Waiting is a mundane yet inevitable customer experience. Surprisingly, little research has analyzed the effects of waiting on subsequent customer behavior. The current research explores a counterintuitive effect of waiting times on behavior during a shopping trip: Longer waits, compared with shorter waits, can lead to a larger number of purchases despite generating more negative emotional reactions. Results of a field study and three lab experiments demonstrate this effect in the context of waiting for hedonic products. Consistent with a social-inference (...) account, the experiments further show that the effect of waiting duration occurs when wait times are thought to depend on others’ preferences. This article explores the multifaceted effects of waiting duration on purchase behavior of hedonic products and sheds light on the social cognitions that underlie these effects. (shrink)

Representing species-specific proteins and protein complexes in ontologies that are both human and machine-readable facilitates the retrieval, analysis, and interpretation of genome-scale data sets. Although existing protin-centric informatics resources provide the biomedical research community with well-curated compendia of protein sequence and structure, these resources lack formal ontological representations of the relationships among the proteins themselves. The Protein Ontology (PRO) Consortium is filling this informatics resource gap by developing ontological representations and relationships among proteins and their variants and modified forms. Because (...) proteins are often functional only as members of stable protein complexes, the PRO Consortium, in collaboration with existing protein and pathway databases, has launched a new initiative to implement logical and consistent representation of protein complexes. We describe here how the PRO Consortium is meeting the challenge of representing species-specific protein complexes, how protein complex representation in PRO supports annotation of protein complexes and comparative biology, and how PRO is being integrated into existing community bioinformatics resources. Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR. The translational research community, in general, and the Clinical and Translational Science Awards (CTSA) community, in particular, share the vision of repurposing EHRs for research that will improve the quality of clinical practice. Many members of these communities are also aware that electronic health records (EHRs) suffer limitations of data becoming poorly structured, biased, and unusable out of original context. This creates obstacles to the continuity of care, utility, quality improvement, and translational research. Analogous limitations to sharing objective data in (...) other areas of the natural sciences have been successfully overcome by developing and using common ontologies. This White Paper presents the authors’ rationale for the use of ontologies with computable semantics for the improvement of clinical data quality and EHR usability formulated for researchers with a stake in clinical and translational science and who are advocates for the use of information technology in medicine but at the same time are concerned by current major shortfalls. This White Paper outlines pitfalls, opportunities, and solutions and recommends increased investment in research and development of ontologies with computable semantics for a new generation of EHRs. The Protein Ontology provides terms for and supports annotation of species-specific protein complexes in an ontology framework that relates them both to their components and to species-independent families of complexes. Comprehensive curation of experimentally known forms and annotations thereof is expected to expose discrepancies, differences, and gaps in our knowledge. We have annotated the early events of innate immune signaling mediated by Toll-Like Receptor 3 and 4 complexes in human, mouse, and chicken. The resulting ontology and annotation data set has (...) allowed us to identify species-specific gaps in experimental data and possible functional differences between species, and to employ inferred structural and functional relationships to suggest plausible resolutions of these discrepancies and gaps. Monoclonal antibodies are essential biomedical research and clinical reagents that are produced by companies and research laboratories. The NIAID ImmPort (Immunology Database and Analysis Portal) resource provides a long-term, sustainable data warehouse for immunological data generated by NIAID, DAIT and DMID funded investigators for data archiving and re-use. A variety of immunological data is generated using techniques that rely upon monoclonal antibody reagents, including flow cytometry, immunofluorescence, and ELISA. In order to facilitate querying, integration, and reuse of data, standardized terminology (...) for describing monoclonal antibody reagents and their targets needs to be used for annotating data submitted to ImmPort. We are developing the Neurological Disease Ontology (ND) to provide a framework to enable representation of aspects of neurological diseases that are relevant to their treatment and study. ND is a representational tool that addresses the need for unambiguous annotation, storage, and retrieval of data associated with the treatment and study of neurological diseases. ND is being developed in compliance with the Open Biomedical Ontology Foundry principles and builds upon the paradigm established by the Ontology for General Medical Science (OGMS) (...) for the representation of entities in the domain of disease and medical practice. We have begun work on two separate but related ontologies for the study of neurological diseases. The first, the Neurological Disease Ontology (ND), is intended to provide a set of controlled, logically connected classes to describe the range of neurological diseases and their associated signs and symptoms, assessments, diagnoses, and interventions that are encountered in the course of clinical practice. ND is built as an extension of the Ontology for General Medical Sciences — a high-level candidate OBO Foundry ontology that (...) provides a set of general classes that can be used to describe general aspects of medical science. ND is being built with classes utilizing both textual and axiomatized definitions that describe and formalize the relations between instances of other classes within the ontology itself as well as to external ontologies such as the Gene Ontology, Cell Ontology, Protein Ontology, and Chemical Entities of Biological Interest. In addition, references to similar or associated terms in external ontologies, vocabularies and terminologies are included when possible. Initial work on ND is focused on the areas of Alzheimer’s and other diseases associated with dementia, multiple sclerosis, and stroke and cerebrovascular disease. Extensions to additional groups of neurological diseases are planned. The second ontology, the Neuro-Psychological Testing Ontology (NPT), is intended to provide a set of classes for the annotation of neuropsychological testing data. The intention of this ontology is to allow for the integration of results from a variety of neuropsychological tests that assay similar measures of cognitive functioning. Neuro-psychological testing is an important component in developing the clinical picture used in the diagnosis of patients with a range of neurological diseases, such as Alzheimer’s disease and multiple sclerosis, and following stroke or traumatic brain injury. Vaccine research, as well as the development, testing, clinical trials, and commercial uses of vaccines involve complex processes with various biological data that include gene and protein expression, analysis of molecular and cellular interactions, study of tissue and whole body responses, and extensive epidemiological modeling. Although many data resources are available to meet different aspects of vaccine needs, it remains a challenge how we are to standardize vaccine annotation, integrate data about varied vaccine types and resources, and support advanced vaccine (...) data analysis and inference. To address these problems, the community-based Vaccine Ontology (VO) has been developed through collaboration with vaccine researchers and many national and international centers and programs, including the National Center for Biomedical Ontology (NCBO), the Infectious Disease Ontology (IDO) Initiative, and the Ontology for Biomedical Investigations (OBI). VO utilizes the Basic Formal Ontology (BFO) as the top ontology and the Relation Ontology (RO) for definition of term relationships. VO is represented in the Web Ontology Language (OWL) and edited using the Protégé-OWL. Currently VO contains more than 2000 terms and relationships. VO emphasizes on classification of vaccines and vaccine components, vaccine quality and phenotypes, and host immune response to vaccines. These reflect different aspects of vaccine composition and biology and can thus be used to model individual vaccines. More than 200 licensed vaccines and many vaccine candidates in research or clinical trials have been modeled in VO. VO is being used for vaccine literature mining through collaboration with the National Center for Integrative Biomedical Informatics (NCIBI). Multiple VO applications will be presented. (shrink)

Despite widespread agreement that privacy in the context of education is important, it can be difficult to pin down precisely why and to what extent it is important, and it is challenging to determine how privacy is related to other important values. But that task is crucial. Absent a clear sense of what privacy is, it will be difficult to understand the scope of privacy protections in codes of ethics. Moreover, privacy will inevitably conflict with other values, and understanding the (...) values that underwrite privacy protections is crucial for addressing conflicts between privacy and institutional efficiency, advising efficacy, vendor benefits, and student autonomy. -/- My task in this paper is to seek a better understanding of the concept of privacy in institutional research, canvas a number of important moral values underlying privacy generally (including several that are explicit in the AIR Statement), and examine how those moral values should bear upon institutional research by considering several recent cases. The Protein Ontology (PRO; http://purl.obolibrary.org/obo/pr) formally defines and describes taxon-specific and taxon-neutral protein-related entities in three major areas: proteins related by evolution; proteins produced from a given gene; and protein-containing complexes. PRO thus serves as a tool for referencing protein entities at any level of specificity. To enhance this ability, and to facilitate the comparison of such entities described in different resources, we developed a standardized representation of proteoforms using UniProtKB as a sequence reference and PSI-MOD as a post-translational modification (...) reference. We illustrate its use in facilitating an alignment between PRO and Reactome protein entities. We also address issues of scalability, describing our first steps into the use of text mining to identify protein-related entities, the large-scale import of proteoform information from expert curated resources, and our ability to dynamically generate PRO terms. Web views for individual terms are now more informative about closely-related terms, including for example an interactive multiple sequence alignment. Finally, we describe recent improvement in semantic utility, with PRO now represented in OWL and as a SPARQL endpoint. These developments will further support the anticipated growth of PRO and facilitate discoverability of and allow aggregation of data relating to protein entities. (shrink)

In recent years, sequencing technologies have enabled the identification of a wide range of non-coding RNAs (ncRNAs). Unfortunately, annotation and integration of ncRNA data has lagged behind their identification. Given the large quantity of information being obtained in this area, there emerges an urgent need to integrate what is being discovered by a broad range of relevant communities. To this end, the Non-Coding RNA Ontology (NCRO) is being developed to provide a systematically structured and precisely defined controlled vocabulary for the (...) domain of ncRNAs, thereby facilitating the discovery, curation, analysis, exchange, and reasoning of data about structures of ncRNAs, their molecular and cellular functions, and their impacts upon phenotypes. The goal of NCRO is to serve as a common resource for annotations of diverse research in a way that will significantly enhance integrative and comparative analysis of the myriad resources currently housed in disparate sources. It is our belief that the NCRO ontology can perform an important role in the comprehensive unification of ncRNA biology and, indeed, fill a critical gap in both the Open Biological and Biomedical Ontologies (OBO) Library and the National Center for Biomedical Ontology (NCBO) BioPortal. Our initial focus is on the ontological representation of small regulatory ncRNAs, which we see as the first step in providing a resource for the annotation of data about all forms of ncRNAs. In this paper we suggest a revisionist perspective on two significant figures in early modern life science and philosophy: William Harvey and John Locke. Harvey, the discoverer of the circulation of the blood, is often named as one of the rare representatives of the ‘life sciences’ who was a major figure in the Scientific Revolution. While this status itself is problematic, we would like to call attention to a different kind of problem: Harvey dislikes abstraction and controlled experiments (aside from (...) the ligature experiment in De Motu Cordis), tends to dismiss the value of instruments such as the microscope, and emphasizes instead the privileged status of ‘observed experience’. To use a contemporary term, Harvey appears to rely on, and chiefly value, ‘tacit knowledge’. Secondly, Locke’s project is often explained with reference to the image he uses in the Epistle to the Reader of his Essay, that he was an “underlabourer” of the sciences. In fact, despite the significant medical phase of his career, Locke’s ‘empiricism’ turns out to be above all a practical (i.e. ‘moral’) project, which focuses on the delimitation of our powers in order to achieve happiness, and rejects the possibility of naturalizing knowledge. When combined, these two cases suggest a different view of some canonical moments in early modern natural philosophy. (shrink)

Modern philosophy recognizes two major ethical theories: deontology, which encourages adherence to rules and fulfillment of duties or obligations; and consequentialism, which evaluates morally significant actions strictly on the basis of their actual or anticipated outcomes. Both involve the systematic application of universal abstract principles, reflecting the culturally dominant paradigm of technical rationality. Professional societies promulgate codes of ethics with which engineers are expected to comply, while courts and the public generally assign liability to engineers primarily in accordance with the (...) results of their work, whether intended or unintended. A third option, prominent in ancient philosophy, has reemerged recently: virtue ethics, which recognizes that sensitivity to context and practical judgment are indispensable in particular concrete situations, and therefore rightly focuses on the person who acts, rather than the action itself. Beneficial character traits—i.e., virtues—are identified within a specific social practice in light of the internal goods that are unique to it. This paper proposes a comprehensive framework for implementing virtue ethics within engineering. (shrink)

In the appendix to his Treatise Hume admits that his philosophy of mind is defective. Reluctantly he asserts that his thought has ensnared him in a labyrinth. Referring specifically to the section in the Treatise on personal identity and the self, the young Scot admits that he is “involv’d in such a labyrinth, that, I must confess, I neither know how to correct my former opinions, nor how to render them consistent.” (Treatise 633) My paper is a critical investigation of (...) this characterization of Hume’s predicament. I argue (1) that at best Hume is facing a dilemma, not a labyrinth, and (2) that the dilemma can be solved, and (3) that the resolution to Hume’s problem can be found in his conception of intelligibility. Background Retraction is a mechanism for alerting readers to unreliable material and other problems in the published scientific and scholarly record. Retracted publications generally remain visible and searchable, but the intention of retraction is to mark them as “removed” from the citable record of scholarship. However, in practice, some retracted articles continue to be treated by researchers and the public as valid content as they are often unaware of the retraction. Research over the past decade has identified a number of (...) factors contributing to the unintentional spread of retracted research. The goal of the Reducing the Inadvertent Spread of Retracted Science: Shaping a Research and Implementation Agenda (RISRS) project was to develop an actionable agenda for reducing the inadvertent spread of retracted science. This included identifying how retraction status could be more thoroughly disseminated, and determining what actions are feasible and relevant for particular stakeholders who play a role in the distribution of knowledge. -/- Methods These recommendations were developed as part of a year-long process that included a scoping review of empirical literature and successive rounds of stakeholder consultation, culminating in a three-part online workshop that brought together a diverse body of 65 stakeholders in October–November 2020 to engage in collaborative problem solving and dialogue. Stakeholders held roles such as publishers, editors, researchers, librarians, standards developers, funding program officers, and technologists and worked for institutions such as universities, governmental agencies, funding organizations, publishing houses, libraries, standards organizations, and technology providers. Workshop discussions were seeded by materials derived from stakeholder interviews (N = 47) and short original discussion pieces contributed by stakeholders. The online workshop resulted in a set of recommendations to address the complexities of retracted research throughout the scholarly communications ecosystem. -/- Results The RISRS recommendations are: (1) Develop a systematic cross-industry approach to ensure the public availability of consistent, standardized, interoperable, and timely information about retractions; (2) Recommend a taxonomy of retraction categories/classifications and corresponding retraction metadata that can be adopted by all stakeholders; (3) Develop best practices for coordinating the retraction process to enable timely, fair, unbiased outcomes; and (4) Educate stakeholders about pre- and post-publication stewardship, including retraction and correction of the scholarly record. -/- Conclusions Our stakeholder engagement study led to 4 recommendations to address inadvertent citation of retracted research, and formation of a working group to develop the Communication of Retractions, Removals, and Expressions of Concern (CORREC) Recommended Practice. Further work will be needed to determine how well retractions are currently documented, how retraction of code and datasets impacts related publications, and to identify if retraction metadata (fails to) propagate. Outcomes of all this work should lead to ensuring retracted papers are never cited without awareness of the retraction, and that, in public fora outside of science, retracted papers are not treated as valid scientific outputs. To enhance the treatment of relations in biomedical ontologies we advance a methodology for providing consistent and unambiguous formal definitions of the relational expressions used in such ontologies in a way designed to assist developers and users in avoiding errors in coding and annotation. The resulting Relation Ontology can promote interoperability of ontologies and support new types of automated reasoning about the spatial and temporal dimensions of biological and medical phenomena.

Within the United States, the most prominent justification for criminal punishment is retributivism. This retributivist justification for punishment maintains that punishment of a wrongdoer is justified for the reason that she deserves something bad to happen to her just because she has knowingly done wrong—this could include pain, deprivation, or death. For the retributivist, it is the basic desert attached to the criminal’s immoral action alone that provides the justification for punishment. This means that the retributivist position is not reducible (...) to consequentialist considerations nor in justifying punishment does it appeal to wider goods such as the safety of society or the moral improvement of those being punished. A number of sentencing guidelines in the U.S. have adopted desert as their distributive principle, and it is increasingly given deference in the “purposes” section of state criminal codes, where it can be the guiding principle in the interpretation and application of the code’s provisions. Indeed, the American Law Institute recently revised the Model Penal Code so as to set desert as the official dominate principle for sentencing. And courts have identified desert as the guiding principle in a variety of contexts, as with the Supreme Court’s enthroning retributivism as the “primary justification for the death penalty.” While retributivism provides one of the main sources of justification for punishment within the criminal justice system, there are good philosophical and practical reasons for rejecting it. One such reason is that it is unclear that agents truly deserve to suffer for the wrongs they have done in the sense required by retributivism. In the first section, I explore the retributivist justification of punishment and explain why it is inconsistent with free will skepticism. In the second section, I then argue that even if one is not convinced by the arguments for free will skepticism, there remains a strong epistemic argument against causing harm on retributivist grounds that undermines both libertarian and compatibilist attempts to justify it. I maintain that this argument provides sufficient reason for rejecting the retributive justification of criminal punishment. I conclude in the third section by briefly sketching my public health-quarantine model, a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. I argue that the model is not only consistent with free will skepticism and the epistemic argument against retributivism, it also provides the most justified, humane, and effective way of dealing with criminal behavior. Here it is proposed, in a synthesis of ideas by various authors, that in reality structures and mechanisms of a biological character underpin the world studied by physicists, in principle supplying detail (...) in the domain that according to regular physics is of an indeterminate character. In regular physics mathematical equations are primary, but this constraint leads to problems with reconciling theory and reality. Biology on the other hand typically does not characterise nature in quantitative terms, instead investigating in detail important complex interrelationships between parts, leading to an understanding of the systems concerned that is in some respects beyond that which prevails in regular physics. It makes contact with quantum physics in various ways, for example in that both involve interactions between observer and observed, an insight that explains what is special about processes involving observation, justifying in the quantum physics context the replacement of the unphysical many-worlds picture by one involving collapse. The link with biology furthermore clarifies Wheeler’s suggestion that a multiplicity of observations can lead to the ‘fabrication of form’, including the insight that this process depends on very specific ‘structures with power’ related to the 'semiotic scaffolding' of the application of sign theory to biology known as biosemiotics. -/- The observer-observed 'circle' of Wheeler and Yardley is a special case of a more general phenomenon, oppositional dynamics, related to the 'intra-action' of Barad's Agential Realism, involving cooperating systems such as mind and matter, abstract and concrete, observer and observed, that preserve their identities while interacting with one another in such a way as to act as a unit. A third system may also be involved, the mediating system of Peirce linking the two together. Such a situation of changing connections and separations may plausibly lead in the future to an understanding of how complex systems are able to evolve to produce 'life, the universe and everything'. -/- (Added 1 July 2018) The general structure proposed here as an alternative to a mathematics-based physics can be usefully characterised by relating it to different disciplines and the specialised concepts utilised therein. In theoretical physics, the test for the correctness of a theory typically involves numerical predictions, corresponding to which theories are expressed in terms of equations, that is to say assertions that two quantities have identical values. Equations have a lesser significance in biology which typically talks in terms of functional mechanisms, dependent for example on details of chemistry and concepts such as genes, natural selection, signals and geometrical or topologically motivated concepts such as the interconnections between systems and the unfolding of DNA. Biosemiotics adds to this the concept of signs and their interpretation, implying novel concepts such as semiotic scaffolding and the semiosphere, code duality, and appreciation of the different types of signs, including symbols and their capacity for abstraction and use in language systems. Circular Theory adds to this picture, as do the ideas of Barad, considerations such as the idea of oppositional dynamics. The proposals in this lecture can be regarded as the idea that concepts such as those deriving from biosemiotics have more general applicability than just conventional biology and may apply, in some circumstances, to nonlinear systems generally, including the domain new to science hypothesised to underlie the phenomena of present-day physics. -/- The task then has to be to restore the mathematical aspect presumed, in this picture, not to be fundamental as it is in conventional theory. Deacon has invoked a complex sequence of evolutionary steps to account for the emergence over time of human language systems, and correspondingly mathematical behaviour can be subsumed under the general evolutionary mechanisms of biosemiotics (cf. also the proposals of Davis and Hersh regarding the nature of mathematics), so that the mathematical behaviour of physical systems is consistent with the proposed scheme. In conclusion, it is suggested that theoretical physicists should cease expecting to find some universal mathematical ‘theory of everything’, and focus instead on understanding in more detail complex systems exhibiting behaviour of a biological character, extending existing understanding. This may in time provide a more fruitful understanding of the natural world than does the regular approach. The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on humans. This (...) framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

The seminal Satisfiability Coding Lemma of Paturi, Pudlák, and Zane is a coding scheme for satisfying assignments of k-CNF formulas. We generalize it to give a coding scheme for implicants and use this generalized scheme to establish new structural and algorithmic properties of prime implicants of k-CNF formulas. Our first application is a near-optimal bound of n⋅ 3^{n(1-Ω(1/k))} on the number of prime implicants of any n-variable k-CNF formula. This resolves an open problem from the Ph.D. thesis of Talebanfard, who (...) proved such a bound for the special case of constant-read k-CNF formulas. Our proof is algorithmic in nature, yielding an algorithm for computing the set of all prime implicants - the Blake Canonical Form - of a given k-CNF formula. The problem of computing the Blake Canonical Form of a given function is a classic one, dating back to Quine, and our work gives the first non-trivial algorithm for k-CNF formulas. (shrink)

Starting with the results of Li et al. in 1992 there is valuable interest in finding long range correlations in DNA sequences since it raises questions about the role of introns and intron-containing genes. In the present paper we studied two sequences that are the human T-cell receptor alpha/delta locus, Gen-Bank name HUMTCRADCV, a noncoding chromosomal fragment of M = 97630 bases (composed of less than 10% of coding regions), and the Escherichia Coli K12, Gen-Bank name ECO110K, a genomic fragment (...) with M = 111401 bases consisting of mostly coding regions and containing more that 80% of coding regions. We attributed the value (+1) to the purines and the value (-1) to the pirimidines and to such reconstructed random walk we applied the method of the Recurrence Quantification Analysis(RQA) that was introduced by Zbilut and Webber in 1994. By using dimension D=1 and Embedded Dimensions D=3 and D=5, we obtain some indicative results. Also by a simple eye examination of the reconstructed maps, the differences between coding and non coding regions are evident and impressive and consist in the presence in noncoding regions of long patches of the same colour that are absent in the coding sequence. At first sight this suggests a simple explanation to the concept of „long-range‟ correlation. On the quantitative plane, we used the %Rec., the %Det., the Ratio, the Entropy, the %Lam., and the Lmax that, as explained in detail in the text, represent the basic variables of RQA. The significant result that we have here is that both Lmax and Laminarity exhibit very large values in HUMTCRADCV and actually different in values respect to ECO110K where such variables assume more modest values. Therefore we suggest that there is the observed difference between HUMTCRADCV and ECO110K. The claimed higher long-range correlations of introns respect to exons from many authors may be explained here in reasonof such found higher values of Lmax and of Laminarity in HUMTCRADCV respect to ECO110K. Le respect de la vie privée et de l’intimité est un droit reconnu aux usagers des services de santé et des services sociaux par différents codes d’éthique, par la Charte des droits et libertés de la personne du Québec et par la Loi sur les services de santé et les services sociaux. Pour autant, la signification que prend ce droit demeure incertaine. Il n’y a pas une signification, mais bien des significations. S’appuyant sur un important travail d’observation dans deux comités (...) d’éthique clinique situés dans des établissements de santé et de services sociaux, les auteurs présentent et analysent ici un certain nombre de situations litigieuses dans lesquelles une interprétation du droit à la vie privée et à l’intimité a été faite. Au terme de l’exercice, il ressort entre autres que, selon les situations analysées, les discussions qui se font dans les CÉC conduisent à des modalités différentes (« déplacement et hiérarchisation », « opposition et évitement », « ouverture et compromis », « élargissement et remise en question ») qui ont pour effet de changer le regard porté sur l’usager et plus spécifiquement de faire comprendre son point de vue. En outre, si le droit à la vie privée et à l’intimité contribue à modifier l’interprétation que l’on se fait d’une situation ou des usagers, il est lui-même objet d’interprétation. C’est la diversité de sens qu’il peut prendre qui lui préserve son pouvoir d’interroger. (shrink)

Science is, if not the most, at least one of the most important human activities which has an undeniable impact on our lives. However, it is a matter of debate that science and its various applications have many negative effects besides their numerous positive contributions. As the negative effects of the science and its applications have become more visible, the science-value relation has regained popularity in the philosophy of science. Precautionary principle is one of the central concepts of the late (...) science-value debates. We first scrutinize the science-value relation, especially whether the science is value-free or value-laden activity, from the perspective of history and philosophy of science, and argue that sciences involve both epistemic and non-epistemic values. Then we introduce the precautionary principle and discuss the possible causes and outcomes of having it as a methodological component of scientific research. Finally, we argue that, if the science-value relation can be reestablished on ethical grounds, as the precautionary principle demands, the negative effects of science and its applications on human health and environment might be minimized and science could contribute more to human happiness. -/- Bilim yaşamımızı biçimlendiren en önemli insan etkinliklerinden birisi, belki de en önemlisidir. Ancak bilimlerin ve onun çeşitli uygulamalarının insan yaşamına olumlu katkılarının yanında insan ve çevre sağlığı üzerinde pek çok olumsuz etkilerinin de olduğu tartışılmaktadır. Bilim ve uygulamalarının insan sağlığı ve çevre üzerindeki olumsuz etkilerinin her geçen gün daha çok görünür hâle gelmesi, bilim-değer ilişkisini yeniden önemli bir tartışma başlığı hâline getirmiştir. İhtiyat ilkesi bilim-değer ilişkisi üzerine yapılan tartışmaların odağında yer alan kavramlardan biridir. Biz çalışmamızda önce bilim-değer ilişkisini, bilimin değerden bağımsız bir etkinlik olup olmadığını bilim tarihi ve felsefesi perspektifinden ele alıyor ve bilimlerin hem epistemik hem de epistemik olmayan değerler içerdiğini savunuyoruz. Daha sonra ihtiyat ilkesini ele alıyor ve onun bilimsel araştırmaların yöntembilimsel bir bileşeni hâline getirilmesinin olası nedenleri ve sonuçları üzerinde duruyoruz. Son olarak, bilim-değer ilişkisinin, ihtiyat ilkesi örneğinde olduğu gibi etik temelli kurulması durumunda bilim ve uygulamalarının insan sağlığı ve çevre üzerindeki olumsuz etkilerinin azaltılabileceğini ve bilimin insan mutluluğuna daha çok katkı sağlayabileceğini tartışıyoruz. Bilim üzerine yapılan tartışmalar her ne kadar geçmişten beri süregelmekte olsa da modern bilimin gelişimini gösteren bilimsel devrimler, bilim ve bilimsel bilginin ne olduğu tartışmalarını yoğun bir biçimde etkiler. Özellikle bilim hakkında yaygın bir biçimde ifade edilen geleneksel anlayışın temel iddialarından biri, deney bilimlerinin gelişmesine bağlı olarak deneyin de ön plana çıkması nedeniyle, bilimin temelinde saf deney ve gözlemin yer aldığıdır.

Considerando la disciplina degli effetti civili del matrimonio canonico, improntata a diversi “sistemi matrimoniali”, il volume ripercorre le vicende politiche e culturali che hanno segnato la storia dei rapporti tra le autorità statali e le autorità ecclesiastiche, lungo un periodo che copre circa due secoli, dal Code civil napoleonico del 1804 ai Codici degli Stati preunitari, dal Codice civile del 1865 del Regno d’Italia ai Patti Lateranensi stipulati dal regime fascista nel 1929, dalla discussione nell’Assemblea costituente nell’Italia repubblicana alle (...) vicende politiche degli anni Cinquanta e Sessanta, sino ai negoziati bilaterali che portarono all’Accordo di Villa Madama, ratificato il 25 marzo 1985. Esaminando le innovazioni formali e sostanziali introdotte nella riforma del matrimonio concordatario, si evidenziano le questioni che continuano a essere oggetto di controversie dottrinali e di sentenze delle corti di giustizia, volte a colmare le lacune e contraddizioni dell’attuale normativa matrimoniale. Dans une définition étroite, la communication renferme les transactions symboliques, c'est-à-dire les interactions par lesquelles plusieurs personnes assignent conjointement significations aux ensembles de signes. Grosso modo, les protagonistes de la communication transmettent ou réceptionnent messages et ainsi ils jouent alternativement le rôle du destinateur respectivement le rôle du destinataire. Mais la transmission et la réception sont actions très complexes parce qu'elles se réalisent par rapport à toutes paramètres nécessaires de la communication – le destinateur, le destinataire, le message, le (...) class='Hi'>code, le contexte et le canal – et satisfaient toutes les fonctions correspondantes du langage: expressive, conative, poétique, métasemique, référentielle et phatique. En transmettant un message, le destinateur (1) s'autorévèle, (2) exerce une influence sur le destinataire, (3) indique le niveau de sa performance communicative, (4) transfère une information syntactique (concernant le code utilisé), (5) désigne un fragment de la réalité et (6) établit une relation spécifique avec le destinataire. En corrélation avec les actes du destinateur, le destinataire procède à une interprétation complexe du message reçu et accomplit six actions complémentaires. Plus exactement, il (1') discerne les aspects personnels du destinateur, (2') répond à l'influence ressentie, (3') indique le niveau de sa compétence communicative, (4') établit une correspondance syntactique entre message et code, (5') confronte le message avec la réalité et (6') maintient, modifie ou annule sa relation avec le destinateur. Les dernières actions qui constituent ensemble l'interprétation peuvent être jugées à l'aide de trois valeurs fondamentales – la précision, la complétude et l'adéquation – et déterminent décisivement la réussite de la communication. Freedom is first apprehended as the pursuit of an activity which implies the choice to defend a thesis among other possible ones. This translation of the problem of freedom in an articulate language presupposes a complex nervous system and sensory apparatuses which we take for granted. In this study, I try to explore the undergrounds of the problem of freedom along with the suggestion that the notion of coding could enable one to bridge nature and the mind. When organisms invent, (...) are they doing it in a spontaneous manner, inscribing in their hereditary and mnemonic instructions a stochastic contrivance of random accidents, or are they attempting to select among a limited number of schemes endowed with some optimality of functioning? If we consider them as submitted to physical forces, it is to the extent that we make them part of a strategy to extend the "laws" of a nature understood to respond passively. I suggest in this study that the epistemological understanding must regionalize itself and admit a hierarchy of dispositions in relation to the phenomenon of selection. I end by suggesting the pursuit of affirmation instead of negation, as this alone contains the requirement of integration to the knowing subject as well as the form in its act of understanding, without giving it a spontaneist position. Supporters of neutrality as benign neglect argue that a neutral state should not grant any type of recognition to cultural or religious groups. Liberal multiculturalists argue instead that due to the non-neutral nature of public institutions, democratic states must adopt policies that recognize and accommodate the distinctive needs of ethnocultural groups. This article examines a different way of conceiving the principle of neutrality. In this conception, developed by Alan Patten in the framework of liberal multiculturalism, a state can only (...) be neutral when it extends equivalent levels of assistance/hindrance to rival conceptions of the good. Neutrality is thus reinterpreted to become a principle justifying the religious exemptions. The article highlights some aspects of this theory that should be reconsidered.// -/- Les défenseurs de la neutralité bienveillante soutiennent qu’un État neutre ne doit accorder aucun type de reconnaissance aux groupes culturels ou religieux. Les multiculturalistes libéraux avancent pour leur part que, en raison de la nature non neutre des institutions publiques, les États démocratiques doivent adopter des politiques vi-sant la reconnaissance et l’accommodement des besoins distinctifs des groupes ethnoculturels. Cet article examine une manière diffé-rente de concevoir le principe de neutralité. Dans cette conception, développée par Alan Patten dans le cadre du multiculturalisme libé-ral, un État ne peut être neutre que s’il assiste ou entrave de manière équivalente les différentes conceptions du bien. La neutralité est ainsi réinterprétée pour devenir un principe permettant de justifier les exemptions religieuses. L’article souligne certains aspects de cette théorie qui méritent d’être repensés. Wittgenstein Tractatus'ta anlamlı bir tümcenin işlevinin bir şey durumunu öne sürmek olduğunu belirtir ve böyle yapmayan bütün tümceleri anlam alanının dışına bırakır. Buna karşılık anlam alanının dışında kalan tümceler işlevsiz değildirler; onlar bir şeyleri gösterebilirler. Bu söylemek/göstermek ayrımı Tractatus için temel önemde olsa da ayrımın göstermek ile ilgili kısmını Wittgenstein yeterince açıklamaz. Bu yazıda bu kavramın özellikle de etik ve estetik söz konusu olduğunda bir bakış açısını göstermek olarak anlaşılabileceğini öne süreceğim. Algı çalışmalarında yaygın bir kavram olan bakış açısı, dilbilim (...) alanına özellikle metafor konusundaki çalışmalarla taşınmıştır. Bir metaforun belirli bir bakış açısı etkisi yaptığı sıklıkla söylenir. Wittgenstein'ın "göstermek" derken anlatmak istediği bir bakış açısı kazandırmak olarak yorumlanabilir. -/- In Tractatus, Wittgenstein states that the function of a meaningful sentence is to assert a state of affairs and excludes all sentences that do not do so from the realm of meaning. Sentences outside the realm of meaning, however, are not useless; they can show something. Although this saying/showing distinction is of fundamental importance for Tractatus, Wittgenstein does not clearly explain the part of the distinction related to showing. In this paper I will argue that this notion can be understood, especially in the case of ethics and aesthetics, as showing an aspect. Aspect, which is a widely used notion in perception studies, has been carried to the field of linguistics, especially with studies on metaphor. It is often said that a metaphor makes an aspectual effect. What Wittgenstein meant by "showing" can be interpreted as making someone recognise an aspect. (shrink)

Güvenilirci (reliabilist) bilgi teorisi, çağdaş epistemik gerekçelendirme kuramları içerisinde, dışsalcı (externalist) kuramın bir türü olarak kendisine yer bulmaktadır. Kısaca, bir inancı gerekçelendiren şeyin o inancın oluşturulduğu sürecin güvenilirliği olduğunu öne süren bu yaklaşım, bu bilişsel süreçleri özne dışı unsurlara bağladığı içinde dışsalcı bir pozisyonda yer almaktadır. Bu bilgi teorisinin tam karşı konumunda yer alan içselci (internalist) bilgi teorisi ise, özne merkezli bir yaklaşımla, doğru inancı gerekçelendirecek yöntemin, kişinin kendi zihinsel yapısından yola çıkarak, belli kognitif süreçler sonucunda ulaşılabileceğini öne sürmektedir. (...) Epistemik gerekçelendirme kuramları içerisinde birçok tartışmada kendisine yer bulan bu iki bilgi teorisi, kendi içerisinde de birçok farklı kurama kapı aralamıştır. Burada içselci bilgi teorisinden ortaya çıkan erişim içselciliği, farkındalık içselciliği gibi kuramları ve dışsalcı bilgi teorisinden ortaya çıkan süreç güvenilirciliği, gösterge güvenilirciliği ve erdem güvenilirciliği gibi farklı türden kuramları örnek olarak verebiliriz. Öte yandan çağdaş epistemolojideki bu tartışmalar, dini epistemoloji içerisinde de kendisine yer bulmuştur. Özellikle Alvin Plantinga, kendi dini epistemolojisi içerisinde dışsalcı bir tutum sergilemiş ve son dönem çalışmaları içerisinde de güvenilirci bir anlayışla Tanrı inancının epistemik mahiyetini ortaya koymaya çalışmıştır. Bu makalede öncelikle dışsalclık ve onun bir türü olan güvenilirci bilgi anlayışını ve bu kuramlara getirilen eleştirileri ele almaya çalışacağız, daha sonra A. Plantinga’nın son dönem dini epistemolojisinin de yönünü belirleyen güvence (warrant) kavramını açıklayıp, bu kavramın bütün teist dinlere uygulanabilirliğini sorgulayacağız. (shrink)

Thomas Kuhn’un 1962 yılında yayımlamış olduğu “Bilimsel Devrimlerin Yapısı” adlı kitabı bilimsel gelişme, bilimin doğası ve bilimsel bilginin özerkliği gibi çeşitli bilim felsefesi konularında alanında rölativist ya da göreci bir anlayışa katkıda bulunarak bilimin sarsılmaz statüsüne zarar verip vermediğine yöneliktir. Kuhn’un rölativistlikle suçlanmasına yol açan argümanlardan ön plana çıkan ikisi; iki farklı rakip paradigmaya bağlı olan kuramların kıyaslanmasının mümkün olmadığını ileri süren metodolojik eşölçülemezlik argümanı ile kuramdan bağımsız nötr gözlem önermelerinin olamayacağını belirten gözlemlerin kuram yüklü olduğu savıdır. Kuhn bu argümanlar (...) çerçevesinde kendisine getirilen görecilik iddialarına karşı çıkar ve bilim felsefecilerinin ona yöneltmiş olduğu eleştirilere yıllar içerisinde “Bilimsel Devrimlerin Yapısı” kitabının ek bölümlerinde cevap vermektedir. Bu bağlamda, Kuhn’un bu iddialara ikna edici bir cevap verip vermediğini tespit edebilmek ve onun gerçekten bilim ve bilimsel bilginin statüsü konusunda rölativist olup olmadığını soruşturmak için ortaya konulan eleştirilerin etraflıca ele alınması gerekliliği ortaya çıkmaktadır. Diğer bir deyişle, Kuhn'un görecilik konusu ile ilgili bir neticeye varabilmek amacıyla onun bütün bilim anlayışının göz önünde bulundurulması önemlidir. Dolayısıyla Kuhn'un genel bilim tasviri bu çalışmanın odağını oluşturmaktadır. Bu bakımdan çalışmada, ilk olarak kısaca “göreciliğin” ne anlama geldiği ortaya konulacak, ardından Kuhn’un eşölçülemezlik ve kuram yüklülük tezleri ayrıntılandırılarak, bu çerçeve içerisinde neden rölativist olarak kabul edildiği serimlenecektir. Nihai olarak, Kuhn'un kendisine getirilen eleştirilere karşı ortaya koyduğu cevapların rölativist suçlamalardan sıyrılması için sağlam gerekçeleri sağlayamadığı ortaya konulacaktır. (shrink)

Neuroscience hasn’t shown how quite similar sensory circuits encode quite different colors and other qualia, nor how the unified pictorial form of images is encoded, nor how these codes yield conscious images. Neuroscience’s fixation here on cortical codes may be the culprit. Treating conscious images partly as retinal substances may avoid these problems. The evidence for conscious retinal images is that (a) the cortical codes for images are quite problematic, (b) injecting retinas with certain genes turns dichromats into trichromats without (...) cortical help, (c) retinas can discern colors by themselves without cortex, (d) retinal distortions appear in images but cortical distortions don’t, (e) retinal detectors support finely detailed colors, but V4 detectors don’t, due to their big receptive fields, (f) retinal activity has pictorial form, but viable cortical codes for pictorial form don’t exist. So, the colors and unified pictorial form of images arguably arise mainly across arrays of retinal detectors—not from abstract cortical codes. Images may be hidden in retinal activity beyond what EEGs show of it (cf. Strawson’s monism). Also, cortex refines these retinal images but cortical impairment (anesthesia, lesions, etc.) blocks awareness of them, for they’re no longer accessible to the mind’s subject-centered consciousness, resident in cortex. This proposal is largely testable and based in recent evidence. It avoids neuroscience’s elusive, problematic coded images and enigmatic explanations of how they become conscious. (shrink)

In 1951 John Rawls expressed these convictions about the fundamental issues in metaethics: [T]he objectivity or the subjectivity of moral knowledge turns, not on the question whether ideal value entities exist or whether moral judgments are caused by emotions or whether there is a variety of moral codes the world over, but simply on the question: does there exist a reasonable method for validating and invalidating given or proposed moral rules and those decisions made on the basis of them? For (...) to say of scientific knowledge that it is objective is to say that the propositions expressed therein may be evidenced to be true by a reasonable and reliable method, that is, by the rules and procedures of what we may call "inductive logic"; and, similarly, to establish the objectivity of moral rules, and the decisions based upon them, we must exhibit the decision procedure, which can be shown to be both reasonable and reliable, at least in some cases, for deciding between moral rules and lines of conduct consequent to them.1 In this passage Rawls reconfigured the issue of moral objectivity and so reoriented the practice of metaethics from linguistic analysis to rational methodology. In so doing, his work has provided inspiration to philosophers as disparate in normative views as Thomas Nagel,2 Richard Brandt3, Alan Gewirth4, and David Gauthier.5 Rawls replaced the Moorean question, Do moral terms refer? with the Rawlsian question, Can moral judgments be the outcome of a rational and reliable procedure? He later gave a resoundingly positive answer to this question6 and later still, a more tentative one.7 Rawls' considered qualification of his earlier enthusiasm about the extent to which moral philosophy could be "part of the theory of rational choice"8 is a tribute to the seriousness with which he took his critics' objections. Amaç: Kanserle yaşayan bireylerin (KYB) bakımında, resmiyette görünür olmayan ve çoğunlukla herhangi bir profesyonel donanıma sahip olmayan, ama sürecin başından sonuna, hasta bireye eşlik eden bakım verenler kritik öneme sahiptir. Baş etmesi zor bir hastalık olan kanserle mücadele eden bireylerin bakımında, bakım verenler fiziksel, zihinsel ve sosyal birtakım zorluklarla karşılaşmaktadır. Bu araştırma, KYB’lere bakım veren, yakınlarının karşılaştıkları zorlukları gündeme getirmeyi ve ihtimam etiği perspektifinden, bakım verenlerin bakımına yönelik öneriler sunmayı amaçlamaktadır. Gereç ve Yöntem: Bu araştırma tanımlayıcı ve kesitsel olup araştırmanın (...) evreni Marmara Üniversitesi Pendik Eğitim ve Araştırma Hastanesi (MÜPEAH) Onkoloji kliniğinde takip edilen, 15 Mart-5 Nisan tarihleri arasında kemoterapi ünitesine ve servis hizmetlerine başvuran KYB’lerin bakım veren yakınlarıdır. KYB’lere bakım verenlerin umutsuzluk derecelerini tespit etmek ve bunu etkileyen faktörleri ölçmek için, veri toplama aracı olarak; sosyodemografik sorular, bakım alan bireyin hastalık derecesine yönelik sorular ve Beck Umutsuzluk Ölçeği sorularından oluşan bir anket elden dağıtılmıştır. Anket bakım verene yönelik sosyodemografik sorular 8, KYB’nin hastalığının durumu ile ilgili sorular 7, Beck Umutsuzluk Ölçeği 20 olmak üzere 35 sorudan oluşmaktadır ve yaklaşık 10 dakikada tamamlanmaktadır. Elde edilen veriler önce Microsoft Excel aracılığıyla dijitalleştirilmiş, ardından IBM SPSS 27.0.1 sürümüyle analiz edilmiştir. Verilerin analizinde Ki-kare, Fisher’s Exact testi ve Pearson Korelasyon analizi kullanılmış, istatistiksel anlamlılık değeri için p<0.05 kabul edilmiştir. Bulgular: Ankete katılan 151 bakım verenin 83’ü (%55,3) kadın, 67’si (%44,7) erkektir. Katılımcıların yaş ortalaması 40,09’dur. Bakım verenlerin %41,1’i umutsuzluk düzeyi ölçeğinde “minimal ya da yok”, %39,7'si "hafif düzeyde", %13.2'si orta düzeyde ve %6’sı “aşırı düzeyde” skorunu almıştır. KYB’lere bakım verenlerin demografik özellikleri ile umutsuzluk düzeyi arasında anlamlı bir ilişki bulunmamıştır. Bakım verenlerin yaşı, cinsiyeti, medeni durumu, gelir durumu ve bakım verme süresi ile umutsuzluk skorları arasında anlamlı bir ilişki bulunmazken, eğitim seviyesi ile umutsuzluk skorları arasında anlamlı bir ilişki bulunmuştur. (p=0,019). Sonuç: Bakım verenlerin, umutsuzluk düzeyleri göz önüne alındığında, önemli psikolojik yükler taşıdığına ve bu yükün, özellikle bakım verenin eğitim seviyesi ile hastanın sağlık durumu arasında belirgin ilişkiler gösterdiğine ulaşılmıştır. Bu bilgiler ışığında, sosyodemografik özelliklerin bakım verenleri önemli ölçüde etkilediği görülmüştür. Bakım verenlerin duygusal yükleri, bakım alıcılarla olan ilişkileri ve bu sürecin hem bireysel hem toplumsal düzeyde getirdiği zorluklar ve sorumluluklar, ihtimam etiği kapsamında ele alınmıştır. Araştırma neticesinde bakım verenlerin karşılaştığı zorluklar ve ihtiyaçlarının daha geniş bir toplumsal ve etik perspektiften ele alınmasının gerekliliği ortaya konmuştur. Bakım verenlerin bakımına yönelik öneriler, duygusal destek; teorik eğitim ve bilgilendirme desteği; pratik ve uygulamalı destek; kaynak erişimi ve tahsisi; tanıma ve doğrulama başlıkları altında sunulmuştur. Mimarlık diğer sanat dallarından iki bakımdan ayrılır. İlk olarak mimari yapıtlarla etkileşim kaçınılmazdır. Müzik dinlemeden, tiyatro veya sinemaya gitmeden, resim veya heykel sergilerini gezmeden yaşamımızı sürdürebiliriz ancak mimari yapılar olmadan bu olanaklı olmaz. Bu bakımdan mimarlık sanatlar içinde belki de insan yaşamını en fazla etkileyen daldır. İkinci olarak mimarlık bir yaşam gereksinimini karşılayan, böyle bir işlevi olan belki de tek sanat dalıdır. Örneğin resim, heykel, şiir, sinema veya tiyatro yapıtlarını sanatsal açıdan değerlendirirken hangi gereksinimimizi karşıladıkları sorusunu sormayız. Buna karşılık mimari (...) yapılar barınma başta olmak üzere bir dizi maddi gereksinimimizi karşılarlar. Hangi gereksinimi karşılamak amacıyla yapıldıkları sorusu onların sanatsal açıdan değerlendirilmesinde önem taşır. Bu yazıda mimarlığın sanatlar içindeki bu iki özgünlüğünü dikkate alan bir düşünürün, Ömer Naci Soykan'ın mimarlık konusundaki görüşlerini sırasıyla “mimarlıkta temel nitelikler”, “mimarlık etkinliği”, “mimarlık dili” ve “mimarlık estetiği” başlıkları altında ele alacağız. İletişimsel eylem kuramı stratejik eylemi dışlamakla bizi gerçekçi bir doğruluk kavramı geliştirmekten alıkoyar. Halbuki, gerçekçi bir doğruluk kavramı, kuramın öndayanaklarından biridir. O halde, yeni bir mantık aracılığıyla, stratejik eylemi de bünyesine alan, yeni bir iletişimsel eylem anlayışının olanaklılığı sorgulanabilir. Bu bildiride böyle bir anlayışın nasıl geliştirilebileceği üzerinde duracağım.

Van Rensselaer Potter (1911-2001), le biologiste à l’origine du terme « bioéthique » dans les écrits nord-américains, considère que « real bioethics falls in the context of the ideals of […] Aldo Leopold », un forestier, philosophe et poète ayant marqué le XXe siècle. Associer Leopold à Potter a pour effet de placer la bioéthique dans la famille des éthiques de l’environnement, ce qui la différencie du sens conventionnel retenu en médecine et en recherche depuis le Rapport Belmont (1979), une (...) déclaration ayant propulsé l’institutionnalisation de la bioéthique en Amérique du Nord. Cependant, diviser la bioéthique entre le médical et l’environnemental est réducteur. Potter propose au contraire une bioéthique globale s’intéressant aux enjeux situés à leur interface, dont ceux concernant la terre, la vie sauvage, la surpopulation, la consommation, etc. Cet article vise à amorcer un nouveau chantier d’analyse de la pensée de Potter en s’appuyant sur l’héritage de Leopold en biologie. Une synthèse de cette vision potterienne est proposée de manière à considérer son œuvre comme un tout cohérent s’intégrant aux grands débats qui transcendent les XXe et XXIe siècles. Sa vision apparaît comme une sagesse collective et prospective sous la forme d’une science de la survie et d’un code de bioéthique. Dépassant l’éthique de l’environnement, son association avec Leopold offre un modèle de la complexité s’imposant comme cas indissociable du contexte qui l’englobe, en améliorant nos façons d’intervenir en pratique dans un monde en constante transformation, à titre de gouvernance adaptative et de sagesse de la responsabilité. To describe computers and sophisticated robots, many people today have no problem using personal attributes. Alan Turing published his famous intelligence test in 1950. From that time onwards, computers have gained increasingly higher status in this regard. Computers and robots nowadays are not only intelligent. They perceive, they remember, they understand, they decide, they play and so on. Recently, another such step has occurred but, this time, many researchers are seriously concerned. In February 2017, the European Parliament passed a (...) Resolution to attribute legal personhood to intelligent robots. If this is accepted as law, it will have very serious consequences for our self-understanding and for the way we live together as a community. The EU Resolution has stimulated various studies, arising mainly from the area of legal studies. It is urgent that the response include also a philosophical evaluation regarding the fundamental concepts at play. This paper seeks to make a contribution precisely in this area. It explores the attribution of legal personhood to machines by focusing on what is happening at the level of meaning. It explores crucial concepts like responsibility, autonomy, person and quasi-person by drawing inspiration from the seminal works of Aristotle and L. Wittgenstein and from the ensuing debates between current philosophers like P. Hacker and D. Dennett. The results of this paper indicate what dangers could lie ahead and what could be the right way to avoid them. (shrink)

Demokratik devletlerin meşruiyet krizinin giderek derinleştiği ve çoğunlukçu, majoritarian, ideolojilerin etraflıca sorgulanmaya başlandığı çağımızda, demokrasiyi çoğunluk kararına ek olarak “rıza”, “Yurttaşlık”, “sivil özgürlük”, “kamusal uzlaşı” ve “Genel İrade” kavramlarıyla birlikte ele alan Rousseau’yu yeniden okumak önemlidir [...] Rousseau-demokrasi ilişkisinin kazılıp ortaya çıkartılacağı bu metinde uğranılacak olan kavramsal duraklar sırasıyla: Eşitsizlik (doğal ve toplumsal), (...) özgürlük (doğal ve sivil), politik bütün (bodypolitic), Genel İrade, ortak iyi (common good) ve Egemen olmalıdır. Söz konusu kavramlar, Rousseau’nun onlara yüklediği özgün anlamları gözden kaçırılmadan sanki ilk defa karşılaşılıyormuşçasına bir zihin açıklığı ile okundukları zaman, onun demokrasi görüşü de gün ışığına çıkartılabilir. Michel Foucault’nun çalışmalarının merkezi noktalarından birisini, Batı kültüründe insanların, özneye dönüştürülmesinin tarihini ortaya çıkarmak oluşturmaktadır. Diğerini ise, özneye dönüştürme tekniklerine karşı verilen mücadeleler, çeşitli iktidar tekniklerinin dayattığı bireysellik ve kimlikten kurtulmanın, özgürleşmenin imkânı oluşturmaktadır. İnsanları, öznelere dönüştüren süreçleri bir bütün olarak ele almak yerine, çeşitli nesneleştirme kipleri üzerinden incelemenin daha akıllıca bir yol olduğunu düşünen Foucault, çalışmalarında insanı özneye dönüştüren üç ayrı nesneleştirme kipine yoğunlaşır. Bunlar; kendilerine bilim statüsü kazandırmaya çalışan filoloji gibi araştırma kipleri, deli ile akıllı, hasta ile sağlıklı, (...) suçlular ile “iyi çocuklar” gibi “bölücü pratikler” olarak adlandırılan pratiklerde ortaya çıkan nesneleştirilme kipleri ve son olarak cinsellik gibi alanlarda bir insanın kendini özneye dönüştürme biçimindeki nesneleştirme kipleridir. İnsan, özneye dönüştürme süreçlerine girerken, iktidar ilişkilerine de dâhil olur. Çünkü bireyleri özne yapan iktidar teknikleridir. Özne sözcüğünün taşıdığı bütün anlamlar, boyun eğdiren ve tabi kılan bir iktidar biçimi telkin etmektedir. Bundan dolayı, özneye dönüşme süreçlerine karşı mücadeleler söz konusudur. Özne, iktidar ve şiddet arasındaki ilişkinin nasıl kurulduğuna dair düşünen Foucault, öznesi olarak tanıtıldığımız deneyimlerin kurulmasını gerçekleştiren bir iktidar alanı olduğunu, şiddetin de modern iktidarın kurumsal ağı içerisinde gelişen öznellik deneyimleri çerçevesinde her yere sirayet ettiğini belirtmektedir. İktidarın kurumsal düzeyde, düzenleyici ve denetleyici mekanizmalar sayesinde toplumsal ağın en uç yerlerine kadar sirayet etmesiyle birlikte şiddet, normlar, tüzükler ve prosedürler aracılığıyla belirli bir kapatma içinde gelişmektedir. Ancak, Foucault, şiddetin, iktidarın etkili bir aracı olduğunu kabul etse de, iktidarın esasını oluşturmadığını belirtmektedir. Bu çalışmada, Foucault’nun kuramsal çözümlemelerinden hareketle, özne, iktidar ve şiddet arasındaki ilişkiyi nasıl ele aldığı tartışılacak, onun düşünsel serüveni açısından önemli olan bu kavramların kendi tarih anlayışı bağlamında bir çözümlemesi yapılacaktır. Ayrıca, modern iktidar ilişkilerinin dayatmış olduğu öznellik deneyimlerine ve inceltilmiş şiddet araçlarına karşı verilecek direnişin imkânları sorgulanacaktır. -/- . (shrink)

Bilim tarihi çalışmaları belirli bir bilim imgesi ışığında yapılır ve söz konusu imgeyi yeniden üretir. Bu nedenle bilim tarihi ve bilim felsefesi bir bütün olarak ele alınmalıdır. Ancak var olan bilim tarihi yazımı geleneği kimi zaman bilim felsefesi alanında bazı önemli değişimleri yansıtmayı güçleştirmektedir. Bu yazıda Mary Anning örneği üzerinden gözlemin kuram yüklü olduğu görüşünün bilim tarihi yazımını nasıl yönlendirmesi gerektiğini tartıştım. -/- Research in history of science is conducted in light of some image of science and in the end (...) it reproduces that image. Hence history of science and philosophy of science should be considered as a whole. Yet the existing tradition in historiography of science sometimes obstructs reflecting some important changes in philosophy of science. Dinî tecrübe Friedrich Schleiermacher (ö.1768) ile önem kazanan ve William James’in (ö.1842) eserleriyle din felsefesinde teistik delillerin içine dahil olan bir delildir. Dini tecrübelerin birçok şekilde meydana geldiği iddia edilmektedir. Bunlardan biri de sezgidir. Bu bildirinin amacı sezgisel bilginin Tanrı’nın varlığına delil olup olmadığını ortaya koymaktır. Sezgisel yetenek, insanın fiziksel gelişimine (yani beyin) paralel olarak gelişen bir yetidir ve zihnin gelişmesiyle birlikte kapasitesi artmaktadır. Önce çocukta duygusal bir sezgi hakim iken (4-7 yaş), daha sonra çocuğun somut işlemlere geçmesiyle sezgisel yetenek (...) somutla ilişkili hale gelir. (7-11 yaş) Ve somut nesne ve durumlar (deney ve pratikler) çocuğun sezgisel yeteneğinin gelişmesine yol açar. En son aşamada yani soyut işlemler döneminde (11-17 yaş) çocuğun beyninde prefrontal lobun gelişmesine bağlı olarak akli muhakeme gelişir ve bunun etkisiyle sezgisel yetenek, akli verileri kullanarak soyut sezgiye yönelir. Sezgisel yetenek böylece üç dönemin özelliklerini gösterebilir; çocukluktan aldığı duygusal sezgi ve somut/nesnenin çağrıştırdığı somut sezgi ve aklın dış dünyadan aldığı bilgileri zihinsel süreçlerden geçirerek işlemesi sonucu gelişen akılcı sezgi. O nedenle insanlarda tek bir sezgiden bahsetmek yanlıştır. Sezginin üç türü birbiriyle eş güdümlü olarak bilgiyi elde etmek için çalışır. Bu üç sezgi türünden akılcı sezgiye önem veren İbn Sina, sezgi bilgisini rasyonel, epistemolojik alana dahil eder. Yaptığı ilim sınıflamasında sezgi bilgisini deneye dayalı bilgi türü olarak görür ve akla/deneye dayalı bir sezgi anlayışı geliştirir. Bu sezgi anlayışı, peygamberliği rasyonel bir temele oturtmak ve irrasyonel olmadığın açıklamak için de kullanır. Kudsi akla sahip peygamberler üstün zekalarının etkisiyle güçlü sezgiye sahip olurlar ve vahiy alırlar. Vahiy alan sezgisel yetenek diğer insanlarda ortaya çıkıp dini tecrübeleri şekillendirebilir mi? Peygamberlerin vahiy tecrübesini taklit ederek kendilerinde yüksek sezgisel yeti olduğunu savunan bazı kişiler (veli) ilham yoluyla bilgi elde ettiklerini iddia etmişlerdir. Dini tecrübe delilinde bu tür tecrübeler dini delil olarak sayılmaktadır. Fakat bu sezgisel bilginin kaynağı duygu mudur, somut bir gösterge (deney) midir yoksa akıl mıdır? İlham ürünü olan eserlerde her zaman duygu vardır ve bu tür ifadeler insanı duygunun hakim olduğu zihinsel bir duruma götürür. Fakat vahiy tecrübesinde duygunun yanında, somut dünyanın varlığı ve akla dayalı bir sezginin olduğu da vurgulanmaktadır. O nedenle sezgisel bilgi ürünü vahiy üç tür sezgi bilgisine dayalı iken, ilham ürünü olan sezgisel bilgi sadece duyguya dayalıdır. O nedenle ‘dini’ bir delil olarak değil ‘mistik’ bir delil olarak değerlendirmeyi hak eder. (shrink)

Bilimi ve bilimsel bilgiyi kültür, değer ve öznel yargılardan izole ederek nesnel bir şekilde ortaya koyabilmeye yönelik hararetli tartışmaların yaşandığı yirminci yüzyıl bilim anlayışının temel gayesi, deney ve gözleme tabi olabilecek fiziki dünyadaki olguları, mantıksal çözümlemeye tabi tutarak birleştirilmiş bilime ulaşmaktır. Bu amaca giden yolda olgulara dayanmayan ve sınanamayan her türlü metafizik öge yok sayılır. Bilimsel bilginin sadece deney ve gözleme tabi olana, diğer bir deyişle olgu verilerine dayandığı iddiasını taşıyan bu düşünce sistemi, özellikle Viyana Çevresi üyeleri tarafından benimsenmiştir. Bu (...) bakımdan Çevre üyelerinin bilimsellik anlayışındaki temel ölçüt olgulara dayanan önermelerin ya da yargıların doğrulanabilmesidir. Bilimsel bilginin sadece olgusal dünyanın gözlemlenmesi ve bu gözlem sonucunda ortaya konulan önermelerin ya da ifadelerin doğrulanmasıyla sağlandığını düşünen Çevre üyelerinin bu savlarındaki amacı bilimi ve onun bilgisini her türlü kültür ve değer alanından uzaklaştırarak metafiziksel unsurlardan arındırılmış nesnel bilgiye ulaşmaktır. Çevre üyelerinin birçoğu bilim alanı içerisinde tartışmaya yol açan meselelerin aslında metafiziksel içerikli ve dolayısıyla bunların görünüşte problemler olduğunu belirterek bu tartışmaların bilimsel bilginin gelişimi önünde bir engel oluşturacağı kanaatindedir (Hızır, 1965, s. 254). Söz gelimi, Carnap’a göre, metafizik ögeler olgusal içeriğe sahip olmadığı ve sınanabilir nitelikte olmadıkları için bilim alanı içerisinde değerlendirilemez. Bu nedenle, metafizik ögeler hem doğrulanması mümkün olmadığı hem de dilin mantıksal dizimine genellikle uymadığı gerekçesiyle anlamsızdır (Öztürk, 2011, s. 155). Bu bakımdan Çevre üyelerine göre, olgulara dayanmayan ve bilimde yanılsamalara yol açan metafizik söylemler bilimden ayıklanmalı ve bilimsel bilgi ancak olgu ve deneye dayanan önermeler üzerinden yürütülmelidir. Öte yandan Çevre düşünürleri mantıksal çözümleme yoluyla olgulara dayanan önermelerin metafiziksel unsurlar içeren önermelerden ayırt edilebileceğini ifade etmiştir. Bu bağlamda metafizik önermeleri, metafizik olmayan önermelerden ayırt edecek ölçütün doğrulanabilirlik olduğunu savunurlar. Çevre üyelerinin bu tutumları bir bakıma bilim ve sözde bilim arasında ayrım yapma ve metafiziği bilimin dışında tutma çabası olarak da değerlendirilebilir (Kabadayı, 2011, s. 39-40). Yirminci yüzyıl bilim anlayışında bilimsel etkinlikte gözlemin ve gözlemi yürüten bilim insanlarının dolaysız öznel duyu verileriyle ilişkili olduğu bu nedenle gözlem verilerinin psikolojizmin etkisinde olduğu fikri ortaya atılır. Başta Neurath olmak üzere dönemin bilim felsefecileri bilimsel bilginin kültür, değer ve psikoloji gibi öznel unsurlardan uzaklaştığı sürece değerli olduğu kanısında olduğu için bu fikre karşı çıkmaktadır (Gillies, 2018, s. 123). Görüldüğü üzere, Çevre üyelerinin temel amacı metafizik önermelerden arındırılmış, olgulara dayanan bir bilime ulaşmaktır. Bu amacın gerçekleşmesine olanak sağlayacak yöntem ise mantıksal çözümlemedir. Bu bağlamda Çevre üyeleri olgulara dayanan ve doğrulanabilen önermelerin, söz dizimi (sentaks) ve anlamsal (semantik) açıdan incelemeye tabi tutulması gerektiğini düşünmektedir (Yardımcı, 2018, s. 13-15). Özellikle Carnap (1935, s. 9-10) doğrulamanın ancak öne sürülen önermenin mantıksal analize tabi tutularak yapılması gerektiğini iddia etmiştir (Irzık, 1962, s. 65). Bununla birlikte, felsefenin işlevi, önermeleri mantıksal analize tabi tutarak yalın hale getirmektir. İşte felsefenin bu yönü Neurath’da bilimin birliği, Carnap’ta ise bilimin sentaksı, yani bilimin mantığı üzerine çalışma anlamına gelir (Hızır, 1965, s. 252). Bilimi, bilim olmayandan ayırma yöntemi olarak kullanılan doğrulama işlemi, teorik bir söylem ve gözlem önermesi arasında yapılan bir işlem olması bakımından mantıksal ve dilsel bir özellik taşır. Buradaki temel sorun ise teorik bir önermenin gözlem önermelerine indirgenebilir nitelikte olması ve gözlem önermelerinin, gözlem ile nasıl ilişki kurduğunu saptamaktır. İşte Viyana Çevresi üyeleri bu ilişkinin protokol önermeleri ile kurulduğu kanaatindedir (Ural, 2012, s. 105-107) çünkü onlara göre; öznelerarası bir bilimin sağlanması için yansız ve anlam karmaşasından arındırılmış bir dil gereklidir (Serin, 2015, s. 55). Bu dil de ancak protokol önermeler aracılığıyla kurulabilir. Bu bağlamda Çevre üyelerinin, metafiziksel ifadeler barındıran önermelerin anlamsızlığı ve bilimleri ortak bir paydada birleştiren fiziksel bir dil oluşturma olmak üzere iki temel hedefinin olduğu söylenebilir (Godfrey-Smith, 2003, s. 25; Salgar, 2012, s. 187).
