Some contemporary discussion about the explanation of consciousness substantially recapitulates a decisive debate about reference, knowledge and justification from an earlier stage of the analytic tradition. In particular, I argue that proponents of a recently popular strategy for accounting for an explanatory gap between physical and phenomenal facts – the so-called “phenomenal concept strategy” – face a problem that was originally fiercely debated by Schlick, Carnap, and Neurath. The question that is common to both the older and the contemporary discussion (...) is that of how the presence or presentation of phenomenal experiences can play a role in justifying beliefs or judgments about them. This problem is, moreover, the same as what was classically discussed as the problem of acquaintance. Interestingly, both physicalist and non-physicalist proponents of the phenomenal concept strategy today face this problem. I consider briefly some recent attempts to solve it and conclude that, although it is prima facie very plausible that acquaintance exists, we have, as yet, no good account of it. (shrink)

Defense of a psychological account of what it is for an artwork to be complete.

Infinity exists as a concept but has no existence in actuality. For infinity to have existence in actuality either time or space have to already be infinite. Unless something is already infinite, the only way to become infinite is by an 'infinity leap' in an infinitely small moment, and this is not possible. Neither does infinitely small have an existence since anything larger than zero is not infinitely small. Therefore infinity has no existence in actuality.

Response to Gover (2015) on Trogdon and Livingston (2015) on artwork completion.

In this essay, we consider the formal and ontological implications of one specific and intensely contested dialectical context from which Deleuze’s thinking about structural ideal genesis visibly arises. This is the formal/ontological dualism between the principles, ἀρχαί, of the One (ἕν) and the Indefinite/Unlimited Dyad (ἀόριστος δυάς), which is arguably the culminating achievement of the later Plato’s development of a mathematical dialectic.3 Following commentators including Lautman, Oskar Becker, and Kenneth M. Sayre, we argue that the duality of the One and (...) the Indefinite Dyad provides, in the later Plato, a unitary theoretical formalism accounting, by means of an iterated mixing without synthesis, for the structural origin and genesis of both supersensible Ideas and the sensible particulars which participate in them. As these commentators also argue, this duality furthermore provides a maximally general answer to the problem of temporal becoming that runs through Plato’s corpus: that of the relationship of the flux of sensory experiences to the fixity and order of what is thinkable in itself. Additionally, it provides a basis for understanding some of the famously puzzling claims about forms, numbers, and the principled genesis of both attributed to Plato by Aristotle in the Metaphysics, and plausibly underlies the late Plato’s deep considerations of the structural paradoxes of temporal change and becoming in the Parmenides, the Sophist, and the Philebus. After extracting this structure of duality and developing some of its formal, ontological, and metalogical features, we consider some of its specific implications for a thinking of time and ideality that follows Deleuze in a formally unitary genetic understanding of structural difference. These implications of Plato’s duality include not only those of the constitution of specific theoretical domains and problematics, but also implicate the reflexive problematic of the ideal determinants of the form of a unitary theory as such. We argue that the consequences of the underlying duality on the level of content are ultimately such as to raise, on the level of form, the broader reflexive problem of the basis for its own formal or meta-theoretical employment. We conclude by arguing for the decisive and substantive presence of a proper “Platonism” of the Idea in Deleuze, and weighing the potential for a substantive recuperation of Plato’s duality in the context of a dialectical affirmation of what Deleuze recognizes as the “only” ontological proposition that has ever been uttered. This is the proposition of the univocity of Being, whereby “being is said in the same sense, everywhere and always,” but is said (both problematically and decisively) of difference itself. (shrink)

The paper explores the handling of singular analogy in quantitative inductive logics. It concentrates on two analogical patterns coextensive with the traditional argument from analogy: perfect and imperfect analogy. Each is examined within Carnap’s λ-continuum, Carnap’s and Stegmüller’s λ-η continuum, Carnap’s Basic System, Hintikka’s α-λ continuum, and Hintikka’s and Niiniluoto’s K-dimensional system. Itis argued that these logics handle perfect analogies with ease, and that imperfect analogies, while unmanageable in some logics, are quite manageable in others. Llull and Leibniz both subscribed to conceptual atomism: the belief that the majority of concepts are compounds constructed from a relatively small number of primitive concepts. Llull worked out techniques for finding the logically possible combinations of his primitives, but Leibniz criticized Llull’s execution of these techniques. This article argues that Leibniz was right about things being more complicated than Llull thought but that he was wrong about the details. The paper attempts to correct these details.

This chapter has two objectives. The first is to clarify Aristotle’s view of the first principles of the sciences. The second is to stake out a critical position with respect to this view. The paper sketches an alternative to Aristotle’s intuitionism based in part on the use of quantitative inductive logics.

Beginning with the prevalent idea that creativity is the ability to make or do things having valuable novelty, the paper explores a variety of axiological and novelty conditions and defends an instrumental success condition. I discuss Robert K. Merton's distinction between 'originality' and 'priority', and Margaret Boden's similar distinction between historical and psychological creativity, as well as Thomas Reid's and Bruce Vermazen's remarks on relations between novelty and value.

The purpose of this project is to argue that we possess a minimal self. It will demonstrate that minimal selfhood arrives early in our development and continues to remain and influence us throughout our entire life. There are two areas of research which shape my understanding of the minimal self: phenomenology and enactivism. Phenomenology emphasizes the sense of givenness, ownership, or mineness that accompanies all of our experiences. Enactivism says there is a sensorimotor coupling that occurs between us and the (...) environment in a way which modulates the dynamic patterns of our self development; the laying down of these basic patterns helps make us who we are and gives rise to the phenomenological, experiential mineness. Drawing on these two core ideas, I will be arguing for a Phenomenological-Enactive Minimal Self. I will be emphasizing the role of the body and the role of affects as the most important components relevant to understanding minimal selfhood. Put more concretely, the set of conditions which constitute the PEMS view are: The minimal self is the experiential subject; the minimal sense of self is present whenever there is awareness. It is the subjectivity of experience, the sense of mineness, or givenness which our experiences contain. The phenomenological part of the PEMS view turns on the idea of a bodily and dynamic integration of sensorimotor coupling and affective experience. It is, ontologically speaking, the lived body in enactive engagement with the environment. It is this embodied subject which anchors and forms the foundation for the later ‘narrative’ self, which emerges from it and which is continually influenced by it. It is the subject enactively engaged with others, dependent on sensorimotor processes and affects. We have an identity, but it emerges from relational and dynamic processes. (shrink)

This project is an investigation into the prospects for an antirealist theory of essence. Essentialism is the claim that at least some things have some of their properties essentially. Essentialist discourse includes claims such as “Socrates is essentially human”, and “Socrates is accidentally bearded”. Historically, there are two ways of interpreting essentialist discourse. I call these positions ‘modal essentialism’ and ‘neo-Aristotelian essentialism’. According to modal essentialism, for Socrates to be essentially human is for it to be necessary that he be (...) a human if he exists, and for Socrates to accidentally have a beard is for it to be contingent that Socrates has a beard if he exists. According to neo-Aristotelian essentialism, objects have definitions in something like the way words do. For Socrates to be essentially human but accidentally bearded is for it to be part of the definition of Socrates that he is human, but not part of that definition that he is bearded. I argue that both are susceptible to antirealist interpretation. This thesis sets about showing that this is the case. In Chapters One and Two I investigate neo-conventionalist theories of modality, in the hope of using such a position to develop an antirealist modal essentialism. In Chapter Three I discuss the debate between modal and neo-Aristotelian essentialism and conclude that it is by no means settled. In Chapter Four I develop an antirealist neo-Aristotelian essentialism based on the mechanism of one of the neo-conventionalist accounts of modality. In Chapter Five I argue that this account is in a better position to give an essentialist theory of necessity than its realist counterparts. I conclude that, regardless of whether one is a modal or neo-Aristotelian essentialist, antirealist essentialism is a viable theory of essence that is worthy of consideration in contemporary debate. The dissertation deals with the questions surrounding the legal, ethical and strategic aspects of armed drones in warfare. This is a vast and complex field, however, one where there remains more conflict and debate than actual consensus. -/- One of the many themes addressed during the course of this research was an examination of the evolution of modern asymmetric transnational armed conflict. It is the opinion of the author that this phenomenon represents a “grey-zone”; an entirely new paradigm of warfare. (...) International terrorism has not been dealt with in a cohesive fashion. Any international prosecution of terrorism which has been conducted has been either “sectoral” adopting a piecemeal typological approach or has been carried out at the domestic level. -/- A novel approach to the problem, of sub-national actors with transnational reach, was proposed, by attributing certain groups with a new legal personality, that of “Stateless International Entities”, or “SIEs”. Those groups who possess, for all intents and purposes, the same attributes as those of States, could then be judged for their behavior before an international tribunal. Other important topics addressed in this research include an examination of important case law, targeted killing, autonomy, preemption versus prevention, imminence versus intent, the find, fix and finish paradigm, the impact of the media, and the role of the CIA, and finally, the flawed reasoning which adopts technology as a form of strategy. Despite the lack of evidence for their effectiveness, the use of physical restraints for patients is widespread. The best ethical justification for restraining patients is that it prevents them from harming themselves. We argue that even if the empirical evidence supported their effectiveness in achieving this aim, their use would nevertheless be unethical, so long as well known exceptions to informed consent fail to apply. Specifically, we argue that ethically justifiable restraint use demands certain necessary and sufficient conditions. These conditions (...) are that the physician obtain informed consent for their application, that their application be medically appropriate, and that restraints be the least liberty-restricting way of achieving the intended benefit. It is a further question whether their application is ever medically appropriate, given the dearth of evidence for their effectiveness. (shrink)

In this article, we consider music and noise in terms of vibrational and transferable energy as well as from the evolutionary significance of the hearing system of Homo sapiens. Music and sound impinge upon our body and our mind and we can react to both either positively or negatively. Much depends, in this regard, on the frequency spectrum and the level of the sound stimuli, which may sometimes make it possible to set music apart from noise. There are, however, two (...) levels of description: the physical-acoustic description of the sound and the subjective-psychological reactions by the listeners. Starting from a vibrational approach to sound and music, we first investigate how sound may activate the sense of touch and the vestibular system of the inner ear besides the sense of hearing. We then touch upon distinct issues such as the relation between low-frequency sounds and annoyance, the harmful effect of loud sound and noise, the direct effects of overstimulation with sound, the indirect effects of unwanted sounds as related to auditory neurology, and the widespread phenomenon of liking loud sound and music, both from the point of view of behavioral and psychological aspects. In this chapter, we outline the interdisciplinary contributions that philosophy, psychology, and neuroscience have provided in the understanding of the self and identity, focusing on one specific line of burgeoning research: the importance of morality to perceptions of self and identity. Of course, this rather limited focus will exclude much of what psychologists and neuroscientists take to be important to the study of self and identity (that plethora of self-hyphenated terms seen in psychology and neuroscience: self-regulation, self-esteem, self-knowledge, self-concept, self-perception, (...) and more). We will likewise not engage with many canonical philosophical treatments of self and identity. But we will lay out a body of research that brings together classic themes in philosophy, psychology, and neuroscience to raise empirically tractable philosophical questions, and philosophically rigorous empirical questions about self and identity. More specifically, in section 4.2, we will review some recent research that has treated traditional philosophical questions about self and identity as empirical questions. Within this body of work, we will be primarily concerned with the finding that morality (more so than memory) is perceived to be at the core of self and identity. Then, in section 4.3, we raise and respond to a variety of questions and criticisms: first, about the operationalization of identity concepts in the empirical literature; second, about the generalizability of the moral self effect; third, about the direction of change; fourth, about connections with recent work in neuroscience; and fifth, about the target of evaluation. Finally, in section 4.4, we consider a variety of implications and applications of this work on the moral self. Throughout, we aim to highlight connections between classical themes in philosophy, psychology, and neuroscience, while also suggesting new directions for interdisciplinary collaboration. (shrink)

This letter addresses the editorial decision to publish the article, “Research on group differences in intelligence: A defense of free inquiry” (Cofnas, 2020). Our letter points out several critical problems with Cofnas's article, which we believe should have either disqualified the manuscript upon submission or been addressed during the review process and resulted in substantial revisions.

This essay is my short, critical review of Donald Livingston’s anthology, Rethinking the American Union for the Twenty-First Century. The contributors of this anthology all argue for secession as a legal and proper tool for calling the Federal government down in size and power. I critically examine the arguments of the contributors.

This article was born of memories of minority groups' plights in the United Kingdom some decades ago and illustrates how opinions become entrenched in citizens minds mainly due to what they read in the media at the time. Today in the UK we still have much ethnic minority groups suffering plain -/- discrimination at work and in society at large. UK police spent 8 million pounds between years 2000 and 2008 doing footwork to relieve this injustice. Nothing came of it (...) apart from some minor attempts at improvement. Then in 2008 this guidance-seen in Appendix 1 of this article, was published by ACPO. We now have the ongoing minority discrimination, still more overt than covert and we have the new asylum seekers influx expected from Ukraine. This piece attempts to show how little improvement there has been over half a century and visibly over the past two decades. (shrink)

Alexander Livingston’s fascinating examination of William James’ work in Damn Great Empires!: William James and the Politics of Pragmatism argues that “William James was an important and innovative theorist of politics.” Livingston claims that James’ anti-imperialist arguments in the letters, editorials, and speeches collected in the Nachlass are an important part of James’ philosophical corpus that provides a critical lens through which the rest of James’ work can be fruitfully read. Though Livingston is not the first to (...) propose a political reexamination of James’ thought, his careful and systematic book-length work provides one of the strongest and most sustained arguments for a historical reinterpretation of James. In this review, I point out some of the strengths and limitations of Livingston's project. (shrink)

Im Falle von Coronamaßnahmen würde deren Tod im Folgejahr lediglich nachgeholt. Das ist natürlich mehr als zynisch: Wer will das einem Menschen im Pflegeheim beibringen? Wer maßt sich die Entscheidung darüber an, ob es sich für einen Anderen lohnt, noch ein (...) paar zusätzliche Monate zu leben? -/- Leider erntete man in der Pandemie, was man jahrzehntelang gesät hatte: Beliebiges Nebeneinander von Forschung und Aberglaube, Wissenschaft und Esoterik, musste in der Bevölkerung den Eindruck einer Gleichberechtigung von Aussagen erwecken. Ganz so, als wäre Vernunft oder Unsinn eben eine Frage des persönlichen Geschmacks, einer alternativen Weltanschauung. Doch zwischen Tatsachen und Blödsinn gibt es keinen Kompromiss. Es existiert kein Recht auf Aberglaube. CoViD-19 wird nicht von 5G-Handymasten ausgelöst. Auch nicht vielleicht! In der Folge stagnieren nun die Impfquoten. Die lassen sich jetzt, nach Jahrzehnten boomender Esoterik, auch durch mehr „Kommunikation mit dem Volk“ nicht wesentlich steigern. (shrink)

Stephen Hawking claims: Philosophy is dead! Natural scientists use terms like 'natural law', 'matter', 'nature' and 'theories'. Often these terms are taken for granted without reflection. The task of philosophy of science as a metatheory of science is to clarify these terms. In doing so, philosophy of science is confronted with epistemological, ontological and metaphysical questions. But it also deals with questions such as "How do we define the boundaries between different scientific disciplines?" or "How do we distinguish science from (...) pseudoscience?". In addition, philosophy of science deals with ethical problems of modern technology, with methodological issues, with reconstructing the structure and development of scientific theories, and with exposing ideological paternalism of science. The optimistic conclusion is: Philosophy is not dead - but philosophers must discuss with scientists on an equal footing. (shrink)

Während die beachtlichen Ergebnisse dieser Forschung aus neuerer Zeit sehr wohl ins Schwarze treffen könnten, ist ihre Methode kritisch zu sehen: Bei der Untersuchung fremder Sprachen und Wahrnehmungsweisen erscheint es unstatthaft, eine bestimmte Ordnung des Farbenraumes vorauszusetzen, die auf Newton zurückgeht und selbst in (...) der europäischen Wissenschaft nicht ohne Alternativen ist. Paisley Livingston claims that an artist’s intentions are successfully realized and hence determinate of the meaning of a work if and only if they are compatible and “mesh” with the linguistic and conventional meanings of the text or artefact taken in its target or intended context. I argue that this specific standard of success is not without its difficulties. First, I show how an artist’s intention can sometimes be constitutive of a work’s meaning even if there is no significant (...) meshing between the artist’s intention and his work. Second, I argue against the claim that the artist’s intentions need to be compatible with the linguistic and conventional meanings of a text. Third, I discuss a case that creates a particular puzzle for Livingston since the intentions of the artist concerned are clearly not successfully realized, though they are compatible and mesh with all the relevant data. I conclude my paper by suggesting a solution to this puzzle. (shrink)

Welche philosophischen Perspektiven gibt es in Bezug auf Rauschmittel? Das Dossier zeigt die Spannbreite: Ob Substanzen, die unsere Leistung erhöhen, sogar moralisch gefordert sein könnten, warum der Staat den Menschen nicht jeden Rausch verbieten sollte, und ob Süchtige Kriminelle sind.

Welche Zukunft erwartet die Menschheit? Oder müsste man fragen: Welche möglichen Zukünfte liegen im Gestaltungsbereich des Menschen? The inoffensive title of Section 1.4.7 of Hume’s Treatise of Human Nature, ‘Conclusion of this Book’, belies the convoluted treatment of scepticism contained within. It is notoriously difficult to decipher Hume’s considered response to scepticism in this section, or whether he even has one. In recent years, however, one line of interpretation has gained popularity in the literature. The ‘usefulness and agreeableness reading’ (henceforth U&A) interprets Hume as arguing in THN 1.4.7 that our beliefs and/or epistemic policies are justified via (...) their usefulness and agreeableness to the self and others; proponents include Ardal (in Livingston & King (eds.) Hume: a re-evaluation, 1976), Kail (in: Frasca-Spada & Kail (eds.) Impressions of Hume, 2005), McCormick (Hume Stud 31:1, 2005), Owen (Hume’s reason, 1999), and Ridge (Hume Stud 29:2, 2003), while Schafer (Philosophers, forthcoming) also defends an interpretation along these lines. In this paper, I will argue that although U&A has textual merit, it struggles to maintain a substantive distinction between epistemic and moral justification—a distinction that Hume insists on. I then attempt to carve out the logical space for there being a distinctly epistemic notion of justification founded on usefulness and agreeableness. However, I find that such an account is problematic for two reasons: first, it cannot take advantage of the textual support for U&A; secondly, it is incompatible with other features of the text. It is illegitimate to read any ontology about "race" off of biological theory or data. Indeed, the technical meaning of "genetic variation" is fluid, and there is no single theoretical agreed-upon criterion for defining and distinguishing populations (or groups or clusters) given a particular set of genetic variation data. Thus, by analyzing three formal senses of "genetic variation"—diversity, differentiation, and heterozygosity—we argue that the use of biological theory for making epistemic claims about "race" can only seem plausible when it relies (...) on the user’s own assumptions about race; the move from biological measures to claims about “race” inevitably amounts to a pernicious reification. We also excavate assumptions in the history of the technical discourse over the concept of "race" (e.g., Livingstone's and Dobzhansky's 1962 exchange, Edwards' 2003 response to Lewontin 1972, as well as contemporary discussions of cladistic "race", and "races" as clusters). We show that claims about the existence (or non-existence) of "race" are underdetermined by biological facts, methods, and theories. Biological theory does not force the concept of "race" upon us; our social discourse, social ontology, and social expectations do. We become prisoners of our abstractions at our own hands, and at our own expense. (shrink)

This paper distinguishes three concepts of "race": bio-genomic cluster/race, biological race, and social race. We map out realism, antirealism, and conventionalism about each of these, in three important historical episodes: Frank Livingstone and Theodosius Dobzhansky in 1962, A.W.F. Edwards' 2003 response to Lewontin (1972), and contemporary discourse. Semantics is especially crucial to the first episode, while normativity is central to the second. Upon inspection, each episode also reveals a variety of commitments to the metaphysics of race. We conclude by interrogating (...) the relevance of these scientific discussions for political positions and a post-racial future. (shrink)

The aim of my paper is to describe and evaluate different conceptions of holism in Ludwig Wittgenstein’s Tractatus Logico-Philosophicus. I distinguish three readings of holistic elements in this work: i) Minimal Holism (E. Anscombe, M. Black, D. Pears); ii) Moderate Holism (J. Conant, C. Diamond, G. Ryle); and iii) Radical Holism (G. Bar-Elli, M. Kremer, P. Livingston). The conclusion is that the most viable option is Moderate Holism since it embraces the logico-syntactical notion of use, rejects an anachronistic interpretation (...) of Tractatarian ontology and allows us to see that the holistic elements are complementary to the initial atomism of the work. Moreover, I point to the consequences of the topic for the overall reading of Wittgenstein’s early and late work. (shrink)

Ethisch argumentierende TA, so die These, lässt sich mit John Dewey als eine Kartografie situativer Wertungskonflikte begreifen. Die entstehenden „moralischen Landkarten“ zu konkreten technischen Entscheidungssituationen zielen darauf ab, den Bedarf an wissenschaftsgestützter, möglichst neutraler Beratung für den öffentlich-politischen Prozess zu ermitteln. Pragmatisch kann „Neutralität“ allerdings nicht als normative Abstinenz verstanden werden. Vielmehr soll der Ausgang von einer Rekonstruktion der normativen Konflikte genommen werden, wobei (...) die Wertvorstellungen, die in den Entscheidungssituationen technischen Handelns jeweils relevant sind, bewusst aus unterschiedlichen Perspektiven erschlossen werden. Worauf beziehen sich die Menschen auf der Zwillingserde mit ihrem Wort 'Wasser', wenn es bei (...) ihnen gar kein H2O gibt? -/- Diese und weitere seltsame Fragen sind das tägliche Brot vieler professioneller Philosophen. Die abstrusen Umstände, die dabei geschildert werden, nennt man "Gedankenexperimente". -/- Was soll die Erörterung dieser Szenarien, die sich so weit von unserem alltäglichen Leben, z.T. außerhalb der Grenzen unserer Wirklichkeit abspielen? Welche Rolle spielen diese "Gedankenexperimente" in der philosophischen Methodologie? Ist diese Rolle überhaupt berechtigt? -/- Das vorliegende Buch gibt Antworten auf diese Fragen. This article presents formal correspondences between the ontological and logical structures of Deleuze’s theory of sense-events in the Logic of Sense as a “post-Cantorian orientation of thought” (Livingston 2012), grappling with an essential incompleteness or inconsistency at the heart of both Being and thought, one which Deleuze champions positively under the equation Ungrounding = Becoming. Through it, Deleuze’s sometimes slippery use of the concept of singularity (and its relation to the virtual) is elaborated, elucidating a post-Cantorian metaphysics of events, (...) distinct from and preceding Badiou’s, that concretely defines the role of the singular in Deleuze’s early major works. In this article, I reply to some criticisms of my book, Pragmatist Egalitarianism, offered by professors Robert Talisse, Susan Dieleman, and Alexander Livingston. Some of the major themes and questions I address include the following: How are conflicts between different egalitarian ideals best understood and addressed? Does the quest for equality have a fundamental locus, or are the different egalitarian variables I identify in the book, conceptually speaking, on an equal footing? What is the relationship between justice and equality? (...) How are feminist egalitarianism and Marxian egalitarianism best slotted into my distinction between “vertical” and “horizontal” egalitarianism? Der Aufsatz beschäftigt sich am Beispiel des deutschen "Kopftuchstreits" mit der rechtlich-politischen Auseinandersetzung um subjektive Rechte innerhalb des liberalen Rechtsstaats. Wie Christoph Menke in seiner Deutung der für den politischen Liberalismus wesentlichen politischen Konflikte gezeigt hat, bezieht sich diese Auseinandersetzung vorrangig auf zwei Fragen: Wer sollte Anspruch darauf genießen, ein politisches Subjekt zu sein, das heißt, als Gleiche oder Gleicher berücksichtigt zu werden? Welche Ansprüche politischer Subjekte könneen als schützenswerte Verwirklichung subjektiver Rechte gelten? Der vorliegende Beitrag beschäftigt sich vorwiegend mit (...) der Frage, wie die politischen Konflikte des letztgenannten Typs auf die rechtliche Auseinandersetzung um Grundrechte abfärben. Damit wende ich mich gegen ein Verständnis der Grundrechte, das diese als Garant der ethischen Neutralität eines liberalen Gemeinwesens ansieht. Ich möchte zeigen, dass der Sinn subjektiver Rechte in der liberalen Demokratie zwar unter anderem genau darin besteht, dass sie partikulare ethische Wertvorstellungen neutralisieren und die Bürgerinnen und Bürger innerhalb eines vernünftigen Rahmens vor Unterdrückung schützen. Wie eine Analyse der Entscheidungen des Bundesverfassungsgerichts (BVerfG) zum "Kopftuchstreit" zeigt, wird diese Funktion aber stets zugleich durch die partikulare Interpretation gleicher Rechte unterminiert. Dies bezeichne ich als die Dekonstruktion der Neutralität, die sich im Recht vollzieht. (shrink)

(For English, scroll down) „Kreativität“ ist ein sehr junger Begriff und ein sehr altes Phänomen. Sie gilt als unaufklärbares Rätsel, als eine Art „Black Box“ des Denkens. Dem kollektiven Bewußtsein zufolge ist sie etwas Rares, Flüchtiges, strapaziös zu erzielen und nur wenige Glückliche begünstigend. Das vorliegende Buch präsentiert eine logische Grundidee zur Entstehung von schöpferisch Neuem – Elemente aus Logik, Symbotheorie, Informations-, Kommunikations- und Medientheorie verbindend. Diese „Formel“ wird an philosophischen Stationen von der Antike bis zur Gegenwart erprobt und weiterentwickelt, (...) darunter Theorien von Platon, Aristoteles, Leibniz, Baumgarten, Kant, Wittgenstein, Nelson Goodman und Gregory Bateson. Kreativität zeigt sich als ein Transformationsphänomen, welches das Denken auf eine andere logische Ebene führt, kategoriale Grenzen transformiert und Anschlußformen öffnet. Im Ergebnis ist sie nichts per Definition Abwesendes, erreichbar nur über den Umweg von unverfügbarer Gunst, weltabgewandter Passion oder verborgenen Tricks. Kreativität ist vielmehr omnipräsent, schöpferische Energien sind nur mit großem Aufwand zu unterdrücken, und die Frage, wie man sie erreicht, wird zur Frage, wie man ihr eine optimale Basis bereitet, ohne sie wesentlich zu behindern. Creativity" is a young term and an old phenomenon. It is considered an unexplainable enigma, a kind of "black box" of thought. According to the default view, it is something rare, fleeting, hard to achieve and favoring only a lucky few. The present book presents a logical formula for the emergence of creative newness - combining elements from logic, theories of symbolization, information-theory, communication- and media theories. This structural idea is tested and further developed by confronting it with select philosophical theories regarding the production of ‘newness’ from antiquity to the present, including theories by Plato, Aristotle, Leibniz, Baumgarten, Kant, Wittgenstein, Nelson Goodman and Gregory Bateson. As a result, creativity shows up as a transformation phenomenon, including different logical levels, thereby transforming categorical boundaries. As a result, it is not something mostly absent, attainable only through of luck, manic passion, or hidden tricks. Creativity is rather omnipresent, creative energies can only be suppressed with great effort, and the question of how to achieve it becomes the question of how to prepare an optimal basis without significantly hindering it. Ob im Fitnessstudio, in der Mode oder bei der Ernährung – heute wird ständig Körperoptimierung betrieben. Durch neue technologische Entwicklungen wie Neuroimplantate und Brain-Computer-Interfaces (neurologisches Enhancement) wird die Körperoptimierung auf eine neue Ebene gehoben. Mittels Pharmazeutika sollen Kognition (kognitives Enhancement) oder moralische Verhaltensweisen (moralisches Enhancement) verbessert werden, Prothesen werden in den Körper integriert und es werden ästhetisch-chirurgische Eingriffe vorgenommen. 2019 wurden insgesamt 983.432 ästhetische Eingriffe in Deutschland unternommen.1 Im Alltag sind Wearables wie Smartwatches mit ihren Fitnessprogrammen und vielfältige Smartphone-Apps zur (...) Körperoptimierung allgegenwärtig. Technologische Körperoptimierung spielt eine wichtige Rolle im menschlichen Leben und bedarf einer ethischen Auseinandersetzung. Der Beitrag behandelt die Frage, wie die gegenwärtigen technologischen Körperoptimierungen ethisch bewertet werden können und stellt dabei die Autonomie ins Zentrum der ethischen Überlegungen. Inwiefern kann die Entscheidung für eine Körperoptimierung autonom getroffen werden? Welche ethischen Aspekte spielen eine Rolle und wie wirken sich die Optimierungen auf das Selbstverständnis des Individuums aus? -/- Die Fülle an Optimierungsmaßnahmen macht es notwendig, in Kap. 1 zunächst in den Begriff, die Formen und Ziele der Körperoptimierung einzuführen und Differenzierungen vorzunehmen. In Kap. 2 wird die Autonomie in den Fokus gerückt und mit Rückgriff auf Foucaults Konzepte der „Bio-Macht“ und „Technologien des Selbst“ untersucht, wie die Optimierungsentscheidungen zwischen individueller Selbstbestimmung und gesellschaftlicher Fremdbestimmung verortet werden können. Daran anknüpfend wird in Kap. 3 nach einer ethischen Bewertung der Optimierungsmaßnahmen gefragt. Der Aufsatz sucht nach einer ethischen Einordnung der Körperoptimierungen und gelangt letztlich zu wichtigen Erkenntnissen über den Zusammenhang von Identität/ Körper, Gesellschaft und Technik. Kap. 4 führt dazu die These aus, dass Technik mithervorbringt, was Körper bedeutet und zeigt auf, wie Technologien auf diese Weise eine Chance sein können, das Menschenund Körperverständnis neu und inklusiv auszuhandeln. Aus den Untersuchungsergebnissen werden letztlich in Kap. 5 Schlüsse für die Theologie abgeleitet und Wege dargestellt, wie die Theologie einen Beitrag zu den Optimierungen leisten kann. Abschließend wird in Kapitel 6 ein Fazit gezogen und ein Ausblick für die zukünftige ethische Forschung eröffnet. (shrink)

Das Interesse, welches den Autobiografien aktuell entgegengebracht wird, erlebt zur Zeit eine Renaissance. Der retrospektive Blick auf die eigene Lebensgeschichte bzw. das geschichtliche Verstehen findet sich sowohl in Wilhelm Diltheys als auch in Georg Mischs Theorie der Autobiografie wieder. Der Zweck der Autobiografie, die Person, die sich hinter der Selbstbiografie befindet, zu verstehen, bringt uns zu einer Autobiografin "par excellence", zu Simone de Beauvoir. Durch Persönlichkeiten wie Beauvoir ist es für uns heute möglich, sowohl in ihr Leben als auch in (...) die Epoche, in der sie gelebt und mitgewirkt hat, Einblick zu gewinnen. Was über Simone de Beauvoir in Erfahrung gebracht werden kann, steht in ihren Büchern. So ist die Relevanz ihrer autobiografischen Schriften, sowohl als literarische Meisterwerke als auch als historische Zeugnisse, unumstritten. Beauvoirs Beweggründe ihre Erinnerungen niederzuschreiben, lassen – wie von Dilthey und Misch angedeutet –, deutlich erkennen, dass in der Selbstbiografik "die Selbstbesinnung den Vorrang [hat]". Simone de Beauvoirs Erinnerungsprozess verweist eindeutig auf die Aufgabe, die Wilhelm Dilthey und Georg Misch der Autobiografie erteilen: "So erscheint die Autobiographie sowohl im Hinblick auf ihre Quellen im Selbstbewußtsein des Menschen, als auch in Anbetracht ihrer Leistung, die im Verstehen des Lebens besteht, nicht bloß als eine eigene Literaturgattung, sondern auch als Mittel zur menschlichen Selbsterkenntnis". Das spezifische Ziel von Argumentationen ist nicht einfach, den Adressaten etwas glauben zu machen - dies wäre bloße Rhetorik ﷓, sondern: den Adressaten beim Erkennen der Akzeptabilität (insbesondere der Wahrheit) der These anzuleiten und ihn so zu begründetem Glauben, zu Erkenntnis zu führen. Argumentationen leiten das Erkennen an, indem sie in ihren Argumenten hinreichende Akzeptabilitätsbedingungen der These als erfüllt beurteilen und so den Adressaten implizit auffordern, diese Bedingungen zu überprüfen. Argumentationen sind gültig, wenn sie prinzipiell das Erkennen anleiten können; d. (...) h. wenn die genannten Akzeptabilitätsbedingungen hinreichend sind, wenn sie tatsächlich erfüllt (die Argumente also wahr) sind und wenn es irgendjemanden gibt, der zwar die Akzeptabilität der Argumente, nicht aber die der These erkannt hat. Eine gültige Argumentation ist adäquat, um einen bestimmten Adressaten rational zu überzeugen, wenn dieser u. a. die Akzeptabilität der Argumente, nicht aber die der These erkannt hat. Die in gültigen Argumentationen als erfüllt beurteilten Akzeptabilitätsbedingungen sind Konkretisierungen allgemeiner Erkenntnisprinzipien für die spezifische These, z. B. des deduktiven Erkenntnisprinzips: 'Eine Proposition ist wahr, wenn sie von wahren Propositionen logisch impliziert wird.' oder des erkenntnisgenetischen Erkenntnisprinzips: 'Eine Proposition ist wahr, wenn sie korrekt verifiziert worden ist.' Eine Konkretisierung des deduktiven Prinzips für eine These p wäre z. B.: 'p ist wahr, 1. wenn q und r wahr sind und 2. wenn q und r zusammen p logisch implizieren.' Sind beide Bedingungen erfüllt, so könnte 'q; r; also p.' eine gültige deduktive Argumentation sein. Die verschiedenen Argumentationstypen unterscheiden sich danach, auf welchem Erkenntnisprinzip sie basieren. Das argumentativ angeleitete Erkennen der Akzeptabilität der These funktioniert so: Der Adressat benutzt das von ihm (zumindest implizit) gewußte allgemeine Erkenntnisprinzip als Checkliste, auf der er nach dem Vorbringen der Argumente abhakt, welche Akzeptabilitätsbedingung des Erkenntnisprinzips durch das Zutreffen des Arguments jeweils erfüllt wird. Auf der Basis dieser Funktionsbestimmung werden in der "Praktischen Argumentationstheorie" (erstmalig) präzise Gültigkeitskriterien für Argumentationen allgemein und für mehrere spezielle Argumentationstypen entwickelt, erkenntnistheoretisch begründet und auf komplexe Argumentationsbeispiele aus Philosophie, Wissenschaft, Technik und Kultur angewendet. Die Analyse der erkenntnistheoretischen Grundlagen - der zugrundeliegenden Erkenntnisprinzipien - vor allem der interpretierenden und praktischen Argumentationen ist zudem von erheblicher Bedeutung weit über die Argumentationstheorie hinaus: für die Interpretationstheorie, die Handlungstheorie und die praktische Philosophie. März 2010 erschienen ist, im Umlauf gebracht, und bezeichnet eine wissenschaftliche (...) Disziplin, welche die morphogenetische Linguistk und Neurobiologie vereint, um die Zusammenhänge zwischen Wahrnehmung, Verhalten und Wortbildung zu erforschen. Die Sprache ist das Mittel zwischenmenschlicher Verständigung, und der Sprache ist dieses Buch gewidmet. Wie entsteht Sprache? Welche sprachliche Formen gab es, gibt es heute, und wird es noch geben? In welchem Verhältnis steht Kultur zur Sprache? Was sind neurobiologische Grundlagen des Denkens und der Verbalisierung mentaler Inhalte? Mit diesen und anderen Fragen befasst sich neue Wissenschaft, die im Jahr 2010 gegründet wurde, um interdisziplinär die Zusammenhänge zwischen Wahrnehmung, Wortbildung und Verhalten zu erforschen. Definition of the problem: The connection between time and the good life has already been worked out for a number of medical specialties and practices. However, what role does the temporality of the good life play for medicine as a whole? That is the central question of this article. Arguments: The good life is here understood as a meaningful life. Living meaningfully is only possible through present action. A fulfilled presence in this sense is therefore an essential aspect of the (...) temporality of the good life. Illness tends to prevent a fulfilled presence. In this respect, medical treatments aim to enable a fulfilled presence. A second structure of time, that is central to the good life, consists in the chronobiological rhythms, upon the maintenance and restoration of which health is critically dependent. Conclusion: The temporality of the good life has a twofold relevance for medicine as a whole. First, the purpose of medical treatment is to enable a fulfilled present. Second, this can and should be done by maintaining and restoring chronobiological rhythms. ++++ Der Zusammenhang von Zeit und gutem Leben wurde bereits für eine Reihe medizinischer Disziplinen und Praktiken herausgearbeitet. Doch welche Rolle spielt die Zeitlichkeit des guten Lebens für die Medizin insgesamt? Das ist die leitende Frage dieses Artikels. Dabei wird das gute Leben als sinnvolles Leben verstanden. In diesem Sinne wird für eine zweifache medizinische Relevanz der Zeitlichkeit des guten Lebens argumentiert: Erstens besteht der Sinn medizinischer Behandlungen in der Ermöglichung erfüllter Gegenwart. Originally published as「歴史的世界の個性的な自己創造と国家：西田哲学における〈国家〉と〈民族〉」, in「西田哲学会年報第七号」[ Jahrbuch der Nishida-Gesellschaft] 7 : 55–76. Übersetzt von Leon Krings. In diesem Aufsatz wird der Frage nachgegangen, in welcher Weise der „Staat“ im späten Denken des Philosophen Nishida Kitarō thematisiert wird. Dies geschieht anhand der Staatstheorie Nishidas, wie sie sich in seinen Aufsätzen Das Problem der Staatsraison und Das Problem der japanischen Kultur sowie im Anhang zur Philosophischen Aufsatzsammlung iv darstellt. Zusätzlich werden Nishidas Schriften, die nach den Grundproblemen der Philosophie geschrieben wurden und den theoretischen Hintergrund (...) seiner Staatstheorie bilden, miteinbezogen. In diesen Schriften fragt Nishida – ausgehend von der genetischen Struktur der historischen Wirklichkeit – nach der Daseinsberechtigung sowie der Bedeutung des Staates, d. h. danach, was ein Staat ist und welche Art von Gemeinschaft es verdient, als „Staat“ bezeichnet zu werden. Mithilfe des im Folgenden dargestellten Leitfadens werde ich versuchen, Nishidas Gedankengang genauer nachzuverfolgen. Dabei wird sich zeigen, dass er den „Staat“ als eine im höchsten Maße paradoxe Form der Gemeinschaft interpretiert. (shrink)

Das deutsche Gesundheitswesen steht durch die schnell steigende Anzahl an CO- VID-19-Erkrankten vor erheblichen Herausforderungen. In dieser Krisensituation sind alle Beteiligten mit ethischen Fragen konfrontiert, beispielsweise nach gerech- ten Verteilungskriterien bei begrenzten Ressourcen und dem gesundheitlichen Schutz des Personals angesichts einer bisher nicht therapierbaren Erkrankung. Daher werden schon jetzt klinische und ambulante Ethikberatungsangebote verstärkt mit Anfragen nach Unterstützung konfrontiert. Wie können Ethikberater*innen Entscheidungen in der Krankenversorgung im Rahmen der COVID-19-Pandemie unterstützen? Welche Grenzen von Ethikberatung sind zu beachten? Bislang liegen hierzu (...) noch wenige praktische Erfahrungen vor. Angesichts der dynamischen Entwicklung erscheint es der Akademie für Ethik in der Medizin (AEM) wichtig, einen Diskurs über die angemessene Rolle der Ethikberatung bei der Bewältigung der vielfachen Heraus- forderungen durch die COVID-19-Pandemie zu führen und professionelle Hinweise zu geben. Mit dem vorliegenden Diskussionspapier möchte die AEM einen Beitrag zur Beantwortung wesentlicher Fragen leisten, die sich für die Ethikberatung in den verschiedenen Bereichen des Gesundheitswesens stellen. Sie regt an, diesen Dis- kurs weiter zu führen und hat ein Online-Forum (s. unten) eingerichtet, in dem Ethikberater*innen ihre Erfahrungen teilen und die professionelle Selbstreflexion der Ethikberatung in Pandemiezeiten mit Anregungen fördern können. Ein Beispiel für die Rezeption und Fortführung der schopenhauerschen Logik findet man in den Mathematiklehrbüchern Friedrich Adolph Wilhelm Diesterwegs (1790–1866), In diesem Aufsatz werden die historische und systematische Dimension dieser Anwendung von Logikdiagramme auf die Mathematik skizziert. In Kapitel 2 wird zunächst die frühe Rezeption der schopenhauerschen Logik und Philosophie der Mathematik vorgestellt. Dabei werden einige oftmals tradierte Vorurteile, die das Werk Schopenhauers betreffen, in Frage gestellt oder sogar ausgeräumt. In Kapitel 3 wird dann die Philosophie der Mathematik und der (...) Logik Schopenhauers vorgestellt. Es wird gezeigt, dass Schopenhauers Logikdiagramme auf Ideen der Mathematiker Leonhard Euler (1707–1783), Bernhard Friedrich Thibaut (1775–1832) und Franz Ferdinand Schweins (1780–1856) zurückgehen und dass Schopenhauer diese Logikdiagramme auch bereits zur Analyse mathematischer Begriffe verwendet. Kapitel 4 beschäftigt sich mit der Schopenhauer-Rezeption Diesterwegs. Es wird die Frage behandelt, inwieweit Diesterweg in der Mathematik von Schopenhauer beeinflusst war und welche Rolle dieser Einfluss auf sein Verständnis von Logik und Mathematik hatte. In Kapitel 5 wird schließlich gezeigt, dass Diesterweg die schopenhauersche Begriffsanalyse der Mathematik mit Hilfe von Logikdiagrammen aufgreift und weiterführt. Da Diesterweg einer der einflussreichsten Pädagogen und Mathematikdidaktiker des 20. Jahrhunderts war, ist anzunehmen, dass sich Spuren dieser Methode noch heute finden lassen. Inwiefern dies wahrscheinlich ist, wird in der Zusammenfassung (Kapitel 6) thematisiert. (shrink)
