Drawing on recent developments in dialogic approaches to learning and teaching, I examine the roots of dialogic meaning-making as a concept in classroom practices. Developments in the field of dialogic pedagogy are reviewed and the case for dialogic engagement as an approach to classroom interaction is considered. The implications of dialogic classroom approaches are discussed in the context of educational research and classroom practice. Dialogic practice is contrasted with monologic practices as evidenced by the resilient of the IRF as the (...) default discourse structure in classrooms. Recent evidence suggests the IRF is resistant to attempts to introduce interactive approaches to whole class teaching. Discussion of dialogic practice as a vehicle for increasing pupil engagement at a deep level and raising the quality of classroom interaction is illustrated through a consideration of Philosophy for Children, which is identified as a dialogic approach to classroom practice which has transformative potential for children's learning. Philosophy for Children offers an approach to pedagogy which enables teachers to value pupil voice and promote reflective learning. As such it has much to offer the current debate on dialogic teaching and learning. Research evidence suggests it will promote improved pupil outcomes on a range of assessments. (shrink)

Relationships with international students can be beneficial to higher education in terms of financial and human resources. For this reason, establishing and maintaining such relationships are usually pre-eminent concerns. In this study, we extended the application of the disconfirmation expectation model by incorporating components from subjective task value to predict the loyalty of international students toward their host countries. On a sample of 410 Vietnamese students enrolled in establishments of higher education in over 15 countries across the globe, we employed (...) structural equation model to construct the conceptual model. Our empirical findings revealed that while the roles of satisfaction and disconfirmation are still important as direct and indirect antecedents of international student loyalty, its most powerful predictors are the three components of subjective task value: attainment, utility and intrinsic. These insights result in a number of implications for actors on the higher ducation scene, such as heads of institutions and policy makers. (shrink)

The Philosophy for Children in Schools Project is an ongoing research project to explore the impact of philosophy for children (P4C) on classroom practice. this paper responds on the responses of head teachers, teachers and local educational authority (LA) officers in South Wales, UK, to the initial training programme in P4C carried out by the University School of Education. Achieving change in schools through the embedding of new practices is an important challenge for head teacher.s Interviews and qualitative questionnaires were (...) used to explore perceptions of and attitudes towards the dialogic practice of P4C and the related challenged for school leaders. The results provide an insight into how head teachers planned to embed the new practice of P4C in their schools. Results from the interviews and questionnaires have been subject to iterative analysis and categories derived under which to discuss the findings. There are many similarities in the the ways in which different head teachers go about planning change in their schools as well as differences. The results provide insight into the role of initial continuing professional development (CPD) in school development and the processes by which individual heads plan to embed change in practice across the whole school. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

Clairaudient ability has a positive connotation upon the ability to hear voices, whereas the diagnosis of Schizophrenia is most commonly treated with pharmaceutical drugs to reduce or eliminate symptoms. This paper involves information about Schizophrenia, how it is perceived and treated. It also discusses various views of clairaudience, and how it is effective and manageable. This is a critical examination of Zizek's concept of ideology in his work on the Sublime of Ideology. His account on this connotes that people are basing only in the conscious state without considering the unconscious "I." This framework in psychology has led Zizek to relate it in the process of economics which is greatly manifested in the contradictory poles of the oppressor and the oppressed and its relationship to the process of commodities. Looking into this orientation, this leaves the (...) author to incorporate the ideological character of Zizek through the lens of Anti-Terrorism Law which is not seen in the naked eye. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

Pauli, ci introducono con tale concettualizzazione in un mondo, nel quale ciò che è interno e ciò che è esterno a noi non è così nettamente definito, mondo nel quale le “coincidenze” non sono più tali, ma rivestono un significato ed un’importanza per la nostra psiche, per (...) la nostra vita. Se un bambino mentre gioca sulla riva di un fiume, vi cade e rischia di venire trascinato dalla corrente, e nello stesso momento sua madre dall’altra parte della città è preda di un’angoscia che l’attanaglia e grida: “il mio bambino!”, siamo in presenza di un evento sincronistico, nel senso della definizione di Jung sopracitata. Noi crediamo, sulla scia di Jung e Pauli che la sincronicità possa essere un possibile principio esplicativo della realtà da affiancare alla causalità, per Pauli vi sono nella realtà sia elementi razionali sia irrazionali ed è quindi impossibile per la fisica dire l’ultima parola sulla realtà, visto che quest’ultima è così complessa. L’attuazione dei fenomeni sincronistici è fuori dalla portata di qualsiasi tipo di previsione razionale, l’evento sincronistico non è riproducibile ed è in qualche modo l’emblema dell’aspetto non razionale della realtà, e come detto, insieme alla più consueta logica causalistica, (ad esempio, una mela su un albero quando è matura può anche cadere), danno una visione più completa della realtà. E questa visione più completa era l’intento di Jung nell’approcciare questi fenomeni: “Cercare di aprire una via verso “l’animazione della materia” a partire dall’assunzione che “ciò che esiste sia dotato di senso”…” ( Pauli e Jung 1992, lettera n.59 di Jung, p. 100). The article argues for the variant ‘tractabimus’ in Book 8, ch. 1 of Augustine’s De Trinitate as opposed to the reading ‘tractavimus’ adopted in the Corpus Christianorum edition, and explains the implications of this variant for the understanding of the overall structure of the work.

In his last book, Le complexe des trois singes. Essai sur l’animalité humaine (2017), the French philosopher Étienne Bimbenet accuses “sensocentric” (« pathocentristes ») animal ethics of committing a performative contradiction: according to Bimbenet, these theories of animal rights — among which he focuses on the case of Zoopolis (2011) by Sue Donaldson and Will Kymlicka — would undermine themselves by means of declaring reason a “non-essential” feature of human beings, while at the same time those theories themselves can only (...) be understood as a highly rational human endeavour. As we will try to point out, the alleged performative contradiction does not actually take place. First of all, Donaldson and Kymlicka only describe reason as “non essential” when it comes to describing moral patients, not moral agents, and particularly not moral theoreticians. In the second place, Zoopolis presents itself explicitly as an effort in “articulating moral reasons” — not as a renouncement of reason as such. (shrink)

Misconceived Consent: Miguel has stage IV lung cancer. He has nearly exhausted his treatment options when his oncologist, Dr. Llewellyn, tells him about an experimental vaccine trial that may boost his immune response to kill cancer cells. Dr. Llewellyn provides Miguel with a consent form that explains why the study is being conducted, what procedures he will undergo, what the various risks and benefits are, alternative sources of treatment, and so forth. She even sits down with him, carefully (...) talks through the most important points, and gives him time to ask questions. Though it is a Phase 1 study and the chance that he will benefit is very low, Miguel happily agrees to take part. A week later, after the first experimental injection, she asks him if he is worried about the risks. “Risks?” he asks. “I’m sure this is safe—you’re a doctor, after all!”. (shrink)

Microaggressions are seemingly negligible slights that can cause significant damage to frequently targeted members of marginalized groups. Recently, Scott O. Lilienfeld challenged a key platform of the microaggression research project: what’s aggressive about microaggressions? To answer this challenge, Derald Wing Sue, the psychologist who has spearheaded the research on microaggressions, needs to theorize a spectrum of aggression that ranges from intentional assault to unintentional microaggressions. I suggest turning to Bonnie Mann’s “Creepers, Flirts, Heroes and Allies” for inspiration. Building from Mann’s (...) richer theoretical framework will allow Sue to answer Lilienfeld’s objection and defend the legitimacy of the concept, ‘microaggression’. (shrink)

My main aim is to clarify what we mean by ‘look’ sentences such as (1) below – ones that we use to talk about visual experience: -/- (1) The ball looked red to Sue -/- This is to help better understand a part of natural language that has so far resisted treatment, and also to help better understand the nature of visual experience. -/- By appealing to general linguistic principles I argue for the following account. First, we use (1) to (...) talk about an event. Second, we use the verb ‘look’ to specify the kind of event about which we are talking – it is a looking event. Third, we use the subject ‘the ball’ to specify a stimulus of the event – something that looks some way in the event. Fourth, we use the adjunct ‘to Sue’ to specify an experiencer of the event – someone to whom things look some way in the event. Finally, we use the complement ‘red’ to specify a way of the event – a way in which the event occurs (I take ways of occurring to be properties of events). Which way do we use ‘red’ in (1) to specify? I argue: the maximally specific way w such that the following is generically true: looking events whose stimulus is red occur in way w (it is important that this is understood generically: this is what does much of the work in explaining our use of (1) and other ‘look’ sentences). Putting this together, what we mean by (1) is: there was a looking event whose stimulus was the ball, whose experiencer was Sue, and which occurred in the maximally specific way that looking events occur when their stimulus is red. -/- This account of how we use ‘red’ in (1) is one of the most interesting aspects of my thesis. It extends to an account of how we use ‘proud’ in ‘John walks proud’, ‘as if he is American’ in ‘John talks as if he is American’, ‘like a duck’ in ‘John sounds like a duck’, and so on. In each case we use the expression in question to specify a way: the maximally specific way proud people walk, the maximally specific way American people talk, and so on. So the study of ‘look’ sentences has much to tell us about the functioning of many other English language constructions, and suggests that ways have a significant role to play in the semantics of natural language – a fact that has not yet been sufficiently recognised by linguists or philosophers of language. -/- My thesis also has implications for the philosophy of perception. One of the central questions about perception is: What is the nature of visual experience? What is it, for example, for a ball to look red to Sue? My thesis offers an answer: What it is for the ball to look red to Sue is for whatever it is that we mean by ‘The ball looks red to Sue’ to be the case, and what we mean by ‘The ball looks red to Sue’ is that there is a looking event whose stimulus is the ball, whose experiencer is Sue, and which is occurring in a certain way. It thus delivers an adverbial account of visual experience, one that has the resources to better deal with problems that are traditionally thought to be decisive against adverbial accounts. (shrink)

In the 1980s and 1990s, a series of attempts were made to put into U.S. law a civil rights ordinance that would make it possible to sue the makers and distributors of pornography for doing so (under certain conditions). One defence of such legislation has come to be called "the free speech argument against pornography." Philosophers Rae Langton, Jennifer Hornsby and Caroline West have supposed that this defence of the legislation can function as a liberal defence of the legislation: in (...) particular, a defence of the legislation based on the value of women's liberty. This would be somewhat unexpected given MacKinnon's own antipathy toward liberalism. In this paper, I argue that the free speech argument against pornography cannot be used as a liberal defence of the ordinances. The legislation is, to some extent, self-defeating insofar as it understood in terms acceptable to a fairly standard kind of liberal. This becomes apparent when we consider the value pornography can have for women, which we can see if we consider what female makers, distributors and consumers of pornography have to say about why they make, distribute and consume it. Nāgārjuna, vissuto in India attorno al primo secolo dopo Cristo, è certamente una delle figure più importanti del pensiero buddhista. In una delle sue opere principali, le ‘Strofe sulla via di mezzo ’, egli elabora in modo compiuto la nozione di ‘vuoto’, che diverrà uno dei concetti fondamentali di tutto il buddhismo successivo, dando vita alla ‘scuola del vuoto’, la quale avrà grande fortuna in Tibet, Cina e Giappone. Per vuoto non si intende certo il nulla, bensì l’inconsistenza rivelata dal (...) reale quando considerato alla luce della critica di Nāgārjuna. Tale critica si esplica innanzitutto sul piano del linguaggio, e possiede quindi una evidente dimensione pragmatica. Il ‘vuoto’ nāgārjuniano sarà allora non solo una non-ontologia, ma anche una non-predicazione, che ammetterà però il giudizio, e quindi la determinazione, solo ed esclusivamente dal punto di vista della prassi del dire. Al linguaggio non è richiesto di parlare dell’essere, bensì di testimoniare, attraverso la propria inconsistenza, dell’assoluta coincidenza di essere e non-essere. (shrink)

The concept of vulnerability has been renewed in meaning and importance over recent decades. Scholars such as Judith Butler, Martha Fineman and Pamela Sue Anderson have endeavored to redeem vulnerability from its traditional signification as a negative individual condition, and to reveal the positive meaning of vulnerability as a transformative call for solidarity, equality and love. In this paper we examine the newly constructed positive understanding of vulnerability, and argue that the current way of pursuing this positive understanding affirms a (...) merely functional positivity. In the recent accounts, vulnerability is still a status to avoid, yet functions positively as a corrective force to the environment that produces vulnerability. We will try to find an essential way of designating the positivity of vulnerability by revisiting the philosophical discussion on vulnerability in Emmanuel Levinas. We will argue that Levinas’s notion of vulnerability is positive in a sense which goes beyond the purely functional; it is seen as essential for his definition of humanity. Yet compared to the contemporary discussion, Levinas’s notion of vulnerability lacks a direct social political meaning. We will tentatively explore how the essential positivity drawn from Levinas can provide a new way to construct the political significance of vulnerability. (shrink)

Genocide remembrance is a complex epistemological/ethical achievement, whereby survivors and descendants give meaning to the past in the quest for both personal-historical and social-historical truth. This paper offers an argument of epistemic injustice specifically as it occurs in relation to practices of (individual and collective) genocide remembrance. In particular, I argue that under conditions of genocide denialism, understood as collective genocide misremembrance and memory distortion, genocide survivors and descendants are confronted with hermeneutical oppression. Drawing on Sue Campbell’s relational, reconstructive account (...) of remembering, I argue that genocide denialism involves disrespectful challenges to memory, which systematically misrecognize rememberers. Adopting the case of Turkey’s denialism of the Armenian genocide, I discuss two interrelated mechanisms through which this can happen: i) through the systematic portrayal of survivors and descendants as vicious rememberers, and ii) through distortions of the very concept of ‘genocide’. Based on this, I show how hermeneutical and testimonial injustice are crucially interrelated when it comes to “contested” memories of historical injustice and the biographical testimony it gives rise to. This article investigates the original meaning of dependent arising in the Buddha’s teaching, by focussing on the imasmi" sati formula. Modern scholars such as the Rhys Davidses, K.N. Jayatilleke and Paul Williams have interpreted it as a princi- ple of causation, comparable to a scientific conception of causation. I argue instead that this formula implies that the Buddha held that causation is nothing more than the correlation of causes and effects, and that it commits the Buddha to a Humean regularity (...) thesis about causation. I draw a distinction between the Buddhist and scientific concepts of causation, and then summarise an alternative approach made by more recent scholars such as Sue Hamilton, Noa Ronkin and Eviatar Shulman, who present dependent arising in terms of conditionality in the causal structure of subjective experience. I conclude by presenting the argument that the imasmi" sati formula does not express a principle of causation but is rather a formula for the method of discovering and presenting causation as conditionality in experience. : How much power does emotional dismissal have over the oppressed's ability to trust outlaw emotions, or to stand for such emotions before others? I discuss Sue Campbell 's view of the interpretation of emotion in light of the political significance of emotional dismissal. In response, I suggest that feminist conventions of interpretation developed within dialogical communities are best suited to providing resources for expressing, interpreting, defining, and reflecting on our emotions.

A set of notes on consciousness and creativity by Federico Faggin are here collected. Federico Faggin, Italian-American physicist and 2009 U.S. National Medal of Technology and Innovation, is best known for designing and creating the first commercial microprocessor, the Intel 4004. Faggin's curiosity about consciousness started in the late eighties when he asked himself if it was possible to develop a conscious computer. Faggin reveals here the main aspects and beliefs of his model about consciousness, fruit of his creative experiences (...) and reflections. These notes (in Italian) at times integrated, partially rewritten or kept unaltered by Federico Faggin himself, are meant to be an invitation to new generations of scholars and researchers to deepen on the topic of human creativity and consciousness. Scopo del presente articolo è di mostrare la genesi e l’evoluzione di tale concetto, a partire dalle sue prime occorrenze in Umano, troppo umano I fino al suo compiuto sviluppo negli scritti del 1885-87. Tale studio permetterà di evidenziare il particolare valore (...) che Nietzsche attribuisce ai “buoni europei”, in quanto promotori dello sviluppo spirituale conseguente alla compiuta liberazione della morale cristiana. ENG: The “good European” is a rich and important topic in Nietzsche. It is first related to Nietzsche’s early reflections on European culture, and during the 1880’s it gains philosophical value, being strictly connected with the purposes of Nietzsche’s mature thought. The aim of this paper is to track the genesis and development of the notion of “good European”, from Human, all too Human I to Nietzsche’s writings from the years 1885-1887. That investigation shall particularly show the meaning and value that Nietzsche attributes to the good Europeans; as for him, they are in fact the leaders of the spiritual development that follows the overcoming of Christian morality. After walking through these shortcomings, he provides 18 suggestions to help improve the reliability and utility of the MRP. In "Microaggressions and 'Evidence': Experimental or Experiential Reality?" Derald Wing Sue responds. This chapter provides background on the origin of the MRP, and referees the dispute between Lillenfeld and Sue about its contemporary status.

La selezione dei testi che verranno menzionati in questa bibliografia tematica tenta, per quanto possibile, di rispettare lo sviluppo cronologico dell’epistemologia delle virtù. Tuttavia, il criterio che ho scelto di adottare per la classificazione di queste opere è primariamente tematico: dopo una prima sezione dedicata alle origini dell’epistemologia delle virtù, verranno indicati alcuni testi che (...) rappresentano gli sviluppi teorici fondamentali—o, a mio avviso, meglio riusciti—di questa corrente, alla luce delle critiche che le sono state via via rivolte con il passare del tempo. Infine, nella terza e ultima sezione saranno proposti alcuni lavori che indicano i nuovi orizzonti della ricerca nell’epistemologia delle virtù e le sue possibili implicazioni in altri ambiti filosofici. Come si può facilmente immaginare, la selezione dei testi è frutto di una scelta, motivata ma comunque opinabile, ed è dettata da limiti di spazio. Pertanto, questa bibliografia tematica non può avere né l’ambizione di mettere tutti d’accordo, né la pretesa di essere completa. Il miglior auspicio è, piuttosto, che queste brevi considerazioni possano suscitare l’interesse del lettore e invitarlo ad approfondire lo studio dell’epistemologia delle virtù nelle maniere che questi riterrà più opportuno. This has generated diverse theories on the nature of intelligence and its genetic and environmental bases. Many scientific and philosophical questions thus remain unaddressed: is it possible to characterize intelligence in scientific terms? What do IQ tests measure? How is intelligence influenced by genetics, epigenetics, and the environment? What are the ethical and social implications of the research (...) on this topic? This book aims to provide the readers with the conceptual resources to critically analyze scientific findings and orientate themselves in this multi-faceted debate across biology, psychology, neuroscience, philosophy, and anthropology. -/- ITA: Ognuno di noi ha una propria idea di cosa significhi essere intelligenti, tanto che anche gli scienziati esperti in materia hanno opinioni differenti al riguardo. Ciò ha contribuito a generare teorie contrastanti sulla natura dell’intelligenza e su quali siano le sue basi genetiche e ambientali. Non è un caso, dunque, che diverse domande scientifiche e filosofiche restino ancora aperte: è possibile caratterizzare scientificamente l’intelligenza? Cosa misurano i test del QI? In che modo genetica, epigenetica e ambiente influenzano l’intelligenza? Quali sono le implicazioni etiche e sociali della ricerca sull’argomento? Cosmovisione è un termine che dovrebbe significare un insieme di fondamenti da cui emerge una comprensione sistemica dell'Universo, delle sue componenti come la vita, il mondo in cui viviamo, la natura, il fenomeno umano e le sue relazioni. Si tratta, quindi, di un campo della filosofia analitica alimentato dalle scienze, il cui obiettivo è questa conoscenza aggregata ed epistemologicamente sostenibile su tutto ciò che siamo e conteniamo, che ci circonda e che in qualche modo si relaziona con noi. È qualcosa (...) di antico quanto il pensiero umano e, oltre a utilizzare elementi di cosmologia scientifica, racchiude tutto ciò che nella filosofia e nella scienza si riferisce all'universo e alla vita. Una cosmovisione non è un insieme d’idee, ipotesi e presupposti, ma un sistema basato su osservazione, analisi, prove e dimostrazione. Nessuna cosmovisione intende definire, stabilire, proporre, ma solo comprendere, analizzare e interpretare. Ognuno di noi costruisce e porta avanti la propria cosmovisione per tutta la vita, senza stabilire forme, come sfondo per il proprio pensiero e comportamento. Linguisticamente il termine “cosmovisione” deriverebbe dal tedesco, equivalente al concetto di“Weltanschauung”, utilizzato da diversi filosofi. Tuttavia, questa relazione linguistica non è applicabile perché contraddice ciò che proponiamo come cosmovisione. Questa parola tedesca rimanda a una visione prelogica o proto-sperimentale della realtà, con un contesto intuitivo e lontana da una conoscenza critica che non esisteva ancora al momento della sua formulazione. Senza dubbio, le cosmovisioni, nel senso in cui le intendiamo, ospitano e utilizzano questi elementi proto-sperimentali o prelogici che includono la storia, l’inconscio collettivo e tutti gli archetipi che portiamo con noi. Tuttavia, nel concetto che qui applichiamo, la cosmovisione va ben oltre questo contenuto, dapprima sottoponendolo costantemente al pensiero critico attuale e, infine, facendo dell'esperienza analitica (e non del pensiero o dell'intuizione stessa) il suo universo reale. In questo lavoro, cerchiamo di delineare una cosmovisione basata sulle realtà che la scienza offre oggi. Non proponiamo, in nessun momento, di fare scienza; o teorizzare la filosofia, ma cercheremo sempre di essere supportati da loro o, almeno, protetti da loro dalle distorsioni cognitive che abitualmente ci portiamo dietro. I introduce the seven papers in this special issue, by Andy Clark, Je´roˆme Dokic, Richard Menary, Jenann Ismael, Sue Campbell, Doris McIlwain, and Mark Rowlands. This paper explains the motivation for an alliance between the sciences of memory and the extended mind hypothesis. It examines in turn the role of worldly, social, and internalized forms of scaffolding to memory and cognition, and also highlights themes relating to affect, agency, and individual differences.

I argue that nonresident aliens, in places that are clearly not U.S. territory, should benefit from constitutional rights. This is a matter of mutuality of obligation. The U.S. claims the authority to hold all people accountable for respecting certain laws, such as the law of war as defined in the Military Commissions Act. Accordingly, it must accord them basic legal rights in return. At the same time, I argue, contra Benjamin Wittes, that this would not lead to absurdly opening the (...) courthouse doors, nor does it require abandoning principle to keep the flood of litigation reasonably contained. Not all harms inflicted by the U.S. government can give rise to a lawsuit, and that the distinction between those who should have a right to sue and those who should not can be drawn in a principled way. Tipicamente, il partito viene presentato come un dinosauro della democrazia ormai incapace di assolvere alle sue funzioni tipiche o come piovra infiltratasi illegittimamente in ogni ambito della vita civile. La tesi di quest’articolo è che, al contrario, i partiti tedeschi abbiano dimostrato una forte reattività alle mutate circostanze nazionali e internazionali e che siano riusciti a mantenere il loro tipico ruolo funzionale di mediatore, (...) rappresentante ed amministratore degli interessi degli elettori. In order to handle presuppositions in the scope of attitude verbs, the binding theory allows presuppositions triggered in a subject's beliefs to be bound at the matrix level; and it allows presuppositions triggered in non-doxastic attitudes to be bound in the subject's beliefs (Geurts, 1999; Maier, 2015). However, we argue that this leads to serious overgeneration, for example it predicts that the unacceptable `Sue will come to the party, but Bill is sure that she won't and that only Sue will (...) come to the party' should be equivalent to the acceptable `Sue will come to the party, but Bill is sure that nobody will come to the party'. This is because the presupposition triggered by `only Sue will come to the party' should be able to be bound at the matrix level. We discuss some responses to this problem, but argue that they all have shortcomings. (shrink)

It could be argued that tort law is failing, and arguably an example of this failure is the recent public liability and insurance (‘PL&I’) crisis. A number of solutions have been proposed, but ultimately the chosen solution should address whatever we take to be the cause of this failure. On one account, the PL&I crisis is a result of an unwarranted expansion of the scope of tort law. Proponents of this position sometimes argue that the duty of care owed by (...) defendants to plaintiffs has expanded beyond reasonable levels, such that parties who were not really responsible for another’s misfortune are successfully sued, while those who really were to blame get away without taking any responsibility. However people should take responsibility for their actions, and the only likely consequence of allowing them to shirk it is that they and others will be less likely to exercise due care in the future, since the deterrents of liability and of no compensation for accidentally self-imposed losses will not be there. Others also argue that this expansion is not warranted because it is inappropriately fueled by ‘deep pocket’ considerations rather than by considerations of fault. They argue that the presence of liability insurance sways the judiciary to award damages against defendants since they know that insurers, and not the defendant personally, will pay for it in the end anyway. But although it may seem that no real person has to bear these burdens when they are imposed onto insurers, in reality all of society bears them collectively when insurers are forced to hike their premiums to cover these increasing damages payments. In any case, it seems unfair to force insurers to cover these costs simply because they can afford to do so. If such an expansion is indeed the cause of the PL&I crisis, then a contraction of the scope of tort liability, and a pious return to the fault principle, might remedy the situation. However it could also be argued that inadequate deterrence is the cause of this crisis. On this account the problem would lie not with the tort system’s continued unwarranted expansion, but in the fact that defendants really have been too careless. If prospective injurers were appropriately deterred from engaging in unnecessarily risky activities, then fewer accidents would ever occur in the first place, and this would reduce the need for litigation at its very source. If we take this to be the cause of tort law’s failure then our solution should aim to improve deterrence. Glen Robinson has argued that improved deterrence could be achieved if plaintiffs were allowed to sue defendants for wrongful exposure to ongoing risks of future harm, even in the absence of currently materialized losses. He argues that at least in toxic injury type cases the tortious creation of risk [should be seen as] an appropriate basis of liability, with damages being assessed according to the value of the risk, as an alternative to forcing risk victims to abide the outcome of the event and seek damages only if and when harm materializes. In a sense, Robinson wishes to treat newly-acquired wrongful risks as de-facto wrongful losses, and these are what would be compensated in liability for risk creation (‘LFRC’) cases. Robinson argues that if the extent of damages were fixed to the extent of risk exposure, all detected unreasonable risk creators would be forced to bear the costs of their activities, rather than only those who could be found responsible for another’s injuries ‘on the balance of probabilities’. The incidence of accidents should decrease as a result of improved deterrence, reduce the ‘suing fest’, and so resolve the PL&I crisis. So whilst the first solution involves contracting the scope of tort liability, Robinson’s solution involves an expansion of its scope. However Robinson acknowledges that LFRC seems prima facie incompatible with current tort principles which in the least require the presence of plaintiff losses, defendant fault, and causation to be established before making defendants liable for plaintiffs’ compensation. Since losses would be absent in LFRC cases by definition, the first evidentiary requirement would always be frustrated, and in its absence proof of defendant fault and causation would also seem scant. If such an expansion of tort liability were not supported by current tort principles then it would be no better than proposals to switch accident law across to no-fault, since both solutions would require comprehensive legal reform. However Robinson argues that the above three evidentiary requirements could be met in LFRC cases to the same extent that they are met in other currently accepted cases, and hence that his solution would therefore be preferable to no-fault solutions as it would only require incremental but not comprehensive legal reform. Although I believe that actual losses should be present before allowing plaintiffs to seek compensation, I will not present a positive argument for this conclusion. My aim in this paper is not to debate the relative merits of Robinson’s solution as compared to no-fault solutions, nor to determine which account of the cause of the PL&I crisis is closer to the truth, but rather to find out whether Robinson’s solution would indeed require less radical legal reform than, for example, proposed no-fault solutions. I will argue that Robinson fails to show that current tort principles would support his proposed solution, and hence that his solution is at best on an even footing with no-fault solutions since both would require comprehensive legal reform. Thinking the Visual, Visualizing the Thought. A perceptual and Political Model of VisionMerleau-Ponty’s program of perceptivizing thought has depoliticizing effects that, though he does not recognize them, undermine his understanding of politics. These anti-political consequences, moreover, bring out the internal difficulties of his anti-intellectualist starting point. There are three areas in which Merleau-Ponty gave a thorough application, though with unequal success, of his perception-based model: the presentation of his own thought, in which his program of picturalization had a striking success; (...) the explanation of the historical process, in which his visualization model was only partly effective; and access to other people’s thought, in which his perceptivist views encountered an undeniable failure. Merleau-Ponty’s successive approaches to other people’s thought show, by two distinct paths, and beyond his own intentions, an unforeseen political defect. His perceptive model proves incompatible with his political ideas when it is applied in depth, and it thus breaks apart the cohesion of his thought. From a larger perspective, it disrupts reflective approaches to politics since it damages their conceptual bases. This article shows successively that Merleau-Ponty laid out a perceptive model of universal scope; that he applied it to several areas, including politics; that this model proves politically deficient when it serves to remove the autochthonous sources of sense; that these depoliticizing effects become more acute when Merleau-Ponty employs the perceptive model to elucidate other people’s thought; and that its frustration in this area not only devalues his political reflections, but also signals that the perceptive model simply prevents a “thinking of the political.”Pensare il visuale, visualizzare il pensiero.Un modello percettivo e politico della visioneIl programma di percettivizzazione del pensiero intrapreso da Merleau-Ponty comporta effetti spoliticizzanti che sconfessano nascostamente la sua comprensione della politica. Tali conseguenze antipolitiche mettono altresì in rilievo le difficoltà intrinseche alla sua posizione anti-intellettualista. Vi sono tre ambiti nei quali Merleau-Ponty, con diverso successo, ha applicato il suo modello percettivo : la presentazione del suo stesso pensiero, nella quale questo programma di pittoricizzazione incontra un successo trionfale; la chiarificazione del processo storico, dove tale modello “visualeˮ non è efficace che in parte; infine l’accesso al pensiero di altri autori, terreno sul quale questa prospettiva percettivista subisce uno scacco innegabile. Molti tentativi merleaupontiani di approcciare il pensiero di altri autori attestano in vario modo un imprevisto deficit politico. Il modello percettivo di Merleau-Ponty si rivela in altri termini incompatibile con le sue idee politiche, nel momento in cui viene applicato in profondità, e in ultima analisi mette a dura prova la coerenza del suo pensiero. In una prospettiva più ampia, esso ostacola un approccio riflessivo alla politica poiché ne degrada le stesse basi concettuali. Il nostro articolo mostra quindi che Merleau-Ponty ha articolato un modello percettivo di portata universale; che l’ha applicato a svariati ambiti d’indagine, tra cui la politica; che quel modello si rivela deficitario quando viene utilizzato per attingere a specifiche fonti di senso; che tali effetti spoliticizzanti si acuiscono nel momento in cui Merleau-Ponty adotta il modello percettivo per illuminare il pensiero di altri autori; che, per concludere, la sua incongruenza con questo peculiare ambito di riflessione non solo impoverisce le sue riflessioni politiche, ma attesta che in linea generale il modello percettivo sbarra la strada a un qualsiasi «pensiero del politico». Catharine Trotter Cockburn (1679- 1749) fu poetessa, drammaturga e filosofa. La vivacità intellettuale e la forte determinazione le permisero di aggirare il pregiudizio di genere e di sottrarsi alle dinamiche di marginalizzazione femminile tipiche dell’età moderna. Pur celandosi dietro l’anonimato, Cockburn prese parte attiva al dibattito filosofico del tempo, intervenendo soprattutto in materia di morale. Le sue opere filosofiche, scritte in difesa di Locke o di Clarke, custodiscono, nonostante il dichiarato intento apologetico, tratti di originalità e indipendenza, particolarmente evidenti nella (...) teoria dell’obbligo morale, nell’interpretazione modale della dottrina lockeana d’identità personale, nell’ipotesi di una natura ontologica dello spazio. Il problema della rappresentazione, connaturato ad ogni mediazione linguistica del rapporto di mente e mondo, è nelle sue molteplici forme un tema antico della riflessione filosofica. La rappresentazione letteraria appartiene alla stessa categoria e pone problemi analoghi al pensiero. Che cosa significa rappresentare poeticamente? Il concetto di finzione letteraria può avere solo un senso peggiorativo o limitante nei confronti della comunicazione dell’universale, o ne può essere una modalità? Il tema del saggio è il rapporto tra realtà e finzione letteraria che (...) pare emergere da I falsari di André Gide. Seguendo le intuizioni e i suggerimenti dello scrittore, si proverà a tracciare le linee principali di un’interpretazione positiva della finzione letteraria, che ne riconosca la potenza espressiva senza soffocarne i caratteri distintivi. Non è detto, poi, che ciò che vale per la rappresentazione poetica non possa avere un senso anche sotto punti di vista più generali. (shrink)

Although it is well known that Gestalt theory had an important impact on Merleau-Ponty’s philosophy throughout his career, there is still no detailed study either of its influence on his ideas or of his own understanding of the notoriously polysemic notion of Gestalt. Yet, this notion is a key to Merleau-Ponty’s fundamental project of overcoming “objective thought” and its inherent dichotomies. By indicating how signification or ideality can be immanent in, rather than opposed to, matter, it compels us to redefine (...) both consciousness and the world it is bound up with. The aim of this article is to clarify Merleau-Ponty’s notion of Gestalt against the historical background that he refers to, including Kurt Goldstein’s theory of the organism that was crucial for his interpretation of it. -/- On sait que la théorie de la Gestalt a eu un impact majeur sur la philosophie merleaupontienne. Il n’existe pourtant pas d’étude extensive de l’influence de cette théorie sur les thèses de Merleau-Ponty ou sur sa compréhension propre de la notion fort polysémique de Gestalt. Or cette notion s’avère être l’une des meilleures clés pour comprendre le projet fondamental du dépassement merleau-pontien de la « pensée objective » et de ses dichotomies. En effet, en montrant comment le sens ou l’idéalité sont immanents, plutôt qu’opposés, à la matière, la Gestalt conduit à définir à nouveaux frais la conscience et le monde auquel elle est liée. L’article vise à clarifier la conception de la Gestalt chez Merleau-Ponty à partir de son fond historique. On étudie en particulier la théorie de l’organisme de Kurt Goldstein, qui a été essentielle pour l’interprétation merleaupontienne de la notion de Gestalt. -/- Benché sia noto che la Gestalttheorie abbia avuto un impatto rilevante sull’intero tragitto della filosofia di Merleau-Ponty, non esiste ancora uno studio dettagliato dell’influenza del gestaltismo sulle sue idee né sulla sua comprensione di un concetto notoriamente sfaccettato come quello di Gestalt. Che gli esseri umani esperiscano e rappresentino il mondo come un dominio ricco di confini è piuttosto ovvio. Tuttavia, Achille Varzi ha sottolineato a più riprese nelle sue opere che, dal punto di vista metafisico, è interessante chiedersi se i confini siano tutti dello stesso tipo. Tale domanda ci permette, infatti, di affrontare con un registro intuitivo una serie di questioni classiche circa la natura del mondo. In queste poche pagine vorrei considerare il tema dei confini da un’angolatura specifica, quella (...) della macelleria. Dapprima introduco una triplice distinzione tra tipologie di confini (§1). Questa risulta utile per inquadrare il successivo esempio tratto dalla pratica della macelleria kosher (§2), che suggerisce una quarta tipologia di confine, dalla quale traggo spunto per alcune considerazioni circa la relazione tra confini, convenzioni e realtà (§3). This paper examines whether American parents legally violate their children’s privacy rights when they share embarrassing images of their children on social media without their children’s consent. My inquiry is motivated by recent reports that French authorities have warned French parents that they could face fines and imprisonment for such conduct, if their children sue them once their children turn 18. Where French privacy law is grounded in respect for dignity, thereby explaining the French concerns for parental “over-sharing,” I show (...) that there are three major legal roadblocks for such a case to succeed in US law. First, US privacy tort law largely only protects a person’s image where the person has a commercial interest in his or her image. Secondly, privacy tort laws are subject to constitutional constraints respecting the freedom of speech and press. Third, American courts are reluctant to erode parental authority, except in cases where extraordinary threats to children’s welfare exist. I argue that while existing privacy law in the US is inadequate to offer children legal remedy if their parents share their embarrassing images of them without their consent, the dignity-based concerns of the French should not be neglected. I consider a recent proposal to protect children’s privacy by extending to them the “right to be forgotten” online, but I identify problems in this proposal, and argue it is not a panacea to the over-sharing problem. I conclude by emphasizing our shared social responsibilities to protect children by teaching them about the importance of respecting one another’s privacy and dignity in the online context, and by setting examples as responsible users of internet technologies. Il saggio intende ricollocare gli studi di Jürgen Habermas sui mutamenti di struttura della sfera pubblica politica nel campo disciplinare della political communication research al fine di indicare operativamente quali elementi fattuali potrebbero confermare la validità del modello normativo deliberativo. Dopo aver introdotto gli esigenti principi pragmatici che improntano l’approccio funzionalista dello studioso tedesco, vengono si-stematizzate le sue riflessioni sull’indipendenza dei media dai sotto-sistemi economici e politico-amministrativi e sugli effetti della comunicazione mediale sul pubblico, considerando la struttura delle relazioni e (...) la qualità dell’informazione. Da ultimo, verrà presentata la tesi – oggi divenuta ancor più controversa – che la concezione deliberativa sia in grado di mantenere una “grandezza controfattuale” grazie al ruolo-guida della “stampa di qualità” e all’impegno degli intellettuali “veri”. Il presente contributo muove dalle osservazioni sul linguaggio che Nietzsche svolge in Umano, troppo umano, I, § 11, con lo scopo di riflettere sulla posizione anti-realista che Nietzsche sostiene in quell’aforisma e di evidenziare il ruolo che essa svolge nelle sue più tarde considerazioni relative alla cultura occidentale e alla sua antropologia. Come si avrà modo di mostrare, la critica nietzscheana al realismo del senso comune è in linea con alcune epistemologie pragmatiste sorte tra Otto- e Novecento. Questo elemento di (...) “attualità” non mina però l’originalità della riflessione di Nietzsche su quell’argomento. Piuttosto, è possibile sostenere che l’idea che il pensiero filosofico intervenga in una correzione dell’impegno metafisico proprio del senso comune sia lo strumento teoretico che permette a Nietzsche di operare sullo sviluppo della cultura e società europee.
