Why have Polish philosophers fared so badly as concerns their admission into the pantheon of Continental Philosophers? Why, for example, should Heidegger and Derrida be included in this pantheon, but not Ingarden or Tarski? Why, to put the question from another side, should there be so close an association in Poland between philosophy and logic, and between philosophy and science? We distinguish a series of answers to this question, which are dealt with under the following headings: (a) the role (...) of socialism; (b) the disciplinary association between philosophy and mathematics; (c) the influence of Austrian philosophy in general and of Brentanian philosophy in particular; (d) the serendipitous role of Twardowski; (e) the role of Catholicism. The conclusion of the paper is that there is no such thing as 'Polish philosophy' because philosophy in Poland is philosophy per se; it is part and parcel of the mainstream of world philosophy simply because, in contrast to French or German philosophy, it meets international standards of training, rigour, professionalism and specialization. Inquiries concerning the theory of imperatives and norms prosecuted in Poland in the 20th century covered practically the whole scope of this theory. In a uniform conceptual scheme, the paper shows main results of this research done mostly within the Lvov-Warsaw School tradition. It begins with presenting the Polish theoreticians’ approach to three correlated theoretical situations containing our preferences (opposed to impulses, decisions and tendencies), accepted values and imposed obligations. The second step is discussing their views on means of (...) verbalising these situations, i.e. by help of imperatives, evaluations and norms (opposed to consultatives, instructions and optatives) correspondingly. Who and how revised Marxism in Poland? The simple answer is that it was done by young intellectuals seeing themselves as obligated to social and political activity, eager to participate in the process of the constitution of a new postwar Communist society. Marxism was for them a philosophical world-view and a political program rising hopes for a better socio-economic reality. Revisionists were committed Communists and their attitude toward Marxism was almost religious. Marxism, Promethean and scientific at the same time, was (...) supposed to replace religion, for which the radically secular revisionists saw no place in the new society. (See: Mikołajczyk 2013, p. 44-48) After the shock of 1956 they stuck by the slogan: ’socialism–yes, distortions–no,’ they thought that “Marxist socialism was possible without Leninist political forms, that Communism might be attacked within «the framework of Marxism»,” and they “believed for some time ... that Stalinism was curable in the sense that Communism could be restored or «democratized» without questioning its foundations” (Kolakowski 1978, p. 461). They saw themselves in an elitist way, i.e., as true and devoted Marxists fighting with dogmas, orthodoxy, myths, and unfounded faith both within Marxism-Leninism and outside it. They were willing to accept the position of sectarians, heretics, or apostates. Their political and ideological involvement forced them to attack pre-war but still active Polish philosophers of the Lvov-Warsaw School and other nonMarxist thinkers (Roman Ingarden, Władysław Tatarkiewicz, Stanisław Ossowski), who were classified as “bourgeois thinkers” unable to understand and assimilate Marxism. Maria Gołaszewska (1926–2015), a Polish philosopher, was associated throughout her life with Poland’s oldest academic institution, the Jagiellonian University in Cracow. She was a student of the phenomenologist Roman Ingarden, himself a student of Edmund Husserl. During the postwar and communist years in Poland, Gołaszewska conducted research focusing on issues related to art and aesthetics. She created her own conception of empirically and anthropologically oriented aesthetics, which I believe is a prime example of a theory that accounts for the (...) perspective of gender, and in this sense should be acknowledged as an important contribution to contemporary gender-sensitive/feminist philosophy. In the article, I present Gołaszewska’s life, academic career, and philosophy as a cognitively valuable response to feminist philosophy’s search for a suitable description of women’s experiences related to art and aesthetic perception. Philosophers of religion of the Cracow Circle (1934-1944) are the principal precursors of what is now called the analytic philosophy of religion. The widespread claim that the analytic philosophy of religion was from the beginning an Anglo-American affair is an ill-informed one. It is demonstrable that the enterprise, although not the label "analytic philosophy of religion," appeared in Poland in the 1930’s. Józef Bochenski’s postwar work is a development of the Cracow Circle’s prewar work in the analytic philosophy of religion, (...) or at least of important elements of that earlier work. Bochenski’s approach in his ’Logic of Religion’ is quite original and might still be profitably studied and discussed by philosophers of religion of the analytic persuasion. (shrink)

The Polish philosophy of mathematics in the 19th century had its origins in the Romantic period under the influence of the then-predominant idealist philosophies. The decline of Romantic philosophy precipitated changes in general philosophy, but what is less well known is how it triggered changes in the philosophy of mathematics. In this paper, we discuss how the Polish philosophy of mathematics evolved from the metaphysical approach that had been formed during the Romantic era to the more modern positivistic (...) paradigm. These evolutionary changes are attributed to the philosophers Henryk Struve, Antoni Molicki and Julian Ochorowicz, and mathematicians Karol Hertz and Samuel Dickstein. We also show how implicit ideas (i.e., those not declared openly) from the area between the philosophy of science and general philosophy played a crucial role in the paradigm shift in the Polish philosophy of mathematics. The Polish philosophy of mathematics in the 19th century is not a well-researched topic. For this period, only five philosophers are usually mentioned, namely Jan Śniadecki, Józef Maria Hoene-Wroński, Henryk Struve, Samuel Dickstein, and Edward Stamm. This limited and incomplete perspective does not allow us to develop a well-balanced picture of the Polish philosophy of mathematics and gauge its influence on 19th- and 20th-century Polish philosophy in general. To somewhat complete our picture of the history of the (...) Polish philosophy of mathematics in those times, we here present the profiles of some lesser-known Polish Romantic philosophers of the 19th century, namely Karol Libelt, Bronisław Trentowski, and Józef Kremer. We discuss their contributions to the philosophy of mathematics and their metaphysical perspectives, and we also show how their metaphysical ideas have found some continuity in the studies of some Catholic philosophers. I argue that the post-1990 practice of giving leadership positions in companies to non-ex-communists is an example of affirmative action.

This chapter focuses on maintaining employment in the sector of small and medium-sized enterprises, which is crucial for the functioning of the economy. However, in an economic crisis, the changes in the area of employment of workers often become the foremost way of adapting to declining financial resources, which are the result of reduction of interest in the offer of the organisation by the customers. These actions had proven to be particularly evident in the case of global financial and economic (...) crisis, which also affected the Polish economy after 2008. The chapter suggests that the layoffs lead to rise in unemployment. Thus, there is a need to promote the outplacement, which is, a technique oriented on responsible dismissals in order to support a smooth transition of laid-off workers to new workplaces. In this way, both employees and companies increase their chances of maintaining competencies and better adapt to market competition requirements. This chapter explores the characteristics of the labour market policy in Poland, main features of the outplacement in the context of the crisis, examples of the outplacement implementation, plans for further development of the outplacement, and conclusions including directions for further research. Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

An axiological analysis of the basis of the 1997 Constitution of the Republic of Poland, determined mainly in the Preamble, makes it possible to put forward a thesis that this axiology is not, at least in reference to the principle, eclectic. In respect of the meta-axiological settlements, this is a tradition of natural-law type, recognizing the objective grounding of values and law. The accepted solutions are also convergent with the axiology typical of the international protection of human rights. -/- Résumé (...) L’analyse des fondements axiologiques de la Constitution polonaise de 1997, inscrits avant tout dans le préambule, permet de formuler la thèse selon laquelle cette axiologie n’est pas, en principe, éclectique. La réflexion sur les valeurs s’inscrit dans la vision classique des fondements du droit, remontant à l’antiquité. Partant de là, se dégage une tradition juridique appuyée sur le droit naturel, reconnaissant la force objective des valeurs et du droit. Ces conclusions rejoignent l’axiologie classique de la protection internationale des droits de l’Homme. -/- Zusammenfassung Die Analyse der vor allem durch die Präambel definierten axiologischen Grundlagen der Verfassung der Republik Polen von 1997 ermöglicht die Aufstellung der These, dass diese Axiologie nicht eklektisch ist, zumindest nicht prinzipiell. Hier enthüllt sich ein Denken von den Werten, das sich in die klassische, bis in die Antike zurückreichende Reflexion über die Grundlagen des Rechts einfügt. Wegen der metaaxiologischen Entscheidungen ist das eine Tradition naturrechtlichen Typs, die die objektive Begründung der Werte und des Rechts anerkennt. The paper reports results of the very first survey-based study on the prevalence, frequency and nature of ethical or other non-medical difficulties faced by Polish physicians in their everyday clinical practice. The study involved 521 physicians of various medical specialties, practicing mainly in inpatient healthcare. The study showed that the majority of Polish physicians encounter ethical and other non-medical difficulties in making clinical decisions. However, they confront such difficulties less frequently than their foreign peers. Moreover, Polish doctors (...) indicate different circumstances as a source of the experienced problems. The difficulties most often reported relate to (i) patients (or their proxies) requests for medically non-indicated interventions; (ii) problems with communication with patients (or their proxies) due to the patients’ negative attitude, unwillingness to cooperate, or aggression; and (iii) various difficulties with obtaining informed consent. Polish physicians report difficulties associated with disagreements among care givers or scarcity of resources less frequently than doctors from other countries. The study’s findings provide support for the thesis that a significant portion of Polish physicians still follow a traditional, paternalistic, and hierarchical model of healthcare practice. Instead of promoting patient’s empowerment, engagement, and rights, they often consider these ideas as a threat to physicians’ professional authority and autonomy. The study leads to the conclusion that due to insufficient training in medical ethics, communication skills, and medical law, many Polish physicians lack the knowledge and competence necessary to adequately respond to challenges posed by modern healthcare practice. Zmierzając do realizacji tego celu uwyraźnię problematykę metaaksjologiczną w kontekście zagadnie­nia legitymizacji, formułując zasadnicze dylematy, które sprowadzają się do wyboru między koncepcją czystych wartości a koncepcją wartości (...) jako dóbr oraz między uznaniem obiektywnego ugruntowania wartości skorelowanym z uznaniem kognitywizmu metaetycznego a odrzuceniem obiektywnego ugruntowania i kognitywizmu. Zarysuję także zasadnicze możliwości ar­gumentacji w sprawie identyfikacji rozstrzygnięć w tym zakresie przyjętych w Konstytucji RP z 2 kwietnia 1997 roku. Zaznaczyć trzeba, że nie jest celem tego opracowania identyfikowanie konkretnych rozstrzygnięć aksjologicznych i metaaksjologicznych legitymizujących prawo, a jedynie wskazanie istotnych problemów i dylematów w kwestii legitymizacyjnych funkcji rozstrzygnięć metaaksjologicznych. When discussing the safety of research subjects, including their exploitation and vulnerability as well as failures in clinical research, recent commentators have focused mostly on countries with low or middle-income economies. High-income countries are seen as relatively safe and well-regulated. This article presents irregularities in clinical trials in an EU member state, Poland, which were revealed by the Supreme Audit Office of Poland (the NIK). Despite adopting many European Union regulations, including European Commission directives concerning Good Clinical Practice, these irregularities (...) occurred. Causes as well as potential solutions to make clinical trials more ethical and safer are discussed. (shrink)

We are in a state of impending crisis. And the fault lies in part with academia. For two centuries or so, academia has been devoted to the pursuit of knowledge and technological know-how. This has enormously increased our power to act which has, in turn, brought us both all the great benefits of the modern world and the crises we now face. Modern science and technology have made possible modern industry and agriculture, the explosive growth of the world’s population, global (...) warming, modern armaments and the lethal character of modern warfare, destruction of natural habitats and rapid extinction of species, immense inequalities of wealth and power across the globe, pollution of earth, sea and air, even the aids epidemic (aids being spread by modern travel). All these global problems have arisen because some of us have acquired unprecedented powers to act, via science and technology, without also acquiring the capacity to act wisely. We urgently need to bring about a revolution in universities so that the basic intellectual aim becomes, not knowledge merely, but rather wisdom – wisdom being the capacity to realize what is of value in life, for oneself and others, thus including knowledge and technological know-how, but much else besides. The revolution we require would put problems of living at the heart of the academic enterprise, the pursuit of knowledge emerging out of, and feeding back into, the fundamental intellectual activity of proposing and critically assessing possible actions, policies, political programmes, from the standpoint of their capacity to help solve problems of living. This revolution would affect almost every branch and aspect of academic inquiry. (shrink)

W NINIEJSZYM opracowaniu analizuję klauzulę dobra wspólnego zawartą w art. 1 Konstytucji Rzeczypospolitej Polskiej z 2 kwietnia 1997 r., zmierzając do uwyraźnienia, w jakim sensie można mówić o jej prawnonaturalnym charakterze (zatem i do zarysowania możliwych znaczeń zwrotu "prawnonaturalny charakter klauzuli dobra wspólnego") oraz do ujawnienia „momentów" prawnonaturalnych, które mogą wchodzić w grę przy interpretacji tej klauzuli.

The author poses a question: which of the two fundamental, constitutional values – common good or human dignity – can be considered to be the cornerstone, the unifying value in the Constitution of the Republic of Poland from 1997. The paper shows the crucial reasons for accepting each of these values as primary and also presents the underlying relationships between these values . The prominence of a given value for defining the aim of the constitution and the legal order based (...) on it was accepted as the most important aspect for determining the order of primacy. In respect of the direct aims of activities of public authorities and more broadly – of the aims of subjects whose activities are defined by the constitution – the primary value should be common good understood as certain social conditions of life which support human development. It defines the space in which other constitutional values, also human dignity, are integrated. Human dignity, however, the primary value defining human being, gives the reason why human development is a first and autonomous aim of the constitutional order. In this respect dignity has priority before common good. -/- Autor stawia pytanie o to, którą z fundamentalnych wartości konstytucyjnych – dobro wspólne czy godność człowieka – można uznać za wartość pierwszą i stanowiącą podstawę spójności aksjologicznej Konstytucji RP z 2 kwietnia 1997 roku. Wskazane są zasadnicze racje przemawiające za uznaniem każdej z tych wartości za wartość pierwszą i identyfikowane są zasadnicze relacje zachodzące między tymi wartościami. Za aspekt najistotniejszy dla ustalenia pierwszeństwa którejś z tych wartości uznana jest doniosłość danej wartości dla określenia celu konstytucji i opartego na niej porządku prawnego. Z punktu widzenia bezpośredniego celu działań władzy publicznej i szerzej – podmiotów, których działanie wyznaczone jest porządkiem konstytucyjnym, wartością tą jest dobro wspólne wyznaczające przestrzeń, w której integrowane są inne wartości konstytucyjne, z godnością włącznie. Dobro wspólne jest celem porządku konstytucyjnego ze względu na godność człowieka, która czyni jego rozwój pierwszym i szczególnym – autotelicznym dobrem. Last time we saw that grammatical tenses anaphorically refer to top-ranked times or time-valued functions of top-ranked events, just like grammatical person markers anaphorically refer to top-ranked individuals or invididual-valued functions of top-ranked events. Today we extend this idea to grammatical aspect. Specifically, grammatical aspect marking in English and Polish is analyzed as discourse anaphora to top-ranked eventualities (states or events).

The first part of this book contains a selection of Leszek Nowak’s (1943-2009) works on non-Marxian historical materialism, which are published here in English for the first time. In these papers, Nowak constructs a dynamic model of religious community, reconstructs historiosophical assumptions of liberalism and considers the methodological status of prognosis of totalitarization of capitalist society. In the second part of the book, new contributions to non-Marxian historical materialism are presented. Their authors analyze mechanisms of the oligarchization of liberal democracy, (...) the democratization of real socialism, and the development of early modern Ottoman and post-war Chinese societies. The volume will be of interest to graduate and undergraduate students, as well as specialists who deal with the development of capitalist society, philosophy of history, the philosophy of social sciences and the political philosophy of liberalism. The contemporary combination of information infrastructure with the commonly experienced transformation of knowledge created, in relation to education especially for older adults, an entirely new area of activeness. In accordance with the social awareness, education became an accessible good regardless of age. In this context, the maximal extending of the potential group of education receivers means, on the one hand, meeting the real social expectations towards so-called educational services. On the other hand, it is another challenge which the contemporary education (...) faces. Unfortunately, the system of permanent education was not created in Poland since what is missing is both the strategy and some practical resolutions enabling old people the access to education with regards to their educational. Presently, the University of the Third Age is the only solution in the educational offer. In order to change the present status quo, what is needed is the re-definition of education and the modern perception of education and then perhaps, there will appear, the expected, by the senior citizens, module educational solutions providing them not only with the competencies but also the acknowledged certificate confirming their knowledge. The complexity of population ageing effect is a significant challenge at a regional and local level. Adaptation activities require the cooperation of local governments, business entities and non-governmental organizations. The article describes the dimensions of interventions, typology of “shrinking regions” and two initiatives: Regions for All Ages and SEN@ER - Silver Economy Network of European Regions. In addition, essay discusses the dilemmas of creating special regional strategies with their implementation factors and barriers in the construction of silver economies. It is (...) supplemented by some conclusions from the analysis of selected regional development strategies in Poland. The influence of Kasimir Twardowski on modern Polish philosophy is all-pervasive. As is well known, almost all important 20th century Polish philosophers went through the hard training of his courses in Lvov. Twardowski instilled in his students an enduring concern for clarity and rigour. He taught them to regard philosophy as a collaborative effort, a matter of disciplined discussion and argument. And he encouraged them to work together with scientists from other disciplines — above all with psychologists, and (...) also with mathematicians — so that the Lvov school of philosophy would gradually evolve into the Warsaw school of logic. "Philosophical Foundations of Understanding of the Common Good". The central question is whether recognizing the common good as the central value in the new Polish Constitution of 1997, means accepting the primacy of the state over an individual. The answer is negative. The preparatory work to the constitution is analyzed and the philosophical perspective is outlined which corresponds to the intentions of the authors of the constitution. The analyses concentrate on the philosophical tradition reaching from Plato to Aristotle and (...) Centralne pytanie brzmi, czy uznanie dobra wspólnego za wartość fundamentalną, nie jest uznaniem prymatu państwa wobec jednostki, czy nie wprowadza do porządku konstytucyjnego idei totalitarystycznych. Odpowiedź na to pytanie jest negatywna. Argumentując, autor dokonuje analizy prac przygotowawczych do Konstytucji, oraz zmierza do zarysowania filozoficznej perspektywy rozumienia dobra wspólnego, perspektywy odpowiadającej intencjom twórców Konstytucji. Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral (...) assessments may have the nature of judgments and truth qualification (they may be true or false). In the course of application of the constitution, norms of natural-law character and natural-law justification. Since dignity and the essence of freedoms and rights based on dignity are the only inviolable values recognized by the constitution, the arguments of natural law lead to a far-going reinterpretation of constitutional norms. The norm of natural law protecting inviolable values will have precedence in the event of collision with norms protecting other values, also with constitutional norms. Even if such a norm is formulated on the basis of the provisions of the constitution, in fact natural law is given higher rank than elements based only on enacted law. Despite that, reliability of a legally established order does not seem to be radically endangered. -/- Konstytucja RP uznając przyrodzoność i niezbywalność godności oraz uniwersalność niektórych wartości, wprowadza do podstaw całego polskiego systemu prawnego elementy prawnonaturalne, które mogą być wykorzystane w stosowaniu konstytucji. Konstytucyjne uznanie takich elementów ma sens przy założeniu ich poznawalności, stąd istotnym elementem konstytucyjnej koncepcji prawa naturalnego jest uznanie tezy kognitywizmu głoszącej, że oceny moralne mogą mieć charakter sądów i kwalifikację prawdziwościową – mogą być prawdziwe lub fałszywe. W procesie stosowania konstytucji mogą być formułowane normy o charakterze prawnonaturalnym oraz uzasadnienia prawnonaturalne. Ponieważ jedynymi wartościami uznanymi w konstytucji za nienaruszalne jest godność oraz istota wolności i praw, których godność jest źródłem, argumentacja prawnonaturalna może prowadzić do daleko idącej reinterpretacji norm konstytucyjnych. Norma prawnonaturalna chroniąca warunki konieczne poszanowania godności lub istoty wolności i praw będzie miała pierwszeństwo w razie kolizji z normami chroniącymi inne wartości, także z normami konstytucyjnymi. Choć norma taka będzie formułowana na podstawie przepisów konstytucji, to jednak faktycznie prawo naturalne uzyskuje wyższą rangę od elementów opartych jedynie na stanowieniu. Mimo tego bezpieczeństwo prawne nie wydaje się być radykalnie zagrożone. O prawnonaturalnym charakterze normy i uzasadnienia decyduje oparcie w ocenach moralnych, które pretendują do bycia sądami, do bycia prawdziwymi lub fałszywymi. Z punktu widzenia stosowania konstytucji i wymogu intersubiektywnej komunikowalności i kontrolowalności dookreślania treści prawnonaturalnych, dla nadania ocenom charakteru sądów istotny jest kształt procedur i argumentacji prowadzących do tego dookreślenia. Powinny to być procedury i argumentacja typowe dla dyskursu mającego na celu sformułowanie prawdziwych sądów. Maksymalizowana powinna być dyskursywność takich procedur, a podstawą rozstrzygnięcia powinien być, jeśli to tylko możliwe, konsens. Nie mogą być uważane za rozstrzygające argumenty odwołujące się do woli indywidualnej lub zbiorowej, reakcji emocjonalnych, stopnia rozpowszechnienia danej oceny czy do tradycji kulturowej. (shrink)

The article discusses the presence of Plato' philosophy in Poland including the presentation of the reception of Plato's texts and the knowledge of Plato's philosophy in Poland. It outlines the influence exerted by Plato's thought on various aspects of Polish culture and sets out the research on Plato in the XIX and XX centuries. The paper is supplemented with a selection of contributions concerning Plato (papers, monographs, translations) published in Poland after the year 1945.

The Introduction outlines, in a concise way, the history of the Lvov-Warsaw School—a most unique Polish school of worldwide renown, which pioneered trends combining philosophy, logic, mathematics and language. The author accepts that the beginnings of the School fall on the year 1895, when its founder Kazimierz Twardowski, a disciple of Franz Brentano, came to Lvov on his mission to organize a scientific circle. Soon, among the characteristic features of the School was its serious approach towards philosophical studies and (...) teaching of philosophy, dealing with philosophy and propagation of it as an intellectual and moral mission, passion for clarity and precision, as well as exchange of thoughts, and cooperation with representatives of other disciplines. The genesis is followed by a chronological presentation of the development of the School in the successive years. The author mentions all the key representatives of the School, accompanying the names with short descriptions of their achievements. The development of the School after Poland’s regaining independence in 1918 meant part of the members moving from Lvov to Warsaw, thus providing the other segment to the name—Warsaw School of Logic. The author dwells longer on the activity of the School during the Interwar period—the time of its greatest prosperity, which ended along with the outbreak of World War 2. Attempts made after the War to recreate the spirit of the School are also outlined and the names of continuators are listed accordingly. The presentation ends with some concluding remarks on the contribution of the School to contemporary developments in the fields of philosophy, mathematical logic or computer science in Poland. The author examines the arguments for applicability of the limitation clause which specifies the requirements for limitation of constitutional freedoms and rights (Article 31 para. 3 of the Constitution) to the right to protection of life (Article 38). Even if there is almost a general acceptance of such applicability, this approach does not hold up to criticism based on the rule existing in the Polish legal order that treaty commitments concerning human rights have supremacy over national statutory regulations. Due (...) to an international pattern which does not provide application of the limitation clause to the right to life protection, despite the recognition — at the level of a constitutional standard — of applicability of the clause of Article 31 para. 3 to Article 38, and to protection of life in general, this will be made impossible at any attempt to formulate a statutory standard. He also points out the defectiveness of the reasoning leading to acceptance of certain limitations of a particular value (e.g. life) on the basis of the ex definitione exemptions existing in the international standard to the assumption of applicability of the limitation clause when shaping statutory standards in the Polish legal system. The discussed issues are related to the question of interpretation of the inviolability of human rights. This term takes different meaning in the context of: 1) inviolability of all human rights understood in abstracto as normative structures of a general and abstract nature; 2) right protecting certain values with no exception; 3) rights to which an application of the limitation clause is forbidden; 4) rights not subject to derogation; 5) inviolability of understood in concreto, as that is (here and now) due to the subject of dignity; 6) inviolable essence of freedoms and rights. One should also clearly distinguish between (7) the descriptive and (8) the normative meaning of inviolability. -/- Punktem wyjścia jest analiza argumentacji na rzecz tezy o stosowalności do prawa do ochrony życia (art. 38 Konstytucji RP), klauzuli limitacyjnej określającej warunki ograniczania konstytucyjnych wolności i praw (art. 31 ust. 3). Mimo niemal powszechnej akceptacji tej tezy, nie wytrzymuje ona krytyki opartej na pierwszeństwie, które w polskim porządku prawnym mają zobowiązania traktowe dotyczące praw człowieka, wobec regulacji ustawowych. Ze względu na wzorzec międzynarodowy, który nie przewiduje stosowania klasycznej klauzuli limitacyjnej do prawa do życia, mimo uznania - na poziomie standardu konstytucyjnego - stosowalności klauzuli z art. 31 ust. 3 do art. 38 i ochrony życia w ogóle, stosowalność tej klauzuli będzie uniemożliwiona przy każdej próbie formułowania standardu ustawowego. From the European point of view Zbigniew Antoni Jordan as a historian of the newest Polish philosophy In his article, the author presents Zbigniew Jordan’s works in the area of the history of philosophy, which are not well known in Poland. This representative of Lvov and Warsaw School was abroad, writing his habilitation thesis, when the World War II broke out. The war did not prevent him from active participation in the political life of Polish emigrants in Great (...) Britain. For the needs of current political activity he accomplished a lot of reliable and objective analyses of some geopolitical phenomena, which were a consequence of just finished war. Such kind of works made him take up serious historical studies and he started to use obtained experience to analyze the state and works of modern Polish philosophy, and especially the works of Lvov and Warsaw School. Furthermore, the article is an attempt to show the significance of Jordan’s works in propagating the history of Polish philosophy abroad. (shrink)

The article analyzes the main aspects of the interpretation of philosophical thinking by the Polish philosopher Leszek Kolakowskі (1927–2009). He is more known as a brilliant disputant on the history of Marxism and the prospects for the further development of Marxist theory, but his thoughts on the nature and functions of philosophical thinking in the broadest sense are of no less importance, since they address the painful issue of the autonomy of thinking. The purpose of the article is to (...) reconstruct the principles that, according to the philosopher, would allow thinking to maintain its autonomy under the pressure of ideas and ideologies. Utopia and nihilism in the interpretation of L. Kolakowskі appear as temptations of the modern world. It is in the quest for defending from these “monsters” (L. Kolakowskі) that the philosopher comes to the conclusion that the basis of utopia and nihilism are certain ideas about the truth. Through the prism of this theoretical discovery, he reveals the importance of consensus, tolerance, compromise, and non-consistency (inconsistency) as epistemological tools of support or undermining of ideologies. The basic epistemological model the philosopher used has been reproduced by means of theoretical reconstruction. This is the attitude of the subject to the truth, which is realized in two ways: to either master the truth on the basis of certain beliefs or neglect the truth on the basis of other beliefs. With the help of this model, the philosopher comes to understanding that dogmatism and unification are not only utopian diseases but also nihilists. The reason for this is loyalty to one’s own truth, that is, thinking without gaps based on unchanging principles and aimed at reproducing certain institutional and social constants. Instead, inconsistency as a principle forms a completely different setting, the advantage of which is that it extends to itself and frees a thinker from the need to be or not to be consistent, but does not relieve the search of truth and meaning, without which human existence is impossible, according to L. Kolakowskі. The reconstruction was carried out on the basis of analysis of articles and essays of various years, combined with the development of concepts of utopia and nihilism as alternative projects of human existence, rooted in the epistemological directions of the subject. This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of this expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the different concepts of dignity encompass dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve different concepts of dignity, and thus twelve types of dignity. Half of (...) them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law. They were considered in the essay Godność jako właściwość osoby. Typy godności – propozycja systematyzacji [Dignity as a Quality of Person – a Proposed Systematisation]. This group of meanings includes three concepts of dignity which recognize dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. The second group of meanings, treating dignity as something with which the human being (the person) is endowed, includes concepts which encompass (4) personal dignity (honour and good reputation), (5) dignity as moral excellence, and (6) dignity as appropriateness of attitude or behaviour. -/- Dignity as an attribute of collective entities and dignity as an institutionally grounded attribute are a subject of this paper. The Constitution of the Republic of Poland speaks of (1) the dignity of the Nation, (2) the dignity of office or function, and (3) public dignity. The expression “the dignity of the Nation” can be understood in four different ways: (i) analogously to the understanding of dignity of the person, (ii) of personal dignity, (iii) of dignity as moral excellence, and (iv) of dignity as appropriateness of attitude or behaviour. The expression “dignity” when designating something institutionally grounded can designate (4) the dignity of social roles, (5) the dignity of a profession, and – specifically to the Polish language – (6) dignity meaning a surname. -/- The author argues that it is unacceptable to ascribe different concepts of dignity to the expression “dignity” appearing in a specific legal provision. The author raises the question why Polish philosophy (by which he means Polish analytical philosophy, or the philosophy of the Lvov-Warsaw School) differs so much from what is known as 'Continental philosophy'. He identifies and analyses the following factors which have influenced philosophical developments in Poland: socialism, the connection between philosophy and mathematics, the influence of Austrian philosophy, the peculiar role of K. The Introduction outlines, in a concise way, the history of the Lvov-Warsaw School – a most unique Polish school of worldwide renown, which pioneered trends combining philosophy, logic, mathematics and language. The traditional picture of the development of analytical philosophy, represented especially by such thinkers as G. Frege, G. E. Moore, B. Russell or R. Carnap, whose attitude was generally anti-metaphysical, can, on closer study, be shown to be incomplete. This article treats of the Cracow circle – a group of Polish philosophers among whom are, above all, to be counted J. Salamucha, J. M. Bocheński, J. F. Drewnowski, and B. Sobociński, who were, at the beginning of the twentieth century, (...) fascinated by the development of modern formal logic and its application to philosophical thinking. They also attempted to apply it to Catholic philosophy. The result of their endeavours were many remarkable works introducing not only a defence of the use of modern philosophical approaches in Christian thought, but also the reconstruction, by means of formal logic, of significant proofs given by Scholastic authors. „Ruch Filozoficzny” and the freedom of scientific research in Poland (in 1947-1957 years). Presented article refers to the situation in the Polish philosophy, which took place between 40-50 of the twentieth century. Author’s reflections are carried on the example of attempts to reactivate in the realities of war, the polish philosophical journal “Ruch Filozoficzny” founded in 1911 by Kazimierz Twardowski. Political conditions have made the magazine was renewed twice, at each time was the greatest merit of Tadeusz Czeżowski. (...) He was assisted by the other representatives of the Lvov-Warsaw School, who worked in various academic centers in Poland. The reconstruction of the history of the magazine in the postwar years, will be based on previously unpublished archival material. In its conclusions, the author tries to point out of great importance of independent from the political authorities publishers on development of Polish philosophy. (shrink)

Zbigniew Jordan (1911–1977) – an outline to philosophical biography The 100th anniversary of Zbigniew Jordan’s birthday, which is coming soon, is an opportunity to remind this forgotten philosopher, classified in the second generation of Lvov and Warsaw School. His complex fortune reflects dilemmas and perplexities of Polish intelligence in the war and post-war times. Jordan, after defending his doctoral thesis in philosophy at Poznań University, continued his studies at Paris Sorbonne. At that time the prepared his postdoctoral thesis on (...) the notion of infinity. His work on this theme was interrupted by the outbreak of the WWII and Jordan participated in operations of Polish Army in the west. After the end of the war he started working in Radio Free Europe, Paris “Culture” and then in the centres of sovietology research in Europe and the United Stated. He has never come back to philosophy and only in the 1960s he undertook research work at English Universities at first as a lecturer and then as a professor of sociology. He died in the USA in 1977. Although Zbigniew Antoni Jordan did not accomplish any crucial discoveries in science, his life story is nearly a symbol of the historical turbulence and dilemmas, which were experienced by Polish intelligence at emigration. This paper discusses two novels by contemporary writer Inga Iwasiów (b. 1963), Bambino (2008) and Ku słońcu [Towards the Sun] (2010), in the context of geopolitical, ideological, social and psycho-cultural transformations as they specifically affect different generations of inhabitants of the Polish city of Szczecin (pre-1945 German Stettin) from 1945 until the first decade of the 21st century. Bambino covers the years 1945–1981, but also contains flashbacks to pre-war memory of Stettin and to the suppressed experiences of the new (...) post-war inhabitants, as well as ‘flash-forwards’ to post-1989, post-communist reality; Ku słońcu covers 1981 to the first decade of 2000s. It shows how the novels portray these transformations through the experience primarily of women (but not only) — in Bambino, through the main protagonists: Ula (formerly Ulrike), Anna and Marysia, and through that of the hidden narrator Magda (Marysia’s daughter born in the same year as the author, Iwasiów, 1963); and in Ku słońcu, primarily through the experience of Magda herself, as well as through that of two generations of ‘feminist’ academics: Małgorzata and Sylwia (in which it is hard not to perceive the personal experience of the author, though she is at pains to emphasize elsewhere that her work is a collective biography of the city, not so much of herself). The analysis follows Katarzyna Chmielewska’s supposition that contemporary Polish fiction dealing with the past ‘constantly oscillates between memory and genealogy’, and that it raises raw issues not yet addressed by historians; it also derives inspiration from the new ‘postdependency’ studies proposed by Hanna Gosk and Ryszard Nycz. It also attempts to capture the specific nature of Iwasiów’s use of language, her style of feminism, her method of portraying place, and the connections in her prose between place and memory. Polish translation of "John Searle: From Speech Acts to Social Reality", -/- We provide an overview of Searle's contributions to speech act theory and the ontology of social reality, focusing on his theory of constitutive rules. In early versions of this theory, Searle proposed that all such rules have the form 'X counts as Y in context C' formula – as for example when Barack Obama (X) counts as President of the United States (Y) in the context of US (...) political affairs. Crucially, the X and the Y terms are here identical. A problem arises for this theory for cases involving 'free-standing Y terms', as for example in the case of money in a computerized bank account. Here there is no physical X to which a status function might be attached. We conclude by arguing that Searle's response to this problem creates difficulties for his naturalistic framework. (shrink)

[A Polish translation of Steven James Bartlett, “Phenomenology of the Implicit,” Dialectica: Revue international de philosophie de la connaissance, Vol. 29, Nos. 2-3, 1975, pp. 173-188.] -/- This paper marks a juncture between the author’s studies in phenomenology and the transition he made to a study of what he has called a “metalogic of reference.” Published in 1974 in Polish translation, followed by its publication in English in 1975, “Phenomenology of the Implicit” describes the author’s “translation schema” that (...) permits certain of the central goals of Husserlian transcendental philosophy to be transposed to a framework that studies the preconditions of valid reference. The result of this translation was the development of the author’s “de-projective” approach to phenomenology, which he later dissociated from phenomenology in the form of a pure metalogic of reference. One of threats and challenges is the process of population ageing. The article attempt to recognition of specific safety problems of old men’s in Białystok. Safety is treated as necessary condition for far more researches on practical (...) solutions connected with the professional activity of seniors and growth of their social participation. Assurance of seniors safety can lead to lowering costs of their maintenance as well as the formation of positive attitudes towards old age and cultural openness. The article deals with relations between the individual and human rights on the one hand, and the State on the other, in the context of the Constitution of the Republic of Poland. The author poses the question whether the idea of subordination of the State to the individual is really a central idea of that constitution. He puts forward many arguments against such suggestion. These arguments relate, above all, to the arrangement of the constitution: a chapter concerning human rights is (...) chapter II, while chapter I deals with foundation of the State; the goals of the State are specified in the preamble including the following initial phrase “the existence and future of Poland as our Homeland” and in Article 5 where human rights are as subject of protection by the State is mentioned after independence and integrity of [its] territory; a general concept of human rights protection adopted in the constitution is dominated by the structures typical of law in its objective sense; the way of regulation admissible limitations on human rights differs from international standards; possibility of claiming human rights is constitutionally guaranteed, mostly by constitutional complaint which is above all aimed at correction of legal system, rather than claiming of rights by the individual; Article 1 (“The Republic of Poland shall be the common good of all its citizens”) interpreted as referring to Article 1 paragraph 1 of the April Constitution of 1935, one of the main ideas of which was precedence of the State over the individual. He also analyses the arguments in favour of the recognition of the idea of subordination of the State. Nevertheless, they cannot be accepted as resolving the question of whether it is a central idea of the constitution. These arguments include in particular: the principle of subsidiarity contained in the preamble, even if it has not been appropriately emphasized there; recognition of inherent and inalienable dignity of the person, but it was not until Article 30 that this provision has been contained and it does not determine the relations between the human dignity and rights and the State. The author suggests that the only conclusive way to justify the subordination of the State in relation to the individual as a central idea of the constitution is by means of Article 1. Taking into account, above all, preparatory work, we should reject the interpretation of that article referring to the April (1935) Constitution. Essential interpretative context may be found in preparatory work and social teachings of the Catholic Church, referred to therein. In that case, the common good means the entirety of the conditions of social life which favour the human development. These conditions include above all the respect for human dignity. Such interpretation of Article 1 gives priority to proposals on what the State should be to serve the individual rather than to safeguard obligations of citizens in relation to the State. (shrink)

Analizowane jest umiejscowienie komentowanego akapitu w całości preambuły, oraz prace nad projektem Konstytucji, które prowadzą ku refleksji nad kategorią dobra wspólnego w artykule 1. W centrum moich analiz jest argumentacja na (...) rzecz tezy, że dobrem wspólnym są warunki życia społecznego służące rozwojowi jednostek i że jednym z istotnych elementów dobra wspólnego jest poszanowanie praw człowieka. Bronisław Kasper Malinowski was a Polish anthropologist, ethnographer, and sociologist. Malinowski is often considered as a pioneer in the ethnographic field research methods, such as participant observation, interviews, and statistics. His studies focused on beliefs and forms of social organization. Malinowski is often recognized as one of the founders of modern social anthropology and functionalism.

It causes many difficulties for jurisprudence to define the notion of judicial activism. At the very beginning it had rather a journalistic character, but but over time it has become a serious charge against these judges who act on the basis of their vision of what the law ought to be like rather than what it actually is like. On the ground of the polish legal theory the echoes of the dispute about judicial activism are reflected in the discussions (...) about the nature of legal interpretation. Transposing the problem of activism into the problem of interpretation allows the use of analysis tools that were previously unavailable. One of these tools are concepts emerged on the neopragmatist philosophy of Stanley Fish. Fish tries to describe the nature of the interpretation in the context of reader-response criticism and the concept of interpretive communities. Application of Fish's philosophy in the field of legal theory provides constructive conclusions about the concepts of judicial activism and judicial law-making. (shrink)
