The aim of the paper is to provide a philosophical and historical background to current discussions about the changing relationships between the university and the state through revisiting the classical “Humboldtian” model of the university as discussed in classical German philosophy. This historical detour is intended to highlight the cultural rootedness of the modern idea of the university, and its close links to the idea of the modern national state. The paper discusses the idea of the university as it emerges (...) from the philosophy of Wilhelm von Humbold, Johann Gottlieb Fichte and Friedrich Schleiermacher, as well as - in the 20th century - Karl Jaspers and Jürgen Habermas. More detailed questions discussed include the historical pact between the modern university and the modern nation-state, the main principles of the Humboldtian university, the process of the nationalization of European universities, the national aspect of the German idea of culture (Bildung), and the tension between the pursuit of truth and public responsibilities of the modern university. In discussing current and future missions and roles of the institution of the university today, it can be useful to revisit its foundational (modern) German idea. In thinking about its future, it can be constructive to reflect on the evident current tensions between traditional modern expectations of the university and the new expectations intensified by the emergence of knowledge-based societies and market-driven economies. Sprawiedliwość jako cecha działającego podmiotu jest w swej istocie doskonałością całości, doskonałością jego istnienia. Taka doskonałość („dzielność”) całości zakłada sprawność każdego zasadniczego elementu naszego wnętrza – intelektu, woli i uczuć, choć nie jest po prostu sumą doskonałości tych elementów, jest czymś jakościowo różnym. Niemniej jednak Platona ujęcie doskonalenia elementów „wnętrza” człowieka prowadzi do refleksji nad powiązaniem sprawiedliwości z pozostałymi uniwersalnymi wartościami konstytucyjnymi – prawdą, dobrem i pięknem. Dzielnością (cnotą) właściwą intelektowi, symbolizowanemu przez władców Platońskiego państwa, jest mądrość, a ta nie (...) może się obyć bez prawdy. Dzielnością woli, symbolizowanej przez żołnierzy i policjantów, jest odwaga pojmowana przez Platona jako postępowanie zgodne z własnymi, rozumnymi przekonaniami, a takie postępowanie jest fundamentem dobra (moralnego). Uczucia – symbolizowane przez wytwórców – ukierunkowywane, „pociągane” są przez piękno. Krótko, wiedza – ma być prawdziwa, działanie – dobre, a to, co wytwarzane – piękne. To przesłanie Platona dotyczące naszych uniwersalnych wartości konstytucyjnych. To też przesłanie dotyczące celów, których realizacji powinna służyć kultura duchowa – nauka zmierza do prawdy, moralność do dobra, sztuka do piękna. Platon każe przy tym pamiętać, że rozwój kultury nie jest celem samym w sobie, ale służyć powinien tworzeniu warunków rozwoju konkretnego człowieka, w tym tworzeniu warunków do bycia sprawiedliwym. "Philosophical Foundations of Understanding of the Common Good". The central question is whether recognizing the common good as the central value in the new Polish Constitution of 1997, means accepting the primacy of the state over an individual. The answer is negative. The preparatory work to the constitution is analyzed and the philosophical perspective is outlined which corresponds to the intentions of the authors of the constitution. The analyses concentrate on the philosophical tradition reaching from Plato to Aristotle and Thomas (...) Aquinas. /////////////////// W nowej Konstytucji Rzeczypospolitej Polskiej przyjętej w 1997 roku, dobro wspólne jest jedną z fundamentalnych wartości. Centralne pytanie brzmi, czy uznanie dobra wspólnego za wartość fundamentalną, nie jest uznaniem prymatu państwa wobec jednostki, czy nie wprowadza do porządku konstytucyjnego idei totalitarystycznych. Odpowiedź na to pytanie jest negatywna. Argumentując, autor dokonuje analizy prac przygotowawczych do Konstytucji, oraz zmierza do zarysowania filozoficznej perspektywy rozumienia dobra wspólnego, perspektywy odpowiadającej intencjom twórców Konstytucji. Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

Za „ojca” filozoficznej kategorii „godności”, która legła u podstaw kategorii prawnej, uznawany jest powszechnie Immanuel Kant. Przypomnieć jednak trzeba, że w bardzo podobny sposób, choć w zasadniczo odmiennym kontekście systemowym, charakteryzował godność Tomasz z Akwinu, pół tysiąca lat wcześniej, uznając ją za fundament bycia osobą. Stąd najistotniejszym i centralnym elementem, tytułowej, klasycznej koncepcji człowieka jest koncepcja godności. Akwinata jest autorem bodaj najbardziej rozbudowanej koncepcji osoby w tradycji filozofii klasycznej. Co więcej zmierzać będę do wykazania, że jego koncepcja lepiej nadaje się (...) do teoretycznego ugruntowania praw człowieka niż koncepcja Kanta. Rekonstruując propozycję Kanta ograniczam się, zasadniczo rzecz biorąc, do analizy Uzasadnienia metafizyki moralności. Interesować będą mnie zagadnienia podstawowe, przede wszystkim – wynikające z różnicy kontekstów systemowych – różnice w pojmowaniu bycia celem samym w sobie. W perspektywie ontologicznej koncentrować się będę na powiązaniu godności z indywidualnością; w perspektywie antropologicznej – na tym, jakiego typu działania stanowią o doskonałości człowieka, jakie działania (czym określone) realizują człowieka jako cel sam w sobie. W szczególności interesować się będę miejscem rozumu i woli w określaniu treści działań (w perspektywie kantowskiej będzie to pytanie o określenie treści powinności; w perspektywie Tomasza – pytanie o treść realizowanego dobra). Zasadnicze pytanie, które leży u podłoża podjętej problematyki antropologicznej, jest pytaniem o to, na ile dla pojmowania godności istotne jest uznanie woli jako w sposób wolny współokreślającej treść powinności (Kant) lub dobra (Akwinata), a na ile woli jedynie podążającej za poznaną powinnością lub poznanym dobrem. Zmierzać będę do uzasadnienia tezy, że koncepcja Akwinaty w ugruntowaniu godności akcentuje wprost indywidualność opartą na wyborze czegoś, co nie jest jednoznacznie treściowo obiektywnie zdeterminowane i co wykracza poza to, co powszechne, poza to, co gatunkowe; natomiast koncepcja Kanta godność wiąże przede wszystkim z tym, co powszechne, gatunkowe i zapoznaje doniosłość indywidualności dla pojmowania godności. This paper concerns an important and exciting book by Marek Dobrzeniecki Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga [Hiddenness and the Incarnation: A Theistic Response to John L. Schellenberg’s Argument for Divine Nonexistence]. After a brief discussion of the content of the book’s chapters, critical remarks are presented. They concern the adopted method and approach to Schellenberg’s philosophy in general and the argument from hiddenness in particular. The conceptual framework serving as a typologization (...) of the propositional dimension of the phenomenon of theistic belief/faith is dubious and requires in-depth research. It is worth considering the possibility of asymmetry of the attitudes of belief/faith and unbelief, which requires consideration in the reasoning whose legitimacy would assume the transfer of features from one to the other and the negation functor. Regarding the voluntarism of belief in God, the paper suggests that extreme, purely intellectual, and purely volitional positions should be considered, as well as moderate and mixed ones. It is argued extensively that Dobrzeniecki’s criticism against the arguments of Rea and Mourad is not conclusive. Just the possibility of voluntariness of disbelief undermines the validity of Schellenberg’s argument and should therefore be ruled out as much as possible. The paper suggests supplementing Dobrzeniecki’s approach with a ‘trans-paradigmatic’ approach consisting of external criticism, which, in the light of Schellenberg’s arguments being probably incompatible with the described phenomenon of religious belief in God, leads to a modification of the theoretical apparatus of Schellenberg’s paradigm. Such a modification deprives the latter’s argument of justification. --- Niniejszy artykuł dotyczy ważnej i interesującej książki Marka Dobrzenieckiego Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga. Po krótkim omówieniu zawartości poszczególnych rozdziałów książki prezentuję swoje uwagi krytyczne. Dotyczą one przyjętej metody i podejścia do filozofii Schellenberga w ogólności, a argumentu z ukrytości w szczególności. Wątpliwa i wymagająca pogłębionego badania jest siatka pojęciowa pełniąca funkcję typologizacji propozycjonalnego wymiaru fenomenu wiary teistycznej. Warta rozważania jest możliwość niesymetryczności postaw wiary i niewiary, co wymaga uwzględnienia w rozumowaniach, których zasadność zakładałaby przenoszenie cech z jednej na drugą oraz funktora negacji. W sprawie woluntaryzmu wiary w Boga sugeruję, że należy rozpatrywać nie tylko stanowiska skrajne, czysto intelektualistyczne i czysto wolicjonalne, ale także u miarkowane i mieszane. Argumentuję szeroko, że krytyka Dobrzenieckiego skierowana przeciwko argumentom Rea i Mourada nie jest konkluzywna. Argumentuję, że samo możliwość woluntarności niewiary podważa zasadność argumentu Schellenberga i dlatego powinna ona być wykluczona w sposób maksymalnie możliwie uzasadniony. Sugeruję uzupełnienie podejścia Dobrzenieckiego o podejście ‘transparadygmatyczne’ polegające na rodzaju krytyki zewnętrznej, która w świetle nieprzystawania argumentacji Schellenberga do opisywanego fenomenu prowadzi do modyfikacji aparatu teoretycznego paradygmatu Schellenberga. Taka modyfikacja odbiera argumentowi tego ostatniego moc uzasadniającą. (shrink)

Using a close reading of a single clause and its context in a section in A Pluralist Universe, we see the moral dangers James saw in traditional ontology, in particular its relation to war and peace. This analysis opens up James’s combining the personalist philosophy of his friend Borden Bowne (and others) with the pluralism he developed late in his career. This leads, further, to reflection of James’s performative philosophizing. Finding in James a theory of “pluralistic personalism” gives us a (...) fresh look at the far-reaching power of his basic concepts of moral philosophy. (shrink)

Idea powszechności legła u samych podstaw współczesnej ochrony praw człowieka i nadal jest często podkreślana w dyskursie typu praktycznego, na różnych płaszczyznach: politycznej, moralnej czy religijnej. Jednakże trudno o koncepcję praw człowieka pozwalającą pogodzić powszechność z właściwościami prawa, z postulatami respektu dla pluralizmu ugruntowanego tak w odmienności kulturowej, jak i wolności poszczególnych jednostek ludzkich. Wziąwszy pod uwagę, że powszechność jest fundamentalnym przy¬miotem praw człowieka, kłopoty z powszechnością są kłopotami ze zbudowaniem filozoficznej koncepcji praw człowieka w ogóle. Odrzucenie powszechności jest równoznaczne (...) z odrzuceniem podstaw współczesnej koncepcji tych praw. The author poses a question: which of the two fundamental, constitutional values – common good or human dignity – can be considered to be the cornerstone, the unifying value in the Constitution of the Republic of Poland from 1997. The paper shows the crucial reasons for accepting each of these values as primary and also presents the underlying relationships between these values . The prominence of a given value for defining the aim of the constitution and the legal order based (...) on it was accepted as the most important aspect for determining the order of primacy. In respect of the direct aims of activities of public authorities and more broadly – of the aims of subjects whose activities are defined by the constitution – the primary value should be common good understood as certain social conditions of life which support human development. It defines the space in which other constitutional values, also human dignity, are integrated. Human dignity, however, the primary value defining human being, gives the reason why human development is a first and autonomous aim of the constitutional order. In this respect dignity has priority before common good. -/- Autor stawia pytanie o to, którą z fundamentalnych wartości konstytucyjnych – dobro wspólne czy godność człowieka – można uznać za wartość pierwszą i stanowiącą podstawę spójności aksjologicznej Konstytucji RP z 2 kwietnia 1997 roku. Wskazane są zasadnicze racje przemawiające za uznaniem każdej z tych wartości za wartość pierwszą i identyfikowane są zasadnicze relacje zachodzące między tymi wartościami. Za aspekt najistotniejszy dla ustalenia pierwszeństwa którejś z tych wartości uznana jest doniosłość danej wartości dla określenia celu konstytucji i opartego na niej porządku prawnego. Z punktu widzenia bezpośredniego celu działań władzy publicznej i szerzej – podmiotów, których działanie wyznaczone jest porządkiem konstytucyjnym, wartością tą jest dobro wspólne wyznaczające przestrzeń, w której integrowane są inne wartości konstytucyjne, z godnością włącznie. Dobro wspólne jest celem porządku konstytucyjnego ze względu na godność człowieka, która czyni jego rozwój pierwszym i szczególnym – autotelicznym dobrem. According to The Consensus Gentium Argument from the premise: “Everyone believes that God exists” one can conclude that God does exist. In my paper I analyze two ways of defending the claim that somebody’s belief in God is a prima facie reason to believe. Kelly takes the fact of the commonness of the belief in God as a datum to explain and argues that the best explanation has to indicate the truthfulness of the theistic belief. Trinkaus Zagzebski grounds her defence (...) on rationality of epistemic trust in others. In the paper I argue that the second line of reasoning is more promising and I propose its improved version. The aim of this paper is to present and analyse legal acts cited in the European Parliament resolution of 20 January 2011 on the situation of Christians in the context of freedom of religion. The author presents the substance of the right to religious freedom and the position of religious freedom among other human rights. The paper also shows the formation of European law on religious freedom and grasps the development trends in this area. Because of the discrepancies that arise (...) when translating the same foreign terms into the Polish language, in order to better explain the content of the cited documents, the texts are also given in English language. The article is the summary of basic legal regulations relevant to reflect on religious freedom at EU level. Compiled materials may be useful to continue the reflection on religious freedom. (shrink)

I think that there is an awful lot wrong with the exclusion problem. So, it seems, does just about everybody else. But of course everyone disagrees about exactly _what_ is wrong with it, and I think there is more to be said about that. So I propose to say a few more words about why the exclusion problem is not really a problem after all—at least, not for the nonreductive physicalist. The genuine _dualist_ is still in trouble. Indeed, one of (...) my main points will be that the nonreductive physicalist is in a rather different position vis à vis the exclusion problem than the dualist is. Properly understanding nonreductive physicalism—and clearly recognizing that it is, after all, a form of _physicalism_—goes a long way toward solving the exclusion problem. (shrink)

The paper presents some historical (Plato, Aristotle, Plotin, Augustine, Boethius, Aquinas) and main contemporary topics about different accounts of goodness of God understood as ontological goodness, perfection and as ethical goodness - impeccability and benevolence. The arguments for goodness of God are presented, mainly from stance of Thomas Aquinas classical theism as well as arguments against compatibility of essential goodness and omnipotence (N. Pike) and being an moral agent. The article draws perspective of different philosophical issues connected with goodness of (...) If history—our past, the sum of our thoughts, passions, and deeds—is so pervasive, influential, and meaningful, why then do we lose sight of it? Why do we not gain good values from it? And if it is part of our existential core, why then do we so often fail to ravel it into our deliberations? I propose that very often and to a great degree it is shame that separates us from history.

Our cultural situation is to seek a moral form of self-constitution, rather than an ontological or epistemological foundation. Such a moral ground lies in the paradox of willing surrender of the will to do wrong or dysfunctional acts in order to enter temporally-extended processes of moral change. But the paradox of willing surrender of the will requires analysis. The propositional form of it cannot be sustained and must instead give way to willingness as an ongoing choice. The self-reflexivity of the (...) will with which we accomplish this turns out to be a core activity of human activity that seeks openness to moral growth through humility. The paper suggests that self-constitution in this manner this is what freedom is for us and is therefore the source of our hope. (shrink)

Agent-based models have played a prominent role in recent debates about the merits of democracy. In particular, the formal model of Lu Hong and Scott Page and the associated “diversity trumps ability” result has typically been seen to support the epistemic virtues of democracy over epistocracy (i.e., governance by experts). In this paper we first identify the modeling choices embodied in the original formal model and then critique the application of the Hong-Page results to philosophical debates on the relative merits (...) of democracy. In particular we argue that the “best-performing agents” in Hong-Page model should not be interpreted as experts. We next explore a closely related model in which best-performing agents are more plausibly seen as experts and show that the diversity trumps ability result fails to hold. However, with changes in other parameters (such as the deliberation dynamic) the diversity trumps ability result is restored. The sensitivity of this result to parameter choices illustrates the complexity of the link between formal modeling and more general philosophical claims; we use this debate as a platform for a more general discussion of when and how agent-based models can contribute to philosophical discussions. Descriptions of bodies within the literature of the enactive approach to cognitive science exhibit an interesting dialectical tension. On the one hand, a body is considered to be a unity which instantiates an identity, forming an intrinsic basis for value. On the other, a living body is in a reciprocally defining relationship with the environment, and is therefore immersed and entangled with, rather than distinct from, its environment. In this paper I examine this tension, and its implications for the enactive (...) approach, particularly the enactive conceptions of life and bodies. Following the lead of others, I argue that enactive cognitive science can benefit from a deeper reading and integration with extant work on the complexity and multiplicity of the living body within feminist philosophy and feminist science studies. Práce se zaměřuje na metodologicko-historické aspekty vývoje neurologie. V roce 2001 přišel Marcus Raichle s překvapujícím objevem, který je nyní obecně známý jako teorie Default Mode Network. DMN s sebou kromě nových poznatků o mozkové aktivitě přináší i kompletní přehodnocení dosavadních přesvědčení o mozku. Vědecká komunita předpokládala, že mozek je „reflexivním" nástrojem k vnějšímu prostředí a od tohoto přesvědčení odvíjela neurologický výzkum. DMN však přichází s pojetím neurální aktivity, jež není závislá na aktivní stimulaci mozku, což je v přímém protikladu (...) s předchozí výzkumnou tradicí. Současné výzkumy DMN vedou ke zcela novým poznatkům, které nebyly dosažitelné v rámci předchozího paradigmatu. Radikální proměna pojetí aktivity mozku s sebou přináší i nutnost přehodnocení neurologického výzkumu z hlediska metodologie. Stať se zabývá otázkou, zda lze považovat DMN za vědeckou revoluci a nové paradigma neurovědy v kontextu analýzy historických událostí, jež formovaly předchozí a stávající neurovědecký výzkum. In the last two decades, major cities in Malaysia have witnessed a spate of urban redevelopment including commercial and retail complexes, and residential estates. The current urban transformations taking place in Malaysian cities are mainly market-driven and characterized by fast-track development with a strong priority on the road infrastructure. This is a typical example of an intensive property-led development that is becoming a central driver of the national economy. This article provides a deeper understanding of the complexity of urban development (...) in Malaysia. Here, the major aim is to understand the Malaysian cities' transitions in the trajectory of their colonial past, national identity, multi-cultural community, culture, and religion. Focusing on South East Asian urbanism, this article determines how internal and external forces and global trends such as neoliberalism and property-led development affect the transformation of urban landscapes and expansions in Malaysia. The outcomes of this paper will indicate how much property-led development and globalisation have affected the traditional and tropical climate-responsive urban environment in Malaysia. It will also identify sustainable design and planning measures that should be implemented in the cities of Malaysia to combat the ill-effects of globalisation. (shrink)

The text—drawing inspiration from the tale of the three waves in Plato᾿s Republic—focuses on the final journey of Odysseus, foretold by Homer’s Teiresias in the Odyssey. This journey—undertaken alone with an oar on his shoulder to a land where people know nothing of the sea—represents a stage in the path of moral maturation, essential for achieving a serene old age, concluded with a gentle death among happy people, and a fulfilled life. It symbolizes the path to a confrontation with something (...) beyond ordinary experience. Plato points to the need for a similar journey, as in the Allegory of the Cave, where the most important lessons are learned not from others but through individual effort, by turning away from what we know in everyday life. At the end of his final journey, Odysseus is to face the question of whether the oar he carries, symbolizing the hardships of his journey back from Troy to Ithaca, is in fact a winnowing fan—a farming tool used to separate the grain from the chaff. The final journey is essential to—using Plato’s language—achieving inner harmony, which is the basis of justice, a virtue Odysseus appears not to have fully attained before this journey. (shrink)

This paper advances a fresh theorization of historicity. The word and concept of historicity has become so widespread and popular that they have ceased to have definite meaning and are used to stand for unsupported notions of the values inherent in human experience. This paper attempts to repair the concept by re-defining it as the temporal aspect of the interdependence of life; having history is to have a life intertwined with the lives of all others and with the universe. After (...) separating out the looser uses, surveying some of the literature, and defining what needs to be done, the paper examines shortcomings in the very different and widely influential conceptions of historicity of Koselleck and Heidegger. It then advances a new conception and fits it into the theoretical and moral capabilities of the philosophy of history as a core of philosophical anthropology. (shrink)

This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of this expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the different concepts of dignity encompass dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve different concepts of dignity, and thus twelve types of dignity. Half of (...) them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law. They were considered in the essay Godność jako właściwość osoby. Typy godności – propozycja systematyzacji [Dignity as a Quality of Person – a Proposed Systematisation]. This group of meanings includes three concepts of dignity which recognize dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. The second group of meanings, treating dignity as something with which the human being (the person) is endowed, includes concepts which encompass (4) personal dignity (honour and good reputation), (5) dignity as moral excellence, and (6) dignity as appropriateness of attitude or behaviour. -/- Dignity as an attribute of collective entities and dignity as an institutionally grounded attribute are a subject of this paper. The Constitution of the Republic of Poland speaks of (1) the dignity of the Nation, (2) the dignity of office or function, and (3) public dignity. The expression “the dignity of the Nation” can be understood in four different ways: (i) analogously to the understanding of dignity of the person, (ii) of personal dignity, (iii) of dignity as moral excellence, and (iv) of dignity as appropriateness of attitude or behaviour. The expression “dignity” when designating something institutionally grounded can designate (4) the dignity of social roles, (5) the dignity of a profession, and – specifically to the Polish language – (6) dignity meaning a surname. -/- The author argues that it is unacceptable to ascribe different concepts of dignity to the expression “dignity” appearing in a specific legal provision. One central argument in favor of perceptual accounts of emotions concerns recalcitrant emotions: emotions that persist in the face of repudiating judgments. For, it is argued, to understand how the conflict between recalcitrant emotions and judgment falls short of incoherence in judgment, we need to understand recalcitrant emotions to be something like perceptual illusions of value, so that in normal, non-recalcitrant cases emotions are non-illusory perceptions of value. I argue that these arguments fail and that a closer examination of recalcitrant (...) emotions reveals important disanalogies with perception that undermine the perceptual model of emotions. I deal with the epistemological uniqueness of experiments in the sense of their irreducibility to other sources of justification. In particular, I criticize an influential argument for the irreducibility of thought experiments to general arguments. First, I introduce the radical empiricist theory of eliminativism, which considers thought experiments to be rhetorically modified arguments, uninteresting from the epistemological point of view. Second, I present objections to the (...) theory, focusing on the critique of eliminativism by Tamar Szabó Gendler based on the reconstruction of famous Galileo's Pisa experiment. I show that her reconstruction is simplistic and that more elaborate reconstruction is needed for an appropriate assessment of the epistemic power of general argument. I propose such a reconstruction and demonstrate that general version of Pisa experiment is epistemically equal to the particular one. Thus, from an epistemological perspective, Galileo's thought experiment is reducible to a straightforward argument without particular premises. (shrink)

A report on Cornel West's Edinburgh Gifford Lectures 2024: "A Jazz-soaked Philosophy for our Catastrophic Times: From Socrates to Coltrane".

The paper links higher education reforms and welfare states reforms in postcommunist Central European countries. It links current higher education debates (and reform pressures) and public sector debates (and reform pressures), stressing the importance of communist-era legacies in both areas. It refers to existing typologies of both higher education governance and welfare state regimes and concludes that the lack of the inclusion of Central Europe in any of them is a serious theoretical drawback in comparative social research. The region should (...) still, after more than two decades of transition and heavy international policy advising, be viewed as a “laboratory of social experimentation”. It is still too risky to suggest generalizations about how Central European higher education and welfare systems fit existing typologies. Consequently, the “transition” period is by no means over: it is over in terms of politics and economics but not in terms of social arrangements. Both higher education and welfare states should be viewed as “work in progress”: permanently under reform pressures, and with unclear future. (shrink)

Surveying nearly seven decades of habitual and obsessive reading, I consider how my character and psychology used reading to shape philosophical questions that move me into forms in which I could pursue them by reading. This became both the method and the substance of my philosophical work. It preserved some core emotional issues but also gave me the way to integrate them into scholarship and into my life.

Tato studie se snaží o filosofickou analýzu problematických aspektů neurogeneze. V první řadě se zaměřuje na moderní historii neurogeneze, která je obecně považována za historii dogmatického přesvědčení, které předpokládalo, že v mozku dospělého savce nemohou vzniknout nové neurony. Tato konvence přežívala v neurovědě po několik desítek let a její kořeny sahají až do dob Ramóna y Cajala. Důležitá část této filosofické analýzy se zaměřuje na aspekt tzv. zaštiťování dogmatu pomocí ad hoc hypotéz. Analýza se dále věnuje implicitním definicím, které hrají (...) roli axiomů neurovědy, a problematice falsifikace potenciálních falsifikátorů. Na konci této filosofické analýzy jsou prezentovány argumenty, které dospívají k tomu, že historie neurogeneze není historií dogmatického uvažování, jak většina autorů předpokládá, ale že jde o historii vědeckého pragmatismu. Perceptual modalities have been traditionally considered the product of dedicated biological systems producing information for higher cognitive processing. Psychological and neuropsychological evidence is offered which undermines this point of view and an alternative account of modality from the enactive approach to understanding cognition is suggested. Under this view, a perceptual modality is a stable form of perception which is structured not just by the biological sensitivities of the agent, but by their goals and the set of skills or expertise which (...) they are deploying at a given time. Such a view suggests that there is no such thing as an experience that is purely visual, auditory, or otherwise modal and that our attempts to understand consciousness and the mind must be conducted within a framework that provides an account of embodied, goal-directed adaptive coping with the world. Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral assessments (...) may have the nature of judgments and truth qualification (they may be true or false). In the course of application of the constitution, norms of natural-law character and natural-law justification. Since dignity and the essence of freedoms and rights based on dignity are the only inviolable values recognized by the constitution, the arguments of natural law lead to a far-going reinterpretation of constitutional norms. The norm of natural law protecting inviolable values will have precedence in the event of collision with norms protecting other values, also with constitutional norms. Even if such a norm is formulated on the basis of the provisions of the constitution, in fact natural law is given higher rank than elements based only on enacted law. Despite that, reliability of a legally established order does not seem to be radically endangered. -/- Konstytucja RP uznając przyrodzoność i niezbywalność godności oraz uniwersalność niektórych wartości, wprowadza do podstaw całego polskiego systemu prawnego elementy prawnonaturalne, które mogą być wykorzystane w stosowaniu konstytucji. Konstytucyjne uznanie takich elementów ma sens przy założeniu ich poznawalności, stąd istotnym elementem konstytucyjnej koncepcji prawa naturalnego jest uznanie tezy kognitywizmu głoszącej, że oceny moralne mogą mieć charakter sądów i kwalifikację prawdziwościową – mogą być prawdziwe lub fałszywe. W procesie stosowania konstytucji mogą być formułowane normy o charakterze prawnonaturalnym oraz uzasadnienia prawnonaturalne. Ponieważ jedynymi wartościami uznanymi w konstytucji za nienaruszalne jest godność oraz istota wolności i praw, których godność jest źródłem, argumentacja prawnonaturalna może prowadzić do daleko idącej reinterpretacji norm konstytucyjnych. Norma prawnonaturalna chroniąca warunki konieczne poszanowania godności lub istoty wolności i praw będzie miała pierwszeństwo w razie kolizji z normami chroniącymi inne wartości, także z normami konstytucyjnymi. Choć norma taka będzie formułowana na podstawie przepisów konstytucji, to jednak faktycznie prawo naturalne uzyskuje wyższą rangę od elementów opartych jedynie na stanowieniu. Mimo tego bezpieczeństwo prawne nie wydaje się być radykalnie zagrożone. O prawnonaturalnym charakterze normy i uzasadnienia decyduje oparcie w ocenach moralnych, które pretendują do bycia sądami, do bycia prawdziwymi lub fałszywymi. Z punktu widzenia stosowania konstytucji i wymogu intersubiektywnej komunikowalności i kontrolowalności dookreślania treści prawnonaturalnych, dla nadania ocenom charakteru sądów istotny jest kształt procedur i argumentacji prowadzących do tego dookreślenia. Powinny to być procedury i argumentacja typowe dla dyskursu mającego na celu sformułowanie prawdziwych sądów. Maksymalizowana powinna być dyskursywność takich procedur, a podstawą rozstrzygnięcia powinien być, jeśli to tylko możliwe, konsens. Nie mogą być uważane za rozstrzygające argumenty odwołujące się do woli indywidualnej lub zbiorowej, reakcji emocjonalnych, stopnia rozpowszechnienia danej oceny czy do tradycji kulturowej. (shrink)

The study aims at making explicit the three spheres or planes, essential from the point of view of semiotics, on which the discourse regarding dignity takes place, and at clarifying the relations between these planes. The analysis uses the conception of Kazimierz Ajdukiewicz. There are three principal areas in which the discourse on dignity is conducted – the plane of linguistic expressions on which the name “dignity” is used; the plane of meanings on which the notion of dignity is placed; (...) and the plane of objects on which there is dignity itself. There is a relationship of meaning between the different concepts of dignity and the expression “dignity”, a relationship of signification between expression “dignity” and dignity as its referent, and a relationship of apprehension between the concepts of dignity and their referents. Problem of Axiological Legitimization of the Universal System of the Protection of Human Rights Summary In this paper it is argued that legitimization of the universal system (UN-system) of the protection of human rights depends primary not from the content of values recognised as fundamental but rather from metaaxiological solutions related to the way of existence and to the possibility of cognition of these values. Legitimisation is based on the recognition of an objective nature and of cognoscibility of basic values. (...) Realisation of the primary aim of this paper is linked to the problem of different meanings of the notion of universality, used in the context of the universal system of the protection of human rights. First, descriptive and normative (prescriptive) meanings have to be distinguished. In the case of normative sense, there are moral and legal meanings of “universality”. An axiological justification of the universality of human rights in the legal sense leads to the legitimisation of the universal system. It is shown that modifications of – broadly accepted in the Polish theory of law – definitions of an axiological justification of legal norms are needed. These definitions base such a justification on the valuations made by particular groups of subjects. It is argued that it is much more convenient to refer to valuations understood as meanings of sentences of certain kind. -/- Streszczenie W artykule zmierza się do uzasadnienia tezy, że legitymizacja uniwersalnego systemu ochrony praw człowieka jest oparta nie tyle na treści wartości uznawanych w tym systemie, ale na uznanych w nich rozstrzygnięciach metaaksjologicznych, dotyczących tego, jak istnieją wartości podstawowe dla tego systemu i czy są one poznawalne. Walor legitymizacyjny posiada przede wszystkim uznanie obiektywnego charakteru tych wartości i ich poznawalności (uznanie kognitywizmu aksjologicznego). Realizacja zasadniczego celu zakłada uporządkowanie podstawowych pojęć dotyczących problematyki powszechności praw człowieka – termin „powszechność” stosowany w odniesieniu do praw człowieka w kontekście uniwersalnego systemu ochrony ma wiele znaczeń. Przede wszystkim odróżnić trzeba powszechność w aspekcie opisowym i w aspekcie normatywnym. W przypadku powszechności w aspekcie normatywnym w grę może wchodzić powszechność w sensie ideowym (moralnym) i powszechność w sensie pozytywnoprawnym. Uzasadnienie tej ostatniej jest też uzasadnieniem poszukiwanej tu legitymizacji uniwersalnego systemu ochrony praw człowieka. Prowadzone analizy prowadza także do sformułowania postulatów dotyczących sposobu definiowania uzasadnienia aksjologicznego norm prawnych. Modyfikacji wymagają powszechnie przyjmowane w polskiej teorii prawa definicje relatywizujące takie uzasadnienie do ocen przyjmowanych przez konkretne podmioty oceniające lub ich grupy. (shrink)

Thought experiments are frequently vague and obscure hypothetical scenarios that are difficult to assess. The paper proposes a simple model of thought experiments. In the first part, I introduce two contemporary frameworks for thought experiment analysis: an experimentalist approach that relies on similarities between real and thought experiment, and a reasonist approach focusing on the answers provided by thought experimenting. Further, I articulate a minimalist approach in which thought experiment is considered strictly as doxastic mechanism based on imagination. I introduce (...) the basic analytical tool that allows us to differentiate an experimental core from an attached argumentation. The last section is reserved for discussion. I address several possible questions concerning adequacy of minimalistic definition and analysis. (shrink)

The article deals with relations between the individual and human rights on the one hand, and the State on the other, in the context of the Constitution of the Republic of Poland. The author poses the question whether the idea of subordination of the State to the individual is really a central idea of that constitution. He puts forward many arguments against such suggestion. These arguments relate, above all, to the arrangement of the constitution: a chapter concerning human rights is (...) chapter II, while chapter I deals with foundation of the State; the goals of the State are specified in the preamble including the following initial phrase “the existence and future of Poland as our Homeland” and in Article 5 where human rights are as subject of protection by the State is mentioned after independence and integrity of [its] territory; a general concept of human rights protection adopted in the constitution is dominated by the structures typical of law in its objective sense; the way of regulation admissible limitations on human rights differs from international standards; possibility of claiming human rights is constitutionally guaranteed, mostly by constitutional complaint which is above all aimed at correction of legal system, rather than claiming of rights by the individual; Article 1 (“The Republic of Poland shall be the common good of all its citizens”) interpreted as referring to Article 1 paragraph 1 of the April Constitution of 1935, one of the main ideas of which was precedence of the State over the individual. He also analyses the arguments in favour of the recognition of the idea of subordination of the State. Nevertheless, they cannot be accepted as resolving the question of whether it is a central idea of the constitution. These arguments include in particular: the principle of subsidiarity contained in the preamble, even if it has not been appropriately emphasized there; recognition of inherent and inalienable dignity of the person, but it was not until Article 30 that this provision has been contained and it does not determine the relations between the human dignity and rights and the State. The author suggests that the only conclusive way to justify the subordination of the State in relation to the individual as a central idea of the constitution is by means of Article 1. Taking into account, above all, preparatory work, we should reject the interpretation of that article referring to the April (1935) Constitution. Essential interpretative context may be found in preparatory work and social teachings of the Catholic Church, referred to therein. In that case, the common good means the entirety of the conditions of social life which favour the human development. These conditions include above all the respect for human dignity. Such interpretation of Article 1 gives priority to proposals on what the State should be to serve the individual rather than to safeguard obligations of citizens in relation to the State. (shrink)

This article first of all attempts to assess the proposals of 2006–2007 to amend Poland’s Constitution, aimed mostly at strengthening constitutional protection of unborn human life. Parliamentary work on this proposal begins with the submission of the Deputy’s bill on amendment of the Constitution, published in the Sejm Paper No. 993 of September 5, 2006, and ends with a series of votes at the 39th sitting of the Sejm of the fifth term of office, held on April 13, 2007, on (...) which it was decided not to adopt any amendment. In the course of the legislative process, several modifi cation were offered not only to Article 38 concerning protection of life, but also to Article 30 dealing with dignity as a source of rights. Each of these proposals had drawbacks, including inter alia: the lack of a definite period of protection or entitlement to dignity, resulting in the decreased protection in relation to issues concerning euthanasia; the application of new categories granting a specific status to unborn human life; specifying the standards for protection by means of legislative acts ranking lower than a constitution, resulting in the transfer of life protection into the sphere of regulation of ordinary legislation. The most conducive for strengthening of the protection of unborn human life, even if not free of imperfections, was an amendment of Article 30 proposed by the Committee in the following wording: “The inherent and inalienable dignity, conferred on the person from the moment of conception, shall be a source of freedoms and rights of persons and citizens. It shall be inviolable; the respect and protection thereof shall be the obligation of public authorities.” From the rejection of the proposals it is diffi cult to draw conclusions that are vital for interpretation of the existing provisions. However, a conclusion that the intention of the authors of the constitution was not to strengthen the constitutional protection of life is not legitimate, mostly because of their doubts about formal correctness of the proposed amendments (when deciding to reject them), particularly the doubts about legal consequences of their adoption. -/- Streszczenie Zasadniczym celem opracowania jest próba całościowej oceny propozycji nowelizacji Konstytucji RP mającej miejsce w latach 2006-2007, zmierzającej przede wszystkim do wzmocnienia konstytucyjnej ochrony życia człowieka przed narodzeniem. Prace parlamentarne nad analizowaną nowelizacją otwiera poselski projekt ustawy o zmianie Konstytucji zawarty w druku sejmowym 993 z dnia 5 września 2006 (projekt wpłynął do Sejmu 7 września); zamyka seria głosowań na 39 posiedzeniu Sejmu V kadencji, dnia 13 kwietnia 2007 roku; głosowań, które przesądziły o niewprowadzeniu żadnych zmian. W trakcie procesu legislacyjnego proponowano szereg formuł, zmieniających nie tylko art. 38 dotyczący ochrony życia, ale także art. 30, który dotyczy godności jako źródła praw. W zasadzie wszystkie zgłoszone propozycje posiadały wady, wśród których najważniejsze to: brak domknięcia okresu ochrony lub przysługiwania godności, skutkujący obniżeniem ochrony w kwestiach związanych z eutanazją; stosowanie nowych kategorii, prowadzące do nadania specyficznego statusu człowiekowi przed narodzeniem; określanie standardu ochrony za pośrednictwem aktów o randze niższej od konstytucji, prowadzące do przesunięcia ochrony życia przed narodzeniem w sferę ustawodawstwa zwykłego. Z punktu widzenia celu, jakim było wzmocnienie konstytucyjnej ochrony życia człowieka przed narodzeniem i wzmocnienie jego pozycji prawnej, najlepsza, choć nie pozbawiona usterek, była zaproponowana przez Komisję zmiana brzmienia art. 30 prowadząca do formuły: „Źródłem wolności i praw człowieka i obywatela jest przyrodzona i niezbywalna godność człowieka, przynależna mu od chwili poczęcia. Jest ona nienaruszalna, a jej poszanowanie i ochrona jest obowiązkiem władz publicznych.”. Na podstawie odrzucenia propozycji zmian trudno wyciągać wnioski istotne dla interpretacji aktualnie obowiązujących przepisów; wniosek, że ustrojodawca nie chciał wzmocnienia konstytucyjnej ochrony życie nie jest prawomocny, przede wszystkim ze względu na – istotne w procesie podejmowania decyzji o odrzuceniu propozycji zmian – wątpliwości, co do formalnej poprawności formułowanych propozycji, w tym wątpliwości co do konsekwencji prawnych ich przyjęcia. Philosophical accounts of freedom typically fail to capture an important kind of freedom—freedom to change what one cares about—that is central to our understanding of what it is to be a person. This paper articulates this kind of freedom more clearly, distinguishing it from freedom of action and freedom of the will, and gives an account of how it is possible. Central to this account is an understanding of the role of emotions in determining what we value, thus motivating a (...) rethinking of the importance of emotions in the mental lives of persons. Studie se věnuje čtyřem astronomickým pomůckám, které vytvořil a užíval Gerbert z Aurillacu, remešský a ravennský arcibiskup, opat v Bobbiu a v letech 999–1003 papež. Gerbert vyučoval quadrivium především v Remeši a od jeho žáka Richera z Remeše a z Gerbertových dopisů víme o čtyřech jeho přístrojích, které poskytovaly srozumitelný a názorný úvod do geocentrického výkladu veškerenstva: 1. glóbus světové sféry s nastavitelným horizontem; 2. pozorovací hemisféra s pěti rovnoběžnými kruhy světové sféry ; 3. armilární sféra s vnitřním umístěním ekliptiky (...) a oběžných drah planet; 4. armilární sféra s vnějším umístěním hvězd a souhvězdí.
