This paper argues that racism should not only be conceived as a moral concept whose main aim is to condemn severe wrongs in the domain of race. The paper advances a complementary interpretation of racism as an explanatory concept--one that plays a key role in explaining race-based social problems afflicting members of subordinate racialized groups. As an explanatory concept, the term 'racism' is used to diagnose and highlight the causes of race-related social problems. The project of diagnosing race-based social problems (...) contributes to the pragmatic anti-racist end of developing better political and policy strategies for solving these social problems. The paper defends this interpretation of racism as an explanatory concept through a critical engagement with Urquidez's moral-philosophical account of racism. (shrink)

This study presents and develops in detail (a new version of) the argumental conception of meaning. The two basic principles of the argumental conception of meaning are: i) To know (implicitly) the sense of a word is to know (implicitly) all the argumentation rules concerning that word; ii) To know the sense of a sentence is to know the syntactic structure of that sentence and to know the senses of the words occurring in it. The sense of a sentence is (...) called immediate argumental role of that sentence. According to the argumental conception of meaning a theory of meaning for a particular language yields a systematic specification of the understanding of every sentence of the language which consists in a specification of the immediate argumental role of the sentence. The immediate argumental role is a particular aspect of the use of a sentence in arguments. But it is not the whole use in arguments, nor is the whole use in arguments reducible to the immediate argumental role. That is why, by accepting the argumental conception of meaning, we can have epistemological holism without linguistic holism. The argumental conception distinguishes between the understanding and the correctness of a language. Such a distinction makes it possible to account for our understanding of paradoxical languages. Redundancy theory of truth, realistic conceptions of truth or epistemic conceptions of truth are all compatible with an argumental conception of sense. But here it is argued that an epistemic conception of truth is preferrable. Acceptance of the argumental conception of meaning and of an epistemic conception of truth leads to a rejection of the idea of analytic truth. The argumental conception is pluralistic with respect to the understandability of different logics, and neutral with respect to their correctness. (shrink)

I defend impact-based accounts of institutional racism against the criticism that they are over-inclusive. If having a negative impact on non-whites suffices to make an institution racist, too many institutions (including institutions whose affirmative action policies inadvertently harm its intended beneficiaries) would count as racist. To address this challenge, I consider a further necessary condition for these institutions to count as racist—they must stand in a particular relation to racist ideology. I argue that, on the impact-based model, institutions are racist (...) if they have a negative racial impact AND this impact is legitimized by racist ideology. Racist ideologies limit social criticism of and collective action against institutions that have a negative racial impact, and in so doing, lend stability to systems of racial domination. (shrink)

I address the objection that the concept of racism has become overly inflated. Critics of the conceptual inflation of “racism” argue that theories of institutional racism engage in untoward conceptual inflation insofar as they undermine our moral understanding of racial phenomena, hinder our ability to explain the causes of racial inequality, and even undercut struggles for racial justice. I develop an original account of institutional racism and show that it is immune to all three versions of the conceptual inflation challenge.

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' Tanto desde el punto de vista teórico como desde una perspectiva práctica, el fenómeno de la "estetización" no parece ser portador de buenos augurios. En el ámbito teórico, la estetización ha sido vinculada con la crisis de los discursos orientados en términos de verdad, mientras que en el terreno práctico, ella ha sido asociada a ciertos procesos culturales que conducirían a la debacle de los principios normativos. Dejando de lado la problemática teórica, el presente trabajo se concentra en el debate (...) en torno al fenómeno práctico de la estetización de la política. En primer lugar, nos remontamos a la historia de la condena filosófica de la estetización de la esfera política para ocuparnos luego, en un segundo momento, de algunas posiciones esteticistas y antiesteticistas de finales del siglo XX. Posteriormente, procuramos avanzar en una redescripción de esta problemática que nos permita rescatar un sentido productivo de lo estético para el pensamiento político. Para esto último, nuestro trabajo se apoya en las reflexiones de la actual coeditora de la Neue Zeitschrift für Sozialforschung, Juliane Rebentisch. Tomando como parámetro algunos de los supuestos de sus investigaciones, aquí intentaremos demostrar hasta qué punto la estetización de la vida política puede contribuir al desarrollo de una concepción renovada de esta última. Both from a theoretical and from a practical perspective, the phenomenon of "aestheticization" does not seem to anticipate anything particularly good. On a theoretical level, it has been linked to the crisis of discourse-oriented in terms of truth, while in the practical, has been associated with certain cultural processes that lead to the the collapse of the normative principles. Leaving aside the theoretical issues, this paper focuses on the debate on the phenomenon of the aestheticization of the political culture. First, it goes back to the history of philosophical condemnation of the aestheticization of the political sphere. In a second time, he deals with some conceptions of the late twentieth century. Subsequently, the paper seeks to advance a redescription of this problem that allows rescue a productive sense of aesthetics for political thought. For the latter, our article is based on the reflections of Juliane Rebentisch and attempts to show how the aestheticization of political life can help to develop a new concept of the same. (shrink)

There are various proposals for a general characterization of holism1. In this paper I propose the following: a variety of holism is the view that every X of an appropriate kind, which is part of a relevant whole W, cannot be legitimately separated or taken in isolation from W. Then, I distinguish two general kinds of holism, depending on two different reasons which can debar us from taking X in isolation from W. One reason can be that separating X from (...) W always amounts to transforming X into something else. Correspondingly, a strong holism is the view that if the whole W is modified anywhere, X ceases to be X and becomes something else. Another reason why it may be illegitimate to consider X in isolation from W can be that if we separate X from W, nothing that we know entitles us to exclude that X might be transformed into something else. Correspondingly, virtual holism is the view that if the whole W is modified anywhere, we can never rule out that X ceases to be X and becomes something else. (shrink)

Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. Alberto Coffa used the phrase "the Copernican turn in semantics" to denote a revolutionary transformation of philosophical views about the connection between the meanings of words and the acceptability of sentences and arguments containing those words. According to the new conception resulting from the Copernican turn, here called "the Copernican view", rules of use are constitutive of the meanings of words. This view has been linked with two doctrines: (A) the instances of meaning-constitutive rules are analytically and a priori true (...) or valid; (B) to grasp a meaning is to accept its rules. The pros and cons of different versions of the Copernican view, ascribable to Wittgenstein, Carnap, Gentzen, Dummett, Prawitz, Boghossian and other authors, will be weighed. A new version will be proposed, which implies neither (A) nor (B). (shrink)

Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Este texto tem como objetivo apresentar a principal motivação filosófica para se defender uma teoria causal da memória, que é explicar como pode um evento que se deu no passado estar relacionado a uma experiência mnêmica que se dá no presente. Para tanto, iniciaremos apresentando a noção de memória de maneira informal e geral, para depois apresentar elementos mais detalhados. Finalizamos apresentando uma teoria causal da memória que se beneficia da noção de veritação (truthmaking).

Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. Can an epistemic conception of truth and an endorsement of the excluded middle (together with other principles of classical logic abandoned by the intuitionists) cohabit in a plausible philosophical view? In PART I I describe the general problem concerning the relation between the epistemic conception of truth and the principle of excluded middle. In PART II I give a historical overview of different attitudes regarding the problem. In PART III I sketch a possible holistic solution.

The author presents a theory of meaning centred upon the notion of "immediate argumental role", which distinguishes between understandability and correctness of a language. First, the theoretical and quasi-empirical criteria of adequacy and the relevant data for such a theory are described. Then the sense of a word is defined as given by a set of argumentation rules. The immediate argumental role of a sentence is determined by its syntactic structure and by the senses of the component words. The immediate (...) argumental role of a sentence is distinguished from its global argumental role. Different conceptions of truth are compatible with the resulting theory of sense, but the author gives some reasons for preferring an epistemic conception of truth. The possibility of understandable and meaningful paradoxical languages and of many different understandable logics is a consequence of such a view. (shrink)

Is a rational dispute over the validity of a fundamental logical law possible? In his lecture ‘Logics and Metalogics’, Timothy Williamson criticizes Dummett’s approach to this problem and maintains that a semantic theory does not provide a way of settling disputes over the validity of fundamental logical laws. I argue that Dummett’s view is different from the view criticized by Williamson. Dummett does not think that a semantic theory alone can settle a dispute over the validity of a fundamental logical (...) law. Such disputes, according to Dummett, should be settled by the theory of meaning. A semantic theory in the sense that is usual among logicians is a theory of logical consequence . Ideas on meaning, rules and mathematical proofs abound in Wittgenstein’s writings. The undeniable fact that they are present together, sometimes intertwined in the same passage of Philosophical Investigations or Remarks on the Foundations of Mathematics, does not show, however, that the connection between these ideas is necessary or inextricable. The possibility remains, and ought to be checked, that they can be plausibly and consistently separated. I am going to examine two views detectable in Wittgenstein’s works: one about proofs, the other (...) about meaning and rules. The first is the denial of the objectivity of proof. The second is a conception of meaning stemming from the rule-following considerations. I shall argue that, though Wittgenstein seems to conjoin the two views, they can be, and should be, separated1. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. Our question, in this paper, is about the plausibility of the expressivist account of one’s self- attribution of mental states. More to the point, we will strictly follow the principle of charity as a mean to show that an expressivist philosopher can have good and reasonable answers to the set of objections put together in so called “Geach’s point”. Using this method, we hope to give enough evidences that an expressivist philosopher has enough resources to build a plausible explanation for (...) one’s attribution of mental states to herself. Direct realists about episodic memory claim that a rememberer has direct contact with a past event. But how is it possible to be acquainted with an event that ceased to exist? That’s the so-called cotemporality problem. The standard solution, proposed by Sven Bernecker, is to distinguish between the occurrence of an event and the existence of an event: an event ceases to occur without ceasing to exist. That’s the eternalist solution for the cotemporality problem. Nevertheless, some philosophers of memory claim (...) that the adoption of an eternalist metaphysics of time would be too high a metaphysical price to be paid to hold direct realist intuitions about memory. Although I agree with these critics, I will try to show two things. First, that this kind of “common sense argument” is far from decisive. Second, that Bernecker’s proposal remains the best solution to the cotemporality problem. (shrink)

It argues, against what some have maintained, that remark 202 is not meant to reject the possibility of a private language as this is defined in remark 243.

A obra de Dilthey desempenha um papel fundamental para a filosofia contemporânea, na medida em que Dilthey distingue duas esferas por meio das quais temos acesso ao todo da realidade: a experiência objetiva ( die Erfahrung ) e a vivência ( das Erlebnis ). É esta distinçáo que possibilita a Dilthey, em oposiçáo às ciências da natureza, conceber as condições de evidência e validade das ciências do espírito. Ainda que náo nomeada com estes termos, esta distinçáo vai estar na base (...) dos textos de muitos autores do final do século XIX e do século XX. Conquanto Dilthey elabore sua teoria no decorrer de uma vasta obra, nosso objetivo é reconstruir a distinçáo que ele estabelece a partir do modo como ele reinterpreta o princípio de razáo suficiente, conforme formulado por Leibniz e Wolff. Também procuramos mostrar, a seguir, como esta reinterpretaçáo permite a Dilthey opor, à esfera dos conhecimentos teóricos circunscrita por Kant, a esfera dos conhecimentos relativos à vivência. Assim, o argumento principal aqui exposto estabelece um vínculo entre o modo como Dilthey reinterpreta o princípio de razáo suficiente e o modo como reconstrói cientificamente a fundamentaçáo das ciências do espírito, concebendo-as a partir de uma relaçáo específica entre evidência e validade. ¿Cómo es posible encontrar una constante en una obra que tiene en la ruptura su principal argumento? Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. (...) En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. At a crucial juncture in Plato’s Sophist, when the interlocutors have reached their deepest confusion about being and not-being, the Eleatic Visitor proclaims that there is yet hope. Insofar as they clarify one, he maintains, they will equally clarify the other. But what justifies the Visitor’s seemingly oracular prediction? A new interpretation explains how the Visitor’s hope is in fact warranted by the peculiar aporia they find themselves in. The present paper offers a libertarian reading of one of the most important Chinese novels of the twentieth century, The Travels of Laocan, written by Chinese entrepreneur Liu E between 1903 and 1906. I start with an exposition of the ideas associated with the concept of “Asian values,” the evident cultural unviability of this notion, and how “Asian authoritarianism” has been rationalized and justified on the basis of a Hobbesian conception of human nature. Next, I examine Liu E’s life and (...) career as an entrepreneur in a highly interventionist society. Finally, I focus on his magnum opus, The Travels of Laocan, a fictionalized autobiography that explains Liu E’s philosophical and libertarian ideas. (shrink)

The goal of this piece is to put some pressure on Brian O’Shaughnessy’s claim that perceptual experiences are necessarily mental processes. The author targets two motivations behind the development of that view. First, O’Shaughnessy resorts to pure conceptual analysis to argue that perceptual experiences are processes. The author argues that this line of reasoning is inconclusive. Secondly, he repeatedly invokes a thought experiment concerning the total freeze of a subject’s experiential life. Os realistas diretos sobre a memória episódica alegam que um sujeito que lembra está em contato direto com um evento passado. No entanto, como seria possível estar em contato direto com um evento que deixou de existir? Este é o assim-chamado problema da cotemporalidade. A solução padrão para este problema, a qual foi proposta por Sven Bernecker, consiste em distinguir entre, por um lado, a ocorrência de um evento, e, por outro lado, a existência de um evento, de modo que (...) um evento deixa de ocorrer sem deixar de existir – esta é a solução eternista para o problema da cotemporalidade. No entanto, alguns filósofos da memória – notadamente Kourken Michaelian – alegam que a adoção de uma metafísica eternista do tempo seria um preço metafísico muito alto a ser pago para se defender as intuições dos realistas diretos sobre a memória. El artículo se concentra en indagar las diferentes declaraciones de Marx sobre la justicia, con la intención de determinar tres cuestiones: en primer lugar, saber si nuestro autor cuenta con una concepción de la justicia; en segundo lugar, establecer si la reflexión acerca de lo que es justo ocupa un lugar privilegiado en su obra; y, en tercer lugar, ver si a partir de ahí puede colegirse la existencia de una teoría marxiana de la justicia. Interpretando a Nietzsche, podríamos afirmar que la embriaguez dionisíaca le posibilita al humano dirigirse afectivamente hacia lo externo, borrando incluso y paradójicamente ese límite que determinaría dónde empieza su ser y dónde aquello a lo que su ser es empujado. Trías recoge esta determinación en un concepto clave de su filosofía al denominarnos “ser del límite”. En ambos filósofos somos radicalmente pasión creadora; somos un animal límite y caótico, sufriente por queriente, y potencialmente feliz por el mismo motivo. Este texto analiza las concepciones que J. S. Mill y K. Marx defienden sobre la libertad, con el fin de establecer si entre ellas hay puntos de convergencia, a pesar de las diferentes motivaciones que las impulsan. En este sentido, la tesis que se propone es que ambos pensadores coinciden en la defensa que realizan de la libertad, dado que le otorgan un papel destacado a la autodeterminación, el libre desarrollo de la individualidad y a la existencia de condiciones materiales (...) para su concreción. Así las cosas, las distancias que las separan no constituyen ningún óbice al momento de abogar por lo que consideran como el valor fundamental del ser humano. (shrink)

Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. Book review: ANTOGNAZZA, M.R. 2016. Leibniz: A very short introduction. Oxford, Oxford University Press, 175 p.

The aim of this paper is to present the copy principle from execution of the principle of separability for the purpose of elucidating the discussions conducted by Hume in understanding the composition of space and its implications for the sciences that operate with spatial constructions. The particular epistemic gain here is to do this within a model of empiricism. Given that there are several irregularities in the manner of analyzing a complex and extracting simple elements from it, as will be (...) demonstrated here, we seek to show that separating a complex considering its simple qualities and decomposing a complex to determine its simple quantities is completely different. Thus, we seek to show how Hume needed to recreate his own cognitive model, strongly based on noting our perceptions, to be able to use it to conceive the composition of space and the operations of geometry that must make reference to it. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. The Parmenides has been unduly overlooked in discussions of hypothesis in Plato. It contains a unique method for testing first principles, a method I call ‘exploring both sides’. The dialogue recommends exploring the consequences of both a hypothesis and its contradictory and thematizes this structure throughout. I challenge the view of Plato’s so-called ‘method of hypothesis’ as an isolated stage in Plato’s development; instead, the evidence of the Parmenides suggests a family of distinct hypothetical methods, each with its own peculiar (...) aim. Exploring both sides is unique both in its structure and in its aim of testing candidate principles. (shrink)

In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. What is at stake is the nature of our society. Do we want an expertocracy, in which an enlightened few design policies for the greater good of the majority and exploit the lack of public knowledge to achieve compliance? (shrink)

Plato’s Parmenides and Lysis have a surprising amount in common from a methodological standpoint. Both systematically employ a method that I call ‘exploring both sides’, a philosophical method for encouraging further inquiry and comprehensively understanding the truth. Both have also been held in suspicion by interpreters for containing what looks uncomfortably similar to sophistic methodology. I argue that the methodological connections across these and other dialogues relieve those suspicions and push back against a standard developmentalist story about Plato’s method. This (...) allows for a better understanding of why exploring both sides is explicitly recommended in the Parmenides and its role within Plato’s broader methodological repertoire. (shrink)

Abstract Background The first live birth following the use of a new reproductive technique, maternal spindle transfer (MST), which is a mitochondrial replacement technique (MRT), was accomplished by dividing the execution of the MST procedure between two countries, the USA and Mexico. This was done in order to avoid US legal restrictions on this technique. -/- Sources of data Academic articles, news articles, documents obtained through freedom of information requests, laws, regulations and national reports. -/- Areas of agreement MRTs are (...) new reproductive techniques that present novel ethical and legal challenges, since genetic material from three people is employed to create a child. -/- Areas of controversy Could the first MST procedure that culminated in a live birth negatively impact reproductive medicine in Mexico? -/- Growing points The USA and Mexico need specific and clear legislation on MRTs, in order for such techniques not to be governed by prior existing legislation on assisted reproduction that is inadequate for dealing with the new challenges that these techniques present. -/- Areas timely for developing research There is a pressing need for work to be done on the international governance of new reproductive techniques. Lo anterior, a partir de dos elementos claves para entender el papel de los mecanismos jurídicos en la defensa de la naturaleza y el ambiente: la participación ambiental y el acceso a la justicia ambiental, ello, con el fin de conocer los instrumentos que reconfiguran el Estado para (...) que la ciudadanía y las organizaciones sociales puedan ejercer una defensa jurídica del medio ambiente, que aporte a la construcción de la justicia ambiental. El propósito de este trabajo consiste en destacar el papel central que tiene el problema de la divisibilidad del alma en los dos enfoques bajo los que se presenta la investigación psicológica aristotélica: el hilemórfico y el cardiocéntrico. Mientras que el primero sostiene que el alma es la forma o esencia del cuerpo entero, el segundo aboga por la localización del alma en el corazón, pues asegura que allí se manifiestan los principios de las partes o facultades anímicas. A simple (...) vista, podría suponerse que existe una incompatibilidad entre ambos enfoques, ya que no tendría mucho sentido afirmar que el alma se halla en todo el cuerpo y, al mismo tiempo, decir que se encuentra exclusivamente en uno de sus órganos específicos. Entonces, la tesis de este trabajo es que el pneuma ofrece la clave para la conciliación de estos dos enfoques, dado que es el instrumento empleado por las partes del alma para desplegar sus funciones por todo el cuerpo. El corazón, como sede material de dichas partes, irradia el pneuma en forma de sangre por todo el organismo; y éste, hasta que no se extingue esa operación vital, preserva su esencia, causa formal o razón de ser de su existir. De este modo, el hilemorfismo resulta sustentado por el cardiocentrismo. (shrink)

Descartes propõe, como atitude àquele que pretende fazer ciência, colocar tudo em dúvida. Como veremos, tal proposta restringe-se ao plano ou domínio da investigação da verdade, o qual é distinto do plano ou domínio da conduta da vida. Tal restrição é fundamental para a própria possibilidade da dúvida metódica, e torna o método da dúvida um análogo das posições críticas usuais dos cientistas em relação aos discursos não justificados. Além de ser possibilitado pela restrição ao domínio da investigação científica, e (...) ser um tipo de postura crítica, o método da dúvida mostra-se adequado para o debate com o tipo de oponente epistemológico que Descartes tinha em seu tempo. A pesar de la antigüedad de la filosofía, la aparición de la historiografía filosófica es relativamente reciente, pues es Hegel quien le asigna por vez primera una metodología precisa. Esta última apunta a un estudio de los filósofos del pasado que evite su tergiversación; sin embargo, el pensador alemán reconoce que el ejercicio del historiador de la filosofía no puede ser imparcial, dado que sus consideraciones poseen una carga valorativa. Esto ha hecho de la historiografía filosófica una palestra, en la (...) que se enfrentan las más variadas interpretaciones. Frente a este panorama reacciona Jacques Brunschwig: su propuesta consiste en evadir los presupuestos filosóficos que permean a las empresas hermenéuticas; para ello, estima necesario recurrir a técnicas objetivas (paleografía, filología, traducción, edición crítica) que tratan de dilucidar el sentido de un texto. Empero, Pierre Aubenque cuestiona que sea posible hacer historiografía de la filosofía sin poseer intereses filosóficos, ya que su practicante debe tener una afinidad electiva con aquello que estudia. El escrito parte de esta idea para destacar que no hay interpretaciones del pasado que permanezcan indiferentes a las motivaciones actuales. En este sentido, el único criterio posible para evaluar la conveniencia de las interpretaciones es su plausibilidad. (shrink)

Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families.
