The observational-theoretical distinction has played a central role in the philosophy of science from logical empiricism onwards. Developments within the discipline have shown that such a distinction hides two non-identical distinctions: observational vs. non-observational and theoretical vs. non-theoretical. Likewise, metatheoretical structuralism proposed a more sophisticated treatment of theoricity in terms of the operational dependence or independence of concepts from the theories in which they appear. Despite this remarkable sophistication, it is still generally accepted that the distinction between theoretical and non-theoretical (...) concepts coincides with the explanatory vs. non-explanatory and testing vs. non-testing distinctions. Ginnobili and Carman argued for the independence between theoricity and explanation. In this paper we will focus on testing and argue for its independence from both theoricity and explanation. To do so, we propose an account of theory testing based on the framework of metatheoretical structuralism and apply it to natural selection theory and cladistics. (shrink)

In this paper, we present a way to translate the metainferences of a mixed metainferential system into formulae of an extended-language system, called its associated σ-system. To do this, the σ-system will contain new operators (one for each standard), called the σ operators, which represent the notions of "belonging to a (given) standard". We first prove, in a model-theoretic way, that these translations preserve (in)validity. That is, that a metainference is valid in the base system if and only if its (...) translation is a tautology of its corresponding σ-system. We then use these results to obtain other key advantages. Most interestingly, we provide a recipe for building unlabeled sequent calculi for σ-systems. We then exemplify this with a σ-system useful for logics of the ST family, and prove soundness and completeness for it, which indirectly gives us a calculus for the metainferences of all those mixed systems. Finally, we respond to some possible objections and show how our σ-framework can shed light on the “obeying” discussion within mixed metainferential contexts. (shrink)

Esto permite a los autores afirmar que la teoría de la probabilidad brindaría la base reductiva para toda la biología evolutiva (dado que consideran que otros principios, como el de selección natural, también serían parte de la teoría de la probabilidad). Defenderemos que, efectivamente, ZFEL no es propio de la biología únicamente, pero no por formar parte de la teoría de la probabilidad, sino por tratarse de una versión específica del principio de causa común. -/- In a recent book, McShea and Brandon argue that the observed diversity and complexity of life are explainable by a principle they call the “zero-force evolutionary law” or “ZFEL”. Although this principle would be implicit in many explanations given by biologists, it would have never been made explicit. Assuming that this idea is interesting, and that the authors are right, we will discuss the metatheoretical way in which they present said principle, as being a part of probability theory. This allows the authors to claim that probability theory provides the reductive basis for all evolutionary biology. We will defend, in accordance with them, that ZFEL is not a solely biological principle, but not because it is a part of probability theory, but rather because it is a specific version of the principle of common cause. In this article, we provide three generators of propositional formulae for arbitrary languages, which uniformly sample three different formulae spaces. They take the same three parameters as input, namely, a desired depth, a set of atomics and a set of logical constants (with specified arities). The first generator returns formulae of exactly the given depth, using all or some of the propositional letters. The second does the same but samples up-to the given depth. The third generator outputs formulae with exactly (...) the desired depth and all the atomics in the set. To make the generators uniform (i.e. to make them return every formula in their space with the same probability), we will prove various cardinality results about those spaces. (shrink)

This paper will seek firstly to understand Deleuze’s main challenges to phenomenology, particularly as they are expressed in The Logic of Sense and What is Philosophy?, although reference will also be made to Pure Immanence and Difference and Repetition. We will then turn to a discussion of one of the few passages in which Deleuze directly engages with Merleau-Ponty, which occurs in the chapter on art in What is Philosophy? In this text, he and Guattari offer a critique of what (...) they call the “final avatar” of phenomenology – that is, the “fleshism” that Merleau-Ponty proposes in his unfinished but justly famous work, The Visible and the Invisible. It will be argued that both Deleuze’s basic criticisms of phenomenology, as well as he and Guattari’s problems with the concept of the flesh, do not adequately come to grips with Merleau-Ponty’s later philosophy. Merleau-Ponty is not obviously partisan to what Deleuze finds problematic in this tradition, despite continuing to identify himself as a phenomenologist, and is working within a surprisingly similar framework in certain key respects. In fact, in the more positive part of this paper, we will compare Merleau-Ponty’s notion of flesh, and Deleuze’s equally infamous univocity of being, as a means to consider the broader question of the ways in which the two philosophers consider ontological thought, its meaning and its conditions. It is our belief that through properly understanding both positions, a rapprochement, or at least the foundation for one, can be established between these two important thinkers. (shrink)

Drawing on recent developments in dialogic approaches to learning and teaching, I examine the roots of dialogic meaning-making as a concept in classroom practices. Developments in the field of dialogic pedagogy are reviewed and the case for dialogic engagement as an approach to classroom interaction is considered. The implications of dialogic classroom approaches are discussed in the context of educational research and classroom practice. Dialogic practice is contrasted with monologic practices as evidenced by the resilient of the IRF as the (...) default discourse structure in classrooms. Recent evidence suggests the IRF is resistant to attempts to introduce interactive approaches to whole class teaching. Discussion of dialogic practice as a vehicle for increasing pupil engagement at a deep level and raising the quality of classroom interaction is illustrated through a consideration of Philosophy for Children, which is identified as a dialogic approach to classroom practice which has transformative potential for children's learning. Philosophy for Children offers an approach to pedagogy which enables teachers to value pupil voice and promote reflective learning. As such it has much to offer the current debate on dialogic teaching and learning. Research evidence suggests it will promote improved pupil outcomes on a range of assessments. (shrink)

Relationships with international students can be beneficial to higher education in terms of financial and human resources. For this reason, establishing and maintaining such relationships are usually pre-eminent concerns. In this study, we extended the application of the disconfirmation expectation model by incorporating components from subjective task value to predict the loyalty of international students toward their host countries. On a sample of 410 Vietnamese students enrolled in establishments of higher education in over 15 countries across the globe, we employed (...) structural equation model to construct the conceptual model. Our empirical findings revealed that while the roles of satisfaction and disconfirmation are still important as direct and indirect antecedents of international student loyalty, its most powerful predictors are the three components of subjective task value: attainment, utility and intrinsic. These insights result in a number of implications for actors on the higher ducation scene, such as heads of institutions and policy makers. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

Clairaudient ability has a positive connotation upon the ability to hear voices, whereas the diagnosis of Schizophrenia is most commonly treated with pharmaceutical drugs to reduce or eliminate symptoms. This paper involves information about Schizophrenia, how it is perceived and treated. It also discusses various views of clairaudience, and how it is effective and manageable. This is a critical examination of Zizek's concept of ideology in his work on the Sublime of Ideology. His account on this connotes that people are basing only in the conscious state without considering the unconscious "I." This framework in psychology has led Zizek to relate it in the process of economics which is greatly manifested in the contradictory poles of the oppressor and the oppressed and its relationship to the process of commodities. Looking into this orientation, this leaves the (...) author to incorporate the ideological character of Zizek through the lens of Anti-Terrorism Law which is not seen in the naked eye. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

La memética constituye un enfoque sobre la evolución cultural que se ha encontrado en el foco de la discusión y recolectado críticas de diverso tipo en las últimas décadas. El propósito de nuestro trabajo consiste en indagar si, más allá de las críticas y defensas existentes, puede considerarse que existe actualmente algún programa de investigación que pueda caracterizarse adecuadamente como memético. Nos centraremos, específicamente, en el ámbito del estudio de la evolución cultural de los cantos de aves, pues allí algunos (...) autores han utilizado la palabra «meme» para referirse a los ítems culturales bajo estudio. Sin embargo, no todos utilizan la palabra, pues, probablemente por su carácter controversial, ha caído en desuso. Eso implica que para cumplir con el objetivo de nuestro trabajo no pueda apelarse a análisis bibliométricos. Por este motivo elucidaremos los diferentes sentidos en los que puede caracterizarse a la memética. Nuestro objetivo es defender que en el área de cantos de aves se pueden encontrar investigaciones que responden a la perspectiva memética en todos los sentidos señalados. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

La sincronicità, è “la simultaneità di un certo stato psichico con uno o più eventi esterni che paiono paralleli significativi della condizione momentaneamente soggettiva” (Jung, 1952). C.G.Jung e il fisico quantistico premio Nobel, W. Pauli, ci introducono con tale concettualizzazione in un mondo, nel quale ciò che è interno e ciò che è esterno a noi non è così nettamente definito, mondo nel quale le “coincidenze” non sono più tali, ma rivestono un significato ed un’importanza per la nostra psiche, per (...) la nostra vita. Se un bambino mentre gioca sulla riva di un fiume, vi cade e rischia di venire trascinato dalla corrente, e nello stesso momento sua madre dall’altra parte della città è preda di un’angoscia che l’attanaglia e grida: “il mio bambino!”, siamo in presenza di un evento sincronistico, nel senso della definizione di Jung sopracitata. Noi crediamo, sulla scia di Jung e Pauli che la sincronicità possa essere un possibile principio esplicativo della realtà da affiancare alla causalità, per Pauli vi sono nella realtà sia elementi razionali sia irrazionali ed è quindi impossibile per la fisica dire l’ultima parola sulla realtà, visto che quest’ultima è così complessa. L’attuazione dei fenomeni sincronistici è fuori dalla portata di qualsiasi tipo di previsione razionale, l’evento sincronistico non è riproducibile ed è in qualche modo l’emblema dell’aspetto non razionale della realtà, e come detto, insieme alla più consueta logica causalistica, (ad esempio, una mela su un albero quando è matura può anche cadere), danno una visione più completa della realtà. E questa visione più completa era l’intento di Jung nell’approcciare questi fenomeni: “Cercare di aprire una via verso “l’animazione della materia” a partire dall’assunzione che “ciò che esiste sia dotato di senso”…” ( Pauli e Jung 1992, lettera n.59 di Jung, p. 100). The aim of this essay is to provide an overview of New Realism in its opposition and reaction to Postmodernism. An analysis of the implications of both philosophical approaches in diverse fields will be offered, from epistemology, to politics, to ethics. Ethical new realism is presented as particularly promising and important to the future of philosophy.

The article argues for the variant ‘tractabimus’ in Book 8, ch. 1 of Augustine’s De Trinitate as opposed to the reading ‘tractavimus’ adopted in the Corpus Christianorum edition, and explains the implications of this variant for the understanding of the overall structure of the work.

In this pages the author suggests a spiritual interpretation of Jungian epistemology as a way towards authenticity. He also argues that Martin Heidegger's philosophy and panpsychism can confirm the possibility offered by Jung - with his alchemical - archetypical description of human nature - to achieve a deeper and more authentic awareness of our existence.

Visse durante il periodo del rinascimento italiano nel XV secolo tra Bologna e Milano, morto a Cremona nel 1495. La suo apiù importante opera è proprio il commento alla Metafisica di Aristotele (Acutissimae quaestiones metaphysicales, 1 ed. Venezia 1498) che rappresenta una particolare sintesi del commentatore arabo Averrè, Tommaso d'Aquino, Erveo Natale († 1323) e Giovanni Capreolo († 1444). L'opera filosofica del Soncinate (...) era spesso discusso tra il XVI e XVII secolo. Il libro offre la prima biografia scientifica dell'autore in italiano, e l'edizione critica del suo commento al IV libro della Metafica di Aristotele in latino. -/- Paolo Barbò da Soncino called "Soncinas" was an Italian Dominican, Thomist philosopher and theologian. His life and work fall within the ambit of Italian Renaissance Thomism of the fifteenth century, between Bologna and Milano, died in 1495 in Cremona. His principal work, the exposition of Aristotle's Metaphysics, (Acutissimae quaestiones metaphysicales 1 ed. Venice 1498) proceeds from a particular synthesis of the Arabic commentator Averroes, Thomas Aquinas, Hervaeus Natalis (d. 1323), and John Capreolus (d. 1444). Soncinas' work and position were frequently discussed from the sixteenth to the seventeenth century. This study offers the first scientific biography, description and analysis of the method, sources and doctrine of Soncinas, in particular the critical Latin edition of the 4th book of his Acutissimae Quaestiones Metaphysicales (the exposition of Aristotle's Metaphysics). In his last book, Le complexe des trois singes. Essai sur l’animalité humaine (2017), the French philosopher Étienne Bimbenet accuses “sensocentric” (« pathocentristes ») animal ethics of committing a performative contradiction: according to Bimbenet, these theories of animal rights — among which he focuses on the case of Zoopolis (2011) by Sue Donaldson and Will Kymlicka — would undermine themselves by means of declaring reason a “non-essential” feature of human beings, while at the same time those theories themselves can only (...) be understood as a highly rational human endeavour. As we will try to point out, the alleged performative contradiction does not actually take place. First of all, Donaldson and Kymlicka only describe reason as “non essential” when it comes to describing moral patients, not moral agents, and particularly not moral theoreticians. In the second place, Zoopolis presents itself explicitly as an effort in “articulating moral reasons” — not as a renouncement of reason as such. (shrink)

In "Microaggressions: Strong Claims, Inadequate Evidence," Scott Lillenfeld argues that, despite a decade of scholarship, the Microaggression Research Program (MRP) continues to suffer serious analytic and evidentiary problems. After walking through these shortcomings, he provides 18 suggestions to help improve the reliability and utility of the MRP. In "Microaggressions and 'Evidence': Experimental or Experiential Reality?" Derald Wing Sue responds. This chapter provides background on the origin of the MRP, and referees the dispute between Lillenfeld and Sue about its contemporary status.

Genocide remembrance is a complex epistemological/ethical achievement, whereby survivors and descendants give meaning to the past in the quest for both personal-historical and social-historical truth. This paper offers an argument of epistemic injustice specifically as it occurs in relation to practices of (individual and collective) genocide remembrance. In particular, I argue that under conditions of genocide denialism, understood as collective genocide misremembrance and memory distortion, genocide survivors and descendants are confronted with hermeneutical oppression. Drawing on Sue Campbell’s relational, reconstructive account (...) of remembering, I argue that genocide denialism involves disrespectful challenges to memory, which systematically misrecognize rememberers. Adopting the case of Turkey’s denialism of the Armenian genocide, I discuss two interrelated mechanisms through which this can happen: i) through the systematic portrayal of survivors and descendants as vicious rememberers, and ii) through distortions of the very concept of ‘genocide’. Based on this, I show how hermeneutical and testimonial injustice are crucially interrelated when it comes to “contested” memories of historical injustice and the biographical testimony it gives rise to. I introduce the seven papers in this special issue, by Andy Clark, Je´roˆme Dokic, Richard Menary, Jenann Ismael, Sue Campbell, Doris McIlwain, and Mark Rowlands. This paper explains the motivation for an alliance between the sciences of memory and the extended mind hypothesis. It examines in turn the role of worldly, social, and internalized forms of scaffolding to memory and cognition, and also highlights themes relating to affect, agency, and individual differences.

In order to handle presuppositions in the scope of attitude verbs, the binding theory allows presuppositions triggered in a subject's beliefs to be bound at the matrix level; and it allows presuppositions triggered in non-doxastic attitudes to be bound in the subject's beliefs (Geurts, 1999; Maier, 2015). However, we argue that this leads to serious overgeneration, for example it predicts that the unacceptable `Sue will come to the party, but Bill is sure that she won't and that only Sue will (...) come to the party' should be equivalent to the acceptable `Sue will come to the party, but Bill is sure that nobody will come to the party'. This is because the presupposition triggered by `only Sue will come to the party' should be able to be bound at the matrix level. We discuss some responses to this problem, but argue that they all have shortcomings. (shrink)

Scopo del presente articolo è di mostrare la genesi e l’evoluzione di tale concetto, a partire dalle sue prime occorrenze in Umano, troppo umano I fino al suo compiuto sviluppo negli scritti del 1885-87. Tale studio permetterà di evidenziare il particolare valore (...) che Nietzsche attribuisce ai “buoni europei”, in quanto promotori dello sviluppo spirituale conseguente alla compiuta liberazione della morale cristiana. ENG: The “good European” is a rich and important topic in Nietzsche. It is first related to Nietzsche’s early reflections on European culture, and during the 1880’s it gains philosophical value, being strictly connected with the purposes of Nietzsche’s mature thought. The aim of this paper is to track the genesis and development of the notion of “good European”, from Human, all too Human I to Nietzsche’s writings from the years 1885-1887. That investigation shall particularly show the meaning and value that Nietzsche attributes to the good Europeans; as for him, they are in fact the leaders of the spiritual development that follows the overcoming of Christian morality. A short sketch of the argument can be found on pp. 246-48 of ‘Vagueness and Partial Belief’ ; a more elaborated presentation occurs in “TWOIs sues of Vagueness”.

: How much power does emotional dismissal have over the oppressed's ability to trust outlaw emotions, or to stand for such emotions before others? I discuss Sue Campbell 's view of the interpretation of emotion in light of the political significance of emotional dismissal. In response, I suggest that feminist conventions of interpretation developed within dialogical communities are best suited to providing resources for expressing, interpreting, defining, and reflecting on our emotions.

My main aim is to clarify what we mean by ‘look’ sentences such as (1) below – ones that we use to talk about visual experience: -/- (1) The ball looked red to Sue -/- This is to help better understand a part of natural language that has so far resisted treatment, and also to help better understand the nature of visual experience. -/- By appealing to general linguistic principles I argue for the following account. First, we use (1) to (...) talk about an event. Second, we use the verb ‘look’ to specify the kind of event about which we are talking – it is a looking event. Third, we use the subject ‘the ball’ to specify a stimulus of the event – something that looks some way in the event. Fourth, we use the adjunct ‘to Sue’ to specify an experiencer of the event – someone to whom things look some way in the event. Finally, we use the complement ‘red’ to specify a way of the event – a way in which the event occurs (I take ways of occurring to be properties of events). Which way do we use ‘red’ in (1) to specify? I argue: the maximally specific way w such that the following is generically true: looking events whose stimulus is red occur in way w (it is important that this is understood generically: this is what does much of the work in explaining our use of (1) and other ‘look’ sentences). Putting this together, what we mean by (1) is: there was a looking event whose stimulus was the ball, whose experiencer was Sue, and which occurred in the maximally specific way that looking events occur when their stimulus is red. -/- This account of how we use ‘red’ in (1) is one of the most interesting aspects of my thesis. It extends to an account of how we use ‘proud’ in ‘John walks proud’, ‘as if he is American’ in ‘John talks as if he is American’, ‘like a duck’ in ‘John sounds like a duck’, and so on. In each case we use the expression in question to specify a way: the maximally specific way proud people walk, the maximally specific way American people talk, and so on. So the study of ‘look’ sentences has much to tell us about the functioning of many other English language constructions, and suggests that ways have a significant role to play in the semantics of natural language – a fact that has not yet been sufficiently recognised by linguists or philosophers of language. -/- My thesis also has implications for the philosophy of perception. One of the central questions about perception is: What is the nature of visual experience? What is it, for example, for a ball to look red to Sue? My thesis offers an answer: What it is for the ball to look red to Sue is for whatever it is that we mean by ‘The ball looks red to Sue’ to be the case, and what we mean by ‘The ball looks red to Sue’ is that there is a looking event whose stimulus is the ball, whose experiencer is Sue, and which is occurring in a certain way. It thus delivers an adverbial account of visual experience, one that has the resources to better deal with problems that are traditionally thought to be decisive against adverbial accounts. (shrink)

Microaggressions are seemingly negligible slights that can cause significant damage to frequently targeted members of marginalized groups. Recently, Scott O. Lilienfeld challenged a key platform of the microaggression research project: what’s aggressive about microaggressions? To answer this challenge, Derald Wing Sue, the psychologist who has spearheaded the research on microaggressions, needs to theorize a spectrum of aggression that ranges from intentional assault to unintentional microaggressions. I suggest turning to Bonnie Mann’s “Creepers, Flirts, Heroes and Allies” for inspiration. Building from Mann’s (...) richer theoretical framework will allow Sue to answer Lilienfeld’s objection and defend the legitimacy of the concept, ‘microaggression’. (shrink)

I argue that nonresident aliens, in places that are clearly not U.S. territory, should benefit from constitutional rights. This is a matter of mutuality of obligation. The U.S. claims the authority to hold all people accountable for respecting certain laws, such as the law of war as defined in the Military Commissions Act. Accordingly, it must accord them basic legal rights in return. At the same time, I argue, contra Benjamin Wittes, that this would not lead to absurdly opening the (...) courthouse doors, nor does it require abandoning principle to keep the flood of litigation reasonably contained. Not all harms inflicted by the U.S. government can give rise to a lawsuit, and that the distinction between those who should have a right to sue and those who should not can be drawn in a principled way. Domesticated animals need to be treated as fellow citizens: only if we conceive of domesticated animals as full members of our political communities can we do justice to their moral standing—or so Sue Donaldson and Will Kymlicka argue in their widely discussed book Zoopolis. In this contribution, we pursue two objectives. Firstly, we reject Donaldson and Kymlicka’s appeal for animal citizenship. We do so by submitting that instead of paying due heed to their moral status, regarding animals as citizens misinterprets (...) their moral qualities and thus risks treating them unjustly. Secondly, we suggest that Donaldson and Kymlicka’s reinforced focus on membership should draw our attention to the moral standing of a further ‘species’, namely robots. Developments within artificial intelligence have advanced rapidly in recent years. With robots’ gaining ever greater capacities and abilities, we need to ask urgent questions about the moral ramifications of these technical advances. (shrink)

This article investigates the original meaning of dependent arising in the Buddha’s teaching, by focussing on the imasmi" sati formula. Modern scholars such as the Rhys Davidses, K.N. Jayatilleke and Paul Williams have interpreted it as a princi- ple of causation, comparable to a scientific conception of causation. I argue instead that this formula implies that the Buddha held that causation is nothing more than the correlation of causes and effects, and that it commits the Buddha to a Humean regularity (...) thesis about causation. I draw a distinction between the Buddhist and scientific concepts of causation, and then summarise an alternative approach made by more recent scholars such as Sue Hamilton, Noa Ronkin and Eviatar Shulman, who present dependent arising in terms of conditionality in the causal structure of subjective experience. I conclude by presenting the argument that the imasmi" sati formula does not express a principle of causation but is rather a formula for the method of discovering and presenting causation as conditionality in experience. La rappresentazione letteraria appartiene alla stessa categoria e pone problemi analoghi al pensiero. Che cosa significa rappresentare poeticamente? Il concetto di finzione letteraria può avere solo un senso peggiorativo o limitante nei confronti della comunicazione dell’universale, o ne può essere una modalità? Il tema del saggio è il rapporto tra realtà e finzione letteraria che (...) pare emergere da I falsari di André Gide. Seguendo le intuizioni e i suggerimenti dello scrittore, si proverà a tracciare le linee principali di un’interpretazione positiva della finzione letteraria, che ne riconosca la potenza espressiva senza soffocarne i caratteri distintivi. Non è detto, poi, che ciò che vale per la rappresentazione poetica non possa avere un senso anche sotto punti di vista più generali. (shrink)

Although it is well known that Gestalt theory had an important impact on Merleau-Ponty’s philosophy throughout his career, there is still no detailed study either of its influence on his ideas or of his own understanding of the notoriously polysemic notion of Gestalt. Yet, this notion is a key to Merleau-Ponty’s fundamental project of overcoming “objective thought” and its inherent dichotomies. By indicating how signification or ideality can be immanent in, rather than opposed to, matter, it compels us to redefine (...) both consciousness and the world it is bound up with. The aim of this article is to clarify Merleau-Ponty’s notion of Gestalt against the historical background that he refers to, including Kurt Goldstein’s theory of the organism that was crucial for his interpretation of it. -/- On sait que la théorie de la Gestalt a eu un impact majeur sur la philosophie merleaupontienne. Il n’existe pourtant pas d’étude extensive de l’influence de cette théorie sur les thèses de Merleau-Ponty ou sur sa compréhension propre de la notion fort polysémique de Gestalt. Or cette notion s’avère être l’une des meilleures clés pour comprendre le projet fondamental du dépassement merleau-pontien de la « pensée objective » et de ses dichotomies. En effet, en montrant comment le sens ou l’idéalité sont immanents, plutôt qu’opposés, à la matière, la Gestalt conduit à définir à nouveaux frais la conscience et le monde auquel elle est liée. L’article vise à clarifier la conception de la Gestalt chez Merleau-Ponty à partir de son fond historique. On étudie en particulier la théorie de l’organisme de Kurt Goldstein, qui a été essentielle pour l’interprétation merleaupontienne de la notion de Gestalt. -/- Benché sia noto che la Gestalttheorie abbia avuto un impatto rilevante sull’intero tragitto della filosofia di Merleau-Ponty, non esiste ancora uno studio dettagliato dell’influenza del gestaltismo sulle sue idee né sulla sua comprensione di un concetto notoriamente sfaccettato come quello di Gestalt. Tuttavia proprio questa nozione costituisce una chiave d’accesso fondamentale al grande progetto merleaupontyano di oltrepassare il “pensiero oggettivo” insieme alle dicotomie che lo accompagnano. Indicando come il significato o l’idealità possano essere immanenti, anziché opposti, alla materia, tale nozione ci obbliga a ridefinire tanto la coscienza quanto il mondo a cui essa è legata. L’obiettivo di questo articolo è quello di chiarire la nozione merleaupontyana di Gestalt nel suo contesto storico, con particolare riferimento alla teoria dell’organismo elaborata da Kurt Goldstein, determinante per l’interpretazione merleaupontyana della nozione di Gestalt. The concept of vulnerability has been renewed in meaning and importance over recent decades. Scholars such as Judith Butler, Martha Fineman and Pamela Sue Anderson have endeavored to redeem vulnerability from its traditional signification as a negative individual condition, and to reveal the positive meaning of vulnerability as a transformative call for solidarity, equality and love. In this paper we examine the newly constructed positive understanding of vulnerability, and argue that the current way of pursuing this positive understanding affirms a (...) merely functional positivity. In the recent accounts, vulnerability is still a status to avoid, yet functions positively as a corrective force to the environment that produces vulnerability. We will try to find an essential way of designating the positivity of vulnerability by revisiting the philosophical discussion on vulnerability in Emmanuel Levinas. We will argue that Levinas’s notion of vulnerability is positive in a sense which goes beyond the purely functional; it is seen as essential for his definition of humanity. Yet compared to the contemporary discussion, Levinas’s notion of vulnerability lacks a direct social political meaning. We will tentatively explore how the essential positivity drawn from Levinas can provide a new way to construct the political significance of vulnerability. (shrink)

Tuttavia, per come è usualmente presentata nei libri di testo, la meccanica quantistica è sostanzialmenteun’insieme di regole per calcolare le distribuzioni di probabilità dei risultati di qualunqueesperimento (nel dominio di validità della meccanica quantistica). In quanto tale, non ci forniscedirettamente una descrizione della realtà. Una descrizione della realtà, cioè un’ ontologia , dovrebbedirci che cosa c’è nel mondo e come si comporta, quali sono i processi che si realizzano a livellomicroscopico e, di conseguenza, fornirci una spiegazione del formalismo quantistico. In the 1980s and 1990s, a series of attempts were made to put into U.S. law a civil rights ordinance that would make it possible to sue the makers and distributors of pornography for doing so (under certain conditions). One defence of such legislation has come to be called "the free speech argument against pornography." Philosophers Rae Langton, Jennifer Hornsby and Caroline West have supposed that this defence of the legislation can function as a liberal defence of the legislation: in (...) particular, a defence of the legislation based on the value of women's liberty. This would be somewhat unexpected given MacKinnon's own antipathy toward liberalism. In this paper, I argue that the free speech argument against pornography cannot be used as a liberal defence of the ordinances. The legislation is, to some extent, self-defeating insofar as it understood in terms acceptable to a fairly standard kind of liberal. This becomes apparent when we consider the value pornography can have for women, which we can see if we consider what female makers, distributors and consumers of pornography have to say about why they make, distribute and consume it. Tuttavia, Achille Varzi ha sottolineato a più riprese nelle sue opere che, dal punto di vista metafisico, è interessante chiedersi se i confini siano tutti dello stesso tipo. Tale domanda ci permette, infatti, di affrontare con un registro intuitivo una serie di questioni classiche circa la natura del mondo. In queste poche pagine vorrei considerare il tema dei confini da un’angolatura specifica, quella (...) della macelleria. Dapprima introduco una triplice distinzione tra tipologie di confini (§1). Questa risulta utile per inquadrare il successivo esempio tratto dalla pratica della macelleria kosher (§2), che suggerisce una quarta tipologia di confine, dalla quale traggo spunto per alcune considerazioni circa la relazione tra confini, convenzioni e realtà (§3). It could be argued that tort law is failing, and arguably an example of this failure is the recent public liability and insurance (‘PL&I’) crisis. A number of solutions have been proposed, but ultimately the chosen solution should address whatever we take to be the cause of this failure. On one account, the PL&I crisis is a result of an unwarranted expansion of the scope of tort law. Proponents of this position sometimes argue that the duty of care owed by (...) defendants to plaintiffs has expanded beyond reasonable levels, such that parties who were not really responsible for another’s misfortune are successfully sued, while those who really were to blame get away without taking any responsibility. However people should take responsibility for their actions, and the only likely consequence of allowing them to shirk it is that they and others will be less likely to exercise due care in the future, since the deterrents of liability and of no compensation for accidentally self-imposed losses will not be there. Others also argue that this expansion is not warranted because it is inappropriately fueled by ‘deep pocket’ considerations rather than by considerations of fault. They argue that the presence of liability insurance sways the judiciary to award damages against defendants since they know that insurers, and not the defendant personally, will pay for it in the end anyway. But although it may seem that no real person has to bear these burdens when they are imposed onto insurers, in reality all of society bears them collectively when insurers are forced to hike their premiums to cover these increasing damages payments. In any case, it seems unfair to force insurers to cover these costs simply because they can afford to do so. If such an expansion is indeed the cause of the PL&I crisis, then a contraction of the scope of tort liability, and a pious return to the fault principle, might remedy the situation. However it could also be argued that inadequate deterrence is the cause of this crisis. On this account the problem would lie not with the tort system’s continued unwarranted expansion, but in the fact that defendants really have been too careless. If prospective injurers were appropriately deterred from engaging in unnecessarily risky activities, then fewer accidents would ever occur in the first place, and this would reduce the need for litigation at its very source. If we take this to be the cause of tort law’s failure then our solution should aim to improve deterrence. Glen Robinson has argued that improved deterrence could be achieved if plaintiffs were allowed to sue defendants for wrongful exposure to ongoing risks of future harm, even in the absence of currently materialized losses. He argues that at least in toxic injury type cases the tortious creation of risk [should be seen as] an appropriate basis of liability, with damages being assessed according to the value of the risk, as an alternative to forcing risk victims to abide the outcome of the event and seek damages only if and when harm materializes. In a sense, Robinson wishes to treat newly-acquired wrongful risks as de-facto wrongful losses, and these are what would be compensated in liability for risk creation (‘LFRC’) cases. Robinson argues that if the extent of damages were fixed to the extent of risk exposure, all detected unreasonable risk creators would be forced to bear the costs of their activities, rather than only those who could be found responsible for another’s injuries ‘on the balance of probabilities’. The incidence of accidents should decrease as a result of improved deterrence, reduce the ‘suing fest’, and so resolve the PL&I crisis. So whilst the first solution involves contracting the scope of tort liability, Robinson’s solution involves an expansion of its scope. However Robinson acknowledges that LFRC seems prima facie incompatible with current tort principles which in the least require the presence of plaintiff losses, defendant fault, and causation to be established before making defendants liable for plaintiffs’ compensation. Since losses would be absent in LFRC cases by definition, the first evidentiary requirement would always be frustrated, and in its absence proof of defendant fault and causation would also seem scant. If such an expansion of tort liability were not supported by current tort principles then it would be no better than proposals to switch accident law across to no-fault, since both solutions would require comprehensive legal reform. However Robinson argues that the above three evidentiary requirements could be met in LFRC cases to the same extent that they are met in other currently accepted cases, and hence that his solution would therefore be preferable to no-fault solutions as it would only require incremental but not comprehensive legal reform. Although I believe that actual losses should be present before allowing plaintiffs to seek compensation, I will not present a positive argument for this conclusion. My aim in this paper is not to debate the relative merits of Robinson’s solution as compared to no-fault solutions, nor to determine which account of the cause of the PL&I crisis is closer to the truth, but rather to find out whether Robinson’s solution would indeed require less radical legal reform than, for example, proposed no-fault solutions. I will argue that Robinson fails to show that current tort principles would support his proposed solution, and hence that his solution is at best on an even footing with no-fault solutions since both would require comprehensive legal reform. Il pensiero di Hans Jonas è comunemente inteso nel segno di una netta reazione all’interpretazione gnostica del sé e del mondo. Egli si dedicò allo studio della gnosi dalla metà degli anni venti fino al secondo dopoguerra, e il frutto delle sue ricerche è raccolto nei due volumi di Gnosi e spirito tardoantico (1934, 1964). Questa lettura polemica della sua filosofia è davvero in grado di rendere conto dei rapporti che la proposta jonasiana, come filosofia della biologia e etica della (...) responsabilità, intrattiene con le strutture caratteristiche del mito gnostico? Attraverso una approfondita analisi de Il concetto di Dio dopo Auschwitz, momento nel quale l’approccio unitario della filosofia jonasiana è più evidente, possono essere ritrovati i segni di un confronto positivo con la gnosi. Anche i caratteri del pensiero gnostico, dunque, concorrono a guidare la ricerca di Hans Jonas verso i temi propri della sua riflessione matura. (shrink)

Thinking the Visual, Visualizing the Thought. A perceptual and Political Model of VisionMerleau-Ponty’s program of perceptivizing thought has depoliticizing effects that, though he does not recognize them, undermine his understanding of politics. These anti-political consequences, moreover, bring out the internal difficulties of his anti-intellectualist starting point. There are three areas in which Merleau-Ponty gave a thorough application, though with unequal success, of his perception-based model: the presentation of his own thought, in which his program of picturalization had a striking success; (...) the explanation of the historical process, in which his visualization model was only partly effective; and access to other people’s thought, in which his perceptivist views encountered an undeniable failure. Merleau-Ponty’s successive approaches to other people’s thought show, by two distinct paths, and beyond his own intentions, an unforeseen political defect. His perceptive model proves incompatible with his political ideas when it is applied in depth, and it thus breaks apart the cohesion of his thought. From a larger perspective, it disrupts reflective approaches to politics since it damages their conceptual bases. This article shows successively that Merleau-Ponty laid out a perceptive model of universal scope; that he applied it to several areas, including politics; that this model proves politically deficient when it serves to remove the autochthonous sources of sense; that these depoliticizing effects become more acute when Merleau-Ponty employs the perceptive model to elucidate other people’s thought; and that its frustration in this area not only devalues his political reflections, but also signals that the perceptive model simply prevents a “thinking of the political.”Pensare il visuale, visualizzare il pensiero.Un modello percettivo e politico della visioneIl programma di percettivizzazione del pensiero intrapreso da Merleau-Ponty comporta effetti spoliticizzanti che sconfessano nascostamente la sua comprensione della politica. Tali conseguenze antipolitiche mettono altresì in rilievo le difficoltà intrinseche alla sua posizione anti-intellettualista. Vi sono tre ambiti nei quali Merleau-Ponty, con diverso successo, ha applicato il suo modello percettivo : la presentazione del suo stesso pensiero, nella quale questo programma di pittoricizzazione incontra un successo trionfale; la chiarificazione del processo storico, dove tale modello “visualeˮ non è efficace che in parte; infine l’accesso al pensiero di altri autori, terreno sul quale questa prospettiva percettivista subisce uno scacco innegabile. Molti tentativi merleaupontiani di approcciare il pensiero di altri autori attestano in vario modo un imprevisto deficit politico. Il modello percettivo di Merleau-Ponty si rivela in altri termini incompatibile con le sue idee politiche, nel momento in cui viene applicato in profondità, e in ultima analisi mette a dura prova la coerenza del suo pensiero. In una prospettiva più ampia, esso ostacola un approccio riflessivo alla politica poiché ne degrada le stesse basi concettuali. Il nostro articolo mostra quindi che Merleau-Ponty ha articolato un modello percettivo di portata universale; che l’ha applicato a svariati ambiti d’indagine, tra cui la politica; che quel modello si rivela deficitario quando viene utilizzato per attingere a specifiche fonti di senso; che tali effetti spoliticizzanti si acuiscono nel momento in cui Merleau-Ponty adotta il modello percettivo per illuminare il pensiero di altri autori; che, per concludere, la sua incongruenza con questo peculiare ambito di riflessione non solo impoverisce le sue riflessioni politiche, ma attesta che in linea generale il modello percettivo sbarra la strada a un qualsiasi «pensiero del politico». In questo saggio traccio un profilo del pensiero di Bernard Williams, concentrandomi su temi relativi alla filosofia morale e, più nello specifico, ricostruendo la sua disamina dell’idea di oggettività in questa disciplina. Dopo aver esaminato le sue critiche all’idea di teoria etica normativa, offro un inquadramento metaetico della sua posizione e concludo mostrando le sue affinità con la riflessione etica degli antichi Greci e, in particolar modo, di Aristotele.

Catharine Trotter Cockburn (1679- 1749) fu poetessa, drammaturga e filosofa. La vivacità intellettuale e la forte determinazione le permisero di aggirare il pregiudizio di genere e di sottrarsi alle dinamiche di marginalizzazione femminile tipiche dell’età moderna. Pur celandosi dietro l’anonimato, Cockburn prese parte attiva al dibattito filosofico del tempo, intervenendo soprattutto in materia di morale. Le sue opere filosofiche, scritte in difesa di Locke o di Clarke, custodiscono, nonostante il dichiarato intento apologetico, tratti di originalità e indipendenza, particolarmente evidenti nella (...) teoria dell’obbligo morale, nell’interpretazione modale della dottrina lockeana d’identità personale, nell’ipotesi di una natura ontologica dello spazio.
