The study area was a small lowland river valley (the Łęg river) located in the south-east of Poland. The object of investigation was the macrophytes of 10 river lakes with corresponding active river channel stretches of the same length as the cut-offs. The aim was to check the difference in species diversity between cut-off and active river channels. The second aim was to test the following hypothesis: vegetation of river lake has been shaped under the influence of contiguous river (...) stretch which has left a measurable mark in species abundance and composition. To test this, we checked whether a cut-off channel’s flora is more similar to flora of the contiguous river stretch, than to flora of a farther river stretch. During the course of the study it was found that the average species richness was approximately two times higher in the cut-off channels than in the river stretches. The number of the species exclusive for the river lakes was nine times higher in comparison with the river’s exclusives (not found in the cut-offs). The Shannon diversity index definitely spoke in favor of the river lakes. These results clearly show the significance of river lakes in maintaining biodiversity of aquatic ecosystems in a small river valley. We did not confirm our hypothesis concerning floristic relation between an active channel and its cut-offs. The floristic similarity between a given cut-off channel and the contiguous active river channel stretch is not stronger than the similarity between this lake and more distant river stretches. The cause of such a state of affairs may be high natural dynamics of investigated habitats and anthropogenic transformation of the river valley. (shrink)

Why have Polish philosophers fared so badly as concerns their admission into the pantheon of Continental Philosophers? Why, for example, should Heidegger and Derrida be included in this pantheon, but not Ingarden or Tarski? Why, to put the question from another side, should there be so close an association in Poland between philosophy and logic, and between philosophy and science? We distinguish a series of answers to this question, which are dealt with under the following headings: (a) the role (...) of socialism; (b) the disciplinary association between philosophy and mathematics; (c) the influence of Austrian philosophy in general and of Brentanian philosophy in particular; (d) the serendipitous role of Twardowski; (e) the role of Catholicism. The conclusion of the paper is that there is no such thing as 'Polish philosophy' because philosophy in Poland is philosophy per se; it is part and parcel of the mainstream of world philosophy simply because, in contrast to French or German philosophy, it meets international standards of training, rigour, professionalism and specialization. An axiological analysis of the basis of the 1997 Constitution of the Republic of Poland, determined mainly in the Preamble, makes it possible to put forward a thesis that this axiology is not, at least in reference to the principle, eclectic. In respect of the meta-axiological settlements, this is a tradition of natural-law type, recognizing the objective grounding of values and law. The accepted solutions are also convergent with the axiology typical of the international protection of human rights. -/- (...) Résumé L’analyse des fondements axiologiques de la Constitution polonaise de 1997, inscrits avant tout dans le préambule, permet de formuler la thèse selon laquelle cette axiologie n’est pas, en principe, éclectique. La réflexion sur les valeurs s’inscrit dans la vision classique des fondements du droit, remontant à l’antiquité. Partant de là, se dégage une tradition juridique appuyée sur le droit naturel, reconnaissant la force objective des valeurs et du droit. Ces conclusions rejoignent l’axiologie classique de la protection internationale des droits de l’Homme. -/- Zusammenfassung Die Analyse der vor allem durch die Präambel definierten axiologischen Grundlagen der Verfassung der Republik Polen von 1997 ermöglicht die Aufstellung der These, dass diese Axiologie nicht eklektisch ist, zumindest nicht prinzipiell. Hier enthüllt sich ein Denken von den Werten, das sich in die klassische, bis in die Antike zurückreichende Reflexion über die Grundlagen des Rechts einfügt. Wegen der metaaxiologischen Entscheidungen ist das eine Tradition naturrechtlichen Typs, die die objektive Begründung der Werte und des Rechts anerkennt. Artykuł przybliża łączną analizę tych zagadnień w odniesieniu do kształtowania kapitału społecznego ludzi starych. Kolejno omówione zostają podstawowe pojęcia wykorzystywane w dyskursie o aktywizacji społecznej osób starszych, założenia kształtowania współczesnych wielopoziomowych polityk publicznych w tym zakresie oraz typologie przykładowych rozwiązań na rzecz budowy zasobów kapitału społecznego. De se beliefs typically pose a problem for propositional theories of content. The Property Theory of content tries to overcome the problem of de se beliefs by taking properties to be the objects of our beliefs. I argue that the concept of self-ascription plays a crucial role in the Property Theory while being virtually unexplained. I then offer different possibilities of illuminating that concept and argue that the most common ones are either circular, question-begging, or epistemically problematic. Finally, I argue (...) that only a primitive understanding of self-ascription is viable. Self-ascription is the relation that subjects stand in with respect to the properties that they believe themselves to have. As such, self-ascription has to be primitive if it is supposed to do justice to the characteristic features of de se beliefs. (shrink)

This paper concerns two points of intersection between de se attitudes and the study of natural language: attitude ascription and communication. I first survey some recent work on the semantics of de se attitude ascriptions, with particular attention to ascriptions that are true only if the subject of the ascription has the appropriate de se attitude. I then examine – and attempt to solve – some problems concerning the role of de se attitudes in linguistic communication.

Though it is evident that seriously and irreversibly defective infants are born in Poland, as well as in other socialist countries we do not know really what is the existing medical practice concerning their treatment or non-treatment. No representative empirical investigations were conducted with respect to it. We believe, however, that for the majority of doctors this is not a genuine moral problem at all. They feel simply morally, legally, and professionally obliged to treat those unhappy creatures without any (...) regard to economic and moral cost of treatment. It is highly plausible that this attitude is common to all socialist countries. All the factors mentioned in this paper (religion, ideology, medical education, paternalism, remembrance of Nazi doctors’ criminal practice, the legal situation, and the health care system) have a direct influence on the moral beliefs and attitudes of doctors in socialist countries. And even in those countries in which there are different religious traditions (like the Soviet Union, Yugoslavia, or the German Democratic Republic) there is a deeply-entrenched belief that preserving any human life is the principal and absolute duty of a doctor, one which must be fulfilled at any cost. We should also keep in mind that in this part of the world hardly any distinction at all is made between euthanasia and ordinary murder. (shrink)

Text se zabývá Latourovým pojetím překladu. Poukazuje na některé epistemologické problémy, které vyplývají ze zohledňování překladu jako předmětu zájmu. Tyto problémy lze redukovat na otázku, zda se na výsledné podobě překladu podílí jen poznávající subjekt, nebo také studovaná skutečnost. Podle způsobu řešení této otázky lze rozlišit mezi lingvistickým a nelingvistickým přístupem. Latourovu snahu o systematičtější vymezení překladu lze chápat jako odklon od lingvistické tradice ve prospěch nelingvistických forem podílejících se na vymezení programu epistemologického obratu. V textu jsou v tomto směru (...) diskutovány především problémy redukcionismu, asymetrie, zobecněné symetrie, aktérství a role badatele ve výzkumném procesu. V Latourově perspektivě tento proces není záležitostí fakticity, nýbrž ontologické politiky, v níž dochází k vyjednávání o tom, co činí svět reálným. (shrink)

Comparing the degree of openness of the economy of Poland and the Netherlands, we can say the following. The Netherlands is more dependent on foreign trade than Poland. The Netherlands export quota reaches almost 50%, unlike 41,37% in Poland in 2016. However, Poland has become more import-dependent. Poland, in contrast to the Netherlands, is continuing to increase the indicators of "economic globalization". To date, the Netherlands has been pursuing more moderate foreign trade policy and trying (...) to protect itself from external risks by focusing on an internal market with high purchasing power. On the contrary, Polish politics tries to focus on the new markets for its products in order to increase the prosperity and well-being of its citizens. Poland as a country and an economic entity has made a qualitative leap in its development. The economy of this country has become more open and integrated into the world economy. (shrink)

ABSTRACT. Thought experiments about de se attitudes and Jackson’s original Knowledge Argument are compared with each other and discussed from the perspective of a computational theory of mind. It is argued that internal knowledge, i.e. knowledge formed on the basis of signals that encode aspects of their own processing rather than being intentionally directed towards external objects, suffices for explaining the seminal puzzles without resorting to acquaintance or phenomenal character as primitive notions. Since computationalism is ontologically neutral, the account also (...) explains why neither Lewis’s two gods nor Mary’s surprise in the Knowledge Argument violate physicalism. (shrink)

This chapter addresses the assumed connection between de se attitude ascription and logophoricity in the case of Chinese ziji. It is widely believed that logophors are among the paradigm cases of de se marking, and that long-distance ziji is logophoric. Drawing on a critical examination of a variety of analyses, this chapter argues that long-distance anaphora, de se interpretation, and logophoric marking are overlapping but distinct phenomena. Even if ziji is logophoric, it does not automatically trigger de se requirement. A (...) de se-neutral analysis of ziji is consistent with pragmatic derivations of interpretations that emphasize the self. The findings point to a new approach to long-distance binding, and identify the blocking effect as the key issue for further research. (shrink)

I discuss an aspect of the relation between accounts of de se thought and the phenomenon of immunity to error through misidentification. I will argue that a deflationary account of the latter—the Simple Account, due to Evans —will not do; a more robust one based on an account of de se thoughts is required. O presente artigo pretende explorar a máxima contida em Os irmãos Karamázov (se não há Deus, tudo é permitido?) à luz do pensamento de Immanuel Kant. Para tanto, se vale do pensamento de Dostoiévski apenas na medida em que ele serve como auxílio na apresentação da ideia de Deus e de sua relação com a posição do ateu. Tendo em vista a filosofia kantiana, buscamos não apenas a apresentação dessa ideia, mas também sua relação com o ato moral e com (...) a própria condição desse ato. Isso, portanto, resultará em Kant, uma resposta duplamente negativa à pergunta que reflete a posição ateísta de Ivan Karamazov. Pois Kant ao distinguir o ato moral por dever e conforme o dever, defende que recorrer a algo externo à razão (Deus) constituiria uma vontade meramente heterônoma. Portanto, o ato moral por excelência ocorre quando a ação é realizada de um modo unicamente guiado pela razão, com base num interesse puro, e isso conduz, por sua vez, à reprovação por parte de Kant da referida máxima presente na obra de Dostoiévski. What is the relationship between Frege’s puzzle and the puzzle of the de se? An increasingly influential view claims that the de se puzzle is merely an instance of Frege’s puzzle and that the idea that de se attitudes pose a distinctive theoretical challenge rests on a myth. Here we argue that this view is misguided. There are important differences between the two puzzles. First, unlike Frege puzzle cases, de se puzzle cases involve unshareable Fregean senses. Second, unlike Frege puzzle (...) cases, de se puzzle cases cannot be resolved by objective information alone. Further, there seem to be pure cases of each puzzle: instances of the de se puzzle which do not have a Fregean structure, and instances of Frege’s puzzle, which do not involve de se attitudes. We conclude that the two puzzles are fundamentally different and that the traditional theory of attitudes needs to be amended. (shrink)

Inspired by Castañeda (1966, 1968), Perry (1979) and Lewis (1979) showed that a specific variety of singular thoughts, thoughts about oneself “as oneself” – de se thoughts, as Lewis called them – raise special issues, and they advanced rival accounts. Their suggestive examples raise the problem of de se thought – to wit, how to characterize it so as to give an accurate account of the data, tracing its relations to singular thoughts in general. After rehearsing the main tenets of (...) two contrasting accounts – a Lewisian one and a Perrian one – in the first section of this paper, in the second I will present a proposal of my own, which is a specific elaboration of the Perrian account. In the first section I will indicate some weaknesses of Perry’s presentation of his view; the proposal I will articulate in the second overcomes them. I will conclude with a brief discussion of reasons for preferring one or another account, in particular regarding the issue of the communication of de se thoughts. (shrink)

Chicago: University of Chicago Press, 2011, a zasazuje ji do kontextu současných úvah o proměnách výzkumné praxe sociálních věd, akademické kultury, stylů myšlení a psaní. Pokouší se analyzovat v knize ohlašovaný „obrat k praxi" a ukazuje, nakolik samotné výzkumné praktiky v sociálních vědách ovlivňuje neexistence „standardních" forem, způsobů či stylů bádání. Detailně jsou představeny rovněž výchozí myšlenky takzvané „nové" sociologie idejí, jež stojí v (...) pozadí celého projektu analýzy sociálních praktik projevujících se v procesech „produkce, evaluace a aplikace" sociálního vědění. Jako klíčová se ukazuje potřeba nově promyslet samotnou koncepci „profesionalizované" sociální vědy, jež byla v dřívějším vývoji odmítnuta jako morálně i prakticky neudržitelná, neboť s demokratizací výzkumného procesu a proměnou vztahu mezi sociálními vědami a jejich publikem se stále zřetelněji projevuje, že s odklo- nem od konceptu profesionální sociální vědy se veřejná irelevance sociálního vědění spíše stále více prohlubuje. Typical puzzles for de se attitudes by Perry and Lewis are laid out and contrasted with the original version of Jackson's Knowledge Argument. It is argued, from an epistemic perspective, that de se attitudes can be explained by looking at the way internal/introspective knowledge is formed without resorting to acquaintance or making assumptions about the Mind/Body problem.

De se thoughts have traditionally been seen to be exceptional in mandating a departure from orthodox theories of attitudes. Against this, skeptics about the de se have argued that the de se phenomena demand no more of our theories of attitudes than traditional Frege cases. In this camp one view is that the de se can be accounted for by MOPs in the same way that MOPs can account for how it can be rational to believe, for instance, ”Hesperus is (...) shining” while also believing ”Phosphorus is shining.” This paper formulates some minimal conditions that de se MOPs must have in order to explain the relevant de se phenomena. Some potential replies are answered. I conclude that de se MOPs are not exceptional. (shrink)

This chapter aims at describing the role of housing in the ageing population, on the example of Poland, which is one the fastest ageing country in the world. This issue is significant because housing well suited to the needs of older people means lower expenses in medical and social care. Seniors living in proper conditions remain not only longer healthy, but they may also stay longer active in the labor market. Housing adoption to the needs of an older population (...) means a particular challenge for Poland, where the majority of the housing stock was created in socialism and is inhabited by large by older people. It is crucial to raise awareness of age-friendly housing among the seniors, their relatives, architects, and policymakers. This purpose serves the first model apartment for seniors in Poland, which was created by the chapter's authors. (shrink)

In this paper I examine an argument that has been made by Patrick Grim for the claim that de se knowledge is incompatible with the existence of an omniscient being. I claim that the success of the argument depends upon whether it is possible for someone else to know what I know in knowing (F), where (F) is a claim involving de se knowledge. I discuss one reply to this argument, proposed by Edward Wierenga, that appeals to first-person propositions and (...) argue that this response is unsuccessful. I then consider David Lewis’s theory of de se attitudes involving the self-ascription of properties. I claim that, according to this theory, there are two senses in which someone else can know what I know in knowing (F). I then argue that the second sense allows for the compatibility of de se knowledge with the existence of an omniscient being. (shrink)

Nowadays, in the context of the growing migration of the Muslim population in Europe, caused by the wars in Syria and other areas, the question is increasingly being asked whether there is a danger of „Islamization of Europe” following the „clash of civilizations”. The last formula is not new. It created a real dispute in the past. But the discussions must also take into account other questions that are currently being asked: is there still a Christian Europe? Is it possible (...) to speak of an intrinsic conflict between Christianity and Islam, which erupts at certain periods of time? In this study we will focus on the topic of „clash of civilizations”, the impact that this formula had in the world at the end of the twentieth century and the connotations it has for our times. The topic of research starts from the realities that no one can dispute, globally emphasizing the problems that affect people: conflicts in various territories, difficult economic situations in certain regions of the world, reaching financial crises and important social changes, in which the majority populations have to live with minorities that, most of the time, they do not know and do not accept. This essay offers a proposal for how to understand the idea that there is a special connection between de se attitudes and the explanation of action.

De se attitudes seem to play a special role in action and cognition. This raises a challenge to the traditional way in which mental attitudes have been understood. In this chapter, we review the case for thinking that de se attitudes require special theoretical treatment and discuss various ways in which the traditional theory can be modified to accommodate de se attitudes.

_(MA thesis)_ Immunity to error through misidentification (IEM) describes a sort of immunity against such a situation that the thinker wrongly identifies something as other things. Philosophers consider it as being especially relevant to first-person or de se judgments. Many philosophers seem to advance IEM as an alternative to a Cartesian method of defining first-person privilege and of circumscribing the first-person perspective. However, as more and more representative instances are substantiated as being vulnerable to error through misidentification, it is thus (...) necessary to offer an account sufficient to explain IEM. Then, there are roughly two approaches in the literature: the identification-freedom approach and the metasemantic approach. The former is characterised by the claim that the presence of IEM is always explained by the absence of an identificatory-component in the thought's grounds. The latter is more heterogeneous than the former. Nevertheless, it can be roughly described by their focus on explaining the IEM of de se thoughts based on an account of how the reference of de se thoughts is fixed, rather than just on the grounds of particular de se thoughts. However, there are still some problems with the existing accounts. More specifically, some problems from the indexical thoughts put at risk Recanati's appeal, which is viewed as a representative of the metasematic approach. Nonetheless, I think these problems can be resolved competently by pointing out the fact that there are three levels of reflection in introspection. Thoughts produced by the first level of reflection (first-level thoughts, hereafter) correspond to Recanati's implicit thoughts; Third-level thoughts are Recanati's explicit thoughts (whether it is made explicit by an extra reflective act, as Recanati puts it). However, second-level thoughts, which include a sort of aboutness in their content, could explain the subject appearing in indexical statements with IEM, guaranteeing IEM of these thoughts in the meanwhile. Background: Biomedical research nowadays is increasingly carried out in multinational and multicenter settings. Due to disparate national regulations on various ethical aspects, such as informed consent, there is the risk of ethical compromises when involving human subjects in research. Although the Declaration of Helsinki is the point of reference for ethical conduct of research on humans, national normative requirements may diverge from its provisions. The aim of this research is to examine requirements on informed consent in biomedical research in Germany, (...) Poland, and Russia to determine how each national regulatory framework relates to the provisions of the Declaration of Helsinki. Methods: For this analysis, we conducted a search of the legal databases “Gesetze im Internet” for Germany, “Internetowy System Aktow Prawnych” for Poland, and “ГAPAHT – Garant” for Russia. The search was complemented by a review of secondary literature contained in the databases Google Scholar, PubMed, Polish National Library, and eLibrary ru. We have identified 21 normative regulations containing provisions on informed consent in clinical research in all three countries. The content of these documents was systematically categorized and analyzed. Results: The normative framework in all three countries shows a strong commitment towards the core ethical principles of research envisaged in the Declaration of Helsinki. Nevertheless, provisions on informed consent vary between these three countries. The differences range from the method and language in which information should be provided, through the amount of information required to be disclosed, to the form of documenting consent or withdrawal. In the case of research on vulnerable groups, these differences are particularly visible. Conclusions: The identified differences can negatively impact the ethical conduct of international clinical studies. Attention needs to be paid that flexibilities within national regulations are not misused to undermine the protection of research subjects. Achieving global or regional legislative harmonization might prove impossible. Such lack of legal consensus reinforces the significance of the international ethical agreements. (shrink)

Studie poukazuje na tři základní slabiny současného českého diskurzu o kolapsech komplexních společností, jehož předním mluvčím se stal egyptolog Miroslav Bárta. Zaprvé nedošlo k vyrovnání s absencí vědeckého konsenzu ohledně determinantů historického vývoje a teorii, která by poskytla jednotící rámec pro zařazení a interpretaci konkrétních prediktorů kolapsu, byla věnována jen minimální pozornost. Zadruhé nebyla podána jasná odpověď na otázku, která společenská struktura je při studiu kolapsu vlastně předmětem zkoumání, přestože se volné přechody mezi rovinami kultur, států a civilizací nejeví z (...) analytického hlediska možné. Zatřetí se řada navržených prediktorů kolapsu ukazuje už při zběžném ohledání jako zásadně problematická. Studie dochází k závěru, že současný stav poznání problematiky kolapsů komplexních společností neospravedlňuje vyslovování žádných vědecky podložených predikcí, které by mohly být zdrojem pragmatické legitimizace pro společenské a humanitní vědy. The development of new methods in the field of prenatal testing leads to an expansion of information that needs to be provided to expectant mothers. The aim of this research is to explore opinions and attitudes of gynecologists in Germany, Poland and Russia towards access to prenatal testing and diagnostics in these countries. Semi-structured interviews were conducted with n = 18 gynecologists in Germany, Poland and Russia. The interviews were analyzed using the methods of content analysis and thematic (...) analysis. Visible in all three countries is a connection of prenatal medicine with the politically and socially contentious issue of pregnancy termination. Respondents in Poland and Russia concentrated on the topic of inadequate resources. Quality of information for expectant mothers is an important point in all three countries. Only in Germany was the issue of language barriers in communication raised. With regard to non-invasive prenatal testing (NIPT) respondents in Germany focused on the ethical issues of routinization of testing; in Poland and Russia they concentrated on fair access to NIPT. Challenges in all three countries arise from structural factors such as imprecise and prohibitive regulations, lack of resources or organization of healthcare services. These should be addressed on a political and medico-ethical level. (shrink)

The article discusses the presence of Plato' philosophy in Poland including the presentation of the reception of Plato's texts and the knowledge of Plato's philosophy in Poland. It outlines the influence exerted by Plato's thought on various aspects of Polish culture and sets out the research on Plato in the XIX and XX centuries. The paper is supplemented with a selection of contributions concerning Plato (papers, monographs, translations) published in Poland after the year 1945.

Background: The internationalization of clinical studies requires a shared understanding of the fundamental ethical values guiding clinical studies. It is important that these values are not only embraced at the legal level but also adopted by clinicians themselves during clinical studies. Objective: Our goal is to provide an insight on how clinicians in Germany and Poland perceive and identify the different ethical issues regarding informed consent in clinical studies. Methods: To gain an understanding of how clinicians view clinical studies (...) in the countries they work in, we carried out semi-structured problem-centered interviews per telephone in Poland (n = 6) and Germany (n = 6). Our interviewees concentrated on three main topics: an appraisal of the normative framework, challenges in the information process and the protection of all participants in clinical studies. Results: Clinicians generally supported the normative framework, even though they considered it quite complex. In the two study countries, a widely noted dilemma in the information process was whether to overburden participants with extensive information or risking leaving out important facts. Clinicians were ready to exclude larger population groups from participating in clinical studies when the information process could not be carried out with standard procedures or when their inclusion was ethically sensitive. Conclusion: Clinicians need to gain a better understanding of the consequences of excluding larger population groups form participating in clinical studies. They should seek assistance in improving the information process for the inclusion of underrepresented groups in clinical studies. (shrink)

Colin Howson (1995 ) offers a counter-example to the rule of conditionalization. I will argue that the counter-example doesn't hit its target. The problem is that Howson mis-describes the total evidence the agent has. In particular, Howson overlooks how the restriction that the agent learn 'E and nothing else' interacts with the de se evidence 'I have learnt E'.

Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral (...) assessments may have the nature of judgments and truth qualification (they may be true or false). In the course of application of the constitution, norms of natural-law character and natural-law justification. Since dignity and the essence of freedoms and rights based on dignity are the only inviolable values recognized by the constitution, the arguments of natural law lead to a far-going reinterpretation of constitutional norms. The norm of natural law protecting inviolable values will have precedence in the event of collision with norms protecting other values, also with constitutional norms. Even if such a norm is formulated on the basis of the provisions of the constitution, in fact natural law is given higher rank than elements based only on enacted law. Despite that, reliability of a legally established order does not seem to be radically endangered. -/- Konstytucja RP uznając przyrodzoność i niezbywalność godności oraz uniwersalność niektórych wartości, wprowadza do podstaw całego polskiego systemu prawnego elementy prawnonaturalne, które mogą być wykorzystane w stosowaniu konstytucji. Konstytucyjne uznanie takich elementów ma sens przy założeniu ich poznawalności, stąd istotnym elementem konstytucyjnej koncepcji prawa naturalnego jest uznanie tezy kognitywizmu głoszącej, że oceny moralne mogą mieć charakter sądów i kwalifikację prawdziwościową – mogą być prawdziwe lub fałszywe. W procesie stosowania konstytucji mogą być formułowane normy o charakterze prawnonaturalnym oraz uzasadnienia prawnonaturalne. Ponieważ jedynymi wartościami uznanymi w konstytucji za nienaruszalne jest godność oraz istota wolności i praw, których godność jest źródłem, argumentacja prawnonaturalna może prowadzić do daleko idącej reinterpretacji norm konstytucyjnych. Norma prawnonaturalna chroniąca warunki konieczne poszanowania godności lub istoty wolności i praw będzie miała pierwszeństwo w razie kolizji z normami chroniącymi inne wartości, także z normami konstytucyjnymi. Choć norma taka będzie formułowana na podstawie przepisów konstytucji, to jednak faktycznie prawo naturalne uzyskuje wyższą rangę od elementów opartych jedynie na stanowieniu. Mimo tego bezpieczeństwo prawne nie wydaje się być radykalnie zagrożone. O prawnonaturalnym charakterze normy i uzasadnienia decyduje oparcie w ocenach moralnych, które pretendują do bycia sądami, do bycia prawdziwymi lub fałszywymi. Z punktu widzenia stosowania konstytucji i wymogu intersubiektywnej komunikowalności i kontrolowalności dookreślania treści prawnonaturalnych, dla nadania ocenom charakteru sądów istotny jest kształt procedur i argumentacji prowadzących do tego dookreślenia. Powinny to być procedury i argumentacja typowe dla dyskursu mającego na celu sformułowanie prawdziwych sądów. Maksymalizowana powinna być dyskursywność takich procedur, a podstawą rozstrzygnięcia powinien być, jeśli to tylko możliwe, konsens. Nie mogą być uważane za rozstrzygające argumenty odwołujące się do woli indywidualnej lub zbiorowej, reakcji emocjonalnych, stopnia rozpowszechnienia danej oceny czy do tradycji kulturowej. (shrink)

The article deals with relations between the individual and human rights on the one hand, and the State on the other, in the context of the Constitution of the Republic of Poland. The author poses the question whether the idea of subordination of the State to the individual is really a central idea of that constitution. He puts forward many arguments against such suggestion. These arguments relate, above all, to the arrangement of the constitution: a chapter concerning human rights (...) is chapter II, while chapter I deals with foundation of the State; the goals of the State are specified in the preamble including the following initial phrase “the existence and future of Poland as our Homeland” and in Article 5 where human rights are as subject of protection by the State is mentioned after independence and integrity of [its] territory; a general concept of human rights protection adopted in the constitution is dominated by the structures typical of law in its objective sense; the way of regulation admissible limitations on human rights differs from international standards; possibility of claiming human rights is constitutionally guaranteed, mostly by constitutional complaint which is above all aimed at correction of legal system, rather than claiming of rights by the individual; Article 1 (“The Republic of Poland shall be the common good of all its citizens”) interpreted as referring to Article 1 paragraph 1 of the April Constitution of 1935, one of the main ideas of which was precedence of the State over the individual. He also analyses the arguments in favour of the recognition of the idea of subordination of the State. Nevertheless, they cannot be accepted as resolving the question of whether it is a central idea of the constitution. These arguments include in particular: the principle of subsidiarity contained in the preamble, even if it has not been appropriately emphasized there; recognition of inherent and inalienable dignity of the person, but it was not until Article 30 that this provision has been contained and it does not determine the relations between the human dignity and rights and the State. The author suggests that the only conclusive way to justify the subordination of the State in relation to the individual as a central idea of the constitution is by means of Article 1. Taking into account, above all, preparatory work, we should reject the interpretation of that article referring to the April (1935) Constitution. Essential interpretative context may be found in preparatory work and social teachings of the Catholic Church, referred to therein. In that case, the common good means the entirety of the conditions of social life which favour the human development. These conditions include above all the respect for human dignity. Such interpretation of Article 1 gives priority to proposals on what the State should be to serve the individual rather than to safeguard obligations of citizens in relation to the State. (shrink)

This article first of all attempts to assess the proposals of 2006–2007 to amend Poland’s Constitution, aimed mostly at strengthening constitutional protection of unborn human life. Parliamentary work on this proposal begins with the submission of the Deputy’s bill on amendment of the Constitution, published in the Sejm Paper No. 993 of September 5, 2006, and ends with a series of votes at the 39th sitting of the Sejm of the fifth term of office, held on April 13, 2007, (...) on which it was decided not to adopt any amendment. In the course of the legislative process, several modifi cation were offered not only to Article 38 concerning protection of life, but also to Article 30 dealing with dignity as a source of rights. Each of these proposals had drawbacks, including inter alia: the lack of a definite period of protection or entitlement to dignity, resulting in the decreased protection in relation to issues concerning euthanasia; the application of new categories granting a specific status to unborn human life; specifying the standards for protection by means of legislative acts ranking lower than a constitution, resulting in the transfer of life protection into the sphere of regulation of ordinary legislation. The most conducive for strengthening of the protection of unborn human life, even if not free of imperfections, was an amendment of Article 30 proposed by the Committee in the following wording: “The inherent and inalienable dignity, conferred on the person from the moment of conception, shall be a source of freedoms and rights of persons and citizens. It shall be inviolable; the respect and protection thereof shall be the obligation of public authorities.” From the rejection of the proposals it is diffi cult to draw conclusions that are vital for interpretation of the existing provisions. However, a conclusion that the intention of the authors of the constitution was not to strengthen the constitutional protection of life is not legitimate, mostly because of their doubts about formal correctness of the proposed amendments (when deciding to reject them), particularly the doubts about legal consequences of their adoption. -/- Streszczenie Zasadniczym celem opracowania jest próba całościowej oceny propozycji nowelizacji Konstytucji RP mającej miejsce w latach 2006-2007, zmierzającej przede wszystkim do wzmocnienia konstytucyjnej ochrony życia człowieka przed narodzeniem. Prace parlamentarne nad analizowaną nowelizacją otwiera poselski projekt ustawy o zmianie Konstytucji zawarty w druku sejmowym 993 z dnia 5 września 2006 (projekt wpłynął do Sejmu 7 września); zamyka seria głosowań na 39 posiedzeniu Sejmu V kadencji, dnia 13 kwietnia 2007 roku; głosowań, które przesądziły o niewprowadzeniu żadnych zmian. W trakcie procesu legislacyjnego proponowano szereg formuł, zmieniających nie tylko art. 38 dotyczący ochrony życia, ale także art. 30, który dotyczy godności jako źródła praw. W zasadzie wszystkie zgłoszone propozycje posiadały wady, wśród których najważniejsze to: brak domknięcia okresu ochrony lub przysługiwania godności, skutkujący obniżeniem ochrony w kwestiach związanych z eutanazją; stosowanie nowych kategorii, prowadzące do nadania specyficznego statusu człowiekowi przed narodzeniem; określanie standardu ochrony za pośrednictwem aktów o randze niższej od konstytucji, prowadzące do przesunięcia ochrony życia przed narodzeniem w sferę ustawodawstwa zwykłego. Z punktu widzenia celu, jakim było wzmocnienie konstytucyjnej ochrony życia człowieka przed narodzeniem i wzmocnienie jego pozycji prawnej, najlepsza, choć nie pozbawiona usterek, była zaproponowana przez Komisję zmiana brzmienia art. 30 prowadząca do formuły: „Źródłem wolności i praw człowieka i obywatela jest przyrodzona i niezbywalna godność człowieka, przynależna mu od chwili poczęcia. Jest ona nienaruszalna, a jej poszanowanie i ochrona jest obowiązkiem władz publicznych.”. Na podstawie odrzucenia propozycji zmian trudno wyciągać wnioski istotne dla interpretacji aktualnie obowiązujących przepisów; wniosek, że ustrojodawca nie chciał wzmocnienia konstytucyjnej ochrony życie nie jest prawomocny, przede wszystkim ze względu na – istotne w procesie podejmowania decyzji o odrzuceniu propozycji zmian – wątpliwości, co do formalnej poprawności formułowanych propozycji, w tym wątpliwości co do konsekwencji prawnych ich przyjęcia. Adults aged 65 and above comprise the fastest growing sector of the world’s population. In the context of increasing numbers of older adults, employment policies have become a prominent issue. Governments recognize the importance of increasing participation in working age population and providing them with equal workplace opportunities. Yet, it appears that policies raising employment rates of older adults have become a slogan that governments use for election purposes, but the reality is different. In the groundbreaking report “Working Better with (...) Age: Poland‘ prepared by the Organization for Economic Cooperation and Development, Poland, the Czech Republic, and Slovakia belong to a group of countries where the increase in the employment rate of older adults is well below the OECD average. The objective of our critical review is to evaluate current employment policies for older adults, including but not limited to healthy work conditions, age management strategies, employment services for older workers, and strategies implemented to prevent the age discrimination, in these three countries. This article also discusses the reasons for the reduction in the employment of older adults, the current barriers in employing older adults that require governments’ attention, and suggests solutions for creating an age-friendly labor market that can effectively make use of older adults’ competencies. Employment rates for people of different ages are significantly affected by government policies with regard to higher education, pensions, and retirement age. (shrink)

There is currently disagreement about whether the phenomenon of first-person, or de se, thought motivates a move towards special kinds of contents. Some take the conclusion that traditional propositions are unable to serve as the content of de se belief to be old news, successfully argued for in a number of influential works several decades ago.1 Recently, some philosophers have challenged the view that there exist uniquely de se contents, claiming that most of the philosophical community has been under the (...) grip of an attractive but unmotivated myth.2 At the very least, this latter group has brought into question the arguments in favor of positing special kinds of content for de se belief; I think they have successfully shown that these arguments are not as conclusive, or fully articulated, as many have taken them to be. In this paper I will address these challenges directly and I will present and defend an argument for the conclusion that the phenomenon of de se thought does indeed motivate the move to a special kind of content, content that is uniquely de se. First, I characterize a notion of de se belief that is neutral with respect to friends and foes of uniquely de se content. I then argue for a determination thesis relating de se belief to belief content: that there is no difference in de se belief without a difference in belief content. I argue that various proposals for rejecting this determination thesis are unsuccessful. In the last part of the paper, I employ this determination thesis to argue for the existence of a type of belief content that is uniquely de se. (shrink)

In the chapter, there is an analysis of sharing economy development in Poland. It concerns both the big players on the market like the most known Airbnb and Uber, as well as smaller, local initiatives, flourishing especially in the food sector. Sharing economy is not a normative concept and is defined differently depending on the subject to which it refers. However, the significance of the phenomenon is rising rapidly from year to year. Moreover, sharing economy brings many opportunities but (...) also creates a lot of unsolved issues, such as regulations, tax regulations, labour law, competition, which often can lead to conflicts between diverse groups of actors. The new, unregulated, by law, model of the economy in some sectors has caused a lot of confusion, leading to conflicts, as well as a feeling of inequality. (shrink)

Two lines of investigation into the nature of mental content have proceeded in parallel until now. The first looks at thoughts that are attributable to collectives, such as bands' beliefs and teams' desires. So far, philosophers who have written on collective belief, collective intentionality, etc. have primarily focused on third-personal attributions of thoughts to collectives. The second looks at de se, or self-locating, thoughts, such as beliefs and desires that are essentially about oneself. So far, philosophers who have written on (...) the de se have primarily focused on de se thoughts of individuals. This paper looks at where these two lines of investigations intersect: collective de se thoughts, such as bands' and teams' beliefs and desires that are essentially about themselves. There is a surprising problem at this intersection: the most prominent framework for modeling de se thoughts, the framework of centered worlds, cannot model a special class of collective de se thoughts. A brief survey of this problem's solution space shows that collective de se thoughts pose a new challenge for modeling mental content. (shrink)

Este artigo desenvolve uma leitura do livro de Jacques Derrida, Mal de arquivo, com o objetivo de situar o que se poderia chamar de concepção derridiana de arquivo. Ao desdobrar o potencial de conflito que se arquiva na própria palavra "arquivo", Derrida oferece uma concepção de arquivo que, para além das discussões desenvolvidas no livro em questão, abre a possibilidade de uma nova forma de se pensar o âmbito da política. This article develops a reading of Jacques Derrida's book, Archive (...) Fever, with the aim of circumscribing what could be named the Derridian conception of archive. By unfolding the conflictive power which is archived within the proper word "archive", Derrida comes with a conception of archive that, beyond the discussions developed in the book, opens the possibility of a new way of thinking the political. This chapter presents the successive stages to make changes in the Polish development policy after 1989. The national administration reform of 1990 in the Third Commonwealth of Poland restored the local government after 40 years of non-existence during the time of Polish People’s Republic that was a satellite state of the Soviet Union after the Second World War. Another reform took place in 1998 as a part of preparations for the country’s membership in the European Union from 2004. Currently (...) developed strategic documents are suggesting the use of the "polarization and diffusion model of the development." The authors also discuss the regional policy currently implemented in Poland, which was designed in years 2009-2014. The process of creation of new policy includes plans to reform the policy instruments and to update the strategic framework. Conclusions highlight a need for a clearer division of powers between the center and regional governments and the importance of strengthening the financial basis and institutional capacity building. O presente ensaio pretende apresentar uma série de distanciamentos fundamentais entre o pensamento do italiano Gianni Vattimo, centrado no conceito de pensamento fraco, com a ontologia heideggeriana. A problemática consiste no confesso fato de Vattimo basear seu pensamento na filosofia de Heidegger; contudo, sob forte influência do pensamento de Nietzsche, o filósofo italiano acaba por desvirtuar certos conceitos cruciais da filosofia heideggeriana, conduzindo-a a conclusões diametralmente opostas às suas. Vattimo assevera, assim, que há um elemento niilista que perpassa toda a (...) ontologia heideggeriana, não, contudo, apenas como um sintoma de uma sociedade decadente e indefinida, mas julga esta mesma ausência de sentido como a própria superação da metafísica tão almejada pela filosofia da história de Heidegger. One of the key challenges of social policy in Poland in the early 21st century is to adapt its management to the requirements of a service economy. Essential conditions for the mixed economy of welfare have been already created after adjustments of the subsystems of national social policy during the first years of membership in the European Union since 2004. Labour market policies already include the relationships between providers from the public sector, the commercial sector, and the non-governmental sector. (...) However, the tasks and services of individual entities and institutions still lack coordination and integration. This paper focus on the examples of possibilities for their development by combining the activation policy with concepts of the governance and welfare mix. The paper presents the results of the author’s research on the implementation of welfare mix solutions in the field of professional activation of the unemployed people in Poland. Two case studies are included the implementation of outplacement programs that are based on the cooperation between different entities; and the cooperation between the public employment services and non-governmental employment agencies in the activation of people with disabilities in the labour market. Moreover, basic concepts of ongoing reforms of active labour market policies in Poland were discussed. The summary contains the practical recommendations and possible directions for further research in the field of integration of employment services. (shrink)

Principles of chance deference face two kinds of problems. In the first place, they face difficulties with a priori knowable contingencies. In the second place, they face difficulties in cases where you've lost track of the time. I provide a principle of chance deference which handles these problem cases. This principle has a surprising consequence for Adam Elga's Sleeping Beauty Puzzle.
