STRESZCZENIE Opracowanie zmierza do udzielenia odpowiedzi na pytanie, czym – z punktu widzenia struktury procesu wykładni i struktury wchodzących w grę wartości konstytucyjnych – różni się ograniczanie wolności i praw w ramach stosowania „zwykłych środków konstytucyjnych”, od ograniczania wolności i praw dopuszczalnego w stanach nadzwyczajnych. Podjęta zostaje problematyka dotyczącą kwestii materialnych, a poza zakresem rozważanych zagadnień pozostają kwestie dotyczące formalnych warunków dopuszczalności ograniczeń, jak publiczne ogłoszenie zagrożenia czy możliwość wprowadzania ograniczeń w aktach podustawowych. Stawiane tezy są polemiczne wobec poglądów, że (...) zawieszenie wolności lub praw jest skrajnym typem ograniczania i następuje wtedy, gdy wolności czy prawa „już nie ma”, lub że zawieszenie zakłada ograniczenie istoty wolności lub prawa. Okazuje się, że można sensownie mówić o zawieszaniu wolności lub praw także wówczas, gdy są one ograniczane w niewielkim tylko stopniu. Ponadto, możliwe jest zawieszanie, które nie prowadzi do ograniczenia istoty wolności lub prawa. Argumentuje się, że istotą zawieszania wolności lub praw w stanach nadzwyczajnych jest zakwestionowanie podstawowego ich przymiotu, jakim jest – uznawana w prawie międzynarodowym – nienaruszalność „całych” poszczególnych praw człowieka, która jest czymś innym od nienaruszalności ich istoty. Przy okazji prowadzona jest refleksja teoretycznoprawna nad zagadnieniem zawieszania wolności lub praw. Zawieszenie okazuje się czymś istotnie różnym od czasowej utraty mocy obowiązującej przepisów dotyczących wolności czy praw. Ich ciągłe obowiązywanie znajduje wyraz, na przykład, w zasadzie proporcjonalności mającej zastosowanie do zawieszanych wolności lub praw. -/- Extraordinary Measures and Restrictions of Constitutional Freedoms and Rights ABSTRACT The study aims to answer the question on the difference between limitation of freedoms and rights in ordinary situations and their suspension (derogation) when extraordinary measures are introduced. This question is considered from the point of view of the structure of the interpretation process and the structure of the constitutional values. Consideration is given to issues relating to material aspects. However, issues relating to formal conditions for the admissibility of restrictions, such as public announcement of a threat or the possibility of introducing restrictions in sub-statutory acts, are not examined. The theses put forward are critical of the view that suspension of freedoms or rights is an extreme type of limitation and a freedom or a right "is no longer there", and of the view that suspension presupposes violation of the essence of freedom or right. It can be argued that it makes sense to talk about the suspension of freedoms or rights also when they are only slightly restricted. Moreover, it is possible to suspend a freedom or a right without violating their essence. It is argued that suspension of freedoms or rights leads to questioning of their basic characteristic that is their inviolability as recognized in international law. However, this inviolability of freedoms or rights is something different from the inviolability of their essence. In terms of the theory of law, the suspension of freedoms or rights turns out to be something significantly different from the temporary loss of the binding force of the respective provisions. Their continued validity is reflected, for example, in the application of the principle of proportionality to the suspended freedoms or rights. (shrink)

In elite sport, the advantages demonstrated by expert performers over novices are sometimes due in part to their superior physical fitness or to their greater technical precision in executing specialist motor skills. However at the very highest levels, all competitors typically share extraordinary physical capacities and have supremely well-honed techniques. Among the extra factors which can differentiate between the best performers, psychological skills are paramount. These range from the capacities to cope under pressure and to bounce back from setbacks, (...) to the knowledge of themselves, opponents, and the domain, which experts access and apply in performance. In the companion chapter on breadth and depth of knowledge in expert sport (see Chapter 11), we discussed the forms or kinds of knowledge deployed by elite athletes, and described some lines of research which seek to tap and study such expert knowledge (McPherson & MacMahon, 2008; McRobert, Ward, Eccles & Williams, 2011). In this chapter we focus more directly on questions about methods for measuring or more accurately assessing expert knowledge, in particular addressing a wider range of methods to help us understand what experts know. Suggesting that sport researchers can productively adopt and adapt existing qualitative methodologies for integration with more standard quantitative methods, we introduce and survey a number of areas of qualitative research in psychology. In what sense is a person addicted to drugs or alcohol incompetent, and so a legitimate object of coercive treatment? The standard tests for competence do not pick out the capacity that is lost in addiction: the capacity to properly regulate consumption. This paper is an attempt to sketch a justificatory framework for understanding the conditions under which addicted persons may be treated against their will. These conditions rarely obtain, for they apply only when addiction is extremely severe and great (...) harm threatens. It will be argued also that to widen the measures currently in place in some jurisdictions, though philosophically well-motivated, would require very strong evidence of a set of conditions disposing a person to an addictive future. It is doubtful that any such currently available evidence is strong enough to justify coercive treatment. Nevertheless, coercive treatment of addiction is already a reality, with the potential for more, and so some discussion will be presented regarding the extraordinary safeguards necessary to prevent misapplication of such treatment policies. According to Mathias Risse and Richard Zeckhauser, racial profiling can be justified in a society, such as the contemporary United States, where the legacy of slavery and segregation is found in lesser but, nonetheless, troubling forms of racial inequality. Racial profiling, Risse and Zeckhauser recognize, is often marked by police abuse and the harassment of racial minorities and by the disproportionate use of race in profiling. These, on their view, are unjustified. But, they contend, this does not mean that all (...) forms of racial profiling are unjustified; nor, they claim, need one be indifferent to the harms of racism in order to justify racial profiling. In fact, one of the aims of their paper is to show that racial profiling, suitably understood, “is consistent with support for far-reaching measures to decrease racial inequities and inequality.” Hence, one of their most striking claims, in an original and provocative paper, is that one can endorse racial profiling without being in any way indifferent to the disadvantaged status of racial minorities. In an initial response to these claims, I argued that Risse and Zeckhauser tend to underestimate the harms of racial profiling. I suggested two main reasons why they did so. The first is that they tend to identify the more serious harms associated with profiling with background racism, and therefore to believe that these are not properly attributable to profiling itself. The second reason is that they ignore the ways in which background racism makes even relatively minor harms harder to bear and to justify than would otherwise be the case. Hence, I concluded, racial profiling cannot be a normal part of police practice in a society still struggling with racism, although under very special conditions and with special regulation and compensation in place, it might be justified as an extraordinary police measure. I want to stand by those claims. However, Risse’s response to my arguments persuades me that I misinterpreted his earlier position in one significant respect. So I will start by explaining what interpretive mistake I believe that I made. I will then argue that despite Risse’s patient and careful response to my arguments, my initial concerns with his justification of profiling remain valid. -/- . (shrink)

The topic of this article is consciousness and, in it, I will theorize what consciousness is like and where it arises from. The work began to emerge and develop over time starting from my belief that consciousness is a physical self-referential phenomenon; thus, my attention was focused on the research for a self-referential process. I was confident that I could satisfy my curiosity through the reductionist method adopted by science. Unfortunately, neuroscientists and philosophers of mind realized that the attempts to (...) explain consciousness with this method have all proved inconclusive. For this reason, they are now trying to address the problem of consciousness with non-reductionist methods. As for me, I have always remained faithful to reductionism, but with the conviction that quantum mechanics, even though capable of making predictions with an extraordinary degree of accuracy, is a theory founded on wrong concepts. Thus, surprisingly, I have found a solution to the mystery of consciousness, perceiving a way to explain what it is like at its fundamental level in the field of quantum mechanics and, particularly, in one of its counterintuitive and generally less debated aspects among physicists today, but which aroused great interest in me: I am referring to the spin of the electron that will be described in this paper as a self-interacting process. This paper will also offer a rational explanation of the results obtainable in all experiments for measuring the spin of electrons through Stern-Gerlach magnets. In addition, my theory of consciousness is susceptible to experimental control. (shrink)

This study forms a part of a larger investigation of the influence of the philosophy of Heraclitus of Ephesus on modern poetry. T. S. Eliot, to mention the best known of the many poets inspired by Heraclitus, selected two Heraclitus fragments (B 2 and B 60) as epigraphs for his “Burnt Norton”, the first of his Four Quartets. Eliot explained that he was drawn to the fragments because of their ‘ambiguity’ and ‘extraordinary poetic suggestiveness’. Similarly, in ‘This Solitude of (...) Cataracts’, Wallace Stevens spoke of ‘the flecked river which kept flowing and never the same way twice’ and elsewhere noted the ‘inherently poetic quality’ of many Heraclitean sayings. To gain some sense of the nature and magnitude of Heraclitus’ legacy for modern poetry we must first explore his vision of ‘a fiery cosmos being kindled in measures and extinguished in measures’ and a river into which one cannot step twice. -/- . In the evolution of the vertebrates and probably a few other animals (Metazoa), biological values have been translated (subjectivized) into affective experience that necessarily involves the consciousness of external objects/events (as different from one’s body), which is tantamount to the origins of subjectivity. Mammals, birds and other vertebrates are experiencing subjects even though their negative and positive experience greatly vary in scope. Some mammals are capable of vicarious experience and may act as empathic agents, and some of them, at least (...) the great apes, use true reflective self-consciousness and thus perceive themselves as agents, which generates attributive feelings. The balance of positive and negative experience determines the intrinsic value of (an individual) life. Every subjective life is autotelic in striving to maximize this balance. A subjective life may also have a social value that is measured in terms of the impact on intrinsic values of other lives. The social value of life is contingent upon an agency, that is, conscious intentional actions that impact intrinsic value of other lives. The difference between the social value of a subjective life and an instrumental value of an individual comes down to the difference between agent causation and event causation. The moral agency refers to a subcategory of agent causation that involves the awareness of impact on another subject’s wellbeing (interests). The moral agency is at present known only in the hominids (including the chimpanzees) which understand causality and use reflective self-consciousness, which in turn enables them to perceive themselves as agents and attribute to themselves responsibility. The moral agency originated as a motivational mechanism of reciprocity execution , and thus as an adaptation for group life, which is why it favors ingroup members and often promotes norms that harm other groups. The human moral agency is frequently used by third parties to implement group norms that are based on ideologies (religious or secular) and may actually harm both group members and the entire groups. Any received, bioculturally evolved morality is unlikely to be good in either absolute or universal sense. Therefore, the moral capacity alone does not make a human life categorically more valuable, even if human motivation were dominated by moral agency (which is true only of some people). The life of a vertebrate has, therefore, two values, intrinsic and social. Each can be negative or positive, and may vary to a large extent independently of the other, whereby a joint value of a subjective life cannot be sensibly assessed and compared without prior assessments of the intrinsic and social component separately. In the absence of objective reasons to rate the intrinsic value of a human life as categorically higher than that of other mentally advanced mammals, and in consideration of the observed range of social values of human lives, some of which approach zero and some are highly negative (lower than any thinkable negative values of non-human lives), the doctrine of extraordinary and inalienable (innate) human „dignity” is groundless and unethical, as it leads to a depreciation of the lives of non-human subjects, and often preempts the need to impart a real social value to one’s own life. Purpose of this article is to investigate the role that the "miraculous" – that is, everything that goes beyond “natural” – plays in the worldview of Western man. Methodology. I do not consider “miracles” as the facts of nature, but as the facts of culture, so in this article I am not talking about specific cases of violation of “laws of nature”, but about the place of “miraculous” in the view of the world of Western man and those transformations, that (...) occur with this element outlook influenced the development of information technologies. Novelty. It has been proved that miracles should be sought in mind, because the “miraculous” event does our attitude towards it. Moreover, it is impossible to determine the “true miracle”, while we are “inside” the reality. It has been demonstrated that influenced the development of society is transformed representations of gods and miracles. It has been discovered fundamental shift associated with the transition from mythology-as-faith to mythology-as-show. However, even within the latter remains a need for miracles, though, and goes to a completely different level. Conclusions. The term "miracle" has no meaning outside of accepted socio-cultural settings. The last set as the “natural” conditions and admissibility (inadmissibility) of its violation. And these installations are formed by social institutions, which in this age and at this time have a weight sufficient to impose their views to all the congregation or the greater part. Any extraordinary event can be explained by the action of internal agents unknown to us, and their ability to alter the reality is not necessarily superior to even our own capabilities. The only thing we can not do – is to change the source code of being (e.g., fundamental physical constants). This could make only creatures that are not spelled out in these source codes. However, people have not seen anything like it, and scarcely become witnesses of such events. (shrink)

Measuring the effectiveness of medical interventions faces three epistemological challenges: the choice of good measuring instruments, the use of appropriate analytic measures, and the use of a reliable method of extrapolating measures from an experimental context to a more general context. In practice each of these challenges contributes to overestimating the effectiveness of medical interventions. These challenges suggest the need for corrective normative principles. The instruments employed in clinical research should measure patient-relevant and disease-specific parameters, and should not (...) be sensitive to parameters that are only indirectly relevant. Effectiveness always should be measured and reported in absolute terms (using measures such as 'absolute risk reduction'), and only sometimes should effectiveness also be measured and reported in relative terms (using measures such as 'relative risk reduction')-employment of relative measures promotes an informal fallacy akin to the base-rate fallacy, which can be exploited to exaggerate claims of effectiveness. Finally, extrapolating from research settings to clinical settings should more rigorously take into account possible ways in which the intervention in question can fail to be effective in a target population. Extensive measurement is the standard measurement-theoretic approach for constructing a ratio scale. It involves the comparison of objects that can be concatenated in an additively representable way. This paper studies the implications of extensively measurable welfare for social choice theory. We do this in two frameworks: an Arrovian framework with a fixed population and no interpersonal comparisons, and a generalized framework with variable populations and full interpersonal comparability. In each framework we use extensive measurement to introduce novel domain restrictions, independence (...) conditions, and constraints on social evaluation. We prove a welfarism theorem for these domains and characterize the social welfare functions that satisfy the axioms of extensive measurement at both the individual and social levels. The main results are simple axiomatizations of strong dictatorship in the Arrovian framework and classical utilitarianism in the generalized framework. (shrink)

This paper examines the role existence plays in measurement validity. I argue that existing popular theories of measurement and of validity follow a correspondence framework, which starts by assuming that an entity exists in the real world with certain properties that allow it to be measurable. Drawing on literature from the sociology of measurement, I show that the correspondence framework faces several theoretical and practical challenges. I suggested the validity-first framework of measurement, which starts with a practice-based validation process as (...) the basis for a measurement theory, and only posits objective existence when it is scientifically useful to do so. In the last few decades the role played by models and modeling activities has become a central topic in the scientific enterprise. In particular, it has been highlighted both that the development of models constitutes a crucial step for understanding the world and that the developed models operate as mediators between theories and the world. Such perspective is exploited here to cope with the issue as to whether error-based and uncertainty-based modeling of measurement are incompatible, and thus alternative with one (...) another, as sometimes claimed nowadays. The crucial problem is whether assuming this standpoint implies definitely renouncing to maintain a role for truth and the related concepts, particularly accuracy, in measurement. It is argued here that the well known objections against true values in measurement, which would lead to refuse the concept of accuracy as non-operational, or to maintain it as only qualitative, derive from a not clear distinction between three distinct processes: the metrological characterization of measuring systems, their calibration, and finally measurement. Under the hypotheses that (1) the concept of true value is related to the model of a measurement process, (2) the concept of uncertainty is related to the connection between such model and the world, and (3) accuracy is a property of measuring systems (and not of measurement results) and uncertainty is a property of measurement results (and not of measuring systems), not only the compatibility but actually the conjoint need of error-based and uncertainty-based modeling emerges. The social welfare functional approach to social choice theory fails to distinguish a genuine change in individual well-beings from a merely representational change due to the use of different measurement scales. A generalization of the concept of a social welfare functional is introduced that explicitly takes account of the scales that are used to measure well-beings so as to distinguish between these two kinds of changes. This generalization of the standard theoretical framework results in a more satisfactory formulation of welfarism, (...) the doctrine that social alternatives are evaluated and socially ranked solely in terms of the well-beings of the relevant individuals. This scale-dependent form of welfarism is axiomatized using this framework. The implications of this approach for characterizing classes of social welfare orderings are also considered. (shrink)

Corporate social responsibility (CSR) is one of the most prominent concepts in the literature and, in short, indicates the positive impacts of businesses on their stakeholders. Despite the growing body of literature on this concept, the measurement of CSR is still problematic. Although the literature provides several methods for measuring corporate social activities, almost all of them have some limitations. The purpose of this study is to provide an original, valid, and reliable measure of CSR reflecting the responsibilities of a (...) business to various stakeholders. Based on a proposed conceptual framework of CSR, a scale was developed through a systematic scale development process. In the study, exploratory factor analysis was conducted to determine the underlying factorial structure of the scale. Data was collected from 269 business professionals working in Turkey. The results of the analysis provided a four-dimensional structure of CSR, including CSR to social and nonsocial stakeholders, employees, customers, and government. (shrink)

This paper addresses what we consider to be the most pressing challenge for the emerging science of consciousness: the measurement problem of consciousness. That is, by what methods can we determine the presence of and properties of consciousness? Most methods are currently developed through evaluation of the presence of consciousness in humans and here we argue that there are particular problems in application of these methods to nonhuman cases—what we call the indicator validity problem and the extrapolation problem. The first (...) is a problem with the application of indicators developed using the differences between conscious and unconscious processing in humans to the identification of other conscious vs. nonconscious organisms or systems. The second is a problem in extrapolating any indicators developed in humans or other organisms to artificial systems. However, while pressing ethical concerns add urgency to the attribution of consciousness and its attendant moral status to nonhuman animals and intelligent machines, we cannot wait for certainty and we advocate the use of a precautionary principle to avoid causing unintentional harm. We also intend that the considerations and limitations discussed in this paper can be used to further analyze and refine the methods of consciousness science with the hope that one day we may be able to solve the measurement problem of consciousness. We characterize access to empirical objects in biology from a theoretical perspective. Unlike objects in current physical theories, biological objects are the result of a history and their variations continue to generate a history. This property is the starting point of our concept of measurement. We argue that biological measurement is relative to a natural history which is shared by the different objects subjected to the measurement and is more or less constrained by biologists. We call symmetrization the theoretical and (...) often concrete operation which leads to considering biological objects as equivalent in a measurement. Last, we use our notion of measurement to analyze research strategies. Some strategies aim to bring biology closer to the epistemology of physical theories, by studying objects as similar as possible, while others build on biological diversity. (shrink)

Prisoners, those who probably engaged in criminal activities, might possess different perceptions and notions of moral foundations than non-prisoners. Thus, assessing such foundations among the population without testing the validity of the measure may produce biased outcomes. To address the potential methodological issue, we examined the validity of the measurement model for moral foundations among prisoners and community members, i.e., non-prisoners. We conducted the measurement invariance test and measurement alignment to test whether the model was consistently valid across the groups. (...) We also employed the differential item functioning test to examine whether item responses were not biased between the different populations. Results demonstrated significant measurement non-invariance and differential item functioning. However, measurement alignment could address the non-invariance issue. Between-group comparisons of moral foundations were consistent with findings from prior research after performing the alignment. (shrink)

This article concerns the distinction between memory-time and information-time, which appeared in Wittgenstein’s middle-period lectures and writings, and its relation to Wittgenstein’s career-long reflection about musical understanding. While the idea of “information-time” entails a public frame of reference typically pertaining to objects which persist in physical time, the idea of pure “memory-time” involves the totality of one’s present memories and expectations that do now provide any way of measuring time-spans. I argue that Wittgenstein’s critique of Augustine notion of pure memory-time (...) entails ipso facto a critique of an influential idea of musical motion, which has been recurring in the work of some major philosophers of music up until the present day. The article connects Wittgenstein’s critical remarks on the confused foundations of such “Augustinian Picture of Music” with his emphasis on the notion of phrasing or characterization in language and music. Wittgenstein’s reversal of Augustinian priorities regarding musical time brings to surface the particularity of expression and the aesthetically “right” in music, evoked by Wittgenstein’s remarks on simultaneity and tempo in music and language. Wittgenstein renders musical simultaneity as enabled by a “protocol” which inheres in musizieren, in the aptly collaborative quest for drawing in significance by means of the phrasing and re-phrasing of a passage in order to characterize it, enabling by means of such comparative investigation meaningful distinctions between right and wrong. The paper discusses the philosophical conclusions, which the interrelation between quantum mechanics and general relativity implies by quantum measure. Quantum measure is three-dimensional, both universal as the Borel measure and complete as the Lebesgue one. Its unit is a quantum bit (qubit) and can be considered as a generalization of the unit of classical information, a bit. It allows quantum mechanics to be interpreted in terms of quantum information, and all physical processes to be seen as informational in a generalized (...) sense. This implies a fundamental connection between the physical and material, on the one hand, and the mathematical and ideal, on the other hand. Quantum measure unifies them by a common and joint informational unit. Quantum mechanics and general relativity can be understood correspondingly as the holistic and temporal aspect of one and the same, the state of a quantum system, e.g. that of the universe as a whole. What is it to know more? By what metric should the quantity of one's knowledge be measured? I start by examining and arguing against a very natural approach to the measure of knowledge, one on which how much is a matter of how many. I then turn to the quasi-spatial notion of counterfactual distance and show how a model that appeals to distance avoids the problems that plague appeals to cardinality. But such a model faces fatal problems of its own. (...) Reflection on what the distance model gets right and where it goes wrong motivates a third approach, which appeals not to cardinality, nor to counterfactual distance, but to similarity. I close the paper by advocating this model and briefly discussing some of its significance for epistemic normativity. In particular, I argue that the 'trivial truths' objection to the view that truth is the goal of inquiry rests on an unstated, but false, assumption about the measure of knowledge, and suggest that a similarity model preserves truth as the aim of belief in an intuitively satisfying way. The old evidence problem affects any probabilistic confirmation measure based on comparing pr(H/E) and pr(H). The article argues for the following points: (1) measures based on likelihood ratios also suffer old evidence difficulties; (2) the less-discussed synchronic old evidence problem is, in an important sense, the most acute; (3) prominent attempts to solve or dissolve the synchronic problem fail; (4) a little-discussed variant of the standard measure avoids the problem, in an appealing way; and (5) this measure nevertheless reveals (...) a different problem for probabilistic confirmation measures, a problem that is unlikely to lend itself to formal solution. -/- Species lists play an important role in biology and practical domains like conservation, legislation, biosecurity and trade regulation. However, their effective use by non-specialist scientific and societal users is sometimes hindered by disagreements between competing lists. While it is well-known that such disagreements exist, it remains unclear how prevalent they are, what their nature is, and what causes them. In this study, we argue that these questions should be investigated using methods based on taxon concept rather than methods based (...) on Linnaean names, and use such a concept-based method to quantify disagreement about bird classification and investigate its relation to research effort. We found that there was disagreement about 38% of all groups of birds recognized as a species, more than three times as much as indicated by previous measures. Disagreement about the delimitation of bird groups was the most common kind of conflict, outnumbering disagreement about nomenclature and disagreement about rank. While high levels of conflict about rank were associated with lower levels of research effort, this was not the case for conflict about the delimitation of bird groups. This suggests that taxonomic disagreement cannot be resolved simply by increasing research effort. (shrink)

In Measuring the Immeasurable Mind: Where Contemporary Neuroscience Meets the Aristotelian Tradition, Matthew Owen argues that despite its nonphysical character, it is possible to empirically detect and measure consciousness. -/- Toward the end of the previous century, the neuroscience of consciousness set its roots and sprouted within a materialist milieu that reduced the mind to matter. Several decades later, dualism is being dusted off and reconsidered. Although some may see this revival as a threat to consciousness science aimed at measuring (...) the conscious mind, Owen argues that measuring consciousness, along with the medical benefits of such measurements, is not ruled out by consciousness being nonphysical. Owen proposes the Mind-Body Powers model of neural correlates of consciousness, which is informed by Aristotelian causation and a substance dualist view of human nature inspired by Thomas Aquinas, who often followed Aristotle. In addition to explaining why there are neural correlates of consciousness, the model provides a philosophical foundation for empirically discerning and quantifying consciousness. En route to presenting and applying the Mind-Body Powers model to neurobiology, Owen rebuts longstanding objections to dualism related to the mind-body problem. With scholarly precision and readable clarity, Owen applies an oft forgotten yet richly developed historical vantage point to contemporary cognitive neuroscience. (shrink)

Seven problems that occur in attempts to measure complexity are pointed out as they occur in four proposed measurement techniques. Each example method is an improvement over the previous examples. It turns out, however, that none are up to the challenge of complexity. Apparently, there is no currently available method that truly gets the measure of complexity. There are two reasons. First, the most natural approach, quantitative analysis, is rendered inadequate by the very nature of complexity. Second, the intrinsic magnitude (...) of complexity is still holding at bay attempts to use both quantitative and qualitative methods combined. Further progress in complexity science and in systems science is required. Any method that simplifies will fail because it ignores what complexity is. Techniques of understanding that do not simplify, but rather provide ways for the mind to grasp and work with complexity are more effective in getting its measure. (shrink)

This paper aims to assess knowledge management maturity at HEI to determine the most effecting variables on knowledge management that enhance the total performance of the organization. This study was applied on Al-Azhar University in Gaza strip, Palestine. This paper depends on Asian productivity organization model that used to assess KM maturity. Second dimension assess high performance was developed by the authors. The controlled sample was (364). Several statistical tools were used for data analysis and hypotheses testing, including reliability Correlation (...) using Cronbach’s alpha, “ANOVA”, Simple Linear Regression and Step Wise Regression. The overall findings of the current study suggest that KMM is suitable for measuring and lead to enhance high performance. KMM assessment shows that the university maturity level is in level three. Findings also support the main hypothesis and it is subhypotheses. The most important factors effecting high performance are: Processes, KM leadership, People, KM Outcomes, Knowledge Process. Furthermore the current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first study at HEI in Palestine explores the status of KMM using the Asian productivity model. To what extend does David Hume's argument about miracles inform modern skepticism about pseudoscience?

Do sensory measurements deserve the label of “measurement”? We argue that they do. They fit with an epistemological view of measurement held in current philosophy of science, and they face the same kinds of epistemological challenges as physical measurements do: the problem of coordination and the problem of standardization. These problems are addressed through the process of “epistemic iteration,” for all measurements. We also argue for distinguishing the problem of standardization from the problem of coordination. We investigate the implications of protective measurement for de Broglie-Bohm theory, mainly focusing on the interpretation of the wave function. It has been argued that the de Broglie-Bohm theory gives the same predictions as quantum mechanics by means of quantum equilibrium hypothesis. However, this equivalence is based on the premise that the wave function, regarded as a Ψ-field, has no mass and charge density distributions. But this premise turns out to be wrong according to protective measurement; a charged quantum system (...) has effective mass and charge density distributing in space, proportional to the square of the absolute value of its wave function. Then in the de Broglie-Bohm theory both Ψ-field and Bohmian particle will have charge density distribution for a charged quantum system. This will result in the existence of an electrostatic self-interaction of the field and an electromagnetic interaction between the field and Bohmian particle, which not only violates the superposition principle of quantum mechanics but also contradicts experimental observations. Therefore, the de Broglie-Bohm theory as a realistic interpretation of quantum mechanics is problematic according to protective measurement. Lastly, we briefly discuss the possibility that the wave function is not a physical field but a description of some sort of ergodic motion (e.g. random discontinuous motion) of particles. (shrink)

Are widely used measurements in the human sciences (say happiness surveys or depression scales) quantitative or merely ordinal? If they are merely ordinal, could they be developed into quantitative measurements, just like in the progression from thermoscopes to thermometers? Taking inspiration from recent philosophy of measurement, some practitioners express optimism about future human science measurements. The so-called quantity objection stands out for having the only chance of settling the debate in favour of the pessimists. It claims that the problem lies (...) not with current, or likely future, measurement practices in the human sciences, but with human science attributes themselves—they just are not quantitative, but merely ordinal. Hence, they cannot not (thus will not) be measured quantitatively. The argument has a long and distinguished pedigree. This paper assesses old and recent versions of it, namely: the objection made originally to Fechner’s psychophysics by von Kries (among others) and Michell’s recent version of this objection. To do so, the paper first draws important distinctions between different versions of the argument that have been overlooked. Then, it argues that none of the versions of the quantity objection provide a good reason for the optimists to give up their optimism. In particular, Michell’s argument characterizes the measurand (that is, the attribute to be measured) in a way that optimists do not and need not accept. Yet the optimists’ defence articulated here brings with it serious burdens to discharge. The ball is in their court. (shrink)

Thick concepts, namely those concepts that describe and evaluate simultaneously, present a challenge to science. Since science does not have a monopoly on value judgments, what is responsible research involving such concepts? Using measurement of wellbeing as an example, we first present the options open to researchers wishing to study phenomena denoted by such concepts. We argue that while it is possible to treat these concepts as technical terms, or to make the relevant value judgment in-house, the responsible thing to (...) do, especially in the context of public policy, is to make this value judgment through a legitimate political process that includes all the stakeholders of this research. We then develop a participatory model of measurement based on the ideal of co-production. To show that this model is feasible and realistic, we illustrate it with a case study of co-production of a concept of thriving conducted by the authors in collaboration with a UK anti-poverty charity Turn2us. In a recent paper in this Journal San Pedro I formulated a conjecture relating Measurement Independence and Parameter Independence, in the context of common cause explanations of EPR correlations. My conjecture suggested that a violation of Measurement Independence would entail a violation of Parameter Independence as well. Leszek Wroński has shown that conjecture to be false. In this note, I review Wroński’s arguments and agree with him on the fate of the conjecture. I argue that what is interesting about the (...) conjecture, however, is not whether it is true or false in itself, but the reasons for the actual verdict, and their implications regarding locality. How can an event be extraordinary? What is the metaphysical background necessary to believe that extraordinary events are possible? The possibility of extraordinary events can be approached from metaphysical, epistemic, and scientific perspectives. Metaphysical explanations are extraordinary events that transcend nature or violate the regular structure in nature. Epistemological explanations, on the other hand, are explanations of extraordinary events by referring either to our lack of knowledge about nature or to our inadequacy of knowledge about (...) events. Scientific explanations recognize phenomena that have been observed or experimented on but have not yet been explained by any theory. In this article, I focus on metaphysical and epistemological explanations. We see that three basic assumptions are used for a metaphysical explanation: 1) There must be an orderly operation called Nature. 2) The process in nature can be violated. 3) There is a compatibility between the mind and the world. With the adoption of these three assumptions by different philosophers in various combinations, two kinds of metaphysical explanations arise: extraordinary as supernatural and extraordinary by appealing to the principle of sufficient reason. According to the first type of explanation, extraordinary events are events caused by what is beyond nature, exceeding nature, or violating the workings of nature. In order to explain extraordinary events with the supernatural, there is a need to violate the metaphysical necessities on which nature is based, such as the principle of causality. An approach represented by philosophers such as St. Augustine, al-Ghazālī, Richard Swinburne, and Nazif Muhtaroğlu claims that it is possible for a supernatural event to occur, claiming that the functioning of nature is not necessary. But if there is no metaphysical necessity in nature such as the principle of causality, how can an extraordinary event violate anything? Both Swinburne and St. Augustine answer this question with the argument that the principle of causality is effective in nature and that principle can be violated by God, a supernatural power. Al-Ghazālī and Muhtaroğlu, on the other hand, prefer not to accept the effectiveness of causality in the functioning of nature. Thus, all activity in nature will be attributed to God, and extraordinary events will gain the same status as ordinary events. The point that unites these views is the belief that the operation in nature is not necessary, with or without causality. Philosophers with this belief could not successfully explain extraordinary events because they could not ground their understanding of nature and the supernatural. Moreover, when we analyze their approach to the problem, we see that ordinary and extraordinary events cannot be separated from each other, since no other principle is put forward to replace the principle of causality. The second type of explanation is the explanation of extraordinary events by applying the principle of sufficient reason. The philosophers represented by Ibn Sînâ and Leibniz consider it necessary both metaphysically and epistemologically that everything in nature needs sufficient reason to come to be. According to them, no event can take place without sufficient cause. In this respect, there must be sufficient reason for extraordinary events to occur as well as ordinary ones. Both philosophers argue that extraordinary events are metaphysically possible events in nature, but their occurance does not violate principles such as causality. According to this type of explanation, extraordinary events are not supernatural. Ibn Sînâ, using the concept of nature in its metaphysical sense, argued that forces beyond matter are also effective in nature. Meanwhile, he maintained the necessity of the causality principle. In this way, it is possible to have previously unknown results from known causes. For example, the human soul can affect different bodies through celestial realms, just as it affects its own body. However, this interaction does not violate the necessity of the causality principle, on the contrary, it means the discovery of the necessary structure of nature. In short, the epistemological approaches of Leibniz and Ibn Sînâ, which they developed while preserving the metaphysical necessity of causation, do not require denying extraordinary events without examining them, but also offer a stronger basis for the possibility of extraordinary events, as they expand the limits of our knowledge of nature. In ‘Measuring the Consequences of Rules’, Holly Smith presents two problems involving the indeterminacy of compliance, which she takes to be fatal for all forms of rule-utilitarianism. In this reply, I attempt to dispel both problems.

Recently two distinct forms of rule-utilitarianism have been introduced that differ on how to measure the consequences of rules. Brad Hooker advocates fixed-rate rule-utilitarianism, while Michael Ridge advocates variable-rate rule-utilitarianism. I argue that both of these are inferior to a new proposal, optimum-rate rule-utilitarianism. According to optimum-rate rule-utilitarianism, an ideal code is the code whose optimum acceptance level is no lower than that of any alternative code. I then argue that all three forms of rule-utilitarianism fall prey to two fatal (...) problems that leave us without any viable form of rule-utilitarianism. (shrink)

Fitelson (1999) demonstrates that the validity of various arguments within Bayesian confirmation theory depends on which confirmation measure is adopted. The present paper adds to the results set out in Fitelson (1999), expanding on them in two principal respects. First, it considers more confirmation measures. Second, it shows that there are important arguments within Bayesian confirmation theory and that there is no confirmation measure that renders them all valid. Finally, the paper reviews the ramifications that this "strengthened problem of (...) measure sensitivity" has for Bayesian confirmation theory and discusses whether it points at pluralism about notions of confirmation. SUMMARY The research focuses on the three main political parties in Albania, namely Socialist Party, Democratic Party and Socialist Movement for Integration. Its objectives are to measure the Intra-Party Democracy(IPD) in the Albanian political parties and to explore the meaning that party members attach to it. The IPD is understood and broken down into categories and sub-categories so that parties in particular and all interested actors in the field of political parties and democracy could understand, which component of IPD parties (...) are performing better and where they are performing worse. IPD is measured against two dimensions: inclusiveness and decentralization. Inclusiveness denotes the extent to which party members have the right to express their opinions and participate in the decision-making process. With decentralization is understood the process which makes possible the decentralization of the decision-making process from the highest national party level to party sub-national levels and party members. In a decentralized party, subnational party units enjoy a certain level of autonomy from the party in the center. The analysis is based on both primary and secondary data. Content analysis of party statutes particularly focuses on measuring IPD, while focus groups with party members and interviews with high-ranking officials of the political parties are used to explore the meaning that party members have on IPD, as well as validate content analysis findings. The main findings are: -/- Content Analysis of Party Statutes: Parties do have rules that govern their internal life, however these rules need to be improved in order to strengthen IPD. Especially problematic were the provisions for the role of the executive committee and party president, which provide these two institutions, especially the leader of the party with powers that don’t hold him/her accountable to the party members and middle level organs. Furthermore, members were not sufficiently involved in the procedures of candidate nominations for MPs, in the election of the national Executive and Executive Committee and in the election of the Party President. The analysis also finds that voting procedures are not sufficiently at place to allow members express their will and participate in the decision-making process and that members are not or little consulted in terms of programmatic issues. The analysis of the relationship between the national and subnational levels of party organization revealed that the center of the party has accumulated power to the detriment of the subnational units which enjoy little autonomy in the decision-making process. -/- Focus Groups and Interviews: The study finds that party members linked system-level democracy with IPD and that they have a very clear understanding if IPD: what it is and how it could be achieved. They linked IPD with the structure and organization of the party, seeing it as an important instrument that allows for decentralization of power and integration of rank and file into the decision-making process. The party members considered the statute as an important educational political tool and invoked it whenever disputes rose or decisions had to be taken. They linked IPD with the electoral system and considered that closed list proportional was a system that strengthened the power in the hands of the few at the party top executive level and weakened IPD. The study aimed at measuring the dominant pattern of leadership and its relation to the performance of the administrative staff in the Palestinian universities. The study community consists of all the administrative staff from Al-Azhar University and the Islamic University, and through the census of the study society it was found to consist of (655) administrative staff. In order to achieve the objectives of the study, the researchers used the method of random sample in the study, and the study was (...) conducted on a sample of (221) administrative staff of the surveyed universities and the response rate was (82.35%). The study found that there is a high degree of satisfaction with the Dominant Pattern of Leadership in the Palestinian universities in Gaza Strip from the point of view of the administrative staff, which reached (71.67%). There is a high level of performance from the point of view of administrative staff, with a percentage of (82.53%). There is a direct correlation between the dominant pattern of leadership and the functional Performance of Administrative Staff, the absence of differences between the sample according to the gender variable in their perception of the dominant pattern of leadership and the functional Performance of Administrative Staff, the absence of differences in the perception of employees of the dominant pattern of leadership and the functional Performance of Administrative Staff depending on the age variable. There are differences of statistical significance according to the variable of scientific qualification in the Dominant Pattern of Leadership, while there were no differences in performance, the differences in the dominant pattern of leadership according to the scientific qualification were in favor of those who obtained the diploma degree compared to other practical qualifications, the absence of differences in the perception of employees of the dominant pattern of leadership and the functional Performance of Administrative Staff depending on the variable years of service, the absence of differences in the perception of employees of the dominant pattern of leadership and the functional Performance of Administrative Staff depending on the variable level of career (Director, Head of Department, and Administrative Officer). There were differences in the perception of workers to the dominant pattern of leadership depending on the variable of the workplace, where there were differences in favor of workers in deanships and colleges compared with the workers in the technical departments. While there were no differences in job performance according to the workplace variable, the existence of differences in the perception of workers to the dominant pattern of leadership depending on the university in which they work in favor of the Islamic University and the absence of differences in performance between the Islamic University and Al-Azhar University. The study reached a number of recommendations, the most important of which is that the interest of the managements of the Palestinian universities in improving the dominant pattern of leadership, to give universities the opportunity to participate in decision-making, the continued administration of universities interest and continuous improvement of the performance of its employees, enhance the periodic evaluation of job performance and to inform employees and express their opinion, solving workers' problems and giving them the opportunity to contribute to solving their own problems, the use of the staff rotation method periodically and strengthening the democratic the dominant pattern of leadership and empowering university staff. -/- . This paper introduces a refined single-valued neutrosophic set (RSVNS) and presents a similarity measure of RSVNSs. Then a multicriteria decision-making method with RSVNS information is developed based on the similarity measure of RSVNSs. By the similarity measure between each alternative and the ideal solution (ideal alternative), all the alternatives can be ranked and the best one can be selected as well. Finally, an actual example on the selecting problems of construction projects demonstrates the application and effectiveness of the proposed method.

This paper is a discussion note on Isaacs et al. (2022), who have claimed to offer a new motivation for imprecise probabilities, based on the mathematical phenomenon of non-measurability. In this note, I clarify some consequences of their proposal. In particular, I show that if their proposal is applied to a bounded 3-dimensional space, then they have to reject at least one of the following: (i) If A is at most as probable as B and B is at most as (...) probable as C, then A is at most as probable as C. (ii) Let A ∩ C = B ∩ C = ∅. A is at most as probable as B iff (A ∪ C) is at most as probable as (B ∪ C). But rejecting either statement seems unattractive. (shrink)

The measurement problem concerns an apparent conflict between the two fundamental principles of quantum mechanics, namely the Schrödinger equation and the measurement postulate. These principles describe inconsistent behavior for quantum systems in so-called "measurement contexts." Many theorists have thought that the measurement problem can only be resolved by proposing a mechanistic explanation of (genuine or apparent) wavefunction collapse that avoids explicit reference to "measurement." However, I argue here that the measurement problem dissolves if we accept Humeanism about laws of nature. (...) On a Humean metaphysics, there is no conflict between the two principles, nor is there any inherent problem with the concept of "measurement" figuring into the account of collapse. (shrink)

In this paper, we first propose the concept of divergence measure on neutrosophic sets. We also provide some formulas for the divergence measure for neutrosophic sets. After that, we investigate the properties of proposed neutrosophic divergence measure. Finally, we also apply these formulas in medical problem and the classification problem.

Background: Many people with aphasia and people without brain injury talk to themselves in their heads, i.e., have “inner speech.” Inner speech may be more preserved compared with spoken speech for some people with aphasia and may serve a variety of functions (e.g., emotion regulation), which motivates us to provide a high-fidelity characterization of it. Researchers have used multiple methods to measure this internal phenomenon in the past, which we combine here for the first time in a single study. -/- (...) Aims: We compare performance between individuals with and without aphasia on inner speech tasks that assess inner speech “inthe- moment” to general subjective impressions of inner speech to tease apart the relationship of aphasia severity to inner speech. Methods and Procedures: Twenty people with mild-moderate aphasia and twenty neurotypical controls completed several inner speech tasks, including objective silent rhyme judgements (picture, written, and auditory), subjective reports of inner speech during naming, and subjective rating scales about inner speech experience more generally. -/- Outcomes and Results: In-the-moment inner speech during silent rhyming tasks was associated with aphasia severity only for picture and written rhyming but not auditory rhyming. In-the-moment inner speech reports during silent naming were not associated with aphasia severity, nor were the subjective ratings about general inner speech experience. Individuals with and without aphasia demonstrated a variety of subjective general inner speech experiences, demonstrating heterogeneity of this phenomenon more broadly. -/- Conclusions: Methods of measuring inner speech complement each other and speak to different facets of the inner speech phenomenon, and clinicians and researchers must carefully choose the method(s) that will provide the information about inner speech that they desire. While it is often said that robotics should aspire to reproducible and measurable results that allow benchmarking, I argue that a focus on benchmarking can be a hindrance for progress in robotics. The reason is what I call the ‘measure-target confusion’, the confusion between a measure of progress and the target of progress. Progress on a benchmark (the measure) is not identical to scientific or technological progress (the target). In the past, several academic disciplines have been led into pursuing only (...) reproducible and measurable ‘scientific’ results – robotics should be careful to follow that line because results that can be benchmarked must be specific and context-dependent, but robotics targets whole complex systems for a broad variety of contexts. While it is extremely valuable to improve benchmarks to reduce the distance be- tween measure and target, the general problem to measure progress towards more intelligent machines (the target) will not be solved by benchmarks alone; we need a balanced approach with sophisticated benchmarks, plus real-life testing, plus qualitative judgment. Well-being measurements are frequently used to support conclusions about a range of philosophically important issues. This is a problem, because we know too little about the intervals of the relevant scales. I argue that it is plausible that well-being measurements are non-linear, and that common beliefs that they are linear are not truth-tracking, so we are not justified in believing that well-being scales are linear. I then argue that this undermines common appeals to both hypothetical and actual well-being measurements; I (...) first focus on the philosophical literature on prioritarianism and then discuss Kahneman’s Peak-End Rule as a systematic bias. Finally, I discuss general implications for research on well-being, and suggest a better way of representing scales. (shrink)

I argue that prioritarianism cannot be assessed in abstraction from an account of the measure of utility. Rather, the soundness of this view crucially depends on what counts as a greater, lesser, or equal increase in a person’s utility. In particular, prioritarianism cannot accommodate a normatively compelling measure of utility that is captured by the axioms of John von Neumann and Oskar Morgenstern’s expected utility theory. Nor can it accommodate a plausible and elegant generalization of this theory that has been (...) offered in response to challenges to von Neumann and Morgenstern. This is, I think, a theoretically interesting and unexpected source of difficulty for prioritarianism, which I explore in this article. (shrink)

Since the world is full of indeterminacy, the neutrosophics found their place into contemporary research. We now introduce for the first time the notions of neutrosophic measure and neutrosophic integral. Neutrosophic Science means development and applications of neutrosophic logic/set/measure/integral/ probability etc. and their applications in any field. It is possible to define the neutrosophic measure and consequently the neutrosophic integral and neutrosophic probability in many ways, because there are various types of indeterminacies, depending on the problem we need to solve. (...) Indeterminacy is different from randomness. Indeterminacy can be caused by physical space materials and type of construction, by items involved in the space, or by other factors. Neutrosophic measure is a generalization of the classical measure for the case when the space contains some indeterminacy. Neutrosophic Integral is defined on neutrosophic measure. Simple examples of neutrosophic integrals are given. (shrink)

The purpose of this article is to show a structural relationship in Dutch between sentences with the main verb "duren" (last) and specifying complements such as een week (a week) or "drie kwartier" (three quarters of an hour) on the one hand, and sentences with Duration Measuring Adverbials such as "gedurende een week" (for a week), "gedurende die week" (lit: for that week) on the other.

While spreading wide-world, the new coronavirus Sars-CoV-2 made changes in many social departments of our society on levels we never thought about and messes with all our cultural habits. Thus, we witnessed that the religious denominations took into consideration changes without precedent in their cultic history and thus dogmatic as well concerning the actual threat of Coronavirus. We saw for example the Roman-Catholic Church who suspended all masses here and there[1] at first or banned the crucial gestures in rituals [to (...) suspend the distribution of Holy Communion from the Chalice[2], to distribute the Eucharist preferably into the hands of the faithful, and to avoid the physical contact from a peaceful handshake, to forego ash crosses on forehead, to suspend placing water in holy water fonts at the entrance of churches, that the churchgoers "refrain" from kissing or touching the cross for veneration, or even cancellation of masses]. We witnessed Buddhist temples and Protestant churches around Korea [at first] and beyond that have also suspended religious gatherings, and so on. In my case, the Romanian Orthodox Church did the same thing[3], but in a controversial way, firstly making some recommendations for its believers [e.g. not to kiss public icons in Churches, but their indoor ones, and receive Holy Communion with teaspoons for single-use]; afterward same Church reconsidered these recommendations and withdrew its decision [perhaps at the pressure of civil fundamentalists]. How can we qualify all these measures and, moreover, the withdrawal on behalf of religious believers, as weakness, populism, diligence, assuming the human limits, or...something else? What would be the correct and coherent answer religion should assume in this particular regard, and especially what are the reasons to qualify it in a way or another? (shrink)
