The main aim of my paper is to analyse Aristotle’s theory of language in the context of his Physics I.1 and via an analysis and an interpretation of this part of his Physics I try to show that (i) the study of human language (logos) significantly falls within the competence of Aristotle’s physics (i.e. natural philosophy), (ii) we can find the results of such (physical) inquiry in Aristotle’s zoological writings, stated in the forms of the first principles, causes and elements (...) of the human speech (logos) and (iii) the analogies (Phys. 184b13-14) made by Aristotle at the very end of the first chapter make better sense if we consider them in the broader context in which Aristotle recognizes language as a complex natural phenomenon we are born into and which has to be not only biologically, but also socially developed through our lives. The nationwide economic reform in 1986 transformed Vietnam from a centrally planned economy to a socialist-oriented market economy. Entrepreneurs and entrepreneurial spirits within the populace are suggested to fuel the structural changes. Despite the importance of entrepreneurship in Vietnam’s economy, studies in Vietnam mainly pay attention to the practical aspects of entrepreneurial activities and neglect the cognitive and theoretical aspects of entrepreneurship. Thus, the current study employs the information-processing perspective of the Mindsponge Theory to explore how entrepreneurs’ knowledge accumulation can (...) affect their perceived likelihood of business success. Bayesian analysis indicates that business-related experience positively affects entrepreneurs’ business success likelihood. Greater willingness/readiness to transform thinking, acting, and beliefs can improve the business success of entrepreneurs who study others’ failures carefully. However, for entrepreneurs who perceive learning from others’ failures as unnecessary, higher willingness/readiness to transform diminishes their chance of success. Based on these findings, we recommend Vietnamese entrepreneurs accumulate knowledge through experience, learning, and an open mind for better decision-making and innovation creation capabilities. In the global fight against the rapid spread of COVID-19, a variety of unprecedented preventive measures have been implemented across the globe, as well as in Vietnam. How Vietnamese people respond to threats to their health and life remains unclear. For this reason, the current study aims to examine Vietnamese people’s protective behavior and its factors. Based on 1,798 online survey respondents’ data collected on the last three days of the nationwide social distancing campaign in mid-April, it is found that (...) gender, knowledge of COVID-19 and preventive measures, and attitudes towards the COVID-19 prevention policies are the three main factors of participants’ protective behaviors. We also find that males are less likely than females to adopt precautionary measures. People who are knowledgeable about COVID-19 may have inappropriate practices towards it. Further research is needed to examine other determinants of protective behaviors to provide more useful information for authorities, public health policy-makers, and healthcare workers to deliver the best practices to control COVID-19 in our country. Austere relationism rejects the orthodox analysis of hallucinations and illusions as incorrect perceptual representations. In this article, I argue that illusions of optimal motion present a serious challenge for this view. First, I submit that austere-relationist accounts of misleading experiences cannot be adapted to account for IOMs. Second, I show that any attempt at elucidating IOMs within an austere-relationist framework undermines the claim that perceptual experiences fundamentally involve relations to mind-independent objects. In the mid-seventeenth century a movement of self-styled experimental philosophers emerged in Britain. Originating in the discipline of natural philosophy amongst Fellows of the fledgling Royal Society of London, it soon spread to medicine and by the eighteenth century had impacted moral and political philosophy and even aesthetics. Early modern experimental philosophers gave epistemic priority to observation and experiment over theorising and speculation. They decried the use of hypotheses and system-building without recourse to experiment and, in some quarters, developed a (...) philosophy of experiment. The movement spread to the Netherlands and France in the early eighteenth century and later impacted Germany. Its important role in early modern philosophy was subsequently eclipsed by the widespread adoption of the Kantian historiography of modern philosophy, which emphasised the distinction between rationalism and empiricism and had no place for the historical phenomenon of early modern experimental philosophy. The re-emergence of interest in early modern experimental philosophy roughly coincided with the development of contemporary x-phi and there are some important similarities between the two. (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

Plausibly, how much is at stake in some salient practical task can affect how generously people ascribe knowledge of task-relevant facts. There is a metaphysical puzzle about this phenomenon, and an empirical puzzle. Metaphysically: there are competing theories about when and how practical stakes affect whether it is correct to ascribe knowledge. Which of these theories is the right one? Empirically: experimental philosophy has struggled to find a stakes-effect on people’s knowledge ascriptions. Is the alleged phenomenon just a (...) philosopher’s fantasy? I propose a new psychological account of when and why people’s knowledge ascriptions are sensitive to stakes. My hypothesis is motivated by empirical research on how people’s judgements are sensitive to their social context. Specifically, people’s evaluations are sensitive to their ‘psychological distance’ from the scenarios they are considering. When using ‘fixed-evidence probes’, experimental philosophy has found that what’s at stake for a fictional character in a made-up scenario has little or no effect on how participants ascribe knowledge to them. My hypothesis predicts this finding: the scenarios are too ‘psychologically distant’ to participants. Our empirical puzzle is resolved: the stakes-effect often present in the wild won’t be present in vignette studies. (This illustrates a widespread problem with X-phi vignette studies: if people might judge differently in other social contexts, we can’t generalize from the results of these experiments. That is, vignette studies are of doubtful ‘external validity’.) The hypothesis also resolves our metaphysical puzzle. It predicts that people do not ascribe knowledge in a way deemed correct by any of the standard philosophical views, namely classical invariantism, interest-relative invariantism, and contextualism. Our knowledge ascriptions shift around in the way that’s most useful for social beings like us, and this pattern in our judgements can only be endorsed by a genuinely relativist metaphysics for knowledge. The rise of experimental philosophy has placed metaphilosophical questions, particularly those concerning concepts, at the center of philosophical attention. X-phi offers empirically rigorous methods for identifying conceptual content, but what exactly it contributes towards evaluating conceptual content remains unclear. We show how x-phi complements Rudolf Carnap’s underappreciated methodology for concept determination, explication. This clarifies and extends x-phi’s positive philosophical import, and also exhibits explication’s broad appeal. But there is a potential problem: Carnap’s account of explication was limited to empirical and (...) logical concepts, but many concepts of interest to philosophers are essentially normative. With formal epistemology as a case study, we show how x-phi assisted explication can apply to normative domains. (shrink)

This paper discusses “impartiality thought experiments”, i.e., thought experiments that attempt to generate intuitions which are unaffected by personal characteristics such as age, gender or race. We focus on the most prominent impartiality thought experiment, the Veil of Ignorance (VOI), and show that both in its original Rawlsian version and in a more generic version, empirical investigations can be normatively relevant in two ways: First, on the assumption that the VOI is effective and robust, if subjects dominantly favor a certain (...) normative judgment behind the VOI this provides evidence in favor of that judgment; if, on the other hand, they do not dominantly favor a judgment this reduces our justification for it. Second, empirical investigations can also contribute to assessing the effectiveness and robustness of the VOI in the first place, thereby supporting or undermining its applications across the board. It is the editorial for the first issue of the second volume of the journal Theology and Philosophy of Education. The journal’s logo is described and interpreted here in the context of the journal’s aim. All the texts of the offered issue are briefly introduced here.

Ad hoc concepts feature prominently in lexical pragmatics. A speaker can use a word or phrase to communicate an ad hoc concept that is different from the lexically encoded concept and the hearer can construct the intended ad hoc concept pragmatically during utterance comprehension. I argue that some philosophical concepts have origins as ad hoc concepts, and such concepts pose a challenge for experimental philosophy regarding these concepts. To illustrate this, I consider philosophers’ ‘what-it’s-like’-concepts and experimental philosophy of consciousness.

Purpose. The research is aimed at determining the influence of negative ethical emotions on social life and the activity of the individual, which involves solving the following problems: a) to find out approaches to the typology of ethical emotions, b) to highlight individual negative ethical emotions and to determine their ability to influence human behaviour. Theoretical basis. The theoretical and methodological basis of the research is the recognition of the significant influence of negative emotions on human activity in society. In (...) this regard, it is proposed to consider them as a complex multidisciplinary phenomenon, which is predetermined by both social and personal factors of origin and has a certain specificity of objectification. Originality. The authors determined that in addition to destructive effects on a person of negative emotions, they can also have a constructive effect on person’s behaviour, due primarily to the fact that a person does not want to experience these emotions and therefore tries to avoid situations they cause. Conclusions. The ethical emotions of guilt, embarrassment, anger, disgust and contempt can affect, through the cognitive aspect of the emotional process, the decision-making process of people when they predict situations in which they risk to feel such emotions. So the emotion of guilt creates a constructive setup aimed at correcting inappropriate social norms of human behaviour. The emotion of embarrassment motivates a person to behave more benevolently in society in order to integrate in it and get its approval, thus encouraging the person to adhere to social and moral agreements and norms. The emotion of anger motivates a person to act to eliminate injustice, herewith not only in relation to himself, but also in relation to others. Rejecting those people who cause moral and social aversion, society creates a system of punishments and rewards that acts as a strong deterrent to the socio-cultural behaviour. The emotion of contempt performs the function of preventing punishment in relation to the despised individual. (shrink)

Recent developments in experimental philosophy (‘x-phi’) suggest that there is a new way in which the empirical and normative dimensions of bioethics can be brought into successful dialogue with one another. It revolves around conceptual analysis – though not the kind of conceptual analysis one might perform in an armchair. Following Édouard Machery, this is Conceptual Analysis Rebooted. In short, morally-pertinent medical concepts like ‘treatment’, ‘euthanasia’ and ‘sanctity of life’ can each have several meanings that underwrite inferences with different moral (...) implications. X-phi shows us that an experimental approach to conceptual analysis can make explicit the implicit structures that underpin our thinking about such concepts. By presenting concrete examples, I aim to offer a glimpse of an empirically-grounded, practically-normative 'bioxphi' that demystifies and distinguishes medical concepts, assesses the normative inferences these concepts dispose us to draw and revises those inferences that are deficient. We investigate adverbial agreement in Sandəmarkesə (S. Marco in Lamis, Apulia) proposing phase-bound, local agreement relations, reducible to coordination, as in past and absolute participial constructions, suggesting a copulaless analysis where arguments are subjects in a small clause. With disjunct nominals with matching φ-features, the adverb agrees separately with each part in the set, otherwise resulting in ‘non-agreeing’ forms, which we test also with negative polarity items (niʃun-, ‘nobody’ and nentə, ‘nothing’). With fragment answers, the negation scopes over adverbs agreeing (...) with the two proposed topics: matching of the φ-features of both nouns values the negative operator with the same features. In fronted adverbs, agreement occurs when the question contains overt coordinated arguments, elements continuing a chain, and if coordinated arguments have matching φ-features. In agreement in topical contexts with fronted adverbs, agreement occurs with the aboutness-shift topic closely preceding them, rather than with the embedded direct object. (shrink)

Husserl’s phenomenology of imagination embraces a cluster of different theories and approaches regarding the multi-faced phenomenon of imaginative experience. In this paper I consider one aspect that seems to be crucial to the understanding of a particular form of imagination that Husserl names pure phantasy. I argue that the phenomenon of Ego-splitting discloses the best way to elucidate the peculiarity of pure phantasy with respect to other forms of representative acts and to any simple form of act modification. First, I unravel the phenomenological distinctions which, respectively, oppose phantasy to perception, on the one hand, and phantasy to other forms of the so-called “intuitive re-presentations”. Second, I introduce the difference between presentative and representative acts, arguing that this cannot help us to single out the defining feature of phantasy experiences. The third section draws again an important distinction between pure phantasy and neutrality modification, which allows me to finally determine an internal trait of phantasy experiences, which Husserl refers to as the “Ego-splitting”. In this way, I hope to contribute to a refined characterization of Husserl’s phenomenology of imagination. (shrink)

In the face of the Corona Phenomenon, this volume includes the reflections of 26 scholars on 60 important philosophical and political questions, together and interconnected.

In the last decade, Guilio Tononi has developed the Integrated Information Theory (IIT) of consciousness. IIT postulates that consciousness is equal to integrated information (Φ). The goal of this paper is to show that IIT fails in its stated goal of quantifying consciousness. The paper will challenge the theoretical and empirical arguments in support of IIT. The main theoretical argument for the relevance of integrated information to consciousness is the principle of information exclusion. Yet, no justification is given to support (...) this principle. Tononi claims there is significant empirical support for IIT, but this is called into question by the creation of a trivial theory of consciousness with equal explanatory power. After examining the theoretical and empirical evidence for IIT, arguments from philosophy of mind and epistemology will be examined. Since IIT is not a form of computational functionalism, it is vulnerable to fading/dancing qualia arguments. Finally, the limitations of the phenomenological approach to studying consciousness are examined, and it will be shown that IIT is a theory of protoconsciousness rather than a theory of consciousness. Grau and Pury (Review of Philosophy and Psychology, 5, 155–168, 2014) reported that people’s views about love are related to their views about reference. This surprising effect was however not replicated in Cova et al.’s (in press) replication study. In this article, we show that the replication failure is probably due to the replication’s low power and that a metaanalytic reanalysis of the result in Cova et al. suggests that the effect reported in Grau and Pury is real. We then (...) report a large, highly powered replication that successfully replicates Grau and Pury 2014. This successful replication is a case study in the challenges involved in replicating scientific work, and our article contributes to the discussion of these challenges. (shrink)

Patients with serious illnesses or injuries may decide to quit their medical treatment if they think paying the fees will put their families into destitution. Without treatment, it is likely that fatal outcomes will soon follow. We call this phenomenon “near-suicide”. This study attempted to explore this phenomenon by examining how the seriousness of the patient’s illness or injury and the subjective evaluation of the patient’s and family’s financial situation after paying treatment fees affect the final decision on (...) the treatment process. Bayesian Mindsponge Framework (BMF) analytics were employed to analyze a dataset of 1042 Vietnamese patients. We found that the more serious the illnesses or injuries of patients were, the more likely they were to choose to quit treatment if they perceived that paying the treatment fees heavily affected their families’ financial status. Particularly, only one in four patients with the most serious health issues who thought that continuing the treatment would push themselves and their families into destitution would decide to continue the treatment. Considering the information-filtering mechanism using subjective cost–benefit judgments, these patients likely chose the financial well-being and future of their family members over their individual suffering and inevitable death. Our study also demonstrates that mindsponge-based reasoning and BMF analytics can be effective in designing and processing health data for studying extreme psychosocial phenomena. Moreover, we suggest that policymakers implement and adjust their policies (e.g., health insurance) following scientific evidence to mitigate patients’ likelihood of making “near-suicide” decisions and improve social equality in the healthcare system. Kurt Gödel wrote (1964, p. 272), after he had read Husserl, that the notion of objectivity raises a question: “the question of the objective existence of the objects of mathematical intuition (which, incidentally, is an exact replica of the question of the objective existence of the outer world)”. This “exact replica” brings to mind the close analogy Husserl saw between our intuition of essences in Wesensschau and of physical objects in perception. What is it like to experience a mathematical proving (...) process? What is the ontological status of a mathematical proof? Can computer assisted provers output a proof? Taking a naturalized world account, I will assess the relationship between mathematics, the physical world and consciousness by introducing a significant conceptual distinction between proving and proof. I will propose that proving is a phenomenological conscious experience. This experience involves a combination of what Kurt Gödel called intuition, and what Husserl called intentionality. In contrast, proof is a function of that process — the mathematical phenomenon — that objectively self-presents a property in the world, and that results from a spatiotemporal unity being subject to the exact laws of nature. In this essay, I apply phenomenology to mathematical proving as a performance of consciousness, that is, a lived experience expressed and formalized in language, in which there is the possibility of formulating intersubjectively shareable meanings. The Utugwang society is of a type which places a greater value on human life and communal belonging which is indicative of the name they bear Utugwang, which literally translated means – “Let’s come together”. However, this coming together has not been without blemish as the believe in witchcraft by the Utugwang people like many other African communities has hindered the growth and progress of the community. This paper is an attempt to investigate the phenomenon of witchcraft which essentially (...) is a metaphysical phenomenon that cuts across gender and all ages, contrary to the opinion that witchcraft is a phenomenon that is predominantly found among female. It reveals further that, witchcraft is an act that is shrouded in secrecy and mysticism. It submits that this phenomenon of witchcraft poses both metaphysical and epistemological challenge in the in Utugwang cosmology. It also shows that basically witches are classified into two categories in Utugwang cosmology. The black witch that causes pain or harm and the white witch that is endowed with wisdom. (shrink)

In lecture III of Naming and Necessity, Kripke extends his claim that names are non-descriptive to natural kind terms, and in so doing includes a brief supporting discussion of terms for natural phenomena, in particular the terms ‘light’ and ‘heat’. Whilst natural kind terms continue to feature centrally in the recent literature, natural phenomenon terms have barely figured. The purpose of the present paper is to show how the apparent similarities between natural kind terms and the natural phenomenon (...) terms on which Kripke focuses are outweighed by more significant differences. Thus, rather than providing additional support for non-descriptivism, natural phenomenon terms turn out to challenge that thesis. (shrink)

It is widely thought that grounding is a hyperintensional phenomenon. Unfortunately, the term ‘hyperintensionality’ has been doing double-duty, picking out two distinct phenomena. This paper clears up this conceptual confusion. We call the two resulting notions hyperintensionalityGRND and hyperintensionalityTRAD. While it is clear that grounding is hyperintensionalGRND, the interesting question is whether it is hyperintensionalTRAD. We argue that given well-accepted constraints on the logical form of grounding, to wit, that grounding is irreflexive and asymmetric, grounding is hyperintensionalTRAD only if (...) one endorses a sentential operator view of grounding. We argue that proponents of the sentential operator view will need to distinguish two importantly different kinds of hyperintensionalityTRAD—weak and strong—and we offer them a way to do so. In the philosophical debate on lying, there has generally been agreement that either the speaker believes that his statement is false, or he believes that his statement is true. This article challenges this assumption, and argues that lying is a scalar phenomenon that allows for a number of intermediate cases – the most obvious being cases of uncertainty. The first section shows that lying can involve beliefs about graded truth values (fuzzy lies) and graded beliefs (graded-belief lies). It puts (...) forward a new definition to deal with these scalar parameters, that requires that the speaker asserts what he believes more likely to be false than true. The second section shows that statements are scalar in the same way beliefs are, and accounts for a further element of scalarity, illocutionary force. (shrink)

Given this bitter reality, the “near-suicide” term is coined to describe the phenomenon in which poor patients with serious illnesses or injuries choose to end their treatment, which is highly likely to result in mortality, to avoid making their families destitute.

The AISDL Team is delighted to celebrate the event of our study, titled “Near-Suicide Phenomenon: An Investigation into the Psychology of Patients with Serious Illnesses Withdrawing from Treatment,” surpassing the 100,000-view landmark at 22:20 Hanoi time, April 7, 2023. This unthinkable event occurred only 24 days after publication.

Together with the return to traditional religions and the parallel immersion in pagan and Orthodox archaism, a third tendency—minimal religion, or "poor faith"—can be observed in contemporary Russia. According to the polls, more than one fourth of Russians believe in God but are not affiliated with any specific religion or denomination. To date, this type of religiosity has attracted the least attention because it has no clear organizational and dogmatic manifestations and tends to escape all forms of objectification. Its ‘minimality’ (...) almost precludes the formation of dogma or ritual and can be identified only as an internal impulse, a state of spirit, or a disposition of mind. This is what is called ‘poor’ or ‘minimal’ religion. For a Western observer, a more ‘recognizable’ name for it would be religious modernism, universalism, or ecumenicism, even if these terms do not exactly correspond to the Russian phenomenon. The spiritual vacuum, created by Soviet atheism, gave rise in the 1970s — 1990s to this new type of religiosity. Minimal religion is transcendental in two senses. As a religion, in distinction from a purely secular position, it transcends the ‘earthly’ world of immanence. As a minimal religion, in distinction from all organized religions, it transcends the world of all existing religious traditions, dogmas, rituals, and affiliations. It is only in the liminal ‘between’ that this uniquely postsecular phenomenon can be defined. Religion, yet minimal; poor, yet faith. (shrink)

In the thesis a description of the other person as a phenomenon of icon in thinking of a contemporary French philosopher Jean-Luc Marion is researched. A question is raised how the icon (as Marion describes it) can be recognized in the face of the other. A notion of “iconic visibility” is accepted and employed to study how phenomenal “structure” of the first icon – Christ – repeats itself in the face of the other. Main features allowing to interpret the (...) face as the icon from the phenomenological and not theological point of view are displayed. “Subject” capable of recognizing the icon is researched in detail. It is argumented why the gifted should not be considered to be a passive object-like givee and why the other is not the only active subject-like pole of the phenomenon. Features of Marion’s conception of the icon which determine the initial lack of evidence of the phenomenon are disclosed. It is shown that the difficulty of recognition of the icon is inherent to the description of the phenomenon. The role of the phenomenon of love for the appearing of the icon is highlighted and Marion’s conception of love is discussed. A possibility to demonstrate the icon as a final and inevitable interpretation of the face of the other was not found. It is reasoned that the possibility of such demonstration is prohibited in the very definition of the phenomenon. In spite of that it was shown how such a phenomenon may appear, therefore, lack of proof does not deny the possibility of appearing. (shrink)

Biologists often study particular biological systems as models of a phenomenon of interest even if they already know that the phenomenon is produced by diverse mechanisms and hence none of those systems alone can sufficiently represent it. To understand this modeling practice, the present paper provides an account of how multiple model systems can be used to study a phenomenon that is produced by diverse mechanisms. Even if generalizability of results from a single model system is significantly (...) limited, generalizations concerning specific aspects of mechanisms often hold across certain ranges of biological systems, which enables multiple model systems to jointly represent such a phenomenon. Comparing mechanisms that operate in different biological systems as examples of the same phenomenon also facilitates characterization and investigation of individual mechanisms. I also compare my account with two existing accounts of the use of multiple model systems and argue that my account is distinct from and complementary to them. (shrink)

One of the aspects of consciousness is the fact that it is formed from unifications of qualia. In this paper, unification will be shown to be a phenomenon that works based on the unformal nature of self-reference. Self-reference being an unformal entity, it is no-thing and every-thing both at the same time. These unformal properties will be shown to play an essential role in the existence and manifestation of unification. The best exemplification of the unformal workings of unification will (...) be shown to happen in the phenomenon of telepathy. Telepathy will be argued to be a case of consciousness unification and will be shown that its imperfection is not a reason for rejecting it, but is a door towards the workings of the phenomenon of unification. The AISDL Team is happy to inform the research community that the “near-suicide phenomenon” (NS) paper passed the milestone of 400 thousand reads on July 28, 2023. The day was one and a half months after the study reached the 300-thousand-read milestone on June 15, 2023. The previous dates are April 7 (100K) and May 1 (200K).

“Freedom” is a phenomenon in the natural world. This phenomenon—and indirectly the question of free will—is explored using a variety of systems-theoretic ideas. It is argued that freedom can emerge only in systems that are partially determined and partially random, and that freedom is a matter of degree. The paper considers types of freedom and their conditions of possibility in simple living systems and in complex living systems that have modeling subsystems. In simple living systems, types of freedom (...) include independence from fixed materiality, internal rather than external determination, activeness that is unblocked and holistic, and the capacity to choose or alter environmental constraint. In complex living systems, there is freedom in satisfaction of lower level needs that allows higher potentials to be realized. Several types of freedom also manifest in the modeling subsystems of these complex systems: in the transcending of automatism in subjective experience, in reason as instrument for passion yet also in reason ruling over passion, in independence from informational colonization by the environment, and in mobility of attention. Considering the wide range of freedoms in simple and complex living systems allows a panoramic view of this diverse and important natural phenomenon. (shrink)

Post-industrial society is also defined as a "post-class" society, reflecting the breakdown of the stable social structures and identities characteristic of industrial society. If before the status of an individual in a society was determined by his place in the economic structure, that is, by the class affiliation to which all other social characteristics were subordinated, now the status characteristic of the individual is determined by a multitude of factors, among which the increasing role is played by education and the (...) level of culture (according to P. Bourdieu "cultural capital"). On this basis, D. Bell and several other Western sociologists put forward the idea of a new "service" class. (shrink)

This paper offers both a criticism of and a novel alternative perspective on current ontologies that take race to be something that is either static and wholly evident at one’s birth or preformed prior to it. In it I survey and critically assess six of the most popular conceptions of race, concluding with an outline of my own suggestion for an alternative account. I suggest that race can be best understood in terms of one’s experience of his or her body, (...) one’s interactions with other individuals, and one’s experiences within particular cultures and societies. This embeddedness of human experience has been left out of most discussions of race which tie race to a set of characteristics (either biologically or sociologically defined). To rectify this omission, I articulate what I call the “physiosocial” view of race. This emphasizes the situatedness of human experience, the reciprocal and dynamic nature of the racial identities of individuals and groups. Approaching racial identity in this way entails a union of two historically uncomfortable partners: biological and sociological conceptions of race. If successful, this philosophical stance may illuminate the process of racial self-ascription as well as provide an explanation for the potential changeability of an individual’s racial identity at different times and at different places. The study aims at determining the role and significance of such moral emotions as nobility, gratitude, admiration for the socially significant behavior of a person in society. That involves identifying a close relationship between those emotions and personality’s social behavior and that they can be one of the main incentives for socially significant behavior – theoretical basis. The importance of ethical emotions with positive valence when making decisions with their implementation in society determines the research’s theoretical and methodological basis. Those (...) are studied in the cognitive dimension of human social activity, considering their subjective experience and objectification. The authors determined that ethical emotions with positive valence, pleasant emotions stimulate a person to experience them again and behave socially desirable as such behavior allows reliving those emotions and self-actualizing. Emotions with a positive valence are most desirable for a person and are the essential behavior incentives in society. A person can act actively to achieve them, to experience them repeatedly, which is the basis of motivation for socially desirable and meaningful behavior. From exclusively subjective experiences, those emotions move into objectification, i.e., those motivated to act in conditions of a definite or indefinite social continuum. In due time, these socially crucial actions acquire normative content, sometimes even a form, since they serve as a model for others. Moral emotions with positive valence, empathy, rule-making, high culture, and responsibility to oneself and others form a good way of a person’s self-realization through positive social behavior. The “incel” phenomenon began after 2010 when like-minded young – mostly straight white – men started to share similar thoughts and worldviews on certain digital platforms and online forums leading to an exclusive community. The phenomenon is characterized by misogynism, racism and homophobia. The most extreme forms of the phenomenon have led to violent hate crimes. The aim of this paper is to understand this phenomenon and analyze it by applying the echo chamber theory.

Contra uma leitura disseminada segundo a qual os primeiros filósofos teriam se ocupado sobretudo do princípio material das coisas existentes, o trabalho defende que a cosmologia de Anaximandro é eminentemente processual e se caracteriza por ser uma minuciosa descrição acerca do modo como estados presentes decorrem de estados passados segundo um princípio de justiça que é regulado pela “disposição do tempo”. Sua cosmologia constitui a emergência de uma nova concepção de temporalidade que não explica o que é, foi e será (...) em termos de gerações de deuses, mas em termos de processos que se sucedem; e, por conseguinte, constitui a emergência de uma certa noção de causalidade entendida como regra da sucessão. Entretanto, para Anaximandro, χρόνος não é nem o meio neutro onde ocorrem as transformações da natureza, nem designa a totalidade de três instâncias temporais (passado, presente, futuro). Antes, χρόνος é um agente regulador das transformações naturais e se identifica com os arranjos celestes. O ponto de partida da leitura aqui proposta é a contextualização do chamado fragmento DK12B1 em sua fonte doxográfica (SIMPL. in Phys. 24.13–25 = DK12A9). A leitura se guia pela compreensão da história da filosofia como uma história da recepção e não da veracidade das fontes. Para a introdução do problema, se apresenta uma breve visão geral sobre a natureza de nossas fontes e se discute os pressupostos filológico-hermenêuticos que sustentariam a pretensão histórica dos estudos pré-socráticos. A análise de SIMPL. in Phys. 24.13–25 se inicia discutindo a identificação dos referentes de certos termos anafóricos, além do escopo de abrangência do particípio τὰ ὄντα. Contra a ideia de que DK12B1 se refere ou bem a ἄπειρον ou bem a στοιχεῖα, se levanta a hipótese de que o referente em questão é οὐρανοί. Esta hipótese constitui a pedra angular da edificação argumentativa desta dissertação. (shrink)

Roger Penrose is known for his proposals, in collaboration with Stuart Hameroff, for quantum action in the brain. These proposals, which are still recent, have a prior, less known basis, which will be studied in the following work. First, the paper situates the framework from which a mathematical physicist like Penrose proposes to speak about consciousness. Then it shows how he understands the possible relationships between computation and consciousness and what criticism from other authors he endorses, to conclude by explaining (...) how he understands this relationship between consciousness and computation. Then, it focuses on the concept of non-locality so essential to his understanding of consciousness. With some examples, such as impossible objects or aperiodic tiling, the study addresses the concept of non-locality as Penrose understands it, and then shows how far he intends to arrive with that concept of non-locality. At all times the approach will be more philosophical than physical. (shrink)
