Drawing on recent developments in dialogic approaches to learning and teaching, I examine the roots of dialogic meaning-making as a concept in classroom practices. Developments in the field of dialogic pedagogy are reviewed and the case for dialogic engagement as an approach to classroom interaction is considered. The implications of dialogic classroom approaches are discussed in the context of educational research and classroom practice. Dialogic practice is contrasted with monologic practices as evidenced by the resilient of the IRF as the (...) default discourse structure in classrooms. Recent evidence suggests the IRF is resistant to attempts to introduce interactive approaches to whole class teaching. Discussion of dialogic practice as a vehicle for increasing pupil engagement at a deep level and raising the quality of classroom interaction is illustrated through a consideration of Philosophy for Children, which is identified as a dialogic approach to classroom practice which has transformative potential for children's learning. Philosophy for Children offers an approach to pedagogy which enables teachers to value pupil voice and promote reflective learning. As such it has much to offer the current debate on dialogic teaching and learning. Research evidence suggests it will promote improved pupil outcomes on a range of assessments. (shrink)

Relationships with international students can be beneficial to higher education in terms of financial and human resources. For this reason, establishing and maintaining such relationships are usually pre-eminent concerns. In this study, we extended the application of the disconfirmation expectation model by incorporating components from subjective task value to predict the loyalty of international students toward their host countries. On a sample of 410 Vietnamese students enrolled in establishments of higher education in over 15 countries across the globe, we employed (...) structural equation model to construct the conceptual model. Our empirical findings revealed that while the roles of satisfaction and disconfirmation are still important as direct and indirect antecedents of international student loyalty, its most powerful predictors are the three components of subjective task value: attainment, utility and intrinsic. These insights result in a number of implications for actors on the higher ducation scene, such as heads of institutions and policy makers. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

This research focuses on Schizophrenia and Clairaudience that is part of doctoral research for a Doctorate of Metaphysical Sciences at the University of Metaphysics. The mental illness known as Schizophrenia has been known for centuries. There are various symptoms associated with this mental illness upon which a diagnosis is based. The exact causes of the mental illness Schizophrenia remain unknown, as does the actual part of the individual which is effect by the illness. The most prominent and definable symptom of (...) Schizophrenia remains to be auditory hallucinations. Another explanation for individual's being able to hear voices, is that of clairaudience, a psychic ability. Clairaudient ability has a positive connotation upon the ability to hear voices, whereas the diagnosis of Schizophrenia is most commonly treated with pharmaceutical drugs to reduce or eliminate symptoms. This paper involves information about Schizophrenia, how it is perceived and treated. It also discusses various views of clairaudience, and how it is effective and manageable. A new approach is required to the medical industry when individuals are being treated for a diagnosis of Schizophrenia. (shrink)

This is a critical examination of Zizek's concept of ideology in his work on the Sublime of Ideology. His account on this connotes that people are basing only in the conscious state without considering the unconscious "I." This framework in psychology has led Zizek to relate it in the process of economics which is greatly manifested in the contradictory poles of the oppressor and the oppressed and its relationship to the process of commodities. Looking into this orientation, this leaves the (...) author to incorporate the ideological character of Zizek through the lens of Anti-Terrorism Law which is not seen in the naked eye. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

A. Newell and H. A. Simon were two of the most influential scientists in the emerging field of artificial intelligence (AI) in the late 1950s through to the early 1990s. This paper reviews their crucial contribution to this field, namely to symbolic AI. This contribution was constituted mostly by their quest for the implementation of general intelligence and (commonsense) knowledge in artificial thinking or reasoning artifacts, a project they shared with many other scientists but that in their case was (...) theoretically based on the idiosyncratic notions of symbol systems and the representational abilities they give rise to, in particular with respect to knowledge. While focusing on the period 1956-1982, this review cites both earlier and later literature and it attempts to make visible their potential relevance to today's greatest unifying AI challenge, to wit, the design of wholly autonomous artificial agents (a.k.a. robots) that are not only rational and ethical, but also self-conscious. The biomedical literature makes extensive use of the concept of a genetic program. So far, however, the nature of genetic programs has received no satisfactory elucidation from the standpoint of computer science. This unsettling omission has led to doubts about the very existence of genetic programs, on the grounds that gene regulatory networks lack a predetermined schedule of execution, which may seem to contradict the very idea of a program. I show, however, that we can make perfect sense of genetic (...) programs, if only we abandon the preconception that all computers have a von Neumann architecture. Instead, genetic programs instantiate the computational architecture of Post–Newell Production Systems. That is, genetic programs are unordered sets of conditional instructions, instructions that fire independently when their conditions are matched. For illustration I present a paradigm Production System that regulates the functioning of the well-known lac operon of E. coli. On close reflection it turns out that not only genes, but also proteins encode instructions. I propose, therefore, to rename genetic programs to biomolecular programs. Biomolecular and/or genetic programs, and the cellular computers than run them, are to be understood not as von Neumann computers, but as Post–Newell production systems. (shrink)

La sincronicità, è “la simultaneità di un certo stato psichico con uno o più eventi esterni che paiono paralleli significativi della condizione momentaneamente soggettiva” (Jung, 1952). C.G.Jung e il fisico quantistico premio Nobel, W. Pauli, ci introducono con tale concettualizzazione in un mondo, nel quale ciò che è interno e ciò che è esterno a noi non è così nettamente definito, mondo nel quale le “coincidenze” non sono più tali, ma rivestono un significato ed un’importanza per la nostra psiche, per (...) la nostra vita. Se un bambino mentre gioca sulla riva di un fiume, vi cade e rischia di venire trascinato dalla corrente, e nello stesso momento sua madre dall’altra parte della città è preda di un’angoscia che l’attanaglia e grida: “il mio bambino!”, siamo in presenza di un evento sincronistico, nel senso della definizione di Jung sopracitata. Noi crediamo, sulla scia di Jung e Pauli che la sincronicità possa essere un possibile principio esplicativo della realtà da affiancare alla causalità, per Pauli vi sono nella realtà sia elementi razionali sia irrazionali ed è quindi impossibile per la fisica dire l’ultima parola sulla realtà, visto che quest’ultima è così complessa. L’attuazione dei fenomeni sincronistici è fuori dalla portata di qualsiasi tipo di previsione razionale, l’evento sincronistico non è riproducibile ed è in qualche modo l’emblema dell’aspetto non razionale della realtà, e come detto, insieme alla più consueta logica causalistica, (ad esempio, una mela su un albero quando è matura può anche cadere), danno una visione più completa della realtà. E questa visione più completa era l’intento di Jung nell’approcciare questi fenomeni: “Cercare di aprire una via verso “l’animazione della materia” a partire dall’assunzione che “ciò che esiste sia dotato di senso”…” ( Pauli e Jung 1992, lettera n.59 di Jung, p. 100). The aim of this essay is to provide an overview of New Realism in its opposition and reaction to Postmodernism. An analysis of the implications of both philosophical approaches in diverse fields will be offered, from epistemology, to politics, to ethics. Ethical new realism is presented as particularly promising and important to the future of philosophy.

The article argues for the variant ‘tractabimus’ in Book 8, ch. 1 of Augustine’s De Trinitate as opposed to the reading ‘tractavimus’ adopted in the Corpus Christianorum edition, and explains the implications of this variant for the understanding of the overall structure of the work.

In this pages the author suggests a spiritual interpretation of Jungian epistemology as a way towards authenticity. He also argues that Martin Heidegger's philosophy and panpsychism can confirm the possibility offered by Jung - with his alchemical - archetypical description of human nature - to achieve a deeper and more authentic awareness of our existence.

La suo apiù importante opera è proprio il commento alla Metafisica di Aristotele (Acutissimae quaestiones metaphysicales, 1 ed. Venezia 1498) che rappresenta una particolare sintesi del commentatore arabo Averrè, Tommaso d'Aquino, Erveo Natale († 1323) e Giovanni Capreolo († 1444). His principal work, the exposition of Aristotle's Metaphysics, (Acutissimae quaestiones metaphysicales 1 ed. Venice 1498) proceeds from a particular synthesis of the Arabic commentator Averroes, Thomas Aquinas, Hervaeus Natalis (d. 1323), and John Capreolus (d. 1444). Soncinas' work and position were frequently discussed from the sixteenth to the seventeenth century. In his last book, Le complexe des trois singes. Essai sur l’animalité humaine (2017), the French philosopher Étienne Bimbenet accuses “sensocentric” (« pathocentristes ») animal ethics of committing a performative contradiction: according to Bimbenet, these theories of animal rights — among which he focuses on the case of Zoopolis (2011) by Sue Donaldson and Will Kymlicka — would undermine themselves by means of declaring reason a “non-essential” feature of human beings, while at the same time those theories themselves can only (...) be understood as a highly rational human endeavour. As we will try to point out, the alleged performative contradiction does not actually take place. First of all, Donaldson and Kymlicka only describe reason as “non essential” when it comes to describing moral patients, not moral agents, and particularly not moral theoreticians. In the second place, Zoopolis presents itself explicitly as an effort in “articulating moral reasons” — not as a renouncement of reason as such. (shrink)

“Pick a card, any card. This has to be a completely free choice.” the magician tells you. But is it really? Although we like to think that we are using our free will to make our decisions, research in psychology has shown that many of our behaviours are automatic and unconsciously influenced by external stimuli (Ariely, 2008; Bargh & Chartrand, 1999; Newell & Shanks, 2014; Nisbett & Wilson, 1977), and that we are often oblivious to the cognitive mechanisms that (...) underpin our decision (Wegner, 2002, 2003). Magicians have exploited this illusory sense of agency for a long time, and have developed a wide range of techniques to influence and control spectators’ choices of such things as card, word, or number (Annemann, 1933; Banachek, 2002a; Jones, 1994; Turner, 2015). These techniques are instances of what is called forcing. -/- Many forces are extremely effective, illustrating various weaknesses in our sense of control over decisions and their outcomes. Researchers have started to investigate them in various ways (Kuhn, Pailh s, & Lan, 2020; Olson, Amlani, Raz, & Rensink, 2015; Pailhes & Kuhn, 2020b, 2020c; Shalom et al., 2013) and are beginning to obtain valuable insights into decision-making processes as well as a better understanding of the cognitive mechanisms that lead people to experience an illusory sense of free will and of agency. -/- Although magicians have acquired large amounts of knowledge in covertly controlling people’s choices, much of this knowledge is only discussed in the context of individual magic tricks, or in books that are not readily accessible to non-magicans. As we and others have argued elsewhere (Ekroll, Sayim, & Wagemans, 2017; Kuhn, 2019; Kuhn, Amlani, & Rensink, 2008; Kuhn, Caffaratti, Teszka, & Rensink, 2014; Macknik et al., 2008; Olson et al., 2015; Olson, Landry, Appourchaux, & Raz, 2016; Shalom et al., 2013; Thomas, Didierjean, Maquestiaux, & Gygax, 2015), a particularly effective way of making this knowledge more available is via the creation of taxonomies centered around psychological mechanisms (Rensink & Kuhn, 2015). For example, the psychologically based taxonomy of misdirection (Kuhn et al., 2014) helps draw links between misdirection and formal theories of perception and cognition. -/- Our aim here is to apply a similar process to the knowledge magicians have about forcing. The present paper develops a psychologically based taxonomy of forcing techniques with two goals in mind. Firstly, it should help uncover the various psychological mechanisms that underlie forcing techniques. Secondly, it should facilitate knowledge transfer between magicians and psychologists. Among other things, this knowledge will allow researchers to gain new insights into the mechanisms underlying decision-making, and the feeling of free will and of agency over choice. In his famous 1982 paper, Allen Newell [22, 23] introduced the notion of knowledge level to indicate a level of analysis, and prediction, of the rational behavior of a cognitive arti cial agent. This analysis concerns the investigation about the availability of the agent knowledge, in order to pursue its own goals, and is based on the so-called Rationality Principle (an assumption according to which "an agent will use the knowledge it has of its environment to achieve its goals" (...) [22, p. 17]. By using the Newell's own words: "To treat a system at the knowledge level is to treat it as having some knowledge, some goals, and believing it will do whatever is within its power to attain its goals, in so far as its knowledge indicates" [22, p. 13]. In the last decades, the importance of the knowledge level has been historically and system- atically downsized by the research area in cognitive architectures (CAs), whose interests have been mainly focused on the analysis and the development of mechanisms and the processes governing human and (arti cial) cognition. The knowledge level in CAs, however, represents a crucial level of analysis for the development of such arti cial general systems and therefore deserves greater research attention [17]. In the following, we will discuss areas of broad agree- ment and outline the main problematic aspects that should be faced within a Common Model of Cognition [12]. Such aspects, departing from an analysis at the knowledge level, also clearly impact both lower (e.g. representational) and higher (e.g. social) levels. (shrink)

This article addresses three main questions: What causes cognitive overload in the workplace? What analytical framework should be used to understand how agents interact with their work environments? How can environments be restructured to improve the cognitive workflow of agents? Four primary causes of overload are identified: too much tasking and interruption, and inadequate workplace infrastructure to help reduce the need for planning, monitoring, reminding, reclassifying information, etc… The first step in reducing the cognitive impact of these causes is to (...) enrich classical frameworks for understanding work environments, such as Newell and Simon’s notion of a task environment, by recognizing that our actual workplace is a superposition of many specific environments – activity spaces – which we slip between. Each has its own cost structure arising from the tools and resources available, including the cognitive strategies and interpretational frameworks of individual agents. These cognitive factors are significant, affecting how easy or difficult it is to perform an action, such as finding a specific paper in a “mess” desk. A few simple examples show how work environments can be redesigned and how restructuring can alter the cost structure of activity spaces. (shrink)

In order to handle presuppositions in the scope of attitude verbs, the binding theory allows presuppositions triggered in a subject's beliefs to be bound at the matrix level; and it allows presuppositions triggered in non-doxastic attitudes to be bound in the subject's beliefs (Geurts, 1999; Maier, 2015). However, we argue that this leads to serious overgeneration, for example it predicts that the unacceptable `Sue will come to the party, but Bill is sure that she won't and that only Sue will (...) come to the party' should be equivalent to the acceptable `Sue will come to the party, but Bill is sure that nobody will come to the party'. This is because the presupposition triggered by `only Sue will come to the party' should be able to be bound at the matrix level. We discuss some responses to this problem, but argue that they all have shortcomings. (shrink)

Thirty years ago, I elaborated on a position that could be seen as a compromise between an "extreme," symbol-based AI, and a "neurochemical reductionism" in AI. The present article recalls aspects of the espoused framework of schema theory that, it suggested, could provide a better bridge from human psychology to brain theory than that offered by the symbol systems of A. Newell and H. A. Simon.

I introduce the seven papers in this special issue, by Andy Clark, Je´roˆme Dokic, Richard Menary, Jenann Ismael, Sue Campbell, Doris McIlwain, and Mark Rowlands. This paper explains the motivation for an alliance between the sciences of memory and the extended mind hypothesis. It examines in turn the role of worldly, social, and internalized forms of scaffolding to memory and cognition, and also highlights themes relating to affect, agency, and individual differences.

The paper defends the claim that the mechanistic explanation of information processing is the fundamental kind of explanation in cognitive science. These mechanisms are complex organized systems whose functioning depends on the orchestrated interaction of their component parts and processes. A constitutive explanation of every mechanism must include both appeal to its environment and to the role it plays in it. This role has been traditionally dubbed competence. To fully explain how this role is played it is necessary to explain (...) the information processing inside the mechanism embedded in the environment. The most usual explanation on this level has a form of a computational model, for example a software program or a trained artificial neural network. However, this is not the end of the explanatory chain. What is left to be explained is how the program is realized (or what processes are responsible for information processing in the artificial neural network). By using two dramatically different examples from the history of cognitive science I show the multi-level structure of explanations in cognitive science. These examples are (1) the explanation of human process solving as proposed by A. Newell & H. Simon; (2) the explanation of cricket phonotaxis via robotic models by B. Webb. (shrink)

Since the early eighties, computationalism in the study of the mind has been “under attack” by several critics of the so-called “classic” or “symbolic” approaches in AI and cognitive science. Computationalism was generically identified with such approaches. For example, it was identified with both Allen Newell and Herbert Simon’s Physical Symbol System Hypothesis and Jerry Fodor’s theory of Language of Thought, usually without taking into account the fact ,that such approaches are very different as to their methods and aims. (...) Zenon Pylyshyn, in his influential book Computation and Cognition, claimed that both Newell and Fodor deeply influenced his ideas on cognition as computation. This probably added to the confusion, as many people still consider Pylyshyn’s book as paradigmatic of the computational approach in the study of the mind. Since then, cognitive scientists, AI researchers and also philosophers of the mind have been asked to take sides on different “paradigms” that have from time to time been proposed as opponents of (classic or symbolic) computationalism. Examples of such oppositions are: -/- computationalism vs. connectionism, computationalism vs. dynamical systems, computationalism vs. situated and embodied cognition, computationalism vs. behavioural and evolutionary robotics. -/- Our preliminary claim in section 1 is that computationalism should not be identified with what we would call the “paradigm (based on the metaphor) of the computer” (in the following, PoC). PoC is the (rather vague) statement that the mind functions “as a digital computer”. Actually, PoC is a restrictive version of computationalism, and nobody ever seriously upheld it, except in some rough versions of the computational approach and in some popular discussions about it. Usually, PoC is used as a straw man in many arguments against computationalism. In section 1 we look in some detail at PoC’s claims and argue that computationalism cannot be identified with PoC. In section 2 we point out that certain anticomputationalist arguments are based on this misleading identification. In section 3 we suggest that the view of the levels of explanation proposed by David Marr could clarify certain points of the debate on computationalism. In section 4 we touch on a controversial issue, namely the possibility of developing a notion of analog computation, similar to the notion of digital computation. Genocide remembrance is a complex epistemological/ethical achievement, whereby survivors and descendants give meaning to the past in the quest for both personal-historical and social-historical truth. This paper offers an argument of epistemic injustice specifically as it occurs in relation to practices of (individual and collective) genocide remembrance. In particular, I argue that under conditions of genocide denialism, understood as collective genocide misremembrance and memory distortion, genocide survivors and descendants are confronted with hermeneutical oppression. Drawing on Sue Campbell’s relational, reconstructive account (...) of remembering, I argue that genocide denialism involves disrespectful challenges to memory, which systematically misrecognize rememberers. Adopting the case of Turkey’s denialism of the Armenian genocide, I discuss two interrelated mechanisms through which this can happen: i) through the systematic portrayal of survivors and descendants as vicious rememberers, and ii) through distortions of the very concept of ‘genocide’. Based on this, I show how hermeneutical and testimonial injustice are crucially interrelated when it comes to “contested” memories of historical injustice and the biographical testimony it gives rise to. Scopo del presente articolo è di mostrare la genesi e l’evoluzione di tale concetto, a partire dalle sue prime occorrenze in Umano, troppo umano I fino al suo compiuto sviluppo negli scritti del 1885-87. Tale studio permetterà di evidenziare il particolare valore (...) che Nietzsche attribuisce ai “buoni europei”, in quanto promotori dello sviluppo spirituale conseguente alla compiuta liberazione della morale cristiana. ENG: The “good European” is a rich and important topic in Nietzsche. It is first related to Nietzsche’s early reflections on European culture, and during the 1880’s it gains philosophical value, being strictly connected with the purposes of Nietzsche’s mature thought. The aim of this paper is to track the genesis and development of the notion of “good European”, from Human, all too Human I to Nietzsche’s writings from the years 1885-1887. That investigation shall particularly show the meaning and value that Nietzsche attributes to the good Europeans; as for him, they are in fact the leaders of the spiritual development that follows the overcoming of Christian morality. : How much power does emotional dismissal have over the oppressed's ability to trust outlaw emotions, or to stand for such emotions before others? I discuss Sue Campbell 's view of the interpretation of emotion in light of the political significance of emotional dismissal. In response, I suggest that feminist conventions of interpretation developed within dialogical communities are best suited to providing resources for expressing, interpreting, defining, and reflecting on our emotions.

The purpose of this paper is to provide a detailed technical protocol analysis of chess masters' evaluative expertise, paying particular attention to the analysis of the structure of their memory process in evaluating foreseen possibilities in games of dynamic equilibrium. The paper has two purposes. First, to publish a results chapter from my DPhil thesis (in revised journal article form) attending to the measurement of foresight in chess masters' evaluation process, testing alternative theories of cognitive expertise in the domain of (...) chess; and second to provide a subset of the technical graphical analysis that corresponds to that measurement to preserve this protocol analysis for access in the academic domain for future studies of expert memory and foresight (e.g., Ericsson & Simon, 1993). The step-by-step protocol analysis consists of: (i) an introduction to foresight cognition as hypothesis testing, (ii) a theoretical review in the domain of chess masters' expertise according to the theoretical frameworks in that field purporting hypotheses relevant to chess masters' evaluative skill processes, and (iii) summary tables and non-parametric statistical analysis corroborating chunking theory frameworks of expert cognition (e.g., DeGroot, 1965; Newell & Simon, 1972; Gobet, 1998; Gobet et al., 2004), and refuting the alternative search-evaluation models (e.g., Holding & Reynolds, 1982). Moreover, the journal article espouses the preservation of the traditional protocol analysis method core to the field of expert cognition (DeGroot, 1969; Kotov, 1971). The full protocol analysis can be found in monograph form here on my SSRN profile in ‘The role of falsification in hypothesis testing’. It takes the form of a specialist population study (e.g., detailed case study work; Luria, 1987). Thus the outline consists of a short introduction, a theoretical methodological review discussing protocol analysis methods for specialist population studies in cognition (with particular attention to the preservation of protocol analysis methods for chess studies in cognition and expert memory/ with a fresh angle on the foresight process), and the full set of protocol analyses with corresponding problem behaviour graphs. A subset of the main results has been published elsewhere (e.g., Cowley & Byrne, 2004; Cowley 2006), receiving scientific and scientific journalistic acclaim (e.g., Nature Online News 2004). My main aim is to clarify what we mean by ‘look’ sentences such as (1) below – ones that we use to talk about visual experience: -/- (1) The ball looked red to Sue -/- This is to help better understand a part of natural language that has so far resisted treatment, and also to help better understand the nature of visual experience. -/- By appealing to general linguistic principles I argue for the following account. First, we use (1) to (...) talk about an event. Second, we use the verb ‘look’ to specify the kind of event about which we are talking – it is a looking event. Third, we use the subject ‘the ball’ to specify a stimulus of the event – something that looks some way in the event. Fourth, we use the adjunct ‘to Sue’ to specify an experiencer of the event – someone to whom things look some way in the event. Finally, we use the complement ‘red’ to specify a way of the event – a way in which the event occurs (I take ways of occurring to be properties of events). Which way do we use ‘red’ in (1) to specify? I argue: the maximally specific way w such that the following is generically true: looking events whose stimulus is red occur in way w (it is important that this is understood generically: this is what does much of the work in explaining our use of (1) and other ‘look’ sentences). Putting this together, what we mean by (1) is: there was a looking event whose stimulus was the ball, whose experiencer was Sue, and which occurred in the maximally specific way that looking events occur when their stimulus is red. -/- This account of how we use ‘red’ in (1) is one of the most interesting aspects of my thesis. It extends to an account of how we use ‘proud’ in ‘John walks proud’, ‘as if he is American’ in ‘John talks as if he is American’, ‘like a duck’ in ‘John sounds like a duck’, and so on. In each case we use the expression in question to specify a way: the maximally specific way proud people walk, the maximally specific way American people talk, and so on. So the study of ‘look’ sentences has much to tell us about the functioning of many other English language constructions, and suggests that ways have a significant role to play in the semantics of natural language – a fact that has not yet been sufficiently recognised by linguists or philosophers of language. -/- My thesis also has implications for the philosophy of perception. One of the central questions about perception is: What is the nature of visual experience? What is it, for example, for a ball to look red to Sue? My thesis offers an answer: What it is for the ball to look red to Sue is for whatever it is that we mean by ‘The ball looks red to Sue’ to be the case, and what we mean by ‘The ball looks red to Sue’ is that there is a looking event whose stimulus is the ball, whose experiencer is Sue, and which is occurring in a certain way. It thus delivers an adverbial account of visual experience, one that has the resources to better deal with problems that are traditionally thought to be decisive against adverbial accounts. (shrink)

Microaggressions are seemingly negligible slights that can cause significant damage to frequently targeted members of marginalized groups. Recently, Scott O. Lilienfeld challenged a key platform of the microaggression research project: what’s aggressive about microaggressions? To answer this challenge, Derald Wing Sue, the psychologist who has spearheaded the research on microaggressions, needs to theorize a spectrum of aggression that ranges from intentional assault to unintentional microaggressions. I suggest turning to Bonnie Mann’s “Creepers, Flirts, Heroes and Allies” for inspiration. Building from Mann’s (...) richer theoretical framework will allow Sue to answer Lilienfeld’s objection and defend the legitimacy of the concept, ‘microaggression’. (shrink)

This article investigates the original meaning of dependent arising in the Buddha’s teaching, by focussing on the imasmi" sati formula. Modern scholars such as the Rhys Davidses, K.N. Jayatilleke and Paul Williams have interpreted it as a princi- ple of causation, comparable to a scientific conception of causation. I argue instead that this formula implies that the Buddha held that causation is nothing more than the correlation of causes and effects, and that it commits the Buddha to a Humean regularity (...) thesis about causation. I draw a distinction between the Buddhist and scientific concepts of causation, and then summarise an alternative approach made by more recent scholars such as Sue Hamilton, Noa Ronkin and Eviatar Shulman, who present dependent arising in terms of conditionality in the causal structure of subjective experience. I conclude by presenting the argument that the imasmi" sati formula does not express a principle of causation but is rather a formula for the method of discovering and presenting causation as conditionality in experience. The revised and polished version of Inwood’s 2011 Carl Newell Jackson at Harvard University, Ethics after Aristotle surveys the ethical teachings of the original “neo-Aristotelians,” namely those self-identified (although not always named) members of the Peripatetic school from the time of Theophrastus (fl. 300 BCE) until that of Alexander of Aphrodisias (fl. 200 CE). An initial chapter surveys the sorts of problems in Aristotle’s ethical corpus which would generate subsequent debate amongst members of the Peripatetic school. Chapter Two examines (...) the views of “Magnus,” the name which Inwood gives to the anonymous 3rd century author of the Magna Moralia (which Inwood takes to be pseudo-Aristotle), and those of Strato of Lampsacus, Lycon, and Hieronymus, 3rd century heads of the Peripatetic school, all of whom show the influences of Epicureanism in their re-articulations of Aristotelian positions. Chapter Three, entitled “The Turning Point,” finds in the work of Critolaus—head of the Peripatetic school in the middle of the 2nd century BCE—a move away from the centrality of activity within Aristotelian ethical thought, which Critolaus instead replaces with the notion of possessing specific goods, namely those of the body, the soul, and what is external. The same chapter argues that at approximately the same historical point Cicero, in the character of Piso in De finibus, articulated an account of Peripatetic ethics that was far more faithful to 4th century Aristotelianism. The final two chapters focus on neo-Aristotelian ethical philosophizing within a new and explicitly Roman cultural setting. (shrink)

Connections between Pañcaviṃśatisāhasrikā-prajñāpāramitā-sūtra and Aṣṭasāhasrikā-prajñāpāramitā-sūtra suggest a new interpretation of an important passage in the Prajñāpāramitā-hṛdaya or Heart Sutra. I am able to show that the four phrases exemplified by “form is emptiness” were once a reference to the well-known simile, “Form is like an illusion” (rūpam māyopamam). As the Prajñāpāramitā corpus expanded, the simile became a metaphor, “form is illusion”. It was then deliberately altered by exchanging “illusion” for “emptiness”, leading to the familiar phrases. This connection opens the door (...) to reading the Heart Sutra, and the early Prajñāpāramitā sutras more generally, along the lines of Sue Hamilton’s (2000) epistemological approach to the Pāḷi suttas; i.e. as focussed on experience and particularly the meditative experience known in the Pāḷi suttas as dwelling in emptiness (suññatā-vihāra). In this view, the Heart Sutra makes sense on its own terms without having to invoke paradox or mysticism. (shrink)

It could be argued that tort law is failing, and arguably an example of this failure is the recent public liability and insurance (‘PL&I’) crisis. A number of solutions have been proposed, but ultimately the chosen solution should address whatever we take to be the cause of this failure. On one account, the PL&I crisis is a result of an unwarranted expansion of the scope of tort law. Proponents of this position sometimes argue that the duty of care owed by (...) defendants to plaintiffs has expanded beyond reasonable levels, such that parties who were not really responsible for another’s misfortune are successfully sued, while those who really were to blame get away without taking any responsibility. However people should take responsibility for their actions, and the only likely consequence of allowing them to shirk it is that they and others will be less likely to exercise due care in the future, since the deterrents of liability and of no compensation for accidentally self-imposed losses will not be there. Others also argue that this expansion is not warranted because it is inappropriately fueled by ‘deep pocket’ considerations rather than by considerations of fault. They argue that the presence of liability insurance sways the judiciary to award damages against defendants since they know that insurers, and not the defendant personally, will pay for it in the end anyway. But although it may seem that no real person has to bear these burdens when they are imposed onto insurers, in reality all of society bears them collectively when insurers are forced to hike their premiums to cover these increasing damages payments. In any case, it seems unfair to force insurers to cover these costs simply because they can afford to do so. If such an expansion is indeed the cause of the PL&I crisis, then a contraction of the scope of tort liability, and a pious return to the fault principle, might remedy the situation. However it could also be argued that inadequate deterrence is the cause of this crisis. On this account the problem would lie not with the tort system’s continued unwarranted expansion, but in the fact that defendants really have been too careless. If prospective injurers were appropriately deterred from engaging in unnecessarily risky activities, then fewer accidents would ever occur in the first place, and this would reduce the need for litigation at its very source. If we take this to be the cause of tort law’s failure then our solution should aim to improve deterrence. Glen Robinson has argued that improved deterrence could be achieved if plaintiffs were allowed to sue defendants for wrongful exposure to ongoing risks of future harm, even in the absence of currently materialized losses. He argues that at least in toxic injury type cases the tortious creation of risk [should be seen as] an appropriate basis of liability, with damages being assessed according to the value of the risk, as an alternative to forcing risk victims to abide the outcome of the event and seek damages only if and when harm materializes. In a sense, Robinson wishes to treat newly-acquired wrongful risks as de-facto wrongful losses, and these are what would be compensated in liability for risk creation (‘LFRC’) cases. Robinson argues that if the extent of damages were fixed to the extent of risk exposure, all detected unreasonable risk creators would be forced to bear the costs of their activities, rather than only those who could be found responsible for another’s injuries ‘on the balance of probabilities’. The incidence of accidents should decrease as a result of improved deterrence, reduce the ‘suing fest’, and so resolve the PL&I crisis. So whilst the first solution involves contracting the scope of tort liability, Robinson’s solution involves an expansion of its scope. However Robinson acknowledges that LFRC seems prima facie incompatible with current tort principles which in the least require the presence of plaintiff losses, defendant fault, and causation to be established before making defendants liable for plaintiffs’ compensation. Since losses would be absent in LFRC cases by definition, the first evidentiary requirement would always be frustrated, and in its absence proof of defendant fault and causation would also seem scant. If such an expansion of tort liability were not supported by current tort principles then it would be no better than proposals to switch accident law across to no-fault, since both solutions would require comprehensive legal reform. However Robinson argues that the above three evidentiary requirements could be met in LFRC cases to the same extent that they are met in other currently accepted cases, and hence that his solution would therefore be preferable to no-fault solutions as it would only require incremental but not comprehensive legal reform. Although I believe that actual losses should be present before allowing plaintiffs to seek compensation, I will not present a positive argument for this conclusion. My aim in this paper is not to debate the relative merits of Robinson’s solution as compared to no-fault solutions, nor to determine which account of the cause of the PL&I crisis is closer to the truth, but rather to find out whether Robinson’s solution would indeed require less radical legal reform than, for example, proposed no-fault solutions. I will argue that Robinson fails to show that current tort principles would support his proposed solution, and hence that his solution is at best on an even footing with no-fault solutions since both would require comprehensive legal reform. The concept of vulnerability has been renewed in meaning and importance over recent decades. Scholars such as Judith Butler, Martha Fineman and Pamela Sue Anderson have endeavored to redeem vulnerability from its traditional signification as a negative individual condition, and to reveal the positive meaning of vulnerability as a transformative call for solidarity, equality and love. In this paper we examine the newly constructed positive understanding of vulnerability, and argue that the current way of pursuing this positive understanding affirms a (...) merely functional positivity. In the recent accounts, vulnerability is still a status to avoid, yet functions positively as a corrective force to the environment that produces vulnerability. We will try to find an essential way of designating the positivity of vulnerability by revisiting the philosophical discussion on vulnerability in Emmanuel Levinas. We will argue that Levinas’s notion of vulnerability is positive in a sense which goes beyond the purely functional; it is seen as essential for his definition of humanity. Yet compared to the contemporary discussion, Levinas’s notion of vulnerability lacks a direct social political meaning. We will tentatively explore how the essential positivity drawn from Levinas can provide a new way to construct the political significance of vulnerability. (shrink)

Che cosa distingue, concettualmente, l’esattore delle tasse che esiga da un uomo, a pena di sanzioni, una determinata somma di denaro, dal bandito che gli intimi, sotto la minaccia di un’arma, di consegnargli la medesima somma? È sul soddisfacimento del requisito della giustizia che si fonda, come sostenne Agostino, l’eterogeneità tra uno Stato e un’accolita di furfanti? «Se non è rispettata la giustizia, che cosa sono gli Stati, se non delle grandi bande di ladri? Perché le bande di briganti che (...) cosa sono, se non dei piccoli Stati?». Il volume ripercorre le risposte più autorevoli fornite nel XX secolo, entro un orizzonte postmetafisico, alla domanda agostiniana: prima dell’avvento del regime nazista, la tesi che un’associazione a delinquere sia indistinguibile da uno Stato è stata sostenuta da Benedetto Croce, Santi Romano e Hans Kelsen; dopo l’esperienza del nazismo e delle sue atrocità, perpetrate in nome dello Stato e della legge, le questioni relative alla natura del diritto e alla relazione tra morale e diritto hanno assunto – come ha osservato Robert Alexy – «l’urgenza di un problema scottante», e la domanda filosofica sulla validità della legge ingiusta è apparsa ineludibile non solo ai maggiori filosofi del diritto (Herbert L.H. Hart, Alf Ross, Ronald Dworkin e lo stesso Alexy), ma alle stesse corti tedesche. (shrink)

In the 1980s and 1990s, a series of attempts were made to put into U.S. law a civil rights ordinance that would make it possible to sue the makers and distributors of pornography for doing so (under certain conditions). One defence of such legislation has come to be called "the free speech argument against pornography." Philosophers Rae Langton, Jennifer Hornsby and Caroline West have supposed that this defence of the legislation can function as a liberal defence of the legislation: in (...) particular, a defence of the legislation based on the value of women's liberty. This would be somewhat unexpected given MacKinnon's own antipathy toward liberalism. In this paper, I argue that the free speech argument against pornography cannot be used as a liberal defence of the ordinances. The legislation is, to some extent, self-defeating insofar as it understood in terms acceptable to a fairly standard kind of liberal. This becomes apparent when we consider the value pornography can have for women, which we can see if we consider what female makers, distributors and consumers of pornography have to say about why they make, distribute and consume it. In questo saggio traccio un profilo del pensiero di Bernard Williams, concentrandomi su temi relativi alla filosofia morale e, più nello specifico, ricostruendo la sua disamina dell’idea di oggettività in questa disciplina. Dopo aver esaminato le sue critiche all’idea di teoria etica normativa, offro un inquadramento metaetico della sua posizione e concludo mostrando le sue affinità con la riflessione etica degli antichi Greci e, in particolar modo, di Aristotele.

L’obiettivo di questa bibliografia tematica, tuttavia, è quello di fornire al lettore una panoramica, sintetica ma informativa, sull’evoluzione dell’epistemologia delle virtù nell’arco di quasi quattro decenni. La selezione dei testi che verranno menzionati in questa bibliografia tematica tenta, per quanto possibile, di rispettare lo sviluppo cronologico dell’epistemologia delle virtù. Tuttavia, il criterio che ho scelto di adottare per la classificazione di queste opere è primariamente tematico: dopo una prima sezione dedicata alle origini dell’epistemologia delle virtù, verranno indicati alcuni testi che (...) rappresentano gli sviluppi teorici fondamentali—o, a mio avviso, meglio riusciti—di questa corrente, alla luce delle critiche che le sono state via via rivolte con il passare del tempo. Infine, nella terza e ultima sezione saranno proposti alcuni lavori che indicano i nuovi orizzonti della ricerca nell’epistemologia delle virtù e le sue possibili implicazioni in altri ambiti filosofici. Come si può facilmente immaginare, la selezione dei testi è frutto di una scelta, motivata ma comunque opinabile, ed è dettata da limiti di spazio. Pertanto, questa bibliografia tematica non può avere né l’ambizione di mettere tutti d’accordo, né la pretesa di essere completa. Il miglior auspicio è, piuttosto, che queste brevi considerazioni possano suscitare l’interesse del lettore e invitarlo ad approfondire lo studio dell’epistemologia delle virtù nelle maniere che questi riterrà più opportuno. Thinking the Visual, Visualizing the Thought. A perceptual and Political Model of VisionMerleau-Ponty’s program of perceptivizing thought has depoliticizing effects that, though he does not recognize them, undermine his understanding of politics. These anti-political consequences, moreover, bring out the internal difficulties of his anti-intellectualist starting point. There are three areas in which Merleau-Ponty gave a thorough application, though with unequal success, of his perception-based model: the presentation of his own thought, in which his program of picturalization had a striking success; (...) the explanation of the historical process, in which his visualization model was only partly effective; and access to other people’s thought, in which his perceptivist views encountered an undeniable failure. Merleau-Ponty’s successive approaches to other people’s thought show, by two distinct paths, and beyond his own intentions, an unforeseen political defect. His perceptive model proves incompatible with his political ideas when it is applied in depth, and it thus breaks apart the cohesion of his thought. From a larger perspective, it disrupts reflective approaches to politics since it damages their conceptual bases. This article shows successively that Merleau-Ponty laid out a perceptive model of universal scope; that he applied it to several areas, including politics; that this model proves politically deficient when it serves to remove the autochthonous sources of sense; that these depoliticizing effects become more acute when Merleau-Ponty employs the perceptive model to elucidate other people’s thought; and that its frustration in this area not only devalues his political reflections, but also signals that the perceptive model simply prevents a “thinking of the political.”Pensare il visuale, visualizzare il pensiero.Un modello percettivo e politico della visioneIl programma di percettivizzazione del pensiero intrapreso da Merleau-Ponty comporta effetti spoliticizzanti che sconfessano nascostamente la sua comprensione della politica. Tali conseguenze antipolitiche mettono altresì in rilievo le difficoltà intrinseche alla sua posizione anti-intellettualista. Vi sono tre ambiti nei quali Merleau-Ponty, con diverso successo, ha applicato il suo modello percettivo : la presentazione del suo stesso pensiero, nella quale questo programma di pittoricizzazione incontra un successo trionfale; la chiarificazione del processo storico, dove tale modello “visualeˮ non è efficace che in parte; infine l’accesso al pensiero di altri autori, terreno sul quale questa prospettiva percettivista subisce uno scacco innegabile. Molti tentativi merleaupontiani di approcciare il pensiero di altri autori attestano in vario modo un imprevisto deficit politico. Il modello percettivo di Merleau-Ponty si rivela in altri termini incompatibile con le sue idee politiche, nel momento in cui viene applicato in profondità, e in ultima analisi mette a dura prova la coerenza del suo pensiero. In una prospettiva più ampia, esso ostacola un approccio riflessivo alla politica poiché ne degrada le stesse basi concettuali. Il nostro articolo mostra quindi che Merleau-Ponty ha articolato un modello percettivo di portata universale; che l’ha applicato a svariati ambiti d’indagine, tra cui la politica; che quel modello si rivela deficitario quando viene utilizzato per attingere a specifiche fonti di senso; che tali effetti spoliticizzanti si acuiscono nel momento in cui Merleau-Ponty adotta il modello percettivo per illuminare il pensiero di altri autori; che, per concludere, la sua incongruenza con questo peculiare ambito di riflessione non solo impoverisce le sue riflessioni politiche, ma attesta che in linea generale il modello percettivo sbarra la strada a un qualsiasi «pensiero del politico». All'inizio degli anni '90 nella pubblicistica tedesca emerge la tendenza a decretare la fine politica dell’istituzione partito. Tipicamente, il partito viene presentato come un dinosauro della democrazia ormai incapace di assolvere alle sue funzioni tipiche o come piovra infiltratasi illegittimamente in ogni ambito della vita civile. La tesi di quest’articolo è che, al contrario, i partiti tedeschi abbiano dimostrato una forte reattività alle mutate circostanze nazionali e internazionali e che siano riusciti a mantenere il loro tipico ruolo funzionale di mediatore, (...) rappresentante ed amministratore degli interessi degli elettori. Catharine Trotter Cockburn (1679- 1749) fu poetessa, drammaturga e filosofa. La vivacità intellettuale e la forte determinazione le permisero di aggirare il pregiudizio di genere e di sottrarsi alle dinamiche di marginalizzazione femminile tipiche dell’età moderna. Pur celandosi dietro l’anonimato, Cockburn prese parte attiva al dibattito filosofico del tempo, intervenendo soprattutto in materia di morale. Le sue opere filosofiche, scritte in difesa di Locke o di Clarke, custodiscono, nonostante il dichiarato intento apologetico, tratti di originalità e indipendenza, particolarmente evidenti nella (...) teoria dell’obbligo morale, nell’interpretazione modale della dottrina lockeana d’identità personale, nell’ipotesi di una natura ontologica dello spazio. Domesticated animals need to be treated as fellow citizens: only if we conceive of domesticated animals as full members of our political communities can we do justice to their moral standing—or so Sue Donaldson and Will Kymlicka argue in their widely discussed book Zoopolis. In this contribution, we pursue two objectives. Firstly, we reject Donaldson and Kymlicka’s appeal for animal citizenship. We do so by submitting that instead of paying due heed to their moral status, regarding animals as citizens misinterprets (...) their moral qualities and thus risks treating them unjustly. Secondly, we suggest that Donaldson and Kymlicka’s reinforced focus on membership should draw our attention to the moral standing of a further ‘species’, namely robots. Developments within artificial intelligence have advanced rapidly in recent years. With robots’ gaining ever greater capacities and abilities, we need to ask urgent questions about the moral ramifications of these technical advances. (shrink)

L’indagine sugli anni giovanili di Benedetto Spinoza, filosofo poco compreso nel tempo in cui visse e colpito dalla scomunica della comunità ebraica nel 1656, a 24 anni, rivela una personalità già straordinariamente autonoma ed una forte indipendenza di pensiero. Dotato di una immensa cultura, comprensiva di molteplici riferimenti e tradizioni, Spinoza scopre e si avvicina anche alla filosofia di Cartesio, che lo affascina per la sua chiarezza logico-matematica ed il rigore che la caratterizza. La prima opera in cui egli si (...) cimenta si chiama, proprio, Principi di filosofia cartesiana, una lettura, migliorata in chiave di ricostruttivismo logico, del testo cartesiano. In questo documentatissimo e agile libro si ripercorre la fase giovanile della vita del filosofo olandese: l’ambiente religioso, gli studi, l’intraprendenza commerciale dell’Olanda del Seicento, il desiderio di solitudine per compiere le sue ricerche, l’aspirazione ad una vita tranquilla e l’amore per la verità, ma anche le frequentazioni con le sette religiose del suo tempo e la fitta rete di contatti e corrispondenze che Spinoza intrattenne con diversi intellettuali europei, fino all’offerta di una cattedra universitaria che gli arriva nel 1673, dieci anni dopo la pubblicazione dei Principi, grazie ad una traduzione fattane da Pieter Balling. Il successivo distacco da Cartesio porterà Spinoza ad elaborare un proprio originale sistema e gli consentirà di sviluppare l’idea del Deus sive Natura. (shrink)
