Intelligent neurotechnology is an emerging field that combines neurotechnologies like brain-computer interface (BCI) with artificial intelligence. This paper introduces a capability framework to assess the responsible use of intelligent BCI systems and provide practical ethical guidance. It proposes two tests, the threshold and flourishing tests, that BCI applications must meet, and illustrates them in a series of cases. After a brief introduction (Section 1), Section 2 sets forth the capability view and the two tests. It illustrates the threshold test using (...) examples from clinical medicine of BCI applications that enable patients with profound disabilities to function at a threshold level through computer mediation. Section 3 illustrates the flourishing test by exploring possible future applications of BCI involving neuroenhancements for healthy people, using examples adapted from research currently underway in the US military. Section 3 applies a capability lens to a complex case involving dual effects, both therapeutic and non-therapeutic, showing how the threshold and flourishing tests resolve the case. Section 4 replies to three objections: neurorights are the best tool for assessing BCI; the two tests are moving targets; and the analysis utilizes a capability view to do work it is not designed for. The paper concludes that a capability view offers unique advantages and gives practical guidance for evaluating the responsible use of present and future BCI applications. Extrapolating from our analysis may help guide other emerging technologies, such as germline gene editing, expected to impact central human capabilities. (shrink)

Previously, we introduced a capability approach to assess the responsible use of brain-computer interface. In this commentary, we say more about the ethical basis of our capability view and respond to three objections. The first objection holds that by stressing that capability lists are provisional and subject to change, we threaten the persistence of human dignity, which is tied to capabilities. The second objection states that we conflate capabilities and abilities. The essay discusses how the President employed the term ‘obosen’ to show his leadership quality characterized by strenght, firmness, patriotism and courage. He used ‘obosen’ as a way to persuade his target audience. The essay explicates how he was able to excellently manipulate and control the Philippine social consciousness. Nancy Jecker and Andrew Ko (2017) wish to present an account of personal identity which captures what matters to the patient and places the patient at the center of medical decisions. They focus particularly on medical interventions in the brain that can cause drastic changes in personality; under what circumstances should we say the patient has 'survived' these changes? More specifically, how can we best understand the notion of survival in a way that captures what is of concern to the (...) patient? This goal is laudable, however, their chosen account of narrative identity is ill-suited to this task for one reason in particular; it does not give sufficient guidance in predicting which medical decisions are likely to be experienced as disruptive to identity. The History of Ideas is presently enjoying a certain renaissance after a long period of disrepute. Increasing quantities of digitally available historical texts and the availability of computational tools for the exploration of such masses of sources, it is suggested, can be of invaluable help to historians of ideas. The question is: how exactly? In this paper, we argue that a computational history of ideas is possible if the following two conditions are satisfied: (i) Sound Method . A computational history (...) of ideas must be built upon a sound theoretical foundation for its methodology, and the only such foundation is given by the use of models , i.e., fully explicit and revisable interpretive frameworks or networks of concepts developed by the historians of ideas themselves. (ii) Data Organisation. Interpretive models in our sense must be seen as topic-specific knowledge organisation systems (KOS) implementable (i.e. formalisable) as e.g. computer science ontologies. We thus require historians of ideas to provide explicitly structured semantic framing of domain knowledge before investigating texts computationally, and to constantly re-input findings from the interpretive point of view. In this way, a computational history of ideas maximally profits from computer methods while also keeping humanities experts in the loop. We elucidate our proposal with reference to a model of the notion of axiomatic science in 18th -19th century Europe. (shrink)

Some have suggested that certain classical physical systems have undecidable long-term behavior, without specifying an appropriate notion of decidability over the reals. We introduce such a notion, decidability in (or d- ) for any measure , which is particularly appropriate for physics and in some ways more intuitive than Ko's (1991) recursive approximability (r.a.). For Lebesgue measure , d- implies r.a. Sets with positive -measure that are sufficiently "riddled" with holes are never d- but are often r.a. This explicates Sommerer (...) and Ott's (1996) claim of uncomputable behavior in a system with riddled basins of attraction. Furthermore, it clarifies speculations that the stability of the solar system (and similar systems) may be undecidable, for the invariant tori established by KAM theory form sets that are not d-. Schätzungen zufolge machen von den über 7000 Nahrungspflanzenarten ganze 103 Sorten 90% der Nahrungsmittelproduktion aus. Dieser Verlust könnte in Zukunft gewaltige negative Auswirkungen auf die Nahrungsmittelsicherheit haben, da die Biodiversität eine zentrale Rolle bei der Absorbierung biotischer und abiotischer Stressfaktoren spielt, die auf die Pflanzen wirken. Darüber hinaus stellt der Verlust eine bedeutende Verarmung nicht nur des Pools genetischer Ressourcen dar, die zukünftigen Generationen zur (...) Verfügung stehen, sondern auch der kulturellen Diversität, indem die Nahrungsmittelvielfalt der Landesküchen eingeschränkt und sowohl Kulturlandschaften als auch Stadtgärten vereinheitlicht werden. Wegen der grundlegenden Funktion, die die Agrobiodiversität in der menschlichen Gesellschaft erfüllt, werden wir im Folgenden verschiedene Schwierigkeiten bei der Pflege der Agrobiodiversität als ein gemeinsames Erbe der Menschheit in einer stark ungleichen Welt erörtern. Zuvor jedoch möchten wir untersuchen, was Agrobiodiversität eigentlich ist und welche Funktion sie für das menschliche Wohlbefinden erfüllt. The composition of a timeline depends on purpose, perspective, and scale – and of the very understanding of the word, the phenomenon referred to, and whether the focus is the idea or concept, an instance of an idea or a phenomenon, a process, or an event and so forth. The main function of timelines is to provide an overview over a long history, it is a kind of a mnemotechnic device or a particular kind of Knowledge Organization System (KOS).b The (...) entries in the timeline should be brief and indisputable. Therefore, timelines often identify the first occurrences rather than the most widespread or most qualified instances leaving the fuller and more complex, and possibly disputable story out. But even first occurrences are often difficult to establish. The first occurrence is most often only the first finding of an instance. Older instances may be found and competing definitions develop either within a field or in different fields. This is further complicated since the phenomena, their names, and their meanings may change over time. Former meanings may become redundant, or they must accommodate and coexist with new meanings. The time and place of the composition of the timeline are to be considered in interpreting the things listed. The following note will discuss these issues as they occur in the development of the notions of text, e-text and hypertext, and the origin of machine translation. (shrink)

Die gegenwärtig unter dem Titel ›Realismus‹ geführten Debatten in der Philosophie befinden sich nach allgemeiner Ansicht in einem Zustand größter Verwirrung, so daß es nützlich erscheint, ein wenig Ordnung in die theoretischen Optionen zu bringen bevor man für die eine oder andere Auffassung Partei ergreift. In der vorliegenden Arbeit wird dafür argumentiert, daß sich ein systematisch zusammenhängendes Zentrum dieser Debatten mit Hilfe des Begriffes der Referenz ordnen läßt. Nach der Analyse einiger klassischer Positionen soll ein Rahmen erstellt werden, innerhalb dessen (...) die Positionen eingeordnet und die zentralen Probleme fruchtbar diskutiert werden können. Zu diesem Zwecke ist es erforderlich, für die Einordnung der Positionen theoretische Kriterien zu benennen, die sich an den Problemen orientieren von denen hier argumentiert wird, das sie zentral seien. Sehr knapp ausgedrückt wird hier die Auffassung vertreten, Realismus sei als metaphysische These aufzufassen, welche eine von menschlichen epistemischen und semantischen Möglichkeiten unabhängige Existenz behauptet; in den gegenwärtigen Debatten typischerweise die Existenz einer Art von Dingen, nicht die eines individuellen Gegenstandes. Diese metaphysische These wird jedoch in der gegenwärtigen Debatte mit semantischen Argumenten untermauert, bzw. angegriffen und jene semantischen Argumente wiederum verwenden epistemische Erwägungen – die Frage betreffend, was man wissen kann und was nicht. Der Beginn der gegenwärtigen Realismusdebatten mit der soeben skizzierten zentralen Stellung semantischer Argumente ist, der hier vertretenen Auffassung zufolge, die Kritik am traditionellen Fregeschen Referenzbegriff durch Kripke und den frühen Putnam um 1970 (Kap. 2). Aus dieser neu zu bewertenden Kritik und der von den Autoren daraus entwickelten externalistischen realistischen Semantik für Artausdrücke läßt sich das erste Kriterium für eine Position in einer Realismusdebatte ableiten und klären (Kap. 3): Hält man die fragliche Art für eine natürliche Art und meint also, sie habe ihren ›Zusammenhalt‹ von Natur aus? Wenn ja, dann ist die fragliche Position eine realistische (das Kriterium ist dank des engen Zusammenhangs von Realismus und Externalismus sowohl hinreichend als auch notwendig). Hält man die Art nicht für eine natürliche Art, ist man Antirealist. Damit geht jeweils not- wendig eine bestimmte Semantik für den auf die Art referierenden Ausdruck einher. Es zeigt sich zugleich, daß es zwei Varianten des Realismus zu unterscheiden gilt, die hier als klassischer bzw. als moderater Realismus bezeichnet werden. Im folgenden (Kap. 4.1) wird argumentiert, daß der Begriff der Wahrheit nicht eigentlich der zentrale Punkt in den in Frage stehenden Realismusdebatten sein sollte, wie vielfach behauptet wurde, sondern seine Brisanz vielmehr aus zugrundeliegenden semantischen Fragen gewinnt die also in der weiteren Aufdeckung der Kriterien die zentrale Rolle spielen müssen. In der Analyse der Kritik an der in Kap. 3 entwickelten Position des ›klassischen Realismus‹ läßt sich ein zweites unterscheidendes Kriterium für Positionen in Realismusdebatten entwickeln: begriffliche Relativität. Nach der Ablehnung von Putnams Auffassungen zu diesem Thema, werden zwei Varianten vorgeschlagen, starke und schwache begriffliche Relativität (Kap. 4.2). Die Anwendung dieses Merkmals zwingt, so wird argumentiert, in einigen Fällen zu einer Kombination einer realistischen Auffassung von Arten als natürliche mit begrifflicher Relativität. Diese mittlere Position zwischen klassischem Realismus und Antirealismus wird als »moderater Realismus« bezeichnet. Der im ersten Kriterium verwendete Begriff der natürlichen Art, und damit die Optionen in den Debatten, wird schließlich mittels einer Dis- kussion des Phänomens der Vagheit noch weiter verdeutlicht (Kap. 4.3). There is no uniquely standard concept of an effectively decidable set of real numbers or real n-tuples. Here we consider three notions: decidability up to measure zero [M.W. Parker, Undecidability in Rn: Riddled basins, the KAM tori, and the stability of the solar system, Phil. Sci. 70(2) (2003) 359–382], which we abbreviate d.m.z.; recursive approximability [or r.a.; K.-I. Ko, Complexity Theory of Real Functions, Birkhäuser, Boston, 1991]; and decidability ignoring boundaries [d.i.b.; W.C. Myrvold, The decision problem for entanglement, in: R.S. (...) Cohen et al. (Eds.), Potentiality, Entanglement, and Passion-at-a-Distance: Quantum Mechanical Studies fo Abner Shimony, Vol. 2, Kluwer Academic Publishers, Great Britain, 1997, pp. 177–190]. Unlike some others in the literature, these notions apply not only to certain nice sets, but to general sets in Rn and other appropriate spaces. We consider some motivations for these concepts and the logical relations between them. It has been argued that d.m.z. is especially appropriate for physical applications, and on Rn with the standard measure, it is strictly stronger than r.a. [M.W. Parker, Undecidability in Rn: Riddled basins, the KAM tori, and the stability of the solar system, Phil. Sci. 70(2) (2003) 359–382]. Here we show that this is the only implication that holds among our three decidabilities in that setting. Under arbitrary measures, even this implication fails. Yet for intervals of non-zero length, and more generally, convex sets of non-zero measure, the three concepts are equivalent. (shrink)

Purpose – The purpose of the research reported here is to improve comprehension of the socially-negotiated identity of concepts in the domain of knowledge organization. Because knowledge organization as a domain has as its focus the order of concepts, both from a theoretical perspective and from an applied perspective, it is important to understand how the domain itself understands the meaning of a concept. Design/methodology/approach – The paper provides an empirical demonstration of how the domain itself understands the meaning of (...) a concept. The paper employs content analysis to demonstrate the ways in which concepts are portrayed in KO concept maps as signs, and they are subjected to evaluative semiotic analysis as a way to understand their meaning. The frame was the entire population of formal proceedings in knowledge organization – all proceedings of the International Society for Knowledge Organization’s international conferences (1990-2010) and those of the annual classification workshops of the Special Interest Group for Classification Research of the American Society for Information Science and Technology (SIG/CR). Findings – A total of 344 concept maps were analyzed. There was no discernible chronological pattern. Most concept maps were created by authors who were professors from the USA, Germany, France, or Canada. Roughly half were judged to contain semiotic content. Peirceian semiotics predominated, and tended to convey greater granularity and complexity in conceptual terminology. Nodes could be identified as anchors of conceptual clusters in the domain; the arcs were identifiable as verbal relationship indicators. Saussurian concept maps were more applied than theoretical; Peirceian concept maps had more theoretical content. Originality/value – The paper demonstrates important empirical evidence about the coherence of the domain of knowledge organization. Core values are conveyed across time through the concept maps in this population of conference papers. (shrink)

All languages have unique morphemes as distinguishing features from other languages. Unique morpheme is a morpheme with typical features divergent from other morphemes or language morpheme in general. This study aims to explain the unique morphemes in Malay Language of Makassar dialect. The finding is useful for linguistic studies especially morphological studies of morphemes. This study used descriptive method data collection method used was listening method. The techniques were listening and engaged in conversation and notes-taking. The role of researcher in (...) listening and engaged in conversation technique was not only as listener but also took part in the conversation. In note-taking techniques the researcher recorded the conversations from the research objects. The results found that the The Malay language of Makassar dialect has unique morphemes, such as ka, ta, nu, ki. Na, ko-, etc. Unique morphemes in form of words are such as pale (only), sedeng (again), bela (that’s it), and so on. More unique morphemes of particles are mine-, ji-, pi-, pa-, mo-, etc. Using these unique morphemes before words would make different in sense of the words from using them after words. (shrink)

Merriam-Webster dictionary defines an apostle as a person who initiates a great moral reform or who first advocates an important belief and system [1]. Similarly, the Cambridge Dictionary states that an apostle is someone who strongly supports a particular belief or political movement [2]. The Free Dictionary by Farlex describes an apostle as a person who pioneers an important reform movement, cause, or belief; a passionate adherent; or a strong supporter. In the light of the above meanings of the term (...) ‘apostle’, one can easily say that Guru Nanak was an apostle as he initiated great moral and social reforms in the Indian society of his times, as is evident from his life and works. The most popular (Western) view of peace is an absence of dissension, violence, or war. But peace is also seen as concord, or harmony and tranquility. It is viewed as peace of mind or serenity, especially in the East [5]. Peace of mind (also called inner peace) indicates a state of being mentally and spiritually at peace. It refers to having enough knowledge and understanding to keep oneself firm during discord or stress. 본 논문은 개혁개방정책을 통하여 체제 내 개혁을 시도하였던 베 트남의 체제변화 요인에 관한 연구이다. 경제개혁을 통한 베트남의 체제변화가 지속될 수 있을 것인지 그리고 이런 경제개혁이 정치체 제 개혁에 영향을 미칠 수 있을 것인지에 대한 관심에서 연구가 시 작되었다. 또한 베트남 사회주의가 어떤 길을 걷게 될 것인지에 대 한 해답을 찾기 위해서는 베트남 체제변화의 영향요인 파악이 우선 적으로 이루어져야 한다고 보았다.

이 연구는 현재까지 성공적이라 평할 수 있는 베트남의 코로나19 대응 상황 을 파악하고 그 원인을 찾는 데 목적이 있다. 첫째, 베트남의 코로나19 대응이 성공적일 수 있었던 이유와 코로나19 대응과정에서 나타나는 여러 특징을 살 펴봤다. 베트남의 코로나19 대응은 국경 봉쇄로 이야기되는데, 극단적이리만 큼 강력한 대처를 어떻게 진행할 수 있었는지 대응과정을 짚어봤다. 베트남의 코로나19 대응과정을 좀 더 면밀하게 살펴보면서, 전시상황과 견줄 정도로 빠 르고 강력한 봉쇄를 어떻게 진행할 수 있었고, 국민적 동의는 어떻게 얻을 수 있 었는지 분석했다. 메타포, 과학적 사실 공유, 애국을 (...) 위한 사회적 격리와 감시 는 베트남의 코로나19 대응에서 중요한 지점이었다. 둘째, 강력한 국경 봉쇄로 대변되는 베트남의 코로나19 대응전략이 사회경제적으로 어떤 영향을 미쳤으 며, 이러한 영향이 베트남의 코로나19 대응에 어떻게 반영되고 있는지를 살펴 봤다. 베트남의 코로나19 대응 방식과 관련해서 첨예한 갈등이 촉발되었던 사 건인 베트남의 ‘대구발(發) 비행기 탑승객 격리조치’가 베트남 내 한국 및 한국 기업에 대한 부정적인 반응을 확산시켰고, 이 문제를 해소하는데 베트남 현지 기업과 교민사회의 민간 연대가 중요한 역할을 하였다. 이 연구에서는 이러한 내용을 중심으로 국가 차원에서의 봉쇄가 국민적 합의를 얻어냈고, 그것은 베 트남 정부의 권위주의적 성향에 동조한다는 단순한 논리로 설명될 수 없음을 밝히고 있다. 이는 코로나19 상황을 해결하기 위한 국가의 리더십과 사회적 신 뢰가 바탕이 된 국가의 역량은 ‘감시’와 ‘통제’라는 권위주의적 성향의 아이디 어로만 평가되기에는 부족하다는 것을 의미한다. Plato's Tim. 90b1-c6 describes a pathway to the soul's salvation via the study of the heavens. This paper poses three questions about this theme in Platonism: 1. The epistemological question: How is the paradigmatic function of the visible heavenly bodies to be reconciled with various Platonic misgivings about the faculty of perception? 2. The metaphysical question: How can »assimilation« to the motions of bodies in the realm of Becoming provide for the salvation of souls when souls are »higher«- a mid-point (...) between Being and Becoming? 3. The psychological question: What can it mean for an incorporeal soul to utilise the motions of a body for an ethical and cognitive paradigm? [English abstract] In his last metaethical statement, Parfit revisits his earlier arguments for non-metaphysical normative non-naturalism , and points to the possibility of convergence between his view and Railton's non-analytical normative naturalism. I examine the basis of this convergence claim and find it unpersuasive, mainly because if their views converge on the same position, Parfit's non-natural norms exist only as predicates. In order to avoid this consequence, he needs to present a reason for believing in the existence of normative properties (...) . There is an indispensability argument implicit in his text, with concepts of sui generis normative ground and necessity at its centre. At the time in which quantum mechanics engages in talks of multiverses and quantum technologies helps to realize a concept of metaverse, the so-called ‘virtual life’ has become the extended reality. Chalmers in his book rejects a dichotomy of reality and illusion and consctructs a trichotomy by adding virtuality in order to offer a proposition that a virtual world is a part of the extended reality. The author sees new philosophical challenges in this new reality. For an example, as we (...) are bound to allow some form of consciousness to a robot in a context of simulation there are questions of status of personal agency or personal identity. Traditional subjects of ontology, knowledge, and value come to us as new challenges. The Western intellectual tradition is accustomed to the separation between the human sphere and the sphere of nature, whereas in the East Asian intellectual tradition the two are considered continuous. For good or bad, the Western dualist outlook, which considers mind and matter to be fundamentally distinct, received much philosophical attention in modern times. But how is the East Asian tradition of non-separation to be philosophically expounded? The idea that the human sphere and the sphere of nature are fundamentally connected (...) is attractive on many levels, but it appears to be in need of philosophical scrutiny. One of the key notions which any attempt to provide an adequate elucidation of the East Asian integrative outlook would have had to address is the notion of intentionality. For the idea of intentionality is placed at the center of discussions regarding the continuity — or lack thereof — of minds and bodies, and of nature and humanity. The present paper claims that the dualistic thesis according to which intentionality serves as a delineative mark which separates the mental from the physical and the human sphere from the sphere of nature is implausible (1st section). It further argues that the concept of intention, cheng(誠) of Zhungyong, can be taken to reflect the idea that all things have a mind as a capacity to process information at the appropriate level where they are placed (2nd section). Finally, it develops the view that the capacity for integration sustains a picture according to which integration is a case of yinyang intentionality (3rd section). (shrink)

Then, I seek to connect the anthropological notion and the holistic notion via cheng(誠) or integration. Zhungyong-The Doctrine of the (...) Mean, one of 4 Confucian texts, says that the ultimate integration(至誠) is to reflect the total nature of objects involved (盡性) so that it will show that self realization and all other realizations are one and not two(成己成物) and it will ultimately reach the stage of holiness(聖). Important elements of cheng intentionality can be read out of the two thinker’s various conceptual aspects. YU’s interpretation of history to be internalistic, his view of Hangul(Korean written language) as a revelational medium, his hermeneutics of Christian God as the emptiness cannot be understood on the dichotomous model of human-nature. HAM’s seed holism, his beliefs that humans’s minds are the heavenly mind and that all things under the heaven should come to be unified are best to be understood on the model of cheng intentionality of integration. With an aim to introduce these fundamental concepts into Korean philosophical literature, the study navigates through the debates surrounding the nature of scientific inquiries and the extent to which they accurately represent the reality of the world. Scientific realists contend that scientific theories aspire to uncover genuine claims about the natural (...) world, asserting the approximate truth of well-confirmed theories. On the other hand, anti-realists challenge the necessity of committing to unobservable entities postulated by scientific theories based solely on their empirical success. The paper also discusses influential arguments such as the "No Miracle Argument" put forth by realists and the "pessimistic induction" raised by anti-realists, shedding light on the historical context of scientific theories and their empirical success. As the study unfolds, it provides a nuanced perspective that transcends the dichotomy of scientific realism and anti-realism, emphasizing selective skepticism as a middle ground. By delving into the ontological and epistemological nuances of these philosophical positions, this paper seeks to contribute to the Korean philosophical discourse by presenting a comprehensive overview of scientific realism and anti-realism. The theory of universals faces two opposing demands. On the one hand, it must be explanatory. That is, certain kinds of statements found in our everyday discourse and the theories used to explain them seem to require the existence of universals for their understanding or acceptance. On the other hand, it must be ontologically appropriate. This means that theories that intervene ontologically without sufficient reasons for the existence of implausible entities or theories that result in an excessive proliferation of new (...) entities should not be embraced as theories of universals. The problem is that a theoretically sound theory of universals appears to inevitably involve a tension between explanatory and ontological appropriateness. This dilemma arises from the two aforementioned demands, and it is a genuine dilemma in that it is difficult to give up either demand. Philosophy, or metaphysics, fundamentally aims to explain the facts of the experiential world. If a philosophical theory fails to adequately satisfy our explanatory demands regarding the experiential world, it is not suitable as a philosophical theory. Conversely, it is also undesirable for a philosophical theory to impose excessive ontological burdens. The justification of a philosophical theory is a priori, and any a priori claims about the existence of entities should not be arbitrarily adopted. This article resolves this dilemma as follows: If the explanatory demand requires reduction from an ontological standpoint, it can be adequately addressed through unproblematic means. On the other hand, the apparent conflict between the explanatory demand and appropriate ontology only arises when it is understood as a demand for explanatory priority. However, such a demand does not necessarily require the introduction of any ontological priority. Therefore, there was no need for the dilemma to arise. Finally, I attempt to respond to the demands from natural kind predicates. (shrink)

It is natural to suppose the following three: factivity of knowledge, alda-know synonymy, and the univocity of alda. However, rago-knowledge attribution, expressed by “rago alda” sentences, seems to defeat to hold them at once. In this paper, I try to dissolve this predicament, analyzing “rago alda” sentence as a kind of hybrid language expression. And the theoretical advantages, which my analysis has over other possible, alternative approaches, are to be shown.

The paper aims at rethinking the traditional understanding of commercial law, and tentatively provides its cosmopolitan concept under the backdrop of extended commercial exchange and corresponding development of the transnational trade laws. Given the influence of legal positivism over the source of law debate, the commercial law would be defined in a relatively narrower focus, which principally presumes the sovereign nature of legal community. The phenomenon and interactive reality in this global sphere through the mid-20th century and new millennium have (...) driven us to experience new ways of dealings, sometimes blurring or otherwise encroaching upon a conventional discourse about the true nature of laws. In one way of efforts to accommodate such new phenomena, the author likes to present a possibility of more systemic, comprehensive, reality-oriented construction of commercial law concept concerning the current wave of legal pluralism. It became increasingly pervasive in our daily experiences that the norms of various nature have a potential to govern the commercial relationship. These norms, unlike the traditional state laws, are observed to poses a distinctive feature requiring a coherent understanding among another. This conceptual work also could mater with the traditional concept of sovereignty-driven commercial law. The paper will begin with the theoretical essence of legal positivism propounded by Hart and Raz. Particularly, the five strands of legal system would provide the basis of analysis, and could be compared to the narrative of legal positivists. For the purpose of this thesis, they would be contested to favor the strengths of cosmopolitan concept of commercial law. For an illustration,the author would argue that the shared agency element as well as recognition process of norms can give us more genuine understanding of the commercial law and practices. In this way, the author discuses and proposes a new concept focusing on the contemporary commercial law. Finally, he pointed out the critical needs of this kind of definitional work notwithstanding the legal plane or global diversity. In many ways, the paper would be found tentative, epitomizing, less exhaustive as trade-offs for a comprehensive build-up. The author also regrets to curtail much potentials of opposing arguments against the cosmopolitan understanding of commercial law. The paper aims to briefly look into the civil law remedies of CISG from the perspective of economic efficiency. It mainly illustrates the basic tools of remedies in CISG, and discusses its strengths and flaws from the standpoint of economic deals normally present in most of commercial transactions. As many literature have long contributed to the legal economic discourse, our discussion, as a matter of course, largely depends on the current stronghold, or prospect that those theories espouse. Generally, the remedies (...) in CISG have two basic pathways addressing or penalizing the breach of contract from one party, namely specific performance and damages award. Other instruments to deal with the breach of contract cover a cure of defect, repudiation to perform a contract, additional period to perform a contractual duty, avoidance of contract and etc. This group of instruments can be classed as a privately administered remedies for our purpose of analysis. On this assumption, we can find many aspects of strengths in economic terms, but some paucity that the prescribed approach cannot properly address the best of economics between the contracting parties. This paucity comes mainly because the lawmakers normally could not pre-consider all circumstances among the individual contracting parties. For this reason, this paper argues in favor of privately administered remedies to fill the paucity of two typical remedies. Moreover, the contractual negotiation or design of contract is considered very important as the contracting parties are most informed about their best of economics besides the official lawmakers. The paper concludes with a short discussion of the electronic commerce in comparison with the traditional domestic and international commerce. (shrink)

[Author's note: although this paper is written in Korean, it is archived here in the hope of bringing it to the attention of a wider audience including scholars of pragmatics and of Korean linguistics.] Recently, Korean linguists and philosophers of language have engaged in discussions on the meaning and usage of the Korean determiner ‘uri’ as in such phrases as ‘uri manura [our wife]’ which might seem strange given the monogamous marital institution of Korea. The aim of this paper is (...) to provide a new interpretation of such expressions as ‘uri manura’. To that end, various proposals concerning the meaning and usage of the determiner ‘uri’ in those expressions will be critically examined first. Then it will be argued that ‘uri manura’ is a polite form of ‘nae manura [my wife]’ and is used when one needs, or wants, to speak in a polite tone in deference to the hearer or the wider audience. The upshot will be that the ubiquitous use of ‘uri’ in Korean is not due to the collectivist nature of the Korean society, as has often been claimed, but rather results from the linguistic embodiment of the Confucian tradition in Korea that values courteous words and behavior. This paper considers the aporia in Dialectic of Enlightenment in two aspects of the self-destruction and self-critique of enlightenment and then emphasizes the dual vision which Horkheimer and Adorno hold on rationality. Firstly, it traces the explanation of the self-destruction of enlightenment so as to make explicit that it results in another form of the aporia, the self-critique of enlightenment. This is followed by formulating the criticism into two aspects, that Horkheimer and Adorno’s aporia leads them to be confronted by (...) a self-contradiction. I argue that the criticism neglects their narrative strategy of history as critique and the methodology of immanent critique of Horkheimer and Adorno. In conclusion, it is elucidated that Horkheimer and Adorno rightly posit their aporia and suggest a proper solution, by which we could take the dual vision on rationality and their own model of immanent critique as its significances. 그동안 많은 전문서적을 출간한 경험을 가지고 있지만, 이번 출간하는 법과 생활은 생활 현장에서 느낀 바를 진솔하게 담고 있어 독자들이 쉽게 읽을 수 있게 하였다. 항상 법이 무엇인가를 생각하면서 단조로운 일상을 살아야 하는 변호사, 법학교수로서, 우리 주변의 이야기는 빈곤한 사고의 저변을 넓혀 준다. 조선대학교 법사회대학에서 학생들을 가르치는 백면서생이지만, 서울과 광주를 오가면서 한국 사회를 객관적으로 바라볼 수 있는 시간을 가질 수 있었던 것은 본서 출간을 가능하게 한 동인이었다. 본 서는 정밀한 법이론이나 사례 분석, 또는 판례에 대한 학술적 비평을 담고 있지 않다. 다만 (...) 지난 수년간 느껴온 바를 일상의 시간에 연결한 천학비재한 한 법학도의 단상과 에세이 모음집이라 할 수 있다. 페이스북을 통하여 발표된 글들을 정리하여 학술적 외관을 씌운 부끄러운 졸작이다. 그러나 저자로서 작은 소망이 있다면, 그것은 독자들이 함께 살아 온 시간들을 반추하면서, 민주주의와 법치주의의 가치를 조금이라도 음미할 수 있었으면 하는 것이다. The study originates in the interest in whether Vietnam could continue its changes of system via economic reform, and whether the economic reform could affect the reform of the political system. This article examines whether Nietzschean agonistic democracy theory can be a plausible alternative to Chantal Mouffe’s model. Agonistic democracy theory has Carl Schmitt or Nietzsche as its philosophical source. In the case of Mouffe, she constructed her model based on Schmitt. However, her Schmitt-based model is vulnerable to four criticisms. First, the distinction between ‘worthy opponents’ and ‘enemy’ is ambiguous. Second, it is inconsistent to simultaneously claim ‘the ontological fundamentality of antagonism’ and ‘agonism without antagonism.’ Third, her agonism can not (...) capture the pluralistic world, since it is trapped in the telos of self-preservation. Fourth, there are no theoretical factors to maintain her agonism, and there is no explanation for the degree of conflict that can sustain her model. Unlike Mouffe, Nietzschean like Connolly and Owen provides agonistic democracy theories based on Nietzsche. After analyzing and reconstructing Nietzsche’s text and Nietzschean’s discussions, I will argue that the Nietzschean model can overcome some thresholds of Mouffe’s model. (shrink)

여름은 가을의 풍성한 수확을 위하여 땀 흘리는 계절이다. 김기영 시모음 제 1권에 이어 여름의 풍성함-내맘대로 세상이라는 제목으로 제 2권을 펴내게 되었다. 모쪼록 더위에 행운과 건강이 함께 하길 기원하면서 엉터리 사마천 같은 우리의 시간 기록과 함께 삭막한 세상의 반려가 되었으면 하는 바램이다.

버리고 비우는 일은 결코 소극적인 삶이 아니라 지혜로운 삶의 선택이라는 법정 스님의 말씀이 새삼 가슴에 사무치는 가을입니다. 우리는 버리고 비우지 않고는 새것이 들어설 수 없다는 지혜를 알고 있습니다. 가을은 나눔의 계절입니다. 오늘은 나눔의 날입니다. 내 마음에 가득 고인 고마운 마음을 이웃과 나누고 싶습니다. 보잘 것 없는 생각의 편린들이지만 나도 나눌 수 있다는 것이 고맙습니다. 가을의 풍성함과 쓸쓸함은 인생의 진리인 듯 합니다. 들판의 곡식이 다 내 것이 아니고 나무의 열매가 다 내 것이 아니지만 추수의 계절은 우리에게 감사한 마음을 가져다 주고 모든 (...) 수고로운 사람들과 만물에 감사하는 계절임에 분명합니다. 모두에게 고마운 마음을 전하고 싶은 소박한 마음에 김기영 시모음 제 1권, 제 2권에 이어 『가을이 보내온 편지-우거에서』 라는 제목으로 제 3권을 펴내게 되었읍니다. 모쪼록 풍성한 가을을 맞아 행운과 건강이 함께 하길 기원하면서 엉터리 사마천 같은 우리의 시간 기록과 함께 삭막한 세상 살이에 위로가 될 수 있었으면 좋겠습니다. This article aims to introduce various ways of reading Nietzsche as social & political philosophy that has not received attention in the South Korean research group. In South Korea, researchers tend to rely on German-tradition philosophies to overcome the split between the community and the individual(the universal and the individual). Yet, Nietzsche has been classified as a radical individualistic philosophy and excluded from the discourse. Or he only has been referred to indirectly through French philosophers represented by Foucault and Deleuze. (...) This was widely accepted by Nietzsche researchers that, through Nietzsche, it is hard to construct positive arguments about community and society. But since the 21st century, Anglophone researchers have started to examine established readings and shed new light on Nietzsche’s social & political aspects. This article organizes and criticizes their recent arguments. First, I will point out the main opinions of traditional individualism reading and clarify issues that will be contested by the Communitarian Nietzsche reading (Chap. 2). Next, I will introduce the Communitarian reading that emerged by pointing out problems of individualism reading focused on the issues (Chap. 3.1) and check their drawbacks (Chap. 3.2). And then, I will account for two alternative readings that accommodate Communitarian reading’s good point and get over its problems (Chap. 4&5). Finally, I will try to analyze their arguments and check fallacies in alternative readings (Chap. 6). (shrink)

The Paris Convention on Climate Change is a convention under the United Nations Framework Convention on Climate Change that deals with greenhouse gas emission reduction, coordination and financing issues. The Convention shall enter into force from 2020. The Paris Climate Convention is an international environmental law with stronger social norms than other international law areas. Furthermore, the national characteristics of the norm have been doubled as a result of adopting the nationally determined contribution as the most important mechanism. In this (...) context, this paper examines the issues of the Paris Climate Convention at the international legal level. We examine the issue of enhancing normative efficiency through international trials of the Paris Convention and the International Court of Justice. Second, we examine possible conflicts between the Paris Climate Convention and the WTO law. This is to look at the bilateral issues between the WTO and the Parisian climate treaty, which represents the interests of developmentalists in the basic framework of the confrontation between developmentalists and environmentalists. Of course, when the two norms are in harmony, the normative effectiveness of the Paris Climate Convention is increased. Third, we briefly discuss the role of the domestic courts in raising the Paris Climate Convention, human rights issues, and normative effectiveness. In the end, the Paris Climate Convention enhances the normative effectiveness and suggests ways for lawyers and key actors to move forward. (shrink)

WTO는 2005. 3. 7. EC 제소의 선박산업에 대한 보조금지급에 관한 한국과 EC 간의 通商紛爭에 관 하여 패널결정을 선고하였으며, 양국의 항소포기로 인하여 4. 12. 분쟁해결기구가 동 결정을 채택하고 그 이행에 관하여 감시하고 있다. 즉, WTO는 제소국인 EC가 대한민국의 수출입은행법 및 동법 시행 령, 동 법령에 근거한, 개별적 특혜조치, 대우, 한라, 대동 등 우리 나라 주요 조선기업에 대한 특혜적 구조조정이 WTO가 허용하지 않는 금지보조금 및 조치가능보조금에 해당한다고 주장하면서 대한민국 정부를 상대로 제소한 통상분쟁과 관련하여 대부분 EC의 주장을 배척하고 일부 개별적 거래가 WTO 의 (...) 보조금 및 상계조치에 관한 협정에 위반한다는 결정을 내린 것이다. 이에 따라 WTO는 피소국인 대한민국에게 지체없이 동 일부 특혜조치 등을 철회할 것을 권고하였고, 대한민국 정부는 이를 이행할 의무를 부담하게 되었다. -/- 본 사안을 통하여 WTO는 보조금 및 상계조치에 관한 해석론상의 많은 쟁점들에 관하여 法理的 견해 를 밝혔다. 첫째, 동일한 사실관계에 관하여 금지보조금과 조치가능보조금의 주장이 중첩적으로 가능하 고, 둘째, 전통적인 재량행위론, 즉 법령조항의 기속행위성 여부가 정부나 공공기관의 재정적 공여요건 의 충족 여부에 관한 판단의 기초를 제공하며, 셋째, 소위 SCM협정 예시목록의 법적 성격, 넷째, 재정 적 공여 요건과 특혜요건의 준별, 다섯째, 중대한 손상요건과 관련하여 보조금 해당요건과 국내 상계관 세부과조치의 준별, 여섯째, 보조금해당 여부의 판단에 있어 ‘ 동종물품요건’ 의 적용문제, 일곱째, 조치가 능보조금의 태양으로서 가격유지 및 왜곡된 가격인하의 개념 및 보조금요건충족과의 문제 등이 그것이 다. 본 논문은 우리의 주요 수출산업인 조선산업과 관련하여 이러한 쟁점들에 대한 WTO 결정의 의미 를 검토하였는바, 국제통상규범과 관련하여 향후의 무역분쟁에 대한 대비에 일조할 수 있었으면 한다. The global economy has showed progress in terms of a new reign of multilateral cooperation represented by the World Trade Organization (WTO). On the other hand. regional integration creates economic benefits as illustrated by the creation of the EU and NAFTA. East Asia has also seriously pursued prospects for economic integration. producing considerable successes thus far. A Free Trade Agreement is a useful tool to assist in this evolution of trade relations. and South Korea. one of the major economies in (...) East Asia. is uniquely situated to play a significant role in future negotiations. From this perspective. this paper surveys the global structure and organization of international trade. problems of regional economic integration emphasizing East Asia. and attempts to articulate a plausible South Korean strategy. 법을 공부하고 법을 가르치는 법학도나 법학 교수, 그리고 현실 사회에서 법과 정의를 구현하기 위하여 묵묵히 자신의 책무를 수행하는 일선 법률가들을 생각하며 조금이라도 도움이 될 수 있는 글을 써 보겠다는 마음으로 페북에 글을 올리기 시작한지 어언 5년 가까이 되고 있다. 우리 법률전문가들은 세상의 진실에 눈을 감고 진리를 왜곡하는 곡학아세의 길을 걷는 것을 항상 경계하여야 한다. 특히 좌우 정치가 자리를 잡아가면서 법률가들 마저 파벌을 이루어 법을 생각하기 앞서 자파의 이익을 생각하는 현실을 부인하기 어렵다. 이는 우리에게 양심의 회복을 질책한다. 무매한 민중을 호도하고 국가의 (...) 기강이자 바른 초석이어야 할 법과 법지식을 우롱하는 것이라 아니할 수 없다. 이는 민주주의와 함께 우뚝 서야 할 법치주의를 갉아 먹는 행태라 아니할 수 없다. 조심스러운 마음에서 같이 공부하여야겠다는 생각으로 ‘인간과 사회 그리고 법에 관한 성찰’이라는 제목으로 책을 출간하기로 마음 먹었다. 본서는 한 법률과목을 전문적으로 다루었다거나, 법이론이나 법해석학 관련 주제를 체계적으로 다룬 서적이 아니다. 그렇다고 법 실무에 도움이 될 수 있는 구체적이고 실무적인 문제를 다루고 있는 것도 아니다. 본서는 우리의 일상을 기반으로 법에 관한 단상, 그리고 관련되는 이론들을 생각나는대로 기술한 책이다. 변호사. 법률가. 법학교수, 법학도 등이 제 1차로 독자가 될 수 있을 것이지만, 그 밖에 인간, 사회, 법에 관심 있는 시민 모두가 즐겁게 읽을 수 있도록 엮으려고 노력하였다. 천학비재한 주제에도 화광동진(和光同塵)의 심정으로 출간에 나아가면서 감히 일독을 권하는 바이다.
