The necessity of a continuous creation by God, the need of a creation that is prolonged in the time, is an important issue in the Metaphysics of Descartes; for the being of the human conscience is not so persistent and so strong as the being of a really substance. Newman remains an ecumenical figure held in high esteem by Roman Catholics and Anglicans. His ecumenical hermeneutics is observable in Tract No. 90. This Tract is a re-reading of the Thirty-nine Articles of Religion ratified in 1571 as the fundamentals of the Anglican faith. This tract is the product of the Oxford Movement that returned to the Antiquity in view of resolving the Anglican faith crises epitomized by erastianism. This return to the Fathers of the Church had a lot of (...) implications for the Anglican faith. Influenced by Antiquity, Newman rediscovered the common grounds between the Anglican faith and the church Catholic that inheres in the Roman Church. Thus, Tract No. 90 demonstrated that more things united the Nineteenth Anglicans and the Roman Catholics than what separated them. (shrink)

Thirty years ago, I elaborated on a position that could be seen as a compromise between an "extreme," symbol-based AI, and a "neurochemical reductionism" in AI. The present article recalls aspects of the espoused framework of schema theory that, it suggested, could provide a better bridge from human psychology to brain theory than that offered by the symbol systems of A. Newell and H. A. Simon.

El objetivo del texto de Del Río es cuádruple: primero, busca documentar la exclusión de la que han sido víctimas las mujeres mexicanas a partir del análisis de diecisiete obras de historia de la filosofía mexicana publicadas entre 1943 y 2018; segundo, mostrar que dicha exclusión, además de presentar una imagen distorsionada del quehacer filosófico en nuestro país, comete un injusticia contra las mujeres y la comunidad filosófica nacional; tercero, defender que el aparato conceptual sobre injusticia epistémica que Miranda Fricker (...) Purpose: To develop proposals on the directions of institutional support for the processes of creativity of the Ukrainian economy. Design/methodology/approach: The analysis of trends in the creativity of the Ukrainian economy is carried out and proposals are developed for conceptualizing institutional support for these processes. The authors set out to develop proposals for institutional support for creativity processes and offer recommendations for systematic updating of Ukrainian legislation in the areas of state regulation of high-tech business. The information base was the (...) information materials of the State Statistics Service of Ukraine, Ministry of Economic Development and Trade of Ukraine, the statistical databases of the European Commission, OECD and World Bank for the period 2014–2020. The research methodology is based on scientific tools that include comparative analysis and economic and mathematical modeling. Findings: Building a national program of public investment in creative development will allow us to systematically approach the issue of institutional support for technological breakthroughs. Research limitations/implications: Recommendations on the development and improvement of legislative instruments of deregulatory policy, harmonization with European standards are substantiated. Directions of systematic updating of legislation on guaranteeing foreign investment of creative projects and targeted investment of joint research projects of academic science and creative organizations are proposed. The implementation will allow a systematic approach to the issue of institutional support for the technological breakthrough of Ukraine. Originality/value: There is a need to step up institutional activities in the field of organizing research centers, introduce targeted investment in the academic science and research activity of creative organizations. In this very brief comment, I try to show that the "drowning case" posed by McGowan et al. is not a good challenge to Hornsby & Langton's account of silencing, despite the fact that I agree with them in that the systematicity condition is not clear at all in Hornsby & Langton's account.

This book represents more than a decade of work (p. ix) by this eminent scholar. It is intended primarily for scholars of Classical Greek; however, F.’s laudable practice of, in most cases, providing English translations and repeating them when needed, makes it accessible to non-specialists and undergraduates, as he intended (pp. ix–x).

This study, by using 142 groups of data from 1990 to 2007 and the method of cross-temporal meta-analysis, researched the changing trend of status of mental health of 108736 members of the Chinese Army along with the change of years. All the data came from 94 related research reports, and all the research reports used SCL-90 (the Symptom Checklist 90) as the testing tool of mental health. The study found that: (1) mental health of members of the Chinese Army steadily (...) improved between 1990 and 2007; (2) during those 18 years, the Interpersonal Sensitivity factor of SCL-90 of Chinese Army members changed most significantly, and the least significantly changed factor was Somatization; (3) Chinese Army members showed evidence of fewest problems on the Photic Anxiety factor, in contrast to the consistent problems indicated by scores on the Obsessive-Compulsive and Interpersonal Sensitivity scales; (4) Chinese Army members from single-child families (N =1,944) showed significant lower evidence of positive mental health than soldiers from multiple child families (N =2,649); (5) The mental health of soldiers from non-agricultural backgrounds (N =7,808) was less positive than that of soldiers from agricultural households(N =11,459); (6) Chinese Army members with senior high school education level (N = 10,189) had less positive mental health than those with junior high school (N = 8,407) or university education (N = 863). Ngunit hindi din dapat kaligtaan ang isa pang temang maaaring umusbong mula dito—ang kalagayan at danas ng mga karakter, hindi lamang bilang mangingibig, kundi bilang manggagawa din. Kung gayon, pagkalas ito panandalian sa kinasanayang pagtrato sa mga romantic movie ng mga Pilipino sa payak (...) nitong anyo bilang kuwentong pag-ibig lamang. Bagkus, malaong holistikong magsisiwalat sa malawakang diaspora at realidad ng paggawang Pilipino sa iba’t ibang bahagi ng mundo. Bagaman hindi pa tapos ang serye, mahalaga pa ring tingnan ang kahalagahan ng Trese bilang holistikong paglalarawan sa imahe ng kultura at lipunang Pilipino. Sa pamamagitan ng labintatlong (13) malikhain at faktuwal na representasyong alegorikal ng Trese, nailatag ang saklaw (...) at ispektrum ng pagka-Pilipino. Ang pag-aaral na ito ay naglalahad ng isang komprehensibong istruktura ng gramatika na nakatuon sa katangian ng Nawn Preys (NP). Ito ang kauna-unahang pag-aaral na nakapokus sa katangian ng NP ng isang varayti ng wikang Waray na wala pang anumang naisagawang pag-aaral. Ang balidasyon, muling pagsusuri, at pag-aanalisa sa mga datos ay ginawa mismo ng mananaliksik bilang taal na mananalita ng Biri-Waray at sa gabay ng tagapayo. Ang mga kinapanayam ay mga nasa edad 47- 67 at mga taal na mananalita (...) ng Biri-Waray. Sila ang siyam (9) na piniling kapanayamin sapagkat bukod sa sila ay taal na mananalita ng Biri-Waray, nakapagtapos din sila ng pag-aaral at may ganap na pag-unawa sa gramatika. Ang listahan ng mga pangungusap na may kabuuang 384 ay nakasulat sa wikang Tagalog na isinasalin nang mga informant nang pasalita. Mula sa pag-aaral, sinuri ang mga katangian ng Nawn sa Biri-Waray, mga konstityuwent na bumubuo sa iba’t ibang anyo ng NP sa Biri-Waray, at iba’t ibang gamit ng NP sa istrukturang gramatikal sa Biri-Waray. Ang implikasyon sa mga teyorya sa pagkakapare-pareho ng mga wika sa istrukturang gramatikal ay nakabatay pa rin sa katangian ng isang wika. Isa na rito ang proseso paglilipat ng posisyon sa sabjek sa unahang bahagi ng gramatikal istraktyur na hindi nangyayari sa Biri-Waray sa mga nan-verbal na pangungusap kapag ang predikeyt at sabjek ay parehong may nominal marker an ‘ang’. Dulot ito ng walang direktang katumbas o zero (ø) ‘ay’ order marker ng wikang Tagalog ang Biri-Waray. Isa ito sa nakitang kahalagahan ng pagsusuri na magagabayan higit lalo na ang mga hindi taal na mananalita ng Biri-Waray sa pag-unawa sa gramatikal na istukrtura ng naturang wika. (shrink)

Kaya’t tila isang melodramatiko o mala-teledramang inaabangan ng mga manonood at tagapakinig ang bawat pahayag ni Duterte habang pinamamayani ng huli ang mga 'birong' nagpapatingkad sa impunidad ng karahasan sa kababaihan, misogynista, at sexismo. Sa ilang pagkakataon, literal na ibinida ng populistang pangulo ang kaniyang phallus o titing nakatayo bilang larawan ng pagiging lalaki, matapang, at malakas at upang (...) yurakan hindi lamang ang kababaihan ngunit para ipamukha ang 'kahinaan' ng mga kritiko. Kinalaunan, umusbong sa midya ang pagbabansag kay Duterte bilang 'Mang Kanor,' isang personalidad na ipinamamalas ang exhibisyonismo sa anyo ng mga pornograpikong bidyo. Inihahain din ng mga may-akda ang mga sumusunod na tanong: Paano naaapi ang babaeng may BRCA? Paano hinahamon ng kanyang karanasan ang konsepto ng seksuwalidad? Maaari bang ituring ang kanyang karanasan bilang anyo ng pagbalikwas? Tutugunan ng mga may-akda ang naturang mga tanong gamit ang kapangyarihan-diskurso-seksuwalidad ni Foucault habang ipinapalagay na: (1) matagumpay na naipapakita ng talaangkanan ng seksuwalidad ni Foucault kung paanong (...) ang seksuwalidad, bilang isang diskursibong kontrak, ay ginagamit bilang isang teknik ng pangongontrol, at (2) nabibigyan tayo ni Foucault ng isang paraan ng pag-unawa sa kung papaano tumutugon ang indibidwal sa iba’t ibang sistema ng kontrol, maging ng isang balangkas na makapagpapaliwanag sa maraming relasyong pangkapangyarihan na siyang tumutukoy sa moda ng pag-iral ng indibidwal. Nahahati ang papel na ito sa tatlong pangunahing bahagi: (1) Ang Panunuring Feminista ng Sabjek na Foucauldian, (2) Ang Pangkasariang Karanasan ng Babaeng may BRCA, at (3) Pagbalikwas bilang Diskurso-Konstrak at Binuong Tugon. Com isso, surgiram críticas contundentes, tanto do ponto de vista empírico quanto conceitual, à suposição de que a representação é a marca do mental. Apesar disso, cientistas cognitivos parecem relutar em desfazer- se do vocabulário representacionalista. Este artigo tenta lançar luz sobre a questão do suposto representacionalismo de um dos principais paradigmas das ciências cognitivas, o Processamento Preditivo, revisando argumentos pela interpretação (...) não- representacionalista de alguns de seus pontos, assim resgatando a ideia avançada pelas teorias da cognição corporificada segundo a qual a atividade exploratória de um organismo em seu ambiente não exige a geração de modelos representacionais acerca do ambiente. Automatic detection of diseases and anatomical landmarks in medical images by the use of computers is important and considered a challenging process that could help medical diagnosis and reduce the cost and time of investigational procedures and refine health care systems all over the world. Recently, gastrointestinal (GI) tract disease diagnosis through endoscopic image classification is an active research area in the biomedical field. Several GI tract disease classification methods based on image processing and machine learning techniques have been proposed (...) by diverse research groups in the recent past. However, yet effective and comprehensive deep ensemble neural network-based classification model with high accuracy classification results is not available in the literature. In this thesis, we review ways and mechanisms to use deep learning techniques to research on multi-disease computer-aided detection about gastrointestinal and identify these images. We re-trained five state-of-the-art neural network architectures, VGG16, ResNet, MobileNet, Inception-v3, and Xception on the Kvasir dataset to classify eight categories that include an anatomical landmark (pylorus, z-line, cecum), a diseased state (esophagitis, ulcerative colitis, polyps), or a medical procedure (dyed lifted polyps, dyed resection margins) in the Gastrointestinal Tract. Our models have showed results with a promising accuracy which is a remarkable performance with respect to the state-of-the-art approaches. The resulting accuracies achieved using VGG, ResNet, MobileNet, Inception-v3, and Xception were 98.3%, 92.3%, 97.6%, 90% and 98.2%, respectively. As it appears, the most accurate result has been achieved when retraining VGG16 and Xception neural networks with accuracy reache to 98% due to its high performance on training on ImageNet dataset and internal structure that support classification problems. Gayumpaman, bukod sa naghahatid ito ng iba’t ibang anyo ng kaalaman, kung minsan ay nagiging aparato rin ng mga propagandang maaaring mag-angat o magsantabi sa isang partikular na pangkat. Dahil karamihan sa mga museo ay binuo sa panahong post-kolonyal, maaaring pagnilayan ang namamayaning naratibo, representasyon, at (...) pag-alala sa mga ito. Sa bawat museo, naitatanghal ba ang mga katutubo, kolonyal, o postkolonyal na kaisipan at pagpapakahulugan? Patas ba ang pakikisangkot ng bayan bilang nilalaman at bida ng mga museo, o tagatangkilik o tagamasid lamang sila sapagkat dinodomina na rin ito ng mga naghahari at makapangyarihang naratibo? Aambagan ng sanaysay na ito ang napapanahon at makabagong pagtingin sa museolohiyang kakawala sa naghaharing pananaw at pamantayan ng Kanluran—na kadalasa’y nagtanghal, walang humpay na nagbigay ng pagpapakahulugan, sa Silangan nitong mga nagdaang panahon. Bagaman hinugot at isinentro ito mula sa mga personal na paglalakbay, pagsusuruy-suroy, at obserbasyon ng may-akda sa mga museo nang siya’y maglakbay sa iba’t ibang bansa sa Asya-Pasipiko at Europa sa pagitan ng taong 2014 at huling bahagi ng 2019, naglatag naman ito ng ilang kritikal na pagsusuri at pagtingin tungkol sa (1) pagkakahati at nilalaman ng mga museong kanyang narating; (2) kalagayan ng mga artifact (sampu ng mga posibleng isyu rito); at (3) representasyon at layuning “isabansa” ang mga museo, na siyang maaaring ilapat din sa lipunang Pilipino. Liban pa rito, nilayon din ng sanaysay na ambagan ang umuusbong na Araling Kabanwahan—ang pag-aaral tungkol sa ugnayan/pag-uugnay-ugnay ng Pilipinas at ng mga ibang bayan sa labas nito na umaayon sa diwa, talastasan, at tunguhin ng pagka-Pilipino. Tipicamente, il partito viene presentato come un dinosauro della democrazia ormai incapace di assolvere alle sue funzioni tipiche o come piovra infiltratasi illegittimamente in ogni ambito della vita civile. La tesi di quest’articolo è che, al contrario, i partiti tedeschi abbiano dimostrato una forte reattività alle mutate circostanze nazionali e internazionali e che siano riusciti a mantenere il loro tipico ruolo funzionale di mediatore, (...) rappresentante ed amministratore degli interessi degli elettori. Hindi sa pag-iisip na tayo ay lumikha ng mga mundo. Sa pamamagitan ng pag-unawa sa mundo natututo tayong mag-isip. Ang Cosmovision ay isang termino na dapat ay nangangahulugang isang hanay ng mga pundasyon kung saan lumalabas ang isang sistematikong pag-unawa sa Uniberso, ang mga bahagi (...) nito bilang buhay, ang mundong ating ginagalawan, kalikasan, mga phenomena ng tao, at ang kanilang mga relasyon. In order to perform certain actions – such as incarcerating a person or revoking parental rights – the state must establish certain facts to a particular standard of proof. These standards – such as preponderance of evidence and beyond reasonable doubt – are often interpreted as likelihoods or epistemic confidences. Many theorists construe them numerically; beyond reasonable doubt, for example, is often construed as 90 to 95% confidence in the guilt of the defendant. -/- A family of influential cases suggests (...) standards of proof should not be interpreted numerically. These ‘proof paradoxes’ illustrate that purely statistical evidence can warrant high credence in a disputed fact without satisfying the relevant legal standard. Kimberlé Williams Crenshaw ends her landmark essay “Mapping the Margins: Intersectionality, Identity Politics, and Violence against Women of Color” with a normative claim about coalitions. She suggests that we should reconceptualize identity groups as “in fact coalitions,” or at least as “potential coalitions waiting to be formed.” In this essay, I explore this largely overlooked claim by combining philosophical analysis with archival research I conducted at the Gay, Lesbian, Bisexual and Transgender Historical Society Archive in San Francisco about Somos Hermanas, (...) the solidarity project of the Alliance Against Women’s Oppression, based in the San Francisco Women’s Building (1984–90). I extend my analysis into the present by drawing on the oral history and published works of Carmen Vázquez, a key organizer in both Somos Hermanas and the Women’s Building. I argue that conceptualizing identities as in fact coalitions—as complex, internally heterogeneous unities constituted by their internal differences and dissonances and by internal as well as external relations of power—enables us to organize effective political coalitions that cross existing identity categories and to pursue a liberatory politics of interconnection. According to a common conception of legal proof, satisfying a legal burden requires establishing a claim to a numerical threshold. Beyond reasonable doubt, for example, is often glossed as 90% or 95% likelihood given the evidence. Preponderance of evidence is interpreted as meaning at least 50% likelihood given the evidence. In light of problems with the common conception, I propose a new ‘relevant alternatives’ framework for legal standards of proof. Relevant alternative accounts of knowledge state that a person knows a (...) proposition when their evidence rules out all relevant error possibilities. I adapt this framework to model three legal standards of proof—the preponderance of evidence, clear and convincing evidence, and beyond reasonable doubt standards. I describe virtues of this framework. I argue that, by eschewing numerical thresholds, the relevant alternatives framework avoids problems inherent to rival models. I conclude by articulating aspects of legal normativity and practice illuminated by the relevant alternatives framework. (shrink)

Sufficiently grounding the origin of sense-perceptions in the mind is an issue that has concerned philosophers for a long time, and remains an issue even today. In eighteenth-century Germany prior to the publication of Kant’s Critical philosophy, the two main competing theories to causally ground sense-perceptions were pre-established harmony and physical influx, the latter of which ultimately carried the day. A third option had been around in the seventeenth century: occasionalism. However, historians of philosophy believe this option to have entirely (...) disappeared in the eighteenth century. I will show that this is not the case. In this paper, I focus on one influential German occasionalist: Gottfried Ploucquet (1716–90). Ploucquet not only criticizes Leibniz’s theory of pre-established harmony for providing an ultimately ungrounded, subjective, and arbitrary account of the origin of sense-perceptions, but also presents his own daring alternative: a representationalist-occasionalist theory that locates the objective ground of sense-perceptions in the divine mind. In Aspiration, Agnes Callard examines the phenomenon of aspiration, the process by which one acquires values and becomes a certain kind of person. Aspiring to become a certain type of person involves more than wanting to act in certain ways. We want to come to see the world in a certain way and to develop the dispositions, attributes, and skills that allow us to seamlessly and effectively respond to situations. The skilled athlete or musician, for example, has developed the muscle (...) memory and the perceptual equivalent to naturally see what a situation requires and to respond well, whether playing a Rachmaninoff concerto or returning a tennis volley. -/- I use Merleau-Ponty’s Phenomenology of Perception to flesh out the process of becoming, through which aspired-to values, skills, and characteristics become part of one’s embodied being-in-the-world. Although some rightly focus on Merleau-Ponty’s efforts to avoid over-intellectualizing skillful action, without appreciating his distinction between habitual actions and human (or personal) acts, we overlook an important aspect of robust human agency—the way “a human act becomes dormant and is continued absent-mindedly as a reflex” (90). Merleau-Ponty’s account of habit and its relation to personal acts offers a rich and phenomenologically sensitive picture of aspiration. (shrink)

A fresh translation and in-depth commentary of Leibniz's seminal text, the Monadology. -/- Written in 1714, the Monadology is widely considered to be the classic statement of Leibniz's mature philosophy. In the space of 90 numbered paragraphs, totalling little more than 6000 words, Leibniz outlines - and argues for - the core features of his philosophical system. Although rightly regarded as a masterpiece, it is also a very condensed work that generations of students have struggled to understand. -/- Lloyd Strickland (...) presents a new translation of the Monadology, alongside key parts of the Theodicy, and an in-depth, section-by-section commentary that explains in detail not just what Leibniz is saying in the text but also why he says it. Nietzsche talks about trust [vertraue*] and mistrust [misstrau*] in all of his published and authorized works, from The Birth of Tragedy to Ecce Homo. He refers to trust in 90 passages and mistrust in 101 – approximately ten times as often as he refers to resentment/ressentiment. Yet the scholarly literature on Nietzsche and trust includes just a handful of publications. Worse still, I have been unable to find a single publication devoted to Nietzsche and mistrust. This chapter aims to fill (...) the gap in the secondary literature by using digital humanities methods to systematically investigate the functions of trust and mistrust in Nietzsche’s writings. I argue that Nietzsche offers three main insights into trust and an additional two into mistrust. When it comes to trust, in his free spirit works, he reflects on the development of interpersonal trust, with an eye to situations in which trust is or is not reciprocated. He also criticizes some of the heuristics people use to identify trustworthy partners, especially the notion that all and only people with stable character are trustworthy. And perhaps Nietzsche’s most interesting thoughts about trust relate to self-trust, which he thinks is often unjustifiably undermined. When it comes to mistrust, although he regards generalized mistrust as a sign of bad character, he also thinks that harnessing mistrust can be valuable in at least two domains. One is morality, where we are disposed to accept traditional pieties and would benefit from turning a suspicious eye towards these pieties. The other is science, which systematizes both trust and mistrust in pursuit of the truth. (shrink)

Abstract: Research on the nature and varieties of the format of cognitive representations in philosophy and cognitive science have been partly shaped by analogies to external, public representations. In this paper, we argue that relying on such analogies contributes to framing the question of cognitive formats in problematic, potentially counterproductive ways. We show that cognitive and public representations differ in many of their central features, making analogies to public representations ill-suited to improving our understanding of cognitive formats. We illustrate these (...) points by examining two case studies in which analogies to public representations may have had a negative impact on research: the 80’s-90’s debate about compositionality and cognitive architecture between symbolicists and connectionists; and contemporary discussions about the nature of visual demonstratives. Finally, we outline an alternative, computational account of formats that does not share the shortcomings of appeal to public representations. (shrink)

This paper advances our understanding of the norms of assertion in two ways. First, I evaluate recent studies claiming to discredit an important earlier finding which supports the hypothesis that assertion has a factive norm. In particular, I evaluate whether it was due to stimuli mentioning that a speaker’s evidence was fallible. Second, I evaluate the hypothesis that assertion has a truth-insensitive standard of justification. In particular, I evaluate the claim that switching an assertion from true to false, while holding (...) all else objectively constant, is irrelevant to attributions of justification. Two pre-registered experiments provide decisive evidence against each claim. In the first experiment, switching from mentioning to not mentioning fallibility made no difference to assertability attributions, thereby disproving the criticism concerning fallibility. By contrast, switching an assertion from true to false decreased the rate of assertability attribution from over 90% to less than 20%, thereby replicating and vindicating the original finding supporting a factive norm. In the second experiment, switching an assertion from true to false decreased the rate of justification attribution from over 80 to 10%, thereby undermining the hypothesis that assertion’s standard of justification is truth-insensitive. The second experiment also demonstrates that perspective-taking influences attributions of justification, and it provides initial evidence that the standard of justification for assertion is stricter than the standard for belief. To speak of being religious lucky certainly sounds odd. But then, so does “My faith holds value in God’s plan, while yours does not.” This book argues that these two concerns — with the concept of religious luck and with asymmetric or sharply differential ascriptions of religious value — are inextricably connected. It argues that religious luck attributions can profitably be studied from a number of directions, not just theological, but also social scientific and philosophical. There is a strong tendency (...) among adherents of different faith traditions to invoke asymmetric explanations of the religious value or salvific status of the home religion vis-à-vis all others. Attributions of good/bad religious luck and exclusivist dismissal of the significance of religious disagreement are the central phenomena that the book studies. Part I lays out a taxonomy of kinds of religious luck, a taxonomy that draws upon but extends work on moral and epistemic luck. It asks: What is going on when persons, theologies, or purported revelations ascribe various kinds of religiously-relevant traits to insiders and outsiders of a faith tradition in sharply asymmetric fashion? “I am saved but you are lost”; “My religion is holy but yours is idolatrous”; “My faith tradition is true, and valued by God, but yours is false and valueless.” Part II further develops the theory introduced in Part I, pushing forward both the descriptive/explanatory and normative sides of what the author terms his inductive risk account. Firstly, the concept of inductive risk is shown to contribute to the needed field of comparative fundamentalism by suggesting new psychological markers of fundamentalist orientation. The second side of what is termed an inductive risk account is concerned with the epistemology of religious belief, but more especially with an account of the limits of reasonable religious disagreement. Problems of inductively risky modes of belief-formation problematize claims to religion-specific knowledge. But the inductive risk account does not aim to set religion apart, or to challenge the reasonableness of religious belief tout court. Rather the burden of the argument is to challenge the reasonableness of attitudes of religious exclusivism, and to demotivate the “polemical apologetics” that exclusivists practice and hope to normalize. The standard of proof in criminal trials in many liberal democracies is proof beyond a reasonable doubt, the BARD standard. It is customary to describe it, when putting a number on it, as requiring that the fact finder be at least 90% certain, after considering the evidence, that the defendant is guilty. Strikingly, no good reason has yet been offered in defense of using that standard. A number of non-consequentialist justifications that aim to support an even higher standard have been (...) offered; all are morally unsound. Meanwhile, consequentialist arguments plausibly support a substantially lower standard — in some cases so low as to undermine the idea that punishment is what is at stake. In this paper, I offer a new retributive justification that supports excluding the instrumental benefits of punishment from the balance that sets the standard. The resulting balance supports a standard arguably in the ballpark of the customary understanding of BARD: a standard requiring that the fact finder have a high, though not maximally high, degree of confidence that the defendant is guilty. Suppose that a patient is receiving treatment options from her doctor. In one case, the doctor says, “the surgery has a 90% survival rate.” Now, suppose the doctor instead said, “the procedure has a 10% mortality rate.” Predictably, the patient is more likely to consent on the first description and more likely to dissent on the second. This is an example of a framing effect. A framing effect occurs when “the description of [logically-equivalent] options in terms of gains (positive frame) (...) rather than losses (negative frame) elicits systematically different choices.” Framing effects are ubiquitous, but they are particularly troublesome in medicine. Many worry that there is tension between valuing informed consent and using framing effects in clinical settings. In this paper, I answer this question: if an individual is subject to a framing effect when she gives her consent, does this undermine the validity of her consent? I argue that framing effects do not undermine consent in general. (shrink)
