A deterrence theory of punishment holds that the institution of criminal punishment is morally justified because it serves to deter crime. Because the fear of external sanction is an important incentive in crime deterrence, the deterrence theory is often associated with the idea of severe, disproportionate punishment. An objection to this theory holds that hope of escape renders even the severest punishment inapt and irrelevant. -/- This article revisits the concept of deterrence and defend a more plausible deterrence theory of (...) punishment—the wide-scope deterrence theory. The wide-scope theory holds that we must make the best use of all the deterrence tools available, including both external and internal sanctions. Drawing on insights from the early Confucian tradition, the article develops a deep deterrence theory, which holds that the most important deterrence tool involves internal, not external, sanction. It describes how internal sanctions deter potential offenses and why relevant policies need not conflict with liberalism’s respect for neutrality. (shrink)

Does communicative retributivism necessarily negate capital punishment? My answer is no. I argue that there is a place, though a very limited and unsettled one, for capital punishment within the theoretical vision of communicative retributivism. The death penalty, when reserved for extravagantly evil murderers for the most heinous crimes, is justifiable by communicative retributive ideals. I argue that punishment as censure is a response to the preceding message sent by the offender through his criminal act. The gravity of punishment should (...) be commensurate to the preceding criminal message, so that the offender can face up to the nature and significance of his crime. All murders are not the same. To measure up to the most evil and humanity-degrading murderous message, capital punishment should be the counter-message. Next, I argue that capital punishment does not necessarily violate human dignity. The death penalty and torture may both disrupt human dignity, yet in distinct ways. The death penalty terminates life, the vessel that holds together autonomy, while torture directly assaults autonomy. Torture is never permissible as a form of punishment. But death penalty, when used only on the extravagant evildoers, is justifiable, as life is thoroughly degraded by his own evil act. Further, I argue that mercy is integral to communicative retributivists’ theory of capital punishment. (shrink)

Mystical religious experiences typically purport to engage with the transcendent and often claim to involve encounters with spiritual entities or a detachment from the material world. Daoism diverges from this paradigm. This paper examines Daoist mystical experiences of bodily transformations and explores their epistemological implications. Specifically, we defend the justificatory power of Daoist somatic experiences against the disanalogy objection. The disanalogy objection posits that mystical experiences, in contrast to sense perceptions, are not socially verifiable and thereby lack prima facie epistemic (...) value. We argue that some Daoist mystical bodily states, being essentially spatiotemporal, are exempt from this challenge. This leads to a broader understanding of mysticism and offers a partial resolution to the disanalogy objection. (shrink)

David Miller argues that national identity is indispensable for the successful functioning of a liberal democracy. National identity makes important contributions to liberal democratic institutions, including creating incentives for the fulfilment of civic duties, facilitating deliberative democracy, and consolidating representative democracy. Thus, a shared identity is indispensable for liberal democracy and grounds a good claim for self-determination. Because Miller’s arguments appeal to the instrumental values of a national culture, I call his argument ‘instrumental value’ arguments. In this paper, I examine (...) the instrumental value arguments and show that they fail to justify a group’s right to self-determination. (shrink)

Despite the good intention of humanitarian agencies, humanitarian assistance and relief aid exacerbated the humanitarian crisis in Tanzania during 1994. In the case of Tanzania, humanitarian assistance relieved belligerents’ burden of sustaining conflicts, created safe spaces for armed combatants, undermined local economies, bestowed legitimacy upon belligerents, and fed armed combatants. This situation hence posed the typical humanitarian assistance dilemma for humanitarian agencies. While most scholars and aid practitioners suggest that humanitarian agencies should withdraw their assistance in these contexts given aid’s (...) apparent negative impact, there is relatively little research that properly identifies different kinds of ethical constraints and moral dilemmas that have long challenged humanitarian agencies. Referencing the case of late-twentieth-century Tanzania, this article contextualises the humanitarian assistance dilemma and systematically examines the ethical predicaments that surround it. Its analysis sheds light on moral quandaries that humanitarian agencies need to address in conflict situations. (shrink)

In this paper, I propose a new self-defense theory of punishment, the rights-protection theory. By appealing to the interest theory of right, I show that what we call “the right of self-defense” is actually composed of the right to protect our basic rights. The right of self-defense is not a single, self-standing right but a group of derivative rights justified by their contribution to the protection of the core, basic rights. Thus, these rights of self-defense are both justified and constrained (...) by the basic rights they are supposed to protect. I then explain how this theory responds to a common objection. Opponents argue that, to exercise the right of self-defense, some threat must be present. However, in the context of punishment, the threat has already taken effect or is already gone. Thus, the right of self-defense becomes irrelevant when we punish an offender. I show that this objection is based on an implausibly narrow conception of self-defense. A reasonable conception would allow us to exercise our right of self-defense when there is a present definite threat, a future definite threat, or a potential threat. Thus, we may still exercise our right of self-defense in the context of punishment. (shrink)

We describe a strategy that is being used for the horizontal integration of warfighter intelligence data within the framework of the US Army’s Distributed Common Ground System Standard Cloud (DSC) initiative. The strategy rests on the development of a set of ontologies that are being incrementally applied to bring about what we call the ‘semantic enhancement’ of data models used within each intelligence discipline. We show how the strategy can help to overcome familiar tendencies to stovepiping of intelligence data, and (...) describe how it can be applied in an agile fashion to new data resources in ways that address immediate needs of intelligence analysts. Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

Recent psychological research shown that the places where we live are linked to our personality traits. Geographical aggregation of personalities has been observed in many individualistic nations; notably, the mountainousness is an essential component in understanding regional variances in personality. Could mountainousness therefore also explain the clustering of personality-types in collectivist countries like China? Using a nationwide survey (29,838 participants) in Mainland China, we investigated the relationship between the Big Five personality traits and mountainousness indicators at the provincial level. Multilevel (...) modelling showed significant negative associations between the elevation coefficient of variation (Elevation CV) and the Big Five personality traits, whereas mean elevation (Elevation Mean) and the standard deviation in elevation (Elevation STD) were positively associated with human personalities. Subsequent machine learning analyses showed that, for example, Elevation Mean outperformed other mountainousness indicators regarding correlations with neuroticism, while Elevation CV performed best relative to openness models. Our results mirror some previous findings, such as the positive association between openness and Elevation STD, while also revealing cultural differences, such as the social desirability of people living in China’s mountainous areas. Both Kymlicka and Patten argue that the equal treatment of different national groups require that the state officially recognize the right of each to create its own autonomous government. After carefully examining their arguments, I show that they both make the false assumption that, in a multinational state, the state belongs only to the majority group but not the minority, and that a multination state can never treat minority groups equally. Both claims are inherently anti-pluralistic. Thus, the equal treatment of (...) different national cultures does not require that each be granted the right to self-government. (shrink)

Following the pioneering studies of the receptive field (RF), the concept gained further significance for visual perception by the discovery of input effects from beyond the classical RF. These studies demonstrated that neuronal responses could be modulated by stimuli outside their RFs, consistent with the perception of induced brightness, color, orientation, and motion. Lesion scotomata are similarly modulated perceptually from the surround by RFs that have migrated from the interior to the outer edge of the scotoma and in this way (...) provide filling-in of the void. Large RFs are advantageous to this task. In higher visual areas, such as the middle temporal and inferotemporal lobe, RFs increase in size and lose most of their retinotopic organization while encoding increasingly complex features. Whereas lowerlevel RFs mediate perceptual filling-in, contour integration, and figure–ground segregation, RFs at higher levels serve the perception of grouping by common fate, biological motion, and other biologically relevant stimuli, such as faces. Studies in alert monkeys while freely viewing natural scenes showed that classical and nonclassical RFs cooperate in forming representations of the visual world. Today, our understanding of the mechanisms underlying the RF is undergoing a quantum leap. What had started out as a hierarchical feedforward concept for simple stimuli, such as spots, lines, and bars, now refers to mechanisms involving ascending, descending, and lateral signal flow. By extension of the bottom-up paradigm, RFs are nowadays understood as adaptive processors, enabling the predictive coding of complex scenes. Top-down effects guiding attention and tuned to task-relevant information complement the bottom-up analysis. (shrink)

This paper establishes a Kantian duty against screen overexposure. After defining screen exposure, I adopt a Kantian approach to its morality on the ground that Kant’s notion of duties to oneself easily captures wrongdoing in absence of harm or wrong to others. Then, I draw specifically on Kant’s ‘duties to oneself as an animal being’ to introduce a duty of self-government. This duty is based on the negative causal impact of the activities it regulates on a human being’s mental and (...) physical powers, and, ultimately, on the moral employment of these powers. After doing so, I argue that the duty against screen overexposure is an instance of the duty of self-government. Finally, I consider some objections. (shrink)

The principle of national self-determination holds that a national community, simply by virtue of being a national community, has a prima facie right to create its own sovereign state. While many support this principle, not as many agree that it should be formally recognized by political institutions. One of the main concerns is that implementing this principle may lead to certain types of inequalities—between nations with and without their own states, members inside and outside the border, and members and nonmembers (...) inside the same nation state. While these inequalities may arise, I shall argue that they are not unjust. These worries are partly the results of confusing two types of interests that a national group may have—in cultural affairs and in political affairs. While a national community should enjoy rights over their cultural affairs, this does not grant them authority over other non-cultural, political affairs. Once the distinction is drawn, we can see that there are constraints on the implementation of this principle. Consequently, these inequalities justify setting limits to a group’s right of self-government, although they do not conclusively refute the right itself. (shrink)

In this chapter, I consider contemporary consequentialist theories of punishment. Consequentialist theories of punishment look to the consequences of punishment to justify the institution of punishment. Two types of theories fall into this category—teleology and aggregationism. I argue that teleology is implausible as it is based on a problematic assumption about the fundamental value of criminal punishment, and that aggregationism provides a more reasonable alternative. Aggregationism holds that punishment is morally justified because it is an institution that helps society to (...) aggregate important moral values. Several theories fall into this category, including general deterrence theories, specific deterrence theories, and preventionism. I critically evaluate these theories and argue that only one specific deterrence theory, namely, my rights-protection theory, provides the most reasonable consequentialist account of punishment. In a recent work, Walter Carnielli and Abilio Rodrigues present an epistemically motivated interpretation of paraconsistent logic. In their view, when there is conflicting evidence with regard to a proposition A (i.e. when there is both evidence in favor of A and evidence in favor of ￢A) both A and ￢A should be accepted without thereby accepting any proposition B whatsoever. Hence, reasoning within their system intends to mirror, and thus, should be constrained by, the way in which we reason (...) about evidence. In this article we will thoroughly discuss their position and suggest some ways in which this project can be further developed. The aim of the paper is twofold. On the one hand, we will present some philosophical critiques to the specific epistemic interpretation of paraconsistent logic proposed by Carnielli & Rodrigues. First, we will contend that Carnielli & Rodrigues’s interpretation implies a thesis about what evidence rationally justifies to accept or believe, called Extreme Permissivism, which is controversial among epistemologists. Second, we will argue that what agents should do, from an epistemic point of view, when faced with conflicting evidence, is to suspend judgment. On the other hand, despite these criticisms we do not believe that the epistemological motivation put forward by Carnielli & Rodrigues is entirely wrong. In the last section, we offer an alternative way in which one might account for the epistemic rationality of accepting contradictions and, thus, for an epistemic understanding of paraconsistency, which leads us to discuss the notion of diachronic epistemic rationality. A number of philosophers argue that the moral value of national identity is sufficient to justify at least a prima facie right of a national community to create its own independent, sovereign state. In the literature, this argument is commonly referred to as the identity argument. In this paper, I consider whether the identity argument successfully proves that a national group is entitled to a state of its own. To do so, I first explain three important steps in the argument (...) and then consider whether they lead to the desired conclusion. My examination reveals that the identity argument relies on the Optimal Protection Principle; however, this principle does not apply to the case of a national community. As a result, the identity argument fails to justify even a prima facie right of a national community to establish its own state. (shrink)

Allen Buchanan proposes a methodological framework with which theorists may evaluate different theories of secession, including the National Self-Determination theory. An important claim he makes is, because the right to secede is inherently institutional, any adequate theory of secession must include, as an integral part, an analysis of institutional morality. Because the National Self-Determination theory blatantly lacks such an analysis, Buchanan concludes that this theory is inherently flawed. In this paper, I consider Buchanan’s framework and the responses from supporters of (...) national self-determination theory. I try to clarify the confusion shared by both parties. I conclude that, although Buchanan’s theory of institutional morality is sound, his critiques of the national self-determination theory fails. (shrink)

This article analyses how child victims of abuse may be subjected to hermeneutical injustice. I start by explaining how child victims are hermeneutically marginalised by adults’ social and epistemic authority, and the stigma around child abuse. In understanding their abuse, I highlight two epistemic obstacles child victims may face: (i) lack of access to concepts of child abuse, thereby causing victims not to know what abuse is; and (ii) myths of child abuse causing misunderstandings of abuse. When these epistemic obstacles (...) cause the child victims to fail to see themselves as being abused and/or to get adults to recognise that they are being abused, I argue that this constitutes hermeneutical injustice. While some may justify obstructing epistemic access to concepts of abuse on the grounds of parental rights and protection of children’s innocence, I reply that both grounds are unjust in light of children’s basic rights and the fact that children can easily be taught such concepts in a child-appropriate manner. The case of child abuse prompts important reflections on existing epistemic injustice literature, particularly on the ways in which hermeneutical injustice materialises, the epistemic responsibilities of institutional bodies and individuals, and the interrelationship between testimonial and hermeneutical injustice. In Religion within the Bounds of Bare Reason Kant speaks of an ethical state of nature and of an ethico-civil condition, with explicit reference to the juridical state of nature and the juridico-civil condition he discusses at length in his legal-political writings. Given that the Religion is the only work where Kant introduces a parallel between these concepts, one might think that this is only a loose analogy, serving a merely illustrative function. The paper provides a first outline of the (...) similarities and the differences between the state of nature and the civil condition in Right and in ethics. The comparison points to a deeper, structural relation between the two pairs of concepts. By doing so, it makes room for developing a unitary conception of the state of nature and of the civil condition, which would underlie both the ethical and the juridical version. (shrink)

The paper lays the foundations for a duty of sustainable property use based on Kant’s Doctrine of Right. In doing so, it contributes to the project of extending the application of Kant’s philosophy to environmental issues so as to include his legal-political philosophy. After providing some context, focusing in particular on Kant’s property argument, I present and critically evaluate a recent argument for a duty of sustainable property use, put forward by Attila Ataner. Then, I draw on Reinhard Brandt’s and (...) Katrin Flikschuh’s interpretation of Kant’s permissive law in order to develop my own argument. According to my account, the duty of sustainable property use is rooted in Kant’s property argument, it is best construed in terms of interpersonal freedom, and it has a structure resembling that of duties of distributive justice. Unlike Ataner’s, my argument proceeds entirely within the domain of interpersonal freedom; it focuses clearly on the normative sense of usability; it does not overgenerate obligations; and it categorises the duty of sustainable property use within Kant’s taxonomy of duties. It thus constitutes a promising starting point to further investigate the connection between sustainability, Kant’s property argument and its use of a permissive law, and the Universal Principle of Right. Gary Bartlett (2022) provides critical reflections on my account of hermeneutical injustice experienced by child victims of abuse (Lo 2022). He argues that professionals cannot be said to have all the relevant concepts of abuse as child victims have unique access to the emotional and subjective aspects of that experience. He thus cautions against remedying the hermeneutical injustice by having institutions replace folk concepts with institutional concepts. Bartlett further reflects on the hermeneutical marginalisation of children and questions to what extent (...) does that constitute hermeneutical injustice against children generally. Open science is the movement to make scientific research (including publications, data, physical samples, and software) and its dissemination accessible to all levels of society, amateur or professional.

There are two kinds of time-bias: near-bias and future-bias. While philosophers typically hold that near-bias is rationally impermissible, many hold that future-bias is rationally permissible. Call this normative hybridism. According to arbitrariness objections, certain patterns of preference are rationally impermissible because they are arbitrary. While arbitrariness objections have been levelled against both near-bias and future-bias, the kind of arbitrariness in question has been different. In this paper we investigate whether there are forms of arbitrariness that are common to both kinds (...) of preferences, and hence whether there are versions of the arbitrariness objection that are objections both to near-bias and future-bias. If there are, then this might go some way towards undermining normative hybridism and to defending a thorough-going time-neutralism. (shrink)

У статті описано підходи до написання словників у перші десятиліття ХХ ст. Розглянуто концепцію і принципи укладання російсько-українського академічного словника. Проаналізовано реалізацію концепції російсько-українського академічного словника як лексикографічної праці, що поєднує риси перекладного, тлумачного, синонімічного та фразеологічного словників.

У статті описано джерела реєстру російсько-українського академічного словника за редакцією А. Кримського та С. Єфремова, а також інших російсько-українських словників 20-х рр. ХХ ст. Реєстри тогочасних перекладних словників базувалися переважно на реєстрах перекладних словників, виданих раніше, частково залучалися словники інших типів, зокрема термінологічні, а також матеріали преси.

Статтю присвячено аналізові церковно-музичних книг василіянських монастирів Руської провінції другої половини XVIII — початку ХІХ ст. На підставі монастирських інвентарів висвітлюється діяльність друкарні Почаївського василіянського монастиря, яка, серед іншого, спеціалізувалася на виданні музичних книг, зокрема Ірмолоїв— поліжанрових збірників, що властиві українському типові церковно-співочої книги. У статті наголошено також на ролі Василіянського Чину в поширенні західно-християнських культурних впливів упродовж другої половини XVIII cт.

Many philosophers have become sceptical of the use of thought experiments in theorising about personal identity. In large part this is due to work in experimental philosophy that appears to confirm long held philosophical suspicions that thought experiments elicit inconsistent judgements about personal identity, and hence judgements that are thought to be the product of cognitive biases. If so, these judgements appear to be useless at informing our theories of personal identity. Using the methods of experimental philosophy, we investigate whether (...) people exhibit inconsistent judgements and, if they do, whether these judgements are likely to be the source of cognitive bias or, instead, sensitivity to some relevant factor. We do not find that people’s judgements are sensitive to any of the factors we investigate (relevant or irrelevant), nor that people have inconsistent judgements across cases. Rather, people’s judgements are best explained by them having a very minimal account of what it takes for a person to survive. Since this pattern of judgements is no reason to think that we are subject to cognitive bias, we see no reason, as things stand, to be sceptical of our judgements. (shrink)

De ellos queremos rescatar su ética y estética, su condición de asumir la filosofía como un estilo de vida y su permanente cuestionamiento a la moral establecida dentro de la polis griega. No menos importante es presentar el tema de su sexualidad, su postura filosófica ante el dolor humano y su ataque a los convencionalismos. Se consideraron médicos del alma, permaneciendo (...) como una escuela inclasificable a lo largo de la historia de la filosofía. Presentamos su concepción del cuido de sí en tanto un apartarse de los demás, es decir, estableciendo un cuido contra los demás, sin obviar al otro sino enfrentándolo a su ignorancia. En su momento fueron llamados revolucionarios de la ética por su actitud insobornable frente a sus principios de autonomía y autosuficiencia. (shrink)

In this essay, I reflect on the implications of intellectual virtues in scientific endeavor. To this end, I first offer a depiction of scientific endeavor by resorting to the notion of academic attitude, which involves aspects concerning the generation and possession of knowledge. Although there are differences between these activities, they have in common the engagement of diverse intellectual agents (scientists). In this sense, I analyze how intellectual virtues are linked to 1) scientific research tasks, such as theory appraisal, and (...) 2) those tasks of vigilance and intervention in the uses of scientific knowledge. I conclude that intellectual virtues play a leading role in achieving higher quality scientific research and adequate foresight on the uses and impacts of scientific findings. In this order of ideas, I propose an agenda for further inquiries on these matters, highlighting the relevance of reflecting and empirically researching the relationship between intellectual virtues and science, as well as cultivating intellectual virtues in various stages of scientific training. The paper discusses two ways to understand political liberalism. On the one hand, political liberalism may rely on the existence of an overlapping consensus among all reasonable comprehensive views present in our society. On the other hand, we may ground political liberalism on the moral value of equal respect for everyone. The dilemma between a factual identification of an overlapping consensus and a normative appeal to moral values arises at two levels. First, when we fill the content of our political (...) conception of justice. And second, when we require impartiality to fill that content. In the former case, we may argue for a particular conception of justice through normative argument with moral premises, or our political conception of justice might be the area where all reasona-ble comprehensive views overlap. Similarly, we require that citizens offer impartial public reasons because this is what people holding different comprehensive views do think ap-propriate, or because they should consider it so. The author argues that we should define our political conception of justice through impartial normative argument, and that we should ground the demand of impartiality on the moral value of equal respect. Non-state peoples cannot be subjects of Kant’s international law, which accordingly affords them no protection against external interference. They might also lack the dynamic of private law at the basis of the duty of state entrance. Prima facie, this compels Kant to allow that their lands be appropriated and that they be forced out of the state of nature. But this conclusion is at odds with his cosmopolitanism, particularly its anti-imperialistic commitments: non-state peoples are protected against annexation, under Kant’s cosmopolitan (...) law. The paper makes three contributions to the debate on this tension. Firstly, it disambiguates scope, ground, and relata of the duty to exit the state of nature. Secondly, it argues that non-state peoples have an inter-group duty to exit the state of nature; and that this holds for a non-state people regardless of whether it also has an intra-group duty of state entrance, which remains unenforceable by outside parties. Finally, it offers a construal of the former duty as a cosmopolitan duty to interact peacefully even in the absence of a shared culture. (shrink)

En este texto defiendo los contraejemplos tipo-Frankfurt de este ataque de Widerker presentando un dilema en el que su premisa fundamental, el Principio de expectativas alternativas, se ve envuelta: o bien la plausibilidad de este principio depende de la máxima kantiana "deber" implica "poder", lo cual haría (...) que el principio mismo, y con él todo el argumento de Widerker, sea redundante y prescindible; o bien no se basa en esta máxima, pero entonces no hay ninguna razón de fuerza por la cual se pudiera defender que este principio debe ser aceptado como válido. A critique presented by David Widerker on Frankfurt-counterexamples and known as the "W-defense" has persisted for years and has been considered one of the most difficult challenges these counterexamples have to face. This paper aims to defend Frankfurt counterexamples against Widerker's attack. For doing this, the paper presents a dilemma addressed to the main premise of Widerker's attack: The Principle of Alternative Expectations. The dilemma states: either this principle rests on the Kant's maxim, "ought" implies "can", and then this makes redundant and unnecessary the principle and Widerker's whole argument; or the principle does not rest on such maxim and then there is no good reason to accept it as valid. Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. El discurso sobre los nuevos derechos humanos se ha asentado como un elemento característico de la práctica política y jurídica contemporánea. Son muy diversos los colectivos que presentan sus reivindicaciones políticas con el lenguaje de los derechos humanos con la finalidad de incrementar el apoyo a dichas reivindicaciones y de dotar a dichas reivindicaciones de la protección privilegiada de los derechos humanos. Pese a ello, las constantes referencias a nuevos derechos no han venido acompañadas de una reflexión teórica adecuada. ¿Cómo (...) se relacionan los nuevos derechos con los derechos clásicos?, ¿ponen en entredicho los nuevos derechos el paradigma de derechos humanos dominante en la actualidad?, ¿cómo afectaría su reconocimiento a la configuración de los sistemas jurídicos contemporáneos?, ¿qué reivindicaciones de nuevos derechos están verdaderamente justificadas? Los nuevos derechos humanos: teoría jurídica y praxis política reúne a una serie de trabajos que tratan de dar respuesta a estos interrogantes, tanto a partir de la discusión general de la teoría de los derechos humanos como a partir de la discusión de derechos específicos, como los neuroderechos, los derechos digitales, derechos relacionados con el inicio o final de la vida, los derechos de la naturaleza, el derecho al deporte o los derechos de asistencia sexual. Los espacios de la violencia (direccionalidad), en la primera novela de Vargas Llosa, La ciudad y los perros (1963), se representan en sus ámbitos intelectual, físico, emocional, social y cultural. La frecuencia con la que los personajes ejecutan estas acciones, en un determinado lugar, acentuará el proceso de la conformación de su identidad violenta, como cuando los cadetes pelean entre ellos; únicamente, en lugares apartados donde las autoridades militares del Leoncio Prado no pueden verlos ni controlarlos. El personaje Ricardo Arana (...) practica la no violencia, pero ni aun así puede librarse de las perversidades de sus otros compañeros; la resistencia que ejerce tan solo provoca que los demás muchachos lo envidien y terminen abusando de él, más que de cualquier otro estudiante. Considerar un evento como descubrimiento científico es tarea compleja que, casi siempre, se ve influida por la sistematización de las investigaciones, la publicación de los hallazgos, o las ideas sobre la realidad del contexto donde se presenta.

Se ofrece un grupo de reflexiones acerca del vínculo entre dos conceptos de amplio uso en el lenguaje académico y no académico contemporáneo: valores universales y problemas globales. ¿Qué son los valores universales? ¿Por qué los seres humanos difieren en cuanto a su interpretación? ¿En qué medida el surgimiento y agudización de los problemas globales se asocia a una práctica distanciada de los verdaderos valores universales? ¿Qué hacer para que sean estos últimos los que en realidad sustenten las relaciones internacionales? (...) ¿Qué papel desempeñan estos valores en la búsqueda de soluciones a los problemas globales? El presente trabajo pretende aproximar una respuesta a estas interrogantes. (shrink)

Sobre los robots como mejores médicos que los humanos.

El estudio acerca de la influencia de las pasiones en el voluntario libre ha sido recurrente en la tradición tomista. Sin embargo, las causas de los dos efectos psicológicos de la intentio volitiva mencionados por Tomás de Aquino, la redundantia y la distractio, pasaron desapercibidas, y podrían aclarar algunos comportamientos consecuencia de la dinámica de las pasiones del hombre. La acción de la intentio volitiva originada por los afectos, al alcanzar cierto grado de intensidad, puede llegar a sobrepasar el control (...) de la voluntad y la inteligencia. Además, otro punto original de esta temática es que, a la par que el influjo de “abajo hacia arriba” (pasiones hacia la voluntad) —algo ya mencionado por Aristóteles cuando habla de la intemperancia y por los medievales en el estudio de la voluntad—, también puede detectarse otro de “arriba hacia abajo” (influjos afectivos superiores que influyen en la inteligencia —conocimiento afectivo⎯ y ésta sobre la voluntad), de tal manera que cierto tipo de concentraciones psicológicas hacen que la persona deje de tener sensaciones somáticas hasta producirse en él evasiones temporales, trances inconscientes y efectos extremos similares. Finalmente, desde el punto de vista de la Historia de la Filosofía, este trabajo también muestra que ha habido un olvido en el estudio de esta faceta volitiva de la intentio, ya que se ha estudiado sobre todo su aspecto ético, pero sin relación con la intentio cognoscitiva (“intencionalidad”). En cualquier caso, las tesis sobre la intentio y sus efectos muestran cómo es preciso rebasar el estudio del ámbito natural-biológico para completarlo con el ámbito personal-cultural. (shrink)

En 1968 Raquel Carson comenzaba una revolución en el pensamiento, quizá una de las de mayor peso en la actualidad. En su libro "La primavera silenciosa" acusaba del deterioro ambiental al poder ilimitado del ser humano. La creencia surgida en la modernidad de que todo lo que el hombre decidía era en sí mismo lo mejor por haber sido fruto de una voluntad libérrima, daba primacía y legitimidad absoluta a su acción sobre la naturaleza. Surgieron con gran fuerza numerosos grupos (...) ecologistas que adoptaron un pensamiento que responde al nombre de "ecología profunda" o "Deep Ecology" descrito por primera vez por Arme Naess en un artículo publicado por la revista Inquiry y titulado "The Shallow and the Deep, Long Range Ecology Movement". Los principios que proponía este movimiento (Naess 1984) pueden ser resumidos en ocho grandes puntos: 1) la vida de los seres no humanos es un valor en sí: 2) la riqueza y la diversidad de estas formas de vida son también valores en sí; 3) los seres humanos no pueden intervenir de manera destructiva en la vida; 4) a este respecto, la intervención humana actual es eminentemente excesiva; 5) por consiguiente, las reglas de juego deben ser radicalmente modificadas; 6) esta modificación radical debe hacerse tanto a nivel de las estructuras económicas como de las estructuras ideológicas y culturales; 7) a nivel ideológico, el cambio principal consiste en apreciar más la calidad de la vida que el goce de los bienes materiales; 8) las personas que acepten estos principios tienen la obligación de contribuir, directa o indirectamente a la realización de los cambios fundamentales que aquellos implican. Para Foucault las relaciones de dominación son el camino de acceso al análisis del poder. Cabe la pregunta si la relación de poder es lucha, enfrentamiento, guerra, siendo ésta última el motor de las instituciones y el orden en la visión foucaultiana de la realidad. Para responderla aparecen nociones como la del mal radical de Hanna Arendt o la de libertad de Leonardo Polo. Aún cuando se trata de posiciones filosóficas distintas todas ellas vislumbran que lo auténticamente radical en el (...) ser humano es la libertad. (shrink)

En “The King´s two bodies” Kantorowicz explora la ficción legal de los dos cuerpos del Rey: cuerpo mortal y cuerpo político. Ficción en la cual el rey, constituido como persona ficta, trasciende la temporalidad de cualquier cuerpo individual sobre la idea de “dignitas non moritur”. El presente trabajo pretende abordar la lectura de esa dualidad corporal encarnada en el derecho a través de un doble registro: cuerpo textual y cuerpo imaginario, explorando asimismo cómo el discurso jurídico se construye en el (...) marco de dicha simbología y legitimidad. Instituir lo vivo del texto jurídico no puede hacerse más que sobre el rastro de la semiótica misma. Como señala Legendre, la normatividad produce un “Écrit vivant” en perpetua necesidad de interpretación. Es paradójicamente la batalla por la apertura del texto lo que permite la imagen misma de su continuidad. Una crítica de los montajes vividos, de la instancia de la censura que ata y moviliza el discurso jurídico, provee el fondo de una urgencia: el de la tarea iusfilosófica por venir. (shrink)
