Rabindranath Tagore (1861–1941), one of the greatest contemporary Indian thinkers, discussed the problem of religion and faith on the ground of global pluralism and religious diversity. He presented his views in numerous poetical works (including Gitanjali, a collection of Song offerings translated into English, for which he was awarded with the Noble Prize in literature in 1913), but he also delivered many speeches, mostly addressed to the Western audience (e.g. The religion of Man). In his writing, Tagore often uses the (...) terms “religion” and dharma interchangeably. This article focuses on both key terms and on the question whether they may be seen as equivalent according to him. Does he really equalize both terms? or, How was his understanding of “religion” and dharma influenced by his cultural background? The article opens with the analyse of the dictionary definitions of both key terms. Next, at the basis of dictionary explanation the main question is raised: whether “religion” and dharma could be treated as equivalents in their whole range of meanings or should their understanding be limited to a chosen definition or definitions? In the following section, Tagore’s concept of the so called “Man the Eternal” and “Divinity in Man” is briefly described. Final comments include some remarks on both terms explained in the light of Tagore’s view on comparative methodology. He claims that “religion” and dharma are close in meaning, since they both stand for the rational description of the individual experience of divinity. Therefore, they may ultimately lead to the common end, regardless their different cultural roots and various circumstances in which both concepts developed. Tagore argues for freedom as the preliminary condition for understanding of the phenomenon of transcendence of human nature towards the experience of divinity. He understands freedom as perfect harmony realized in this world but not merely through our response to it in knowing but in being. Only when such an approach is accepted the experience of “Man the Eternal” can be achieved. In this respect all human beings may meet, regardless they come from Western or Eastern culture. Such an exposition of the core of religious experience allows us to use the terms of “religion” and dharma interchangeably, and thus contribute to the comparative methodology in religious studies. Following the tradition of the philosophy of nature, influenced by hippocratic medicine, Sophists claim that human-being is a biological creature, a part of the world of nature, subject to its rules and rights. Convinced that human-being is a composition of physical and spiritual elements and interested in the relation between the two, the Sophists examine the impact of psychological and physical stimuli on human behaviour. They take under scrutiny various (...) human states (pathe) such as sleep, wakefulness, sickness, madness, love, hatred. They emphasize the uniqueness and "private" character of individual perceptions and states which are dependent on the particular situation of a given subject. PHILOSOPHY OF HUMAN RIGHTS: HUMAN RIGHTS IN LIGHT OF THEIR INTERNATIONAL PROTECTION Summary The book consists of two main parts: in the first, on the basis of an analysis of international law, elements of the contemporary conception of human rights and its positive legal protection are identified; in the second - in light of the first part -a philosophical theory of law based on the tradition leading from Plato, Aristotle, and St. Thomas Aquinas is constructed. The conclusion contains an application (...) of the results of the analysis conducted in the second part. The first part comprises four chapters. The first aims at revealing characteristics of human rights on the basis of an analysis of historical conditioning of the inter-national law of human rights and its development. The historical context displays the practical, vindicative, and critical character of the positive legal protection of human rights. Moreover, the process of change of positive human rights law is distinguished from the process of change of human rights as such. In the second chapter the content of human rights - a topic which is only auxiliary to the conducted analysis - is discussed. Basic typology and catalogues of rights proclaimed in the Universal Declaration of Human Rights and protected in the International Covenants of Human Rights are presented. The review of the content of rights aims at a more precise limitation of the field of research. The examination shows a diversity of rights which poses a serious challenge to the coherence of every philosophical theory of human rights. In the third chapter, central in the first part, international law is analyzed with regard to the characteristics of rights and the foundations of them. The analysis of documents shows a number of solutions referring to the anthropological foundations of rights. The inherent dignity of the human person is the source of all human rights. Each human being is recognized as free, and endowed with both reason and conscience. In the propounded conception of man individuals are not rivals but create a community which is a condition for their development. International law characterizes the rights as universal, inherent, inalienable and inviolable. The reconstructed conception also comprises the following basic elements: on the level of the structure of rights, a recognition of their equality, interdependence, and comprehensiveness; in the grounding of these rights, a recognition of the anthropological foundations of law; in the conception of positive law, a recognition of the secondariness of the positive law of human rights to human rights themselves, and a recognition of human rights and justice as the basis for legal order; in the conception of state, a recognition of the well-being of the individual as the fundamental aim of actions undertaken by political institutions, and recogni¬tion of rights which form an impassable boundary to the power of the state, includ¬ing its legislative actions. The characterization of the international legal paradigm serving for the under¬standing of human rights is supplemented by analyses of the structure of their posi¬tive legal protection. Various meanings of the terms "right" and "freedom" are distinguished. Subjective right, as basic structure of the positive legal protection of human rights, is understood as a complex relation formed by various legal situations of the subject of a right which create a functional whole in respect of the subordi-nation of human person to its good. Subordinating person to a good proper for it, expressed usually in a proclamatory norm, is the central element of particular rights around which further elements aiming at the realization of this good are built. In the second part of the book a philosophical theory is developed which allows for the location of a coherent foundation for the presented characterization of human rights and their positive legal protection. This part consists of two chapters. The first includes a review of some - not entirely satisfactory - means of founding of human rights; the second presents philosophical conceptions of law and man which may form a basis for the constructed theory. The review of arguments contained in the first chapter does not aim at a detailed analysis of various specific ways of argumentation encountered in works on this subject but rather at a concise presentation of the main possible lines of argumentation. These analyses also serve to emphasize the positive solutions which are pro¬posed later and to underscore the explanatory power of the elaborated theory. This theory, retaining accurate intuitions contained in the presented types of argumenta¬tion, helps in avoiding their consequences which are difficult to reconcile with the reconstructed paradigm of human rights. Efforts to base human rights on the norms of international law rightly take into account the necessity of determining the content of the rights and their positive legal protection as a means for the realization of man's good. These attempts, how¬ever, do not properly take into account the inherent character of human rights, which are independent of positive law and provide grounds for applying specific legislative measures and not others. Founding human rights on freedom accurately points at the freedom of an indi¬vidual as a constitutive element of some rights; however, absolutization of freedom leads, to a loss of an important element of the contemporary paradigm of under¬standing human rights. This foundation undermines recognition of the fact that human rights may set limits to both the freedom of others and the freedom of the subject of rights itself. Additionally, attempts at the so-called axiological justification of human rights are discussed. This type of justification has a few variants depending on the as¬sumed conception of value. Subjectivistic conceptions have similar advantages and disadvantages to the conceptions basing human rights on freedom; objectivistic conceptions while providing for the universality of human rights place, the fundamental aim of human rights protection beyond the individual human being - in the idealistically existing world of values; finally, conceptions rooting values and human rights in culture, while accurately noting that human rights are learned through the medium of culture, place the source of human rights beyond a concrete individual - in culture and processes which take place in it - which leads to difficulties in finding a basis for the universality of rights. Furthermore, attempts to ground human rights in specific characteristics of the human being are presented. This type of approach points to an important problem of dependence of the content of rights on what man is. However, recognition of specific characteristics of a human being as an ontic foundation of the existence of rights poses a danger to their universality since one has to accept that it is not enough to be a man to be a subject of rights, but a man possessing specific charac¬teristics. The second chapter aims at outlining solutions worked out by Saint Thomas Aquinas. For a fuller understanding of his propositions selected elements of Plato's and Aristotle's philosophy are presented. It was them who formulated the founda¬tions for reflection on law and justice in the ontological context. A qualification is made that Stoicism is not be analysed in depth. Although Thomas' concept of law was undoubtedly developed under the influence of the Stoic doctrine as well, it is not in this that one should look for the tools to understand the ontic foundations of human rights and law in general since the Stoic moral philosophy and philosophy of law were developed in the context of a theory of being which assumed monistic and pantheistic premises as foundations, leading to the recognition of a total subor¬dination of the human individual to a larger unity of which man is only a part. The analysis of Plato's and Aristotle's texts concentrates on problems of justice. Plato seems to be the first philosopher who reflected on the formula basic in the history of European thought: to render to each his due. It appears that justice as both a characteristic of man and his acts is understood in the perspective of that which is just, that which is a good for another man - the recipient of the act. The basis for determining what is just is the relation of correspondence between some¬one and something. While in the case of Plato this relation is based on something beyond its terms, namely on ideas, in the case of Aristotle the relation occurs on account of the elements of the relation itself. Something is just when it contributes to the develop¬ment of the recipient of an act realizing that which is just. At the same time, the realization of that which is just is a good for the agent. In the analysis of the just two types of relation are revealed: the relation of due-to-recipient occurring on account of the compatibility of that which is due, with the recipient of the act; and - a "superstructure" - a relation of obligation-of-subject occurring on account of the compatibility of the acting subject with the thing which should be done. The basis for being that which is due is formed by various potentialities of development of man - the recipient of agency; the basis of being that which is an obligation is the possibility of development of the subject of action. Aristotle distinguishes various types of freedom and points to the necessity of taking them into account in the discussion of justice. Among other things, as the core of man's freedom, he considers life for its own sake, which can be seen as his expression of the basic indices of the autotelic character of man - which is funda¬mental for later conceptions of dignity. The freedom which is described by him is not, however, inherent and inalienable; being free is conditioned by a factual possi¬bility of undertaking actions, which are not solely means to the realization of aims set by others. Thomas Aquinas takes over the Aristotelian research perspective both in his conception of man and of law. At the same time, however, he significantly enriches it. In anthropology he develops a conception of personal being. Drawing upon his distinction between existence ("that something is") and essence ("what something is"), he sees the basis for being a person in the dignity of personal being which is a certain way of existence of a rational being more perfect than that of non-personal beings. The person is a being which, by virtue of its act of existence, is individual¬ized in a specific way. It is an aim in itself. Expressing it in a negative way, one may say that it does not exist as a means for the realization of the aims of others and, in this sense, that it is free. As distinct from Aristotelian conclusions, being a person is not conditioned by the specific actions of a being. Dignity is inherent, based on that which is the foundation of the factual existence of every rational being. Although freedom requires that a being is rational, dignity still encompasses all being, all its properties and potentialities. Thus an act conforming with dignity has to take into account a whole human being. Among different types of that which is just, ius, the first place, from the point of view of understanding law, falls to "the just thing itself ("ipsa res justa"), which is right in the full meaning of the word. On the one hand, it is that which is due; on the other hand, it determines the way of acting in the utmost degree, since the course of every act is determined in the fullest extent by its aim. The content of ius may be determined both by elements independent of free decisions - ius naturale - and by free decisions taking into account the state of things - ius positivum. Recognition of the objective structure of being as the basis of law does not entail that it is possible or desirable to determine unequivocally "the only right" patterns of conduct. This concept is very well justified within the system proposed by Saint Thomas. Individualization of being is a significant element of the develop¬ment of a person as a person. It is attained by the realization of individual aims which are not unequivocally determined by circumstances and the nature common to all people. By virtue of free choices made in the sphere of that which is not by its nature unjust, the object of action becomes ius. Since in the realization of the person the individualization of human being is central, Aquinas clearly sees the need for the protection of the sphere of "dominion of will". This sphere itself constitutes ius naturale, something which is due to man independently of the acts of will. Therefore "law should forbid nothing which is not unjust" ("nihil debet lege prohiberi quod licite fieri potest", In 3 Sent., dist. 40, q. I, a. 1, 3). Besides the relation of due-to-recipient, ius also includes the relation of obligation-of-subject which is superimposed on the relation of due-to-recipient. As far as the ontic foundations of obligation are concerned, in explaining why man is subordinated to realization of the good of others, Aquinas generally follows Aristotle in accepting that this basis is the subordination to moral good - to actions conforming with the learned truth about reality. Aquinas' systemic solutions allow, however, to reach deeper and understand why moral development is also a development of the whole human being. This was difficult within Aristotle's system, since he was reluc¬tant to decide whether precedence should be given to intellectual or moral develop¬ment. The inclination to realise good of another appears to be a transcendental characteristic of being, based on its very existence. Morality understood as rational and free subordination to realize the good of another is a specifically personal way of the realization of this inclination. Thus just actions contribute to the actualization of being in the aspect of its existence and therefore to the actualization of being as a whole. Thomas' conception of natural law (lex naturalis) as participation in eternal law (lex aeterna), offers possibilities for grasping that which is just as something which is basically accessible cognition, independently of Revelation and independently of faith in God, and at the same time as something based in eternal law, understood as a design of God's wisdom. Eternal law, embracing all particular actions, is not, from the human perspective, accessible cognition directly. It is enacted in the struc-ture of the created being and - in case of human beings - in free choices taking this structure into account. In the concluding remarks, the results obtained earlier are applied directly to the contemporary conception of human rights. Human rights are understood in the first place as "just things" - concrete goods of man; as that which is due because of subordination, based on dignity, to the personal development of man. That which is just is understood as a relational - actual or potential - state of things, which exists by virtue of existing relations. Evaluations referring to that which is right are true when respective relations of due-to-recipient take place; norms of conduct are true when respective relations of obligation-of-subject take place. Examples of the application of the sketched theory outside the field of human rights are also presented. Procedural consequences of the developed theory are shown, such as the discrimination of two types of legislative procedures which differ significantly in the structure of argumentation: the first aims at recognition of that which is just independently of the will of the legislator, and the second, at making individual or collective "projects" of development compatible. Finally the possibilities of applying the theory to the increasingly important problems of the protection of the environment and the "rights" of animals are mentioned. The central issue is a philosophical conception of man and his freedom and a conception of law. It is also indispensable to turn to a general theory of being. The search for a comprehensive theory of human rights requires attention to the Abso¬lute Being - God - as well. This is important for at least two reasons. First, a conception of the Absolute Being is integral to philosophy of the systemic type -of which the present book is a piece. A conception of the Absolute Being is signifi¬cant for understanding all being, including, first of all, man as a personal being. Second, every theory of human rights which does not comprise the problem of the Absolute may be questioned as to whether solutions adopted in it do not lead, in consequence, to eliminating God from the perspective of the understanding of law. It is desirable that a philosophical theory should deal with this problem directly. A theory which eliminates God from the perspective of the understanding of rights will be unacceptable for all those who, for philosophical reasons or relying on faith, consider God as the author of inherent rights. Nevertheless, a theoretical approach to rights from the perspective of the Absolute Being should only be a possible extension of a philosophical approach which bases rights on something which is cognizable independently of the acceptance of the existence of God so that the theory is also acceptable for those who reject the existence of God or suspend their judgment on this subject. The pursued theory should therefore contain, on the one hand, reference to natural, faith-independent foundations of human rights, but on the other hand, point to a possible extension accounting for the Absolute Being. The analyses contained in this chapter have undoubtedly some historical value since they are based on source texts. Nevertheless, the use of these texts and not critical works was dictated, first of all, by a conviction that analyses embrace a given theory in the aspect selected by the interests of the researcher. Therefore to find out what past thinkers say on the subject characterized in the first part it is simpler to reach to the sources than to adopt the existing critical works. The pre¬sented reconstruction of Aquinas' views on philosophy of law incorporates proposi¬tions of supplementing and developing some of the ideas undertaken by him. Obligation to act in this and not an other way arises because human actions are subordinated to the conformity, on the one hand, of aims realized by these actions and, on the one hand, the order of being determining that which is favourable to man or destroys him. The content of the order of being is, on the one hand, determined by the structure of being independent from man's will and, on the other, by free decisions of man. (shrink)

Study of religion describes, analyzes and compares how certain human beings do in fact express their faith in terms of particular scriptures, religious figures, sacred rituals, community solidarity, etc. — and how all these explicitly religious phenomena may relate to other aspects of people’s lives. It also aspires and addresses the questions to be even-handed, objective, based on evidence that may be checked by any competent inquirer, and non-committal on claims to divine revelation and authority. It is in principle comparative, (...) not in a judgmental evaluative sense, but in terms of describing and analysing comparable elements or phenomena from various religious traditions, using the same criteria in each case. The paper begins with a brief report on the study of religion in the context of India and presents in detail Rabindranath Tagore’s (1861–1941) views on the need, an objective and philosophy behind the comparative study of religion. As Tagore observes, when studying religion one usually chooses among two alternative approaches: to do research on the secret text or to study the rituals. Tagore accepts fully none of them and instead suggests to rediscover how human aspiration for transcendence works in practice, how it sustains the individual — often marginalized by the power of institutionalised religion — and society, and how it generates new cultural forms. For Tagore, the essence of religion lies is the will to transcend the limit of the self-cantered being towards an ideal of perfection — which he calls divinity of Man. His understanding of the “religion of Man”, as he puts it, is discussed in the major part of the paper. (shrink)

The purpose of this study is to compile a selection of the various formalisms found in conversation theory to introduce readers to Pask's discursive algebra. In this way, the text demonstrates how concept sharing and concept formation by means of the interaction of two participants may be formalized. The approach taken in this study is to examine the formal notation system used by Pask and demonstrate how such formalisms may be used to represent concept sharing and concept formation through conversation. The purpose of the following text is to give readers a general introduction to Gordon Pask’s conversation theory, which is considered here to be a cybernetic and epistemological account of concept-forming and concept-sharing through conversational discourse and practice. While Pask devoted three lengthy tomes to articulate the theory and its applications, I believe it is necessary to give readers who are interested in conversation theory a general introduction to what I believe are the key features of his work in this (...) area. I argue that conversation theory should be considered an inferential account of the theory of concepts rather than a representational account, by virtue of Pask’s argument that a concept must be a process that involves many other concepts. This article focuses on the imposition of modern education upon the foraging Raute people and the ways in which this project has been both reluctantly accepted and actively resisted by the Raute. The Nepalese government established schools for Raute children as part of the nation-state development policy. However, it has refused to incorporate their cultural values, traditions, customs and language into the school curriculum. This paper argues that in attempting to create forms of domination through the educational process the state (...) fosters inequality. Such an arrangement is met with everyday forms of resistance through non-collective and unorganised behaviour of Raute children at school. The Raute’s silent reaction against the government policies typifies the cultural disposition and ethos of the Raute community. This paper is based on research methods that include observation, interviews, informal discussions and document analysis, and outlines the interconnections between family, social class, students and state agency as they relate to education. In particular, it explores the Raute’s own narratives, perspectives and reactions with regard to their educational processes. This case study is presented in an effort to better understand the relations between resistance and reproduction of knowledge in foraging societies. (shrink)

Recent research in science indicates that we are living in a fine-tuned universe. Only a very small parameter space of universal fundamental constants in Physics is congenial for the existence of life. Moreover, recent studies in Biological evolution also reveal that fine-tuning did exist in the evolution. It seems that we are so lucky to exist as all universal fundamental constants and life-permitting factors really fall into such a very small life-allowing region. This problem is known as the fine-tuning problem. (...) Does this phenomenon need an explanation? Can the fine-tuning problem point to the existence of God? Modern Science invokes the idea of multiverse to address the fine-tuning problem. Some scientists suggest that each universe in a set of infinitely many universes contains a typical set of fundamental constants. We should not be surprised why our universe is fine-tuned because we would not exist if the constants are not the life-allowed values. Some suggest that the existence of God can explain this fine-tuning problem. The naturalistic multiverse theory and the existence of God are the two most robust proposals to address the fine-tuning problem. Moreover, some argue that the fine-tuning problem is not real because we are just subject to observational selection effect. In this thesis, I will provide a comprehensive discussion on the fine-tuning phenomena in our universe. In particular, I will use the confirmation principle and the inference to the best explanation simultaneously to evaluate different hypotheses in a more systematic way and give some of the new and updated scientific and philosophical arguments to respond to the recent criticisms of the fine-tuning arguments. I conclude that the theistic hypothesis is the best among all to address the fine-tuning problem. (shrink)

This paper focuses on reciprocity among the nomadic hunter-gatherer Rāute and sedentary groups, ie farmers and artisans. The Rāute’s reciprocal relation depends on social contracts, trust, territorial relations and residential propinquity. These facets of reciprocity can be accepted, denied or even cancelled. I argue that the Rāute are economically prosperous because of their regular exchange of woodenwares for grains and other necessary items, though they refrain from storing resources, earning cash incomes, and eschew agricultural production and animal husbandry. Sharing, exchange, (...) gift and counter-gift engagements are obligatory or compulsory, free and voluntary, ensuring their reciprocity with neighbouring populations – which has been regulated by seasonality, foraging and population density around the vicinities of their camps. Qualitative research was employed, with informal interviews, observations, personal accounts, audio and video recording, as well as field diaries. (shrink)

In this paper, we attempt to de-naturalize the prevailing economistic imaginary of work that Max Weber and later commentators described as ‘protestant work ethic,’ epitomized in the figure of homo economicus. We do so by contrasting it with the imaginary of skillful work that can be found in vignettes about artisans in the Zhuangzi. We argue that there are interesting contrasts between these views concerning 1) direct goal achievement vs. indirect goal achievement through the cultivation of skills; 2) the hierarchization (...) of mental versus physical dimensions of work; 3) the crafting of non-dominating relationships between the working subject, their object, and their instruments of work, which leads to questions about the sustainability of these relationships; and 4) the relationship between work and well-being, which the Daoist texts conceptualize in a much more holistic, but also more presentist way than Western economic rationality. We conclude by pointing out the relevance of these differences for several contemporary debates about work, by denaturalizing a dominant imaginary of work, by distinguishing different forms of work, by suggesting a different relation between work and nature, and by raising questions about the desirability of the automation of work. The abstract Everyone who gets to know deeper with the Nietzsche philosophy is forced to think about a mutual relationship of a culture and a biology. The main problem to correct show of above relationships is the understanding of the meaning of a language with reference to the culture and the biology. Considerations which are represented here are inspired by the Nietzsche philosophy. They are split by three parts. In the first part there is shown the meaning of the language (...) to create the herd in the Nietzsche philosophy. The second part develops his qualification of the language as a shortening of communication. The final part tries to refer the functioning of the language to the sphere of a biological human being. As I think, only the biological perspective permits to overstep the rhetoric of the individualism expressed in the Nietzsche philosophy by the opposition among weak and strong, or else among a priest and a superman. Thanks to drawn consequence from accepted by Nietzsche of the reduction my to the animal sort we are forced to the reversal of the perspective of his thought. The herd is not a centre to create the superman as the aim of the all mankind, but the sense of the exceptionality of an each subject is a centre to a fixation of the reproduction of the genetic definite population. This paper suggests that time travelling scenarios commonly depicted in science fiction introduce problems and dangers for the time traveller. If time travel takes time, then time travellers risk collision with past objects, relocation to distant parts of the universe, and time travel-specific injuries. I propose several models of time travel that avoid the dangers and risks of time travel taking time, and that introduce new questions about the relationship between time travel and spatial location.

W opracowaniu tym poszukiwana jest odpowiedź na dwa pytania: „co to są prawa człowieka?” oraz „jakie są zasadnicze elementy konstytucyjnej koncepcji tych praw?” Odpowiadając na pierwsze pytanie, zmierzać będę do wskazania zasadniczych elementów współczesnej – opartej przede wszystkim na prawie międzynarodowym – koncepcji służącej ujęciu tych praw, czyli do eksplikacji pojęcia praw człowieka. Odpowiadając na drugie, będę poszukiwać zasadniczych konsekwencji, które dla konstytucyjnych regulacji ma uznanie tej koncepcji. Analizy mają charakter projektujący. Nie jest moim celem rekonstrukcja koncepcji praw (...) człowieka zawartej w obecnie obowiązującej konstytucji lub w projektach nowej ustawy zasadniczej, lecz zmierzam do wskazania zasadniczych rozstrzygnięć, których przyjęcie w konstytucji jest postulowane ze względu na uznanie praw człowieka. Trzeba tu zastrzec, że całościowe opracowanie zagadnienia wymagałoby obszernej monografii, toteż nie zostaną tu podjęte zagadnienia dotyczące normowania poszczególnych praw, ale problemy konstytucyjnego ujęcia praw człowieka w ogóle, które jest decydujące dla rozumienia poszczególnych praw. Idea powszechności legła u samych podstaw współczesnej ochrony praw człowieka i nadal jest często podkreślana w dyskursie typu praktycznego, na różnych płaszczyznach: politycznej, moralnej czy religijnej. Jednakże trudno o koncepcję praw człowieka pozwalającą pogodzić powszechność z właściwościami prawa, z postulatami respektu dla pluralizmu ugruntowanego tak w odmienności kulturowej, jak i wolności poszczególnych jednostek ludzkich. Wziąwszy pod uwagę, że powszechność jest fundamentalnym przy¬miotem praw człowieka, kłopoty z powszechnością są kłopotami ze zbudowaniem filozoficznej koncepcji praw człowieka w ogóle. (...) Odrzucenie powszechności jest równoznaczne z odrzuceniem podstaw współczesnej koncepcji tych praw. Die von Kant vorgeschlagene Auflösung der Freiheitsantinomie gehört zu denjenigen Theoriestücken, die auch für den transzendentalen Idealismus aufgeschlossene Philosophen schwer zu verteidigen finden. Dies gilt insbesondere für die Lehre von der nichtzeitlichen Verursachung. Nach dieser Doktrin hebt die »Causalität der Vernunft im intelligibelen Charakter […] nicht zu einer gewissen Zeit an, um eine Wirkung hervorzubringen«. In diesem Beitrag wird nicht Kants Auflösung der Freiheitsantinomie im Mittelpunkt stehen, sondern die Frage, wie das Junktim zwischen Freiheitsrettung und transzendentalem Idealismus allererst motiviert ist. (...) Ich werde zunächst eine Reihe von Gründen dafür anführen, dieses Junktim zu lösen. Kant konstruiert in der dritten Antinomie ein idiosynkratisches Vereinbarkeitsproblem, das auf angreifbaren kausalitätstheoretischen und metaphysischen Vorannahmen beruht. In den Abschnitten 3.-5. versuche ich zu zeigen, dass die transzendental-idealistische Auflösung der Freiheitsantinomie nur nötig wird, weil Kant für Freiheit Erstverursachung fordert, die Gesetzesauffassung der Kausalität für einen analytischen Bestandteil des Kausalbegriffs hält, das Kausalprinzip mit dem Determinismusprinzip identifiziert und mit der Auszeichnung des Kausalprinzips als synthetischen Satz a priori zugleich den deterministischen Charakter des »Naturmechanismus« erwiesen zu haben glaubt. Danach werde ich die Frage erörtern, ob die noumenale »Kausalität aus Freiheit « im Sinne von Akteurskausalität bzw. Substanzkausalität rekonstruiert werden kann. Abschließend werde ich tentative Überlegungen dazu anstellen, ob zumindest einige transzendental-idealistische Elemente eine alternative Rolle in der Freiheits- und Handlungstheorie spielen können. Immanuel Kant’s moral philosophy is organized around an exclusive disjunction of dignity or price, equality or equivalence. In his 1797 Doctrine of Right, however, Kant places enslaved black people on the wrong side of this disjunction when he speculates that their status as currency may offer insight into the origins of money. Recent work in black studies has begun to speculate on the link between blackness and money in modernity, and this paper draws attention to Kant’s role as an unlikely (...) and unwitting precursor for monetary theories of blackness. Precisely in his attempt to secure the priceless and unconditional character of freedom and dignity, it argues, Kant ends up demonstrating the positional value of both. (shrink)

Celem niniejszej pracy jest zastosowanie wizji „Lewiatana” Thomasa Hobbesa do koncepcji superinteligencji lub nadludzkiej inteligencji, które dyskutowane jest wśród transhumanistów i poruszone jest przez takich filozofów i futurologów jak między innymi Nick Bostrom, Stanisław Lem, albo Ray Kurzweil. Inspiracją mojej pracy były pytania w rodzaju: „kiedy człowiek przestaje być autonomicznym podmiotem?” albo „czy człowiek w ogóle może być samodzielny?”. Niemniej jednak wydaje mi się, że takie pytania mogą się pojawić wtedy, kiedy człowieka rozpoznamy jako zwierzę polityczne (politikon zoon w (...) sensie Arystotelesowskim). Albowiem trudno wyobrażać sobie wyłonienie pojęcia polityki wobec człowieka samotnego, to znaczy w izolacji od innych ludzi i bez odniesienia się lub ustosunkowania się do nich. Będę argumentował z perspektywy historyka ewolucyjnego. Za badaczy posiadających wkład do takiego stanowiska można uznać Karola Darwina, Samuela Butlera, George’a Dysona i szczególnie Yuvala Noaha Harariego. Opieram się głównie na pracach dwóch ostatnich. The article deals with relations between the individual and human rights on the one hand, and the State on the other, in the context of the Constitution of the Republic of Poland. The author poses the question whether the idea of subordination of the State to the individual is really a central idea of that constitution. He puts forward many arguments against such suggestion. These arguments relate, above all, to the arrangement of the constitution: a chapter concerning human rights is (...) chapter II, while chapter I deals with foundation of the State; the goals of the State are specified in the preamble including the following initial phrase “the existence and future of Poland as our Homeland” and in Article 5 where human rights are as subject of protection by the State is mentioned after independence and integrity of [its] territory; a general concept of human rights protection adopted in the constitution is dominated by the structures typical of law in its objective sense; the way of regulation admissible limitations on human rights differs from international standards; possibility of claiming human rights is constitutionally guaranteed, mostly by constitutional complaint which is above all aimed at correction of legal system, rather than claiming of rights by the individual; Article 1 (“The Republic of Poland shall be the common good of all its citizens”) interpreted as referring to Article 1 paragraph 1 of the April Constitution of 1935, one of the main ideas of which was precedence of the State over the individual. He also analyses the arguments in favour of the recognition of the idea of subordination of the State. Nevertheless, they cannot be accepted as resolving the question of whether it is a central idea of the constitution. These arguments include in particular: the principle of subsidiarity contained in the preamble, even if it has not been appropriately emphasized there; recognition of inherent and inalienable dignity of the person, but it was not until Article 30 that this provision has been contained and it does not determine the relations between the human dignity and rights and the State. The author suggests that the only conclusive way to justify the subordination of the State in relation to the individual as a central idea of the constitution is by means of Article 1. Taking into account, above all, preparatory work, we should reject the interpretation of that article referring to the April (1935) Constitution. Essential interpretative context may be found in preparatory work and social teachings of the Catholic Church, referred to therein. In that case, the common good means the entirety of the conditions of social life which favour the human development. These conditions include above all the respect for human dignity. Such interpretation of Article 1 gives priority to proposals on what the State should be to serve the individual rather than to safeguard obligations of citizens in relation to the State. (shrink)

In 2003, biophysicist and Nobel Laureate Maurice Wilkins published his autobiography entitled The Third Man. In the preface, he diffidently points out that the title was chosen by his publisher, as a reference to the famous 1949 movie no doubt, featuring Orson Welles in his classical role as penicillin racketeer Harry Lime. In this paper I intend to show that there is much more to this title than merely its familiar ring. If subjected to a comparative analysis, multiple correspondences between (...) movie and memoirs can be brought to the fore. Taken together, these documents shed an intriguing light on the vicissitudes of budding life sciences research during the post-war era. I will focus my comparative analysis on issues still relevant today, such as dual use, the handling of sensitive scientific information and, finally, on the interwovenness of science and warfare. Thus, I will explain how science autobiographies on the one hand and genres of the imagination on the other may deepen our comprehension of tensions and dilemmas of life sciences research then and now. For that reason, science autobiographies can provide valuable input for teaching philosophy and history of science to science students. (shrink)

The paper investigates the issue of historicity of existence and self-understanding within Gadamer’s philosophical hermeneutics. The purpose of the paper is to answer the question of how the author of Truth and method argues and interprets the unity of existence in the context of recognizing historicity as the fundamental characteristics of human being and the world. The paper shows that the historicity excludes the possibility of basing this unity on an absolute metaphysical foundation or on a reflective self-consciousness of transcendental (...) subjectivity. On the ground of philosophical hermeneutics, being-one of a human has the character of historical continuity, constituted in the process of incessant, interpretive transcending and uniting oneself. The paper shows what roles the inherited tradition and community in which one lives play in this process. Furthermore, the paper points out that for proper understanding of Gadamer’s interpretation of the unity of existence, it is necessary to take into account two issues: firstly, its departure from the concept of empty time, which is a stream of the past, present and future moments of the “Now”, in favour of ful-filled time and secondly, how general-individual relations are interpreted in philosophical hermeneutics. Purpose. The author believes that the main topic of philosophical studies of Heraclitus was not nature, not dialectics, and not political philosophy; he was engaged in the development of philosophical anthropology, and all other questions raised by him were subordinated to it to one degree or another. It is anthropology that is the most "dark" part of the teachings of this philosopher, therefore the purpose of this article is to identify the hidden anthropological message of Heraclitus. In case of success, (...) it will become clear what made him "darken". Theoretical basis. The methodological basis of the article is the anthropological understanding of fragments of Heraclitus’ texts presented in a historical and philosophical context. Originality. The philosophical concept of Heraclitus is still a mystery for researchers of his work. The author of the article proposed such a variant of interpretation, within the framework of which different elements of this concept fit into a consistent model. Conclusions. The article proves that although the anthropological turn in philosophy is traditionally associated with the activities of the sophists and Socrates, the previous philosophical thought was also not devoid of anthropological ideas. Moreover, pre-Socratic philosophers posed problems, the interpretation of which brought the doctrine of man to the level of high-order abstractions, while surprisingly preserving the concreteness of the life-meaning questions that confront him. And one of the brightest representatives of pre-Socratic anthropology was Heraclitus of Ephesus. Religion was the motivator that made him study the world, man, and society. The doctrine of the Logos developed by Heraclitus had a tremendous impact on Plato and Philo of Alexandria, and through them on the author of the Fourth Gospel, who begins his story with a "Greek" rethinking of the mystery of the Incarnation. If Heraclitus claimed that a person carries a particle of the Logos, then John proclaimed that the Logos itself incorporated a particle of man. Despite all the differences between these approaches, each of them postulated the cosmic significance of human existence, which means that it brought anthropology to the ontological level. (shrink)

Although there are several monistic and dualistic approaches to the mind-body problem on the basis of classical or quantum mechanics, thus far no consensus exists about a solution. Recently, the Elementary Process Theory (EPT) has been developed: this corresponds with a fundamentally new disciplinary matrix for the study of physical reality. The purpose of the present research was to investigate the mind-body problem within this newly developed disciplinary matrix. The main finding is that the idea of a duality of body (...) and mind has to be rejected as an incomplete representation of reality: in the universe of the EPT, man hás to be a trinity of body, spirit and soul, where ‘body’, ‘spirit’ and ‘soul’ are names for distinct physical things. The mind is then a mere idea that arises from (self-)experience, but without onto-logical connotation. In addition a mechanism for mental causation, which implies a principle of choice, is rigorously formulated. The main conclusion is that a fundamentally new physicalist approach to the mind-body problem, according to which man has a free will, has been formulated strictly within the language of the EPT. Further physical research is then required to describe how the interaction between body, spirit and soul is to be understood in terms of fundamental interactions. In addition, further philosophical-theological research has to establish whether the presently discussed trinity and the trinities of body, spirit and soul mentioned in the Bible and the Vedic texts are one and the same thing. -/- Edit: a revised version of this preprint has been published as a book chapter. In the period after the First World War when the various national-ideological “truths” that led to it were not well resolved which resulted in the Second World War, one of the greatest world crises occurs. In those turbulent times, one philosopher renounces his national identity (changes his religion and name), wanting not to save himself from an evil world that is emerging but to join the creation of a completely new world – the world of modern logic. This man is (...) Alfred Tarski, whom many recognize as “the man who defined truth”, linking him to the formulation of the distinction between object and metalanguage. In the paper, I argue with historians of philosophy who claim that this distinction was first set by the logician and philosopher of the Lvov-Warsaw school Stanislaw Leśniewski (whose Tarski was the only doctoral student) accusing Tarski of violating professional laws without attributing the authorship of this distinction to Leśniewski. I show that this is not true and I cite the places where Tarski clearly emphasizes Leśniewski ‘s contribution. (shrink)

The ecofeminist argument for veganism is powerful. Meat consumption is a deeply gendered act that is closely tied to the systematic objectification of women and nonhuman animals. I worry, however, that presenting veganism as "the" moral ideal might reinforce rather than alleviate the disordered status quo in gendered eating, further disadvantaging women in patriarchal power structures. In this chapter, I advocate a feminist account of ethical eating that treats dietary choices as moral choices insofar as they constitute an integral part (...) of our relationships to ourselves and to others. I believe that we should think of dietary choices in Aristotelian moral terms as a mean relative to us, falling on a continuum between the vice of doing injustice to ourselves, on the one hand, and the vice of doing injustice to others, on the other. On this view, what it is moral to eat for individuals is not a fixed ideal, but rather depends on particulars of our physiological, psychological, economic, cultural, and relational situations. The paper aims at reconstructing the fundamentals of the sophistic anthropology. Contrary to the recognized view of the humanistic shift which took place in the sophistic thought, there is evidence that the sophists were continuously concerned with the problems of philosophy of nature. The difference between the sophists and their Presocratic predecessors was that their criticism of the philosophical tradition and the transformative answers given to the old questions were the basis and the starting point of the " ethical " (...) and " rhetorical " part of their intellectual activity. This natu-ralistic perspective is reflected in their research in the field of medicine and biology, in the discussion about " the human nature " , and in their interest in the individual physiological and mental conditions, which determine the state of the human body and the behaviour of a man. The sophists pioneered in linguistic, rhetorical, and philological studies. To enhance the power of persuasion, they investigated how various mental conditions influenced cognitive processes and physiological reactions. Thus they started a thorough examination of the human psyche, initiating the field of psychology. (shrink)

In his two chief works, the Theogony and Works and Days, Hesiod treats the possibility of providence. In the former poem, he considers what sort of god could claim to gives human beings guidance. After arriving at Zeus as the only consistent possibility, Hesiod presents Zeus’ rule as both cosmic and legalistic. In the latter poem, how- ever, Hesiod shows that so long as Zeus is legalistic, his rule is limited cosmically to the human being. Ultimately, Zeus’ rule emerges as (...) more human than cosmic, and thus unable to fulfill the cosmic demands of piety. Hesiod’s presentation thus begs, without thematically posing, the question of how human beings ought to live. Accordingly, Hesiod’s theological analysis, and not his theogony (or, implicit cosmogony or cosmology), sets the stage for the inquiries of the early Greek philosophers, and so political philosophy as a whole. This chapter discusses the reception of Avicenna’s well-known “flying man” thought experiment in twelfth- and thirteenth-century Latin philosophy. The central claim is that the argumentative role of the thought experiment changed radically in the latter half of the thirteenth century. The earlier authors—Dominicus Gundissalinus, William of Auvergne, Peter of Spain, and John of la Rochelle—understood it as an ontological proof for the existence and/or the nature of the soul. By contrast, Matthew of Aquasparta and Vital du Four used the flying (...) man as an argument for the soul’s ability to be directly aware of itself. A detailed analysis of the views of these authors shows interesting philosophical differences between them and reveals how one of the crucial premises of the original thought experiment—namely that the flying man is unaware of his body—loses its importance due to the changes in the argumentative role that is assigned to it. The most radical example of a new way of understanding bodily self-awareness is Peter Olivi’s so-called ‘man before the creation.’. (shrink)

Today we find philosophical naturalists and Christian theists both expressing an interest in virtue epistemology, while starting out from vastly different assumptions. What can be done to increase fruitful dialogue among these divergent groups of virtue-theoretic thinkers? The primary aim of this paper is to uncover more substantial common ground for dialogue by wielding a double-edged critique of certain assumptions shared by `scientific' and `theistic' externalisms, assumptions that undermine proper attention to epistemic agency and responsibility. I employ a responsibilist virtue (...) epistemology to this end, utilizing it most extensively in critique of Alvin Plantinga’s Warranted Christian Belief (2000). Epistemological externalism presages, I also argue, a new demarcation problem, but a secondary aim of the paper is to suggest reasons to think that `responsibilist externalism,' especially as glossed in virtue-theoretic terms, provides its proponents with the ability to adequately address this problem as we find it represented in a potent thought-experiment developed by Barry Stroud. The paper focuses on how the field of philosophical thinking and especially philosophical anthropology critically copes with the issue of understanding of man in a new state of the natural and human world, which scientists in the field of natural sciences called the Anthropocene. The new perspective of man as a geobiophysical force which has the ability to change the environment to such an extent that it becomes a threat to the global environment brings new ways of thinking about man. (...) Not only thinkers from the humanities and social sciences but also naturalists, express the urgent need to change the traditional anthropological discourse. This is more important in the discourse of Créolité since it silences the grandmothers, great aunts and village midwives who are the transmitters of folk tales, folk medicines and oral culture. In the struggle for recognition between Caribbean males and western males folk medicine may be too closely associated with the denigrated female role to be considered a suitable inclusion into modern development.

This book shows how research in linguistic pragmatics, philosophy of language, and rhetoric can be connected through argumentation to analyze a recognizably common strategy used in political and everyday conversation, namely the distortion of another’s words in an argumentative exchange. Straw man argumentation refers to the modification of a position by misquoting, misreporting or wrenching the original speaker’s statements from their context in order to attack them more easily or more effectively. Through 63 examples taken from different contexts (including political (...) and forensic discourses and dialogs) and 20 legal cases, the book analyzes the explicit and implicit types of straw man, shows how to assess the correctness of a quote or a report, and illustrates the arguments that can be used for supporting an interpretation and defending against a distortion. The tools of argumentation theory, a discipline aimed at investigating the uses of arguments by combining insights from pragmatics, logic, and communication, are applied to provide an original account of interpretation and reporting, and to describe and illustrate tactics and procedures that can be used and implemented for practical purposes.. Die vorliegende Arbeit geht zunächst der Frage der Möglichkeit einer spezifischen, methodisch von den Naturwissenschaften unterschiedenen „Phänomenologie der Natur“ nach. Das Paradigma einer solchen Phänomenologie der Natur ist Goethes Farbenlehre, deren Methode über die Farberscheinungen hinaus Anwendungsmöglichkeiten auf neue Gegenstände eröffnet. Im Zusammenhang damit werden in der vorliegenden Arbeit die Ergebnisse eines philosophischen Versuchs vorgestellt, das Paradigma der Farbenlehre auf die Erscheinung Kraft zu übertragen. Die Anwendung des Paradigmas der Farbenlehre auf den Kraftbegriff ist möglich; das Ergebnis stellt bis in (...) die verwendete Terminologie hinein einen ähnlich deutlichen Kontrapunkt zur Physik dar wie die Inhalte der goetheschen Farbenlehre. Dadurch wird eine Lesart der Farbenlehre gestützt, nach welcher deren Anliegen methodisch und inhaltlich deutlich vom Anliegen der modernen Physik unterschieden werden muss; die Farbenlehre erschließt sich somit viel deutlicher durch Herausarbeiten und Rekonstruieren der Differenzen zwischen Phänomenologie und Physik als durch Postulieren vermeintlicher Schnittmengen. Als Ausblick ergibt sich ein über das philosophische Experiment hinausgehender und noch zu begründender Geltungsanspruch einer in der Tradition der Farbenlehre arbeitenden Naturphänomenologie, indem sie die allgemeinen Bedingungen eines erfahrbaren und vermittelbaren Wissenskorpus von Natur aufzeigen und damit einen grundlegenden Beitrag zur Erkenntniskritik liefern könnte; diese Reflexion ist jedoch zunächst noch ein Desideratum. Za „ojca” filozoficznej kategorii „godności”, która legła u podstaw kategorii prawnej, uznawany jest powszechnie Immanuel Kant. Przypomnieć jednak trzeba, że w bardzo podobny sposób, choć w zasadniczo odmiennym kontekście systemowym, charakteryzował godność Tomasz z Akwinu, pół tysiąca lat wcześniej, uznając ją za fundament bycia osobą. Stąd najistotniejszym i centralnym elementem, tytułowej, klasycznej koncepcji człowieka jest koncepcja godności. Akwinata jest autorem bodaj najbardziej rozbudowanej koncepcji osoby w tradycji filozofii klasycznej. Co więcej zmierzać będę do wykazania, że jego koncepcja lepiej nadaje (...) się do teoretycznego ugruntowania praw człowieka niż koncepcja Kanta. Rekonstruując propozycję Kanta ograniczam się, zasadniczo rzecz biorąc, do analizy Uzasadnienia metafizyki moralności. Interesować będą mnie zagadnienia podstawowe, przede wszystkim – wynikające z różnicy kontekstów systemowych – różnice w pojmowaniu bycia celem samym w sobie. W perspektywie ontologicznej koncentrować się będę na powiązaniu godności z indywidualnością; w perspektywie antropologicznej – na tym, jakiego typu działania stanowią o doskonałości człowieka, jakie działania (czym określone) realizują człowieka jako cel sam w sobie. W szczególności interesować się będę miejscem rozumu i woli w określaniu treści działań (w perspektywie kantowskiej będzie to pytanie o określenie treści powinności; w perspektywie Tomasza – pytanie o treść realizowanego dobra). Zasadnicze pytanie, które leży u podłoża podjętej problematyki antropologicznej, jest pytaniem o to, na ile dla pojmowania godności istotne jest uznanie woli jako w sposób wolny współokreślającej treść powinności (Kant) lub dobra (Akwinata), a na ile woli jedynie podążającej za poznaną powinnością lub poznanym dobrem. Zmierzać będę do uzasadnienia tezy, że koncepcja Akwinaty w ugruntowaniu godności akcentuje wprost indywidualność opartą na wyborze czegoś, co nie jest jednoznacznie treściowo obiektywnie zdeterminowane i co wykracza poza to, co powszechne, poza to, co gatunkowe; natomiast koncepcja Kanta godność wiąże przede wszystkim z tym, co powszechne, gatunkowe i zapoznaje doniosłość indywidualności dla pojmowania godności.
