Constructivism is frequently met with objections, criticism and often equated with nihilism or relativism. Sometimes even blamed for what some would randomly picture as unwanted side effects of radicalism or of a progressivist era: such misconceptions are not only due to an imprecise grasp of the premises shared by the constructivist family of systems. The structure of media, political systems, and economic models, still up today impel societal understandings of knowledge on neo-positivistic grounds. The first part of this essay outlines (...) such pressures while sketching how language and worldviews play critical roles in our knowledge construction. Focusing on recent mediatic events, this work advances displaying some essential limits regarding the construction of human knowledge. Though unavoidable, some of the distinguishing aspects regarding the nature of our narratives are then critically reviewed. Later, it is shown how a special kind of self-denial that certain sub-stories implicitly hold about their own narrative nature leaves us with clashing worldviews that eventually collide onto crisis. Finally, it’ll be argued that it’s precisely in this scenario where a constructivist depiction of social discourses may move us away from any adolescent intent of elucidating absolutes within mere heuristics, to the pragmatic need of arriving on satisfactory agreements between parties (DOI: 10.4236/ojpp.2022). Developments in the realm of formal sciences and math foundations during the twentieth century were marked by important methodological advances. Such new approaches partialy owe their appearance to the abandonment of the previous paradigm. To identify how this transition occured, in this essay we observe some aspects regarding the works of Gödel and Tarski, who, under a certain interpretations, restructure epistemological bases of math's formalisms. It'll be argued that the theoretical variabilities produced in abstract sciences upon weakening previous viewpoints forced (...) to abandon some of the components of hegemonic programs. (shrink)

Using semi-structured interviews and an analytic approach based on the grounded theory, this research took on constructing an understanding of the socio-emotional relevance, and the meaning that a group of elder participants of CIAM «Lucía Salas Romo» of Quilicura (Santiago, Chile) ascribe to social discourses regarding aging. Findings showed that, mobilizing the semantic dissonance between what society promotes and the effective opportunities it allows for the elderly, there are two crucial components of the social discourse: social injustice and fear of (...) dependency. This essay is a contribution to social ontology, drawing on the work of John Searle and of Hernando de Soto. At the center of the argument is the proposition advanced by de Soto in his Mystery of Capital to the effect that many of the entities which structure our contemporary social reality are entities which exist in virtue of the fact that there are (paper or digital) documents which support their existence. I here develop de Soto’s argument (...) further, focusing specifically on the ontological problems raised by a family of new types of social phenomena – exemplified most dramatically in the domain of finance for example in the form of what are called ‘structured investment vehicles’ – made possible as a result of the employment of computer technology in entity creation. I address also Searle’s most recent work on social ontology, and conclude with an appendix on the theory of documentality advanced by Maurizio Ferraris. (shrink)

This collection of essays assembles 21 philosophers, economists, and political scientists to help readers understand these exciting new theories.

Endocrinologists apply the idea of feedback loops to explain how hormones regulate certain bodily functions such as glucose metabolism. In particular, feedback loops focus on the maintenance of the plasma concentrations of glucose within a narrow range. Here, we put forward a different, organicist perspective on the endocrine regulation of glycaemia, by relying on the pivotal concept of closure of constraints. From this perspective, biological systems are understood as organized ones, which means that they are constituted of a set of (...) mutually dependent functional structures acting as constraints, whose maintenance depends on their reciprocal interactions. Closure refers specifically to the mutual dependence among functional constraints in an organism. We show that, when compared to feedback loops, organizational closure can generate much richer descriptions of the processes and constraints at play in the metabolism and regulation of glycaemia, by making explicit the different hierarchical orders involved. We expect that the proposed theoretical framework will open the way to the construction of original mathematical models, which would provide a better understanding of endocrine regulation from an organicist perspective. Development economist Hernando de Soto Polar has effectively advocated for property rights in the Third World, as his ideas have influenced the policies of the World Bank, International Monetary Fund and United Nations Development Programme. He envisions land titling as a means of lifting the poor out of poverty. I argue that his classical liberal interpretations of property and the good life are dangerously naive. One can see the dangers of de Soto’s imperialist and one-dimensional vision after considering (...) the cultural destruction that results from his brand of development in pastoral Kenya. Also, this article demands a reframing of standardized development approaches. It argues that the conventional view is prone to creating unstable, culturally hegemonic relationships between the government and entrepreneurs, and the people of the land. Asymmetrical lawfare is another nondemocratic feature of de Soto’s development. This article emphasizes that Kenyan pastoralists are not inherently vulnerable people but that they have been rendered vulnerable by society. Lastly, the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) is the basis for an alternative to de Soto’s development design. UNDRIP was a hard-fought legal protection for the world’s indigenous peoples that makes human dignity central to development. The Global North and Global South produce differing visions of development. This article points to Kenya as an example of how the Global North’s vision has fundamentally failed because it disenfranchises pastoralists—the very people policymakers and policy supporters claim it is intended to benefit. In this fragment of Opuscula Logica it is displayed an arithmetical treatment of the aristotelic syllogisms upon the previous interpretations of Christine Ladd-Franklin and Jean Piaget. For the first time, the whole deductive corpus for each syllogism is presented in the two innovative modalities first proposed by Hugo Padilla Chacón. A. The Projection method (all the possible expressions that can be deduced through the conditional from a logical expression) and B. The Retrojection method (all the possible valid antecedents or premises (...) conjunction for an expression proposed as a conclusion). Dōgen has been described as a social reformer based on his more “enlightened” attitude towards women, inviting women students into his sangha and advocating for more egalitarian views of gender (Eido Frances Carney, Receiving the Marrow: Teachings on Dōgen by Soto Zen Women Priests (2012), p. xi). In this chapter, I describe how contemporary Western Zen women and their allies have understood Dōgen’s texts as a tool of personal and social transformation through examination of work by Zen practitioners such (...) as Greenwood’s Bow First (2018), Carney’s Receiving the Marrow (2012), Schireson’s Zen Women (2009), and Glassman and Fields’ Instructions to the Cook (1996). In particular, I posit that Zen women have expressed the practical nature of Dōgen’s philosophy for contemporary non-monastics, showing how to de-center oneself through full participation in the activity of the world. This is in contrast to self-centered preoccupation with individual enlightenment or spiritual attainment. Paradoxically, it is the fact that women have often been confined to social roles that prevent their separation from the minutiae of everyday life that allows them to embody Dōgen’s dictum to “forget the self and be actualized by myriad things.”. Der vorliegende Aufsatz stellt das Erbe der Kantischen Theorie der Konstitutions- und Regulationsleistung der Erfahrung – die Analytik der Grundsätze – dar, das unserer Auffassung nach zur Begründung der rein spekulativen Philosophie Hegels führt. In diesem Zusammenhang werden einerseits die transzendental-konstitutiven Grundsätze – Axiome der Anschauung und Antizipationen der Wahrnehmung – und andererseits die transzendental-regulativen Grundsätze – Analogien der Erfahrung und Postulate des empirischen Denkens überhaupt – als grundlegendes Material der Exegese benutzt. Als Resultat der Deutung erscheint das Problem des (...) Doppel-Verhältnisses zwischen Erfahrung und Verstandesgrundsätzen. Ein solches Verhältnis entfaltet sich nicht nur als die erfahrungsmäßige Verwirklichung der Grundsätze, sondern auch als die grundsätzliche Ermöglichung der Erfahrung. Der notwendige Charakter der Wahrheit in transzendentaler Hinsicht begründet sich dabei durch die allgemeine Beziehung der transzendentalen Grundsätze des reinen Verstandes zur Gesamtheit der Erfahrung. Es wird die These vertreten, dass die Auffassung der Natur – d.h. die das Dasein der Erscheinungen in der Zeit ermöglichende Einheit – das Hauptvermächtnis Kants für den Deutschen Idealismus im Allgemeinen und für Hegels Philosophie im Besonderen darstellt. Abbreviating Kantian and Aristotelian outlooks' evolution, recomposition and differentiation, this brief sketches some effects and outlines such viewpoints have had upon behaviorism, finally delineating emerging approaches on to knowledge and reality.

This overview opens with a discussion of human holistic and analytic kinds of understanding, comparing eastern and western viewpoints, focusing on their impact for usability studies. Then, the understanding of human groups and the ability to reach group agreements are briefly addressed moving on to a comparative detail regarding their impact on commercial relations. Further on, this allows approaching systems’ design while focusing on culture, moving on to a cross-country research review. Finally, based on a folkloric sketch for Chile, a (...) comparison of some defining characteristics to build a chilean user persona is presented. The Dominican Pedro de Ledesma was educated at the University of Salamanca, where he became a professor. He is considered one of the last members of the famous School of Salamanca. This work studies his contribution to economic thought as regards tax doctrine. In Ledesma’s thought almost a century of moral reflections developed by the Salamanca professors (such as Vitoria, Azpilcueta, Soto…) crystallises, who were echoed by other Spanish authors. Ledesma recapitulates this reflection by providing his personal point of (...) view on the subject in a historical period in which the Spanish influence had reached global dimensions. (shrink)

Polish translation of "John Searle: From Speech Acts to Social Reality", -/- We provide an overview of Searle's contributions to speech act theory and the ontology of social reality, focusing on his theory of constitutive rules. In early versions of this theory, Searle proposed that all such rules have the form 'X counts as Y in context C' formula – as for example when Barack Obama (X) counts as President of the United States (Y) in the context of US political (...) affairs. Crucially, the X and the Y terms are here identical. A problem arises for this theory for cases involving 'free-standing Y terms', as for example in the case of money in a computerized bank account. Here there is no physical X to which a status function might be attached. We conclude by arguing that Searle's response to this problem creates difficulties for his naturalistic framework. (shrink)

In 2024, five centuries will have passed since the first course taught by Vitoria in Spain after his arrival in his native country. This monographic issue of Scio gathers the signatures of several experts on Vitoria's thought and the School of Salamanca.

This article exposes the concept of "second" Salamanca's School, i.e. the followers of Vitoria in a second generation that teach in Salamanca during the last years of the sixteenth century and the first years of the seventeenth. The author shows that there is an important continuity among the first and the second School and revisits the aspects which have been seen as negative for the School: the developing of metaphysics and the De Auxiliis controversy. The metaphysics as such cannot be (...) considered as a negative aspect and the De Auxiliis controversy has also some positive aspects, although it supposed a fatal tendency which determined the end of the School. Consider a game of blind chess between two chess masters that is recorded in some standard chess notation. The recording is a representation of the game. But what is the game itself? This question is, we believe, central to the entire domain of social ontology. We argue that the recorded game is a special sort of quasi-abstract pattern, something that is: (i) like abstract entities such as numbers or forms, in that it is both nonphysical and nonpsychological; but at the (...) same time, (ii) through its association with specific players and a specific occasion, tied to time and history. We discover other abstract patterns of this sort especially in the domains of law and commerce. This essay draws on the work in social ontology, we of Hernando de Soto and of John Searle to develop an ontology of the social world based on an analysis of the peculiar interdependence between quasi-abstract patterns and their representations in documents of different sorts. Many researchers consider cancer to have molecular causes, namely mutated genes that result in abnormal cell proliferation (e.g. Weinberg 1998); yet for others, the causes of cancer are to be found not at the molecular level but at the tissue level and carcinogenesis would consist in a disrupted tissue organization with downward causation effects on cells and cellular components (e.g. Sonnenschein & Soto 2008). In this contribution, I ponder how to make sense of such downward causation claims. Adopting a (...) manipulationist account of causation (Woodward 2003), I propose a formal definition of downward causation, and discuss further requirements (in light of Baumgartner 2009). I then show that such an account cannot be mobilized in support of non-reductive physicalism (contrary to Raatikainen 2010). However, I also argue that such downward causation claims might point at particularly interesting dynamic properties of causal relationships that might prove salient in characterizing causal relationships (following Woodward 2010). The parceling of land into real estate is more than a simple geometrical affair. Real estate is a historical product of interaction between human beings, political, legal and economic institutions, and the physical environment. And while many authors, from Jeremy Bentham to Hernando de Soto, have drawn attention to the ontological (metaphysical) aspect of property in general, no comprehensive analysis of landed property has been attempted. The paper presents such an analysis and shows how landed property differs from other (...) types of property in a way which implies a special role for political and economic philosophy of property rights in land. Aristotle divided arguments that persuade into the rhetorical (which happen to persuade), the dialectical (which are strong so ought to persuade to some degree) and the demonstrative (which must persuade if rightly understood). Dialectical arguments were long neglected, partly because Aristotle did not write a book about them. But in the sixteenth and seventeenth century late scholastic authors such as Medina, Cano and Soto developed a sound theory of probable arguments, those that have logical and not merely psychological force (...) but fall short of demonstration. Informed by late medieval treatments of the law of evidence and problems in moral theology and aleatory contracts, they considered the reasons that could render legal, moral, theological, commercial and historical arguments strong though not demonstrative. At the same time, demonstrative arguments became better understood as Galileo and other figures of the Scientific Revolution used mathematical proof in arguments in physics. Galileo moved both dialectical and demonstrative arguments into mathematical territory. (shrink)

Pedro de Ledesma is one of the Dominican theologians of the School of Salamanca involved in the De Auxiliis controversy, i.e., the disputes around a famous book by Luis de Molina on the relation between divine foreknowledge and providence and our free will. Studying an unpublished manuscript by Ledesma and his 1611 book on this subject, the article shows that he opposed Molina with a Thomistic position that we call deflationary. According to this interpretation, God, in moving the created will (...) to do good actions, does not bring about an entity distinct from volition itself. Contrary to other Thomists, he does not think that the immediate effect of the divine motion of the will is an intermediary entity used by God to produce, with the will, the created free act. Ledesma defends his thesis by using some elements of Aristotelian-Thomistic metaphysics, in particular, a minimalist interpretation of the relation between action and passion already present in Domingo de Soto and the specific causality of immanent acts. In The Case for Animal Rights, Tom Regan argues that, in addition to the negative duty not to harm nonhuman animals, moral agents have a positive duty to assist nonhuman animals who are victims of injustice. This claim is not unproblematic because, in many cases, assisting a victim of injustice requires that we harm some other nonhuman animal(s). For instance, in order to feed victims of injustice who are obligate carnivores, we must kill some other animal(s). It seems, then, that (...) sometimes the duty to assist nonhuman animals who are victims of injustice conflicts with the prima facie duty not to harm nonhuman animals. In defense of Regan’s theory against this apparent inconsistency, I introduce an additional principle, the “guardianship principle,” which can be used to illustrate how we can be justified, under certain conditions, in overriding our prima facie duty not to harm nonhuman animals in order to fulfill our duty to assist nonhuman animals who are victims of injustice. The Compendium of the Life and Genealogy of Cometan is a compilation of years of family history research conducted by Cometan on his maternal and paternal ancestry. The book is formatted as an index of individual family members with key biographical details, photographs and extracts from various sources collected over the years. The book has over 300 pages of life stories of members of the Cottam, Moon, Prescott, Taylor and Warbrick families. The life stories include religious conversions, tragic deaths, details (...) of married life, the births of children, burials, poetry, interviews, extracts of newspaper articles, paintings, wartime stories, emigration, illustrations of key events, religious tracts, details of people’s careers, pictures of gravestones and letters. This book embodies an ethnography of the lives of several families in Lancashire using a methodology of family history. (shrink)

In a recent paper, Tristan Haze offers two examples that, he claims, are counterexamples to Nozick's Theory of Knowledge. Haze claims his examples work against Nozick's theory understood as relativized to belief forming methods M. We believe that they fail to be counterexamples to Nozick's theory. Since he aims the examples at tracking theories generally, we will also explain why they are not counterexamples to Dretske's Conclusive Reasons Theory of Knowledge.

Respect for autonomy is a central moral principle in bioethics. The concept of autonomy can be construed in various ways. Under the non-ideal conceptualization proposed by Beauchamp and Childress, everyday choices of generally competent persons are autonomous to the extent that they are intentional and are made with understanding and without controlling influences. It is sometimes suggested that authenticity is important to personal autonomy, so that inauthenticity prevents otherwise autonomous persons from making autonomous decisions. Building from Beauchamp and Childress’s theory, (...) this article develops a non-ideal authenticity-based conceptualization of personal autonomy. Factors that indicate inauthentic decision-making are explicated, and the full concept is defended from three expected objections. The theory is then tested on a paradigm case which has concerned theorists and practitioners for some time, namely the possible inauthenticity of anorexia nervosa patients’ decision-making. It is concluded that the theory seems to be fruitful in analyses of the degree of autonomy of patients’ decision-making, and that it succeeds in providing reliable action-guidance in practical contexts. This paper explores the idea that human consciousness perceives itself as the "main character" due to the structure of the multiverse. If every decision branches into a new reality, then an individual’s memory and experience are biased toward the timeline where they continue to exist. This could lead to a form of subjective immortality, where consciousness shifts to realities where survival and satisfaction persist. The implications of this perspective are examined through the lenses of quantum mechanics, philosophy, and cognitive psychology.

The scarcity of livers available for transplants forces tough choices upon us. Lives for those not receiving a transplant are likely to be short. One large group of potential recipients needs a new liver because of alcohol consumption, while others suffer for reasons unrelated to their own behaviour. Should the former group receive lower priority when scarce livers are allocated? This discussion connects with one of the most pertinent issues in contemporary political philosophy; the role of personal responsibility in distributive (...) justice. One prominent theory of distributive justice, luck egalitarianism, assesses distributions as just if, and only if, people's relative positions reflect their exercises of responsibility. There is a principled luck egalitarian case for giving lower priority to those who are responsible for their need. Compared to the existing literature favouring such differentiation, luck egalitarianism provides a clearer rationale of fairness, acknowledges the need for individual assessments of responsibility, and requires initiatives both inside and outside of the allocation systems aimed at mitigating the influence from social circumstances. Furthermore, the concrete policies that luck egalitarians can recommend are neither too harsh on those who make imprudent choices nor excessively intrusive towards those whose exercises of responsibility are assessed. According to telling based views of testimony (TBVs), B has reason to believe that p when A tells B that p because A thereby takes public responsibility for B's subsequent belief that p. Andrew Peet presents a new argument against TBVs. He argues that insofar as A uses context-sensitive expressions to express p, A doesn't take public responsibility for B's belief that p. Since context-sensitivity is widespread, the kind of reason TBVs say we have to believe what we're told, is (...) not widespread. Peet doesn't identify any problem with his own argument though he does attempt to limit its sceptical potential by identifying special contexts in which TBVs stand a chance of success. A more general defence of TBVs can be provided by showing Peet's argument to be unsound. I argue that Peet's argument is unsound because it requires us to wrongly suppose that speakers do far less labour than their audiences in context-sensitive linguistic communication. I aim to show why—in the context of the epistemology of testimony and the philosophy of language—it's important to recognize the labour that speakers can do, and so can can be held responsible for not doing, in episodes of context-sensitive linguistic communication. Drawing from Dancy's notion of ethical particularism, we explore why foreign policy doctrines are counterproductive in terms of crafting sound responses to complex, fluid and dynamic events. However, despite their horrible track record, foreign policy dogmas remain ubiquitous--a phenomenon which is largely a function of how useful they are in the political sphere.

Until recently one begins to speak of the “experimental philosophy” in the thought of Nietzsche. This novel way of approaching the philosopher of Röcken is due specifically to the reflections of Andreas Urs Sommer, an eminent interpreter of Nietzsche. Sommer explains the “experimental philosophy” supported by paragraph 125 of The Gay Science and goes hand in hand with an important figure in that paragraph: the madman. This article aims to explain what “experimental philosophy” is and then describe that literary artifice, (...) besides being found in paragraph 125, can be found in other texts by Nietzsche. That is to say, we will stop to analyze some texts of Thus spoke Zarathustra, fundamentally in those that are the question of the solitude. Is it possible to conclude that "experimental philosophy" can be framed in the theme of Nietzsche's solitude? The use of “experimental philosophy” can show us, as far as possible, a novel way of approaching the thoughts of the German philosopher and away from the conventional interpretation that has marked the twentieth century so profoundly. As a non-cognitivist analysis of moral language, Charles Stevenson's sophisticated emotivism is widely regarded by moral philosophers as a substantial improvement over its historical antecedent, radical emotivism. None the less, it has come in for its share of criticism. In this essay, Leslie Allan responds to the key philosophical objections to Stevenson's thesis, arguing that the criticisms levelled against his meta-ethical theory rest largely on a too hasty reading of his works.

The author challenges both the eliminative idealist's contention that physical objects do not exist and the phenomenalist idealist's view that statements about physical objects are translatable into statements about private mental experiences. Firstly, he details how phenomenalist translations are parasitic on the realist assumption that physical objects exist independently of experience. Secondly, the author confronts eliminative idealism head on by exposing its heuristic sterility in contrast with realism's predictive success.

Rodion Raskolnikov, the central figure in Dostoyevsky’s Crime and Punishment, is one of the best-known characters in the world of the novel but one who continues to pose major interpretive problems. Why exactly does he murder the old pawnbroker and her sister? Why, throughout the novel, does he continue to believe that he has committed no crime? And why, despite this belief, does he suffer a form of psychological breakdown and eventually give himself up to the police? This article, which (...) traces Raskolnikov’s literary ancestry to Les Liaisons dangereuses and Le Père Goriot, argues that Raskolnikov, a prototype of the modern “virtuous assassin” described by Albert Camus in L’Homme révolté, commits murder to implement a “magnificent” idea that will establish his worth as a human being. His ultimate collapse results not, as sometimes suggested, from guilt or remorse, or a belief that he has deluded himself about his motives, but from the state of irremediable solitude into which his act plunges him. -/- _PLEASE NOTE:_ This journal is moving from Oxford to Johns Hopkins. Strange Tools foregoes stolid conventions of professional philosophy, laudably broadening the book’s appeal to accommodate a popular audience. However, Noë’s manner of glossing over complex issues about art does not necessarily render these topics intelligible to philosophical novices. Instead, his oversimplifications will tend to confirm naïve notions that art is straightforward – a common misconception that a foray into philosophy of art ought to dispel, not corroborate.

A critical review of Michael Ridge's book Impassioned Belief.

Several prominent theorists have recently advocated reconceptualizing rape as “nonconsensual sex,” omitting the traditional “force” element of the crime. I argue that such a conceptualization fails to capture what is distinctively problematic about rape for women and why rape is pivotal in supporting women’s gender oppression. I argue that conceptualizing rape as coerced sex can replace both the force and nonconsent elements and thereby remedies some of the main difficulties with extant definitions, especially in recognizing “acquaintance” rape as such. It is a widespread opinion that toleration, as a political practice, has merely instrumental value. The aim of this paper is to defend, on the contrary, that toleration has political value in itself. In more specific terms, I will claim that it is valuable in itself in virtue of its intrinsic relationship with democracy. Toleration is a constituent of democracy inasmuch as it is necessary for the existence of a democratic administration of political power. I will show that that relation (...) of constitution holds because toleration, through the protection of spaces of contestation to the political power, contributes to solving democracy’s inner tension resulting from its practical implementation. -/- Es una opinión extendida que la tolerancia, en cuanto práctica política, tiene valor meramente instrumental. El objetivo de este artículo es defender, por el contrario, que ella tiene valor político en sí. Específicamente, defenderé que es valiosa en sí misma a causa de su relación intrínseca con la democracia. La tolerancia es un constituyente de la democracia en cuanto es necesaria para que pueda existir una administración democrática del poder político. Mostraré que esa relación de constitución existe porque la tolerancia, mediante la protección de espacios de contestación al poder político, contribuye a la resolución de una tensión interna de la democracia en su implementación práctica.
