  1. Law and Morality: An Appraisal of Hart's Concept of Law.John Ezenwankwor - 2013 - Enugu Nigeria: Claretian Communications.
In an attempt to resolve the problem or the marriage between law and morality, Dr. John Ezenwankwor publishes this book, Law and Morality: An Appraisal of Hart's Concept of Law. In it, he delves into a critical analysis of the works of a British legal philosopher, Herbert Lionel Adolphus Hart (1907-1992), who made landmark contributions to the moral and legal questions surrounding human actions or conducts. Incidentally, he surpasses his master, Hart, in this book, (...)

Scholars are grateful to Cyril Lionel Robert James (1901-1989) and Herbert Aptheker (1915-2003) for their pioneering work in the field of slave revolts. What they've virtually never mentioned, however, let alone explored, was Aptheker’s practice of rendering James invisible. It is highly improbable that Aptheker did not know either of James or of his noteworthy study of the Haitian Revolution, given that the latter was related to the slave revolts that Aptheker did study. Aptheker’s neglect of James was (...)

  3. The Hierarchical Model and H. L. A. Hart's Concept of Law.Massimo La Torre - 2013 - Revus 21:141-161.
Law is traditionally related to the practice of command and hierarchy. It seems that a legal rule should immediately establish a relation between a superior and an inferior. This hierarchical and authoritharian view might however be challenged once the phenomenology of the rule is considered from the internal point of view, that is, from the stance of those that can be said to “use” rather than to “suffer” the rules themselves. A practice oriented approach could in this way open up (...)

Evil Law as the Pure Law: Critical Remarks on the Philosophy of Law of H.L.A. Hart.Andrei Nekhaev - 2019 - Tomsk State University Journal 20 (440):72–80.
The article examines the issue of a necessary connection between the phenomena of law and morality. According to legal positiv- ism, morality is not a criterion of the legitimacy for legal norms. The law can have any content including absolutely immoral (the so-called “separability thesis”). Law issues are not connected with discussing the moral merits of a possible judicial decision. They are only closely related to studying various purely legal phenomena like precedents, judicial discretion, legislatures, etc. The ascriptive legal statements (...)

Fifty years ago this year a legal practitioner turned military intelligencer turned philosopher, Herbert Hart, published The Concept of Law, still deservedly best-seller in thought about law. It presents law, especially common law and constitutionally ordered systems such as ours, as a social reality which results from the sharing of ideas and making of decisions that, for good or evil, establish rules of law which are what they are, whether just or unjust. The article is concerned with the general characteristics of Aristotle’s theory of a genus-differentia definition. The authors examine the validity of the definitions in the framework of legal language and present some objections against the definitions of per genus proximum et differentia specificam as they are considered by Aristotle. At the same time, through the objections to the position of genus-differentia definition critics, it is proved that in a number of cases Aristotle’s theory is more preferable than the approach offered (...)

Two currently much discussed views about truth, truth pluralism and truth relativism, are found in Sellars’s writings. I show that his motivations for adoping these views are interestingly different from those shared by most of their recent advocates. First, I explain how Sellars comes to embrace a version of truth pluralism. I argue that his version overcomes a difficulty confronting pluralists, albeit at a serious cost. Then I argue that Sellars’s truth pluralism isn’t motivated by his interest in domains of (...)

Dewey’s book is the first systematic attempt at a pragmatistic logic (since the work of Peirce). Because of the ambiguity of the concept of pragmatism, the author rejects the concept in general. But, if one interprets pragmatism correctly, then this book is ‘through and through Pragmatistic’. What he understands as ‘correct’ will become clear in the following account. The book takes its subject matter far beyond the traditional works on logic. It is a material logic first in the sense that (...)

Brandom's "inferentialism"—his theory that contentfulness consists in being governed by inferential norms—proves dubiously compatible with his own deflationary approach to intentional objectivity. This is because a deflationist argument, adapted from the case of truth to that of correct inference, undermines the criterion of adequacy Brandom employs in motivating inferentialism. Once that constraint is abandoned, moreover, the very constitutive-explanatory availability of Brandom's inferential norms becomes suspect. Yet Brandom intertwines inferentialism with a separate explanatory project, one that in explaining the pragmatic significance (...)

Building on recent work, I present sequent systems for the non-classical logics LP, K3, and FDE with two main virtues. First, derivations closely resemble those in standard Gentzen-style systems. Second, the systems can be obtained by reformulating a classical system using nonstandard sequent structure and simply removing certain structural rules (relatives of exchange and contraction). I clarify two senses in which these logics count as “substructural.”.

Locke's claims about the "inadequacy" of substance-ideas can only be understood once it is recognized that the "sort" represented by such an idea is not wholly determined by the idea's descriptive content. The key to his compromise between classificatory conventionalism and essentialism is his injunction to "perfect" the abstract ideas that serve as "nominal essences." This injunction promotes the pursuit of collections of perceptible qualities that approach ever closer to singling out things that possess some shared explanatory-level constitution. It is (...)

According to traditional logical expressivism, logical operators allow speakers to explicitly endorse claims that are already implicitly endorsed in their discursive practice — endorsed in virtue of that practice’s having instituted certain logical relations. Here, I propose a different version of logical expressivism, according to which the expressive role of logical operators is explained without invoking logical relations at all, but instead in terms of the expression of discursive-practical attitudes. In defense of this alternative, I present a deflationary account of (...)

This chapter first seeks to identify Huw Price's reasons for holding that "object naturalism" can be undermined by "subject-naturalistic" inquiry. It then addresses five questions about how his project bears on the prospects for a liberal naturalism. (1) Does Price’s strategy depend on his requirement that the relevant inquiry into human discourse and thought be conducted in natural-scientific terms? (2) Is Price’s strategy even compatible with that requirement? (3) Does the worldview Price arrives at amount to a liberal naturalism, i.e. (...)

According to both philosophers, I argue, the same idea can simultaneously count as “of” two different objects—in two different senses of the phrase ‘idea of’. One kind of intentional directedness is invoked in answering the question What is it to think that thus-and-so? The other kind is invoked in answering the question What accounts for (...)

According to Roman Ingarden, transcendental idealism prevented Kant from "even undertaking an attempt" at elucidating freedom "in terms of the causal structure of the world." I show that this claim requires qualification. In a remarkable series of Critical-period Reflexionen (5611-4, 5616-9), Kant sketches a defense of the possibility of freedom that differs radically from his published ones by incorporating an indeterministic account of the phenomena. Anticipating Łukasiewicz, he argues that universal causal determination is consistent with an open future: if an (...)

Methodological differentiation is one way in which science expresses dynamism. Such differentiation led to the theological and the natural sciences, and conflicting views regarding the nature of existence: the theological worldview versus the natural worldview. This study is a comparison of the conflicting worldviews of the theological and cosmological theories of the (...)

If each reflection is negative and undermining, does that not give us a diminution of our original belief to nothing? It requires (...)
