Several recent works in history and philosophy of science have re-evaluated the alleged opposition between the theses put forth by logical empiricists such as Carnap and the so-called "post-positivists", such as Kuhn. Although the latter came to be viewed as having seriously challenged the logical positivist views of science, recent authors (e.g., Friedman, Reisch, Earman, Irzik and Grünberg) maintain that some of the most notable theses of the Kuhnian view of science have striking similarities with some aspects of Carnap's philosophy. (...) Against that reading, Oliveira and Psillos argue that within Carnap's philosophy there is no place for the Kuhnian theses of incommensurability, holism, and theory-ladenness of observations. This paper presents each of those readings and argues that Carnap and Kuhn have non-opposing views on holism, incommensurability, the theory-ladenness of observations, and scientific revolutions. We note at the very end - without dwelling on the point, however - that they come apart on other matters, such as their views on metaphysics and on the context of discovery/justification distinction. Concluímos o artigo com algumas observações sobre lógicas não clássicas e seus impactos sobre a filosofia. Preface -/- This volume was published in 2000 by Jaca Book under the title Ethics of Reason. La filosofia dell'uomo nell'epoca del nichilismo e del confronto interculturale (The Philosophy of Man in the Age of Nihilism and Intercultural Confrontation) and is now long out of print. I gladly republish it online because, for the most part, I still recognize myself in what was written. The book had required considerable work and had been prepared by many years of study at a (...) time when I had the opportunity to study intensively and continuously. It benefited from the encounter that took place for me in those years between the continental tradition (with particular attention, in addition to the classics, to twentieth-century Christian thought of Thomasian and Augustinian inspiration) and contemporary Anglo-American philosophy. Exceeding 350 printed pages and dealing with various themes, albeit interrelated, and much metaphysics, it was certainly not a work suited to the new cultural trends. I have subsequently deepened and modified individual aspects in other publications, but the overall itinerary in the volume remains valid for me. Even the title is for me still valid, although today I would prefer Ethics of Rationality. The challenges of nihilism and interculturalism (to which the subtitle refers) remain valid, albeit in new forms, even if they are generally talked about less than they once were and take on new configurations. But the fact that something is talked about less or should be talked about less does not mean that the problem does not exist or has been philosophically overcome. To these can be added other challenges such as the ecological issue or the application of technology to mankind with biotechnology, challenges that have long been present in our culture. Some in-depth examinations of individual anthropological and ethical themes as well as philosophy of religion can be found in the volume L'uomo. Lineamenti di antropologia filosofica (Rubbettino 2013) and in the essays collected in the two volumes entitled L'esperienza integrale. Philosophy of Man, Morals and Religion (Orthotes 2016). In particular, the themes of Virtue ethics and Natural law have been re-proposed and explored in more recent essays (some of which are present in this collection). Certain themes such as those present in the central chapter precisely on the Ethics of Reason (where ample space is devoted to John Henry Newman) and other more exquisitely metaphysical ones such as those present in Chapter IV devoted to the classical transcendentals (ens, unum, verum, bonum, etc.) are only to be found in this volume. The volume, in fact, defends a realist conception of rationality that is inspired by Thomas Aquinas' conception of being, taken up with an existential accentuation, and which opposes the rationalist, immanentist and scientist turn of part of modern thought that according to many 20th century authors (such as Heidegger, but also Gilson and Fabro) would logically lead to nihilism. For this realist accentuation, too, it seems to me useful to republish the volume online. I therefore republish it with a few minor modifications and a few caveats. The overall itinerary of the volume was recently reproposed in a more summary and fragmentary form in the volume Etica del filosofare. Frammenti ironici, Il Melangolo 2020 and in my afterword to Virtù, legge e fioritura umana. Essays in honour of Angelo Campodonico, Mimesis 2022. First of all, in the new text that I am reproposing here, I have changed the term integrity (principio d'integrità) to integralità (principle of wholeness), which in the Italian language seems to me to be more in keeping with what is meant, even if it is more used and abused especially in the past decades in certain contexts. A lo largo de la obra de Tomás de Aquino es posible encontrar cierta tensión textual en torno a la posibilidad de conocer de manera natural la esencia divina. Por un lado el teólogo parece afirmar que, precisamente, no podemos conocer acerca de Dios qué es, sino solo qué no es. Pero, por otra parte, existe evidencia textual de que habría sostenido la posibilidad de un conocimiento quiditativo imperfecto. En tanto y en cuanto el matiz más positivo suele aparecer con (...) mayor énfasis en el tratamiento de los problemas relativos al lenguaje, un gran número de comentadores (desde E. Gilson hasta, más recientemente, D. Burrell, G. Rocca y R. Accar) ha expresado una tentencia a circunscribir la tensión al ámbito linguistico o judicativo. Tomás, de acuerdo a estos autores, nunca habría sostenido que es posible tener un conocimiento quiditativo natural de la esencia divina. En palabras de E. En este trabajo intentaremos volver a revisar la posición de Tomás sobre el conocimiento quiditativo natural desde sus bases. A nuestro entender el teólogo medieval ha sostenido desde sus obras más tempranas que es posible un conocimiento natural quiditativo -si bien imperfecto. Interpretamos que ese conocimiento incluye la posibilidad de representarnos, aunque de manera deficiente, la esencia divina. Defendemos, consecuentemente, la posibilidad de formarnos conceptos, siempre deficientes, claro, de la misma, distintos, por supuesto, de los conceptos análogos. Y sostenemos que la tesis de que la interpretación de la teoría epistemológica tomista en la que el sentido precede a la verdad judicativa no atenta contra la tesis de que Dios es, finalmente incomprehensible. In this paper the author deals with the new development of Metaphysics among American Thomists. In contrast to Gilson, there is revaluation of 'essence' among some authors, insofar form has an instrumental role for the existence of things (see e.g. Lawrence Dewan). The example of Stephen L. Brock is presented as an alternative to the excessive Apophaticism of some interpretations of Aquinas such as the one of J.-L. Marion.

This chapter explores the possibility of an alliance between Deleuze’s philosophy and feminist philosophy with respect to ethics. I begin by specifying some of the general points of convergence between Deleuzian ethics and feminist ethics. In the second section, I turn away from feminist ethics in particular to consider feminist engagement with Deleuze’s (and Deleuze and Guattari’s) work; in this section of the paper, I describe the central criticisms of Deleuze offered by feminist philosophers and point out the aspects of (...) his thought that have been valuable for feminist theorizing. In order to respond to what I take to be the overarching concern feminists have about Deleuze’s philosophy, the third section develops a proposal for a Deleuzian conception of ethics that is able to do (much of) what feminists require of an ethical theory. The question “what is an interpretation?” is often intertwined with the perhaps even harder question “what is a scientific theory?”. Given this proximity, we try to clarify the first question to acquire some ground for the latter. The quarrel between the syntactic and semantic conceptions of scientific theories occupied a large part of the scenario of the philosophy of science in the 20th century. For many authors, one of the two currents needed to be victorious. We endorse that such debate, (...) at least in the terms commonly expressed, can be misleading. We argue that the traditional notion of “interpretation” within the syntax/semantic debate is not the same as that of the debate concerning the interpretation of quantum mechanics. As much as the term is the same, the term “interpretation” as employed in quantum mechanics has its meaning beyond (pure) logic. Our main focus here lies on the formal aspects of the solutions to the measurement problem. There are many versions of quantum theory, many of them incompatible with each other. In order to encompass a wider variety of approaches to quantum theory, we propose a different one with an emphasis on pure formalism. This perspective has the intent of elucidating the role of each so-called “interpretation” of quantum mechanics, as well as the precise origin of the need to interpret it. (shrink)

Carnap's conception of linguistic frameworks is widespread; however, it is not entirely clear nor consensual to pinpoint what is the influence of his stance within the traditional realist/anti-realist debate. In this paper, we place Carnap as a proponent of a scientific realist stance, by presenting what he called “linguistic realism”. Some possible criticisms are considered, and a case study is offered with wave function realism, a popular position in the philosophy of quantum mechanics.

Wittgenstein’s concepts shed light on the phenomenon of schizophrenia in at least three different ways: with a view to empathy, scientific explanation, or philosophical clarification. I consider two different “positive” wittgensteinian accounts―Campbell’s idea that delusions involve a mechanism of which different framework propositions are parts, Sass’ proposal that the schizophrenic patient can be described as a solipsist, and a Rhodes’ and Gipp’s account, where epistemic aspects of schizophrenia are explained as failures in the ordinary background of certainties. I argue that (...) none of them amounts to empathic-phenomenological understanding, but they provide examples of how philosophical concepts can contribute to scientific explanation, and to philosophical clarification respectively. De uma perspectiva comportamentalista radical, o eu é um repertório verbal complexo, que, como tal, tem uma gênese social. O reconhecimento da origem social do “eu” abre caminho para uma análise política, incluindo uma discussão do pa- pel das relações de poder na constituição do eu. Entretanto, uma concepção radicalmente social do “eu”, como a proposta pelo comportamentalismo, suscita um problema político: se o eu é integralmente produto do ambiente social, de onde viria uma eventual “vontade” de romper com esse (...) sistema? Parece que para reconhecer a possibilidade de ação política transformadora seria preciso preservar uma noção descontextualizada de “eu”. Considerando essa dificuldade, o objetivo deste artigo é propor uma interpretação política da constituição do “eu” no âmbito do comportamentalismo radical, mantendo no horizonte a possibilidade de uma ação política transformadora. Para tanto, destacamos como “eus” oprimidos são tornados submissos, mas também como de certas contingências podem emergir “eus” subversivos, que se opõem a um sistema social opressivo. Esse “eu” subversivo é caracterizado por um repertório de autoconhecimento mais amplo, que inclui a discriminação do papel das relações de poder e do controle promovido por instituições. Concluímos, com isso, que um “eu” socialmente constituído pode ser politicamente ativo. (shrink)

O presente trabalho visa apresentar a solução dada por Santo Agostinho ao problema do mal, aliado à aparente contraditoriedade entre a presciência de Deus e a liberdade humana. Para isto, será útil como bibliografia principal do filósofo sua obra De libero arbitrio, um livro em forma de diálogo onde o pensador esclarece suas posições acerca do livre-arbítrio e da presciência divina.

Este ensaio estabelece uma comparação estética e fenomenológica entre os pensamentos de Yves-Klein e Merleau-Ponty. Se o pintor materializou as suas reflexões e concepções em obra pictórica, o fenomenólogo francês dissertou na escrita filosófica o resultado da sua reflexão. Da análise conjunta entre um e outro resulta esta fenomenologia e estética comparativa que apresenta alguns conceitos fundamentais que alimentaram essas reflexões, tais como a visibilidade, o corpo, o mundo. From the joint analysis between one and the other, this phenomenology and comparative aesthetics results, which presents some fundamental concepts that fed these reflections such as visibility, the body, the world. The ability to perceive the shapes of things as enduring through changes in how they stimulate our sense organs is vital to our sense of stability in the world. But what sort of capacity is shape constancy, and how is it reflected in perceptual experience? This paper defends a pluralist account of shape constancy: There are multiple kinds of shape constancy centered on geometrical properties at various levels of abstraction, and properties at these various levels feature in the content of (...) perceptual experience, governing patterns of apparent shape similarity. I propose that the varieties of shape constancy are subserved by the syntactic complexity of perceptual shape representations. By assigning discrete constituents to various abstract shape parameters, these representations attune us to the preservation of certain abstract shape properties through changes in more determinate shape properties. Finally, I draw broader lessons concerning the nature and function of perceptual constancy. (shrink)

Resumo: A crise na União Europeia e os programas de austeridade subsequentes fizeram emergir uma miríade de movimentos sociais, diversos na sua natureza e nos seus propósitos. O que se pretende aferir neste artigo é a relação e a conexão existentes entre o Estado, o poder económico, a sociedade civil e os movimentos sociais neste contexto específico de crise. Procuraremos, nesta breve abordagem, explanar alguns elementos de originalidade intrínsecos aos movimentos sociais hodiernos, patentes na sua forma de participação e organização, (...) assim como aplicar estas questões teóricas relevantes ao contexto português. A parte empírica, dada a escassez de estudos de caso existentes, será apoiada no último inquérito do European Social Survey, de 2012. Analisando um conjunto de perguntas aí explícitas, podemos compreender, de forma indirecta, algumas das dinâmicas que caracterizam estes movimentos. Abstract: The crisis in the European Union and the subsequent austerity programs have unleashed a myriad of social movements, diverse in its nature and purpose. The purpose of this paper is to assess the relationship and connection between the State, economic power, civil society and social movements in this specific context of crisis. We will try, in this brief approach, to explain some elements of originality intrinsic to modern social movements, evident in their form of participation and organization, as well as to apply these theoretical questions relevant to the Portuguese context. The empirical part, given the paucity of existing case studies, will be supported in the last survey of the European Social Survey of 2012. By analyzing a set of questions explicit there, we can, indirectly, understand some of the dynamics that characterize these movements. (shrink)

When we perceive an object, we perceive the object from a perspective. As a consequence of the perspectival nature of perception, when we perceive, say, a circular coin from different angles, there is a respect in which the coin looks circular throughout, but also a respect in which the coin's appearance changes. More generally, perception of shape and size properties has both a constant aspect—an aspect that remains stable across changes in perspective—and a perspectival aspect—an aspect that changes depending on (...) one's perspective on the object. How should we account for the perspectival aspect of spatial perception? We present a framework within which to discuss the perspectival aspect of perception and put forward three desiderata that any account of the perspectival aspect of perception should satisfy. We discuss views on which the perspectival aspect of perception is analyzed in terms of constitutively mind-dependent appearance properties as well as views on which the perspectival aspect of perception is analyzed in terms of representations of mind-independent perspectival properties. In this article, I examine the moral dimensions of gender affirmation. I argue that the moral value of gender affirmation is rooted in what Iris Murdoch called loving attention. Loving attention is central to the moral value of gender affirmation because such affirmation is otherwise too fragile or insincere to have such value. Moral reasons to engage in acts that gender affirm derive from the commitment to give and express loving attention to trans people as a way of challenging their (...) marginalization. In the latter part of the paper, I will discuss how my arguments bear on recent arguments by Robin Dembroff and Daniel Wodak (2018) on the use of gender-neutral language. They argue that we have a duty not to use gender-specific pronouns for anyone. Their conclusion turns, in part, on a rejection of gender affirmation as a moral duty. The value of gender affirmation, rooted in our moral perception of trans people, should make us skeptical of this conclusion, in favor of a more nuanced and pluralistic approach to the ethics of gendering. A prominent view holds that perception and memory are distinguished at least partly by their temporal orientation: Perception functions to represent the present, while memory functions to represent the past. Call this view perceptual presentism. This chapter critically examines perceptual presentism in light of contemporary perception science. I adduce evidence for three forms of perceptual sensitivity to the past: (i) shaping perception by past stimulus exposure, (ii) recruitment of mnemonic representations in perceptual processing, and (iii) perceptual representation of present objects (...) as possessing past properties. I argue that forms (i) and (ii) are consistent with perceptual presentism, while form (iii) poses a genuine threat to the view. While the empirical case for form (iii) remains inconclusive, I suggest that the most serious challenges to perceptual presentism derive from representations that integrate mnemonic and present-tensed elements in the performance of canonical perceptual functions, such as perceiving object continuity over time. Traditional approaches to conflict are oriented towards establishing (or re-establishing) consensus, either in the form of a resolution of the conflict or in the form of an ‘agree-to-disagree’ standstill between the stakeholders. In this paper, we criticize these traditional approaches, each for specific reasons, and we propose and develop the agonistic approach to conflict. Based on Chantal Mouffe’s agonistic democratic theory, the agonistic approach to conflict is more welcoming of dissensus, replacing discussion stoppers with discussion starters and replacing standstills with (...) contestation. We illustrate such replacements and develop this approach, we analyse technological conflicts in a concrete R&D setting: the global hydrogen economy. From this context, we focus on the conflict between the proponents of blue hydrogen (drawn from fossil fuels) and those of green hydrogen (created through electrolysis). We conclude by highlighting the advantage of the agonistic approach but also drawing attention to its own specific risk, namely, antagonism. (shrink)

Causal closure arguments against interactionist dualism are currently popular amongst physicalists. Such an argument appeals to some principles of the causal closure of the physical, together with certain other premises, to conclude that at least some mental events are identical with physical events. However, it is crucial to the success of any such argument that the physical causal closure principle to which it appeals is neither too strong nor too weak by certain standards. In this paper, it is argued that (...) various forms of naturalistic dualism, of an emergentist character, are consistent with the strongest physical causal closure principles that can plausibly be advocated. Shedding light on the political power and oppressive potential of language, theories of illocutionary silencing and discursive injustice show how gender, class and race can shape the pragmatics of speech, limiting in some circumstances the speaker’s ability to do things with her words. This article takes a close look at discursive injustice in trials for gender-based violence in connection with the phenomenon of misogyny. It argues that in the courtroom the testimony of the complainant is sometimes silenced by a sexist (...) ideology used in service of misogynistic ends. In particular, it argues that sexist social meanings can sometimes be enacted by the judge and accommodated by prosecutors, figuring as a component of the score in the language game of the trial and thus 1) determining what counts as sexual violence and 2) preventing complainants from making the moves they intend to make. The thought that empathy plays an important role in moral motivation is almost a platitude of contemporary folk psychology. Parallel themes were mooted in German moral philosophy and aesthetics in the 1700s, and versions of the empathy construct remained prominent in continental accounts of moral motivation through the nineteenth century and early twentieth centuries. This chapter elucidates the Empathic Motivation Hypothesis (EMH) and sets out some of the conceptual and empirical challenges it faces. It distinguishes empathic concern from other dimensions (...) of empathy (e.g., resonance, attunement, distress, and non-empathic concern) and examines the merits of EMH as a developmental thesis, focusing on evidence from psychopathology and attachment theory. This Article argues that a particular political theory underlies the judicial interpretation of ‘equality before the law’. The Canadian Courts at the date of writing have elaborated two tests for the signification of ‘equality before the law’. The Article traces the two tests to the utilitarian political theory outlined by John Stuart Mill. The one test sets out the ‘greatest happiness of the greatest number’ or ‘social interests’ as the criterion for adjudicating equality. The second test identifies the reasonable relationship (...) of an alleged statutory classification vis-à-vis the statutory purpose. The Article offers an alternative approach based upon democratic theory. Examples of the two tests and the alternative approach are drawn from judicial constitutional interpretations in the USA and Canada. (shrink)

Abstract: Alienation and slavery from Precious or what we don't want to see. It is our purpose to establish, in a parallel reading, these two films (highly rewarded), namely The Fence and Precious, that apparently being so different, are an illustration of the reality of life and the modern democratic world: the social uprooting and slavery. If in the movie of Phillip Noyce and Christone Olsen The Fence, is told a story of three young Aboriginal girls who are forcibly taken (...) to be transformed into domestic slaves, in the movie of Lee Daniels Precious, the young woman is already a servant in her own home and seeks the transformation of her life. Uniting these two stories, we find fundamental elements: illiteracy, ill-treatment, the idea of a migration (real or metaphysical), among others, but whose fundamental notion is the journey. If the film The Fence, the fence itself is used to conduct the three young Aboriginal to a real reunion with the family, in Precious, the metaphorical ‘fence’ is the limit of her world. From this interpretation, we will undertake our reflection about what we consider to be the alienation of the modern world and the silence we produce about them. (shrink)

This essay considers the eighth century Indian Buddhist monk, Śāntideva’s strategy of using the afflictive mental states for progress towards liberation in his Introduction to the Practice of Awakening. I begin by contrasting two images from the first chapter that represent the power of bodhicitta: the fires destroying the universe at the end of time, and the mercury elixir that transmutes base metals into gold. The first of these, I argue, better illustrates the text’s predominant strategy of destroying the afflictive (...) mental states directly by their antidotes. The second, in contrast, represents an alternative strategy in which afflictive mental states like anger, craving and delusion, are manipulated for liberative gain. I offer several examples of Śāntideva’s use of the kleśas in his text, and argue that they can be understood as a continuation of the logic of skillful means, in which destructive actions, and here destructive mental states, are used to lessen suffering. Finally, I suggest that one reason Śāntideva employs the kleśas in this way is because of his realization that many practitioners early on the bodhisattva path will lack the motivation necessary to successfully pursue the difficult training of the bodhisattva. Sustainability assessments bring together different perspectives that pertain to sustainability in order to produce overall assessments and a wealth of approaches and tools have been developed in the past decades. But two major problematics remain. The problem of integration concerns the surplus of possibilities for integration; different tools produce different assessments. The problem of implementation concerns the barrier between assessment and transformation; assessments do not lead to the expected changes in practice. This paper aims to analyze issues of complementarity in (...) sustainability assessment and transformation as a key to better handling the problems of integration and implementation. Based on a generalization of Niels Bohr’s complementarity from quantum mechanics, we have identified two forms of complementarity in sustainability assessment, observer stance complementarity and value complementarity. Unlike many other problems of sustainability assessment, complementarity is of a fundamental character connected to the very conditions for observation. Therefore complementarity cannot be overcome methodologically; only handled better or worse. Science is essential to the societal goal of sustainability, but these issues of complementarity impede the constructive role of science in the transition to more sustainable structures and practices in food systems. The agencies of sustainability assessment and transformation need to be acutely aware of the importance of different perspectives and values and the complementarities that may be connected to these differences. An improved understanding of complementarity can help to better recognize and handle issues of complementarity. These deliberations have relevance not only for sustainability assessment, but more generally for transdisciplinary research on wicked problems. (shrink)

Abstract: William Conklin takes on Hegel’s interpretation of Sophocles’ Antigone in this essay. Hegel asked what makes human laws human and what makes divine laws divine? After outlining Hegel’s interpretation of Antigone in the light of this issue, Conklin argues that we must address what makes human law law? and what makes divine law law? Taking his cue from Michel Foucault’s “What is an Author?”, the key to understanding Sophocles’ Antigone and Hegel’s interpretation to it, according to Conklin, is the (...) relationship between legal authority and an author. Antigone’s divine law opposes Creon’s human law in terms of whether the sense of legal authority presupposes an author. Antigone’s tribe recognises divine laws as nested in an impersonal Fate or Moira common to the Helenes as experienced through rituals and other personal experiences. Such an unwritten law lacks an author “whose origin we know not when”. The city-state’s citizens recognize authority in terms of whether a law has a source in a juridical representer of an invisible author. The invisible author is the city-state external to the representers. The representers interpret human laws in a manner which tries to access the invisible author. What becomes important is that philosophical consciousness observes how the characteristics of the two senses of legal authority clash. (shrink)

There are many different meanings of sustainability and precaution and no evident connection between the new normative concepts and the traditional moral theories. We seek an ethical basis for sustainability and precaution—a common framework that can serve as a means of resolving the conceptual ambiguities of the new normative concepts and the conflicts between new and traditional moral concepts and theories. We employ a systemic approach to analyze the past and possible future extension of ethics and establish an inclusive framework (...) of ethical extension. Logical realism is a view about the metaphysical status of logic. Common to most if not all the views captured by the label ‘logical realism’ is that logical facts are mind- and language-independent. But that does not tell us anything about the nature of logical facts or about our epistemic access to them. The goal of this paper is to outline and systematize the different ways that logical realism could be entertained and to examine some of the challenges that these (...) views face. It will be suggested that logical realism is best understood as a metaphysical view about the logical structure of the world, but this raises an important question: does logical realism collapse into standard metaphysical realism? Some ‘naturalist’ accounts of disease employ a biostatistical account of dysfunction, whilst others use a ‘selected effect’ account. Several recent authors have argued that the biostatistical account offers the best hope for a naturalist account of disease. We show that the selected effect account survives the criticisms levelled by these authors relatively unscathed, and has significant advantages over the BST. Moreover, unlike the BST, it has a strong theoretical rationale and can provide substantive reasons to decide difficult cases. There is a long tradition in philosophy and literary theory defending the view that engagement with literature promotes readers’ empathy. Until the last century, few of the empirical claims adduced in that tradition were investigated experimentally. Recent work in psychology and neuropsychology has now shed new light on the interplay of empathy and literature. This article surveys the experimental findings, addressing three central questions: What is it to read empathically? Does reading make us more empathic? What characteristics of literature, if (...) any, affect readers’ empathy? While experimental studies have delivered no conclusive answers to these questions, it has exposed their psychological complexity and constructed a more nuanced picture of the diverse ways in which literature interacts with our empathic capacities. The Notion of ‘civilisation’ in European and post-Enlightenment writings has recently been reassessed. Critics have especially reread the works of Immanuel Kant by highlighting his racial categories. However, this Paper argues that something is missing in this contemporary literature: namely, the role of the European legal culture in the development of a racial and ethnic hierarchy of societies. The clue to this missing element rests in how ‘civilisation’ has been understood. This Paper examines how one of the leading jurists of (...) the 19th and 20th centuries, George W. Hegel (1770-1831), took for granted a sense of a legal culture that excluded indigenous inhabitants of the Americas as legal persons worthy of legal protection. -/- Such an exclusionary legal culture represented a crucial feature of ‘civilisation’ according to Hegel. This Paper identifies a series of factors which Hegel highlighted as instrumental in constituting a civilised society: Bildung, an ethos, a written legal culture, a self-creative author (the state), territorial knowledge, and a hierarchy of societies. Hegel emphasized the need of jurists to analytically “leap” from a traditional society to a legal culture before the jurist could identify a law. The traditional societies of the Americas, according to Hegel, were considered lawless because they lacked a European sense of a legal culture. Why Hegel characterised traditional communities as lacking a legal culture is then explained. The Paper ends by suggesting that the features of a legal culture that Hegel highlights remain with us today. (shrink)

We argue that the trend toward providing users with feasible and actionable explanations of AI decisions—known as recourse explanations—comes with ethical downsides. Specifically, we argue that recourse explanations face several conceptual pitfalls and can lead to problematic explanation hacking, which undermines their ethical status. As an alternative, we advocate that explanations of AI decisions should aim at understanding.

Christopher Hill's Perceptual experience is a must‐read for philosophers of mind and cognitive science. Here I consider Hill's representationalist account of spatial perception. I distinguish two theses defended in the book. The first is that perceptual experience does not represent the enduring, intrinsic properties of objects, such as intrinsic shape or size. The second is that perceptual experience does represent certain viewpoint‐dependent properties of objects—namely, Thouless properties. I argue that Hill's arguments do not establish the first thesis, and then I (...) raise questions about the Thouless‐property view and its role in Hill's defense of representationalism. (shrink)

There are two aims of this paper: (1) to explore the affective dimensions of moral shock and how it relates to normative marginalization of those furthest from dominant society, but also, more specifically; (2) to articulate the trans experience of constantly being under moral attack because the dominant “world” normatively defines you out of existence. Toward these ends, I build on Katie Stockdale’s recent work on moral shock, arguing that moral shock needs to be contextualized to “worlds” of sense to (...) understand how marginalized people affectively experience shocking events. My focus is the trans experience of moral shock due to the way trans people are positioned outside of dominant society, creating the conditions to experience cyclical, chronic shock. These affective conditions point to a collective responsibility to ease the affective stress that the most marginalized experience. (shrink)

Is color experience cognitively penetrable? Some philosophers have recently argued that it is. In this paper, we take issue with the claim that color experience is cognitively penetrable. We argue that the notion of cognitive penetration that has recently dominated the literature is flawed since it fails to distinguish between the modulation of perceptual content by non-perceptual principles and genuine cognitive penetration. We use this distinction to show that studies suggesting that color experience can be modulated by factors of the (...) cognitive system do not establish that color experience is cognitively penetrable. Additionally, we argue that even if color experience turns out to be modulated by color-related beliefs and knowledge beyond non-perceptual principles, it does not follow that color experience is cognitively penetrable since the experiences of determinate hues involve post-perceptual processes. We conclude with a brief discussion of the implications that these ideas may have on debates in philosophy. (shrink)

I offer a qualified defence of Kant’s natural teleological argument, that is, his inference from the (un)naturalness of an act to its (im)morality. Though I reject many of Kant’s conclusions, I think the form of argument he uses to support these conclusions is not as wrong-headed as it might at first appear. I consider and answer two objections: first, that the argument is inconsistent with Kant’s moral rationalism; and second, that the argument is inconsistent with post-Kantian developments in science. I (...) argue that both objections rest on a common mistake, namely, the assumption that the account of (human) nature on which Kant’s argument relies is theoretical. On the contrary, the relevant account is practical: informed by science, but not determined by it. Once we appreciate the practical character of Kant’s naturalism, we can see not only that Kant can be a naturalist and a rationalist, but contemporary Kantians can be as well. (shrink)

There is a widespread belief that for their own safety and for the protection of wildlife, cats should be permanently kept indoors. Against this view, I argue that cat guardians have a duty to provide their feline companions with outdoor access. The argument is based on a sophisticated hedonistic account of animal well-being that acknowledges that the performance of species-normal ethological behavior is especially pleasurable. Territorial behavior, which requires outdoor access, is a feline-normal ethological behavior, so when a cat is (...) permanently confined to the indoors, her ability to flourish is impaired. Since cat guardians have a duty not to impair the well-being of their cats, the impairment of cat flourishing via confinement signifies a moral failing. Although some cats assume significant risks and sometimes kill wild animals when roaming outdoors, these important considerations do not imply that all cats should be deprived of the opportunity to access the outdoors. Indeed, they do not, by themselves, imply that any cat should be permanently kept indoors. (shrink)

Stereotypes shape inferences in philosophical thought, political discourse, and everyday life. These inferences are routinely made when thinkers engage in language comprehension or production: We make them whenever we hear, read, or formulate stories, reports, philosophical case-descriptions, or premises of arguments – on virtually any topic. These inferences are largely automatic: largely unconscious, non-intentional, and effortless. Accordingly, they shape our thought in ways we can properly understand only by complementing traditional forms of philosophical analysis with experimental methods from psycholinguistics. This (...) paper seeks, first, to bring out the wider philosophical relevance of stereotypical inference, well beyond familiar topics like gender and race. Second, we wish to provide philosophers with a toolkit to experimentally study these ubiquitous inferences and what intuitions they may generate. This paper explains what stereotypes are, and why they matter to current and traditional concerns in philosophy – experimental, analytic, and applied. It then assembles a psycholinguistic toolkit and demonstrates through two studies how potentially questionnaire-based measures can be combined with process measures to garner evidence for specific stereotypical inferences and study when they ‘go through’ and influence our thinking. This paper is inspired by and develops on E. J. Lowe’s work, who writes in his book The Possibility of Metaphysics that ‘metaphysical possibility is an inescapable determinant of actuality’ (1998: 9). Metaphysics deals with possibilities – metaphysical possibilities – but is not able to determine what is actual without the help of empirical research. Accordingly, a delimitation of the space of possibilities is required. The resulting – controversial – picture is that we generally need to know whether something is (...) possible before we can know whether it is actual. In order to appreciate this picture, we need to understand Lowe’s slogan: ‘essence precedes existence’ (Lowe 2008: 40). This slogan has both an ontological and an epistemic reading. The ontological reading is related to the now familiar idea that essence grounds modality, as popularised by Kit Fine. The epistemic reading suggests that we can know the essence of some entity before we know whether or not that entity exists. However, this idea is often met with puzzlement and Lowe himself sadly passed away before he had a chance to clarify this framework. I will present the framework as I understand it, develop it on my own terms, and put forward a qualified defence of it. I will also illustrate how the framework can be put to use with a case study concerning the discovery of transuranic elements. (shrink)

Four studies explore the role of perceptual fluency in attenuating bullshit receptivity, or the tendency for individuals to rate otherwise meaningless statements as “profound”. Across four studies, we presented participants with a sample of pseudoprofound bullshit statements in either a fluent or disfluent font and found that overall, disfluency attenuated bullshit receptivity while also finding little evidence that this effect was moderated by cognitive thinking style. In all studies, we measured participants’ cognitive reflection, need for cognition, faith in intuition, and (...) superstitious beliefs. Superstition strongly predicted bullshit receptivity regardless of fluency. Inconclusive results were found for the remaining scales. Potential links for the role of perceptual disfluency in promoting analytic thinking are discussed. (shrink)

This article develops a view of shape representation both in visual experience and in subpersonal visual processing. The view is that, in both cases, shape is represented in a ‘layered’ manner: an object is represented as having multiple shape properties, and these properties have varying degrees of abstraction. I argue that this view is supported both by the facts about visual phenomenology and by a large collection of evidence in perceptual psychology. Such evidence is provided by studies of shape discriminability, (...) apparent motion, multiple-object tracking, and structure-from-motion. Recent neuroscientific work has also corroborated this psychophysical evidence. The Pyrrhonist’s argumentative practice is characterized by at least four features. First, he makes a therapeutic use of arguments: he employs arguments that differ in their persuasiveness in order to cure his dogmatic patients of the distinct degrees of conceit and rashness that afflict them. Secondly, his arguments are for the most part dialectical: when offering an argument to oppose it to another argument advanced by a given dogmatist, he accepts in propria persona neither the truth of its premises and (...) conclusion nor the validity of its logical form. Thirdly, he avails himself of arguments in his own open-minded inquiry into the truth about a wide range of topics. Fourthly, Pyrrhonian argumentation is oppositional inasmuch as it typically works by producing oppositions among arguments that appear to the Pyrrhonist to be equipollent. In this article, I focus on the first three features with the aim of both shedding some light on them and determining whether they are in tension or coherently relate to each other. (shrink)
