The two volumes of _Maus_ composed by Art Spiegelman were the first graphic novels to be awarded the Pulitzer Prize. These volumes introduced a new genre of graphic novel in the form of comics. The present study examines the hierarchical content and subtexts of Maus and the unique presentation methods of comics. The researcher employed the concepts of “Threefold mimesis” proposed by the French philosopher Paul Ricoeur, to see how Maus interpretate the Jewish history of suffering in Holocaust and the (...) postmemory. Spiegelman is the icon of the graphic novel world, however, so far research on his work still seems to be rare in Taiwan. Since the 1960s, the focus of African Philosophy has predominantly been Afrocentric, and with an emphasis on racial issues, as a reaction to Eurocentrism. To hold an open intercultural dialogue on African Philosophy with African and other philosophers is, therefore, not-self-evident. This article will argue that intercultural dialogues or (in case of more than two participants) ‘polylogues’ can and should become a more central point of focus in the academic study of African Philosophy. The author will center on how three (...) renowned African(a) philosophers with a focus on the Akan people of Ghana have initiated intercultural dialogues for the enhancement of human wellbeing. These are Kwasi Wiredu, Kwame Gyekye and Kwame Anthony Appiah. What these philosophers have in common is their belief that all human beings are interdependent and that an emphatic, ethic orientation to one another and mutual communication helps to live together in social harmony, which enhances the wellbeing of mankind. Discussing these African philosophers’ insights into depth will pave the way for other scholars to explore the intercultural dialogue as a weak or non-centric and non-racial focused philosophical method and to enhance understanding of its relation to African(a) Philosophy and a Global Ethics of care. Abstract Qadi `Abdul-Jabbar, although has come to be Known as a Mu`tazili theologian, can be certainly mentioned as a moral philosopher by attention to his ethical views in the theological books. The paper is going to present his ethical opinions concerning normative ethics and Meta-ethics. It shows that `Abdul-Jabbar is a rationalist moral philosopher, who considers reason as the origin of moral obligations, and as the means of evaluating the rightness and wrongfulness of actions. Moreover, he is an essentialist, that (...) is, he regards the nature of actions as the source of rightness or wrongfulness of actions, rather than the external factors. Furthermore, he is a rule-deontologist, who holds human beings must act in accordance with rules and duties. In addition to these, he is an ethical intuitionist and foundationalist; that is to say, he believes that there exist basic moral propositions that can be intellectually intuitionable. These propositions expressing moral principles are evident and necessary ones, and determinant foundations of other duties, whether theoretical or practical. (shrink)

The philosophical model of constellation has been applied to contemporary musical form, but it reveals too many limitations when confronted with late Adorno’s model of informal music. Once the component of heteronomy, in hierarchical and centered structures of traditional music, has been overcome, it reemerges in the opposite type, the decentered, non-hierarchical or free structures, between the opposites of serialism and aleatoric music. Therefore, the model of informal music, as an "image of freedom", pursues the realization of a musical-aesthetic nominalism (...) that is subtracted from all forms of heteronomy, ancient or modern. To do this, it has to achieve the 'actually constructed totality' of the work, integrating in it the opposite of free subjectivity. (shrink)

This is a review of Mu Peng's recent book on popular religion in rural China.

This essay provides a novel account of iterated epistemic states. The essay argues that states of epistemic determinacy might be secured by countenancing iterated epistemic states on the model of fixed points in the modal $\mu$-calculus. Despite the epistemic indeterminacy witnessed by the invalidation of modal axiom 4 in the sorites paradox -- i.e. the KK principle: $\square$$\phi$ $\rightarrow$ $\square$$\square$$\phi$ -- a hyperintensional epistemic $\mu$-automaton permits fixed points to entrain a principled means by which to iterate epistemic states and account (...) thereby for necessary conditions on self-knowledge. The hyperintensional epistemic $\mu$-calculus is applied to the iteration of the epistemic states of a single agent instead of the common knowledge of a group of agents, and is thus a novel contribution to the literature. PREFACE WORD The Tanzimat period, which was the starting point of reform movements in many areas such as social, political, economic, military, etc., in which steps were taken towards Westernization, is considered to be an important milestone in drawing the fate of the Ottoman Empire. In this longest century of the empire, when many things were rushed, education partially received its share of change and reform. However, since the field of education was under the control of religious institutions such as (...) the Şeyhülislâmlık and the Nezâresi Evkâf-ı Hümâyun, the changes and reforms in this field remained limited. Regarding philosophy, which is the subject of our study, we can say in advance that philosophical movements in the West, the ideas of philosophers and philosophical education in the Western sense began to enter our country in the post-Tanzimat period. It is noteworthy that during this period when the Ottoman Empire became acquainted with Western philosophy, philosophy in the West experienced a period of crisis. In the period preceding this acquaintance, philosophy education in our country was carried out in a style loyal to the tradition of Islamic philosophy, and the break in this tradition occurred with the Tanzimat. One of the most widely debated issues from the Tanzimat to the present day has been whether or not a philosophical tradition unique to us can be established. Issues such as whether a philosophy built on our own culture and values can provide us with the opportunity to raise philosophers who are considered philosophers in the Western sense, and the level of competence and proficiency of Turkish in terms of creating a philosophical language on the way to realizing this opportunity, and efforts to establish a deep-rooted tradition continue to stand before us. In this study, from a holistic perspective, the changes in philosophical paradigms in certain periods from Tanzimat to the present day have been tried to be determined chronologically and problematically. The fact that the movements that emerged with Tanzimat were broken in certain periods, such as 1915, 1933 and 1960, and left their place to different movements, and the changes in our country in parallel with the change in the perception of philosophy in the world have been tried to be revealed in this study, and as a result of the study, results that have not been expressed so far have been reached. Again, whether the perception of philosophy has changed in society along with the change in philosophy in higher education is among the topics investigated in this study. For example, the fact that professors such as Mehmet İzzet, Niyazi Berkes and Necati Öner, who studied philosophy, regretfully admitted that it was embarrassing to say "I am studying philosophy", and instead took refuge in evasive answers such as "I am studying at the Faculty of Literature, I am studying at the Faculty of Language and History", clearly shows how the difficulty of doing philosophy in Turkey is at a high level with these prejudices. From the times when philosophy was identified with irreligion and atheism, and philosophers were seen as useless people who only criticized and did not produce solutions, to the present situation, the paths taken and the obstacles overcome make us hopeful for the bright future of philosophy in Turkey. In the Dârülfünun, which was de facto established in 1863 and opened and closed many times, philosophy courses were able to find a wide place in the curriculum after 1900 and especially after 1916. However, the contribution of philosophy courses and departments, which have been a significant part of the academy since 1916 both as a field of research and education, to the establishment and development of the longed-for original philosophical thought is currently the subject of a separate discussion. Indeed, philosophy departments have never escaped the criticism that they teach Western thought, transfer Western intellectual currents, ignore social values, and provide an exclusively Western and unproductive education. Our study, which deals with the processes of change and transition in philosophy education in Turkey and the debates on these processes, consists of three chapters and three appendices. In the first part, the studies in the field of philosophy from Tanzimat to the Republic are discussed theoretically and a general framework is tried to be drawn about the establishment of philosophy in Turkey. The topics covered in this section are mainly philosophy education until the establishment of the first university in 1863 under the name Dârülfünun and its closure and reopening in 1900 under the name Dârülfünun-ı Şâhâne. As is known, after a long period of trial and error, Dârülfünun was reformed under the name "Dârülfünun-ı Osmânî" in 1908 during the Second Constitutional Monarchy. Reforms in the field of education continued unabated, and with the university reforms in 1915 and 1933, philosophy departments also underwent significant change and transformation. Especially German faculty members, who were influential in these reforms, played an active role in the restructuring of the philosophy department. Apart from universities, philosophical activities were also carried out in non-governmental organizations, newspapers and journals. In particular, the philosophers who tried to become an association under the name of the Turkish Philosophical Society are today actively working under the name of the Philosophical Society of Turkey and the Turkish Philosophical Association. In this part of our study, in addition to these issues, the philosophers of the Republican period, which we have identified as four generations, and their philosophical attitudes and behaviors are evaluated together with the aspects reflected and not reflected in their works, and the interaction between the similarities and differences between the general characteristics of the generations and the philosophical atmosphere in the country is tried to be analyzed. The similarities and differences between the generations are analyzed since they are the main factors that determine and govern the course of philosophy in Turkey. The second chapter is devoted to "Philosophical Disciplines in Purgatory in the Republican Era". In this section, the disciplines of history of science, logic, Islamic philosophy and philosophy of religion, which we characterize as disciplines in limbo because their place in philosophy departments has always been controversial, are analyzed. In the third and final chapter, under the title "Philosophical Problems and Movements in the Republican Era", the problem of establishing the practical implications of the philosophical issues discussed in the first two chapters on the theoretical level, the question of whether Turkish can be the language of philosophy, Western philosophical movements in Turkey and their representatives are discussed. This chapter concludes with the main purpose of the study, which is to discuss the problems of philosophy in Turkey, suggestions for solutions and future perspectives. We have tried to enrich our research with three appendices that are considered to be complementary to these three chapters. The first appendix contains interviews with twelve senior professors who retired after teaching philosophy in Turkey for many years. These senior professors were asked questions about the changes in the view of philosophy in Turkey, philosophy education in higher education, their perceptions of philosophy, etc., and an important historical note was made with their answers based on their experiences. In this respect, we believe that these interviews will serve as an important source and reference for future generations and the social sciences community. Although the speeches of these professors contain many important discourses, messages and references, we have chosen one motto phrase to carry in the title. On this occasion, we would like to express our gratitude to our esteemed professors for sharing their vast knowledge and experience in the field of philosophy with us. In the second appendix, the short life stories and works of about a hundred professors in the field of philosophy in the Republican period are included. Although this information is sometimes easily obtained through the internet, biographical books or the works of the professors themselves, sometimes, after a very long and laborious work, original information has been reached, which is expressed for the first time in this study. Sometimes the capture of a very small detail required great efforts. This book concerns the foundations of epistemic modality and hyperintensionality and their applications to the philosophy of mathematics. I examine the nature of epistemic modality, when the modal operator is interpreted as concerning both apriority and conceivability, as well as states of knowledge and belief. The book demonstrates how epistemic modality and hyperintensionality relate to the computational theory of mind; metaphysical modality and hyperintensionality; the types of mathematical modality and hyperintensionality; to the epistemic status of large cardinal axioms, undecidable propositions, (...) and abstraction principles in the philosophy of mathematics; to the modal and hyperintensional profiles of the logic of rational intuition; and to the types of intention, when the latter is interpreted as a hyperintensional mental state. Chapter \textbf{2} argues for a novel type of expressivism based on the duality between the categories of coalgebras and algebras, and argues that the duality permits of the reconciliation between modal and hyperintensional cognitivism and modal and hyperintensional expressivism. I also develop a novel topic-sensitive truthmaker semantics for dynamic epistemic logic, and develop a novel dynamic two-dimensional semantics grounded in two-dimensional hyperintensional Turing machines. Chapter \textbf{3} provides an abstraction principle for epistemic (hyper-)intensions. Chapter \textbf{4} advances a topic-sensitive two-dimensional truthmaker semantics, and provides three novel interpretations of the framework along with the epistemic and metasemantic. Chapter \textbf{5} applies the fixed points of the modal $\mu$-calculus in order to account for the iteration of epistemic states in a single agent, by contrast to availing of modal axiom 4 (i.e. the KK principle). The fixed point operators in the modal $\mu$-calculus are rendered hyperintensional, which yields the first hyperintensional construal of the modal $\mu$-calculus in the literature and the first application of the calculus to the iteration of epistemic states in a single agent instead of the common knowledge of a group of agents. Chapter \textbf{6} advances a solution to the Julius Caesar problem based on Fine's `criterial' identity conditions which incorporate conditions on essentiality and grounding. Chapter \textbf{7} provides a ground-theoretic regimentation of the proposals in the metaphysics of consciousness and examines its bearing on the two-dimensional conceivability argument against physicalism. The topic-sensitive epistemic two-dimensional truthmaker semantics developed in chapters \textbf{2} and \textbf{4} are availed of in order for epistemic states to be a guide to metaphysical states in the hyperintensional setting. -/- Chapters \textbf{8-12} provide cases demonstrating how the two-dimensional hyperintensions of hyperintensional, i.e. topic-sensitive epistemic two-dimensional truthmaker, semantics, solve the access problem in the epistemology of mathematics. Chapter \textbf{8} examines the interaction between my hyperintensional semantics and the axioms of epistemic set theory, large cardinal axioms, the Epistemic Church-Turing Thesis, the modal axioms governing the modal profile of $\Omega$-logic, Orey sentences such as the Generalized Continuum Hypothesis, and absolute decidability. These results yield inter alia the first hyperintensional Epistemic Church-Turing Thesis and hyperintensional epistemic set theories in the literature. Chapter \textbf{9} examines the modal and hyperintensional commitments of abstractionism, in particular necessitism, and epistemic hyperintensionality, epistemic utility theory, and the epistemology of abstraction. I countenance a hyperintensional semantics for novel epistemic abstractionist modalities. I suggest, too, that higher observational type theory can be applied to first-order abstraction principles in order to make first-order abstraction principles recursively enumerable, i.e. Turing machine computable, and that the truth of the first-order abstraction principle for hyperintensions is grounded in its being possibly recursively enumerable and the machine being physically implementable. Chapter \textbf{10} examines the philosophical significance of hyperintensional $\Omega$-logic in set theory and discusses the hyperintensionality of metamathematics. Chapter \textbf{11} provides a modal logic for rational intuition and provides a hyperintensional semantics. Chapter \textbf{12} avails of modal coalgebras to interpret the defining properties of indefinite extensibility, and avails of hyperintensional epistemic two-dimensional semantics in order to account for the interaction between interpretational and objective modalities and the truthmakers thereof. This yields the first hyperintensional category theory in the literature. I invent a new mathematical trick in which first-order structures are treated as categories, and Vopenka's principle can be satisfied because of the elementary embeddings between the categories and generate Vopenka cardinals in the category of Set in category theory. Chapter \textbf{13} examines modal responses to the alethic paradoxes. I provide a counter-example to epistemic closure for logical deduction. Chapter \textbf{14} examines, finally, the modal and hyperintensional semantics for the different types of intention and the relation of the latter to evidential decision theory. (shrink)

The encounter of the medieval Muslims with Greek philosophy undeniably shaped the course of their philosophical and theological thought. This encounter led to the complex and contentious issue of ‘philosophy versus theology’. Medieval Muslim thinkers needed to develop a response to the issue of philosophy versus theology. The present article will first highlight the response of the Islamic theologians to their encounter with Greek philosophy in the form of three major trends in medieval Islamic theology: (1) strong opposition to the (...) application of reason and rationalist approach to Islamic doctrines, and strict adherence to the actual text of the Qur’an and the Hadith, (2) the adoption of Greek philosophy, and the application of reason and rationalist approach to explain and defend Islamic religion and (3) acknowledging the significance of reason in exploring the matters related to the natural world but, at the same time, stressing the subordination of reason to revelation. This article will discuss Atharism, Muʿtazilism and Ashʿarism as the representatives of the first, second and third trends, respectively. The response of the medieval Islamic theologians to the issue of philosophy versus theology serves as a context in which medieval Muslim philosophers carried out their philosophy–theology debate. The article will proceed to show that some medieval Muslim philosophers, such as Abu Bakr Al-Razi, subordinated religion or revelation to philosophy or reason. Other medieval Muslim philosophers, such as Al-Ghazali, subordinated philosophy to theology. The third group of medieval Islamic philosophers represented by Alfarabi argued for the reconciliation and harmonious co-existence of philosophy and religion. Contribution: This article highlights the response of medieval Islamic theologians and philosophers to the issue of philosophy versus theology that was caused by their encounter with Greek philosophy. Although the issue of Imāmate was not initially seen as being one of the central subjects of Kalām, by the time it has gained importance especially after the Shīʿa started debating the matter in terms of credential aspects and as a result, it came to be covered as a specific chapter in Kalām books. The Muʿtazilite scholars on the other hand, did not lag from the relevant debates and included the matters that were related to Imāmate, in their works. Abū (...) l-Ḥusayn al-Baṣrī who was portrayed among one of the most influential figures of late Muʿtazila and was also recognized as the founder of Ḥusayniyya branch within the school, wrote extensively on the subject at stake. From among his works, Imāmate chapter of Sharḥ al-Uṣūl al-Khamsa has managed to survive. Abū l-Ḥusayn al-Baṣrī’s work is crucial not only because it included Imāmate discussions prior to him, but also it determined the directions in which the relevant debates took place since many refutations were written against it. Considering that Baṣrī’s work reflects the issues of his time in terms of both content and classification, it plays a significant role in the development of Islamic political thought and Imāmate discussions. Including the debates on Imāmate, this work extensively discusses the rational defenses of 10th century Shite Imāmate theory. The only extant copy of al-Baṣrī’s work is preserved at Glaser collection from VI/XIII. century under the heading number 114 at the Austrian National Library in Vienna. This study provides an examination regarding the authorship of Imāmate fragment of Sharḥ al-Uṣūl al-Khamsa, analyses the main characteristics of the manuscript, its contents and its approach to the Imāmate discussions; and finally provides the critical edition of al-Baṣrī’s mentioned work to the attention of researchers. This chapter aims to lay out a map of the diverse epistemological perspectives within the Islamic theological tradition, in the conceptual framework of contemporary analytic philosophy of religion. In order achieve that goal, it aims to consider epistemological views in light of their historic context, while at the same time seeking to “translate” those broadly medieval perspectives into contemporary philosophical language. In doing so, the chapter offers a succinct overview of the main epistemic trends within the Islamic theological tradition concerning (...) religious epistemology. The chapter is divided into two main sections designated for discussions of differing accounts found in distinct trends of the tradition, namely the Rationalist and Traditionalist trends. The discussion concerning the Rationalist trend focuses on the philosophical-theologians of the dominant Mu’tazilite, Ash’arite, and Maturidite schools. The section on Islamic Traditionalism focuses on the Atharite scripturalism of Ibn Qudāma, and in particular the thought of Ibn Taymiyya. In order to map out these historic positions in light of contemporary religious epistemology, reference is made to a threefold typology of current views in the literature: (1) theistic evidentialism, (2) reformed epistemology, and (3) fideism. As such, the remainder of the chapter will attempt to outline the different approaches toward religious epistemology in the Islamic theological tradition with this threefold typology in mind. Studie věnuje pozornost problematice demokratizace vědy, v jejímž rámci zaujímá klíčové postavení otázka, v jaké míře a zda vůbec má mít široká veřejnost možnost zasahovat do vědní a výzkumné politiky a participovat na rozhodování v odborných záležitostech. První část studie je věnována představení dvou radikálně odlišných a vzájemně protichůdných pohledů na tuto problematiku, které byly rozpracovány v rámci poválečné filosofie vědy v dílech Michaela Polanyiho a Paula Feyerabenda a v různých podobách spolu soupeří dodnes. Tyto dva pohledy, jež nás staví (...) před volbu mezi odborností na úkor demokracie a demokracií na úkor odbornosti, jsou následně podrobeny kritickému zhodnocení a v opozici k nim je představen alternativní pohled rozvíjený v rámci vědních studií Harrym Collinsem a Robertem Evansem, jenž překračuje nutnost této volby a na základě sociologických výzkumů fenoménu odbornosti nabízí způsob, jak lze odbornost a demokratické hodnoty sloučit dohromady. In diesem Empfinden des Widersinns im Widersprechen manifestiert sich psychischer Widerstand, der überwunden werden muß, indem er für alle, die davon betroffen sind, bewußt gemacht wird. Weil die Bewußtwerdung abgewehrter Inhalte ein Vorgang ist, der im Verlauf psychoanalytischer Behandlung oder Selbstbefragung bzw. Selbstinfragestellung zustande kommt, versuche ich die wesentlichen Ursachen für psychischen Widerstand aufzuzeigen.

John P. Burgess kritisiert Kurt Gödels Begriff der mathematischen oder rationalen Anschauung und erläutert, warum heuristische Intuition dasselbe leistet wie rationale Anschauung, aber ganz ohne ontologisch überflüssige Vorannahmen auskommt. Laut Burgess müsste Gödel einen Unterschied zwischen rationaler Anschauung und so etwas wie mathematischer Ahnung, aufzeigen können, die auf unbewusster Induktion oder Analogie beruht und eine heuristische Funktion bei der Rechtfertigung mathematischer Aussagen einnimmt. Nur, wozu benötigen wir eine solche Annahme? Reicht es nicht, wenn die mathematische Intuition als Heuristik funktioniert? Für (...) Gödel sind Mengen Extensionen von Begriffen und er beharrt beispielsweise auf dem ontologischen Objektstatus von Mengen, weil Denken für ihn einen Input benötigt, den es selbst nicht zu liefern im Stande ist. Im Falle der mathematischen Anschauung darf dieser Input allerdings nicht subjektiv kontingent sein, wenn es sich um objektiv gültige Theorien handeln soll. (Zudem vertritt Gödel eine Korrespondenztheorie der Wahrheit.) Der Begriff der heuristischen Intuition, den Burgess expliziert, stammt hingegen nicht zuletzt aus der kognitiven Psychologie, der bei der Verarbeitung impliziter, also unbewusster Informationen ansetzt und so das menschliche Vermögen erklärt, Entscheidungen und Urteile zu fällen, ohne sich der Urteilsgrundlagen bewusst zu sein. Über den ontologischen oder erkenntnistheoretischen Status dieser Urteilsgrundlagen sagen diese Theorien nichts aus. Sie könnten auch subjektiv kontingent zustande gekommen sein. Ihr normativer Anspruch ergibt sich lediglich aus „dem Funktionieren“, nicht daraus, dass es sich um Gesetze des Wahrseins handelt. (shrink)

Vzestup tohoto režimu je interpretován s ohledem na procesy odpojování univerzitního prostředí od dosavadního vzdělávacího rámce spojeného s veřejnými zájmy. The previously introduced algorithm \sqema\ computes first-order frame equivalents for modal formulae and also proves their canonicity. Here we extend \sqema\ with an additional rule based on a recursive version of Ackermann's lemma, which enables the algorithm to compute local frame equivalents of modal formulae in the extension of first-order logic with monadic least fixed-points \mffo. This computation operates by transforming input formulae into locally frame equivalent ones in the pure fragment of the hybrid mu-calculus. In particular, we prove that (...) the recursive extension of \sqema\ succeeds on the class of `recursive formulae'. We also show that a certain version of this algorithm guarantees the canonicity of the formulae on which it succeeds. (shrink)

This paper will focus on a famous nineteenth century debate over the physiology of perception between Ewald Hering and Hermann von Helmholtz. This debate is often explained as a contest between empiricism (Helmholtz) and nativism (Hering) about perception. I will argue that this is only part of the picture. Hering was a pioneer of Lamarckian explanations, arguing for an early version of the biogenetic law. Hering explains physical processes, including perception, in terms of ‘organic memory’ that is supported by ‘vital (...) forces’ located throughout the body. Helmholtz, on the other hand, argues that vital forces are in direct conflict with the results he and others proved in the 1840s and 50s on the conservation of force. The battleground of the debate was the interpretation of Johannes Müller’s ‘law of specific nerve energies’, which Hering interpreted in terms of vital forces, and Helmholtz interpreted using a naturalized neo-Kantian approach. In the end, the debate revealed deep fissures in nineteenth century accounts of scientific explanation, as well as in the conception of how physiology, psychology, physics, and philosophy are related. Abū Ishāq al-Ṣaffār was one of scholars of the Western Qarakhānids’ period who followed the Kalām thought of al-Māturīdī (d. 333/944). His theological works Talkhīs al-adilla and Risāla fī al-kalām, his method in kalām, and frequent reference to his works by Ottoman and Arab scholars indicate that al-Ṣaffār is a respected and authorative Māturīdī theologian. The article focuses on his defense of the kalām. By adding a long introduction to Talkhīs about the naming, importance, and religious legitimacy of the science (...) of kalām, Saffār asserted that the kalām should be learned. When systematical vindication of the science of kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the kalām among Ḥanafī-Māturīdīs. Even though he does not state its systematic, it can be understood that vindication of kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation. Al-Ṣaffār’s defending the science of kalām shows that there were opposite thoughts against kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania. In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists. His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- SUMMARY: Abū Ishāq Ibrahīm b. Ismāil Zāhid al-Ṣaffār al-Bukhārī is a scholar belonging to the Ḥanafī theological tradition which was improved by the contribution of Ḥanafī theologians who used thinking system of Abū Ḥanīfa (d. 150/767) as base and adopted Abū Manṣūr al-Māturīdī (d. 333/944) and his thoughts in historical process. The contents of his theological works Talkhīs al-adilla li-qawāʿid al-tawḥīd and Risāla fī al-Kalām, the method that he used, and references to his works made by Ottoman and Arab scholars indicate that he is an important Māturīdī theologian. The article focuses on his defense of the science of Kalām. -/- In Talkhīs al-adilla, there are two sections including the subject of naming, and importance and necessity of Kalām discipline. Here, the necessity of learning Kalām and its value are defended in detail. -/- Besides, rumors “Abū Ḥanīfa turned away from the science of Kalām in his doomsdays” and that “He prohibited to make occupation with Kalām completely” are evaluated. -/- When systematical vindication of the science of Kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the Kalām among Ḥanafī Māturīdīs. Even if Abū Manṣūr al-Māturīdī, Abū al-Yusr al-Bazdawī (d. 493/1100) and Abū Muʿīn al-Nasafī (d. 508/1115) defend that the science of Kalām is not wrong for religion; yet, the vindication of Kalām does not take a place under a separate title and in a detailed manner in any of Māturīdī theologians works. -/- The method that al-Ṣaffār used when he is defending the science of Kalām, differs from strategy of Abū Ḥanīfa. While Abū Ḥanīfa has mentioned that there is a need for the science of Kalām under these new circumstances, al-Ṣaffār has defended theologians who were charged with being Ahl al-Bidaʿ, by trying to prove that the prophets especially the Prophet Ibrāhīm, even the Companions of the Prophet Muḥammad (Ṣaḥāba) and the Successors of the Companions (Tābiʿūn) scholars use their minds and make arguments in religious matters. In this respect, he emphasizes that the Qurʾān orders to think and discuss gently, not to be stay in silence: “And dispute with them, using what is best” (16.125-126). Therefore, he states that this discipline which took a mission to explain and defend the creed of Islam (ʿaqīda), cannot be characterized as an innovation (bidʿah) or illicit. -/- His vindication method can be defined as a more developed type of method that Abu’l-Ḥasan al-Ash’arī’s (d. 324/935) used in Risāla fī istiḥsān al-khawḍ fī ʿilm al-kalām. Even though he does not state its systematic, it can be understood that vindication of Kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation: -/- a) Explanation: Explaining the necessity and importance of the science of Kalām by giving information about its definition, names, value and place among other principles. -/- b) Demonstration: Revealing the religious basics of the science of Kalām from the Qurʾān, the Sunna of the Prophet Muḥammad, the Companions of the Prophet, and the Successors of the Companions thus specifying that it is legitimate for religion. -/- c) Refutation: Replying the claims having aim to weaken the value of Kalām principle and its religious legality. -/- Al-Ṣaffār describes ‘the science of Kalām’ as ‘Knowing the Real with the evidences which help to reach the absolute information’. By allocating the concept of 'Ḥaqq', he repeats the definition of Kalām as “it is to know God with certain evidences” in a part of his work, and “it is to know the principles of religion (uṣūl al-dīn) with certain evidences” in another part. He describes Kalām as “Knowing ḥaqq / God / uṣūl al-dīn by depending on evidence”, and tries to prove that it is wrong to consider a science which performs the stated duty, as illicit and abominable and thus turn away from it. -/- Al-Ṣaffār thinks that it is right to call this principle as ‘Kalām’ because of the certain evidences leading to the truth that this science has used. This thought was defended by other theologians as well. -/- For example, according to Saʿd al-Dīn Masʿūd al-Taftazānī (d. 792/1310) it seems like to say “This is the word (kalām), not the other knowings” by the way of the power of evidences used in Kalām.Thus, it is appropriate to give name Kalām for this science which based on certain evidences. -/- Al-Ṣaffār’s explanations revealed in scope of vindication of the Kalām are adopted by some of following scholars. Ḥusām al-Dīn al-Sighnāqī (d. 714/1314) in his book called al-Tasdīd sharḥ al-Tamhīd fī qawāʿid al-tawḥīd quotes Saffâr’s explanations as the same. -/- Al-Ṣaffār indicates that the method told in the Qurʾān is to reply questions about religion, beliefs and rejection instead of remaining in silence. The duty taken on by Kalām is this vindication activity performed by the prophets whose examples are described in the Qurʾān and which is legal and demanded. His way of thinking and vindication of the Kalām resembles that of Abū Manṣūr al-Māturīdī. Al-Māturīdī says, “Prophets and we were ordered to invite infidels to Islam. When this invitation happens, the respondents will ask for evidence and explanation, and discussion will be inevitable. Therefore, discussing and talking about subjects of Kalām is not objectionable”. -/- Thoughts of al-Māturīdī and al-Ṣaffār regarding the vindication of the Kalām were repeated by Nūr al-Dīn al-Ṣābūnī (d. 580/1184), and Fakhr al-Dīn al-Rāzī (d. 606/1210) later. According to al-Ṣābūnī, the evidences put against deniers and especially the discussion made by the Prophet Ibrāhīm to defend his own belief, prove the legality of Kalām discipline. Likewise, according to al-Rāzī, the duty of Kalām is just an activity performed already in the Qurʾān and ordered to the prophets. At this point of view, since the prophets were leading to Kalām, banning this activity is nonsense. -/- According to al-Ṣaffār, the reason for why Abu Hanifa avoids his son Hammād from these discussions is that Abu Hanifa does not like discussions based on obstinate. Otherwise, it cannot be that Abū Ḥanīfa prohibits to learn Kalām and make discussion about Kalām. According to him, this behavior of Abū Ḥanīfa results from that people discussing with him are ignorant about the subject of Kalām, discussion turns to an obstinate, and coming to an end of discussion seems impossible. This comment of al-Ṣaffār is quoted in Miftāḥ al-saʿāda wa-miṣbāḥ al-siyāda by ʿIṣām al-Dīn Aḥmed b. Muṣṭafā Tashköprüzāde (d. 968/1561) and in Minaḥ al-rawḍ al-azhar fī sharḥ al-Fiqh al-akbar by ʿAlī b. Sulṭān Muḥammad al-Qārī (d. 1014/1606) as same as his words. -/- Al-Ṣaffār’s defending the science of Kalām shows that there were opposite thoughts against Kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania.In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of Kalām. Sie will sich nicht vom Christentum offen absagen, sondern das Christentum verändern oder eine neue Version des Christentums einführen. Radical Orthodoxy (RO), vor allem von John Milbank gegründet, will eine Gegenbewegung dazu sowie zum Säkularismus sein: „A theology which claims to be radical and orthodox“. In diesem Aufsatz möchte ich untersuchen, ob sie es wirklich ist, und (...) ich werde Indizien dafür vorstellen, daß sie es nicht ist. Vor diesem Hintergrund werde ich dann die Analytische Religionsphilosophie (oder Analytische Theologie) als Alternative vorstellen. (shrink)

Al-Taftāzānī introduces the Liar Paradox, in a commentary on al-Rāzī, in a short passage that is part of a polemic against the ethical rationalism of the Muʿtazila. In this essay, we consider his remarks and their place in the history of the Liar Paradox in Arabic Logic. In the passage, al-Taftāzānī introduces Liar Cycles into the tradition, gives the paradox a puzzling name—the fallacy of the “irrational root” —which became standard, and suggests a connection between the paradox and what it (...) tells us about truth and falsehood, and arguments for divine voluntarism and what they tell us about the nature of goodness and badness. On this last point, we also discuss a passage from al-Rāzī, which suggests similar connections. (shrink)

This paper aims to develop Nishida Kitarō’s “logic of place” into an “aesthetics of place.” While brilliantly fusing the Buddhist traditions of Japan with Western philosophy, in his later years, Nishida came up with his own unique philosophy, a “monadology with the concept of substance.” This is a concept anchored in mu or “emptiness.” From this standpoint, how is the individual understood and how does society take shape? The answers to these questions are fundamental keys to understanding Japanese philosophy. In (...) Japan, the individual in Japan is not locked up in itself, but it is possible for the “substantial ego” to vanish and be replaced by the ““I as an event.” Through a discussion of the “place” where the activities of the traditional poetic forms of renku and renga are performed, an attempt is made to develop an aesthetic approach to those questions. In der Korrespondenz mit Clarke ist Leibniz' Standardargument gegen die Annahme, daß Raum und Zeit absolut seien, daß Gott sich bei der Wahl des zu erschaffenden Universums gezwungen sähe, gegen das Prinzip des zureichenden Grundes zu verstoßen, wenn diese Annahme richtig wäre: Bloße Unterschiede in räumlicher und zeitlicher Hinsicht ergeben keinen Vorteilsunterschied, und da Gott nur aus Vorteilsgründen handelt, sind solche Unterschiede nicht möglich. Leibniz stellt dieses Argument als ausschließlich abhängig vom Prinzip des zureichenden Grundes dar, eine gängige Interpretation ist (...) aber, daß dies Prinzip determinierte Objekte göttlicher Wahl nur dann ergibt, wenn ein ergänzendes Prinzip von Kontingenz hinzutritt. Diese Auslegung muß falsch sein, wenn Leibniz hier authentisch bleibt, und insofern wäre doch das Prinzip des zureichenden Grundes eher als irgendein Prinzip des Besten Leibniz' Prinzip der Kontingenz. Nach den Kriterien einer einflußreichen (vor allem in den englischsprachigen Ländern vertretenen) Deutung der neuzeitlichen Philosophie enthält das Denken Kants die maximale Dosis an Idealismus, die eine Philosophie vertragen kann, ohne inkonsistent zu werden. Die Radikalisierung des idealistischen Ansatzes durch Fichte, Schelling und Hegel wird demnach als eine Abkehr von den geltenden Vernunftstandards betrachtet. Ausgangspunkt dieser Einschätzung ist nicht selten die Verwechslung des nachkantischen Idealismus mit einer überspannten Variante des Idealismus von Berkeley. Diese Lesart des postkantischen Idealismus läßt sich aber (...) weder exegetisch noch konzeptuell rechtfertigen. Der Grundsatz der Einheit von Sein und Denken, dessen erste explizite Aufstellung und Entfaltung Hegel zufolge Fichte zu verdanken ist, impliziert in keiner Weise, daß man dadurch die Existenz der Welt verneinen muß. Was dieser Grundsatz zum Ausdruck bringt, ist eigentlich nur die Notwendigkeit, ein komplexes theoretisches Modell auszuarbeiten, das imstande ist, zu erklären, wie sich die Existenz von wirklichen Dingen behaupten läßt, die vom Subjekt durch seine eigenen Erkenntnisakte erkannt werden, dabei aber zugleich vom Subjekt selbst verschieden sind. Hegels erkenntnistheoretischer Hauptansatz ist, daß die Verbindung von Denken und Sein, von Geist und Welt, strukturell ist. Das Sein kommt zu den Denkinhalten insofern nicht synthetisch hinzu; es sind hingegen die nur vorgestellten Erkenntnisinhalte, welche unter bestimmten Bedingungen der strukturellen Einheit des Geistes mit der Welt zugeschrieben werden. Zkoumání je založeno na reflexi sémantického pojetí vědec- kých teorií Ronalda Giera. Gierova východiska a závěry jsou podrobeny kritice, na jejímž základě autor buduje svou vlastní variantu modelově založeného pojetí teorií. Hlavním cílem příspěvku je konceptualizace vztahu mezi principy a modely s důrazem na to, že tento vztah může zakládat dynamiku teorie, respektive posloupnosti teorií. Souhrnně bude v příspěvku prověřována řada tezí: 1) Základními prvky teorie jsou modely, které slouží jako nosiče principů. 2) Modely hrají rozhodující roli při pojmové výstavbě (...) teorie. 3) Modely artikulací principů odhalují poznatky, které ze samotných principů neplynou. 4) Principy mohou být někdy souhrnně definovány až poté, co existuje odpovídající množina modelů. 5) Nová teorie nastoupí ve chvíli, kdy je cluster nových modelů dostatečně komplexní a když si vědecké společenství ujasní, že tento nový cluster je založen na určité množině nových principů. Článek se zabývá problematickou politické korektnosti ve vztahu k feministické filosofii vědy. Zaměřuje pozornost na užší pojem politické korektnosti - hodnotově motivovanou nekorektní práci s fakty. Konstatuje, že navzdory explicitnímu soustředění feministických autorek a autorů na význam hodnot v projektu vědy nelze chápat feministickou filosofii vědy jako politicky korektní nebo jako vybízení k politicky korektní vědě. Naopak se politicky korektní argumentace v tomto užším smyslu mohou dopouštět i práce vystupující proti feministické či politicky korektní agendě ve vědě.

Since the spread of Islam in Transoxiana (Mā-warāʾ al-Nahr), religious understandings based on the opinions of Abū Ḥanīfa (d. 150/767) have always been dominant in the region. Therefore, it was not possible for other understandings, which may seem to be opposite to Abū Ḥanīfa’s opinions, to be influential in the region. That Najjāriyya and Karrāmiyya could not be perennial in the region may be an example of this case. Similarly, Māturīdiyya, which benefited from Abū Ḥanīfa’s treatises of creed and his (...) rational method, could not adequately get the support of people at the time of Abū Manṣūr al-Māturīdī (d. 333/944) and Abū l-Muʿīn al-Nasafī (d. 508/1114) because the school was seen as an opposite approach to the prevailing imaginations about Abū Ḥanīfa. Moreover, the Ḥanafī jurists (Ḥanafī fuqahāʾ), who were influential in not only people but also bureaucracy, and the Ḥanafī theologians (Ḥanafī mutakallimūn), who followed al-Māturīdī’s theological method , did not come to terms on their interpretations of Abū Ḥanīfa. The Ḥanafī jurists who benefited mostly from juridical sources and manāqibworks were thinking different from the Ḥanafī theologians who relied on the treatises of Abū Ḥanīfa on such issues as the legitimacy of Kalām as a scholarly discipline, the responsibility of people of fatra(ahl al-fatra: people having no access to the message of Islam), and the creation of faith (īmān). The Ḥanafī jurists took different stance on various issues and argued that faith is not created; the informative (khabarī) attributes of God (ṣifāt Allāh) mentioned in the Qurʾān cannot be interpreted (taʾwīl); no one can be held accountable for faith only based on the intellect unless the message of the Prophet reaches to her or him; the people of fatracannot be responsible for faith. They also stated that Abū Ḥanīfa broke his relationship with the theological (kalāmī) issues in the last years of his life. Although these jurists accepted Abū Ḥanīfa’s distinction between faith and deeds and his view of the stability of one’s faith without increasing or decreasing they condemned theological discussions on these issues by going beyond the limits of the treatise of creed. While the Ḥanafī theologians known as the Ḥanafī scholars of Samarqand who adopted the religious views of Imām al-Māturīdī of Samarqand acknowledged the intellect and considered it as an independent source in religion, the Ḥanafī jurists known as the Ḥanafī scholars of Bukhārāauthorized the intellect only in understanding the transmission (naql) and its interpretation. The different opinions of the two groups can be seen clearly on the question of the religious responsibility of the people of fatra. When we look at the debates regarding Kalām and the Islamic law, we can see that the difference between these two cities (Samarqand and Bukhārā) stems from their methodological views on the epistemological values of the reason (ʿaql) and the transmission (tradition). Māturīdiyya is a school of theology established by the Ḥanafī theologians who upheld the necessity and significance of Kalām. It is possible to say that the Ḥanafī jurists did not contribute to the establishment and systematisation of this school; rather, they tried to prevent it. Our findings show that the Ḥanafī jurists who lived in Transoxiana differ from each other because of their different understandings of Abū Ḥanīfa. In the historical process extending today it is evident that the religious views of the Ḥanafī jurists and their interpretation of Abū Ḥanīfa have been prominent and effective, not that of Māturīdiyya, which is the understanding of the Ḥanafī theologians. This chapter (5) focuses on the concept of the forgiving God in Islamic religion and theology and claims that Islamic thinking about divine forgiveness accommodates two different views that emphasize two different attributes of God: justice and mercy. The first view is associated with a rationalist school of theology known as Mu'tazilism, while the second is associated with a fideistic school known as Ash'arism. Die im Beitrag behandelte Frage, ob sich die organische Natur des Menschen sowie seine Gesundheits- und Krankheitszustände naturalistisch auffassen lassen, erscheint zunächst irritierend. Ist nicht der Mensch als Säugetier ein natürliches Phänomen par excellence? Wie alle anderen Tiere kann der Mensch gesund oder krank sein, weil er einen Körper hat, dessen vielfältige biologische Funktionen störungsanfällig sind. Was sollte es hier noch zu naturalisieren geben? Integrieren sich Organismus, Gesundheit und Krankheit nicht gleichsam von selbst in ein naturwissenschaftliches Weltbild? Die zu klärende (...) Frage ist, welche begrifflichen und theoretischen Mittel den biologischen Naturalismus in die Lage versetzen, Organismen zu individuieren und Gesundheits- und Krankheitszustände an ihnen zu unterscheiden. In der Philosophie der Biologie wird weithin die Auffassung vertreten, dass der Begriff der Funktion hier die zentrale Rolle spielt. Wenn wir handeln, greifen wir in den Lauf der Welt ein und führen Veränderungen herbei, von denen wir zu Recht denken, daß sie nicht eingetreten wären, hätten wir nicht eingegriffen. Durch menschliche Eingriffe herbeigeführte Veränderungen machen aber nur einen kleinen Teil dessen aus, was in der Welt geschieht. Der größere Teil geschieht ohne unser Zutun. Beide Arten von Geschehnissen werden sowohl alltagssprachlich wie philosophisch in kausalem Vokabular beschrieben. Handelnde werden als kausale Urheber eines Geschehens verstanden; zugleich sind die mit Handlungen (...) einhergehenden Körperbewegungen kausal in natürliche Verläufe eingebettet: sie haben Ursachen und Wirkungen. -/- Die Studie versteht sich als Beitrag zu einer deskriptiven Metaphysik des Kausal- und des Handlungsbegriffes anhand einer Gegenüberstellung von kausaler Handlungstheorie und Handlungstheorie der Kausalität. Der Neuansatz besteht darin, das Verhältnis von Kausalitäts- und Handlungsbegriff konsequent als eine Gleichung mit zwei Unbekannten zu behandeln. -/- Die Untersuchung besteht aus drei Teilen. Der erste Teil dient einer Darstellung und Kritik der kausalen Handlungstheorie, welche den Kausalbegriff zur Analyse des Handlungsbegriffs verwendet. Ihr zufolge sind Handlungen Körperbewegungen, die sich durch eine besondere kausale Genese auszeichnen. Es zeigt sich, daß eine sachgerechte Lösung der internen Probleme dieser Theorie schlecht mit dem weithin akzeptierten Prinzip vom nomologischen Charakter der Kausalität vereinbar ist. Die Auseinandersetzung mit diesem Prinzip steht im Zentrum des zweiten, kausalitätstheoretischen Teils des Buches. Nancy Cartwright vertritt die These, daß es die strikten empirischen Sukzessionsgesetze, die die nomologische Kausalitätsauffassung erfordert, nicht gibt. Diese These wird ausführlich gegen Einwände aus der Wissenschaftstheorie verteidigt. Es entsteht ein kausalitätstheoretisches Vakuum, dessen Auffüllung der dritte Teil dient. Hier wird der kausalen Handlungstheorie eine Theorie der Kausalität gegenübergestellt, die das Explikationsverhältnis von „handeln“ und „verursachen“ umkehrt: die interventionistische Theorie der Kausalität, derzufolge der gewöhnliche Kausalitätsbegriff nicht erläutert werden kann, ohne den Begriff des absichtlichen Eingreifens in natürliche Verläufe ins Spiel zu bringen. Vorliegende Versionen dieser Theorie sind allerdings von schwerwiegenden Einwänden betroffen (Zirkularität, Anthropomorphismus). Um sie zu entkräften, muß die interventionistische Theorie in der richtigen Weise mit der kontrafaktischen Theorie der Kausalität kombiniert werden. Nur so läßt sich ein begrifflicher Rahmen aufspannen, in dem die durch menschliches Zutun und die ohne menschliches Zutun geschehenden Veränderungen in der Körperwelt gleichermaßen Platz finden, ohne daß neben der gewöhnlichen Ereigniskausalität eine zweite Art von Verursachung („Akteurskausalität“, „Kausalität aus Freiheit“) angenommen werden muß. Článek se zabývá způsobem, jakým vnímá vztah vědecké metody a demokracie Karl Popper. Toto sepětí je jedním ze základních atributů Popperova myšlení. Pro jeho pochopení je třeba zasadit Poppera do historického kontextu vývoje liberálního myšlení a poukázat na možné souvislosti se Schumpeterovou redefinicí demokracie. Výchozím bodem je však interpretace základních episte- mologických předpokladů Popperova myšlení - konceptů provizornosti vědeckého poznání a ratio negativa. Primárním cílem článku je kontextualizace těchto předpokladů s politologickými a sociologickými důsledky. Ty lze spatřovat nejen s odmítnutím (...) positivismu a esencialismu, ale také v Popperově preferenci volebních a stranických systémů. Na závěr je rozpracována problematika kritického racionalismu, hodnot a otevřené společnosti na základě možných námitek vůči Popperově teorii. (shrink)

Studie má za cíl představit strukturu Hayekova evolucionismu. Argumentace postupuje v několika krocích: Východiskem je historicko- systematická expozice způsobu, jakým evoluční teorie ovlivnila Hayekovu filosofii, především s ohledem na periodizaci vývoje jeho myšlení a systematické odlišení explanans a explanandum v rámci jeho teorie vědy. Dále je rozebírán způsob, jakým Hayek rozvíjí svoji metodologii vědy. V této souvislosti je argumentováno ve prospěch teze, že Hayekovo pojetí metodologického dualismu je důsledkem ovlivnění evoluční teorií. Zároveň je evoluční teorie představena jako nástroj vysvětlení, konkrétně (...) pak tzv. vysvětlení vzorce. Následně je představeno Hayekovo pojetí společnosti v kontextu kulturní evoluce. Společnost je interpretována jako řád jednání a je kladen důraz na Hayekovo vnímání společnosti jako řádu vyvíjejícího se společně s lidskou myslí. Na základě těchto předpokladů je v poslední části rozvinuto Hayekovo pojetí mysli. Toto pojetí vychází z konekcionistické pozice. Dále argumentuji proti tradičnímu pohledu na Hayekovu filosofii jako rozvíjení Kantovy filosofie. Závěr rekapituluje základní body Hayekova evolucionismu. (shrink)

Aktuelna pandemija virusa korona navela je mnoge pojedince da preispitaju usvojene obrasce ponašanja. Savremeni čovek, naviknut da najčešće odlučuje i dela u skladu sa sopstvenim interesima i željama, suočava se danas sa zahtevom da svoje postupke podredi opštem dobru. U doba pandemije kada svaki vid neopreznog i nesavesnog delanja može predstavljati opasnost kako po samog delatnika, tako i po njegove bližnje, postavlja se pitanje: kako treba postupati i u skladu sa kojim načelima? Odgovor na ovu važnu nedoumicu možemo pronaći ispitivanjem (...) etičke doktrine Imanuela Kanta. Jedna od glavnih odlika njegove etike jeste eksplicitna zabrana postavljanja pojedinca i njegovih ličnih težnji i ciljeva u prvi plan. Kantov vrhovni moralni princip nije utemeljen u čulima i iskustvu, nego u čovekovoj racionalnoj prirodi i njegovom umu, što mu daje opšte važenje. Ovaj princip važi jednako za sva racionalna bića. Cilj ovog teksta je da pokaže kako Kantov vrhovni moralni princip (izražen u formi kategoričkog imperativa) i čuveni test univerzalizacije mogu da nam posluže kao neka vrsta vodiča za ispravno postupanje. Videćemo da prilikom svakog odlučivanja moramo prvo da se zapitamo šta bi se desilo kada bismo svi postupili na određeni način, odnosno, da li možemo hteti da živimo u svetu koji bi u tom slučaju nastao. Ukoliko je odgovor potrvdan, onda je predloženi postupak moralno ispravan. (shrink)

Krize spojená s příchodem pandemie koronaviru ukázala, že užitečné expertní vědění sice podle všeho existuje, ale ne každému, kdo se představí jako expert, bychom měli věřit. Slovy doktora House: „Všichni lžou.“ Lžou i odborníci. Kapitola se zaměřuje na situace, kdy odborník lže takříkajíc „s dobrým úmyslem,“ neboť se domnívá, že pravda by veřejnost vedla k chování, které není společensky žádoucí. V takovém případě se jedná o lhaní paternalistické, protože má ochránit veřejnost před ní samotnou. Ukážeme příklady, kdy k němu dochází, (...) a pokusíme se i odhadnout, jak dobře takový pokus o manipulaci veřejnosti funguje krátkodobě i dlouhodobě. Protože výsledky našeho rozboru nenaznačují, že by dobročinné lhaní odborníků bylo skutečně společensky prospěšné, pobavíme se také o tom, proč by se mu člověk v roli experta měl raději vyhnout. Although some Muslim scholars have been affected in their ethical system by ancient Greek philosophers, they have also added some Islamic teachings to it and established a combined ethical system (philosophical and religious). Raghib Isfahani, the author of Al-Dharīʿa, is one of these Muslim scholars whose ethical system in this book should be regarded as a combined Islamic Virtue Ethics. It is the combination of Quranic and Philosophical Virtue Ethics. The general framework of his theory is philosophical adopted from Aristotle's (...) and Plato's Virtue Ethics, however, the content of his theory is completely Islamic and Quranic. One of the significant innovations of Raghib in philosophical Virtue Ethics is adding religious virtues to moral virtues. He added theses four religious virtues: Hidāya (God's guidance), Rushd (God's supplement), Tasdīd (God's giving strong will to individuals) and Taʾyīd (God's assistance) to Plato's four ethical virtues (wisdom, temperance, courage and justice). He has called them Tufīqī virtues. According to Raghib, there is no way to obtain virtues but by God's guidance and supplement. By inspiration from Quran, he divided justice into absolute and conditional one. This innovation help us in reconciling Muʿtazilites and as Ashʿarites dispute in being moral goodness and badness rational or religious. (shrink)

Přehledová studie sleduje a analyzuje proměny pojmu sociální inovace. Na základě silné společenské poptávky se z původně dílčí, teoreticky nediskutované a nefixované kategorie stává kategorie obecná. Pokrývá širokou oblast nemateriálních inovací a zároveň se profiluje jako aktivita normativní a intencionální, zaměřená na obecně uznávané sociální cíle. Co do ideově-hodnotových orientací současných koncepcí sociálních inovací studie identifikuje kromě mainstreamu, který zůstává u otevřených hodnotových charakteristik, ještě směr emancipačně-mobilizační a sociálně-tržně odpovědný. V epistemologické rovině se teoretici sociálních inovací hlásí především k praktickému (...) experimentování, pragmatismu, teorii komplexnosti a principům transdisciplinarity. (shrink)

This article first of all attempts to assess the proposals of 2006–2007 to amend Poland’s Constitution, aimed mostly at strengthening constitutional protection of unborn human life. Parliamentary work on this proposal begins with the submission of the Deputy’s bill on amendment of the Constitution, published in the Sejm Paper No. 993 of September 5, 2006, and ends with a series of votes at the 39th sitting of the Sejm of the fifth term of office, held on April 13, 2007, on (...) which it was decided not to adopt any amendment. In the course of the legislative process, several modifi cation were offered not only to Article 38 concerning protection of life, but also to Article 30 dealing with dignity as a source of rights. Each of these proposals had drawbacks, including inter alia: the lack of a definite period of protection or entitlement to dignity, resulting in the decreased protection in relation to issues concerning euthanasia; the application of new categories granting a specific status to unborn human life; specifying the standards for protection by means of legislative acts ranking lower than a constitution, resulting in the transfer of life protection into the sphere of regulation of ordinary legislation. The most conducive for strengthening of the protection of unborn human life, even if not free of imperfections, was an amendment of Article 30 proposed by the Committee in the following wording: “The inherent and inalienable dignity, conferred on the person from the moment of conception, shall be a source of freedoms and rights of persons and citizens. It shall be inviolable; the respect and protection thereof shall be the obligation of public authorities.” From the rejection of the proposals it is diffi cult to draw conclusions that are vital for interpretation of the existing provisions. However, a conclusion that the intention of the authors of the constitution was not to strengthen the constitutional protection of life is not legitimate, mostly because of their doubts about formal correctness of the proposed amendments (when deciding to reject them), particularly the doubts about legal consequences of their adoption. -/- Streszczenie Zasadniczym celem opracowania jest próba całościowej oceny propozycji nowelizacji Konstytucji RP mającej miejsce w latach 2006-2007, zmierzającej przede wszystkim do wzmocnienia konstytucyjnej ochrony życia człowieka przed narodzeniem. Prace parlamentarne nad analizowaną nowelizacją otwiera poselski projekt ustawy o zmianie Konstytucji zawarty w druku sejmowym 993 z dnia 5 września 2006 (projekt wpłynął do Sejmu 7 września); zamyka seria głosowań na 39 posiedzeniu Sejmu V kadencji, dnia 13 kwietnia 2007 roku; głosowań, które przesądziły o niewprowadzeniu żadnych zmian. W trakcie procesu legislacyjnego proponowano szereg formuł, zmieniających nie tylko art. 38 dotyczący ochrony życia, ale także art. 30, który dotyczy godności jako źródła praw. W zasadzie wszystkie zgłoszone propozycje posiadały wady, wśród których najważniejsze to: brak domknięcia okresu ochrony lub przysługiwania godności, skutkujący obniżeniem ochrony w kwestiach związanych z eutanazją; stosowanie nowych kategorii, prowadzące do nadania specyficznego statusu człowiekowi przed narodzeniem; określanie standardu ochrony za pośrednictwem aktów o randze niższej od konstytucji, prowadzące do przesunięcia ochrony życia przed narodzeniem w sferę ustawodawstwa zwykłego. Z punktu widzenia celu, jakim było wzmocnienie konstytucyjnej ochrony życia człowieka przed narodzeniem i wzmocnienie jego pozycji prawnej, najlepsza, choć nie pozbawiona usterek, była zaproponowana przez Komisję zmiana brzmienia art. 30 prowadząca do formuły: „Źródłem wolności i praw człowieka i obywatela jest przyrodzona i niezbywalna godność człowieka, przynależna mu od chwili poczęcia. Jest ona nienaruszalna, a jej poszanowanie i ochrona jest obowiązkiem władz publicznych.”. Na podstawie odrzucenia propozycji zmian trudno wyciągać wnioski istotne dla interpretacji aktualnie obowiązujących przepisów; wniosek, że ustrojodawca nie chciał wzmocnienia konstytucyjnej ochrony życie nie jest prawomocny, przede wszystkim ze względu na – istotne w procesie podejmowania decyzji o odrzuceniu propozycji zmian – wątpliwości, co do formalnej poprawności formułowanych propozycji, w tym wątpliwości co do konsekwencji prawnych ich przyjęcia. Tato studie se zabývá dvěma spřízněnými jevy odehrávajícími se ve vědeckém prostředí. Jedná se o fenomén frustrace ve vědecké praxi a s ním spojenou touhu po rozpoznání vlastního výzkumu vědeckou komunitou a následně o otázku uznání od akademického společenství. Zmíněné fenomény jsou přitom úzce propojeny s ústředním tématem filosofie a sociologie vědy: kdo rozhoduje, co bude předmětem vědeckého bádání? Předkládaná studie nejprve představuje Mertonův mýtus o okamžitém rozpoznání vědeckého objevu a následně prostřednictvím exkurzu do oblasti ekonomie a na příkladech z (...) vědecké praxe poukazuje na jeho neplatnost. V závěru textu jsou společně s jejich dekonstrukcí navrhnuta možná řešení popsaných problémů. Text je také kritickým návratem ke dvěma studiím Josepha Agassiho, žáka Karla R. Poppera a tvrdošíjného zastánce kritického racionalismu, neboť právě Agassi ve svých dílech rozebírá dopady vědeckého vyloučení a neochoty naslouchat. (shrink)

Als Nichts läßt sie sich ableiten, u ists.“ Im folgenden werde ich das genannte Resultat in seinem Entstehungszusammenhang im Gang der Wissenschaftslehre 1805 darstellen, um ersichtlich zu machen, inwiefern die empirische Wirklichkeit trotz ihrer empirischen Fülle bzw. This essay by Nishida Kitarō from 1927, translated into English here for the first time, is from the initial period of what has come to be called “Nishida philosophy” (Nishida tetsugaku), when Nishida was first developing his conception of “place” (basho). Nishida here inquires into the relationship between logic and consciousness in terms of place and implacement in order to overcome the shortcomings of previous philosophical attempts—from the ancient Greeks to the moderns—to dualistically conceive the relationship between being and knowing (...) in terms of subject-object or form-matter. During the course of articulating his novel approach to consciousness and cognition, Nishida discusses what he takes to be the weaknesses of Greek hylomorphism, Kantian (and neo-Kantian) dualism, and Husserlian phenomenology. Dissatisfied with the attribution of mere passivity to placiality, and turning away from consciousness objectified as a subject of statement, Nishida imparts to consciousness qua place a certain logical independence as an active yet un-objectifiable “predicate.” This investigation of consciousness as the unobjectifiable place for objectification leads Nishida to the notion of what precedes consciousness itself, a “place of nothing” (mu no basho) that envelops the dichotomized structures of subject-predicate, being-nothing, subject-object, universal-particular, et cetera. The object of this paper is to elaborate an understanding of Islamic law and legal theory in terms of the conceptual framework provided by Legal Positivism. The study is not based on denying or contesting the claim of Islamic law to being of divine origin; rather, it is based on the historical reality of Islamic law as part of a (once) living legal tradition, with structure, method, and theory, regardless of claims of origin. It will be suggested that Ash‘arism may (...) be taken as providing an Islamic version of Legal Positivism, and that the objections which Mu‘tazilism raised in the face of Ash‘arism were not different in substance from some of the objections that have been directed at contemporary Legal Positivism. It will also be suggested that the Ash‘arites and the Mu‘tazilites were not opposed to each other in the way they are commonly supposed to have been. Rather, they were preoccupied with different notions of what it is to be obliged (to have an obligation) to do something. (shrink)
