In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that (...) the principles of legality, proportionality and rationality allow justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios (...) desacuerdos acerca de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Wenn man bedenkt, dass Immanuel Kant die klassischen Gottesbeweise schon als schlechthin falsch zermalmte, ist es nicht verwunderlich, dass Christian Wolffs Religionsphilosophie, die diese Gottesbeweise wiederaufgenommen zu haben scheint, weniger Interesse erweckt hat als zum Beispiel seine Moralphilosophie. Tatsächlich wird Christian Wolffs Theologia naturalis in jüngster Zeit auch als Paradebeispiel für die so genannte „gemäßigte“ Aufklärungsphilosophie angesehen. Denn er suchte nicht nur die Harmonie zwischen vernünftiger Gotteserkenntnis und christlicher Offenbarung nachzuweisen, sondern auch die Vertreter der „radikalen“ Aufklärungsphilosophie zu bekämpfen. (...) Auf der anderen Seite wurde Wolff selbst damals als Feind der christlichen Religion auf die Anklagebank gesetzt, wie Spinoza und Hobbes. Sein Versuch, die Offenbarung zu rechtfertigen, scheint auch mit den aufklärerischen Anforderungen seiner Philosophie widersprüchlich zu sein. Es stellt sich die Frage, ob Wolffs affirmative Stellungnahme zur christlichen Tradition mit seinem autonomen Rationalismus inhaltlich verträglich ist. Angesichts des scheinbar widersprüchlichen Zuges der Philosophie Wolffs und der gegensätzlichen Interpretationen von seiner Philosophie sind Detailstudien vonnöten. In der vorliegenden Arbeit wird versucht, Wolffs Argumentationsstrategie in der natürlichen Theologie und der natürlichen Religion genau zu prüfen, um die Frage beantworten zu können: Wie wendete Christian Wolff seine philosophische Methode auf die Theologie an, um es für möglich zu halten, dass der Gebrauch des Verstandes unbeschränkt wird und zugleich dies der Religion nicht schaden würde? In den vier Kapiteln dieser Arbeit werden der Wunderbeweis, das Verhältnis der natürlichen Religion zur Moral, die Spinozismus-Kritik und der Beweis der Offenbarungsreligion bei Christian Wolff behandelt, da ihm damals vorgeworfen wurde, dass seine Philosophie das biblische Wunder, die natürliche und geoffenbarte Religion abgeschafft und den Weg der Radikalen beschritten hätte. Als Ergebnis wird sich herausstellen, dass der Beweis der Wahrheit der Offenbarungsreligion, um die Begierde der Christen nach dem Naturgesetz zu bestimmen, den roten Faden in Christian Wolffs Lebenswerk ausmacht. Wolffs Argumente für die natürliche und geoffenbarte Religion sind einerseits durchaus vereinbar mit den Forderungen seiner philosophischen Methode. Seine Gegner haben mit Recht in diesen Argumenten das größte Risiko für die Offenbarungsreligion gesehen. Andererseits hat Christian Wolff die Offenbarungsreligion nicht mit einer bloßen apologetischen Absicht verteidigt. Er war davon sehr überzeugt, dass sein System diese minimale Anforderung erfüllen konnte. Ihm lag mehr an der Frage, wie die christlichen Glaubenssätze die Begierde der Christen bestimmen, sodass sie auch nach dem Naturgesetz handeln können. (shrink)

One of the most interesting aspects of Leibniz's philosophy is the distinction between "art" and "nature"; the core of this matter is the possibility (or even the impossibility) of distinguishing as clearly as possible between two ontological domains: on one hand the products of technique (such as "artificial machines"), on the other hand all the beings that can be defined as natural ("natural machines"). This article delves into the mature philosophy of Leibniz, exploring his concepts of life and organism. It aims to establish links between the scientific discoveries of the 17th century and Leibnizian metaphysical assumptions. The paper also highlights how reflections on the Cudworthian system helped the Leipzig philosopher develop his «metaphysics of the organics». The article begins with a brief overview of the querelle sur les natures plastiques to deepen some Leibnizian positions on these topics. It emphasizes Leibniz’s focus on the (...) concept of organism and its fundamental relation and difference with the concept of life. The article also addresses the notion of «nested individuality» and plural individuality in the philosopher’s writings, attempting to determine if such concepts exist. The solution to the coexistence of plural organisms within an organism provided here is mereological. Lastly, the article gathers current research results to demonstrate how the «organism» in the Leibnizian system of maturity is like a fold, leading readers toward different aspects of his metaphysics. Se examina la defensa que de la filosofía en cuanto episteme, elaboró el aristotélico renacentista Cesare Cremonini (1550-1 631), al introducir el curso de lecciones sobre la Física de Aristóteles, según la redacci6n todavía inédita del Ms.200-2 de la Biblioteca Universitaria de Padua. Mediante un topos ya clásico, y actual, los temas en discusión son además de la falta de certitudo y la inconsistencia veritativa que afectan las conclusiones de la filosofía de la naturaleza, la inutilidad e incluso la peligrosidad (...) que, desde el punto de vista ético- político, parecen descalificar la labor del filósofo ociosamente levantar sospechas y alarma. La interpretación de la réplica cremoniniana intenta establecer conexiones entre el perfil conceptual de los argumentos esgrimidos, y algunos episodios de la biografía intelectual y académica de Crernonini sin dejar de tomar en cuenca las implicaciones políticas que pueden derivarse, en perspectiva histórica, del amplio debate que caracterizó la vida académica y cultural del estudio de Padua y de la república veneciana, durante la segunda mitad del siglo XVI.The defence of philosophy as episteme is examined, as elaborated by Renaissance Aristotelian philosopher Cesare Cremonini (1550 - 1 631) in his as yet unpublished manuscript numbered 200-2 by t he University of Padua. Which purported to be an introduction for a course on Aristotle's Physics. Following a topos both classic and contemporary, the issues arc, in addition to the lack of certitudet and the inconsistency of truth concerning the philosophy of nature. The uselessness and even the ethical-political danger arising from the work of the idle philosopher devoted to the contemplation of truth, whose presence in society may stir suspicion and unrest. The analysis of Cremonini’s arguments intends to establish the connections between the philosopher's views and his own academic and intellectual circumstances. Also the political implications are taken into account that resulted from the wide-range debate typical of academic and cultural life in the Studio of Padua and the Republic of Venice during the second half of the 16th Century. Seit Beginn der frühen Neuzeit ist das naturwissenschaftliche Verfahren maßgeblich durch ein neues Konzept geprägt: das Konzept des experimentellen, gestalterischen Eingriffs in die Natur. Es geht nun nicht mehr darum, eine Geschichte der "freien und ungebundenen Natur" (Bacon) zu erzählen, die in ihrem eigenen Lauf belassen und als vollkommene Bildung betrachtet wird. Es geht vielmehr darum, der "gebundenen und bezwungenen Natur" (Bacon) vermittels der experimentellen Tätigkeit des Menschen die Geheimnisse zu entreißen. Diese technisch-praktische Konzeption grenzt sich explizit von den klassischen (...) kontemplativen Wissenschaftsvorstellungen der Antike ab. Wie es Kant paradigmatisch in Bezug auf Bacon formuliert hat, ist diese "Revolution der Denkart" maßgeblich durch ein gewandeltes Verständnis des Verhältnisses des Menschen zur Natur geprägt. Der Mensch als Experimentator hat für Kant nicht mehr die "Qualität eines Schülers", der sich passiv von der Natur belehren läßt und an ihrem "Leitbande" (Kant) gegängelt wird. Seine neu gewonnene Autorität verleiht ihm vielmehr den Status eines Richters, der nun die Natur nötigen kann, auf gestellte Fragen zu antworten. Die Laborforschung der modernen Naturwissenschaft ist von den Formen der alten Naturwissenschaft so weit entfernt, daß sie den Vorwurf auf sich zog, sie untersuche Artekakte, aber nicht Natur. Die grundlegenden Theorien über Natur können in der Regel nur unter den künstlichen Bedingungen des Labors aufgestellt werden. Daraus darf aber nicht geschlossen werden, die anhand von Laborphänomenen aufgestellten und getesteten Theorien handelten nicht von der Natur außerhalb der Labore. Aber ihrer exakten und detaillierten Anwendung auf Prozesse außerhalb der Labore stehen eine Fülle von Schwierigkeiten entgegen. Insofern markiert das Labor sehr wohl eine Grenze exakter Naturforschung, die für den Umgang der wissenschaftlich-technischen Zivilisation mit der Natur wichtige Konsequenzen hat. Aristóteles ha sido considerado como el más grande biólogo de la antigüedad clásica, el primer zoólogo y el fundador de la anatomía comparada. En el presente ensayo examinaremos en qué medida el modelo normativo estipulado en los tratados lógicos se conforma a la recogida de datos empíricos presente en los tratados biológicos. En la segunda parte de la investigación examinaremos cómo los tratados lógicos habrían condicionado la explicación del funcionamiento del cerebro, llevando a Aristóteles a cometer un “error escandaloso”.

In den Elementa juris naturalis behauptet Leibniz, dass es rational ist zu präsumieren, dass eine gegebene Handlung gerecht ist. Diese Behauptung scheint in Widerspruch zu seiner Auffassung zu stehen, dass das, was präsumiert wird, einfacher ist als sein Gegenteil. Nach Leibniz ist einfacher, was weniger Voraussetzungen hat als etwas anderes, wobei er zwischen logischen und ontologischen Voraussetzungen unterscheidet. Dieser Diskussionsbeitrag versucht zu zeigen, dass Voraussetzungen auf der ontologischen Ebene eine oft übersehene Rolle für die Präsumption der Gerechtigkeit einer Handlung (...) spielen und dass sich der scheinbare Widerspruch auf dieser Ebene auflösen lässt. Nach Leibniz ist eine gerechte Handlung eine spezielle Art von Möglichkeit: eine Handlung, die für eine moralische Person möglich ist. Ihm zufolge hat aber ein mögliches Ereignis weniger ontologische Voraussetzungen als ein unmögliches Ereignis, weil die ontologischen Voraussetzungen eines möglichen Ereignisses ein Teil der Voraussetzungen eines unmöglichen Ereignisses sind. Die Präsumption zu Gunsten der Gerechtigkeit einer Handlung lässt sich als Spezialfall der Präsumption zu Gunsten der Möglichkeit eines Ereignisses auffassen. (shrink)

Il problema apparentemente insolubile di una giustificazione non circolare dell’induzione diverrebbe più abbordabile se invece di chiederci solo cosa ci assicura che un fenomeno osservato si riprodurrà in modo uguale in un numero potenzialmente infinito di casi futuri, ci chiedessimo anche come si spiega che esso si sia manifestato fin qui in modo identico e senza eccezioni in un numero di casi finito ma assai alto. E’ questa l’idea della giustificazione abduttiva dell’induzione, avanzata in forme diverse da Armstrong, Foster e (...) BonJour: serie talmente regolari di fenomeni sono da un punto di vista logico talmente improbabili che se il mondo fosse puramente casuale (se cioè gli eventi si presentassero con frequenza proporzionale alla loro probabilità logica) esse non potrebbero verificarsi se non per una coincidenza miracolosa. Pertanto, tali regolarità si spiegano solo assumendo che siano prodotte da meccanismi o necessità nomiche; ma se questo è il caso, è corretto concludere che tali regolarità persisteranno anche in futuro senza eccezioni, e dunque le inferenze induttive su di esse sono giustificate. Anche Kornblith argomenta dall’effettivo successo delle inferenze induttive all’esistenza di regolarità oggettive in natura; mentre Sankey parte dall’ uniformità della natura per giustificare l’induzione. Congiungendo le due argomentazioni, dunque, si ottiene di nuovo una giustificazione dell’induzione in base all’argomento del “se non è un miracolo …”. Un ostacolo su questa via è specificare in che senso la natura sia uniforme (dato che ovviamente non lo è in ogni suo aspetto) e di quali regolarità possiamo aspettarci che persistano senza eccezione anche in futuro (dato che evidentemente non tutte lo fanno: l’acqua non bolle sempre a 100°, la pressione non è sempre funzione della temperatura, e così via). Entrano qui in gioco le conoscenze di sfondo e la ripetizione delle osservazioni in condizioni diverse, che ci mostrano quali circostanze siano rilevanti al verificarsi del fenomeno dato. In tal modo, le nostre descrizioni delle regolarità naturali convergono su descrizioni che specificano sia le condizioni individualmente necessarie e congiuntamente sufficienti, sia tutti gli argomenti delle funzioni che costituiscono tali regolarità. Ciò consente di formulare i principi di Uniformità della Natura e di Induzione in modo non generico (e dunque, a seconda della formulazione, vuoto o eccessivo), ma circostanziato: così essi asseriscono, rispettivamente, che la natura è uniforme negli aspetti evidenziati dalle descrizioni su cui convergiamo grazie alle osservazioni ripetute, e che solo queste descrizioni possono essere induttivamente generalizzate. Ciò consente anche di risolvere enigmi alla Goodman, quali: poiché le osservazioni ci hanno mostrato (solo) il verificarsi di una data regolarità fino al momento presente t, come possiamo presumere che essa si verificherà anche dopo t? La risposta è che osservazioni e conoscenza di sfondo non ci dicono che vi sia alcun limite temporale tra le condizioni necessarie della regolarità data. (shrink)

Fizik disiplininde astronomiye yönelik sorular Johannes Kepler (1571-1630) ve Isaac Newton (1643-1727) gibi fizik alanında devrim yaratan düşüncelerin ortaya çıkmasına yol açmıştır. Kepler ‘Yeni Astronomi’ (Astronomia Nova), ‘Dünya'nın Uyumu’ (Harmonice Mundi) ve ‘Kopernik Astronomisinin Özeti’ (Epitome Astronomiae Copernicanae) adlı çalışmalarından hareketle ileri sürdüğü gezegensel hareket yasaları, Newton ise 1687 yılında yayımlanan ‘Doğa Felsefesinin Matematiksel İlkeleri’ (Philosophiae Naturalis Principia Mathematica) isimli çalışmasında yer verdiği hareket yasaları ile fizik disiplininde Aristoteles fiziğinin terk edilerek yeni bir fizik anlayışının ortaya çıkmasına ve böylece (...) fizik alanında bir devrimin meydana gelmesine sebep olmuşlardır. Fizik disiplininde gerçekleşen bu devrimin bir benzeri ise canlıların çalışılması ya da biyoloji disiplini söz konusu olduğunda 1800’lerden biraz daha geç bir zamana rastlamaktadır. Biyolojide gerçekleşen devrimsel düşünce doğal seçilim mekanizması ile canlılarda zaman içerisinde gerçekleşen değişim ve dönüşüm sürecini açıklayan Charles Darwin’in evrim kuramına yönelik görüşlerini ortaya koymasına tekabül etmektedir. Bu kapsamda çalışmada öncelikli olarak canlılarda meydana gelen değişim süreçlerine yönelik tespitleri ile Darwin’in görüşlerinin olgunlaşmasına katkıda bulunan Fransız Transformistler (Dönüşümcüler) olarak da bilinen Georges-Louis Leclerc (Comte de Buffon), Jean-Baptiste Lamarck ve George Cuvier’in görüşlerine yer verilmektedir. Ardından bu bilim insanlarının canlılardaki dönüşümsel ya da evrimsel değişime ilişkin argümanlarının Darwin’in evrim kuramını nasıl etkilediği ve bu etkilerin sonucunda biyoloji biliminde nasıl bir devrimin ortaya çıkmasına yardımcı oldukları aktarılmakta ve bu çerçevede Darwin’in on dokuzuncu yüzyılda biyoloji biliminde devrime yol açan tespitlerine ve evrim kuramının ayrıntılarına yer verilmektedir. Tra i numerosi autori attivi nel campo delle scienze naturali che Friedrich Nietzsche ebbe modo di conoscere nel corso della propria vita, Ernst Mach rappresenta certamente un caso significativo. La sua presenza all'interno degli scritti del filosofo è pressoché nulla, ma la comunanza dei temi trattati e la particolare affinità delle prospettive adottate in materia di teoria della conoscenza invitano ad avvicinare questi due autori e a ipotizzare un qualche tipo di influsso diretto tra loro. Ciononostante, fino ad oggi non (...) era mai stato svolto uno studio critico e completo che esaminasse e discutesse tale relazione. Muovendo dai contenuti di una delle principali opere di Mach, i "Beiträge zur Analyse der Empfindungen" (1886) questo volume delinea un quadro esegetico che fa di Mach non tanto un referente diretto, quanto piuttosto il segnale di una prospettiva di ricerca che in qualche modo stimolò l'interesse di Nietzsche e che per molti aspetti egli mostra di condividere. Le controversie nosologiche in psichiatria siano orientate da ragioni sia epistemiche che non epistemiche, da questioni di evidenza ma anche di etica e sociologia della scienza, data la presenza di vari programmi di ricerca, di metodologie e anche di agenti differenti che si focalizzano sul problema del disturbo mentale. I due casi qui brevemente considerati, quello della Disposofobia e quello del Disturbo di personalità narcisistica mostrano, assieme al ruolo dell’evidenza empirica, da un lato il peso delle ragioni etiche dei gruppi (...) di pazienti e di quelle culturali della società allargata, dall’altro le dinamiche del consenso tra esperti. Che i disturbi mentali siano o non siano generi naturali, la loro classificazione è un processo razionale complesso che comprende norme e deviazioni dalle norme di diverso tipo. (shrink)

When Newton articulated the concept of absolute time in his treatise, Philosophae Naturalis Principia Mathematica (Mathematical Principles of Natural Philosophy), along with its correlate, absolute space, he did not present it as anything controversial. Whereas his references to attraction are accompanied by the self- protective caveats that typically signal an expectation of censure, the Scholium following Principia’s definitions is free of such remarks, instead elaborating his ideas as clarifications of concepts that, in some manner, we already possess. This is (...) not surprising. The germ of the concept emerged naturally from astronomers’ findings, and variants of it had already been formulated by other seventeenth century thinkers. Thus the novelty of Newton’s absolute time lay mainly in the use to which he put it. (shrink)

The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. Our final words will discuss deontic-modal parallelism in the context of Ibn Ḥazm’s rejection of reasoning by conjecture and what we call “the internalization of nature.”. (shrink)

Newton frequently characterized his methodology as distinctive and capable of achieving greater evidential support than that of his contemporaries, due to its mathematical character. Newton's pronouncements reflect a striking position regarding the role of mathematics in natural philosophy. We can give an initial characterization of his position by considering two questions central to seventeenth century debates about the applicability of mathematics. First, how are we to understand the distinctive universality and necessity of mathematical reasoning? One common way to preserve the (...) demonstrative character of mathematics was to restrict its domain, as far as possible, to pure abstractions. The subject matter of mathematics is then taken to be abstracted from the changeable natural world, consisting of quantity and magnitude themselves rather than the objects bearing quantifiable properties. Yet restricting the domain in this way leaves it difficult to see how mathematics relates to natural phenomena. How could the book of nature be written in a language of pure abstractions? Second, what is the proper role of mathematical reasoning in natural philosophy? Many followed Aristotle in consigning mathematics to a subordinate role. Mathematics could not fulfill the main aim of natural philosophy, namely to provide demonstrations reflecting the essences of things and nature's causal order. A related concern was also pressing for the mechanical philosophers: a merely mathematical demonstration fails to provide an intelligible mechanical explanation. The very title of Newton's masterpiece, Philosophiae Naturalis Principia Mathematica, would have been extremely perplexing: how could natural philosophy be based on mathematical principles? My aim is to articulate Newton's position regarding the mathematization of nature in response to these two concerns. (shrink)

The content of Boscovich’s Theoria philosophiae naturalis was well-known to his contemporaries, but both scientists and philosophers chiefly discussed it during the 19th century. The observations that Boscovich presented in this text, and that he himself defined as “philosophicas metitationes”, soon showed their being a good programme for the forthcoming atomic physics, and contributed to get rid of the mechanistic paradigm in science. In this paper I’ll go back to some meaningful moments of the history of Boscovich’s reception in (...) the era of contemporary philosophy, by referring to what authors such as Popper, Cassirer, Nietzsche and Fechner wrote about him. These thinkers, indeed, particularly stressed the importance of the Theoria in the history of Western thought, and showed that it can easily be evaluated beyond the plane of a pure scientific investigation. Negli ultimi quindici anni la letteratura filosofico-linguistica ha registrato un rinnovato interesse per i meccanismi di implicatura, specialmente del tipo scalare. In buona parte, l’interesse stato suscitato dall’emergere di una prospettiva grammaticale, secondo la quale i fenomeni di implicatura scalare sarebbero conseguenza di un meccanismo interpretativo incassato nella logica delle lingue naturali, e quindi riferibile al componente semantico dell’architettura cognitiva umana. L’obiettivo di questo testo fornire una presentazione di alcuni tra gli argomenti che hanno motivato l’emergere della prospettiva grammaticale. Inizieremo, (...) con una descrizione del fenomeno di implicatura scalare, sostanzialmente condivisa dai fautori delle diverse prospettive. Quindi, approfondiremo la nostra comprensione del fenomeno, pre- sentando alcuni punti fermi della prospettiva pragmaticista, e mostrandone i punti di debolezza individuati dai fautori della prospettiva grammaticale. Infine, presenteremo la prospettiva grammaticale, presentando da una parte i vantaggi che questo approccio presenta rispetto alla prospettiva pragmaticista, e dall’altra discutendo le sfide che attendono questa nuova prospettiva. In the last decade, awareness has grown that global warming, overpopulation and the destruction of natural habitats are destroying biodiversity. The consequences of this phenomenon have also been extensively discussed in the literature, from vulnerability to natural disasters to the availability and quality of food and water resources. Less attention has been paid to another phenomenon of no less shocking significance for our lives: the loss of cultural diversity which is affecting the human sphere, including the ways of living and (...) thinking, the languages and visions of the world, the knowledge and the traditions. This essay documents this phenomenon and considers its negative effects on the preservation of the heritage of traditions and on the expansion of opportunities for innovation. -/- ABSTRACT (ITA) Nell’ultimo decennio è cresciuta la consapevolezza che il riscaldamento globale, la sovrappopolazione e la distruzione degli habitat naturali stanno distruggendo la biodiversità. Sono state anche ampiamente discusse in letteratura le conseguenze di questo fenomeno, dalla vulnerabilità ai disastri naturali, sino alla disponibilità e alla qualità delle risorse alimentari e idriche. Minore attenzione è stata riservata a un altro fenomeno di portata non meno sconvolgente per le nostre vite: la perdita di diversità culturale che riguarda la sfera umana, comprendendo i modi di vivere e di pensare, i linguaggi e le visioni del mondo, ma anche le conoscenze e le tradizioni, nonché le specificità locali. In questo articolo si documenta questo fenomeno e se ne indicano i riflessi negativi sulla conservazione del patrimonio delle tradizioni e sull’ampiamento delle opportunità di innovazione. (shrink)

The question about evolution of consciousness has been addressed so far as possible selectional advantage related to consciousness ("What evolutionary advantages, if any, being conscious might confer on an organism ? "). But evidencing an adaptative explanation of consciousness has proven to be very difficult. Reason for that being the complexity of consciousness. We take here a different approach on subject by looking at possible selectional advantages related to the performance of Self Awareness that appeared during evolution millions of years (...) before consciousness as we know it for humans. The interest of such an approach is that the analysis of selectional advantage is done at an evolution step sigificantly simpler that the step of Human Consciousness. We analyse how evolutionary advantages have resulted from this specific Self Awareness step. This is done by taking into consideration the possibility for a subject to identify with a conspecific at this level of evolution. We use the results made available by Mirror Neuron researchs where intersubjectivity and some level of identification with conspecifics have been evidenced for non human primates. Selectional advantages related to Self Awareness are analysed two ways: - Reformulating the performances of imitation and of development of language. - Showing that Self Awareness within group life can naturaly produce an important increase in fear/anxiety for a subject, and that the means implemented by the subject to overcome this fear/anxiety can act as significant evolution advantages opening the road to Human Consciousness. Such approach brings new elements supporting the view that consciousness is grounded in emotions. It also proposes some more evolutionist explanations to the widely dicussed subject of Empathy (S. Preston & F. de Waal) in terms of specific behaviour implemented to limit fear/anxiety increase. This approach also provides some explanation for limited anxiety within dolphins and introduces a basis for a possible phylogenesis of emotions. (shrink)

Nell’analisi, la stipulazione di una pragmatica musicale segue strettamente recenti proposte presentate in ambito semantico, in cui si illustrano le potenziali virtù rappresentazionali delle strutture musicali. In particolare, in questa nota si suggerisce la presenza di strategie di ricostruzione dei significati musicali le quali intervengono a prevenire la realizzazione di contenuti semantici contraddittori. L’evidenza utilizzata è ricavata da alcune misure del madrigale primo del II libro dei (...) madrigali di Monteverdi (1590), e dal testo (di T. Tasso) che le accompagna; sviluppi dell’analisi qui proposta dovranno fondarsi su evidenze indipendenti e auspicabilmente naturali. (shrink)

Nel campo delle scienze cognitive molti oggi condividono l’ipotesi che siano necessari differenti tipi di rappresentazioni per modellare i sistemi cognitivi sia naturali, sia artificiali. Si considerino le rappresentazioni basate su reti neurali, i formalismi simbolici e rappresentazioni analogiche quali rappresentazioni diagrammatiche o modelli mentali. Tutti questi metodi hanno successo nello spiegare e modellare alcune classi di fenomeni cognitivi, ma nessuno è in grado di rendere conto di tutti gli aspetti della cognizione. A partire da queste considerazioni, riteniamo che sistemi (...) intelligenti e architetture cognitive possano trarre vantaggio dalla combinazione di sistemi di rappresentazione diversi. Si pone allora il problema di fare interagire rappresentazioni di natura differente in maniera cognitivamente e teoricamente fondata. La nostra ipotesi è che gli spazi concettuali possano offrire una sorta di lingua comune, che consentirebbe di integrare e generalizzare molti aspetti delle impostazioni sopra menzionate, superando i limiti delle varie proposte intese singolarmente. Le argomentazioni presentate in questo volume costituiscono il primo contributo dell’autore al progettato compito di un’analisi e commento completi e puntuali dei principali testi filosofici di Giordano Bruno. Iniziando con il "De umbris idearum" e procedendo con le prime opere in latino, l’autore intende svelare le basi teoretiche della prima speculazione bruniana, destinate ad essere riprese, ampliate ed approfondite nei testi successivi, i "Dialoghi Italiani", così come, in una originale prospettiva atomistica, in quelli latini delle ultime fasi. Il "De umbris (...) idearum" costituisce in questa prospettiva il testo base della difficile e complessa speculazione bruniana: assolutamente lontano – come del resto indicato dalle esplicite affermazioni del filosofo di Nola – dall’impiego pragmatico e retorico della tradizionale arte della memoria, esso piuttosto costruisce progressivamente uno spazio di riflessione di natura ontologica, metafisica e teologica, con influssi sulle considerazioni razionali e naturali. In questo modo l’arte di memoria bruniana diventa la memoria di un arte filosofica civile, la necessità del ricordo di una possibilità del pensiero e della prassi incardinata sulla presenza di un plesso centrale creativo e dialettico, che progressivamente consente l’inserimento della principale innovazione escogitata dalla filosofia bruniana: il concetto dell’infinito. Direttamente tematizzato nei dialoghi in italiano, il concetto creativo e dialettico dell’infinito bruniano separa progressivamente l’autore nolano dalla tradizione neoplatonico-aristotelica, definendo in tal modo uno schema interpretativo della realtà diverso ed opposto rispetto a quello che – oltre l’apparente rivoluzionarietà della scienza moderna – ha innervato i principali sviluppi della civiltà occidentale moderna e contemporanea. Books that required enormous sacrifices, which had been a reason for living for their authors and, at the same time, the source of a thousand dangers. Giovan Battista Della Porta's “Magia Naturalis” was one of the most widespread texts between the 16th and 17th centuries. Le texte est conservé dans le codex Cusanus 106 à Bernkastel-Kues et représente un des très rares traités de métaphysique écrit durant le Moyen Âge latin indépendamment de la tradition des commentaires à Aristote. Le Colliget cherche, de manière originale, à combiner l’idée d’une science de (...) tout connaissable, reprise de Raymond Lulle, avec la tradition métaphysique aristotélicienne et sa réinterprétation par Albert le Grand. The search for an agreement between Aristotle’s and Descartes’ philosophy was aimed at making Cartesian physics acceptable in the Dutch universities by showing its consistency with Aristotelian thought. Their agreement is defended by Johannes De Raey in the Clavis philosophiae naturalis (1654), where he interprets the Corpus Aristotelicum from a Cartesian standpoint. Those Aristotelian positions which are inconsistent with Descartes’ are treated as erroneous. The Scholastic positions, moreover, are considered as distant from the true Aristotelian philosophy rediscovered by Descartes.

Theories have been formulated to address the problem of evil [“The concept of Evil”. Stanford Encyclopedia of Philosophy]. We look here at a possible origin of human evil in pre-human times by using an evolutionary scenario for self-consciousness based on identifications with conspecifics [“Proposal for an evolutionary approach to self-consciousness”. Menant 2014]. The key point is that these identifications have also taken place with suffering or endangered conspecifics, thus creating in the minds of our ancestors a huge anxiety increase, a (...) mental pain unbearable if not limited. To limit it our ancestors could have reduced the sufferings and dangers, or reduced the identification, or limited the conspecificity. Reducing the sufferings and dangers was straightforward as it also brought in evolutionary advantages (collaboration, imitation, communication, ToM, ...), with some pleasant feeling coming with the reduction of anxiety. But the two other possibilities may have produced very different outcomes. Reducing the identifications and limiting the conspecificity did reduce the mental pain and correspondingly produce some pleasure. But it has also lowered the emotional attachment to conspecifics as well as the care given to them. Conspecifics were then left alone with their sufferings. And as the process led to less mental pain, our ancestor were naturaly led to associate some pleasure to these sufferings of conspecifics. All this may have introduced in the mind of our ancestors the possibility to reduce anxiety and mental pains also by accepting and valorizing the sufferings of others, thus making evil deeds a potential source of pleasure. We propose these mechanisms as possible sources of psychology of evil in human evolution. These mechanisms now belong to our human nature where evil projects can become a means for limiting the unconscious anxiety present in our human minds. Such positioning of self-consciousness and human evil under a common evolutionary nature is new and needs more developments. Continuations are proposed. (shrink)

L’analisi dei principali temi della filosofia di Nietzsche conduce all’individuazione della nozione di forza come elemento centrale delle sue riflessioni. Egli la incorpora ed utilizza filosoficamente, in periodi diversi, per la definizione di teorie centrali quali l’eterno ritorno, la volontà di potenza e il prospettivismo conoscitivo. L’assimilazione di questa nozione – come è stato osservato in passato – può essere riportata alla sua lettura nel 1873 della Theoria philosophiae naturalis del matematico Ruggero Boscovich. Attraverso una dettagliata analisi del materiale (...) postumo oltre che del contesto delle discussioni scientifiche dell’epoca, questo studio si propone di chiarire nella maniera più esaustiva fino a che punto il sistema di Boscovich e, più in generale, la visione dinamica del mondo in esso delineata abbiano influito sul pensiero nietzscheano, con la precisa finalità di restituire nella sua complessità il rapporto di Nietzsche con questa figura. The topic of disinterested love became fashionable in 1697 due to the famous amour pur dispute between Fénelon (1651-1715) and Bossuet (1627-1704). It soon attracted the attention of Electress Sophie of Hanover (1630-1714) and she asked for an opinion about the dispute from her trusted friend and correspondent, the Hanoverian councilor Gottfried Wilhelm Leibniz (1646-1716). This gave Leibniz an opportunity to present his views on the matter, which he had developed earlier in his career (for example, in Elementa juris (...) class='Hi'>naturalis of 1671 and Codex iuris gentium of 1693). In his 1697 letter to Sophie he did not explicitly take sides in the dispute, but formulated his own views on the topic in a theological manner, aiming to provide an account of disinterested love which would surpass the doctrines of both French theologians. In addition to presenting Leibniz’ early views on disinterested love and examining this alternative formulation of his views on love, I will show that after the letter Leibniz gave this alternative perspective up and returned to his earlier, more philosophical views on the topic, which suggests that he regarded them to be superior to the theological version, where the virtue of charity was related to the virtue of hope. La naturalisation prend la forme chez Bunge d’une naturalisation de la pensée générale qui permet de remplacer le discours général philosophique par le discours général scientifique. Finalement, cette naturalisation du (...) discours général ne doit pas être confondue avec les projets de naturalisation de la philo-sophie, notamment un des projets de la métaphysique scientifique ou naturali-sée connu sous le nom de réalisme structurel ontique. PHILOSOPHY OF HUMAN RIGHTS: HUMAN RIGHTS IN LIGHT OF THEIR INTERNATIONAL PROTECTION Summary The book consists of two main parts: in the first, on the basis of an analysis of international law, elements of the contemporary conception of human rights and its positive legal protection are identified; in the second - in light of the first part -a philosophical theory of law based on the tradition leading from Plato, Aristotle, and St. Thomas Aquinas is constructed. The conclusion contains an application (...) of the results of the analysis conducted in the second part. The first part comprises four chapters. The first aims at revealing characteristics of human rights on the basis of an analysis of historical conditioning of the inter-national law of human rights and its development. The historical context displays the practical, vindicative, and critical character of the positive legal protection of human rights. Moreover, the process of change of positive human rights law is distinguished from the process of change of human rights as such. In the second chapter the content of human rights - a topic which is only auxiliary to the conducted analysis - is discussed. Basic typology and catalogues of rights proclaimed in the Universal Declaration of Human Rights and protected in the International Covenants of Human Rights are presented. The review of the content of rights aims at a more precise limitation of the field of research. The examination shows a diversity of rights which poses a serious challenge to the coherence of every philosophical theory of human rights. In the third chapter, central in the first part, international law is analyzed with regard to the characteristics of rights and the foundations of them. The analysis of documents shows a number of solutions referring to the anthropological foundations of rights. The inherent dignity of the human person is the source of all human rights. Each human being is recognized as free, and endowed with both reason and conscience. In the propounded conception of man individuals are not rivals but create a community which is a condition for their development. International law characterizes the rights as universal, inherent, inalienable and inviolable. The reconstructed conception also comprises the following basic elements: on the level of the structure of rights, a recognition of their equality, interdependence, and comprehensiveness; in the grounding of these rights, a recognition of the anthropological foundations of law; in the conception of positive law, a recognition of the secondariness of the positive law of human rights to human rights themselves, and a recognition of human rights and justice as the basis for legal order; in the conception of state, a recognition of the well-being of the individual as the fundamental aim of actions undertaken by political institutions, and recogni¬tion of rights which form an impassable boundary to the power of the state, includ¬ing its legislative actions. The characterization of the international legal paradigm serving for the under¬standing of human rights is supplemented by analyses of the structure of their posi¬tive legal protection. Various meanings of the terms "right" and "freedom" are distinguished. Subjective right, as basic structure of the positive legal protection of human rights, is understood as a complex relation formed by various legal situations of the subject of a right which create a functional whole in respect of the subordi-nation of human person to its good. Subordinating person to a good proper for it, expressed usually in a proclamatory norm, is the central element of particular rights around which further elements aiming at the realization of this good are built. In the second part of the book a philosophical theory is developed which allows for the location of a coherent foundation for the presented characterization of human rights and their positive legal protection. This part consists of two chapters. The first includes a review of some - not entirely satisfactory - means of founding of human rights; the second presents philosophical conceptions of law and man which may form a basis for the constructed theory. The review of arguments contained in the first chapter does not aim at a detailed analysis of various specific ways of argumentation encountered in works on this subject but rather at a concise presentation of the main possible lines of argumentation. These analyses also serve to emphasize the positive solutions which are pro¬posed later and to underscore the explanatory power of the elaborated theory. This theory, retaining accurate intuitions contained in the presented types of argumenta¬tion, helps in avoiding their consequences which are difficult to reconcile with the reconstructed paradigm of human rights. Efforts to base human rights on the norms of international law rightly take into account the necessity of determining the content of the rights and their positive legal protection as a means for the realization of man's good. These attempts, how¬ever, do not properly take into account the inherent character of human rights, which are independent of positive law and provide grounds for applying specific legislative measures and not others. Founding human rights on freedom accurately points at the freedom of an indi¬vidual as a constitutive element of some rights; however, absolutization of freedom leads, to a loss of an important element of the contemporary paradigm of under¬standing human rights. This foundation undermines recognition of the fact that human rights may set limits to both the freedom of others and the freedom of the subject of rights itself. Additionally, attempts at the so-called axiological justification of human rights are discussed. This type of justification has a few variants depending on the as¬sumed conception of value. Subjectivistic conceptions have similar advantages and disadvantages to the conceptions basing human rights on freedom; objectivistic conceptions while providing for the universality of human rights place, the fundamental aim of human rights protection beyond the individual human being - in the idealistically existing world of values; finally, conceptions rooting values and human rights in culture, while accurately noting that human rights are learned through the medium of culture, place the source of human rights beyond a concrete individual - in culture and processes which take place in it - which leads to difficulties in finding a basis for the universality of rights. Furthermore, attempts to ground human rights in specific characteristics of the human being are presented. This type of approach points to an important problem of dependence of the content of rights on what man is. However, recognition of specific characteristics of a human being as an ontic foundation of the existence of rights poses a danger to their universality since one has to accept that it is not enough to be a man to be a subject of rights, but a man possessing specific charac¬teristics. The second chapter aims at outlining solutions worked out by Saint Thomas Aquinas. For a fuller understanding of his propositions selected elements of Plato's and Aristotle's philosophy are presented. It was them who formulated the founda¬tions for reflection on law and justice in the ontological context. A qualification is made that Stoicism is not be analysed in depth. Although Thomas' concept of law was undoubtedly developed under the influence of the Stoic doctrine as well, it is not in this that one should look for the tools to understand the ontic foundations of human rights and law in general since the Stoic moral philosophy and philosophy of law were developed in the context of a theory of being which assumed monistic and pantheistic premises as foundations, leading to the recognition of a total subor¬dination of the human individual to a larger unity of which man is only a part. The analysis of Plato's and Aristotle's texts concentrates on problems of justice. Plato seems to be the first philosopher who reflected on the formula basic in the history of European thought: to render to each his due. It appears that justice as both a characteristic of man and his acts is understood in the perspective of that which is just, that which is a good for another man - the recipient of the act. The basis for determining what is just is the relation of correspondence between some¬one and something. While in the case of Plato this relation is based on something beyond its terms, namely on ideas, in the case of Aristotle the relation occurs on account of the elements of the relation itself. Something is just when it contributes to the develop¬ment of the recipient of an act realizing that which is just. At the same time, the realization of that which is just is a good for the agent. In the analysis of the just two types of relation are revealed: the relation of due-to-recipient occurring on account of the compatibility of that which is due, with the recipient of the act; and - a "superstructure" - a relation of obligation-of-subject occurring on account of the compatibility of the acting subject with the thing which should be done. The basis for being that which is due is formed by various potentialities of development of man - the recipient of agency; the basis of being that which is an obligation is the possibility of development of the subject of action. Aristotle distinguishes various types of freedom and points to the necessity of taking them into account in the discussion of justice. Among other things, as the core of man's freedom, he considers life for its own sake, which can be seen as his expression of the basic indices of the autotelic character of man - which is funda¬mental for later conceptions of dignity. The freedom which is described by him is not, however, inherent and inalienable; being free is conditioned by a factual possi¬bility of undertaking actions, which are not solely means to the realization of aims set by others. Thomas Aquinas takes over the Aristotelian research perspective both in his conception of man and of law. At the same time, however, he significantly enriches it. In anthropology he develops a conception of personal being. Drawing upon his distinction between existence ("that something is") and essence ("what something is"), he sees the basis for being a person in the dignity of personal being which is a certain way of existence of a rational being more perfect than that of non-personal beings. The person is a being which, by virtue of its act of existence, is individual¬ized in a specific way. It is an aim in itself. Expressing it in a negative way, one may say that it does not exist as a means for the realization of the aims of others and, in this sense, that it is free. As distinct from Aristotelian conclusions, being a person is not conditioned by the specific actions of a being. Dignity is inherent, based on that which is the foundation of the factual existence of every rational being. Although freedom requires that a being is rational, dignity still encompasses all being, all its properties and potentialities. Thus an act conforming with dignity has to take into account a whole human being. Among different types of that which is just, ius, the first place, from the point of view of understanding law, falls to "the just thing itself ("ipsa res justa"), which is right in the full meaning of the word. On the one hand, it is that which is due; on the other hand, it determines the way of acting in the utmost degree, since the course of every act is determined in the fullest extent by its aim. The content of ius may be determined both by elements independent of free decisions - ius naturale - and by free decisions taking into account the state of things - ius positivum. Recognition of the objective structure of being as the basis of law does not entail that it is possible or desirable to determine unequivocally "the only right" patterns of conduct. This concept is very well justified within the system proposed by Saint Thomas. Individualization of being is a significant element of the develop¬ment of a person as a person. It is attained by the realization of individual aims which are not unequivocally determined by circumstances and the nature common to all people. By virtue of free choices made in the sphere of that which is not by its nature unjust, the object of action becomes ius. Since in the realization of the person the individualization of human being is central, Aquinas clearly sees the need for the protection of the sphere of "dominion of will". This sphere itself constitutes ius naturale, something which is due to man independently of the acts of will. Therefore "law should forbid nothing which is not unjust" ("nihil debet lege prohiberi quod licite fieri potest", In 3 Sent., dist. 40, q. I, a. 1, 3). Besides the relation of due-to-recipient, ius also includes the relation of obligation-of-subject which is superimposed on the relation of due-to-recipient. As far as the ontic foundations of obligation are concerned, in explaining why man is subordinated to realization of the good of others, Aquinas generally follows Aristotle in accepting that this basis is the subordination to moral good - to actions conforming with the learned truth about reality. Aquinas' systemic solutions allow, however, to reach deeper and understand why moral development is also a development of the whole human being. This was difficult within Aristotle's system, since he was reluc¬tant to decide whether precedence should be given to intellectual or moral develop¬ment. The inclination to realise good of another appears to be a transcendental characteristic of being, based on its very existence. Morality understood as rational and free subordination to realize the good of another is a specifically personal way of the realization of this inclination. Thus just actions contribute to the actualization of being in the aspect of its existence and therefore to the actualization of being as a whole. Thomas' conception of natural law (lex naturalis) as participation in eternal law (lex aeterna), offers possibilities for grasping that which is just as something which is basically accessible cognition, independently of Revelation and independently of faith in God, and at the same time as something based in eternal law, understood as a design of God's wisdom. Eternal law, embracing all particular actions, is not, from the human perspective, accessible cognition directly. It is enacted in the struc-ture of the created being and - in case of human beings - in free choices taking this structure into account. In the concluding remarks, the results obtained earlier are applied directly to the contemporary conception of human rights. Human rights are understood in the first place as "just things" - concrete goods of man; as that which is due because of subordination, based on dignity, to the personal development of man. That which is just is understood as a relational - actual or potential - state of things, which exists by virtue of existing relations. Evaluations referring to that which is right are true when respective relations of due-to-recipient take place; norms of conduct are true when respective relations of obligation-of-subject take place. Examples of the application of the sketched theory outside the field of human rights are also presented. Procedural consequences of the developed theory are shown, such as the discrimination of two types of legislative procedures which differ significantly in the structure of argumentation: the first aims at recognition of that which is just independently of the will of the legislator, and the second, at making individual or collective "projects" of development compatible. Finally the possibilities of applying the theory to the increasingly important problems of the protection of the environment and the "rights" of animals are mentioned. The central issue is a philosophical conception of man and his freedom and a conception of law. It is also indispensable to turn to a general theory of being. The search for a comprehensive theory of human rights requires attention to the Abso¬lute Being - God - as well. This is important for at least two reasons. First, a conception of the Absolute Being is integral to philosophy of the systemic type -of which the present book is a piece. A conception of the Absolute Being is signifi¬cant for understanding all being, including, first of all, man as a personal being. Second, every theory of human rights which does not comprise the problem of the Absolute may be questioned as to whether solutions adopted in it do not lead, in consequence, to eliminating God from the perspective of the understanding of law. It is desirable that a philosophical theory should deal with this problem directly. A theory which eliminates God from the perspective of the understanding of rights will be unacceptable for all those who, for philosophical reasons or relying on faith, consider God as the author of inherent rights. Nevertheless, a theoretical approach to rights from the perspective of the Absolute Being should only be a possible extension of a philosophical approach which bases rights on something which is cognizable independently of the acceptance of the existence of God so that the theory is also acceptable for those who reject the existence of God or suspend their judgment on this subject. The pursued theory should therefore contain, on the one hand, reference to natural, faith-independent foundations of human rights, but on the other hand, point to a possible extension accounting for the Absolute Being. The analyses contained in this chapter have undoubtedly some historical value since they are based on source texts. Nevertheless, the use of these texts and not critical works was dictated, first of all, by a conviction that analyses embrace a given theory in the aspect selected by the interests of the researcher. Therefore to find out what past thinkers say on the subject characterized in the first part it is simpler to reach to the sources than to adopt the existing critical works. The pre¬sented reconstruction of Aquinas' views on philosophy of law incorporates proposi¬tions of supplementing and developing some of the ideas undertaken by him. Obligation to act in this and not an other way arises because human actions are subordinated to the conformity, on the one hand, of aims realized by these actions and, on the one hand, the order of being determining that which is favourable to man or destroys him. The content of the order of being is, on the one hand, determined by the structure of being independent from man's will and, on the other, by free decisions of man. (shrink)

The deconstruction is enacted by juxtaposing the common notion of Absolute space abstracted from Newton’s Philosophiae Naturalis Principia Mathematica with Levinas’ particular present treatment of space in Otherwise than Being: Or Beyond Essence.

FRANCIS SUÁREZ’S VIEWS ON THE RELATION BETWEEN THE ABSOLUTE POWER OF GOD AND THE NATURAL LAW The article presents Francis Suárez’s views concerning the problem of the possibility of granting dispensation from the natural law by the absolute power of God. Suárez’s opinions on this matter were shown in his comprehensive work on the philosophy of law: De legibus ac Deo legislatore, in Book II De lege aeterna, naturali, et jure gentium, chapter XV entitled Utrum Deus dispensare possit in lege (...) naturali etiam de absoluta potestate. Analyzing the notion of natural law Suárez accepts the Thomistic formula, according to which, the created world is a collection of things with invariable natures. These natures require us to fulfil certain moral obligations and to act in a proper manner. And for this reason, natural law, included in the Decalogue, is invariable and even God is not able to grant its dispensation. The commandments involve an intrinsic principle of justice and obligation and for this reason they are not liable to dispensation. God cannot act contrary to His own nature and His being just, so He would not order people to do something intrinsically unjust. Doctor Eximius justifies moral norms expressed in the Decalogue axiologically, not in a voluntaristic way, by referring to God’s will alone. Suárez criticises both strong theological voluntarism, attributed to Ockham, as well as weak theological voluntarism, attributed to John Duns Scotus. Based on Galileo's experiments, Newton develops the theory of gravity in his first book Philosophiæ Naturalis Principia Mathematica ("Principia") of 1686. Immediately after, Robert Hooke accused Newton of plagiarism, claiming that he unduly assumed his "notion" of "the rule of the decrease of Gravity, being reciprocally as the squares of the distances from the Center". But, according to Edmond Halley, Hooke agreed that "the demonstration of the curves generated by it" belongs entirely to Newton.

A partire dall’incontro con l’opera di Darwin agli inizi degli anni Trenta, Primo Levi eleverà le scienze naturali a incrollabile a priori ontologico della sua riflessione etica e politica. Ciò che si intende mostrare è quanto una solida e consapevole conoscenza del darwinismo abbia costituito il “filtro di lettura” principale della riflessione su Auschwitz compiuta in Se questo è un uomo. È in quest’ottica che il binomio sommersi-salvati, vero e proprio nucleo del pensiero di Levi, rivela tutta la sua portata (...) concettuale. Quest’ultimo rappresenta infatti la risultante socio-antropologica delle leggi inegualitarie della vita, in opposizione alle quali Levi concepisce la disperata necessità della lotta umana contro i limiti dolorosi della materia vivente. Nelle opere della maturità, il naturalismo continuerà a fornire a Levi gli strumenti di base per l’elaborazione di originali soluzioni concettuali a problemi filosofici cruciali come l’origine della aggressività umana, la natura del male politico, il rapporto umano-animale e il nesso natura-civiltà. L’osservazione della natura con l’intento di capire l’origine della varietà di forme e fenomeni in cui si manifesta ha origini remote. All’inizio il rapporto con i fenomeni naturali era dominato da sentimenti quali paura e stupore che conducevano a supporre l’esistenza di entità sfuggenti alla percezione diretta che permeavano gli elementi animandoli. Ecco dunque che la magia rappresenta l’elemento dominante della filosofia naturale primitiva caratterizzata da una unicità degli eventi e dalla impossibilità di capirli e dominarli in quanto frutto della (...) volontà di essenze a noi estranee e non governabili. Con il nascere della civiltà ed il suo progredire il tempo dedicato ai lavori necessari per il sostentamento e la sopravvivenza diminuì e nella ripartizione dei compiti alcuni individui potevano dedicare parte del loro tempo alla osservazione della natura ed alla sua interpretazione in termini non trascendenti. Nella natura, intesa come tutto ciò che ci circonda composto da esseri viventi e da materia inorganica nelle sua varie aggregazioni sulla terra e nel cosmo, ciò che attirò l’attenzione fin dall’inizio furono furono i fenomeni regolari e periodici come i moti della luna, dei pianeti e delle stelle. Nel contempo dopo una spinta iniziale dettata da esigenze pratiche come contare gli oggetti o misurare i campi, la matematica si era sviluppata autonomamente e si rivelò idonea a descrivere in termini quantitativi i moti dei corpi celesti. La terra era al centro dell’universo mentre il moto degli altri corpi celesti risultava da una composizione di moti circolari uniformi. Questa visione geocentrica e pitagorica (armonia delle sfere) dell’universo ha prevalso fino agli albori della scienza moderna, anche se una descrizione eliocentrica, basata su validi argomenti, era stata proposta. Per quanto riguarda la struttura della materia i presocratici avevano già proposto i quattro elementi mentre gli atomisti avevano ricondotto tutto ad entità elementari primigenie, il cui aggregarsi e disgregarsi da luogo a tutti gli stati e le molteplici forme della materia. Queste intuizioni si ritrovano nella fisica moderna che contempla quattro stati di aggregazione, che hanno come unico sostrato comune gli atomi. La fisica moderna nasce con Galileo e Newton, la cui dinamica si sviluppa a partire dalle leggi di Keplero che descrivono il moto dei pianeti nel sistema eliocentrico, per potersi poi applicare ad un qualunque sistema materiale. Pertanto nei due secoli successivi si ritenne che un modello meccanico potesse essere sviluppato per un qualunque sistema fisico e quindi per l’universo intero la cui evoluzione doveva essere matematicamente prevedibile. Per i fenomeni termici tuttavia vennero formulate leggi ad hoc come quelle della termodinamica che mostrano come i processi macroscopici siano irreversibili in contrasto con le leggi della meccanica. Si deve a Boltzmann1 il tentativo di ricondurre la termodinamica alla meccanica per un gran numero di particelle dei cui moti disordinati viene data una lettura di carattere statistico. L’aumento della entropia e la irreversibilità seguono dalla ipotesi di caos molecolare ossia che i moti siano così disordinati che si perde rapidamente memoria dello stato iniziale. L’idea di introdurre una misura di probabilità nel contesto della meccanica sembra antitetica con la natura stessa della teoria rivolta fino ad allora allo studio di sistemi con moti regolari, reversibili e prevedibili individualmente su tempi lunghi. Tuttavia l’analisi probabilistica diventa essenziale per lo studio di sistemi caratterizzati da forti instabilità, e da orbite irregolari per i quali la previsione richiede una conoscenza della condizioni iniziali con precisioni fisicamente non raggiungibili. Combinando la evoluzione deterministica della meccanica di Newton o di Hamilton con la descrizione statistica attraverso una opportuna misura invariante di probabilità nello spazio delle fasi, nasce la teoria dei sistemi dinamici2 che consente di descrivere non solo i sistemi ordinati o i sistemi caotici ma anche tutti quelli che vedono coesistere in diverse proporzioni ordine e caos e che presentano una straordinaria varietà di strutture geometriche e proprietà statistiche, tanto da fornire almeno se non proprio un quadro teorico per lo meno metafore utili per la descrizione dei sistemi complessi. Anche se non c’è unanime consenso ci sembra appropriato definire complessi non tanto sistemi caratterizzati da interazioni non lineari tra i suoi componenti e da proprietà emergenti, che rientrano a pieno titolo nel quadro dei sistemi dinamici, ma piuttosto i sistemi viventi o quelli di vita artificiale che ne condividono le proprietà essenziali3. Tra queste possiamo certamente annoverare la capacità di gestire la informazione e di replicarsi, consentendo tramite un meccanismo di mutazione e selezione di dare origine a strutture di crescente ricchezza strutturale e dotate di capacità cognitive sempre più elaborate. Una teoria dei sistemi complessi non esiste ancora, anche se la teoria degli automi sviluppata da Von Neumann4 e la teoria della evoluzione di Darwin5 ne possono fornire alcuni pilastri importanti. Recentemente la teoria delle reti è stata utilizzata con successo per descrivere le proprietà statistiche delle connessioni tra gli elementi costitutivi (nodi) di un sistema complesso6. Le connessioni che non sono né completamente casuali né completamente gerarchiche, consentono una sufficiente robustezza rispetto a malfunzionamenti o danneggiamenti dei nodi unita a un adeguato livello di organizzazione per consentirne un funzionamento efficiente. Nei sistemi fisici il modello base è un insieme di atomi o molecole interagenti, che danno luogo a strutture diverse quali un gas, un liquido o un cristallo, come risultato di proprietà emergenti. Nello stesso modo per i sistemi complessi possiamo proporre un sistema automi interagenti come modello base. Le molteplici forme che il sistema assume anche in questo caso vanno considerate come proprietà emergenti del medesimo sostrato al mutare delle condizioni esterne e frutto delle i replicazioni, ciascuna delle quali introduce piccole ma significative varianti. Questa è la grande differenza tra un sistema fisico ed un sistema complesso: il primo fissate le condizioni esterne ha sempre le medesime proprietà, il secondo invece cambia con il fluire del tempo perché la sua organizzazione interna muta non solo al cambiare di fattori ambientali ma anche con il succedersi delle generazioni. C’è dunque un flusso di informazione che cresce con il tempo e che consente agli automi costituenti ed alla intera struttura di acquisire nuove capacità. Questo aumento di ordine e ricchezza strutturale avviene naturalmente a spese dell’ambiente circostante, in modo che globalmente i la sua entropia cresce in accordo con la seconda legge della termodinamica. In assenza di una teoria formalizzata paragonabile a quella dei sistemi dinamici, per i sistemi complessi si possono fare osservazioni e misure, sia puntuali sui costituenti elementari e sulle loro connessioni, sia globali sull’intero sistema, oppure costruire modelli suscettibili di essere validati attraverso la simulazione. Se di un sistema si riesce infatti a fornire una descrizione sufficientemente dettagliata, è poi possibile osservare come questo si comporti traducendo le regole in algoritmi e costruendo quindi una versione virtuale, anche se semplificata del sistema stesso. Il passaggio più difficile è il confronto tra il sistema simulato ed il sistema vero, che passa necessariamente attraverso la valutazione di una numero limitato di parametri che ne caratterizzino e proprietà. La codifica del progetto è una proprietà cruciale dei sistemi complessi perché questa si realizza con un dispendio di massa ed energia incomparabilmente più piccolo rispetto a quello necessario per realizzare l’intera struttura; nello stesso tempo apportare piccole modifiche ad un progetto è rapido ed economico. In questo processo che comporta la continua introduzione di varianti si aprono molteplici strade e con lo scorrere del tempo si realizza una storia in modo unico e irripetibile. Anche il susseguirsi di eventi fisici caratterizzati da processi irreversibili e dalla presenza di molteplici biforcazioni da origine ad una storia che non si può percorrere a ritroso, né riprodurre qualora fossimo in grado ripartire dalle stesse condizioni iniziali. Tuttavia esiste una differenza profonda tra la storia di un sistema fisico come il globo terrestre e la storia della vita. La prima registra i molteplici cambiamenti che ha subito la superficie del nostro pianeta ove montagne e mari nascono e scompaiono senza un chiaro disegno soggiacente. La storia della vita è caratterizzata da una progressiva crescita della ricchezza strutturale e funzionale e accompagnata da una crescita della complessità progettuale. La rappresentazione di questa storia prende la forma di un albero con le sue ramificazioni che mostra la continua diversificazione delle strutture e la loro evoluzione verso forme sempre più avanzate. La direzione in cui scorre il tempo è ben definita: le strutture affinano le capacità sensoriali mentre cresce la potenza degli organi che elaborano la informazione. Un sistema complesso è anche caratterizzato da un molteplicità di scale, tanto più alta quanto più si sale sulla scala evolutiva. La ragione è che il procedere verso strutture sempre più elaborate avviene utilizzando altre strutture come mattoni per cui l’immagine che si può fornire è quella di una rete di automi a più strati: partendo dal basso una rete con le sue proprietà emergenti diventa il nodo di una rete di secondo livello, cioè un automa di secondo livello che interagisce con altri automi dello stesso tipo e così via. Nei sistemi inorganici, dove non esiste un progetto, si distinguono di norma solo due livelli, quello dei costituenti elementari e quello su scala macroscopica. I sistemi fisici sono riconducibili a poche leggi universali, che governano i costituenti elementari della materia, ma il passaggio dalla descrizione dalla piccola alla grande scala è impervio e consentito soltanto dalla simulazione numerica, quando ci allontaniamo dalle situazioni più semplici caratterizzate da un equilibrio statistico. I limiti che il disegno riduzionista incontra già per i sistemi fisici diventano decisamente più forti nel caso dei sistemi complessi. (shrink)

Metaphysical considerations aside, today’s inheritors of the tradition of natural philosophy are primarily scientists. However, they are oblivious to the human factor involved in science and in seeing how political, religious, and other ideologies contaminate our visions of nature. In general, philosophers observe human (historical, sociological, and psychological) processes within the construction of theories, as well as in the development of scientific activity itself. -/- In our time, feminism—along with accompanying ideas of identity politics under the slogan “diversity, inclusion, equity”—has (...) emerged in science policies. The vast majority of scientists (including myself) are convinced that discrimination is reprehensible. We also believe that all individuals of any sex, race, ethnic group, or ideology should be valued in academia solely based on his or her merits and potential through equality programs. However, as I will show in this article, political indoctrination has inadmissibly undertaken the struggle for equality in academic institutions in Western countries. I argue here that universities and research institutes should be politically free (neutral) to encourage academic freedom. -/- One negative aspect of equality programs is that worldwide, scientists are harassed for expressing opinions related to the “gender” issue. This situation severely restricts scientists’ freedom of expression, even within the limits of the law. Codes of conduct extending beyond legal boundaries are examples of this issue. Scientists who express their views about “gender” are often harassed, bullied, and socially or academically excluded. Thus, we are witnessing a wave of proselytizing in research institutes and science-associated media. Today, there is widespread biased propaganda of “victimhood”. This propaganda proposes positive discrimination and increasing women’s participation in unnatural ways. It also bends the history of science by overvaluing the creations of forgotten women, offering lectures on indoctrination, organizing congresses on gender and science, and persecuting anyone who sees the subject differently. All of this covered by a multitude of associations that financially benefit from these discourses through succulent subsidies of public money. Apparently, feminism is no longer about fighting against discrimination. Instead, it is about imposing an ideology and giving more power to one group of people. Thus, we must ask whether the end justifies the means. (shrink)

The main claim that I want to defend in this paper is that the there are logical equivalences between eternalism and perdurantism on the one hand and presentism and endurantism on the other. By “logical equivalence” I mean that one position is entailed and entails the other. As a consequence of this equivalence, it becomes important to inquire into the question whether the dispute between endurantists and perdurantists is authentic, given that Savitt (2006) Dolev (2006) and Dorato (2006) have cast (...) doubts on the fact that the debate between presentism and eternalism is about “what there is”. In this respect, I will conclude that also the debate about persistence in time has no ontological consequences, in the sense that there is no real ontological disagreement between the two allegedly opposite positions: as in the case of the presentism/eternalism debate, one can be both a perdurantist and an endurantist, depending on which linguistic framework is preferred. (Ich verweise auf die Religionswissenschaft mit 'RW II', auf die Wissenschaftslehre mit 'WL II'.) In der RW II (vgl. p. 37) ist seine Wahrscheinlichkeitslehre eingebettet in seine Ausführungen "Über die Natur der historischen Erkenntniß, besonders in Hinsicht auf Wunder", und die Lehrsätze, die er dort zusammenstellt, dienen dem ausdrücklichen Zweck, mit mathematischem Rüstzeug (...) Lehrmeinungen entgegentreten zu können, gemäß denen Wundererzählungen keine Glaubwürdigkeit zukommen könne. In der WL II (vgl. p. 171) führt Bolzano im großen und ganzen dieselben Lehrsätze an wie in der RW II, entwickelt nun aber die Wahrscheinlichkeitslehre innerhalb seiner Lehre von den Sätzen an sich. Dabei orientiert er sich zwar durchaus an den Lehrsätzen in den damaligen "Schriften über die Wahrscheinlichkeitsrechnung" (vg. WL II, p. 190), korrigiert aber dort, wo es ihm nötig erscheint (vgl. WL II, pp. 187–191), und leistet so im Grunde eine Reformulierung des elementaren Teils der Wahrscheinlichkeitslehre seiner Zeit innerhalb seiner logischen Theorie von den Sätzen an sich. — Ich bezwecke hier keine historische Studie über Bolzanos Wahrscheinlichkeitslehre, obwohl es von Interesse sein mag, herauszuschälen, worin Bolzano mit welchen Wahrscheinlichkeitstheoretikern seiner Zeit übereinstimmt, und worin nicht, insbesondere welche Schwächen von Bolzanos Wahrscheinlichkeitslehre Schwächen aller damaligen Wahrscheinlichkeitslehren waren. Eine wichtige systematische Studie über Bolzanos Wahrscheinlichkeitslehre bestünde — wie von Berg (1962, pp. 148-149) ansatzweise begonnen — in einer exakten Rekonstruktion seiner Wahrscheinlichkeitslehre innerhalb eines konsistenten logischen Systems der Sätze an sich. Ich werde im folgenden etwas bei weitem Bescheideneres, doch möglicherweise durchaus Fruchtbares versuchen, nämlich die Lehrsätze von Bolzanos Wahrscheinlichkeitslehre in die Sprache einer heutigen Wahrscheinlichkeitstheorie zu übersetzen und die übersetzten Lehrsätze dort herzuleiten, soweit dies möglich ist. Man könnte dann in einem zweiten Schritt, der hier nicht mehr unternommen wird, untersuchen, inwieweit jene Thesen, die den Herleitungstest überstanden haben, jenen Zweck erfüllen, den Bolzano ihnen ursprünglich zugedacht hat: als mathematisches Rüstzeug für seine Argumentationen gegen die Auffassung zu dienen, Wundererzählungen könnten nicht glaubwürdig sein. [ENGLISH] The present article is a contribution to the development of metrological structural realism. This position of philosophy of science goes back to Matthias Neuber, who introduces it as a third variation of the main structural realisms: epistemic structural realism and ontic structural realism. Here, Neuber attempts to tackle the problems of OSR and ESR while preserving their respective strengths. Of central importance to his approach, are the concepts of invariance, structure and, especially, measurement. Starting from Eino Kaila’s „non-linguistic, realist (...) account of logical empricism“, the present article investigates the necessity of yet another position of structural realism. The established structural realisms are examined for their strengths and weaknesses. Afterwards, the requirements on MSR are formulated in a way that extends beyond Neuber’s account. These requirements are of ontological, epistemological and metrological nature. -/- [DEUTSCH] Der vorliegende Aufsatz ist ein Beitrag zur Entwicklung des Metrologischen Strukturenrealismus. Diese Wissenschaftstheoretische Position geht auf Matthias Neuber zurück, der sie als dritte Spielart zwischen den großen Strukturenrealismen – dem Epistemischen Strukturenrealismus und dem Ontischen Strukturenrealismus – ansiedelt. Neuber versucht, die wissenschaftstheoretischen Probleme von ESR und OSR anzugehen, gleichzeitig aber ihre jeweiligen Stärken beizubehalten. Dabei sind die Konzepte der Invarianz, der Struktur und besonders der Messung von zentraler Bedeutung. Ausgehend von Eino Kailas „non-linguistic, realist account of logical empiricism“ untersucht der vorliegende Aufsatz die Notwendigkeit einer weiteren strukturenrealistischen Position. Dazu werden die etablierten Strukturenrealismen auf ihre Stärken und Schwächen hin untersucht. We discuss the usual account of causal structure that relies on the temporal precedence constraint between cause-effect pairs. In particular, we consider the subtle interplay between local and global characters of time and causality encoded in General Relativity. We find that the temporal precedence constraint must be relaxed. We argue that these results could lead to an enriched structure of the physical causality.

A strong motivation for the human genome project was to relate biological features to the structure and function of small sets of genes, and ideally to individual genes. However, it is now increasingly realized that many problems require a "systems" approach emphasizing the interplay of large numbers of genes, and the involvement of complex networks of gene regulation. This implies a new emphasis on integrative, systems theoretical approaches. It may be called 'holistic' if the term is used without irrational overtones, (...) in the general sense of directing attention to integrated features of organs and organisms. In the history of biology, seemingly conflicting reductionist and holistic notions have alternated, with bottom-up as well as top-down approaches eventually contributing to the solutions of basic problems. By now, there is no doubt that biological features and phenomena are rooted in physico-chemical processes of the molecules involved; and yet, integrated systems aspects are becoming more and more relevant in developmental biology, brain and behavioural science, and socio-biology. -/- . Understanding cooperative human behaviour depends on insights into the biological basis of human altruism, as well as into socio-cultural development. In terms of evolutionary theory, kinship and reciprocity are well established as underlying cooperativeness. Reasons will be given suggesting an additional source, the capability of a cognition-based empathy that may have evolved as a by-product of strategic thought. An assessment of the range, the intrinsic limitations, and the conditions for activation of human cooperativeness would profit from a systems approach combining (...) biological and socio-cultural aspects. However, this is not yet the prevailing attitude among contemporary social and biological scientists who often hold prejudiced views of each other's notions. It is therefore worth noticing that the desirable integration of aspects has already been attempted, in remarkable and encouraging ways, in the history of thought on human nature. I will exemplify this with the ideas of the fourteenth century Arab-Muslim historian Ibn Khaldun. He set out to explicate human cooperativeness - "asabiyah" - as having a biological basis in common descent, but being extendable far beyond within social systems, though in a relatively unstable and attenuated fashion. He combined psychological and material factors in a dynamical theory of the rise and decline of political rulership, and related general social phenomena to basic features of human behaviour influenced by kinship, expectation of reciprocity, and empathic emotions. -/- . I introduce a puzzle about contact and de re temporal predication in relativistic spacetime. In particular, I describe an apparent counterexample to the following principle, roughly stated: if B is never in a position to say ‘I was touching A, I am touching A, and I will be touching A’, then (time travel aside) A is never in a position to say ‘I was touching B, I am touching B, and I will be touching B’. In the case I present, (...) the most that A is ever in a position to say is: ‘I am now touching B, but this is the only instant at which this will ever be so’. B, on the other hand, can say: ‘I was formerly touching A, I am currently touching A, and I will in the future be touching A’. (And neither object is a time traveler.). (shrink)

The paper analyses how knowledge claims can be extrapolated from laboratory situation to more complex situations. It argues that claims by Tetens, Knorr-Cetina and Cartwright that put doubts on extrapolation are unwarrented.

It is my aim in this paper to look at some of the arguments that are brought forward for or against certain claims to unity/disunity (in particular to examine those arguments from science and from scientific practice) in order to evaluate whether they really show what they claim to. This presupposes that the concept or rather the concepts of the unity of physics are reasonably clear. Three concepts of unity can be identified: (1) ontological unity, which refers to the objects (...) physics is about; (2) descriptive unity, which addresses the descriptive devices physics employs in dealing with physical systems (3) unity of practice, which deals with what physicists actually do.
