A presente pesquisa em desenvolvimento tem como propósito demonstrar por meio da interpretação das concepções filosóficas a influência de Gustav Radbruch tendo como ponto de partida o direito das obrigações. Por meio da análise da obra Filosofia do Direito, entende-se a perpetuação do autor como uma ponte para a compreensão dos conceitos de personalidade, propriedade e contrato, tendo como fundamento sempre as bases do direito alemão.

O homem no decorrer de sua evolução social sempre pôs a natureza como um objeto e dificilmente pensou ela como sendo parte de um complexo sistema influenciável pelos fatores humanos. Apesar da atualidade desse debate, a constituição brasileira de 1988 apresenta em diversas normas, a proteção do meio ambiente e a defesa do desenvolvimento sustentável como valor constitucional. Porém, desde a materialização desses princípios, pode-se perceber que as concepções defendidas não estão sendo defendidas ou interpretadas de acordo com o que (...) as normas expressam. (shrink)

According to some currents of modern historiography, Galilei's propensity for circular motion would have led him to consider this and not rectilinear motion as “natural motion”; therefore the principle of inertia could not be fully attributed to Galileo, which he would never have formulated. The question of the authorship of the principle of inertia certainly weighs on both nationalistic elements and returns of antigaleleism, while the question of its not explicit formulation as a principle is due to ignorance of the (...) type of organization that Galileo intended to give to the exposition of his physics. The author, after having hinted at possible prodromes of the principle of inertia and having reported the adverse opinions of illustrious historians of science (A. Koyré, I. B. Cohen, P. M. Duhem, P. Rossi, G. Holton), through a careful analysis of the Galilean writings, conducted on the digital versions with the help of text analysis programs, firmly reaffirms Galileo's authorship of the principle of inertia and the consequent principle of classical relativity. R. Feldman defends a general principle about evidence the slogan form of which says that ‘evidence of evidence is evidence’. B. Fitelson considers three renditions of this principle and contends they are all falsified by counterexamples. Against both Feldman and Fitelson, J. Comesaña and E. Tal show that the third rendition––the one actually endorsed by Feldman––isn’t affected by Fitelson’s counterexamples, but only because it is trivially true and thus uninteresting. Tal and Comesaña defend a fourth version of Feldman’s principle, which––they (...) claim––has not yet been shown false. Against Tal and Comesaña I show that this new version of Feldman’s principle is false. (shrink)

This article aims to review the standard objections to dualism and to argue that will either fail to convince someone committed to dualism or are flawed on independent grounds. I begin by presenting the taxonomy of metaphysical positions on concrete particulars as they relate to the dispute between materialists and dualists, and in particular substance dualism is defined. In the first section, several kinds of substance dualism are distinguished and the relevant varieties of this kind of dualism are selected. The (...) remaining sections are analyses of the standard objections to substance dualism : It is uninformative, has troubles accounting for soul individuation, causal pairing and interaction, violates laws of physics, is made implausible by the development of neuroscience and it postulates entities beyond necessity. This piece replies to a recently published article in the European Journal for Philosophy of Religion by J. L. Schellenberg and Paul Draper. They contend that the field of African philosophy of religion needs renewal, and they make several recommendations on how to achieve this. I agree with their recommendations, but I argue they have omitted a crucial problem and solution to renew the field; namely, a fundamental problem of the field is that it systemically excludes non-Western philosophies and scholars (...) and, therefore, the field needs to be decolonised. The analytical notion of ‘scientific style of reasoning’, introduced by Ian Hacking in the middle of the 1980s, has become widespread in the literature of the history and philosophy of science. However, scholars have rarely made explicit the philosophical assumptions and the research objectives underlying the notion of style: what are its philosophical roots? How does the notion of style fit into the area of research of historical epistemology? What does a comparison between Hacking’s project on styles of thinking and (...) other similar projects suggest? My aim in this paper is to answer these questions. Hacking has denied that his project of styles of thinking falls into the field of historical epistemology. I shall challenge his remark by tracing out the connections of the notion of style with historical epistemology and, more in general, with a tradition of thought born in France in the beginning of twentieth-century. Paul Feyerabend, one of the most original and nonconformist epistemologists of the 20th century, is known for describing science as an essentially anarchic enterprise characterized by different, sometimes contradictory, methods, approaches and ways of reasoning. But it was through his reflections on art and myth that he developed an even more radical view: there are different forms of human thought, each characterized by a different rationality and reality, and science is only one of them. According to Originalism, word types are non-eternal continuants which are individuated by their causal-historical lineage and have a unique possible time of origination. This view collides with the intuition that individual words can be added to the lexicon of a language at different times, and generates other problematic consequences. The paper shows that such undesired results can be accommodated without abandoning Originalism.

Translation of Aristotle's Metaphysics IV and VI, with notes. The translation is preliminary and intended as a provisional teaching tool to be also used in seminars and discussions with peers in order to reach a more elaborated version.

I discuss what Aristotle means when he say that scientific demonstration must proceed from necessary principles. I argue that, for Aristotle, scientific demonstration should not be reduced to sound deduction with necessary premises. Scientific demonstration ultimately depends on the fully appropriate explanatory factor for a given explanandum. This explanatory factor is what makes the explanandum what it is. Consequently, this factor is also unique. When Aristotle says that demonstration must proceed from necessary principles, he means that each demonstration requires the (...) principle that is the necessary one for the fully appropriate explanation of its explanandum. This picture also provides a key to understand Aristotle's thesis that scientific explanation depends on essences: it is the essence of the attribute to be explained that should be stated as the fully appropriate explanatory factor. In this paper, we develop an impure somatic theory of emotion, according to which emotions are constituted by the integration of bodily perceptions with representations of external objects, events, or states of affairs. We put forward our theory by contrasting it with Prinz's pure somatic theory, according to which emotions are entirely constituted by bodily perceptions. After illustrating Prinz's theory and discussing the evidence in its favor, we show that it is beset by serious problems—i.e., it gets the neural correlates (...) of emotion wrong, it isn't able to distinguish emotions from bodily perceptions that aren't emotions, it cannot account for emotions being directed towards particular objects, and it mischaracterizes emotion phenomenology. We argue that our theory accounts for the empirical evidence considered by Prinz and solves the problems faced by his theory. In particular, we maintain that our theory gives a unified and principled account of the relation between emotions and bodily perceptions, the intentionality of emotions, and emotion phenomenology. Translation of Aristotle's Physics I-II into Portuguese, with commentaries. Tradução para o português dos livros I e II da Física de Aristóteles, com comentários.

In this paper, three theories of progress and the aim of science are discussed: the theory of progress as increasing explanatory power, advocated by Popper in The logic of scientific discovery ; the theory of progress as approximation to the truth, introduced by Popper in Conjectures and refutations ; the theory of progress as a steady increase of competing alternatives, which Feyerabend put forward in the essay “Reply to criticism. Comments on Smart, Sellars and Putnam” and defended as late as (...) the last edition of Against method. It is argued that, contrary to what Feyerabend scholars have predominantly assumed, Feyerabend's changing attitude towards falsificationism—which he often advocated at the beginning of his career, and vociferously attacked in the 1970s and 1980s—must be explained by taking into account not only Feyerabend's very peculiar view of the aim of science, but also Popper's changing account of progress. Joint attention customarily refers to the coordinated focus of attention between two or more individuals on a common object or event, where it is mutually “open” to all attenders that they are so engaged. We identify two broad approaches to analyse joint attention, one in terms of cognitive notions like common knowledge and common awareness, and one according to which joint attention is fundamentally a primitive phenomenon of sensory experience. John Campbell’s relational theory is a prominent representative of the latter (...) approach, and the main focus of this paper. We argue that Campbell’s theory is problematic for a variety of reasons, through which runs a common thread: most of the problems that the theory is faced with arise from the relational view of perception that he endorses, and, more generally, they suggest that perceptual experience is not sufficient for an analysis of joint attention. In Posterior Analytics 71b9 12, we find Aristotle’s definition of scientific knowledge. The definiens is taken to have only two informative parts: scientific knowledge must be knowledge of the cause and its object must be necessary. However, there is also a contrast between the definiendum and a sophistic way of knowing, which is marked by the expression “kata sumbebekos”. Not much attention has been paid to this contrast. In this paper, I discuss Aristotle’s definition paying due attention to this contrast (...) and to the way it interacts with the two conditions presented in the definiens. I claim that the “necessity” condition ammounts to explanatory appropriateness of the cause. (shrink)

There are two standard conceptions of the functioning of and rationale for the diachronic will, i.e., for an agent's capacity to settle on her future conduct in advance. According to the pragmatic-instrumentalist view, the diachronic will benefits us by increasing the long-term satisfaction of our rational preferences. According to the cognitive view, it benefits us by satisfying our standing desire for self-knowledge and self-understanding. Contrary to these views, I argue for a constitutive view of the diachronic will: the rationale for (...) it is that it makes possible to engage in activities with a radically novel temporal structure, activities that are not merely continuous over time, but temporally integrated and unified. These activities are essential to our form of life and to our existence as temporally unified agents. The instrumental and cognitive benefits, if any, are merely secondary to the ontological ones. I discuss an important feature of the notion of cause in Post. An. 1. 13, 78b13–28, which has been either neglected or misunderstood. Some have treated it as if Aristotle were introducing a false principle about explanation; others have understood the point in terms of coextensiveness of cause and effect. However, none offers a full exegesis of Aristotle's tangled argument or accounts for all of the text's peculiarities. My aim is to disentangle Aristotle's steps to show that he is arguing (...) in favour of a logical requirement for a middle term's being the appropriate cause of its explanandum. Coextensiveness between the middle term and the attribute it explains is advanced as a sine qua non condition of a middle term's being an appropriate or primary cause. This condition is not restricted either to negative causes or to middle terms in second‐figure syllogisms, but ranges over all primary causes qua primary. (shrink)

Resumo Embora controversa, o contextualismo epistêmico alega oferecer a melhor explicação para alguns fenômenos analisados em epistemologia contemporânea, por exemplo: alega responder ou explicar o apelo de certos paradoxos e, ao mesmo tempo, manter a verdade de nossas alegações ordinárias de conhecimento. Conforme alegado por contextualistas, a vantagem de sua teoria ao explicar o apelo de certos paradoxos reside no fato de que nenhum princípio lógico precisa ser rejeitado. O paradoxo do prefácio – que consiste na aparente incoerência lógica que (...) ocorre quando o autor de um livro declara em seu prefácio que, apesar de acreditar que é altamente provável que tudo o que o livro afirma seja verdadeiro, também é altamente provável que o livro contenha, pelo menos, algum erro – parece não ter sido explorado o suficiente pelos contextualistas. Portanto, pretendemos sugerir uma versão do paradoxo do prefácio apresentando um argumento análogo ao argumento que os contextualistas costumam apresentar para explicar o paradoxo cético. Desta maneira, pretendemos oferecer, por meio de uma análise contextualista, uma explicação para o paradoxo do prefácio. Se a resposta contextualista é ou não adequada para esse paradoxo, isso será questão de disputa e não nos caberá discuti-la aqui. Meu objetivo é apenas sugerir que uma análise contextualista semelhante à aplicada ao paradoxo cético pode ser construída para explicar o paradoxo do prefácio. Gottfried Leibniz embarked on a research program to prove all the Aristotelic categorical syllogisms by diagrammatic and algebraic methods. He succeeded in proving them by means of Euler diagrams, but didn’t produce a manuscript with their algebraic proofs. We demonstrate how key excerpts scattered across various Leibniz’s drafts on logic contained sufficient ingredients to prove them by an algebraic method –which we call the Leibniz-Cayley (LC) system– without having to make use of the more expressive and complex machinery of first-order (...) quantificational logic. In addition, we prove the classic categorical syllogisms again by a relational method –which we call the McColl-Ladd (ML) system– employing categorical relations studied by Hugh McColl and Christine Ladd. Finally, we show the connection of ML and LC with Boolean algebra, proving that ML is a consequence of LC, and that LC is a consequence of the Boolean lattice axioms, thus establishing Leibniz’s historical priority over George Boole in characterizing and applying (a sufficient fragment of) Boolean algebra to effectively tackle categorical syllogistic. Starting from the case of insurance claims, I investigate the dynamics of acceptance, rejection and denial. I show that disagreement can be more varied than one might think. I illustrate this by looking at the Warren/Sanders controversy in the 2020 democratic primaries and at religious agnosticism.

We present epistemic multilateral logic, a general logical framework for reasoning involving epistemic modality. Standard bilateral systems use propositional formulae marked with signs for assertion and rejection. Epistemic multilateral logic extends standard bilateral systems with a sign for the speech act of weak assertion (Incurvati and Schlöder 2019) and an operator for epistemic modality. We prove that epistemic multilateral logic is sound and complete with respect to the modal logic S5 modulo an appropriate translation. The logical framework developed provides the (...) basis for a novel, proof-theoretic approach to the study of epistemic modality. To demonstrate the fruitfulness of the approach, we show how the framework allows us to reconcile classical logic with the contradictoriness of so-called Yalcin sentences and to distinguish between various inference patterns on the basis of the epistemic properties they preserve. Aristotle contrasts episteme and doxa through the key notions of universal and necessary. These notions have played a central role in Aristotle’s characterization of scientific knowledge in the previous chapters of APo. They are not spelled out in APo I.33, but work as a sort of reminder that packs an adequate characterization of scientific knowledge and thereby gives a highly specified context for Aristotle’s contrast between episteme and doxa. I will try to show that this context introduces a contrast in (...) terms of explanatory claims: on the one hand, episteme covers those claims which capture explanatory connections that are universal and necessary and thereby deliver scientific understanding; on the other hand, doxa covers the explanatory attempts that fail at doing so. In this paper, I argue against the popular philosophical thesis---aka the ‘own action condition’---that an agent can only intend one’s own actions. I argue that the own action condition does not hold for any executive attitude, intentions included. The proper object of intentions is propositional rather than agential (‘I intend that so-and-so be the case’ rather than ‘I intend to do such-and-such’). I show that, although there are some essential de se components in intending, they do not restrict the content (...) of intentions to one’s own actions. I then discuss the special way in which one’s own actions can figure in the content of one’s intentions, which shows that the distinction between intending and acting is less stark than it appears at first. This is a conclusion that many defenders of the own action condition might find appealing but which, I argue, is better supported by rejecting the own action condition. (shrink)

Há duas diferenças fundamentais entre esses dois direitos que os tornam independentes: (1) a direção da informação do direito de não saber é oposta a do direito à privacidade e (2) o âmbito do direito de não saber é maior do que o do direito à privacidade. Pretendo clarificar essas diferenças e fazer algumas qualificações sobre o direito de não saber, tal como (...) os requisitos para o seu exercício e os limites desse direito. Apesar de o foco da análise não ser sobre um direito jurídico de não saber, ela traz implicações relevantes para o tratamento jurídico tanto do direito de não saber, quanto para o direito à privacidade. I discuss the exact meaning of the thesis according to which the object of scientific knowledge is necessary. The thesis is expressed by Aristotle in the Posterior Analytics, in his definition of scientific knowledge. The traditional interpretation understands this definition as depending on two parallel and independent requirements, the causality requirement and the necessity requirement. Against this interpretation, I try to show, through the examination of several passages that refer to the definition of scientific knowledge, that the necessity requirement specifies (...) more exactly the causality requirement: what cannot be otherwise is the explanatory relation between the explanandum and the cause by which it is what it is. : To address the question “on what there is” raised by Quine, and to accomplish the task of comprehending exhaustively the many ontological units that populate the great province of Being, we propose as an alternative to Puntel’s ontology a new ontology designated as “Structural Ontology” (SO). Such ontology is based on systematic-structural theoretical foundations, but leads to a diverse view in which structured factual units, structural configurations (dynamics), as well as apparent ontological units (objects), all encompassed by the temporal (...) sub-dimension that interconnects them, understood as an internal sub-dimension of the macro-dimension of Being, co-subsist. In this sense, we begin by situating the ontological theme in current philosophical discussion from a Quinean perspective. We then present a concept of truth derived from our reading of puntelian philosophy, which will be the point of connection between language and the world. Subsequently, we show how from the concept of truth, after a brief foray into philosophical semantics, we arrive at the ontological field from the ontological categories of structure and ontological state. Finally, we outline, in its general features, our structural ontology, which includes its own ontological notions that give new directions to philosophical understanding of this great theme. Ian Hacking ha proposto una nozione, quella di "stile di pensiero" ("style of reasoning"), che fornisce un modello per caratterizzarli ed esaminare la loro genesi e il loro sviluppo. Experiences like pains, pleasures, and emotions have affective phenomenal character: they feel pleasant or unpleasant. Imperativism proposes to explain affective phenomenal character by appeal to imperative content, a kind of intentional content that directs rather than describes. We argue that imperativism is on the right track, but has been developed in the wrong way. There are two varieties of imperativism on the market: first-order and higher-order. We show that neither is successful, and offer in their place a new theory: reflexive (...) imperativism. Our proposal is that an experience P feels pleasant in virtue of being constituted by a Command with reflexive imperative content, while an experience U feels unpleasant in virtue of being constituted by a Command with reflexive imperative content : More of P!Less of U! This paper introduces the Monstrous Conclusion, according to which, for any population, there is a better population consisting of just one individual (the Monster). The Monstrous Conclusion is deeply counterintuitive. I defend a version of Prioritarianism as a particularly promising population axiology that does not imply the Monstrous Conclusion. According to this version of Prioritarianism, which I call Asymptotic Prioritarianism, there is diminishing marginal moral importance of individual welfare that can get close to, but never quite reach, some upper limit. (...) I argue that Asymptotic Prioritarianism faces a theoretical cost, that I call the Absolute Priority Principle. However, the Absolute Priority Principle is an extreme version of what I call the Trade-off Condition, an already noteworthy problem facing other (more widely endorsed) versions of Prioritarianism. I conclude that it is better for a theory to imply the Absolute Priority Principle and avoid the Monstrous Conclusion than to imply the Monstrous Conclusion and the Trade-off Condition. The potential for Asymptotic Prioritarianism is substantial. (shrink)

My object is Aristotle's discussion of principle of non-contradiction in the first stretch of Metaphysics IV.4. My main focus rests on the connections between Aristotle's discussion of the principle and some key notions of his (explicit or implied) semantics.

This is an introductory handbook for some of the main themes around the notion of predication in Aristotle. It does not aim at being exhaustive, but only sketches some important lines about the subject; it contains an introductory essay, besides the translation (into Portuguese) and commentary of basic texts (such as Posterior Analytics I-22, Categories 1-5, Interpretation 1-6 etc.).

ABSTRACTLinguistic evidence supports the claim that certain, weak rejections are less specific than assertions. On the basis of this evidence, it has been argued that rejected sentences cannot be premisses and conclusions in inferences. We give examples of inferences with weakly rejected sentences as premisses and conclusions. We then propose a logic of weak rejection which accounts for the relevant phenomena and is motivated by principles of coherence in dialogue. We give a semantics for which this logic is sound and (...) complete, show that it axiomatizes the modal logic KD45 and prove that it still derives classical logic on its asserted fragment. Finally, we defend previous logics of strong rejection as being about the linguistically preferred interpretations of weak rejections. (shrink)

I discuss the methodological passage in the begin- ning of Ethica Eudemia I.6 (1216b26-35), which has received attention in connection with Aristotle’s notion of dialectic and his methodology in Ethics. My central focus is not to discuss whether Aristotle is prescribing and using what has been called the method of endoxa. I will focus on how this passage coheres with the remaining parts of the same chapter, which also are advancing methodological remarks. My claim is that the meth- od of (...) Ethica Eudemia I.6 is in agreement with many features of Aristotle’s theory of explanation as presented in the Posterior Analytics: Aristotle’s main concern is a warning against misuses of explanatory arguments. This chapter argues in favour of three interrelated points. First, I argue that demonstration (as expression of scientific knowledge) is fundamentally defined as knowledge of the appropriate cause for a given explanandum: to have scientific knowledge of the explanandum is to explain it through its fully appropriate cause. Secondly, I stress that Aristotle’s notion of cause has a “triadic” structure, which fundamentally depends on the predicative formulation (or “regimentation”) of the explanandum. Thirdly, I argue that what has motivated Aristotle to (...) choose the syllogism as a demonstrative tool was precisely the fact that syllogisms are apt to express causal relations in their triadic structure. Instead of complaining against Aristotle’s preference for the syllogisms as demonstrative tools, I argue that Aristotle was fully aware of the advantages of regimenting the explanandum into a predication. One of these advantages is to abandon a purely extensional standpoint and to highlight the importance of the notion of relevancy in explanation. (shrink)

We discuss a well-known puzzle about the lexicalization of logical operators in natural language, in particular connectives and quantifiers. Of the many logically possible operators, only few appear in the lexicon of natural languages: the connectives in English, for example, are conjunction _and_, disjunction _or_, and negated disjunction _nor_; the lexical quantifiers are _all, some_ and _no_. The logically possible nand (negated conjunction) and Nall (negated universal) are not expressed by lexical entries in English, nor in any natural language. Moreover, (...) the lexicalized operators are all upward or downward monotone, an observation known as the Monotonicity Universal. We propose a logical explanation of lexical gaps and of the Monotonicity Universal, based on the dynamic behaviour of connectives and quantifiers. We define update potentials for logical operators as procedures to modify the context, under the assumption that an update by \( \phi \) depends on the logical form of \( \phi \) and on the speech act performed: assertion or rejection. We conjecture that the adequacy of update potentials determines the limits of lexicalizability for logical operators in natural language. Finally, we show that on this framework the Monotonicity Universal follows from the logical properties of the updates that correspond to each operator. (shrink)
