Without directly addressing the Demarcation Problem for logic—the problem of distinguishing logical vocabulary from others—we focus on distinctive aspects of logical vocabulary in pursuit of a second goal in the philosophy of logic, namely, proposing criteria for the justification of logical rules. Our preferred approach has three components. Two of these are effectively Belnap’s, but with a twist. We agree with Belnap’s response to Prior’s challenge to inferentialist characterisations of the meanings of logical constants. Belnap argued that for a logical (...) constant to exist, its rules must be conservative over a previously given consequence relation and guarantee the uniqueness of the constant. The twist is that we require logical vocabulary to be provably conservative, not over a previously given formal consequence relation, but over a previously given meaningful vocabulary of a language. Uniqueness is also a feature defined in terms of provability: if two syntactically distinguished expressions are governed by the same rules, then formulas with them as main operators are interderivable. Belnap’s criteria are not only those for the existence of a logical constant, but more: they are what distinguishes logical vocabulary from all other expressions. It is the defining mark of a logical constant that it is provably conservative over the fragment of the language which excludes it and that its rules guarantee its uniqueness. The third component is the topic neutrality of logic. The provable conservativeness of logic over a previously given vocabulary of a language is motivated, in part, by appeal to molecularism in the theory of meaning. Molecularity is a feature endorsed by the theory of meaning as a whole, so it does not distinguish logical constants from other expressions. The same is true for conservativeness. We argue that molecularity, and hence conservativeness, are implicit presuppositions of speakers’ use of language: the addition of new vocabulary to a language is presupposed to be conservative. But this presupposition is one that we should be able reflectively to endorse (such as when attempting a rational reconstruction of the use of the vocabulary). Thus, where conservativeness is found to fail, this defect should be remedied and the use of the vocabulary corrected (as in classical negation) or excised altogether (as in pejoratives). We go on to characterise a notion of topic neutrality, which we argue applies to logical vocabulary. We then note that reflective endorsement of the conservativeness of a topic neutral vocabulary requires a proof that the vocabulary is conservative relative to any base vocabulary. Thus we require that logical vocabulary be demonstrably conservative. Allying this requirement, distinctive of logic, to a general consideration about the commitments of assertion yields a mode of justification for logical constants akin to some conceptions of Harmony, i.e., to the idea that the consequences of assertion of a logical complex need to be warranted by the grounds and ought to be the strongest consequences warranted by the grounds. Intuitionistic logic acquires a somewhat familiar justification but emanating from a new motivation. (shrink)

The democratic boundary problem raises the question of who has democratic participation rights in a given polity and why. One possible solution to this problem is the all-affected principle, according to which a polity ought to enfranchise all persons whose interests are affected by the polity’s decisions in a morally significant way. While AAP offers a plausible principle of democratic enfranchisement, its supporters have so far not paid sufficient attention to economic participation rights. I argue that if one commits oneself (...) to AAP, one must also commit oneself to the view that political participation rights are not necessarily the only, and not necessarily the best, way to protect morally weighty interests. I also argue that economic participation rights raise important worries about democratic accountability, which is why their exercise must be constrained by a number of moral duties. (shrink)

It is becoming more common that the decision-makers in private and public institutions are predictive algorithmic systems, not humans. This article argues that relying on algorithmic systems is procedurally unjust in contexts involving background conditions of structural injustice. Under such nonideal conditions, algorithmic systems, if left to their own devices, cannot meet a necessary condition of procedural justice, because they fail to provide a sufficiently nuanced model of which cases count as relevantly similar. Resolving this problem requires deliberative capacities uniquely (...) available to human agents. After exploring the limitations of existing formal algorithmic fairness strategies, the article argues that procedural justice requires that human agents relying wholly or in part on algorithmic systems proceed with caution: by avoiding doxastic negligence about algorithmic outputs, by exercising deliberative capacities when making similarity judgments, and by suspending belief and gathering additional information in light of higher-order uncertainty. We offer a general framework for theorizing about the structure of knowledge and belief in terms of the comparative normality of situations compatible with one’s evidence. The guiding idea is that, if a possibility is sufficiently less normal than one’s actual situation, then one can know that that possibility does not obtain. This explains how people can have inductive knowledge that goes beyond what is strictly entailed by their evidence. We motivate the framework by showing how it illuminates knowledge about (...) the future, knowledge of lawful regularities, knowledge about parameters measured using imperfect instruments, the connection between knowledge, belief, and probability, and the dynamics of knowledge and belief in response to new evidence. Linguistic expressions frequently make reference to the situation in which they are uttered. In fact, there are expressions whose whole point of use is to relate to their context of utterance. It is such expressions that this article is primarily about. However, rather than presenting the richness of pertinent phenomena (cf. Anderson & Keenan 1985), it concentrates on the theoretical tools provided by the (standard) two-dimensional analysis of context dependence, essentially originating with Kaplan (1989)--with a little help from Stalnaker (1978) (...) and Lewis (1979a, 1980), and various predecessors including Kamp (1971) and Vlach (1973). The current article overlaps in content with the account in Zimmermann (1991), which is however much broader (and at times deeper).. (shrink)

A "concept" in the sense favoured by Wittgenstein is a paradigm for a transition between parts of a notational system. A concept-determining sentence such as "There is no reddish green" registers the absence of such a transition. This suggests a plausible account of what is perceived in an experiment that was first designed by Crane and Piantanida, who claim to have induced perceptions of reddish green. I shall propose a redescription of the relevant phenomena, invoking only ordinary colour concepts. This (...) redescription is not ruled out by anything the experimenters say. It accounts for certain peculiarities in both their descriptions and their subjects', and suggests that instead of discovering forbidden colours the experimenters introduced a new use of "-ish". Still, there is a point in speaking of "reddish green" in their context, which can be motivated by invoking what Wittgenstein calls a "physiognomy". (shrink)

Responding has rather to be understood as the genuine way in which we encounter the alien as alien. It will be shown that the experience of the Other, i.e., what Husserl calls Fremderfahrung, requires a new sort of responsive phenomenology. This kind of responsive phenomenology goes (...) beyond the traditional form of intentional phenomenology just as much as it leaves behind every sort of hermeneutics. Responding means more than intending or understanding. This is an English translation of Waldenfels' German essay: Equality and inequality are basic elements of law, justice and politics. Equality integrates each of us into a common sphere by distributing rights, duties and chances among us. Equality turns into mere indifference as far as we get overintegrated into social orders. When differences are fading away experience loses its relief and individuals lose their face. Our critical reflections start from the inevitable paradox of making equal what is not equal. In (...) various ways they refer to Nietzsche’s concept of order, to Marx’s analysis of money, to Lévinas’s ethics of the Other, and to novelists like Dostoevsky and Musil. Our critique turns against two extremes, on the one hand against any sort of normalism fixed on functioning orders, on the other hand against any sort of anomalism dreaming of mere events and permanent ruptures. Responsive phenomenology shows how we are confronted with extraordinary events. Those deviate from the ordinary and transgress its borders, without leaving the normality of our everyday world behind. The process of equalizing moves between the ordinary and the extraordinary. What makes the difference and resists mere indifference are creative responses which are to be invented again and again. In this article, we reconsider the syntactical analysis as well as the categorial status of two Medieval French elements, et and ne. In this connection, we illustrate and compare various approaches which principally differ with regard to the assignment of a unique category or of various categories to these elements. In the context of this comparison, we address some of the questions pertaining to their motivations and the evidence which has been offered in their favor, showing that approaches which assign (...) a unique category to et and ne, respectively, prove to be empirically more adequate. Nous souhaitons réhabiliter ce concept en tant que connaissance, afin de défendre le rôle du corps dans le savoir et de dénoncer certaines injustices épistémiques. Pour appuyer cela, les éthiques du care nous aideront à reconnaître une légitimité politique envers la vulnérabilité de nos mobilités corporelles. L’intérêt pour la sensibilité cinétique est de permettre à l’agent.e de se soucier (...) de sa relation à l’environnement, en développant un accès pédagogique envers son corps et par l’attention portée envers ses possibilités de mouvement. L’agent.e apprend alors à choisir une manière de s’orienter au sein de l’organisation socio-politique présente. Johann Georg Hamann, filozof z Królewca, filolog oraz teolog (1730-1788) był nazywany przez Goethego „najuczeńszą głową swojego czasu”. Twierdził, że właśnie od niego „najwięcej się nauczył”. Dlatego też zbierał i czytał jego pisma. To samo można powiedzieć o stosunku Ernsta Jüngera (1895-1998) do „maga Północy” . Usłyszał o nim przypadkowo w roku 1924 od lipskiego docenta filozofii Hugo Fischera i odtąd był Hamannem zafascynowany. Często powoływał się na niego w węzłowych miejscach twórczości, jak np. w postaci motta z Hamanna w (...) obu wersjach swojej pierwszej pracy Das abenteuerliche Herz (1929, 1938). Także dzięki Hamannowi powziął przekonanie, że „wyrazistość jest słusznym podziałem między światłem i cieniem”, jak i to, że najważniejsze fenomeny nie są zjawiskami przyczynowo uszeregowanymi, możliwymi do opanowania przez człowieka, lecz zjawiskami podpowierzchniowo powiązanymi ze sobą. Można je poprzez analogię opisać w zbliżony sposób. Jünger stanął tutaj w jednym szeregu z Hamannem i Goethem. Pod koniec swoich opublikowanych dzienników (14.12.1995) nazwał swoją znajomość z magiem Północy „nieuniknionym” i zaliczył go do „budzicieli”, którzy uformowali jego charakter. (shrink)

In the present work, we will analyze the concept of intuition mainly in relation to the epistemological and the metaphysical theses of Schopenhauerian theory. In the first section, we will discuss the central axes of Schopenhauer’s metaphysical system, especially regarding the concept of will (Wille) and the relationship that this entails with his theory of knowledge. Then, we will examine the difference that the German philosopher establishes between representative —or mediated— rational knowledge and direct —or immediate— intuitive knowledge. Likewise, we (...) will trace at first the theses and the fundamental problems of the dualism of representation and we will furtherly establish the problem of the intuition of one’s own body. Finally, we will consider the scope and the limits of intuition, as well as its different variants: mainly aesthetic intuition and its culmination in mystical intuition. (shrink)

In the present study, I will consider the crisis of the movement image, and the emergence of a new type of image, namely, the time image. First, I will analyze certain basic concepts used by Deleuze (1925-1995) and by Bergson (1859- 1941) to understand the new type of image that emerges from an interruption of our natural perception, granting us -by separating ourselves from all our previous experiences- pure optical and sound perceptions. Secondly, I will trace the changes that, both (...) inside and outside cinema, made possible this emergence. Finally, according to the signs of the time-image developed by Deleuze, I will analyze the film Paterson (2016), by Jim Jarmusch. The film, inspired not only by the work of the poet William Carlos Williams (1883-1963), but also by other poets of the New York School, seeks to portray, through visual descriptions, the details of our daily lives. This holds also true for their infrastructures that are processing and transducing information like endocrine networks or nerval channels. Therefore, the ability to compensate for noise is crucial for survival. An efficient mechanism to neutralise disturbances is instantiated in form of parallel complementary communication channels exerting antagonistic effects at their common receivers. Different signal processing types share the ability to suppress noise, to widen the system’s regulation capacity, and to provide for variable (...) gains while leaving the transferred signal to a large extent unchanged. The aim of this work is to move from the foreign dominated to the self-dominated by encouraging people to draw their own conclusions with the help of own rational consideration. Here a room as an environment that is encouraging innovation, which can be denoted as “Innovation Lab”, and making processes as can be regarded as “Smart Lab” is an essential base. The question related to this generalized self-organizational learning method investigated in our paper is how a UVC, which is a (...) room that connects people from different physical places to one synchronous and virtual perceivable place, which is built on these preconditions, can be operated both resource and learning-efficient for both the course participants and the educational organization. A practical approach of implementing a virtual classroom concept, including informative tutorial-feedback, is developed conceptually that also accounts for and implements the results of reinforcement machine-learning methods in AI applications. The difference that makes the difference is gained by reimplementing the AI tools in an AI instrument, in a “Smart Lab” environment and that in the teaching environment. By means of this, a cascaded feedback-loop system is informally installed, which gains feedback at different levels of abstraction. By this learning on each stage, in a collaborative and together decentralized and sequential fashion takes place, as the selforganizational implementations lead implicitly, also by means of the in the course implemented tools, to increasingly self-control. As such in the course, a tool is implemented, as generalizations by means of reinforcement learnings are to be emergently foreseen by this method, which goes beyond the tools, that have already been implemented before. This AI-enhanced learning coevolution shall then, predictively, as well increase the potential of the course participants as the educational organization according to the Wittgensteinean parable: A ladder leading into a selfly-organized future. There are many things—call them ‘experts’—that you should defer to in forming your opinions. The trouble is, many experts are modest: they’re less than certain that they are worthy of deference. When this happens, the standard theories of deference break down: the most popular (“Reflection”-style) principles collapse to inconsistency, while their most popular (“New-Reflection”-style) variants allow you to defer to someone while regarding them as an anti-expert. We propose a middle way: deferring to someone involves preferring to make any decision (...) using their opinions instead of your own. In a slogan, deferring opinions is deferring decisions. Generalizing the proposal of Dorst (2020a), we first formulate a new principle that shows exactly how your opinions must relate to an expert’s for this to be so. We then build off the results of Levinstein (2019) and Campbell-Moore (2020) to show that this principle is also equivalent to the constraint that you must always expect the expert’s estimates to be more accurate than your own. Finally, we characterize the conditions an expert’s opinions must meet to be worthy of deference in this sense, showing how they sit naturally between the too-strong constraints of Reflection and the too-weak constraints of New Reflection. Identification of non-coding RNAs (ncRNAs) has been significantly enhanced due to the rapid advancement in sequencing technologies. On the other hand, semantic annotation of ncRNA data lag behind their identification, and there is a great need to effectively integrate discovery from relevant communities. To this end, the Non-Coding RNA Ontology (NCRO) is being developed to provide a precisely defined ncRNA controlled vocabulary, which can fill a specific and highly needed niche in unification of ncRNA biology.

In recent years, sequencing technologies have enabled the identification of a wide range of non-coding RNAs (ncRNAs). Unfortunately, annotation and integration of ncRNA data has lagged behind their identification. Given the large quantity of information being obtained in this area, there emerges an urgent need to integrate what is being discovered by a broad range of relevant communities. To this end, the Non-Coding RNA Ontology (NCRO) is being developed to provide a systematically structured and precisely defined controlled vocabulary for the (...) domain of ncRNAs, thereby facilitating the discovery, curation, analysis, exchange, and reasoning of data about structures of ncRNAs, their molecular and cellular functions, and their impacts upon phenotypes. The goal of NCRO is to serve as a common resource for annotations of diverse research in a way that will significantly enhance integrative and comparative analysis of the myriad resources currently housed in disparate sources. It is our belief that the NCRO ontology can perform an important role in the comprehensive unification of ncRNA biology and, indeed, fill a critical gap in both the Open Biological and Biomedical Ontologies (OBO) Library and the National Center for Biomedical Ontology (NCBO) BioPortal. Our initial focus is on the ontological representation of small regulatory ncRNAs, which we see as the first step in providing a resource for the annotation of data about all forms of ncRNAs. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. This is, to the best of my knowledge, the first published attempt at a rigorous logical formalization of a passage in Leibniz's Monadology. The method we followed was suggested by Johannes Czermak.

This study is about an aspect of the reception of Herbatianism in Austria which has not been thoroughly investigated so far. It pertains to a controversy opposing Robert Zimmermann and Franz Brentano in the context of discussions which took place in the Philosophical Society of the University of Vienna. This study looks more specifically at three important episodes involving the Philosophical Society, first, the controversy over Herbartianism, second that over the evaluation of Schelling’s philosophy, and finally the reception of (...) Bolzano in Austria. I will first describe the circumstances that led Zimmermann to get involved in the Philosophical Society and the source of his controversy with Brentano and his followers. I will then comment Zimmermann’s address as chairman of the Philosophical Society and Brentano’s reaction to Zimmermann’s remarks on Schelling and the historical period to which he belongs. I will complete my analysis of Brentano’s reaction with a summary of his evaluation of Herbart’s philosophical program to which Zimmermann adhered. The last part focuses on Zimmermann’s decisive role in the reception of Bolzano in Vienna in connection with the Bolzano Commission established by the Philosophical Society. I will conclude with brief remarks on Zimmermann’s legacy in Vienna. (shrink)

This Paper addresses the problem of statelessness, a problem which remains despite treaties and judicial decisions elaborating distinct rules to protect stateless persons. I explain why this has been so. Drawing from the work of Bernhard Waldenfels, I argue that international and domestic courts have presupposed a territorial sense of space, a territorial knowledge and the founding date for the territorial structure of a state-centric international legal community. I then focus upon the idea that an impartial third party can (...) resolve a dispute involving stateless persons by deferring to a universal rule. I call the third party the ‘rule of law third’. Such a rule, I argue, presupposes a presupposed knowledge over stateless persons. The Third takes for granted the territorial boundary of a legal structure, a boundary which excludes the recognition of outsiders to the boundary. (shrink)

The versions of Nietzschean and Cioranian Antihumanism start from different presuppositions than Foucault’s Antihumanism, adding misanthropy to their nihilistic project. The Cioranian term of the not-man, a darker counterpart to Nietzsche’s Übermensch, can be “tested” through forays into the Romantic and Post-romantic literature, considering for instance Shelley’s Frankenstein (1818), Maupassant’s “Horla” (1887), Lorrain’s “The Possessed” (1895) or the poems of Lautréamont. In this paper we compare Cioran’s Antihumanism with the nihilism of Thomas Bernhard’s first novel, Frost (1963).

XENOLOGY AND XENOTOPOGRAPHY OF BERNHARD WALDENFELS The paper strives to adapt Bernhard Waldenfels’ xenology and so called ‘xenotopography’ for the philosophico-literary studies in fantastic world-building with a special concern of the ‘portal-quest’ model of fantasy and SF. Following Waldenfel’s remarks on the nature of post- Husserlian diastasis of our world [Heimwelt] and otherworld [Fremdwelt] and acknowledging the consequences of allocating one’s attitude towards the otherness in the symbolical borderland [‘sphere of intermonde’] in between, it is examined whether such (...) a model can occur in the fantastic literature and what may be the consequence of xenotopographic reconsideration of its basic ontological premises. Additionally, the article offers an original xenotopograpfic model of worldbuilding which addresses three carefully chosen case studies of fantastic worlds from Orson Scott Card’s Ender’s Game tetralogy, Neil Gaiman’s Stardust and George R. R. Martin’s The Song of Ice and Fire. In the end, it is suggested that hitherto presented xenotopography gravely inspired a postmodern shift in the genres of fantasy and SF which results in more ethically conscious representations of the otherness and even more concise and alien comprehensive world-building. The phenomenologists Martin Heidegger and Bernhard Waldenfels describe this connection as a matter of being ("Seinsweise") of images, that allows new views of the world whereas the two cultural anthropologists Ernst Cassirer and Hartmut Böhme note that the connection between both can be seen as the basis of experience ("Erlebnisweise") of images and therefore serves for communication. Hans Bernhard Schmid has argued that contemporary theories of collective action and social metaphysics unnecessarily reject the concept of a “shared intentional state.” I will argue that three neo-Thomist philosophers, Jacques Maritain, Charles de Koninck, and Yves Simon, all seem to agree that the goals of certain kinds of collective agency cannot be analyzed merely in terms of intentional states of individuals. This was prompted by a controversy over the nature of the “common good,” in response to a perceived (...) threat from “personalist” theories of political life. Common goods, as these three authors analyze them, ground our collective action in pursuit of certain kinds of goals which are immanent to social activity itself. Their analysis can support an alternate position to “intentional individualism,” providing an account of collective practical reasoning and social metaphysics based on shared intentional states, but without involving implausible “group minds.”. Semantics traditionally focuses on linguistic meaning. In recent years, the Super Linguistics movement has tried to broaden the scope of inquiry in various directions, including an extension of semantics to talk about the meaning of pictures. There are close similarities between the interpretation of language and of pictures. Most fundamentally, pictures, like utterances, can be either true or false of a given state of affairs, and hence both express propositions (Zimmermann, 2016; Greenberg, 2013; Abusch, 2015). Moreover, sequences of pictures, (...) like sequences of utterances, can be used to tell stories. Wordless picture books, comics, and film are cases in point. In this paper I pick up the project of providing a dynamic semantic account of pictorial story-telling, started by Abusch (2012) and continued by Abusch & Rooth (2017); Maier & Bimpikou (2019); Fernando (2020). More specifically, I propose here a semantics of speech and thought bubbles by adding event reference to PicDRT. To get there I first review the projection-based semantics for pictures (section 1), noting the fundamental distinction between symbolic and iconic meaning that makes speech bubbles especially interesting (section 2). I then review the dynamic PicDRT framework for pictorial narratives (section 3), add events (section 4), and propose an account of speech bubbles as quotational event modification (section 5). I end with a brief look at other conventional, symbolic enrichments in comics (section 6). (shrink)

An adequate semantics for generic sentences must stake out positions across a range of contested territory in philosophy and linguistics. For this reason the study of generic sentences is a venue for investigating different frameworks for understanding human rationality as manifested in linguistic phenomena such as quantification, classification of individuals under kinds, defeasible reasoning, and intensionality. Despite the wide variety of semantic theories developed for generic sentences, to date these theories have been almost universally model-theoretic and representational. This essay outlines (...) a range of proof-theoretic analyses for characterizing generics. Particular attention is given to an expressivist proof-theory that can be traced to 1) work on logical syntax that Carnap undertook prior to his turn toward truth-conditional model theory in the late 1930s, and 2) research on sequent calculi and natural deduction systems that originate in work from Gentzen and Prawitz.11 This essay offers a more precise exposition of some of the material discussed in the first two chapters of my dissertation (Stovall Citation2015a). These ideas developed in the context of a working group on non-monotonic logic run by Robert Brandom, and they were subsequently clarified through the work of Nissim Francez (particularly Francez Citation2015). According to an often repeated definition, economics is the science of individual choices and their consequences. The emphasis on choice is often used – implicitly or explicitly – to mark a contrast between markets and the state: While the price mechanism in well-functioning markets preserves freedom of choice and still efficiently coordinates individual actions, the state has to rely to some degree on coercion to coordinate individual actions. Since coercion should not be used arbitrarily, coordination by the state needs to (...) be legitimized by the consent of its citizens. The emphasis in economic theory on freedom of choice in the market sphere suggests that legitimization in the market sphere is “automatic” and that markets can thus avoid the typical legitimization problem of the state. In this paper, I shall question the alleged dichotomy between legitimization in the market and in the state. I shall argue that it is the result of a conflation of choice and consent in economics and show how an independent concept of consent makes the need for legitimization of market transactions visible. Ein Beispiel für die Rezeption und Fortführung der schopenhauerschen Logik findet man in den Mathematiklehrbüchern Friedrich Adolph Wilhelm Diesterwegs (1790–1866), In diesem Aufsatz werden die historische und systematische Dimension dieser Anwendung von Logikdiagramme auf die Mathematik skizziert. In Kapitel 2 wird zunächst die frühe Rezeption der schopenhauerschen Logik und Philosophie der Mathematik vorgestellt. Dabei werden einige oftmals tradierte Vorurteile, die das Werk Schopenhauers betreffen, in Frage gestellt oder sogar ausgeräumt. In Kapitel 3 wird dann die Philosophie der Mathematik und der (...) Logik Schopenhauers vorgestellt. Es wird gezeigt, dass Schopenhauers Logikdiagramme auf Ideen der Mathematiker Leonhard Euler (1707–1783), Bernhard Friedrich Thibaut (1775–1832) und Franz Ferdinand Schweins (1780–1856) zurückgehen und dass Schopenhauer diese Logikdiagramme auch bereits zur Analyse mathematischer Begriffe verwendet. Kapitel 4 beschäftigt sich mit der Schopenhauer-Rezeption Diesterwegs. Es wird die Frage behandelt, inwieweit Diesterweg in der Mathematik von Schopenhauer beeinflusst war und welche Rolle dieser Einfluss auf sein Verständnis von Logik und Mathematik hatte. In Kapitel 5 wird schließlich gezeigt, dass Diesterweg die schopenhauersche Begriffsanalyse der Mathematik mit Hilfe von Logikdiagrammen aufgreift und weiterführt. Da Diesterweg einer der einflussreichsten Pädagogen und Mathematikdidaktiker des 20. Jahrhunderts war, ist anzunehmen, dass sich Spuren dieser Methode noch heute finden lassen. This paper discusses two approaches of the relationship between subjectivity and intersubjectivity. The Husserlian one, a transcendental phenomenological investigation of the possibility of subjectivity and intersubjectivity, and the Waldenfelsian one, an ethical phenomenological investigation of day to day intersubjective interactions. Both authors pretend to give account of the conditions of possibility of intersubjective interaction. However, Husserl starts with the investigation of the transcendental structure of subjectivity, that is, the fundamental conditions required for the appearance of consciousness. By contrast, Waldenfels looks (...) first at practical interaction and draws conclusions on the deeper structure of subjectivity based on the traces he discovers to be characteristic for this interaction. Our interest lies in determining which of the two approaches should be given priority for the investigation of the constitution of intersubjectivity. (shrink)

This paper argues that to account for group speech acts, we should adopt a representationalist account of mode / force. Individual and collective subjects do not only represent what they e.g. assert or order. By asserting or ordering they also indicate their theoretical or practical positions towards what they assert or order. The ‘Frege point’ cannot establish the received dichotomy of force and propositional content. On the contrary, only the representationalist account allows a satisfactory response to it. It also allows (...) us to give a more satisfactory analysis of the speech act of inviting a joint commitment and to answer two important questions Bernhard Schmid has raised about group speech acts, namely whether there are 1st person plural forms of Moore’s paradox and of 1st person authority. Die anhaltende Popularität von juristisch geprägter Literatur zeigt, dass das Ringen um die Gerechtigkeit im Recht ein brisantes Thema ist, das gesellschaftliche Aufmerksamkeit auf sich zieht, provoziert und immer wieder neu zum Nachdenken herausfordert. Zeitgenössisch sind es Autor*innen wie Juli Zeh, Bernhard Schlink, Georg Oswald oder Ferdinand von Schirach (sogenannte Dichterjurist*innen 1 ), die die Frage nach Recht und Gerechtigkeit literarisch verbinden und deren Problemkontexte beleuchten. Juli Zeh lässt ihrem Roman Spieltrieb die Erzählerinstanz sprechen: „Das Recht ist kein Kreißsaal (...) für die Gerechtigkeit […]“ (2013, 518). Auch Ferdinand von Schirach bemüht sich herauszustellen, dass für ihn Recht nicht gleich Gerechtigkeit bedeutet. Als Strafverteidiger sagt er über die Justiz: „[W]ir sprechen […] nicht Gerechtigkeit, sondern Recht“ (Heise 2009).3 In seinen Bestsellern (angefangen von z. B. Der Fall Collini über Terror bis zu seinem neusten Stück Gott) provoziert er das Gerechtigkeitsempfinden seiner Leser*innen und lässt sie am Ende gerne selbst das Urteil fällen. In Terror (2016) soll das Publikum als Jury selbst entscheiden, ob der Kampfpilot das entführte Passagierflugzeug, das auf ein voll besetztes Fußballstadion zugesteuert ist, hätte abschießen dürfen. Hier geraten u. a. die Gewissensentscheidung des Piloten und die Rechtsgrundlage in einen Konflikt. Nicht selten macht er den Leser*innen das Recht schwer erträglich, wenn er z. B. wie im Erzählband Schuld (2017) auf brutale Weise beschreibt, wie eine minderjährige Kellnerin auf einem Volksfest von einer Gruppe von Männern vergewaltigt wird, aber aus Beweismangel letztendlich keiner dieser Männer schuldig gesprochen werden kann. In der Literatur werden vielfältige Zugänge zum Verhältnis von Recht und Gerechtigkeit eröffnet – wie kann sich die christliche Sozialethik positionieren? (shrink)

O ensino de filosofia seguiu uma rota tortuosa desde a colônia até os tempos atuais. O breve histórico desse percurso tem o objetivo de reafirmar a necessidade dessa disciplina no currículo escolar, sobretudo porque sempre há aqueles que a consideram de pouca importância. No entanto, em um mundo cada vez mais pragmático, a formação exclusivamente técnica de nossos jovens dificulta o processo de conscientização crítica, além de desprezar a herança de uma sabedoria milenar. Os primeiros tempos No Brasil, desde o (...) século XVI, o ensino de filosofia fazia parte do chamado curso de artes oferecido pelos jesuítas aos filhos de colonos que concluíam o primeiro nível de letras humanas. É bem verdade que apenas alguns colégios dispunham desse curso, voltado exclusivamente para a elite colonial portuguesa. A base do ensino de filosofia era a tradição escolástica, e, mesmo durante os séculos seguintes, não houve interesse em abordar as conquistas das ciências modernas, já vigentes desde o século XVII, na perspectiva de Francis Bacon e das descobertas de Galileu Galilei. Do mesmo modo, não eram ensinadas as teorias de René Descartes e John Locke. Inspirado nos ideais da Contrarreforma, o ensino jesuítico reafirmava a autoridade da Igreja e dos clássicos, com o controle sobre as informações a que os alunos teriam acesso. No século XVIII, os fundamentos aristotélico-tomistas perduraram, com raras exceções, apesar de o marquês de Pombal ter expulsado os jesuítas. O próprio Pombal permitiu a divulgação de algumas dessas obras "esclarecidas", mas cuidou de elencar uma lista das proibidas. Contrariando o controle, as novas ideias circulavam no Brasil por meio de estudantes formados pela Universidade de Coimbra e também pela venda clandestina de panfletos e cópias manuscritas. Desse modo, nas aulas régias, instituídas por Pombal para substituir as escolas dos jesuítas, no geral foi mantida a educação elitista, livresca, desfocada da realidade brasileira durante o império e a república. Apesar do controle, havia exceções, nas poucas vezes em que intelectuais, professores e conhecedores de bibliografia atualizada ensinavam disciplinas como ciências modernas, filosofia e matemática. Algumas congregações religiosas, como a dos franciscanos, também se interessavam pelas contribuições científicas e filosóficas de seu tempo. Ensino de filosofia: entre facultativa e obrigatória A partir do século XIX, predominou um vaivém entre a filosofia como disciplina obrigatória ou facultativa. Com a criação de cursos jurídicos no Brasil, na década de 1820 - em São Paulo e Recife -, a filosofia tornou-se disciplina obrigatória do ensino médio, como pré- requisito para o ingresso ao curso superior, reforçando o caráter propedêutico daquele curso. Em 1915, uma reforma de ensino tornou a filosofia disciplina facultativa, mas o ministro Francisco Campos tentou reverter esse quadro em 1932, tornando-a novamente obrigatória. Conhecido pela atuação no movimento da Escola Nova, Campos aliou seus esforços aos de figuras importantes da pedagogia brasileira, como o sociólogo Fernando de Azevedo e o filósofo e educador Anísio Teixeira. A tendência escolanovista era renovadora e se fazia necessária diante da situação econômica do Brasil. Com o início da industrialização, surgia a necessidade de melhorar a escolarização, sobretudo para os segmentos urbanos. Francisco Campos introduziu as disciplinas de lógica, sociologia e história da filosofia no currículo escolar. Com a Reforma Capanema, em 19142, o ensino secundário dividiu-se em ginasial e colegial. Este último foi subdividido em científico, com ênfase no estudo de ciências, e clássico, que privilegiava a formação em humanidades. Nesse contexto, a filosofia se constituiu como disciplina obrigatória em um dos três anos do científico e em dois anos do curso clássico, com proposta de programa bastante extenso. No entanto, uma sequência de portarias reduziu gradativamente o número de horas-aula da disciplina, por fim, restrita ao último ano do colegial. Em 1961, foi promulgada a nossa primeira Lei de Diretrizes e Bases da Educação (LDBJ, a Lei n. 4.024, ocasião em que o ensino de filosofia perdeu a obrigatoriedade. Período da ditadura militar Durante a ditadura militar no Brasil (1964-1985), as aulas de filosofia foram extintas pela Lei n. 5.692, de 1971. Essa lei reformou o então chamado ensino de 1º e 2º graus e introduziu o ensino profissionalizante, de acordo com a tendência tecnicista proposta pelos acordos entre militares e tecnocratas. Um dos objetivos era adequar a educação às exigências da sociedade industrial e tecnológica, com economia de tempo, esforços e custos. A educação tecnicista encontrava-se imbuída dos ideais de racionalidade, organização, objetividade, eficiência e produtividade, como se fosse uma empresa: esperava-se que, ao terminar cada um dos níveis, o aluno estivesse capacitado para ingressar no mercado como força de trabalho, caso necessário. Para implantar o projeto de educação proposto, o governo militar não revogou a LDB de 1961, mas introduziu alterações e fez atualizações. Enquanto a aprovação da LDB resultara de amplo debate na sociedade civil, o governo autoritário regulamentou as leis do ensino universitário (Lei n. 5.540/1968) e do ensino de 1º e 2º graus (Lei n. 5.692/1971) de maneira impositiva. Diversos acordos, conhecidos como MEC-Usaid (Ministério da Educação e Cultura e United States Agency for International Development), ofereceram assistência técnica e cooperação financeira para implantar a reforma. A habilitação profissional constituiu-se em um emaranhado de "ofertas" que chegavam a 130 habilitações profissionais distribuídas conforme os cursos e as regiões do país. Algumas disciplinas desapareceram, como a de filosofia, e outras foram aglutinadas. Por sua vez, a inclusão de Moral e Cívica no primeiro nível e de Organização Social e Política no segundo exerceu a clara intenção de doutrinamento político. Há controvérsias em torno da extinção da filosofia do currículo escolar. Para alguns, a extinção revelava a intenção explícita dos governos militares de evitarem o desenvolvimento do pensamento crítico. Outros analisam de modo diferente, alegando que, com raríssimas exceções, o ensino da filosofia reduzia-se à história da filosofia, com ênfase na memorização, não representando, portanto, nenhuma ameaça ao regime de exceção, por desempenhar papel submisso e nada subversivo. Além disso, de acordo com o viés tecnicista da reforma, havia necessidade de mais espaço para incluir disciplinas voltadas para a habilitação profissional. Já nas universidades, era possível notar o crescente desprestígio da filosofia, tendo ocorrido perseguição a professores, muitos deles exilados. Todavia, o propósito de formar profissionais, conforme propunha a nova lei, não se concretizou. A escola pública se fragilizou ainda mais, enquanto algumas boas escolas da rede particular encontraram meios de contornar a lei e oferecer um ensino de qualidade com os mesmos conteúdos que visavam desenvolver o espírito crítico e, portanto, a capacidade de seus alunos pensarem por si mesmos. Em 1982, no clima da abertura democrática, a Lei n. 7.01-114 permitiu a reinserção da filosofia no currículo como optativa, a critério do estabelecimento de ensino. Nada foi conseguido sem esforço, mas com trabalho intenso e pressão da sociedade civil. Associações especialmente criadas para esse fim aglutinaram professores de cursos secundários e superiores para promoverem encontros, movimentos de protesto e contatos com autoridades governamentais, no esforço conjunto para alcançar aquele objetivo. Lei de Diretrizes e Bases da Educação Nacional (LDB) n. 9.394/1996 Após a aprovação da Constituição brasileira de 1988, restava elaborar a lei complementar para tratar das Diretrizes e Bases da Educação Nacional. A primeira LDB, de 1961, levara muito tempo para ser aprovada e ofereceu no final um texto já envelhecido. Devido a esse fato, havia interesse em acelerar a regulamentação da nova LDB, o que ocorreu em dezembro de 1996, com a publicação da Lei n. 9.394. O primeiro projeto da nova LDB baseou-se em amplo debate, não só na Câmara, mas também na sociedade civil, além de várias entidades sindicais, científicas, estudantis e segmentos organizados da educação. O projeto original exigiu do relator Jorge Hage importante trabalho de finalização, já que a nova lei não resultaria de exclusiva iniciativa do Executivo, e sim do debate democrático da comunidade educacional. No entanto, com apoio do governo e do ministro da Educação, o senador Darcy Ribeiro apresentou outro projeto que começara a ser discutido paralelamente e que terminou por ser aprovado. Como ficou a situação do ensino de filosofia? Apesar do movimento consistente que continuava defendendo o retorno da filosofia ao ensino médio, foi grande a decepção. Vejamos por quê. Ao estabelecer as finalidades da educação básica e as diretrizes dos conteúdos curriculares, essa lei destacava a importância da formação para o exercício da cidadania, a difusão de valores fundamentais ao interesse social, aos direitos e deveres dos cidadãos e de respeito ao bem comum e à ordem democrática. Foi recomendado também o aprimoramento do educando como pessoa humana, por meio de formação ética e desenvolvimento da autonomia intelectual e do pensamento crítico. Conforme a LDB sob Lei 9.394/98: Art. 22. A educação básica tem por finalidades desenvolver o educando, assegurar-lhe a formação comum indispensável para o exercício da cidadania e fornecer-lhe meios para progredir no trabalho e em estudos posteriores. Art. 27. Os conteúdos curriculares da educação básica observarão, ainda, as seguintes diretrizes: I – a difusão de valores fundamentais ao interesse social, aos direitos e deveres dos cidadãos, de respeito ao bem comum e à ordem democrática; II – consideração das condições de escolaridade dos alunos em cada estabelecimento; III – orientação para o trabalho; IV – promoção do desporto educacional e apoio às práticas desportivas não- formais. Art. 35. O ensino médio, etapa final da educação básica, com duração mínima de três anos, terá como finalidades: I – a consolidação e o aprofundamento dos conhecimentos adquiridos no ensino fundamental, possibilitando o prosseguimento de estudos; II – a preparação básica para o trabalho e a cidadania do educando, para continuar aprendendo, de modo a ser capaz de se adaptar com flexibilidade a novas condições de ocupação ou aperfeiçoamento posteriores; III – o aprimoramento do educando como pessoa humana, incluindo a formação ética e o desenvolvimento da autonomia intelectual e do pensamento crítico; IV – a compreensão dos fundamentos científico-tecnológicos dos processos produtivos, relacionando a teoria com a prática, no ensino de cada disciplina. Por fim, ficou claro no artigo 36, parágrafo 1º, inciso III (revogado pela Lei n. 11.684, de 2008), que os conteúdos, as metodologias e as formas de avaliação deveriam ser organizados de tal maneira que ao final do ensino médio o educando demonstrasse "domínio dos conhecimentos de filosofia e de sociologia necessários ao exercício da cidadania". Embora a educação para a cidadania constituísse um objetivo visado por qualquer disciplina, com mais razão o professor de filosofia teria condições de abordá-la explicitamente, não só por tomá-la como um de seus conteúdos, mas principalmente pelo seu caráter problematizador e argumentativo, próprio da filosofia. Portanto, seria válido supor que o artigo 36 definisse a reinserção da filosofia no currículo, ministrada por profissional formado na área, o que de fato não se concretizou, e o ensino de filosofia permaneceu como não obrigatório. Posteriormente, conforme a Resolução CEB n. 3/1998, "as propostas pedagógicas das escolas deverão assegurar o tratamento interdisciplinar e contextualizado para os conhecimentos de filosofia e de sociologia necessários ao exercício da cidadania" (artigo 10, parágrafo 2º, alínea b]. Ou seja, professores de outras disciplinas seriam responsáveis por esses "temas transversais", orientação que prevaleceu nos Parâmetros Curriculares Nacionais. Um pouco antes, em 1997, dando continuidade a anseios de educadores, o deputado federal Padre Roque Zimmermann apresentara projeto de lei para tornar obrigatório o ensino de filosofia e sociologia no currículo do ensino médio. Após sua aprovação no Senado, em 2001, o projeto foi vetado pelo então presidente Fernando Henrique Cardoso. Finalmente, em 2008, o artigo 36 da LDB sofreu alteração, tornando obrigatório o ensino de filosofia e de sociologia no currículo do ensino médio, por meio da Lei n. 11.684/2008. Na sequência da aprovação, continua em andamento a implantação desse projeto de ensino. Esperamos que o espaço conquistado não venha a sofrer mais tarde nova retração. Few have given an extended treatment of the non-statistical sense of normality: a sense captured in sentences like “dogs have four legs,” or “hammers normally have metal heads,” or “it is normal for badgers to take dust baths.” The most direct extant treatment is Bernhard Nickel’s Between Logic and the World, where he claims that the normal or characteristic for a kind is what we can explain by appeal to the right sorts of explanations. Just which explanatory strategies can (...) ground normalities, though, is difficult to determine without inviting circularity into the account. After raising this and other worries for Nickel’s account, I develop my own account according to which normal features are those which are explained by the kind of thing involved. (shrink)

This paper discusses possible forms of loss or weakness of the ability to interact with others and the ways in which this arises. In particular, in the context of socio-affective knowledge and related failures, it focuses on certain deficits that primarily involve the body. The article aims to show that the “destiny” of our inner drives and our lives—the specific solutions to which they are forced in their vicissitudes—is less “blind” than it appears, leaving (albeit minimal) margins of escape, also (...) because it has a relational connotation. Starting from Bernhard Waldenfels’s recent work on the relationship between phenomenology and psychoanalysis, in which this question is addressed from a phenomenological-responsive point of view, this article reflects on the problem by establishing a comparison between Waldenfels’s philosophy and Max Scheler’s phenomenology of values. Beyond the differences that their approaches to the problem of relational deficits present, Waldenfels and Scheler can be put in fruitful dialogue with each other, starting from their common interest in Freudian psychoanalysis. Within this framework, it is possible to evaluate, adopting Scheler’s point of view, both a methodological aspect and a psychological presupposition of Freud’s ontogenesis of sympathy and love: associationism. From this perspective, Freud reveals himself in part as an heir to British empiricism. I will argue that, with and beyond Freud, the human being is not reducible to a mere sum of blind sensations or blind drives and that for both at least certain forms of inability to interact with others are derivative—deformations of normal responsivity and aberrations of normal pulsional-(relational) life—rather than originary phenomena. International human rights law is profoundly oxymoronic. Certain well-known international treaties claim a universal character for human rights, but international tribunals often interpret and enforce these either narrowly or, if widely, they rely upon sovereign states to enforce the rights against themselves. International lawyers and diplomats have usually tried to resolve the apparent contradiction by pressing for more general rules in the form of treaties, legal doctrines, and institutional procedures. Despite such efforts, aliens remain who are neither legal nor illegal (...) and who thereby slip through a discourse that claims universality. I ask, why does international legal discourse claim a universality of human rights enforceable by impartial, politically neutral tribunals when it also recognises that a state may refuse to recognise some groups as “persons”? I turn to the works of Bernhard Waldenfels for an explanation. To that end, I briefly outline two examples of state-centered human rights treaties. I then reconstruct Waldenfels’ explanation as to how a territorial sense of space needs an alien exterior to the space. The territorial structure assumes time is frozen as of the date of the foundation of the structure. The body of the alien is taken as a biological body. The personality, motives, and actions of the alien are the consequence of the imagination of people inside the territorial boundary. The dominant international legal discourse reinforces and institutionalises such a territorial sense of space and frozen time because the territorial state is considered the primary legal subject of international law. I also retrieve, however, an experiential but concealed sense of space and time. To retrieve this sense of space and time requires that lawyers see the world through the twilight of legality heretofore ignored as pre-legal. (shrink)

From the beginning of the 16th century to the end of the 18th century, there were not less than ten philosophers who focused extensively on Venn’s ostensible analytical diagrams, as noted by modern historians of logic (Venn, Gardner, Baron, Coumet et al.). But what was the reason for early modern philosophers to use logic or analytical diagrams? Among modern historians of logic one can find two theses which are closely connected to each other: M. Gardner states that since the Middle (...) Ages certain logic diagrams were used just in order to teach “dull-witted students”. Therefore, logic diagrams were just a means to an end. According to P. Bernhard, the appreciation of logic diagrams had not started prior to the 1960s, therefore the fact that logic diagrams become an end the point of research arose very late. The paper will focus on the question whether logic resp. analytical diagrams were just means in the history of (early) modern logic or not. In contrast to Gardner, I will argue that logic diagrams were not only used as a tool for “dull-witted students”, but rather as a tool used by didactic reformers in early modern logic. In predating Bernhard’s thesis, I will argue that in the 1820s logic diagrams had already become a value in themselves in Arthur Schopenhauer’s lectures on logic, especially in proof theory. The basis of analyzes carried out in the article is the work of Bernhard Welte: Meister Eckhart. Gedanken zu seinen Gedanken. The central subject of research is the idea Abgeschiedenheit (“isolation”). Following the interpretation of Welte it has been considerated a phenomeno‐ logical description on two ways. From the practical experience, as a modus vivendi a religious man, and from the theoretical, as speculative thought. Theoretical considerations consist of analysis of the concept of truth and goodness, which Eckhart identifies (...) with the idea of God. Welte shows that these concepts of medieval thinker at the starting point considerations are still sink in the schemes of metaphysical thinking, but in the next stages of its argumentation he overcome metaphysical discourse. The purpose of the article, guided by the suggestion Weltes interpretation, is to show ways of reaching the source forms of religious experience. At the same time the text raised the issue of problematic use formulas of mystical union and noticed parallels have been taking place between the method of phenomenological reduction and the idea of Abgeschiedenheit.
