Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. Zwischen 1987 und 1994 sandte ich 20 Briefe an Karl Popper. Die meisten betrafen Fragen bezüglich seiner Antiinduktionsbeweise und seiner Wahrscheinlichkeitstheorie, einige die organisatorische und inhaltliche Vorbereitung eines Fachgesprächs mit ihm in Kenly am 22. März 1989 (worauf hier nicht eingegangen werden soll), einige schließlich ganz oder in Teilen nicht-fachliche Angelegenheiten (die im vorliegenden Bericht ebenfalls unberücksichtigt bleiben). Von Karl Popper erhielt ich in diesem Zeitraum 10 Briefe. Der bedeutendste ist sein siebter, bestehend aus drei Teilen, geschrieben am (...) 21., 22. und 23. Oktober 1992, in dem er eine Vorform jener Definition der probabilistischen Unabhängigkeit entwickelte, die er 1994 im neuen Anhang *XX der 10. Auflage seiner Logik der Forschung (LdF) der wissenschaftstheoretischen Forschergemeinde vorstellte. Der berührendste ist sein letzter, geschrieben am 26. Juli 1994, in dem er trotz Erschöpfung mit Humor schildert, wie mühselig der Druck des Anhangs *XX verlaufen ist. Mein Bericht ist zugleich chronologisch und systematisch gegliedert: die ersten, vergleichsweise wenigen Briefe, großteils 1987 geschrieben, handeln von der Induktion; der große Rest, zeitlicher Schwerpunkt 1992, beschäftigt sich mit der Wahrscheinlichkeitstheorie. Das Kapitel 1 über Induktion ist in vier Abschnitte unterteilt: 1.1 Das Popper/Miller-Argument: eine Nachkonstruktion, 1.2 Karl Poppers Brief vom 25.8.1987: Deduktive Stützung, 1.3 Karl Poppers Brief vom 29.9.1987: Nochmals zur deduktiven Stützung, 1.4 Echt induktive Stützung und Schwächung: zwei eigene Beweise. In accordance with Leo Strauss’s ingenious suggestion, the Athenian Stranger of Plato’s Laws is best understood as an alternative ‘Socrates’, fleeing from the hemlock to Crete. Situated between Crito and Phaedo, Laws effectively tests the reader’s loyalty to the real Socrates who obeys Athenian law and dies cheerfully in Athens. Having separated Plato from the Stranger, a nuanced defence of Karl Popper’s suspicions about Laws confronts the apologetic readings of both Strauss and Christopher Bobonich. As hinted by his preference (...) for wine, the antidote for hemlock, the Athenian Stranger repeatedly proves himself the opposite of Socrates, particularly with respect to piety. Once the Stranger is recognized as ‘an unreliable narrator’, this apparently ponderous product of Plato’s senility becomes the taut thriller of an innovative teacher at the peak of his powers. Early in his career, Karl Marx complained that “Philosophers have hitherto only interpreted the world in various ways; the point is to change it.” Philosophers Robert Frodeman and Adam Briggle have recently issued this same complaint against their contemporaries, arguing that philosophy has become an isolated, “purified” discipline, detached from its historical commitments to virtue and to public engagement. In this paper I argue that they are wrong about contemporary philosophy and about its history. Philosophy hitherto has always been (...) characterized both by a concern with practical engagement and by serious misgivings about such engagement. I show that reluctance to engage with practical affairs was a feature of philosophy long before the advent of the modern university and that a wide range of contemporary philosophers are concerned with virtue and public engagement. Finally, I argue that Frodeman and Briggle’s own account of contemporary philosophy makes it unsuitable both as the subject of their title (“When Philosophy Lost Its Way”) and as the object of their call to action. Karl Popper discovered in 1938 that the unconditional probability of a conditional of the form ‘If A, then B’ normally exceeds the conditional probability of B given A, provided that ‘If A, then B’ is taken to mean the same as ‘Not (A and not B)’. So it was clear (but presumably only to him at that time) that the conditional probability of B given A cannot be reduced to the unconditional probability of the material conditional ‘If A, then (...) B’. I describe how this insight was developed in Popper’s writings and I add to this historical study a logical one, in which I compare laws of excess in Kolmogorov probability theory with laws of excess in Popper probability theory. In this paper we consider the possibility of a Quantum Molinism : such a view applies an analogue of the Molinistic account of free will‘s compatibility with God’s foreknowledge to God’s knowledge of (supposedly) indeterministic events at a quantum level. W e ask how (and why) a providential God could care for and know about a world with this kind of indeterminacy. We consider various formulations of such a Quantum Molinism, and after rejecting a number of options arrive at one (...) seemingly coherent formulation. (shrink)

In paragraph 21 of his "Logic of Scientific Discovery", Karl Popper characterizes with the help of two seemingly synonymous definitions the falsifiability of a theory as a logical relation between the theory itself and its basic statements. It is shown that his definitions do not agree with each other, and this result is applied to the problem of the falsifiability of contradictions, to the difference between falsifiable and empirical statements and to the demarcation criterion.

I set up two axiomatic theories of inductive support within the framework of Kolmogorovian probability theory. I call these theories ‘Popperian theories of inductive support’ because I think that their specific axioms express the core meaning of the word ‘inductive support’ as used by Popper (and, presumably, by many others, including some inductivists). As is to be expected from Popperian theories of inductive support, the main theorem of each of them is an anti-induction theorem, the stronger one of them saying, (...) in fact, that the relation of inductive support is identical with the empty relation. It seems to me that an axiomatic treatment of the idea(s) of inductive support within orthodox probability theory could be worthwhile for at least three reasons. Firstly, an axiomatic treatment demands from the builder of a theory of inductive support to state clearly in the form of specific axioms what he means by ‘inductive support’. Perhaps the discussion of the new anti-induction proofs of Karl Popper and David Miller would have been more fruitful if they had given an explicit definition of what inductive support is or should be. Secondly, an axiomatic treatment of the idea(s) of inductive support within Kolmogorovian probability theory might be accommodating to those philosophers who do not completely trust Popperian probability theory for having theorems which orthodox Kolmogorovian probability theory lacks; a transparent derivation of anti-induction theorems within a Kolmogorovian frame might bring additional persuasive power to the original anti-induction proofs of Popper and Miller, developed within the framework of Popperian probability theory. Thirdly, one of the main advantages of the axiomatic method is that it facilitates criticism of its products: the axiomatic theories. On the one hand, it is much easier than usual to check whether those statements which have been distinguished as theorems really are theorems of the theory under examination. On the other hand, after we have convinced ourselves that these statements are indeed theorems, we can take a critical look at the axioms—especially if we have a negative attitude towards one of the theorems. Since anti-induction theorems are not popular at all, the adequacy of some of the axioms they are derived from will certainly be doubted. If doubt should lead to a search for alternative axioms, sheer negative attitudes might develop into constructive criticism and even lead to new discoveries. -/- I proceed as follows. In section 1, I start with a small but sufficiently strong axiomatic theory of deductive dependence, closely following Popper and Miller (1987). In section 2, I extend that starting theory to an elementary Kolmogorovian theory of unconditional probability, which I extend, in section 3, to an elementary Kolmogorovian theory of conditional probability, which in its turn gets extended, in section 4, to a standard theory of probabilistic dependence, which also gets extended, in section 5, to a standard theory of probabilistic support, the main theorem of which will be a theorem about the incompatibility of probabilistic support and deductive independence. In section 6, I extend the theory of probabilistic support to a weak Popperian theory of inductive support, which I extend, in section 7, to a strong Popperian theory of inductive support. In section 8, I reconsider Popper's anti-inductivist theses in the light of the anti-induction theorems. I conclude the paper with a short discussion of possible objections to our anti-induction theorems, paying special attention to the topic of deductive relevance, which has so far been neglected in the discussion of the anti-induction proofs of Popper and Miller. Aim of work: the research of the determination and destination of human for nature and cognition. The basis of the research is Karl Raimund Popper's article «Evolutionary epistemology». A critical analysis of Popper's proposed theses and the scheme of theory evolution is conducted. The signifi-cance of the occurrence of the system of tenses of the language as an implication of the descriptive function of the language is noted. The issue with which the cycle of evolution of life and cognition (...) begins is revealed. The language is included in the scheme proposed by Popper. As a result of the reasoning the pivotal feature of the human essence is identified: awareness the problem of death. This awareness makes it possible to relate oneself to the problem, which is the reason for the presence of the most aggregate evaluation categories: «good» and «evil». This is how a person may determine the purpose of evolution: overcoming the problem. In contrast to nature, the evolution of which is aimed at avoiding the problem. Having reached the goal, a person will go beyond himself as a phe-nomenon defined by the awareness of the problem. In this case, self-transcendence is a person's tran-sition to a new quality. The role of philosophy in the procedures of self-transcendence occurring in contemporary society is discussed. (shrink)

There are two motivations commonly ascribed to historical actors for taking up statistics: to reduce complicated data to a mean value (e.g., Quetelet), and to take account of diversity (e.g., Galton). Different motivations will, it is assumed, lead to different methodological decisions in the practice of the statistical sciences. Karl Pearson and W. F. R. Weldon are generally seen as following directly in Galton’s footsteps. I argue for two related theses in light of this standard interpretation, based on a (...) reading of several sources in which Weldon, independently of Pearson, reflects on his own motivations. First, while Pearson does approach statistics from this "Galtonian" perspective, he is, consistent with his positivist philosophy of science, utilizing statistics to simplify the highly variable data of biology. Weldon, on the other hand, is brought to statistics by a rich empiricism and a desire to preserve the diversity of biological data. Secondly, we have here a counterexample to the claim that divergence in motivation will lead to a corresponding separation in methodology. Pearson and Weldon, despite embracing biometry for different reasons, settled on precisely the same set of statistical tools for the investigation of evolution. (shrink)

Prasa mniejszości niemieckiej była w okresie II Rzeczypospolitej dość zróżnicowana, o czym świadczą liczne publikacje, choćby autorstwa Tadeusza Kowalska czy Wiesławy Kaszubiny. Sytuację taką można by wytłumaczyć faktem, iż ludność niemiecka, zróżnicowana pod względem społecznym, wyróżniała się znacznie wyższym niż przeciętny dla całego kraju poziomem świadomości czytelniczej. Znamienną cechą prasy niemieckiej była duża liczba gazet o charakterze politycznym, wśród których znajdowały się pisma o kierunku nacjonalistycznym, socjalistycznym oraz ugodowym. Na uwagę zasługują tu takie tytuły, jak: Lodzer Freie Presse, Lodzer Volkszeitung, (...) Neue Lodzer Zeitung, Der Deutsche Weg, Deutscher Volksbote czy Der Deutsche Wegweiser. Obok prasy politycznej ważne miejsce zajmowały wydawnictwa o charakterze wyznaniowym, które w wielu wypadkach miały za zadanie uzupełniać określone treści polityczne. W dalszej kolejności, również dużą popularnością wśród mniejszości niemieckiej w Łodzi cieszyła się prasa związków zawodowych, gospodarcza oraz kulturalno-oświatowa. Prasę dla kobiet, dzieci i młodzieży reprezentowały natomiast takie tytuły, jak: Jugendruf, Kinderfreund, Die Jugendwarte, Praktischer Vereinsleiter, Zeitschrift Jur Christliche Jugendführung. Zjawiskiem towarzyszącym rozwojowi prasy okresu międzywojennego - zarówno polskiej, jak i mniejszościowej - była trudna sytuacja finansowa wielu pism, które w wielu wypadkach przybrały charakter efemerydalny. Na brak środków nie narzekały natomiast gazety, takie jak narodowosocjalistyczna Freie Presse czy Der Deutsche Weg, które mogły liczyć na pomoc z Rzeszy. Były one redagowane na dość dobrym poziome, prowadziły stałe rubryki, jak wiadomości polityczne z kraju i ze świata, informacje lokalne czy sport, poza tym drukowały powieści w odcinkach, felietony oraz dodatki, mające rozszerzyć ofertę i zapewnić rozrywkę swojemu czytelnikowi. Również prasa ugodowa, reprezentowana przez dziennik Neue Lodzer Zeitung, oraz socjalistyczna, Die Volkszeitung, nie ustępowała swym poziomem innym gazetom łódzkim. (shrink)

This chapter situates Karl Marx’s dissertation The Difference between the Democritean and Epicurean Philosophy of Nature (1841) within his intellectual biography. It explores the role of a German ideal known as Bildung, translated as “education”, “cultivation” or “culture”, within Marx’s classical education in the Gymnasium and the dissertation itself. Both Wilhelm von Humboldt, who reformed the Gymnasium curriculum prior to Marx’s attendance, and philosopher G.W.F. Hegel have classically inspired notions of Bildung. Each presents the white European man as the (...) model for this “education” or “cultivation”. This chapter argues that the dissertation assimilates Epicurus and his atom into this Eurocentric paradigm, with Marx taking for granted his predecessors’ racist teleology of history and applying their conception of the individual to the atom. Then, it addresses the dissertation’s influence in the development of historical materialism, a facet of Marxism already critiqued for its Eurocentrism. This chapter concludes by showing how non-White and non-Western Marxists have updated Marxist thought through constant critique of its Eurocentrism instead of abandoning its revolutionary vision. It suggests that Marxism is relevant to scholars of antiquity not because of the dissertation but the tradition’s self-interrogation of its foundational ideas and persistent focus on improving the conditions of the marginalised. Już w latach sześćdziesiątych zjawisko walencji znacznie zyskało na znaczeniu. Przyczyną tego mógł być fakt, iż gramatyka oparta na teorii walencji w coraz większym stopniu znajdowała swoje miejsce w nauczaniu języków obcych. W procesie uczenia się języka obcego istnieje bowiem zależność pomiędzy przyswajaniem znaczeń słów a zapamiętywaniem ich struktur syntaktycznych, co niewątpliwie bazuje na zjawisku walencji. Punktem wyjścia tej tezy jest zasada, według której wyrazy o podobnym znaczeniu tworzą konstrukcje o podobnej składni, co z kolei wypływa z faktu, iż wyrazy (...) bliskoznaczne wykazują podobne cechy walencyjne. Problem pojawia się podczas przyswajania języka obcego, albowiem język ojczysty w większym lub mniejszym stopniu wpływa na proces uczenia się. Chodzi tu oczywiście o zjawiska: transferu (pozytywnego oddziaływania języka ojczystego na język obcy) oraz interferencji (negatywnego wpływu), z czego zjawisko interferencji zaistniałe poprzez przenoszenie konstrukcji języka ojczystego na konstrukcje w języku obcym prowadzi do tego, że uczący się popełniają błędy. Biorąc pod uwagę sposób przedstawiania składni i konstrukcji językowych w oparciu o teorię walencji, nie da się zaprzeczyć, iż wzrasta zapotrzebowanie na informacje o cechach walencyjnych głównych części mowy (czasowników, rzeczowników oraz przymiotników). Językoznawcy starają się wyjść temu naprzeciw i redagują słowniki walencyjne, w których oprócz takich właśnie informacji zawierane są również modele poprawnych konstrukcji zdaniowych z danym słowem. W Niemczech od połowy XX w. istnieją dwa instytuty, gdzie prowadzone są badania nad zjawiskiem walencji poszczególnych części mowy: das Herder-Institut der Universität Leipzig oraz das Institut für deutsche Sprache Mannheim. W prezentowanym artykule przedstawione zostały słowniki zredagowane przez językoznawców działających w tych instytutach, jak również inne koncepcje słowników walencyjnych. Na uwagę zasługują tu przede wszystkim prace kontrastywne, jak np. opisany w artykule Słownik walencyjny niemieckich i polskich czasowników (N. Morciniec, L. Cirko i R. Ziobro). Analizie poddane zostały każdorazowo: budowa słownika, informacje zawarte przy poszczególnych hasłach, adresat, założenia oraz praktyczność danej pozycji. (shrink)

Das Thema des Artikels sind sprachliche Fehler, die bei der schriftlichen Übersetzung aus dem Deutschen ins Polnische und aus dem Polnischen ins Deutsche Vorkommen. Das Ziel des Artikels ist, ihre Vielschichtigkeit und Entstehungsmechanismen zu zeigen, die vor allem mit der sprachlichen Interferenz als einer der Hauptursachen für Übersetzungsfehler zusammenhän gen. Der Artikel stützt sich auf die Ergebnisse der Untersuchungen, die in den Jahren 2004-2006 in der Abteilung für Angewandte Sprachwissenschaft am Lehrstuhl für Deutsche und Angewandte Sprachwissenschaft der Universität Łódź durchgeführt (...) wurden. Die Basis für das empirische Material bildeten hierbei durch Germanislikstudenten angefertigte schriftliche Übersetzungen. Am Anfang des Artikels werden verschiedene Definitionen und Klassifizierungsmöglichkeiten des sprachlichen Fehlers präsentiert. Desweiteren konzentriert sich der Autor auf das Phänomen der sprachlichen Interferenz und führt ihre Definitionen von W. Bondzio und T. Lewandowski an. Im weiteren Teil des Artikels wird die Frage der Interferenzmechanismen erörtert, zu denen die von J. Czochralski beschriebene Automatisierung der sprachlichen Strukturen, „zwischensprachliche Zuordnung“, „Übertragung des muttersprachlichen Modells“, fehlerhafte Erweiterung des Geltungsbereiches einer Aussage oder die Vermeidung besiimmter Elemente im System der Fremdsprache gehören. Im zweiten Teil des Artikels werden Ergebnisse der Forschungen präsentiert, deren Korpus einige Hunderte von deutsch-polnischen und polnisch-deutschen Übersetzungen waren, die von Studenten gemacht wurden. Die Fehler wurden zunächst nach der Richtung der Interferenz klassifiziert, dann nach den Sprachebenen. Besondere Aufmerksamkeit bei der Fehlerbeschreibung wurde аиГ die möglichen Störungen der sprachlichen Kommunikation gelenkt. Die durchgeführten Untersuchungen untermauern und erweitern die Thesen aus der Fachliteratur: Die Fehler kommen auf verschiedenen Sprachebenen vor und stören in vielen Fällen die sprachliche Kommunikation, deren Herstellung der Hauptzweck einer jeden Übersetzung ist. Der Autor des Artikels postuliert, bei der Übersetzungsdidaktik mehr Aufmerksamkeit der sprachlichen Interferenz zu widmen, was seiner Meinung nach zu besseren Resultaten verhelfen würde. (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

Mit seinem Einfluß auf die Entwicklung der Physiologie, Physik und Geometrie ist Hermann von Helmholtz wie kaum ein anderer Wissenschaftler der zweiten Hälfte des 19. Jahrhunderts repräsentativ für die Naturforschung in Deutschland. Nicht weniger repräsentativ nimmt sich die Entwicklung seiner Wissenschaftsauffassung aus. Während er bis in die späten 60er Jahre einen emphatischen Wahrheitsanspruch der Wissenschaft vertrat, begann er in der nachfolgenden Zeit, die Geltungsbedingungen der wissenschaftlichen Erkenntnis einer Relativierung zu unterwerfen, die zusammenfassend als Hypothetisierung bezeichnet werden kann. Helmholtz entwickelte damit (...) schon im vergangenen Jahrhundert Ansätze einer Wissenschaftsauffassung , die in erstaunlichem Umfang in die Richtung der Moderne weisen. Wie nah er späteren Wissenschaftsauffassungen bereits gekommen ist, kann ein Vergleich mit Karl R. Poppers Forschungslogik illustrieren. In seiner Forschungslogik ist die Hypothetisierung der wissenschaftlichen Erkenntnis entschieden weiter vorangeschritten als in Heimholtz' Wissenschaftstheorie. Was sich bei Helmholtz erst vage abzuzeichnen beginnt, ist bei ihm bereits explizit formuliertes Programm geworden. Obwohl HeImholtz und Popper in keiner direkten wissenschaftstheoretischen Entwicklungslinie stehen und Popper sich in seinen Schriften auch nur sehr selten und beiläufig auf Helmholtz bezieht, finden sich dennoch überraschende und bisher nicht beachtete Berührungspunkte, die insbesondere dann hervortreten, wenn man Heimholtz' Wissenschaftsauffassung vor dem Hintergrund von Poppers Forschungslogik betrachtet. Pod pojęciem technik interpretacji scenicznej rozumie się działania, które łącząc recepcję tekstu literackiego z pedagogiką dramy, przyczyniają się do intensywnej analizy i interpretacji tekstów. Twórcą i głównym przedstawicielem tego nurtu dydaktyki literatury jest w Niemczech profesor nauk o estetyce i komunikacji Ingo Scheller. Swoją koncepcję pracy z tekstami literackimi Scheller zbudował na gruncie estetyki recepcji - teorii, która nadawała szczególną rolę czytelnikowi w konstytuowaniu znaczenia dzieła literackiego. Ogromny wpływ na powstanie interpretacji scenicznej wywarły także rozwijające się w latach osiemdziesiątych koncepcje (...) dydaktyczne, bazujące na kreatywnym pisaniu i kładące nacisk na powiązanie interpretacji tekstu z produktywnym działaniem czytelnika. Opracowana przez Schellera metoda interpretacji scenicznej nabrała ostatecznego kształtu pod wpływem różnorodnych teorii i koncepcji teatru, reprezentowanych m. in. przez Stanisławskiego, Grotowskiego, Boala, Strasberga i Brechta. W wyniku wieloletnich doświadczeń powstała metoda, która podkreśla znaczenie emocji i imaginacji w procesach uczenia się, pozwala rozwijać umiejętność empatii oraz respektuje indywidualne doświadczenia czytelnika. Niniejszy artykuł poświęcony jest możliwościom zastosowania technik interpretacji scenicznej w nauczaniu języków obcych. Sposoby wykorzystania poszczególnych technik na lekcjach języka niemieckiego zilustrowano na przykładzie dziewiątego rozdziału z podręcznika Tangram 2B. (shrink)

Wydane w latach 1782-1786 Niemieckie baśnie ludowe Johanna Karla Augusta Musausa, znanego oświeceniowej publiczności autora poczytnych Podróży fizjognomicznych, przyjęto początkowo entuzjastycznie, uznając je za wyjątkowo udaną formę literaryzacji elementów baśniowej tradycji ustnej i pisanej oraz podkreślając walory "dowcipnej" narracji. W wieku XVIII pojęcie "baśni" (Miirchen) miało szerokie znaczenie. Słowniki i leksykony wskazują na to, iż pojęcia: "bajka" (Fabel), "baśń" (Mcirchen), "podanie" (Sage) i "legenda"(Legende) mogły być używane zamiennie. Musaus definiuje we wstępie do swego zbioru zatytułowanym Słowo wstępne do pana Dawida (...) Runkela, będącym humorystyczną autoprezentacją pisarza i jego baśni, pojęcie "baśni" jako "poetę cudowną" (wunderbare Dichtung), przemawiającą w sposób szczególny do wyobraźni czytelnika. Taka definicja baśni pozwoliła zebrać Musausowi w swym zbiorze teksty, które według dzisiejszych kryteriów określono by w większości jako podania. Ukazanie się w roku 1812 pierwszego tomu Baśni dziecięcych i domowych braci Jakuba i Wilhelma Grimmów było wydarzeniem epokowym w historii baśni. Baśnie braci Grimmów na długo stały się normą o uniwersalnym znaczeniu, według której oceniano baśniowość tego typu utworów. Podług romantycznej miary Grimmów oceniano również oświeceniowe baśnie Musausa, a ocena ta najczęściej nie wypadała pozytywnie. Artykuł przedstawia recepcję Niemieckich baśni ludowych Musausa u braci Grimmów, Ludwika Tiecka, Achima von Arnima i u nawiązującego bezpośrednio do romantycznych koncepcji Grimmów Ludwika Bechsteina, uwypuklając na ich przykładzie różnicę w ujęciu fenomenu baśniowości w oświeceniu i romantyzmie. Die Breslauer Sprechbühnen wiesen in der Zeit des Nationalsozialismus Tendenzen auf, die für das gesamte Theaterleben Deutschlands charakteristisch waren. Die politische Instrumentalisierung der dramatischen Kunst, wie des ganzen literarischen Lebens, resultierte aus dem zentralen, von dem Reichsministerium für Volksaufklärung und Propaganda postulierten Programm, das den Theatern außcrästhetische Propaganda- und F.rziehungsaufgabcn zuschrieb. Die Hauptfrage - nach der Spielplangestaltung - traf auch für die wichtigsten Verfasser der damaligen Literatur zu, zu denen sicher der eng mit der schlesischen Provinz verbundene Gerhart Hauptmann gehörte. (...) Seine Stellung nach dem Jahre 1933 war keineswegs eideutig und sie bestätigte nur die komplizierten Verhältnisse zwischen ihm und dem Regime, das aus Propagandagründen sein Schaffen selektiv akzeptierte. In den ersten Jahren nach der Machtergreifung spielten deutsche Theater nur wenige Stückre Hauptmanns, in Breslau sogar keine. Erst 1935 brachte das Lobetheater die Aufführung der Komödie Der Biberpelz. Zwei Jahre später (anläßlich Hauptmanns 75. Geburtstages) spielte man im Breslauer Schauspielhaus, das seit 1936 die einzige Sprechbühne war, das Drama Michael Kramer. In Anwesenheit des Dichters fand hier auch die Uraufführung des Filmes Der Biberpelz statt. 1938 gastierte mit einem eigenen Ensemble der Staatsschauspieler Paul Wegener mit der Inszenierung von Kollege Crampton in Breslau. Erst zwei Jahre später (Jan. 1940) nahm das Theater in Breslau Hauptmanns Werk wieder in das Repertoire auf. Die Aufführung des Schauspiels Elga, dessen Motive aus Grillparzers Drama entnommen wurden, verursachte heftige Proteste mancher Regime-Ideologen (einschließlich Alfred Rosenbergs) wegen der polnischen Thematik des Dramas. Im Jahre 1941 inszenierte das Breslauer Schauspielhaus das Stück Der Bogen des Odysseus (die erste Aufführung war am Osternsonntag), im März 1942 die Tragödie Rose Bernd. Eine besondere Bedeutung kommt dem 80. Jubiläum des Dichters (Nov. 1942) zu. Die zentralen Feierlichkeiten dazu wurden von der Theaterabteilung des Goebbelschen Propagandaministeriums nach Breslau verlegt. Nach zahlreichen Kontroversen und Abstimmungen beschloß man im Schauspielhaus 4 Dramen zu spielen: Michael Kramer, Die Tochter der Kathedrale, Und Pippa tanzt und Der Biberpelz. Hauptmann verlieh man auch den Schliesischen Literaturpreis. Außerdem wurde er zum Ersten Ehrenbürger der Friedrich-Wilhelm-Universität ernannt. Das Deutsche Institut der Breslauer Universität veröffentlichte aus diesem Anlaß ein dem Jubilar gewidmetes Gedenkblatt, das verschiedene Aspekte seines Schaffens zum Thema hatte. Auch das Reichspropagandaamt Schlesien bereitete eine Broschüre vor, die das Interesse der Partei betonen sollte. Die Krönung des Jubiläums war die Gesamtausgabe von Hauptmanns Werken, deren erstes Exemplar dem Dichter überreicht wurde. Unter den zahlreichen Wünschen, die Gerhart Hauptmann zu seinem Geburtstage bekam, befanden sich auch Telegrammme von Hitler, Goebbels und Schlösser. Das letzte in Breslau inszenierte Drama Hauptmanns war Imphigenie in Delphi, dessen Erstaufführung am 5. Dez. 1943 im Schauspielhaus stattfand. (shrink)

Der folgende Artikel gibt einen Überblick, wie gegenwärtige chinesische Philosophen über die intellektuelle Beziehung von Hegel und Marx forschen – und möchte damit einen Eindruck vermitteln, in welcher Weise in China über die denkerischen Ursprünge des geistigen Vaters der eigenen sozialistischen Ideologie nachgedacht wird. Die intellektuelle Beziehung zwischen Karl Marx und G. W. F. Hegel ist seit langem ein Schlüsselthema auf dem Gebiet der marxistischen Philosophie. Dabei geht es um das Verständnis der Quelle von Marx' Denken, sowie der Art (...) und Weise, wie er seine eigene Theorie auf der Grundlage der Hegelschen Philosophie entwickelte. Diese Verhältnisbestimmung berührt wichtige Strömungen sowohl der Hegelschen als auch der marxistischen Studien. Die Wiederbelebung der Hegelforschung und der Bedeutungszuwachs der Marxforschung im zwanzigsten Jahrhundert drängen dazu, die intellektuellen Ursprünge dieser beiden Denker neu zu fassen. Die chinesischsprachige Forschung zur Marx-Hegel-Beziehung basiert auf der Grundidee, das Denken von Marx durch das Denken von Hegel zu verstehen ("von Hegel zu Marx"). Dabei lassen sich drei Ansätze identifizieren: den Weg über die Phänomenologie des Geistes, den Weg über die Wissenschaft der Logik und den Weg über die Grundlinien der Philosophie des Rechts. Streng genommen ließe sich auch der Ansatz der "Ent-Hegelisierung" von Marx, einschließlich der Versuche, Kant als seine entscheidende Inspirationsquelle zu positionieren, als eine Spielform der Marx-Hegel-Beziehung betrachten und als weiterer wichtiger Forschungsweg nennen. Jedem dieser Wege entspricht eine relativ fixe Gruppe an Texten von Marx und Hegel. Entwicklungsgeschichtlich fand Marx‘ erste Auseinandersetzung mit Hegel in der Philosophie des Rechts statt. Rezeptionsgeschichtlich wurde diese Auseinandersetzung in China jedoch als letzte diskutiert, was vor allem auf zwei Gründe zurückzuführen ist: Zum einen wurde die moderne politische Philosophie in China erst in den 1990er Jahren als Disziplin eingeführt. Zum anderen haben chinesische Wissenschaftler erst allmählich die Bedeutung und vielfältigen Dimensionen von Marx' frühem Denken erkannt und näher zu erforschen begonnen. (shrink)

This paper examines the differences and affinities between Karl Popper’s critical rationalism and Theodor Adorno’s critical theory through renewed attention to the original documents of their 1961 debate. While commentaries often describe the Popper-Adorno encounter as a theoretical disappointment, I reveal a confrontation between conceptually opposed programs of social research. Though both theorists are committed to critique as a political and epistemological struggle for human freedom, their conceptions of this struggle are starkly different. In the original seminar papers, we (...) find a conflict between critique as a practice of social rationality (Popper) and a critique of social rationality itself (Adorno). The versions of critical rationalism and critical theory meeting in this debate thus emphasize opposite dimensions of a reflexive practice of immanent critique. In closing, I suggest dissolving this conceptual tension by recovering the educational orientation of critique. (shrink)

G. W. F. Hegel (1770–1831) has commonly been seen as Europe’s leading philosopher since Kant. His influence extended across the globe down to the Second World War – not least through his dissident disciple, Karl Marx. Since then, despite intermittent revivals, his importance has tended to be eclipsed by a rising tide of anti-modernist polemic, extending from Heidegger to postmodernism. Central to Hegel’s political thought was his view of the French Revolution. But notwithstanding its pivotal role in the development (...) of his ideas, his reaction to that event has been systematically misconstrued. In presenting a more faithful account of Hegel’s interpretation of his own era, the argument presented here places his response to contemporary developments in the context of a series of World Revolutions which framed the meaning of his age. This approach serves to illustrate the unique combination of historical and philosophical reasoning on which Hegel’s thought depended. In the process, reconstructing his arguments raises challenging questions about the applicability of bygone political ideas to later historical periods. (shrink)

Kimberlé Crenshaw arrived at her famous phrase “intersectionality” by carefully thinking through speeches and writings given to us by early Black feminists, such as like Sojourner Truth and Anna J. Cooper. In this paper, I expand on this groundbreaking work in two somewhat surprising ways. First, I bring the ideas of these early Black feminists together with important, related proposals from W.E.B. Du Bois, Karl Marx, Hannah Arendt, and Simone de Beauvoir. Second, I relate these works to central ideas (...) in Kant’s practical philosophy in an effort to develop a Kantian theory of intersectionality. In addition to grasping the distinctive, destructive directions of oppressive forces aimed at women, the poor, and minorities, I seek to understand better the new, violently destructive elements found in European modernity, as evidenced both in European colonialization as well as the Holocaust. One claim found in the received historiography of the biometrical school (comprised primarily of Francis Galton, Karl Pearson, and W. F. R. Weldon) is that one of the biometricians' great flaws was their inability to look past their population-focused, statistical, gradualist understanding of evolutionary change – which led, in part, to their ignoring developments in cellular biology around 1900. I will argue, on the contrary, that the work of the biometricians was, from its earliest days, fundamentally concerned with connections (...) between statistical patterns of inheritance and the underlying cellular features that gave rise to them. Such work remained current with contemporary knowledge of chromosomes, cytology, and development; in this article, I explore the first case. The biometricians were thus well positioned to understand the relationship between the patterns of Mendelian inheritance and the statistical distributions with which they primarily occupied themselves. Ignorance of this connection, then, is not the reason why they rejected Mendelism. Further, both Galton and Weldon – though each in their own unique way – decided to turn to biological detail as a way to better justify the generality of their statistical approaches to heredity. Perhaps paradoxically, then, for these biometricians, detail offered an approach to theoretical generality. (shrink)

At least since Anaximander’s apeiron, there have been philosophical questions about what, if anything, preceded the gods. But, as far as I know, the precise question that I address in this essay was first explicitly asked by Ronald W. Hepburn, in his essay ‘Restoring the Sacred: Sacred as a Concept of Aesthetics’. In his essay, Hepburn is interested in the actual and potential relationships between religious and aesthetic uses of the concept of the sacred. Which leads him to the question: (...) Does the concept have a valid meaning – an aesthetic meaning, say – that is logically independent of (and therefore might have preceded) the religious one, which seems most strongly associated with the metaphysical belief that God or the gods exist? In other words, is the sacred older than the gods? While he does not provide a definitive answer, Hepburn adumbrates his view on whether this claim is correct. In this essay, I set out my own answer within the guidelines that Hepburn’s sketch has laid out. (shrink)

Jedynie widziadłem sprawiedliwości jest zatem to, że każdy ma się zajmować czymś jednym, że "człowiek, który jest szewcem z natury, najlepiej zrobi, jeżeli zostanie przy swoim kopycie i nic innego nie będzie próbował"; jedynie widziadłem jest także to, że jednostka jest dla państwa a nie państwo dla jednostki. Argumentuje się, że - zdaniem Platona - jeden i ten (...) sam człowiek sprawiedliwy, zatem człowiek doskonały, zajmuje się w swoim życiu nie tylko polityką (rządzeniem państwem, filozofią), ale i ćwiczeniem ciała, aby być zdolnym do walki, i zdobywaniem majątku. Picking up on Marx’s and Hegel’s analyses of human beings as social and individual, the article shows that what is at stake is not merely the possibility of individuality, but also the correct conception of the universal good. Both Marx and Hegel suppose that individuals must be social or political as individuals, which means, at least in Hegel’s case, that particular interests must form part of the universal good. The good and the rational is not something that requires sacrificing one’s (...) interests for the community or denying one’s particular character so as to become an equal rational agent. Very much to the contrary, the rational or the common good is nothing but the harmonious structuring of particular interests. While Section I introduces Marx’s and Hegel’s conceptions of individual and social beings, Sections II and III discuss their respective views of individuality, and Sections IV and V discuss the notion of a universal good containing individual interests. Jakob Friedrich Fries (1773-1843): A Philosophy of the Exact Sciences -/- Shortened version of the article of the same name in: Tabula Rasa. Jenenser magazine for critical thinking. 6th of November 1994 edition -/- 1. Biography -/- Jakob Friedrich Fries was born on the 23rd of August, 1773 in Barby on the Elbe. Because Fries' father had little time, on account of his journeying, he gave up both his sons, of whom Jakob Friedrich was the elder, to the Herrnhut Teaching (...) Institution in Niesky in 1778. Fries attended the theological seminar in Niesky in autumn 1792, which lasted for three years. There he (secretly) began to study Kant. The reading of Kant's works led Fries, for the first time, to a deep philosophical satisfaction. His enthusiasm for Kant is to be understood against the background that a considerable measure of Kant's philosophy is based on a firm foundation of what happens in an analogous and similar manner in mathematics. -/- During this period he also read Heinrich Jacobi's novels, as well as works of the awakening classic German literature; in particular Friedrich Schiller's works. In 1795, Fries arrived at Leipzig University to study law. During his time in Leipzig he became acquainted with Fichte's philosophy. In autumn of the same year he moved to Jena to hear Fichte at first hand, but was soon disappointed. -/- During his first sojourn in Jenaer (1796), Fries got to know the chemist A. N. Scherer who was very influenced by the work of the chemist A. L. Lavoisier. Fries discovered, at Scherer's suggestion, the law of stoichiometric composition. Because he felt that his work still need some time before completion, he withdrew as a private tutor to Zofingen (in Switzerland). There Fries worked on his main critical work, and studied Newton's "Philosophiae naturalis principia mathematica". He remained a lifelong admirer of Newton, whom he praised as a perfectionist of astronomy. Fries saw the final aim of his mathematical natural philosophy in the union of Newton's Principia with Kant's philosophy. -/- With the aim of qualifying as a lecturer, he returned to Jena in 1800. Now Fries was known from his independent writings, such as "Reinhold, Fichte and Schelling" (1st edition in 1803), and "Systems of Philosophy as an Evident Science" (1804). The relationship between G. W. F. Hegel and Fries did not develop favourably. Hegel speaks of "the leader of the superficial army", and at other places he expresses: "he is an extremely narrow-minded bragger". On the other hand, Fries also has an unfavourable take on Hegel. He writes of the "Redundancy of the Hegelistic dialectic" (1828). In his History of Philosophy (1837/40) he writes of Hegel, amongst other things: "Your way of philosophising seems just to give expression to nonsense in the shortest possible way". In this work, Fries appears to argue with Hegel in an objective manner, and expresses a positive attitude to his work. -/- In 1805, Fries was appointed professor for philosophy in Heidelberg. In his time spent in Heidelberg, he married Caroline Erdmann. He also sealed his friendships with W. M. L. de Wette and F. H. Jacobi. Jacobi was amongst the contemporaries who most impressed Fries during this period. In Heidelberg, Fries wrote, amongst other things, his three-volume main work New Critique of Reason (1807). -/- In 1816 Fries returned to Jena. When in 1817 the Wartburg festival took place, Fries was among the guests, and made a small speech. 1819 was the so-called "Great Year" for Fries: His wife Caroline died, and Karl Sand, a member of a student fraternity, and one of Fries' former students stabbed the author August von Kotzebue to death. Fries was punished with a philosophy teaching ban but still received a professorship for physics and mathematics. Only after a period of years, and under restrictions, he was again allowed to read philosophy. From now on, Fries was excluded from political influence. The rest of his life he devoted himself once again to philosophical and natural studies. During this period, he wrote "Mathematical Natural Philosophy" (1822) and the "History of Philosophy" (1837/40). -/- Fries suffered from a stroke on New Year's Day 1843, and a second stroke, on the 10th of August 1843 ended his life. -/- 2. Fries' Work Fries left an extensive body of work. A look at the subject areas he worked on makes us aware of the universality of his thinking. Amongst these subjects are: Psychic anthropology, psychology, pure philosophy, logic, metaphysics, ethics, politics, religious philosophy, aesthetics, natural philosophy, mathematics, physics and medical subjects, to which, e.g., the text "Regarding the optical centre in the eye together with general remarks about the theory of seeing" (1839) bear witness. With popular philosophical writings like the novel "Julius and Evagoras" (1822), or the arabesque "Longing, and a Trip to the Middle of Nowhere" (1820), he tried to make his philosophy accessible to a broader public. Anthropological considerations are shown in the methodical basis of his philosophy, and to this end, he provides the following didactic instruction for the study of his work: "If somebody wishes to study philosophy on the basis of this guide, I would recommend that after studying natural philosophy, a strict study of logic should follow in order to peruse metaphysics and its applied teachings more rapidly, followed by a strict study of criticism, followed once again by a return to an even closer study of metaphysics and its applied teachings." -/- 3. Continuation of Fries' work through the Friesian School -/- Fries' ideas found general acceptance amongst scientists and mathematicians. A large part of the followers of the "Fries School of Thought" had a scientific or mathematical background. Amongst them were biologist Matthias Jakob Schleiden, mathematics and science specialist philosopher Ernst Friedrich Apelt, the zoologist Oscar Schmidt, and the mathematician Oscar Xavier Schlömilch. Between the years 1847 and 1849, the treatises of the "Fries School of Thought", with which the publishers aimed to pursue philosophy according to the model of the natural sciences appeared. In the Kant-Fries philosophy, they saw the realisation of this ideal. The history of the "New Fries School of Thought" began in 1903. It was in this year that the philosopher Leonard Nelson gathered together a small discussion circle in Goettingen. Amongst the founding members of this circle were: A. Rüstow, C. Brinkmann and H. Goesch. In 1904 L. Nelson, A. Rüstow, H. Goesch and the student W. Mecklenburg travelled to Thuringia to find the missing Fries writings. In the same year, G. Hessenberg, K. Kaiser and Nelson published the first pamphlet from their first volume of the "Treatises of the Fries School of Thought, New Edition". -/- The school set out with the aim of searching for the missing Fries' texts, and re-publishing them with a view to re-opening discussion of Fries' brand of philosophy. The members of the circle met regularly for discussions. Additionally, larger conferences took place, mostly during the holidays. Featuring as speakers were: Otto Apelt, Otto Berg, Paul Bernays, G. Fraenkel, K. Grelling, G. Hessenberg, A. Kronfeld, O. Meyerhof, L. Nelson and R. Otto. On the 1st of March 1913, the Jakob-Friedrich-Fries society was founded. Whilst the Fries' school of thought dealt in continuum with the advancement of the Kant-Fries philosophy, the members of the Jakob-Friedrich-Fries society's main task was the dissemination of the Fries' school publications. In May/June, 1914, the organisations took part in their last common conference before the gulf created by the outbreak of the First World War. Several members died during the war. Others returned disabled. The next conference took place in 1919. A second conference followed in 1921. Nevertheless, such intensive work as had been undertaken between 1903 and 1914 was no longer possible. -/- Leonard Nelson died in October 1927. In the 1930's, the 6th and final volume of "Treatises of the Fries School of Thought, New Edition" was published. Franz Oppenheimer, Otto Meyerhof, Minna Specht and Grete Hermann were involved in their publication. -/- 4. About Mathematical Natural Philosophy -/- In 1822, Fries' "Mathematical Natural Philosophy" appeared. Fries rejects the speculative natural philosophy of his time - above all Schelling's natural philosophy. A natural study, founded on speculative philosophy, ceases with its collection, arrangement and order of well-known facts. Only a mathematical natural philosophy can deliver the necessary explanatory reasoning. The basic dictum of his mathematical natural philosophy is: "All natural theories must be definable using purely mathematically determinable reasons of explanation." Fries is of the opinion that science can attain completeness only by the subordination of the empirical facts to the metaphysical categories and mathematical laws. -/- The crux of Fries' natural philosophy is the thought that mathematics must be made fertile for use by the natural sciences. However, pure mathematics displays solely empty abstraction. To be able to apply them to the sensory world, an intermediatory connection is required. Mathematics must be connected to metaphysics. The pure mechanics, consisting of three parts are these: a) A study of geometrical movement, which considers solely the direction of the movement, b) A study of kinematics, which considers velocity in Addition, c) A study of dynamic movement, which also incorporates mass and power, as well as direction and velocity. -/- Of great interest is Fries' natural philosophy in view of its methodology, particularly with regard to the doctrine "leading maxims". Fries calls these "leading maxims" "heuristic", "because they are principal rules for scientific invention". -/- Fries' philosophy found great recognition with Carl Friedrich Gauss, amongst others. Fries asked for Gauss's opinion on his work "An Attempt at a Criticism based on the Principles of the Probability Calculus" (1842). Gauss also provided his opinions on "Mathematical Natural Philosophy" (1822) and on Fries' "History of Philosophy". Gauss acknowledged Fries' philosophy and wrote in a letter to Fries: "I have always had a great predilection for philosophical speculation, and now I am all the more happy to have a reliable teacher in you in the study of the destinies of science, from the most ancient up to the latest times, as I have not always found the desired satisfaction in my own reading of the writings of some of the philosophers. In particular, the writings of several famous (maybe better, so-called famous) philosophers who have appeared since Kant have reminded me of the sieve of a goat-milker, or to use a modern image instead of an old-fashioned one, of Münchhausen's plait, with which he pulled himself from out of the water. These amateurs would not dare make such a confession before their Masters; it would not happen were they were to consider the case upon its merits. I have often regretted not living in your locality, so as to be able to glean much pleasurable entertainment from philosophical verbal discourse." -/- The starting point of the new adoption of Fries was Nelson's article "The critical method and the relation of psychology to philosophy" (1904). Nelson dedicates special attention to Fries' re-interpretation of Kant's deduction concept. Fries awards Kant's criticism the rationale of anthropological idiom, in that he is guided by the idea that one can examine in a psychological way which knowledge we have "a priori", and how this is created, so that we can therefore recognise our own knowledge "a priori" in an empirical way. Fries understands deduction to mean an "awareness residing darkly in us is, and only open to basic metaphysical principles through conscious reflection.". -/- Nelson has pointed to an analogy between Fries' deduction and modern metamathematics. In the same manner, as with the anthropological deduction of the content of the critical investigation into the metaphysical object show, the content of mathematics become, in David Hilbert's view, the object of metamathematics. -/-. Christopher Hookway has been influential in promoting engagement with pragmatist and naturalist perspectives from classical and contemporary American philosophy. This book reflects on Hookway’s work on the American philosophical tradition and its significance for contemporary discussions of the understanding of mind, meaning, knowledge, and value. -/- Hookway’s original and extensive studies of Charles S. Peirce have made him among the most admired and frequently referenced of Peirce’s interpreters. His work on classical American pragmatism has explored the philosophies of William James, (...) John Dewey, and Josiah Royce, and examined the influence of pragmatist ideas outside of the United States. Additionally, Hookway has participated in a number of celebrated exchanges with some of the most high-profile figures of twentieth- and twenty-first-century philosophy, including Karl-Otto Apel, Philip Pettit, Hilary Putnam, and W.V.O. Quine, through which his treatments of a large range of topics in epistemology and the philosophies of mind and language have been developed and promoted. Joseph Butler was an Anglican priest and later a bishop who wrote about ethics, religion, and other philosophical themes. He is not well known today. During his lifetime and into the early part of the twentieth century he was better known especially for his major work the Analogy of Religion (1736). Today he is known mostly for his sermons which are interpreted as essays on ethics and for his essay on identity. Butler had a profound effect on J. H. Newman, (...) Matthew Arnold, and W. E. Gladstone and some effect on many other popular, academic, and professional readers. This book is as much about Butler’s sources and his reception as it is about the way he arranged and presented the evidence in the first half of the 18th century. He was a good man and is recognized by the Anglican church as a divine. We have no interest in taking a nostalgic look at a quaint figure in English church history. To those who claim Butler is unknown, that he was “blown out of the water” by John Wesley or Karl Barth, or Cornelius van Til, we can only say Butler is not as well known in the 20th and 21st centuries as in the 19th, but he is certainly not unknown to those who have taken any interest in philosophy, religion, or ethics. Today there has been a revival of interest in Bishop Butler. Our concern is to build and maintain a bridge that will help to keep this momentum. He offers an ethic that is universal and clearly Christian, yet it is based on the nature of man. Kant had a similar project, but in our opinion, Butler makes more compelling arguments. What is of interest to the Christian apologist is Butler’s work in this area. The purpose of this book is to present Butler’s ideas. We believe that his ethics have a universality that is applicable to people of all religious faiths and those that have none. It is common sense way of looking at ethics for everyday interaction. This book is a narrative argument presenting in detail how Butler’s creative arrangement of the evidence served as a bridge between the ancients as known in the Greek, Latin, and Hebrew originals, and the moderns, mostly Anglophone, who constituted Butler’s work environment and his reception in the latter day down to the present. We can hardly expect everyone to agree with Butler on all points, we certainly do not. The point at issue is rather whether he merits a seat at the present-day round table of deliberation on matters pertaining to philosophy, religion, and ethics. (shrink)

Entre 1860 e 1900, os Estados Unidos passaram de país agrícola, com população em torno de 4 milhões, para país industrial, com uma das maiores economias do mundo e com 75 milhões de habitantes. -/- O incremento populacional e a industrialização redundaram em um processo de urbanização sem precedentes que continuou até a década de 1930. Para se ter uma ideia, em 1860 viviam em Chicago 102 260 pessoas; em 1900, a população da cidade passou a 1 698 575 e, em 1930, a 3 375 329. Em virtude desses fatores, consolidaram-se nos Estados Unidos uma burguesia industrial, comercial e financeira significativa, uma classe trabalhadora majoritariamente formada por imigrantes e uma classe média em ascensão. -/- As principais cidades passaram a ser um espaço de conflito e alvo de preocupações. Temas como imigração, aculturação, conflitos étnicos, comportamentos desviantes e políticas públicas foram importantes na Sociologia desenvolvida inicialmente no país. -/- Entre os principais fundadores da Sociologia nos Estados Unidos estão William Graham Sumner (1840 -1910), Lester Frank Ward (1841-1913), Albion Woodbury Small (1854-1926), Franklin Henry Giddings (1855-1931), Thorstein Bunde Veblen (1857-1929), William Isaac Thomas (1863-1947), Robert Ezra Park (1864-1944), Charles Horton Cooley (1864-1929) e George Herbert Mead (1863-1931). -/- A herança cultural desses fundadores é muito diversa: foram influenciados principalmente pela tradição religiosa protestante disseminada em quase todo o território, pelo liberalismo econômico clássico conservador, do tipo laissez-faire, pelo evolucionismo do inglês Charles Darwin (1809-1882) e pelo darwinismo social de Herbert Spencer (1820-1903). Acrescente-se a esse cadinho de concepções de mundo e ciência o pragmatismo do filósofo e psicólogo William James (1842-1910) e do filósofo Charles Pierce (1839-1914). -/- Essa herança permite compreender as duas grandes características da Sociologia nos Estados Unidos: -/- • multiplicidade de temas, problemas e propostas e diversidade teórica e metodológica; -/- • desenvolvimento desse campo do conhecimento em universidades, nas quais as atividades eram financiadas pelo Estado e pelo setor privado (Fundação Rockefeller, comitês e associações normalmente religiosas). -/- Por causa dessa segunda característica, optei por analisar o desenvolvimento da Sociologia nos Estados Unidos em três importantes universidades estadunidenses: a de Chicago, Harvard e Columbia. -/- 1. A Universidade de Chicago -/- A Universidade de Chicago foi fundada em 1890 pelo magnata do petróleo John D. Rockefeller e recebeu os primeiros alunos em 1892. Nela foi criado o primeiro departamento de Sociologia dos Estados Unidos, sob a direção de Albion Woodbury Small. -/- No início de seus trabalhos sociológicos, a Universidade de Chicago deu primazia à pesquisa empírica, procurando conhecer, por meio da observação direta, a dinâmica das relações sociais. Desenvolveu uma forte tendência pragmática e microssociológica, que viria a ser conhecida como a Escola de Chicago. A maior preocupação dos integrantes dessa Escola foi com os problemas das grandes cidades dos Estados Unidos, como a marginalidade social, o alcoolismo, as drogas, a segregação racial e a delinquência, estabelecendo uma relação entre a pesquisa sociológica e a intervenção dos organismos públicos na sociedade. -/- Os sociólogos de Chicago também se dedicaram ao que chamaram de ecologia humana, em oposição à ecologia animal e vegetal. -/- Em 1895, Albion Woodbury Small fundou o American Journal of Sociology e, em 1907, participou ativamente da fundação da Sociedade Americana de Sociologia. Ele publicou, com Georges Vincent, em 1894, talvez o primeiro manual de Sociologia para estudantes, intitulado Introdução ao estudo da sociedade. Tendo estudado na Alemanha, Small foi o principal divulgador do pensamento de Georg Simmel nos Estados Unidos. -/- Entre os integrantes da Escola de Chicago mais conhecidos no Brasil, podemos citar William I. Thomas (1863-1947) e Florian Znaniecki (1882-1958), cuja principal obra foi O camponês polonês na Europa e na América, editada em 1918. -/- Destacam-se ainda Robert E. Park (1864-1944) e Ernest W. Burgess (1886-1966), que escreveram, entre outras obras, Introdução à ciência da Sociologia, em 1921. -/- Os dois, com Roderick Mackenzie, escreveram o clássico A cidade, em 1925. Outro membro de destaque foi Louis Wirth (1897-1952), autor de O gueto, escrito em 1928, e de um artigo que se tornou famoso, “Urbanismo como modo de vida”, publicado em 1938, no American Journal of Sociology. -/- A Escola de Chicago congregou, ainda, sociólogos e antropólogos com ligação com a Psicologia Social, que desenvolveram uma abordagem sociológica das relações sociais conhecida como interacionismo simbólico. A principal figura dessa vertente foi George Herbert Mead (1863-1932), que trabalhou em diversas áreas, sobretudo como psicólogo social e como professor de várias gerações de antropólogos e sociólogos. Seus escritos foram sistematizados por seus alunos e publicados com o nome Mind, self and society (A mente, o eu e a sociedade), em 1934. -/- Além da tradição intelectual dos Estados Unidos, os integrantes da Escola de Chicago receberam a influência de Jean-Gabriel de Tarde, Émile Durkheim e Georg Simmel. Seus continuadores foram Herbert Blumer (1900-1987) e Everett C. Hughes (1897-1983). -/- 1.1 Erving Goffman (1922-1982) -/- O representante da Sociologia desenvolvida na Universidade de Chicago mais influente no Brasil é Erving Goffman, que nasceu em Manville, Alberta, no Canadá, em 1922, e faleceu nos Estados Unidos em 1982. Obteve o grau de bacharel pela Universidade de Toronto, em 1945, e concluiu mestrado (1949) e doutorado (1953) na Universidade de Chicago, onde estudou Sociologia e Antropologia Social. Em 1958, tornou-se professor da Universidade da Califórnia e, em 1968, ingressou na Universidade da Pensilvânia, onde foi professor de Antropologia e Sociologia. -/- Entre 1981 e 1982, Goffman foi presidente da Sociedade Americana de Sociologia e realizou pesquisas na linha da Sociologia interpretativa e cultural, iniciada por Max Weber, desenvolvendo a ideia de que o mundo é um teatro e cada um, individualmente ou em grupo, interpreta papéis de acordo com as circunstâncias em que se encontra. Essas circunstâncias são marcadas por rituais e posições distintivas em relação a outros indivíduos ou grupos. Para ele, é possível distinguir indivíduos, grupos e classes com base, por exemplo, em aspectos como as formas de vestir ou de se apresentar publicamente. -/- O sociólogo considera a interação social como um processo fundamental de identificação e de diferenciação dos indivíduos e grupos, analisando-a no cotidiano, especialmente em lugares públicos. Goffman estudou com especial atenção o que chamou de “instituições totais”, lugares onde o indivíduo é isolado da sociedade, como prisões e manicômios. -/- De acordo com o sociólogo brasileiro Édison Gastaldo: -/- O trabalho de Goffman trouxe à luz aspectos da vida cotidiana que não se julgavam “sociologicamente relevantes”. Seus insights sobre as interações ordinárias, sobre o deslocamento dos pedestres, sobre a ocupação social dos espaços públicos, sobre a atuação dos vigaristas, mendigos, loucos, espiões, jogadores e de todos aqueles que passam cotidianamente debaixo de nossos narizes sem que prestemos atenção modificaram o pensar sociológico no mundo. Sua descrição etnográfica de um hospital para doentes mentais colaborou decisivamente para deflagrar a luta antimanicomial no mundo inteiro. Vinte e dois anos depois de sua morte, os temas e os conceitos desenvolvidos por Goffman ainda estão em pleno uso e vitalidade (GASTALDO, 2004, p. 9/10). -/- Suas três obras mais conhecidas são: A representação do eu na vida cotidiana (1959), Manicômios, prisões e conventos (1961) e Estigma: notas sobre a manipulação da identidade (1963). -/- 2. A Universidade Harvard -/- A história de Harvard começa em 1636, quando foi fundada, na cidade de Cambridge, no estado de Massachusetts, uma instituição de ensino denominada New College. Em 1639, essa instituição recebeu o nome de Harvard College, em homenagem a John Harvard, seu principal mecenas. -/- A Sociologia desenvolvida na Universidade Harvard é marcada por uma preocupação teórica e tem dois sociólogos como expoentes: Pitirim Alexandrovich Sorokin (1889-1968) e Talcott Edgar Frederick Parsons (1902-1979). Este último influenciou muito o desenvolvimento da Sociologia no mundo e no Brasil. -/- 2.1 Talcott Parsons (1902-1979) -/- Talcott Parsons nasceu no Colorado, nos Estados Unidos. Em 1924, graduou-se em Biologia e Filosofia na Faculdade Amherst. Em 1925, pós-graduou-se em Ciências Sociais na Escola de Economia de Londres, na Inglaterra, e, em seguida, doutorou-se na Universidade de Heidelberg, na Alemanha. -/- Nos Estados Unidos, lecionou Economia e Sociologia na Universidade Harvard durante 45 anos (1927-1973). Em 1944, tornou-se presidente do Departamento de Sociologia, transformando-o, dois anos depois, no Departamento de Relações Sociais, a fim de unir a Sociologia a outras ciências sociais. -/- Assim como Sorokin, Parsons voltou-se para a Sociologia europeia, tendo por base as ideias de Max Weber, Vilfredo Pareto (1848-1923) e Émile Durkheim, além das do economista inglês Alfred Marshall (1842-1924). Fundamentado nesses autores, desenvolveu uma grande obra teórica, que dominaria a Sociologia estadunidense desde então. -/- Parsons é o sociólogo estadunidense mais conhecido no mundo. Em geral, seus críticos entenderam-no como um pensador conservador, preocupado basicamente com o bom ordenamento da sociedade. Seu interesse era determinar a função que os indivíduos desempenhavam na estrutura social. Entendia o indivíduo como expressão dessa estrutura, a qual devia ser mantida e preservada. Caso isso não ocorresse, deviam entrar em ação os mecanismos de controle social (moral, ética, sistema jurídico e penal etc.), como instrumentos preventivos ou corretivos. -/- Seu trabalho exerceu influência em diversos países e ambientes acadêmicos (particularmente nas décadas de 1950 a 1970), até mesmo na então União Soviética, onde, em 1964, ministrou aulas sobre a Sociologia estadunidense a convite da Academia de Ciências da União Soviética (URSS). -/- Suas principais obras foram: A estrutura da ação social (1937), O sistema social (1951), Economia e sociedade (1956, com N. Smelser), Estrutura e processo nas sociedades modernas (1960), Sociedades: perspectivas evolucionárias e comparativas (1966), Teoria sociológica e sociedade moderna (1968), Política e estrutura social (1969), Sistemas sociais e a evolução da teoria da ação (1977) e Teoria da ação e a condição humana (1978). -/- 3. A Universidade Columbia -/- A King’s College foi fundada em 1754, em Nova York, nos Estados Unidos. Quando as colônias inglesas se declararam independentes da Grã-Bretanha, a instituição passou a se chamar Universidade Columbia. A partir da última década do século XIX, essa universidade se destacaria por uma importante produção no campo da Sociologia, tendo como pioneiro Franklin Giddings (1855-1931), fundador da cadeira de Sociologia. Fortemente marcado pelo evolucionismo e pelo pragmatismo, foi um dos primeiros a usar métodos quantitativos e experi-mentais no estudo dos fenômenos sociais. -/- Dois sociólogos de Columbia merecem destaque, por serem muito conhecidos no Brasil: Robert K. Merton e Charles Wright Mills. -/- 3.1 Robert King Merton (1910-2003) -/- Merton nasceu na Filadélfia e faleceu em Nova York. Graduou-se em Sociologia na Universidade Temple e pós-graduou-se na Universidade Harvard, onde trabalhou com Pitirim Sorokin e Talcott Parsons até a defesa de seu doutorado, em 1936. -/- Em 1941 Merton transferiu-se para a Universidade Columbia, onde permaneceu durante 38 anos, até aposentar-se. Nessa universidade procurou integrar teoria à prática sociológica. Estudou o comportamento desviante e os processos de adaptação social, tendo por base pesquisas qualitativas e quantitativas do exercício profissional em ambiente de solidariedade e de conflito. Com Paul Lazarsfeld (1901-1976), desenvolveu o Departamento de Pesquisa Social Aplicada. -/- O nome de Merton está vinculado à proposta de criação de teorias de alcance médio, segundo a qual os sociólogos seriam mais úteis à sociedade se deixassem de lado as grandes teorias (criticando Parsons) e criassem outras de médio alcance. Essas teorias estariam situadas entre as hipóteses de trabalho rotineiras na pesquisa e as amplas especulações. Mediariam, dessa forma, as abstrações, generalizações e fundamentos empíricos da pesquisa. -/- Merton tinha uma visão humanista da função social da ciência, demonstrando influência clara de Max Weber. Concebia a ciência como um conjunto de conhecimentos compartilhados por todos os membros da sociedade, que deveriam julgar a credibilidade das postulações científicas de acordo com suas expectativas e valores morais. Mas as decisões acerca do fazer científico não caberiam à sociedade, e sim ao próprio cientista, sempre adequando seus valores aos da sociedade. -/- 3.2 Charles Wright Mills (1916-1962) -/- Charles Wright Mills (1916-1962) nasceu em Waco, no Texas, Estados Unidos. Mestre em Artes, Filosofia e Sociologia pela Universidade do Texas, concluiu, em 1942, seu doutorado em Sociologia e Antropologia pela Universidade de Wisconsin. Foi professor de Sociologia nas universidades de Maryland e Columbia, onde passou a lecionar em 1947 e permaneceu até a morte, em 1962. -/- Charles Mills representa uma tendência quase marginal na Sociologia dos Estados Unidos, por apresentar uma visão crítica e militante da sociedade estadunidense e da própria Sociologia. -/- Influenciado por Karl Marx e Max Weber, Mills procurou conciliar o conceito de classe social com o de status, visando esclarecer processos e mecanismos dos conflitos e das mudanças sociais. Por meio de pesquisas, tentou elucidar a complexidade de estruturas de poder, particularmente das elites (em lugar de classes dominantes), e de seu papel na mudança social, fugindo da ideia de revolução como única via para a transformação social. -/- Charles Wright Mills é conhecido principalmente por seu livro A imaginação sociológica, publicado originalmente nos Estados Unidos em 1959. Nele, o autor propõe que os sociólogos, ao exercer a profissão, não deixem a imaginação e a criatividade de lado em favor de uma pretensa objetividade e neutralidade do trabalho científico. Para Mills, os grandes intelectuais da história nunca abriram mão da reflexão e da criatividade e mantiveram uma postura crítica diante da realidade. -/- Atribuindo aos sociólogos a responsabilidade de agentes ativos na sociedade, cabendo-lhes tomar parte nos debates públicos de sua época, Mills defendia a ideia de que a Sociologia deveria ser compreensível para o grande público. Para ele, a ciência social era inseparável da vida pessoal do cientista: a intuição, a imaginação e o comprometimento com o tempo em que se vivia eram fundamentais para compreender cientificamente a sociedade. Suas obras foram publicadas em vários idiomas. Além da citada anteriormente, as mais importantes são: A nova classe média (1951), A elite do poder (1956), Sobre o artesanato intelectual (1959) e Os marxistas (1962). -/- Mills escreveu também artigos em revistas e dois livros que tiveram grande exposição na mídia dos Estados Unidos, por seu caráter polêmico: As causas da Terceira Guerra Mundial (1958), no qual discute a corrida nuclear, e A Revolução em Cuba (1960), em que analisa a fase inicial da Revolução Cubana. -/- Outros sociólogos que defendem uma postura crítica na Sociologia estadunidense, continuadores ou não de Charles Wright Mills, são Irving Louis Horowitz (1929-2012), Martin Nicolaus (1928-) e Alvin Gouldner (1920-1980). -/- REFERENCIAL TEÓRICO -/- BOTTOMORE, T.; et al. WhatsApp: (82)9.8143-8399. -/- PREMISSA -/- Na Alemanha, a Sociologia foi profundamente influenciada pela discussão filosófica, histórica e metodológica que se desenvolveu entre o final do século XIX e o início do século XX. Em seus fundamentos encontra-se (...) o pensamento de vários filósofos, como Johann Gottlieb Fichte (1762 -1814), Friedrich Wilhelm Joseph von Schelling (1775 -1854), Friedrich Daniel Ernst Schleiermacher (1768 -1834), Georg Wilhelm Friedrich Hegel (1770 -1831) e Friedrich W. Nietzsche (1844-1900). -/- O representante mais expressivo da Sociologia alemã é Max Weber (1864-1920). Outros pensadores, entretanto, contribuíram significativamente para a formação e o desenvolvimento da Sociologia na Alemanha, entre os quais Ferdinand Tönnies (1855 -1936), Werner Sombart (1863-1941), Georg Simmel (1858-1918) e os estudiosos que a partir da década de 1920 constituíram a chamada Escola de Frankfurt. -/- A obra desses autores liga-se fortemente ao processo de unificação alemã, promovido somente após o triunfo de Otto von Bismarck na Guerra Franco-Prussiana (1871), e à aceleração da industrialização alemã. Esses dois fatores conferiram à Alemanha uma situação muito diferente da de outros países europeus. -/- A alteração nas estruturas de poder, na Alemanha, não ocorreu por meio de uma revolução, como na França, mas por um acordo entre a bur-guesia industrial e os grandes proprietários de terra, tendo em vista uma transição mais adequada aos seus interesses. -/- Vale salientar, em nota, que após a Guerra Franco-Prussiana (1870-71), os príncipes alemães se reuniram no palácio de Versalhes (França), onde aclamaram Guilherme I, da Prússia, como o imperador alemão. Assim surgia o Império da Alemanha, em 1871. -/- A burguesia industrial não estava preocupada em alterar de modo significativo a estrutura fundiária, e os grandes proprietários, que se encastelaram na burocracia estatal, não permitiram a formulação de uma legislação trabalhista que prejudicasse os interesses da burguesia. Assim se fez uma mudança “por cima”, sem levar em conta os interesses dos trabalhadores urbanos ou rurais. Destacam-se aqui dois importantes soció-logos alemães: Georg Simmel e Max Weber, pela presença no Brasil. Depois, brevemente, falar-se-á aqui da famosa Escola de Frankfurt. -/- 1. Georg Simmel (1858-1918) -/- Nascido em Berlim, Georg Simmel é um pensador difícil de enquadrar em alguma tendência ou campo específico do conhecimento. Vamos ler um trecho do que escreveu sobre ele o sociólogo brasileiro Leopoldo Waizbort: -/- Quem tentar esboçar a fisionomia de Georg Simmel (1858-1918), logo se encontra em meio a dificuldades que são características próprias daquilo que se quer apreender. Simmel sempre postulou para seu próprio pensamento uma mobilidade e uma plasticidade para se adaptar ao seu objeto – uma multiplicidade de direções, uma defesa do fragmento –, que se opõem a toda tentativa de fixação e acabamento, a toda pretensão de sistema. Por isso todos os rótulos que lhe são atribuídos, apesar de possuírem seu teor de verdade, sempre soam tão falsos: vitalismo, relativismo, esteticismo, formalismo, irracionalismo, psicologismo, impressionismo e tantos mais. Disto também é exemplo o fato de Simmel, hoje considerado, ao lado de Max Weber e Ferdinand Tönnies, um dos “pais” da sociologia alemã, não poder ser classificado sem mais como “sociólogo”, sob pena de se perderem várias outras dimensões que são essenciais ao seu pensamento (WAIZBORT, 2000. p. 11). -/- G. Simmel foi o último dos sete filhos de um próspero comerciante judeu convertido ao cristianismo. Com a morte do pai, herdou uma fortuna considerável que lhe permitiu independência para desenvolver a vida acadêmica. Estudou História e Filosofia na Universidade de Berlim, onde foi aluno das mais importantes figuras acadêmicas da época. Em 1881, defendeu uma tese sobre Immanuel Kant e recebeu o título de doutor em Filosofia. Entre 1885 e 1914, lecionou Filosofia, Ética e Sociologia na Universidade de Berlim, mas nunca foi incorporado formalmente à universidade. -/- Ocupou o cargo de professor titular de Filosofia somente em 1914, em Estrasburgo, cidade onde permaneceu até a morte, em 1918. -/- Na virada do século XIX para o século XX na Alemanha, houve uma intensa efervescência filosófica, cultural e artística, cenário em que se desenvolveram a psicanálise, a teoria da relatividade, o positivismo lógico e a música atonal. Nesse cenário, Simmel tornou-se um conferencista muito aclamado e escreveu artigos e ensaios sobre os mais variados temas da Filosofia, como lógica, teoria do conhecimento, ética, estética ou metafísica, além de temas da Psicologia, da Sociologia, da História e da religião. -/- Escreveu também muitas biografias (de Johann Wolfgang von Goethe, de Friedrich Nietzsche, de Immanuel Kant e de Rembrandt, entre outros). -/- Suas obras sociológicas mais importantes são: Da diferenciação social (1890), A filosofia do dinheiro (1907), Sociologia (1908) e Questões fundamentais da Sociologia (1917). Georg Simmel teve influência marcante no desenvolvimento da Sociologia na Alemanha, nos Estados Unidos (em especial na Escola de Chicago) e na França (em Durkheim e seus colaboradores diretos). Suas obras foram traduzidas para o francês e o inglês, muitas vezes antes de ser publicadas em alemão. -/- 2. Max Weber (1864-1920) -/- Max Weber nasceu em 21 de abril de 1864, em Erfurt, e morreu em Munique, em 1920. De família abastada, teve uma educação formal de boa qualidade, o que lhe permitiu uma erudição notável. Com 18 anos, ingressou na Universidade de Heidelberg, onde escolheu como área de concentração o Direito e como correlatas a História, a Filosofia e a Economia. Nessa universidade, teve o primeiro contato com os escritos de Immanuel Kant e com neokantianos, os quais nunca deixou de lado em seus estudos. -/- Em 1889, concluiu o doutorado em Direito Comercial com uma tese sobre a história das sociedades comerciais da Idade Média. Em 1891, defendeu outra tese: A importância da história agrária romana para o direito público e privado. Em 1894, tornou-se professor de Economia na Universidade de Freiburg e, dois anos depois, transferiu-se para a Universidade de Heidelberg. -/- A partir de 1897, acometido de uma depressão profunda, não conseguiu desenvolver as atividades acadêmicas. Entre 1902 e 1903, retomou as atividades intelectuais, mas fora da universidade, pois não tinha condições psicológicas para ministrar aulas. No ano seguinte, tornou-se coeditor do Arquivo de Ciências Sociais, publicação muito importante para o desenvolvimento dos estudos sociológicos na Alemanha. -/- Entre agosto e dezembro de 1904, viajou, com Ferdinand Tönnies e Werner Sombart, aos Estados Unidos, por ocasião da Exposição Universal de Saint-Louis, onde entrou em contato com as igrejas e seitas protestantes daquele país e também com vários escritos de Benjamin Franklin (1706-1790), o que foi fundamental para suas pesquisas sobre a relação entre a ética protestante e o capitalismo. -/- Em 1907, recebeu uma herança significativa. A partir de então, dedicou-se exclusivamente à investigação histórica e sociológica. Em 1909, colaborou na fundação da Sociedade Alemã de Sociologia. Ao ser deflagrada a Primeira Guerra Mundial, em 1914, Weber foi convocado como oficial da reserva para dirigir um hospital militar. Entre as atividades no hospital encontrou tempo para continuar a escrever partes do livro que foi publicado postumamente por sua esposa, com o título Economia e sociedade. Além disso, desenvolveu estudos sobre ética econômica e as religiões universais e escreveu uma série de artigos para os grandes jornais da Alemanha. Nesses artigos, criticou a estrutura partidária do país e a burocratização das esferas políticas na Alemanha, afirmando que aquela situação ainda era a herança de Otto von Bismarck. -/- Em 1917, pronunciou uma conferência – A ciência como vocação – e produziu um escrito, no qual explicitou seu método – Ensaio sobre neutralidade axiológica nas ciências sociológicas e econômicas. -/- Pelas ideias expostas em debates e nos jornais e por sua erudição, Max Weber, após a derrota alemã na Primeira Guerra Mundial, fez parte da comissão que redigiu, em 1919, a nova constituição política alemã, conhecida como a Constituição de Weimar. -/- Pode-se afirmar que a vida de Max Weber foi dedicada aos estudos, à pesquisa e à participação ativa na política alemã de seu tempo, por meio de conferências e artigos para jornais e revistas. -/- Weber não media esforços para analisar e com-preender mais profundamente os temas que elegia. Aprendeu grego e hebraico para ler a Bíblia no original, espanhol para ler os documentos sobre as companhias de navegação e comércio espanhol, russo para ler os jornais sobre os acontecimentos na Rússia de 1905 até a revolução de 1917, inglês para ler os textos estadunidenses sobre a vida religiosa e a ética dos protestantes. -/- Para Max Weber, o indivíduo é o núcleo de análise por ser o único que pode definir intenções e finalidades para seus atos. Desse modo, o ponto de partida da Sociologia é a compreensão da ação dos indivíduos, atuando e vivenciando situações sociais com determinadas motivações e intenções. Instituições como Estado e família só ganham sentido quando vistas da perspectiva das relações sociais. Em 1923, um grupo de intelectuais – entre eles Friedrich Pollok (1894-1970), Leo Löwenthal (1900-1993), Karl August Wittfogel (1896-1988), Max Horkheimer (1895-1973) e Theodor Adorno (1903-1969) – desenvolveu uma análise da sociedade contemporânea com base em concepções filosóficas de Immanuel Kant, Friedrich Hegel e Friedrich Nietzsche, em visões sociológicas de Karl Marx e de Max Weber e no pensamento de Sigmund Freud. -/- Os integrantes do grupo de Frankfurt pretendiam desenvolver uma teoria crítica da sociedade capitalista e buscavam explicar fenômenos que iam da análise da personalidade autoritária à indústria cultural. Mantiveram a crítica ao positivismo e ao pragmatismo, procurando demonstrar a necessida-de de refletir sobre as condições que permitiram a emergência do nazismo e sobre o significado dessa ideologia. As reflexões desses intelectuais culminaram com uma crítica à razão instrumental e às formas de controle sobre a sociedade contemporânea. -/- Além dos estudiosos citados, são representantes desse pensamento Walter Benjamin (1892-1940), Erich Fromm (1900-1980) e Herbert Marcuse (1898-1979), entre outros. In this paper, I examine the extent to which Marcien Towa (1931-2014) can be considered the Father of Cameroonian Critical Theory. In this regard, I compare what can be called his social philosophy with the project of a critical theory of society, as outlined by Max Horkheimer (1895-1973). I specifically consider Marcien Towa’s idea of philosophy, which I confront with Horkheimer’s project from the perspectives offered by their sociopolitical premises, conceptual references, and progressive goals. On each of these aspects, I (...) discover sufficient correspondences that allow me to argue that Towa and Horkheimer, who barely knew each other, formulated a somewhat similar claim, namely to provide a critical theory of society, whose aim is not only to understand society but more importantly to change it. Advocates of conceptual engineering as a method of philosophy face a dilemma: either they are ignorant of how conceptual engineering can be implemented, or else it is trivial to implement but of very little value, representing no new or especially fruitful method of philosophizing. Two key distinctions frame this dilemma and explain its two horns. First, the distinction between speaker’s meaning and reference and semantic meaning and reference reveals a severe implementation problem for one construal of conceptual engineering. Second, the (...) distinction between stipulating meanings and conceptually analyzing allows us to see why, on another construal of what conceptual engineering involves, the practice is neither a new nor neglected philosophical methodology. The article also argues that semantic externalism is not the root of the implementation problem for conceptual engineering, and that the usual rationale for adopting the practice, one that ties its value to the amelioration of “conceptual defects”, is unsound. Karl Pfeifer attempts to present a coherent view of panentheism that eschews Pickwickian senses of “in” and aligns itself with, and builds upon, familiar diagrammed portrayals of panentheism. The account is accordingly spatial-locative and moreover accepts the proposal of R.T. Mullins that absolute space and time be regarded as attributes of God. In addition, however, it argues that a substantive parthood relation between the world and God is required. Pfeifer’s preferred version of panpsychism, viz. panintentionalism, is thrown into the (...) mix as an optional add-on. On this account, God is conceived of as a “spiritual field” whose nature can be made more intelligible by regarding “God” as having a mass-noun sense in some contexts. Pfeifer closes with the suggestion that we look to topology and mereology for further development of the position outlined in his paper. (shrink)

In recent years, several philosophers - including Joshua Gert, Douglas Portmore, and Elizabeth Harman - have argued that there is a sense in which morality itself does not treat moral reasons as consistently overriding.2 My aim in the present essay is to develop and extend this idea from a somewhat different perspective. In doing so, I offer an alternative way of formalizing the idea that morality is modest about the weight of moral reasons in this way, thereby making more explicit (...) the connections between this thesis and similar issues in the epistemic sphere. In addition, I discuss how these ideas can transform our thinking about familiar questions in ethics such as the nature of self-effacement, the significance of reflective endorsement, the weight that moral reasons ought to be given in all things consideration, and the plausibility of “indirect” moral theories. Finally, I show that these ideas are compatible even with pictures of morality – such as Kant’s – on which morality might seem to anything but modest about its own importance. In doing so, I stress that it is possible to see morality as modest about the weight of specifically moral reasons, while also seeing all practical reasons as grounded in morality more indirectly – namely, by seeing morality as determining the weight that both moral and non-moral considerations deserve to have in all things considered deliberation. This paper explores how transformative experience generates decision-making problems of particular seriousness in medical settings. Potentially transformative experiences are especially likely to be encountered in medicine, and the associated decisions are confronted jointly by patients and clinicians in the context of an imbalance of power and expertise. However in such scenarios the principle of informed consent, which plays a central role in guiding clinicians, is unequal to the task. We detail how the principle’s assumptions about autonomy, rationality and information handle (...) transformative experiences poorly, appealing to several difficult cases for medical decision-making to illustrate the resulting problem, and we consider how the existing literature on complications with consent fails to offer a resolution. We argue that recognition of the problem has a role to play in achieving a more effective response to transformative decisions. In Sect. 1 we introduce several representative cases of challenging patient decision-making that clinicians might face. In Sect. 2 we detail how transformative experience has been analysed in the recent literature, before outlining in Sect. 3 the theoretical basis of the principle of informed consent, which plays a central role in how clinicians are expected to support decision-making. In Sect. 4, having laid the groundwork for a clear description, we return to the cases given in Sect. 1 to confirm how their transformative nature presents a problem: either clinicians treat the decisions faced by these patients as ‘normal’, encouraging them to focus on information provision that patients may be unable to act on, or they treat them as transformative, in which case they lack the resources to recognise whether they are helping patients make (subjectively) good decisions. In Sect. 5 we argue that the existing literature does not offer any escape from this problem. We close in Sect. 6 by noting the significant impact that appreciating the problem of transformative experience could have on supporting transformative decisions in medicine and briefly suggesting how we might aim to develop new approaches to dealing with these. In this article I offer an opinionated overview of the central elements of Kant’s philosophical methodology during the critical period. I begin with a brief characterization of how Kant conceives of the aims of human inquiry – focusing on the idea that inquiry ideally aims at not just cognition (Erkenntnis), but also the more demanding cognitive achievements that Kant labels insight (Einsehen) and comprehension (Begreifen). Then I explore the implications of this picture for philosophy — emphasizing Kant’s distinction between critical (...) and doctrinal phases of philosophical inquiry, with the first of these playing both a negative and a positive role with respect to the second. Then, I will argue that this positive role is possible, according to Kant, only insofar as philosophy follows what I call a “capacities-first” methodology – that is, one that treats basic cognitive capacities (such as reason) and their self-conscious activities as fundamental (in both a cognitive sense and in an explanatory sense) for the sort of philosophy human beings are capable of. It is this methodology, I will argue, that allows Kant to introduce the first principles that philosophy in its doctrinal phase requires in a manner that is neither arbitrary nor (at least obviously) incompatible with Kant’s own critical restrictions on cognition. I conclude by discussing some of the implications of this methodological picture – including the methodological significance of self-consciousness and regressive or “transcendental” arguments, Kant’s distinction between analytic and synthetic methods in philosophy, and Kant’s conception of reason as autonomous. Over the last two decades, Kant’s name has become closely associated with the “constitutivist” program within metaethics. But is Kant best read as pursuing a constitutivist approach to meta- normative questions? And if so, in what sense? In this essay, I’ll argue that we can best answer these questions by considering them in the context of a broader issue – namely, how Kant understands the proper methodology for philosophy in general. The result of this investigation will be that, while Kant (...) can indeed be read as a sort of constitutivist, his constitutivism is ultimately just one instance of a much more general approach to philosophy – which treats as fundamental our basic, self-conscious rational capacities. Thus, to truly understand why and how Kant is a constitutivist, we need to consider this question within the context of his more fundamental commitment to “capacities-first philosophy”. (shrink)

According to internalism about rationality, the ir/rationality of a subject depends only on how things appear from her subjective perspective. According to culpabilism, rationality is a normative standard such that violations of rationality are (at least sometimes) blameworthy. According to a classical line of reasoning, culpabilism entails internalism. I argue that, to the contrary, culpabilism entails that internalism is false. The internalist cannot accommodate the possibility of culpable irrationality.

The teleosemantic indeterminacy problem has generated much discussion but no consensus. One possible solution is to accept indeterminacy as a real feature of some representations. I call this view “indeterminacy realism.” In this paper, I argue that indeterminacy realism should be treated as a serious option. By drawing an analogy with vagueness, I try to show that accepting the reality of indeterminacy would not be catastrophic for teleosemantics. I further argue that there are positive reasons to endorse indeterminacy realism. Contemporary forms of Kantian constitutivism generally begin with a conception of agency on which the constitutive aim of agency is some form of autonomy or self-unification. This chapter argues for a re-orientation of the Kantian constitutivist project towards views that begin with a conception of rationality on which both theoretical and practical rationality aim at forms of understanding. In a slogan, then, understanding-first as opposed to autonomy-first constitutivism. Such a view gives the constitutivist new resources for explaining many classes of (...) reasons, while also offering a new way of understanding the unity of theoretical and practical reason. The chapter concludes by arguing that the resulting view is best understood, not so much as an alternative to autonomy-first constitutivism, but as a complement to it. (shrink)

The article discusses the conditions under which can we say that people enter the economic system voluntarily. “The Need for an Exit Option” briefly explains the philosophical argument that voluntary interaction requires an exit option—a reasonable alternative to participation in the projects of others. “The Treatment of Effective Forced Labor in Economic and Political Theory” considers the treatment of effectively forced interaction in economic and political theory. “Human Need” discusses theories of human need to determine the capabilities a person requires (...) to have an acceptable exit option. “Capability in Cash, Kind, or Raw Resources” considers what form access to that level of capability should take—in cash, kind, or raw resources, concluding that a basic income guarantee is the most effective method to ensure an exit option in a modern, industrial economy. Karl Pfeifer revisits Wittgenstein’s parenthetical allusion in the _Tractatus Logico-Philosophicus_ to the Grimms’ fairytale “The Golden Lads”, confirming that it does not work well as an illustration of the notion of “internal identity” that figures in Wittgenstein’s picture theory. He then proposes alternative ways of understanding the relationship of identity apparent in “The Golden Lads”.

This article argues the following points. The Hobbesian hypothesis, which we define as the claim that all people are better off under state authority than they would be outside of it, is an empirical claim about all stateless societies. It is an essential premise in most contractarian justifications of government sovereignty. Many small-scale societies are stateless. Anthropological evidence from them provides sufficient reason to doubt the truth of the hypothesis, if not to reject it entirely. Therefore, contractarian theory has not (...) done what it claims to do: it has not justified state sovereignty to each person subject to it by demonstrating that they benefit from that authority. To be justified in contractarian terms, states have to do something to improve the living standards of disadvantaged people under their rule. (shrink)

In this essay, I will outline a novel strategy for using constitutivist ideas from Kantian metaethics to critique social practices and institutions. In doing so, I do not mean to defend this model of critique as the only viable form of social and political critique, even within a Kantian framework – nor, indeed, as always the most appropriate. But I hope to show that it provides us with a form of critique that allows us to (i) develop a robust critique (...) of many social practices (ii) on both epistemic and practical grounds, while nonetheless (iii) beginning from a perspective that is, in some sense, internal – or better, immanent – to the practice in question. Thus, if we are looking for a form of social critique that is neither purely epistemic nor merely external – which, in other words, allows us to critique social practices on something like their own terms as practically irrational – this method should be attractive for philosophers with Kantian (or post-Kantian) sympathies. At the heart of this conception of critique lies in the idea that social practices may be thought of as attempts at (some form of) collective practical understanding. As I will explain more below, this way of thinking about the rationality of social practices may be seen as the product of applying a general (post-Kantian) model of rationality, which I have developed elsewhere, to the rationality of social collectives or practices. Consider the opening sentence of Tolkien’s The Hobbit: In a hole in the ground there lived a hobbit. By writing this sentence, Tolkien is making a fictional statement. There are two influential views of the nature of such statements. On the pretense view, fictional discourse amounts to pretend assertions. Since the author is not really asserting, but merely pretending, a statement such as Tolkien’s is devoid of illocutionary force altogether. By contrast, on the alternative make-believe view, fictional discourse prescribes that (...) the reader make-believe the content of the statement. In this paper, we argue that neither of these views is satisfactory. They both fail to distinguish the linguistic act of creating the fiction, for instance Tolkien writing the sentence above, from the linguistic act of reciting it, such as reading The Hobbit out loud for your children. As an alternative to these views, we propose that the essential feature of the author’s speech act is its productive character, that it makes some state of affairs obtain in the fiction. Tolkien’s statement, we argue, has the illocutionary force of a declaration. (shrink)

Much contemporary ontological inquiry takes place within the so-called ‘Quinean tradition’ but, given that some aspects of Quine’s project have been widely abandoned even by those who consider themselves Quineans, it is unclear what this amounts to. Fortunately recent work in metaontology has produced two relevant results here: a clearer characterisation of the metaontology uniting the aforementioned Quineans, most notably undertaken by Peter van Inwagen, and a raft of criticisms of that metaontology. In this paper I critique van Inwagen’s Quinean (...) metaontology, finding that certain challenges, supplemented by pressure to reflect more closely Quine’s work, should drive Quineans to adopt a stronger metaontology incorporating more of Quine’s radical views. I conclude that while van Inwagen’s Quineanism is problematic there are prospects for a viable, more wholeheartedly Quinean, metaontology. (shrink)
