle characterizes as the “ancestral democracy” (δημοκρατίαν τὴν πάτριον [Pol. 2.12.1273b38]). I argue that Aristotle judges Solon’s reforms—specifically, assigning to the people the roles of electing and auditing magistrates, but limiting their access to the very offices of a magistrate—as a pre-eminent solution to the problem of democratic participation. Finally, in the third part of my chapter I examine Aristotle’s evaluation of democracy both in terms of its notion of democratic justice but also in terms of its relative stability. I argue that the features of moderate democracy and polity are very similar to those of the Solonian politeia, which further supports my claim that Aristotle views Solon as a pre-eminent democratic theorist of ancient Greece. Introduction: the neuroscientific turn in political science The observation that brains and political orders are interdependent is almost trivial. Obviously, political orders require brain processes in order to emerge and to remain in place, as these processes enable action and cognition. Conversely, every since Aristotle coined man as “by nature a political animal” (Aristotle, Pol.: 1252a 3; cf. Eth. Nic.: 1097b 11), this also suggests that the political engagements of this animal has likely consequences for its natural development, including the (...) development of its psychological functions. Given these mutual interdependencies, it is remarkable that only since the 1960s, the more general domain of ‘biopolitics’ has attracted attention though first particularly in the form of behavioral politics (Alford and Hibbing). Since then biopolitics has gained in interest, so much so that different subdomains can be identified. Indeed, a 2008 review of the field of biopolitics identified five ‘headings’ of it: “(1) the case for a ‘more biologically oriented political science’, (2) ‘biologically related’ public policy issues, (3) physiological measures of political attitudes and behaviour, (4) the influence of physiological factors on actual political behaviour, and (5) the manner in which our species’ evolutionary history has left homo sapiens genetically endowed with certain social and political behavioural tendencies” (Somit and Peterson 43). Striking is how the relation between biology and politics is taken here in a rather unidirectional way, emphasizing particularly the decisive power of biology upon politics. The reverse relation is not mentioned specifically, reflecting the field of biopolitics, perhaps until quite recently. This absence of studies of political influences on our biology may have to do with the difficulty in investigating such influences. Empirical studies in biopolitics have two foci, broadly speaking: genetics and the brain, both of which have turned out to be complex and dynamic phenomena (Alford and Hibbing). Yet the studies of genetics and brain processes have made much progress in the last few decades, thanks to the development of research instruments - like fMRI brain scanners and TMS brain stimulation instruments - and of computational tools for data analysis and the simulation of explanatory models. For the field of biopolitics it is particularly relevant that within cognitive neuroscience the study of social and political issues has witnessed an increasing interest of researchers even more recently. Indeed, aware of the enabling and mediating role of the brain regarding those issues, a truly ‘neuroscientific turn’ can be observed in the social sciences, testified for example by the emergence of the field of ‘neuropolitics’ (Connolly; Vandervalk). Developing a systematic neuropolitics or biopolitics in general is a difficult challenge because of the wealth of causal influences on and interdependencies between biological, brain, cognitive and socio-political factors. Taking a somewhat more abstract perspective, this paper focuses on the process of emerging complexity in adaptive systems, enabling those to conduct ever more complex processes. Yet, parallel to that development can be observed that such systems, or organisms, are also capable in reducing the complexity of the information they are to process. Once they’re capable of developing and adjusting such compressed and complex representations of information, those systems or organisms can handle more information faster and more efficient and adaptive, yielding important benefits to the organism in navigating its environment (Halford, Wilson and Phillips). Before focusing on the role of narrative as a cognitive strategy for such a reduction of informational complexity, I will discuss the development of stable structures and increasing complexity in dynamic systems. Such a more general perspective prepares our discussion of the structures of both narratives and politics and in doing so contributes to the explanation of their interaction. (shrink)

In this article, I present an interpretation of Aristotle’s thought regarding the normative value of friendship duties.The argument is divided in VII sections. In Section I, I provide brief summaries of the main arguments defended by me in a previous article about the normative consequences of virtue and utility friendships in Aristotle, the objectives that are to be defended in this article and of the conclusions that I take them to support. In section II, I offer an interpretation of Aristotle’s (...) thought regarding the normative value of friendship duties in cases where there is no practical conflict between friendship duties. In section III, I outline Aristotle’s theory about how we should deal with cases where there is such practical conflict. In the next sections, I analyze three other passages of the Aristotelian corpus where we have good reason to think that this kind of conflict appears, namely, NE, III 1, 1110a20-29 (IV), Pol., III 10, 1286b23-28 (V) and Pol., VII 9, 1330a9-25 (VI), in order to flesh out the outline presented in section III. Mass media, także i w Republice Federalnej Niemiec, zyskują coraz większe znaczenie w informowaniu i funkcjonowaniu społeczeństw. Najstarszym środkiem masowego przekazu społecznego jest prasa. Pierwsze gazety na świecie zostały wydane na początku XVII w. w Wolfenbiittel i Strasburgu, a więc na ówczesnych terenach niemieckich. Nosiły one tytuły: "Aviso" i "Relationen". Aktualnie wydaje się w Niemczech 30 milionów egzemplarzy prasy codziennej (w ogólnym nakładzie). Zwiększa się także liczba gazet zawierających programy telewizyjne oraz czasopism kobiecych. Mediami XX w. są niewątpliwie radio i (...) telewizja. Pierwsze audycje radiowe były nadawane w Niemczech w roku 1923. Nowy wynalazek zyskał wkrótce duże uznanie i już w rok później w Niemczech było zarejestrowanych ponad pół miliona odbiorników. Aktualnie w RFN działa ok. 11 radiostacji publicznych i ponad 200 prywatnych. Powstanie prywatnych stacji radiowych i telewizyjnych było możliwe dzięki rozwiązaniom technologicznym lat osiemdziesiątych. Telewizja była znana już przed II wojną światową. W roku 1935 były nadawane regularne audycje telewizyjne w Niemczech. W rok później telewizja niemiecka transmitowała igrzyska olimpijskie, które odbywały się wtedy w Berlinie. Po II wojnie światowej stworzono w RFN dwie publiczne stacje telewizyjne: ARD (1954) i ZDF (1963). Od połowy lat osiemdziesiątych poważną konkurencją dla publicznych stacji telewizyjnych jest telewizja prywatna, która przekazuje swoje programy za pośrednictwem transmisji satelitarnych i łączy kablowych. Do najbardziej znanych niemieckich stacji telewizji prywatnej, odbieranych także i w Polsce należą: RTL i SATl, a także Pro Sieben, Vox, RTL2, Premiere, Viva itd. Przyszłość elektronicznych mediów audiowizualnych, nie tylko w RFN, ale także i w innych krajach jest ogromna i rozwija się niezwykle intensywnie i dynamicznie, zaspokajając głównie potrzeby ludyczne społeczeństw. This paper examines Aristotle’s two famous claims that man is by nature a political animal, and that he is the only animal who possesses speech and reason (logos). Aristotle’s thesis that man is by nature a political animal is inextricably linked with his thesis that the polis exists by nature. This paper examines the argument that Aristotle develops in Pol. I. 2 to support these two theses. It argues a) that the definition of man as an animal who possesses logos (...) is part of this argument, b) that in the chapter Aristotle understands the term “political animal” not in a broad biological sense but in a narrow sense, c) that Aristotle’s thesis that the polis is “by nature prior to the household and to the individual” is not an independent third theorem – as David Keyt and Fred D. El objetivo de este artı́culo es desarrollar un enfoque para la comprensión de las crisis sociales basado en la “tragedia de los comunes” (TDC), centrada principalmente en sus interpretaciones en la teorı́a de juegos. Al analizar las principales interpretaciones de la TDC, lo que se observa, en primer lugar, es una caracterización del ambiente idóneo para la crisis sociales y, en segundo lugar, la existencia de una lógica con los siguientes elementos: (1) Las decisiones de individuos en contextos de interacción (...) social; (2) La existencia de mecanismos polı́ticos; (3) La existencia de mecanismos sociales. Con estos elementos a la vista lo que sostengo es que contra la idea general de la TDC, los comunes pueden llevar a cabo medidas para enfrenar la crisis por sı́ mismo (en este caso el factor relevante para resolver el problema es la cooperación). Sin embargo esto se encuentra supeditado a factores que exceden a los modelos aquı́ considerados. Además, dada la naturaleza del problema, una idea que se deriva del análisis desarrollado en este artı́culo es que no siempre basta con establecer acuerdos cooperativos para resolver una crisis, ni que todo acuerdo siempre es la mejor opción. Law is a main source of justice in a democratic society, and as such it must send clear and unequivocal messages to its addressees. Therefore, the question of the meaning in the legal vocabulary does not lose its relevance and universality. The present study examines the question of the linguistic significance of legal norms in legal vocabulary, applying an interdisciplinary approach. Joining the thesis that the legislation can be considered as an expression of the legally significant will of the rule-making (...) authority, the legal provisions will be presented as an intentional act. In search of the most appropriate explanatory method, two kinds of theories will be applied in parallel: Paul Grice's theory of linguistic meaning, on the one hand, and some theories with both textualist and intentionalist orientation, on the other. Subsequently, the communicative maxims proposed by Grice will be related to selected normative requirements related to the language of the normative acts. (shrink)

“The law is reason free from passion.” Thus spoke Harvard Law School Professor Stromwell in the 2001 film Legally Blonde, quoting Aristotle in his Politics (Pol 3.16.1287a33, in Ross 1957). Although a single shout-out to Aristotle in a popular film does not prove a resurgence of neo-Aristotelian jurisprudence in the academy, it does illustrate the pitfalls we face in a culture that traffics in meme quotations risibly attributed to great minds. Thus, George Duke is to be commended for showing why, (...) although there is a sense in which Aristotle believes that law is reason free from passion, things are more complicated than that. Duke argues that Aristotle’s seemingly dispersed statements on law and legislation are unified by a commitment to law’s status as an achievement of practical reason, and his book provides a systematic exposition of the significance and coherence of Aristotle’s account of law and indicates the relevance of this account to contemporary legal theory. Aristotle's Politics claims that the polis or city-state "exists by nature" (Pol. 1.2.1252630). Thinkers as diverse as Marsilius of Padua, Thomas Hobbes, and Martha Nussbaum have struggled with how to interpret such a claim-some finding in it a salutary alternative to existing political theories, others finding in it the basis of deeply wrong-headed political thinking. Przed skomentowaniem książki, oferuję uwagi na temat Wittgenstein i Searle i logicznej struktury racjonalności. Eseje tutaj są w większości już opublikowane w ciągu ostatniej dekady (choć niektóre zostały zaktualizowane), wraz z jednym niepublikowanym elementem, i nic tutaj nie będzie zaskoczeniem dla tych, którzy nadążyli za jego pracą. Podobnie jak W, jest uważany za najlepszego filozofa standupu swoich czasów, a jego twórczość pisemna jest solidna jak skała i przełomowa w całym. Jednak jego brak podjęcia później W wystarczająco poważnie prowadzi do pewnych (...) błędów i zamieszania. This essay is about the relationship between the notions of practical reason, the will, and choice in Kant’s practical philosophy. Although Kant explicitly identifies practical reason and the will, many interpreters argue that he cannot really mean it on the grounds that unless they are distinct, irrational and, especially, immoral action is impossible. Other readers affirm his identification but distinguish the will from choice on the same basis. We argue that proper attention to Kant’s conception of practical reason as a (...) capacity reveals that these distinctions are neither textually grounded nor philosophically necessary. His moral psychology concerns a single capacity, practical reason, which is the will, and whose actualities in this or that individual fall under the title of choice. Practical reason is the will and choice because it is the rational faculty of desire: a rational being’s capacity to be, by means of her representations, the cause of the actuality of their objects. This, we argue, is entailed by his conception of rational action: action not just in accordance with, but in and through the representation of, principles. The possibility of irrational action is explained not by a distinction between capacities but by the finitude, and thereby the fallibility, of human reason. (shrink)

The central focus of this paper is to motivate and explore the question, when is it permissible to endorse a psychologizing explanation of a sincere interlocutor? I am interested in the moral question of when (if ever) we may permissibly dismiss the sincere reasons given to us by others, and instead endorse an alternative explanation of their beliefs and actions. I argue that there is a significant risk of wronging the other person, and so we should only psychologize when we (...) are in a position to know that they are in bad faith. (shrink)

Five aspects of visual change detection are reviewed. The first concerns the concept of change itself, in particular the ways it differs from the related notions of motion and difference. The second involves the various methodological approaches that have been developed to study change detection; it is shown that under a variety of conditions observers are often unable to see large changes directly in their field of view. Next, it is argued that this “change blindness” indicates that focused attention is (...) needed to detect change, and that this can help map out the nature of visual attention. The fourth aspect concerns how these results affect our understanding of visual perception—for example, the implication that a sparse, dynamic representation underlies much of our visual experience. Finally, a brief discussion is presented concerning the limits to our current understanding of change detection. (shrink)

Reichenbachian approaches to indexicality contend that indexicals are "token-reflexives": semantic rules associated with any given indexical-type determine the truth-conditional import of properly produced tokens of that type relative to certain relational properties of those tokens. Such a view may be understood as sharing the main tenets of Kaplan's well-known theory regarding content, or truth-conditions, but differs from it regarding the nature of the linguistic meaning of indexicals and also regarding the bearers of truth-conditional import and truth-conditions. Kaplan has criticized these (...) approaches on different counts, the most damaging of which is that they make impossible a "logic of demonstratives". The reason for this is that the token-reflexive approach entails that not two tokens of the same sentential type including indexicals are guaranteed to have the same truth-conditions. In this paper I rebut this and other criticisms of the Reichenbachian approach. Additionally, I point out that Kaplan's original theory of "true demonstratives" is empirically inadequate, and claim that any modification capable of accurately handling the linguistic data would have similar problems to those attributed to the Reichenbachian approach. This is intended to show that the difficulties, no matter how real, are not caused by idiosincracies of the "token-reflexive" view, but by deep facts about indexicality. (shrink)

The concept of instantiation is realized differently across a variety of metaphysical theories. A certain realization of the concept in a given theory depends on what roles are specified and associated with the concept and its corresponding term as well as what entities are suited to fill those roles. In this paper, the classic realization of the concept of instantiation in a one-category ontology of abstract particulars or tropes is articulated in a novel way and defended against unaddressed objections.

It is proposed that our memory is made up of individual, unconnected Records, to each of which is attached a Heading. Retrieval of a Record can only be accomplished by addressing the attached Heading, the contents of which cannot itself be retrieved. Each Heading is made up of a mixture of content in more or less literal form and context, the latter including specification of environment and of internal states (e.g. drug states and mood). This view of memory allows an (...) easy account of a number of natural memory phenomena as well as a variety of laboratory findings such as the differences between recall and recognition. The theory further proposes that Headed Records can neither be deleted nor modified. Data apparently against such a hypothesis can be accounted for in terms of the retrieval process. (shrink)

We present a theoretical view of the cellular foundations for network-level processes involved in producing our conscious experience. Inputs to apical synapses in layer 1 of a large subset of neocortical cells are summed at an integration zone near the top of their apical trunk. These inputs come from diverse sources and provide a context within which the transmission of information abstracted from sensory input to their basal and perisomatic synapses can be amplified when relevant. We argue that apical amplification (...) enables conscious perceptual experience and makes it more flexible, and thus more adaptive, by being sensitive to context. Apical amplification provides a possible mechanism for recurrent processing theory that avoids strong loops. It makes the broadcasting hypothesized by global neuronal workspace theories feasible while preserving the distinct contributions of the individual cells receiving the broadcast. It also provides mechanisms that contribute to the holistic aspects of integrated information theory. As apical amplification is highly dependent on cholinergic, aminergic, and other neuromodulators, it relates the specific contents of conscious experience to global mental states and to fluctuations in arousal when awake. We conclude that apical dendrites provide a cellular mechanism for the context-sensitive selective amplification that is a cardinal prerequisite of conscious perception. (shrink)

Experiments are presented showing that visual search for Mueller-Lyer (ML) stimuli is based on complete configurations, rather than component segments. Segments easily detected in isolation were difficult to detect when embedded in a configuration, indicating preemption by low-level groups. This preemption—which caused stimulus components to become inaccessible to rapid search—was an all-or-nothing effect, and so could serve as a powerful test of grouping. It is shown that these effects are unlikely to be due to blurring by simple spatial filters at (...) early visual levels. It is proposed instead that they are due to more sophisticated processes that rapidly bind contour fragments into spatially-extended assemblies. These results support the view that rapid visual search cannot access the primitives formed at the earliest stages of visual processing; rather, it can access only higher-level, more ecologically-relevant structures. According to the Principle of Charity, we ought to interpret each other charitably. That is, we ought to adopt the interpretation that shows the interpreted person in the best light. The Principle of Charity is motivated by appealing to a harm asymmetry: it is worse (the thought goes) to mistakenly criticize someone than to fail to rightfully criticize them. This chapter argues that in oppressive contexts, charity is not enough. First, the Principle of Charity is myopic. Charitable interpretation only considers (...) harm to the person being interpreted and ignores third party harms. Second, under conditions of oppression, our conceptual resources and evidential standards will be systematically biased against marginalized perspectives. So charitable interpretations will overlook harm to marginalized persons. Finally, the chapter give a diagnosis of the Principle of Charity: It misunderstands the interpersonal interpretive aim. The interpersonal interpretive aim is to interpret one another in a way that accurately captures the normative features that are crucial to our interpersonal relationships. What we need is not a Principle of Charity, but an Aim of Justice. The chapter’s conclusion explains what an Aim of Justice would require of us, notably, empathetic engagement and intellectual humility. (shrink)

In this article, I reconsider bio-essentialism in the study of kinship, centering on David Schneider’s influential critique that concluded that kinship was “a non-subject” (1972:51). Schneider’s critique is often taken to have shown the limitations of and problems with past views of kinship based on biology, genealogy, and reproduction, a critique that subsequently led those reworking kinship as relatedness in the new kinship studies to view their enterprise as divorced from such bio-essentialist studies. Beginning with an alternative narrative connecting kinship (...) past and present and concluding by introducing a novel way of thinking about kinship, I have three constituent aims in this research article: (1) to reconceptualize the relationship between kinship past and kinship present; (2) to reevaluate Schneider’s critique of bio-essentialism and what this implies for the contemporary study of kinship; and (3) subsequently to redirect theoretical discussion of what kinship is. This concluding discussion introduces a general view, the homeostatic property cluster (HPC) view of kinds, into anthropology, providing a theoretical framework that facilitates realization of the often-touted desideratum of the integration of biological and social features of kinship. Rules serve many important functions in society. One such function is to codify, and make public and enforceable, a society's desired prescriptions and proscriptions. This codification means that rules come with predefined punishments administered by third parties. We argue that when we look at how third parties punish rule violations, we see that rules and their punishments often serve dual functions. They support and help to maintain cooperation as it is usually theorized, but they also facilitate the domination of marginalized (...) others. We begin by reviewing literature on rules and third-party punishment, arguing that a great deal of punishment research has neglected to consider the unique power of codified rules. We also argue that by focusing on codified rules, it becomes clear that the enforcement of such rules via third-party punishment is often used to exert control, punish retributively, and oppress outgroup members. By challenging idealized theory of rules as facilitators of social harmony, we highlight their role in satisfying personal punishment motives, and facilitating discrimination in a way that is uniquely justifiable to those who enforce them. Two approaches to prehistoric numeracy are analyzed and compared. The first uses traditional archaeological methods and criteria to examine and characterize marks on prehistoric artifacts for the purpose of assessing whether they were notations. The second uses a theoretical framework in which cognition is extended—meaning that material forms are a component of the mind—in order to understand the role of counting devices in numerical cognition. Each answers a different question: The traditional approach is concerned with understanding the intent and meaning (...) of artifactual marks, while the extended approach focuses on how material forms contribute to numerical realization, explication, and elaboration. Both highlight ongoing issues in investigating prehistoric numeracy, which might benefit from a combined and expanded methodology. (shrink)

Constructivist approaches in epistemology and ethics offer a promising account of normativity. But constructivism faces a powerful Schmagency Objection, raised by David Enoch. While Enoch’s objection has been widely discussed in the context of practical norms, no one has yet explored how the Schmagency Objection might undermine epistemic constructivism. In this paper, I rectify that gap. First, I develop the objection against a prominent form of epistemic constructivism, Belief Constitutivism. Belief Constitutivism is susceptible to a Schmagency Objection, I argue, because (...) it locates the source of normativity in the belief rather than the agent. In the final section, I propose a version of epistemic constructivism that locates epistemic normativity as constitutive of agency. I argue that this version has the resources to respond to the Schmagency Objection. (shrink)

The depth-bounded approach seeks to provide realistic models of reasoners. Recognizing that most useful logics are idealizations in that they are either undecidable or likely to be intractable, the approach accounts for how they can be approximated in practice by resource-bounded agents. The approach has been applied to Classical Propositional Logic (CPL), yielding a hierarchy of tractable depth-bounded approximations to that logic, which in turn has been based on a KE/KI system. -/- This Thesis shows that the approach can be (...) naturally extended to useful nonclassical logics such as First-Degree Entailment (FDE), the Logic of Paradox (LP), Strong Kleene Logic (K3 ) and Intuitionistic Propositional Logic (IPL). To do this, we introduce a KE/KI-style system for each of those logics such that: is formulated via signed formulae, consist of linear operational rules and branching structural rule(s), can be used as a direct-proof and a refutation method, and is interesting independently of the approach in that it has an exponential speed-up on its tableau system counterpart. The latter given that we introduce a new class of examples which we prove to be hard for all tableau systems sharing the V/& rules with the classical one, but easy for their analogous KE-style systems. Then we focus on showing that each of our KE/KI-style systems naturally yields a hierarchy of tractable depth-bounded approximations to the respective logic, in terms of the maximum number of allowed nested applications of the branching rule(s). The rule(s) express(es) a generalized rule of bivalence, is (are) essentially cut rule(s) and govern(s) the manipulation of virtual information, which is information that an agent does not hold but she temporarily assumes as if she held it. Intuitively, the more virtual information needs to be invoked via the branching rule(s), the harder the inference is for the agent. So, the nested application the branching rule(s) provides a sensible measure of inferential depth. We also show that each hierarchy approximating FDE, LP, and K3 , admits of a 5-valued non-deterministic semantics; whereas, paving the way for a semantical characterization of the hierarchy approximating IPL, we provide a 3-valued non-deterministic semantics for the full logic that fixes the meaning of the connectives without appealing to “structural” conditions. -/- Moreover, we show a super-polynomial lower bound for the strongest possible version of clausal tableaux on the well-known class of “truly fat” expressions (which are easy for KE), settling a problem left open in the literature. Further, we investigate a hierarchy of tractable depth-bounded approximations to CPL based only on KE. Finally, we propose a refinement of the p-simulation relation which is adequate to establish positive results about the superiority of a system over another with respect to proof-search. (shrink)

ESP: El concepto de alma en las filosofías de Platón y Aristóteles, por la posición que ocupa en sus argumentos relativos a la esclavitud, fue central para la estructura ideológica sobre la que se sostuvo la institución esclavista durante la Colonia. Será importante remitirnos, en un primer momento, al estudio de Erwin Rohde sobre este concepto, para examinar la materialidad del hálito y plantear una relación entre la mirada y la configuración de imaginarios. Posteriormente, examinaremos el lugar que tiene el (...) alma en los argumentos de Platón y Aristóteles en favor de esclavitud, con énfasis en el papel de la mirada, el dominio sobre el cuerpo y la naturaleza de los cuerpos esclavizables. Finalmente, revisaremos en la obra de Frantz Fanon una crítica a la mirada europea y occidental que diseca el cuerpo negro al otorgarle un alma. -/- ENG: The concept of the soul in the philosophies of Plato and Aristotle, due to the posi-tion it occupies in their arguments concerning slavery, will be central to the ideo-logical structure on which the institution of slavery was sustained during colonial times. It will be important to refer, at first, to Erwin Rohde’s study of this concept, to examine the materiality of the breath and to propose a relationship between the gaze and the configuration of imaginaries. We will then examine the position of the soul in Plato’s and Aristotle’s arguments in favor of slavery, emphasizing the role of the gaze, the dominion over the body, and the nature of enslaved bodies. Finally, we will review in the work of Frantz Fanon a critique of the European and Western gaze that dissects the black body by granting it a soul. (shrink)
