Recent discussions of emergence in physics have focussed on the use of limiting relations, and often particularly on singular or asymptotic limits. We discuss a putative example of emergence that does not fit into this narrative: the case of phonons. These quasi-particles have some claim to be emergent, not least because the way in which they relate to the underlying crystal is almost precisely analogous to the way in which quantum particles relate to the underlying quantum field theory. But there (...) is no need to take a limit when moving from a crystal lattice based description to the phonon description. Not only does this demonstrate that we can have emergence without limits, but also provides a way of understanding cases that do involve limits. (shrink)

In this paper we will examine the influence digital media has had on political dialogue in the public sphere. We will explore the phenomenon through an example case, namely the global feminist #MeToo movement which started in 2017. Within the framework of the #MeToo Movement, we introduce and examine the challenges digital media poses to the political dialogue in the public sphere. We start by going through concepts and theories utilized in this research paper. Then we will discuss the relationship (...) between digital media and #MeToo, after which we will assess the negative and positive outcomes of the #MeToo movement. Finally, an overall assessment concerning the movement and phenomenon around it is given. Our main argument is that while making the public sphere more inclusive, digital media has also made public debate and political discussion more polarized and antagonistic. (shrink)

Discussions concerning whether there is a natural right to health care may occur in various forms, resulting in policy recommendations for how to implement any such right in a given society. But health care policies may be judged by international standards including the UN Universal Declaration of Human Rights. The rights enumerated in the UDHR are grounded in traditions of moral theory, a philosophical analysis of which is necessary in order to adjudicate the value of specific policies designed to enshrine (...) rights such as a right to health care. We begin with an overview of the drafting of the UDHR and highlight the primary influence of natural law theory in validating the rights contained therein. We then provide an explication of natural law theory by reference to the writings of Thomas Aquinas, as well as elucidate the complementary “capabilities approach” of Martha Nussbaum. We conclude that a right to health care ought to be guaranteed by the state. (shrink)

ABSTRACTThis article addresses the question of whether certain experiences that originate in causes other than bereavement are properly termed ‘grief’. To do so, we focus on widespread experiences of grief that have been reported during the Covid-19 pandemic. We consider two potential objections to a more permissive use of the term: grief is, by definition, a response to a death; grief is subject to certain norms that apply only to the case of bereavement. Having shown that these objections are unconvincing, (...) we sketch a positive case for a conception of grief that is not specific to bereavement, by noting some features that grief following bereavement shares with other experiences of loss. 'Hands Tied' brings together two very different films about hands: Maria Lassnig's Palmistry (1973) and Ayesha Hameed's A Rough History (of the Destruction of Fingerprints) (2016). These works are contextualised and their scope extended further by a roundtable discussion featuring participants Rachel Aumiller, Sam Dolbear, Nadine El-Enany, Amelia Groom, Clio Nicastro, Anja Sunhyun Michaelsen, and M. Ty., who discuss their relation to fate, work, pleasure, touch, and surveillance.

Whipple disease is a rare, infectious, disease first described from a single case by Whipple in 1907. As well as characterising the clinical and pathological features of the condition, Whipple made two suggestions regarding its aetiology. These were either than the disease was caused by an infectious agent, or that it was of metabolic origin. As the disease is now thought to be caused by infection with the bacterium Tropheryma whipplei, historical reviews of the history of the disease typically mention (...) only the first of these suggestions. In this paper, we therefore revisit Whipple’s other theory. We argue that a diverse and often successful research programme was developed around this mechanism of disease causation which gave rise to many useful findings on the condition. In the later parts of this article, we then turn to discuss the surprising neglect of this period of Whipple disease research in the current literature, and conclude by offering a brief reconstruction of this early history suitable for use in a technical context. Bài báo này tìm hiểu mối quan hệ tác động giữa tỷ lệ sở hữu nước ngoài và quản trị nước ngoài với hiệu quả hoạt động của các doanh nghiệp niêm yết tại Việt Nam. Số liệu được sử dụng trong bài được thu thập từ 314 doanh nghiệp hoạt động trong các ngành nghề khác nhau trong 4 năm, từ năm 2019 đến năm 2023. Bài báo thực hiện kiểm định Hausman và kết luận mô hình REM là (...) phù hợp với dữ liệu. Kết quả chỉ ra tác động tiêu cực của tỷ lệ sở hữu nước ngoài lên hiệu quả kinh doanh của doanh nghiệp. Tuy nhiên, nếu tỷ lệ sở hữu tăng đi kèm với việc nhà đầu tư nước ngoài tham gia quản lý công ty thì sẽ giúp doanh nghiệp phát triển tốt hơn. Điều này thể hiện ở phát hiện thứ hai của bài báo, là ảnh hưởng tích cực của quản trị nước ngoài lên hiệu quả hoạt động của doanh nghiệp. [This paper explores the relationship between foreign ownership ratio, foreign governance and performance of listed enterprises in Vietnam. Data were collected from 314 businesses in different industries from 2019 to 2023. Employing Hausman testing, it concludes that REM model suits the data. The results point out the negative impact of foreign ownership ratio on performance of those enterprises. However, if the ownership ratio increases while foreign investors participate in company management, enterprises will develop better. Eleanor Knox has argued that our concept of spacetime applies to whichever structure plays a certain functional role in the laws (the role of determining local inertial structure). I raise two complications for this approach. First, our spacetime concept seems to have the structure of a cluster concept, which means that Knox's inertial criteria for spacetime cannot succeed with complete generality. Second, the notion of metaphysical fundamentality may feature in the spacetime concept, in which case spacetime functionalism may be (...) uninformative in the absence of answers to fundamental metaphysical questions like the substantivalist/relationist debate. One of the core insights from Eleanor Rosch’s work on categorization is that human categorization isn’t arbitrary. Instead, two psychological principles constrain possible systems of classification for all human cultures. According to these principles, the task of a category system is to provide maximum information with the least cognitive effort, and the perceived world provides us with structured rather than arbitrary features. In this paper, I show that Rosch's insights give us important resources for making progress on the 'feasibility (...) question' in conceptual engineering: the question of how we can implement conceptual engineering projects in ways that are practically feasible. Specifically, I show that one overlooked upshot of Rosch's work is that naming practices play an extremely important role in the construction of perceived similarities within and dissimilarities between categories, and, correspondingly, the dissemination of social stereotypes that serve as markers between different categories that are otherwise similar. Thus, naming practices will be a crucial constraint for the feasibility of certain ameliorative projects. (shrink)

Článek se zabývá způsobem, jakým vnímá vztah vědecké metody a demokracie Karl Popper. Toto sepětí je jedním ze základních atributů Popperova myšlení. Pro jeho pochopení je třeba zasadit Poppera do historického kontextu vývoje liberálního myšlení a poukázat na možné souvislosti se Schumpeterovou redefinicí demokracie. Výchozím bodem je však interpretace základních episte- mologických předpokladů Popperova myšlení - konceptů provizornosti vědeckého poznání a ratio negativa. Primárním cílem článku je kontextualizace těchto předpokladů s politologickými a sociologickými důsledky. Ty lze spatřovat nejen s odmítnutím (...) positivismu a esencialismu, ale také v Popperově preferenci volebních a stranických systémů. Na závěr je rozpracována problematika kritického racionalismu, hodnot a otevřené společnosti na základě možných námitek vůči Popperově teorii. (shrink)

Debata o tzv. „Novém Humovi“ byla v posledních desetiletích dominantním tématem humovské interpretace. James Hill ve svém příspěvku v tomto časopise podporuje hlavní požadavek „novohumovců“, který vymezuje Huma jako epistemologického skeptika a ontologického realistu. Vůči tomuto pojetí máme několik výhrad. Některé se týkají nejasností v definici realismu a celkově i smysluplnosti projektu „Nový Hume“. Některé se týkají konkrétních Hillových argumentů zaměřených na Humovy Dialogy a především jeho tvrzení, že v tomto díle lze nalézt další důkaz Humova realismu.

In "On Social Facts" (1989) and subsequent works, Margaret Gilbert has suggested a plural subject account of the semantics of ‘we’ that claims that a central or standard use of ‘we’ is to refer to an existing or anticipated plural subject. This contrasts with the more general approach to treat plural pronouns as expressions referring to certain pluralities. I argue that (i) the plural subject approach cannot account for certain syntactic phenomena and that (ii) the sense of intimacy, which Gilbert (...) cites as evidence for her plural subject account, has a different source than the existence of joint commitments constituting a respective plural subject. Moreover, (iii) there is a wide varie-ty of phenomena in the linguistic record, which, while not constituting conclusive evidence against the plural subject account, nevertheless, are dealt with better by the plurality account. ‘We’ thus refers to pluralities, which may or may not be plural subjects. The precise analysis of ‘we’ thus reveals a multi-layered ontology of groups. (shrink)

Cílem článku je podat kritický rozbor predikcí týkajících se budoucnosti sociálních věd, jak je formuluje Ladislav Kvasz pod záštitou svého projektu „formální epistemologie". Modelem dynamiky vztahů mezi obory na vědeckém poli nabízí Kvasz v otázce střídání paradigmat alternativu ke Kuhnově teorii vědeckých revolucí. Text zkoumá, na jakých základech je mechanismus změn u Kvasze vystavěn a co z toho plyne pro relevanci předpovědí z tohoto modelu vyvozených - především těch o sociálních vědách. K tomu slouží souběžné představení historické metody Michela Foucaulta, (...) který zdůrazňuje potřebu vyvarovat se zavádění falešných kontinuit ve zkoumání trajektorií vědeckých oborů, u kterých dochází ke zlomům v jejich epistemické struktuře. Zvláštní zřetel je kladen na souvislost predikcí s možnostmi odlišit epistemologicky a sociologicky uchopitelné prvky spojené s chodem vědy. Jako klíčový moment se tedy ukáže možnost práce se sociálně vědními obory pomocí jemných nástrojů, které Kvasz vyvinul na vědách exaktních. (shrink)

Intellectual humility can be broadly construed as being conscious of the limits of one’s existing knowledge and capable to acquire more knowledge, which makes it a key virtue of the information age. However, the claim “I am (intellectually) humble” seems paradoxical in that someone who has the disposition in question would not typically volunteer it. There is an explanatory gap between the meaning of the sentence and the meaning the speaker ex- presses by uttering it. We therefore suggest analyzing intellectual (...) humility semantically, using a psycholexical approach that focuses on both synonyms and antonyms of ‘intellectual humili- ty’. We present a thesaurus-based methodology to map the semantic space of intellectual hu- mility and the vices it opposes as a heuristic to support philosophical and psychological anal- ysis of this disposition. We performed the mapping both in English and German in order to test for possible cultural differences in the understanding of intellectual humility. In both lan- guages, we find basically the same three semantic dimensions of intellectual humility (sensi- bility, discreetness, and knowledge dimensions) as well as three dimensions of its related vic- es (self-overrating, other-underrating and dogmatism dimensions). The resulting semantic clusters were validated in an empirical study with English (n=276) and German (n=406) par- ticipants. We find medium to high correlations (0.54-0.72) between thesaurus similarity and perceived similarity, and we can validate the labels of the three dimensions identified in the study. But we also find indications of the limitations of the thesaurus methodology in terms of cluster plausibility. We conclude by discussing the importance of these findings for construct- ing psychometric scales for intellectual humility. (shrink)

Myšlenkové experimenty jsou populárním argumentačním nástrojem ve vědě i filosofii. Jejich kritika ze strany naturalistických a experimentálních filosofů vedla k vytvoření deflačních a minimalistických koncepcí, které oslabují epistemickou sílu myšlenkových experimentů a smiřují je s empirismem. Cílem článku je ukázat, že tyto pokusy nepřekonávají hlavní problémy, se kterými se myšlenkové experimenty ve filosofii střetávají. Omezená lidská racionalita a představivost znemožňují experimentátorům řešit nereálné scénáře spolehlivým způsobem. Myšlenkové experimenty se ve filosofii používají jinak než ve vědě, protože ty pravé jsou obvykle (...) neuskutečnitelné a uzavřené vůči možnosti empirické falsifikace. Navíc jsou založeny na vadných analogiích a neoprávněně přenášejí důkazní břemeno. Persvazivní úspěšnost myšlenkových experimentů je velmi nízká, a proto nedokáží přispět k řešení filosofických problémů. Závěrem článku je, že nejběžnější druhy myšlenkových experimentů by měly být odstraněny ze souboru filosofických metod. (shrink)

Vzrůstající využívání digitálních technologií ve vědecké práci a komunikaci vyvolává otázku, jaká je epistemologická povaha takto vytvořeného vědění. V tomto eseji využívám pojmový aparát, který vyvinuli Steven Shapin a Simon Schaffer k analýze historického sporu mezi Robertem Boylem a Thomasem Hobbesem o způsob vytváření vědění v přírodní filosofii, a aplikuji jej na problematiku digitálního výzkumu. Jejich koncepty tří technologií vytvářejících vědění – materiální, literární a sociální – se ukazují jako heuristicky užitečné koncepty i pro reflexi digitálních technologií. Ty jsou v (...) eseji představeny nikoliv jako samostatné technologie vytváření faktů, nýbrž jako prvky, kolem nichž se dosavadní vědecké technologie radikálně rekonfigurují. Zvláštní pozornost esej věnuje představě kódu jako literární technologie a roli digitálních technologií v humanitních vědách. (shrink)

Člověk se od jiných živočišných druhů odlišuje mnoha způsoby, k nejpodstatnějším z nichž patří rozum, jazyk a také schopnost řídit se pravidly. V tomto textu argumentuji, že je to především ta poslední schopnost, která je klíčová a bez které jsou ty další nepředstavitelné. Člověk je společenská bytost nejenom v tom smyslu, že žije ve společenstvích, ale i v tom, že tato společenství jsou strukturována složitým pletivem pravidel, která zásadním způsobem determinují modus vivendi lidí, kteří je tvoří, a v důsledku toho (...) determinují i člověka jako takového. Soustava pravidel může vytvořit jistý „vnitřní prostor" - to jest tato pravidla můžeme přijímat a tím vstoupit do tohoto prostoru, nebo je můžeme jenom zaznamenávat. Dialektika těchto dvou postojů nám umožňuje nahlédnout, že ač je normativní rozměr pro člověka jakožto společenskou bytost naprosto klíčový a těžko postižitelný běžnými vědeckými metodami „nezúčastněného pozorování", není tento normativní rozměr ničím esoterickým, něčím, co by bylo z hlediska vědy pochybné. What would the Merleau-Ponty of Phenomenology of Perception have thought of the use of his phenomenology in the cognitive sciences? This question raises the issue of Merleau-Ponty’s conception of the relationship between the sciences and philosophy, and of what he took the philosophical significance of his phenomenology to be. In this article I suggest an answer to this question through a discussion of certain claims made in connection to the “post-cognitivist” approach to cognitive science by Hubert Dreyfus, Shaun Gallagher and (...) Francisco Varela, Evan Thompson and Eleanor Rosch. I suggest that these claims are indicative of an appropriation of Merleau-Ponty’s thought that he would have welcomed as innovative science. Despite this, I argue that he would have viewed this use of his work as potentially occluding the full philosophical significance that he believed his phenomenological investigations to contain. Filozofia subiektywności dotarła w XX wieku do granic swoich możliwości. Jako odpowiedź na jej ograniczenia rozmaici filozofowie podjęli próby nowego rodzaju myślenia. Takie próby to m.in. myśl dialogiczna, która pierwszy wyraz znalazła w pismach takich filozofów, jak Franz Rosenzweig, Martin Buber czy Eberhard Grisebach. Innym przykładem jest postulat powrotu do pytania o bycie Martina Heideggera. W niniejszym artykule staram się pokazać, że obie próby mają ze sobą wiele wspólnego, choć ich przedstawiciele odnosili się do siebie nawzajem raczej krytycznie, o ile (...) w ogóle to czynili. Okazuje się jednak, że myśl Martina Bubera oraz Martina Heideggera ujmują człowieka jako byt dynamiczny, który staje w obliczu nachodzącego go wezwana. Dlatego też analizuję najpierw koncepcję Martina Heideggera z okresu Bycia i czasu, następnie przedstawiam myślenie Martina Bubera, głównie w oparciu o jego traktat Ja i Ty. Na koniec dokonuję zestawienia i porównania wątków wspólnych obu filozofom, jak również zaznaczam różnice, które dzielą obie próby przekroczenia filozofii podmiotowości. (shrink)

José Hugo Burel Guerra nació el 23 de marzo de 1951 en Montevideo (Uruguay). Desde 2017 es miembro de número de la Academia Nacional de Letras del Uruguay (ANL), institución a la cual ingresó con su discurso titulado «Ismael». Es licenciado en Letras por el Instituto de Filosofía, Ciencias y Letras (que se conoce en la actualidad como UCUDAL) y la Pontificia Universidad Católica de Río Grande do Sul. Aparte de ser escritor, se ha desempeñado como músico, publicista, diseñador gráfico, (...) profesor y periodista. Dentro del ámbito literario, ha publicado cuentos, novelas y ensayos. Entre su producción, algunos títulos son los siguientes: Esperando a la pianista y otros cuentos (1983), Tampoco la pena dura (1989), Los dados de Dios (1997) El autor de mis días (1999), El guerrero del crepúsculo (2001), Tijeras de plata (2003), Los inmortales (2004), El corredor nocturno (2005), El desfile salvaje (2007), El caso Bonapelch (2014) y La misteriosa muerte de Eleanor Rigby (2019). Đại dịch Covid-19 đã gây ảnh hưởng tiêu cực đến thị trường lao động Việt Nam, hàng triệu lao động giảm giờ làm, giảm thu nhập, thậm chí mất việc làm. Đây là lần đầu tiên trong 10 năm qua, nền kinh tế Việt Nam bị sụt giảm nghiêm trọng về số lượng người tham gia thị trường lao động và việc làm. Thu nhập bình quân của người lao động cũng bị thâm hụt. Tỷ lệ thất nghiệp, thiếu việc (...) làm và tỷ lệ lao động làm việc phi chính thức tăng mạnh so với xu hướng giảm của những năm gần đây. Bài viết nghiên cứu tác động của lạm phát đến thị trường chứng khoán Việt Nam bằng mô hình GARCH. Kết quả cho thấy, các chỉ số chứng khoán thường đồng biến với chỉ số lạm phát. Tỷ lệ lạm phát càng cao, kéo theo chỉ số thị trường chứng khoán càng lớn. Bên cạnh đó, nhà đầu tư chứng khoán Việt Nam thường đầu tư bằng các khoản vay tín dụng ngắn hạn và sử dụng đòn bẩy tài chính, (...) dẫn đến nguy cơ thị trường và toàn bộ nền kinh tế thiếu ổn định. COVID-19 bùng phát lần 2 đang gây lo lắng ở Việt Nam. Ảnh hưởng tiêu cực của dịch bệnh có thể cảm nhận được rất rõ trong công việc. Ngoài cản trở và đình trệ với sản xuất, công việc biên tập bình duyệt cũng bị tồn đọng, dẫn đến chờ đợi kéo dài. Tỷ lệ từ chối cũng có khuynh hướng tăng vọt.

Cuộc khủng hoảng 2007-2008 nổ ra ở Hoa Kỳ kéo theo sự lao dốc của các thị trường chứng khoán các nước cho thấy tồn tại tác động lan truyền từ thị trường này sang thị trường khác. Mục tiêu của bài nghiên cứu nhằm kiểm tra mức độ lan truyền trong tỷ suất lợi nhuận và độ biến động tỷ suất lợi nhuận từ các thị trường chứng khoán phát triển (Hoa Kỳ và Nhật Bản) đến tám thị trường (...) các nước mới nổi (Ấn Độ, Trung Quốc, Indonesia, Hàn Quốc, Malaysia, Philippines, Đài Loan, Thái Lan) và Việt Nam. Nghiên cứu sử dụng các biến ngoại sinh là cú sốc từ thị trường Mỹ và Nhật Bản và hiệu ứng ngày trong mô hình ARMA(1,1)-GARCH(1,1) trên dữ liệu của các nước mới nổi khu vực châu Á và Việt Nam nhằm đánh giá tác động lan truyền. Nghiên cứu đưa ra một số kết quả như sau. Thứ nhất, hiệu ứng ngày tồn tại trên sáu trong số chín thị trường chứng khoán được nghiên cứu, ngoại trừ Ấn Độ, Đài Loan và Philippines. Thứ hai, tồn tại tác động lan truyền trong tỷ suất lợi nhuận giữa các thị trường với mức độ khác nhau, trong đó, Hoa Kỳ có tác động mạnh hơn đến thị trường Malaysia, Philippines và Việt Nam; ngược lại, Nhật Bản có hiệu ứng lan truyền cao hơn đến thị trường Trung Quốc, Ấn Độ, Hàn Quốc và Thái Lan; đối với thị trường Indonesia, hiệu ứng lan truyền từ Hoa Kỳ và Nhật Bản là tương đương. Trong những năm gần đây, khái niệm phát triển bền vững đã trở nên phổ biến trong các ngành công nghiệp trên khắp thế giới. Người tiêu dùng ngày càng tỏ ra quan tâm đến tác động môi trường tạo ra từ các lựa chọn của họ, điều này đã thúc đẩy các công ty phải sử dụng các thông điệp và biện pháp thân thiện với môi trường. Mặc dù những nỗ lực thực sự hướng đến sự bền vững (...) là đáng khen ngợi, nhưng đã xuất hiện một xu hướng đáng báo động: hiện tượng "tẩy xanh" (greenwashing). Trong các hoạt động tẩy xanh này, các công ty thường phóng đại hoặc trình bày sai những nỗ lực về môi trường của họ để thu hút những người tiêu dùng có ý thức về môi trường. Vụ bê bối "Diesel sạch" của Volkswagen vào năm 2015 đã chỉ ra hiện hiện tượng tẩy xanh đáng báo động trong các doanh nghiệp. Tình trạng này đã lan rộng sang nhiều lĩnh vực khác nhau, bao gồm cả ngành đồ uống và thời trang nhanh. (shrink)

Artykuł w głównej mierze poświęcony jest analizie późnego eseju Norberta Eliasa Über die Einsamkeit der Sterbenden in unseren Tagen (1982). W pierwszej części autorka rozpatruje socjologiczne refleksje Eliasa nad zmianami we współczesnej percepcji umierania – choroby, starości, śmierci. Zdaniem Eliasa fenomen śmierci podlega systematycznemu wykluczeniu z centrum życia społecznego – z codzienności -, co stanowi o nowej wersji jego „zaczarowania”. W części drugiej przedstawiona jest jedna z najważniejszych tez niniejszego artykułu, tj. idea rozumu anamnetycznego. Autorka skupia się tu na Eliasowskich (...) pojęciach komunikacji, zaangażowania i balansu w strukturze ja-my (resp. ja-ty). Elisowska formuła Ich-Wir-Balance, jako proces uczenia się, ma stanowić o zrównoważeniu i przedefiniowaniu rozumu anamnetycznego / pamięci kolektywnej. W ostatniej, trzeciej części autorka ilustruje krótko pewne podobieństwa między Eliasowską kategorią śmierci a nihilizmem w ujęciu T. Różewicza oraz koncepcją biopolityki G. Agambena. (shrink)

Idea integracji europejskiej nie jest wymysłem naszych czasów. Jest to proces złożony, który dojrzewał na przestrzeni kilku wieków i który w naszym stuleciu zaczął nabierać wyrazistych kształtów. Społeczeństwa europejskie znużone bezsensem wzajemnie wyniszczających wojen, zaczęły poszukiwać takiej formy koegzystencji, która umożliwiłaby im wspólne decydowanie o polityce, gospodarce czy kulturze. W roku 1950 francuski minister spraw zagranicznych Robert Schuman zadeklarował gotowość rządu francuskiego do współpracy z rządem niemieckim w sektorze węgla i stali, w celu zagwarantowania pokoju na kontynencie. Plan Schumana urzeczywistnił (...) się z chwilą podpisania w Paryżu 18 kwietnia 1951 r. przez sześć państw zachodnioeuropejskich: Niemcy, Francję, Włochy, Luksemburg, Belgię i Holandię, układu o Europejskiej Wspólnocie Węgla i Stali (EWWiS). Kolejne dwa traktaty o utworzeniu Europejskiej Wspólnoty Gospodarczej (EWG) oraz Europejskiej Wspólnoty Energii Atomowej (Euratom) podpisane w Rzymie 25 marca 1957 r. miały na celu rozszerzenie współpracy gospodarczej na inne sektory, takie jak rolnictwo, rybołówstwo, komunikacja, handel zagraniczny oraz utworzenie wspólnego rynku gospodarczego. Aby cel ten został osiągnięty, państwa członkowskie zdecydowały się na kolejne kroki integracyjne, jakimi były unia gospodarcza i walutowa. Drogę do tego procesu otworzył podpisany 7 lutego 1992 r. w Maastricht Traktat o Unii Europejskiej. Ratyfikacja Układu z Maastricht stała się okazją dokonania pewnych zmian w niemieckiej konstytucji, do której wprowadzono nowy zapis w art. 23 o Unii Europejskiej. Unia stała się celem nadrzędnym państwa niemieckiego, a Bundestag i Bundesrat otrzymały jasne cele i zadania w sprawach dotyczących Unii Europejskiej. Fakt ten świadczy o ogromnym znaczeniu Unii dla Niemiec. Niemcy są jednym z najbogatszych państw piętnastki. Ich PKB przekracza 20 tys. ECU i jest jednym z najwyższych w Unii. Motorem niemieckiej gospodarki jest przemysł, a zwłaszcza prężnie rozwijający się przemysł samochodowy. Unia Europejska jest dla Niemiec ważnym rynkiem zbytu - 60% eksportu w ramach Unii Europejskiej zajmuje eksport niemiecki. Poziom, który Niemcy osiągnęli w przeciągu 50 lat od zakończenia drugiej wojny światowej, nie byłby możliwy bez ścisłej współpracy pozostałych państw europejskich. Zniesienie ceł oraz wszelkich barier gospodarczych stworzyło ogromne możliwości handlowe i nie tylko. Ważnym krokiem w intensyfikacji wzajemnych stosunków było utworzenie unii gospodarczej i monetarnej, mającej na celu wprowadzenie do 2002 wspólnej waluty EURO. Wraz z postępującą integracją wewnątrz Unii Europejskiej pod koniec lat osiemdziesiątych dokonały się w Europie ważne zmiany historyczne. Europa Środkowa i Wschodnia uwalnia się, w wyniku reform przeprowadzanych w Związku Radzieckim przez Michaiła Gorbaczowa, spod totalitarnych rządów komunistycznych. W roku 1991 wybucha w Moskwie pucz, który wykorzystują republiki radzieckie, ogłaszając swoją niepodległość. W Polsce i na Węgrzech odbywają się obrady okrągłego stołu, w wyniku których komuniści oddają władzę opozycji. Do ostrych konfliktów dochodzi natomiast w Czechosłowacji i Rumunii, gdzie oddanie władzy nie odbywa się bez przelewu krwi. Zmiany polityczne nie ominęły również NRD. W nocy z 9 na 10 listopada 1989 r. runął mur berliński, a 3 października 1990 r. dokonuje się zjednoczenie obu państw niemieckich. Wraz ze zjednoczeniem NRD staje się członkiem Unii Europejskiej. Proces ten odbywa się jednak na innych zasadach, niż przewidują to unijne procedury mówiące o przyjęciu nowych członków w swoje szeregi. W dniu zjednoczenia Wschodnie Niemcy przejmują prawo pierwotne oraz 80% prawa wtórnego Unii. Poza tym otrzymują znaczną pomoc w ramach funduszy strukturalnych. Wiele państw Europy Środkowo- Wschodniej chętnie podzieliłoby los NRD i szybko zintegrowałoby się z zachodnioeuropejskimi strukturami. Dlatego też od początku lat dziewięćdziesiątych zauważamy intensywne starania tych państw o przyjęcie w struktury Unii Europejskiej. W roku 1991 Polska i Węgry podpisały jako pierwsze państwa byłego Bloku Wschodniego Układy Europejskie. W ślad za nimi poszły Bułgaria, Litwa, Łotwa, Estonia, Rumunia, Słowenia, Słowacja i Czechy. Od 1994 r. kraje te wystąpiły oficjalnie o członkostwo w Unii Europejskiej. Przystąpienie do Unii spotyka się w społeczeństwie z wieloma negatywnymi reakcjami. Polacy coraz bardziej sceptycznie odnoszą się do spraw Unii Europejskiej i do przyszłego w niej członkostwa, choć z pewnością można by liczyć na wiele. Chociażby na ustabilizowanie gospodarki, młodej demokracji oraz stosunków polsko-niemieckich. Przeszkodą i problemem na drodze do integracji jest sytuacja polskiego rolnictwa, kwestia wykupu ziem polskich przez Niemców oraz utraty tożsamości narodowej. Również Niemcy obawiają się rozszerzenia. Politycy natomiast wydają się być motorem integracji europejskiej. Helmut Kohl, były kanclerz Niemiec, postawił sobie nawet za cel zintegrowanie krajów środkowoeuropejskich ze strukturami zachodnimi do 2002 r., podając za powód swej decyzji utrzymanie stabilności gospodarki i pokoju w tym regionie. Jego następca Gerhard Schröder nie jest już takim optymistą. Podczas niemieckiego przewodnictwa w Radzie Unii Europejskiej ma zamiar zająć się w pierwszej kolejności interesami niemieckimi oraz sprawami dotyczącymi wewnętrznych problemów Unii Europejskiej. Kwestia rozszerzenia zeszła na plan dalszy. Czy jest to słuszna koncepcja - pokaże czas. (shrink)

In contemporary discussions on identity, difference and subjectivity, the thinking of Judith Butler has played a significant role, viewing identity as a problematic question of how the subject is constituted by historical structures of power that deprives it of original ownness and substantiality. As this situation for Butler stems neither from a historical occurrence, nor is clearly ontological, the question of the origin of this problem of identity and power remains. Through the thinking of Martin Heidegger, the present study develops (...) the argument that this problem indicates the completion of subject metaphysics, not its overcoming. When identity is thought and lived in terms of subjectivity, power will be its condition. This argument is first developed through a comparison of Butler’s and Heidegger’s respective appropriations of He-gel’s philosophy, together with an independent account of Hegel’s thinking. For Hegel, identi-ty involves a strive for being as a mediation of subjectivity and objectivity, where conscious-ness incorporates both beyond their split. According to Butler, this is impossible, as subjectivi-ty and objectivity are multiple, temporal and shared. For Heidegger however, the problem lies in the very thought of being as a connection of subjectivity and objectivity, and the under-standing of the human as the ground of this reconciliation. I will thereafter examine Heidegger’s “The Principle of Identity” (1957) as a response to this metaphysical comprehen-sion of identity. Here, Heidegger develops his notion of a belonging-together of man and be-ing, as a Sameness grounded in an enduring of the ontological difference between being and beings. In holding out this difference, man discovers that his primary belonging is that to the very being of his existence as such, rather than beings of subjective or objective kind. The no-tion of belonging-together is closely connected to the notion of the event (Ereignis), signify-ing Sameness as occurrence. The study covers Butler’s central writings up to 2006, Hegel’s Encyclopedia Logic, Science of Logic and Phenomenology of Spirit, as well as the whole of Heidegger’s late thought on this topic from the 30’s and onward together with a selection of his earlier works, among them Being and Time. Our starting point is the question ‘What is mass’, what in particular enables mass to constitute duration: so that mass can be regarded as moving as well as at rest (the kinematic principle of relativity). In a thought experiment, this question is attacked here not from the perspective of mass itself, but from that of a standing light wave. In this model, mass-analogous structures can be re- constructed that can be in relative motion to each other. The (empirically known) constancy (...) of the speed of light in every reference system is not as- sumed here. However, it can be shown that the speed of light is identical in all systems constituted by mass-analogous structures that move uniformly relative to each other and that the speed of light moreover is the limiting speed of mo- tions. Để đạt được các mục tiêu giảm biến đổi khí hậu, bảo vệ môi trường và môi sinh, đồng thời đảm bảo sự phát triển bền vững, cũng như là công lý cho cả con người và thiên nhiên, chính quyền và hệ thống tư pháp cần hiểu rõ bản chất bản chất của các mâu thuẫn dẫn đến cuộc chiến pháp lý về môi trường. Bài viết này có mục đích tìm hiểu bối cảnh phức tạp của các cuộc chiến pháp lý về môi trường, làm sáng tỏ tầm quan trọng và kết quả tiềm tàng của chúng, từ đó chỉ ra một số lỗ hổng pháp lý và khiếu kiện môi trường tại Việt Nam. Hệ quả tất yếu của quá trình tăng trưởng liên tục hơn 4 thập niên là việc sử dụng tài nguyên, và trong quá trình sản xuất, chế tạo, chế biến cũng sản (...) sinh ra một lượng khí nhà kính (GHG) tích lũy khổng lồ phát thải vào khí quyển.
