In this paper we elaborate on the neo-Confucian interpretation of the Yi-Jing system. Based on a further exploration of the Diagram of the Supreme Polarity of Zhou Dunyi, we develop a cosmological-anthropological model in constructive engagement with Western thoughts and views on systems and on the universe. The vital energy and the pattern play central roles in this model and also in the interpretation of the images and forces of the trigrams. This leads to a comparative model, based on a (...) quadrant system with four perspectives: naturality, rationality, humanity and morality. This model fits in the quadrant system of Wilber, and also corresponds to the cosmic ring of duograms. The natural YI Ba-Gua, a cycle of trigrams where Heaven and Earth are seen as elements of the production cycle, supplies an alternative interpretation of the King Wen Ba-Gua. When extending the quadrant system to octants we observe a cycle of trigrams, the cosmic YI Ba-Gua, as a spiralling sequence, following the order of the Five elements. Heaven and Earth are seen, as in the elaborated Diagram of the Supreme Polarity, as instigator and receiver respectively of the production cycle. It forms the framework for an alternative interpretation of the Fu Xi Ba-Gua. In addition to the images, we can display the forces of the trigrams in the octant system of the cosmic YI Ba-Gua as concentric circles. In the YI Ba-Gua we combine both the cosmic and the natural YI Ba-Gua, and compare this with the Ba-Gua of King Wen and of Fu Xi. Finally we present some hypotheses for further analysis of the matrix of hexagrams based on the cosmic YI Ba-Gua. The comparison of the different philosophical views in one framework may lead to further engagement of these ways of seeing. We already conclude that there is so much structure in the Yi-Jing that it is possible to use the wisdom of the Yi-Jing without applying a divination system. (shrink)

Mystical religious experiences typically purport to engage with the transcendent and often claim to involve encounters with spiritual entities or a detachment from the material world. Daoism diverges from this paradigm. This paper examines Daoist mystical experiences of bodily transformations and explores their epistemological implications. Specifically, we defend the justificatory power of Daoist somatic experiences against the disanalogy objection. The disanalogy objection posits that mystical experiences, in contrast to sense perceptions, are not socially verifiable and thereby lack prima facie epistemic (...) value. We argue that some Daoist mystical bodily states, being essentially spatiotemporal, are exempt from this challenge. This leads to a broader understanding of mysticism and offers a partial resolution to the disanalogy objection. (shrink)

A deterrence theory of punishment holds that the institution of criminal punishment is morally justified because it serves to deter crime. Because the fear of external sanction is an important incentive in crime deterrence, the deterrence theory is often associated with the idea of severe, disproportionate punishment. An objection to this theory holds that hope of escape renders even the severest punishment inapt and irrelevant. -/- This article revisits the concept of deterrence and defend a more plausible deterrence theory of (...) punishment—the wide-scope deterrence theory. The wide-scope theory holds that we must make the best use of all the deterrence tools available, including both external and internal sanctions. Drawing on insights from the early Confucian tradition, the article develops a deep deterrence theory, which holds that the most important deterrence tool involves internal, not external, sanction. It describes how internal sanctions deter potential offenses and why relevant policies need not conflict with liberalism’s respect for neutrality. (shrink)

Despite the good intention of humanitarian agencies, humanitarian assistance and relief aid exacerbated the humanitarian crisis in Tanzania during 1994. In the case of Tanzania, humanitarian assistance relieved belligerents’ burden of sustaining conflicts, created safe spaces for armed combatants, undermined local economies, bestowed legitimacy upon belligerents, and fed armed combatants. This situation hence posed the typical humanitarian assistance dilemma for humanitarian agencies. While most scholars and aid practitioners suggest that humanitarian agencies should withdraw their assistance in these contexts given aid’s (...) apparent negative impact, there is relatively little research that properly identifies different kinds of ethical constraints and moral dilemmas that have long challenged humanitarian agencies. Referencing the case of late-twentieth-century Tanzania, this article contextualises the humanitarian assistance dilemma and systematically examines the ethical predicaments that surround it. Its analysis sheds light on moral quandaries that humanitarian agencies need to address in conflict situations. (shrink)

A widely shared intuition says moral statements like “Aborting at 150 days is permissible” seem vague. But what is the nature of such vagueness? This article proposes a novel, shifty semantic account of moral vagueness which argues: Moral vagueness is essentially a semantic phenomenon existing in our imperfect (moral) language; the referents of vague moral terms may shift under the right circumstance; our usage of vague moral terms may contribute to such shifts, but so may some factors beyond our control. After the account is fleshed out, some distinctions will be drawn to differentiate it from other accounts of moral vagueness, and more importantly, efforts will be made to reconcile this account and moral realism. In conclusion, my account is by far the first (minimal) moral realism-friendly shifty semantic account of moral vagueness that successfully explains our intuitions about vague moral statements. This is a study of the treatment of library patron privacy in licenses for electronic journals in academic libraries. We begin by distinguishing four facets of privacy and intellectual freedom based on the LIS and philosophical literature. Next, we perform a content analysis of 42 license agreements for electronic journals, focusing on terms for enforcing authorized use and collection and sharing of user data. We compare our findings to model licenses, to recommendations proposed in a recent treatise on licenses, and (...) to our account of the four facets of intellectual freedom. Ist dieses nicht gelöst, bleibt auch musikalisches Enden und Schließen eine ungeknackte Nuß. Bach, Beethoven und Schönberg haben, aufeinander aufbauend, drei Lösungskonzepte entwickelt.

David Miller argues that national identity is indispensable for the successful functioning of a liberal democracy. National identity makes important contributions to liberal democratic institutions, including creating incentives for the fulfilment of civic duties, facilitating deliberative democracy, and consolidating representative democracy. Thus, a shared identity is indispensable for liberal democracy and grounds a good claim for self-determination. Because Miller’s arguments appeal to the instrumental values of a national culture, I call his argument ‘instrumental value’ arguments. Globally, above 1.4 billion adults did not reach the recommended level of physical education in their daily life, thus triple intendent reforms are proposed by the Ministry of Physical Education for the development of sporting leadership in schools, colleges, and universities, which are essentially important for the development of physical and mental health of the students. This article analyzes the situation of lacking sustainable sporting leadership among other factors related to Physical Education (PE) resources in the southern areas of Ningxia.

In this paper, I propose a new self-defense theory of punishment, the rights-protection theory. By appealing to the interest theory of right, I show that what we call “the right of self-defense” is actually composed of the right to protect our basic rights. The right of self-defense is not a single, self-standing right but a group of derivative rights justified by their contribution to the protection of the core, basic rights. Thus, these rights of self-defense are both justified and constrained (...) by the basic rights they are supposed to protect. I then explain how this theory responds to a common objection. Opponents argue that, to exercise the right of self-defense, some threat must be present. However, in the context of punishment, the threat has already taken effect or is already gone. Thus, the right of self-defense becomes irrelevant when we punish an offender. I show that this objection is based on an implausibly narrow conception of self-defense. A reasonable conception would allow us to exercise our right of self-defense when there is a present definite threat, a future definite threat, or a potential threat. Thus, we may still exercise our right of self-defense in the context of punishment. (shrink)

The genus Arthrobacter was established in 1947 by Conn & Dimmick. So far, more than 70 recognized species of the genus Arthrobacter have been certified. Its special functions have been widely known by researchers, such as, in agricultural, in medical, in industrial, and in environmental areas, etc. What deserves to be mentioned is that some species of genus Arthrobacter have showed the function of degrading pesticides, fixing nitrogen, producing beneficial enzyme, treating sewage, and so on. Recently, the applications of the (...) genus Arthrobacter, especially the VBNC (viable but non-culturable) bacteria of this genus in the field of contaminated environment repair attract people’s attention and some related research results have also been obtained. The functions that we have known are waiting for us to study about mechanism, deeply. And, we can look forward to discovering more potential functions and applications of this genus in ecological environment. In the meantime, these discoveries must bring more new changes and knowledge. (shrink)

In this chapter, I consider contemporary consequentialist theories of punishment. Consequentialist theories of punishment look to the consequences of punishment to justify the institution of punishment. Two types of theories fall into this category—teleology and aggregationism. I argue that teleology is implausible as it is based on a problematic assumption about the fundamental value of criminal punishment, and that aggregationism provides a more reasonable alternative. Aggregationism holds that punishment is morally justified because it is an institution that helps society to (...) aggregate important moral values. Several theories fall into this category, including general deterrence theories, specific deterrence theories, and preventionism. I critically evaluate these theories and argue that only one specific deterrence theory, namely, my rights-protection theory, provides the most reasonable consequentialist account of punishment. A number of philosophers argue that the moral value of national identity is sufficient to justify at least a prima facie right of a national community to create its own independent, sovereign state. In the literature, this argument is commonly referred to as the identity argument. In this paper, I consider whether the identity argument successfully proves that a national group is entitled to a state of its own. To do so, I first explain three important steps in the argument (...) and then consider whether they lead to the desired conclusion. My examination reveals that the identity argument relies on the Optimal Protection Principle; however, this principle does not apply to the case of a national community. As a result, the identity argument fails to justify even a prima facie right of a national community to establish its own state. (shrink)

Allen Buchanan proposes a methodological framework with which theorists may evaluate different theories of secession, including the National Self-Determination theory. An important claim he makes is, because the right to secede is inherently institutional, any adequate theory of secession must include, as an integral part, an analysis of institutional morality. Because the National Self-Determination theory blatantly lacks such an analysis, Buchanan concludes that this theory is inherently flawed. In this paper, I consider Buchanan’s framework and the responses from supporters of (...) national self-determination theory. I try to clarify the confusion shared by both parties. I conclude that, although Buchanan’s theory of institutional morality is sound, his critiques of the national self-determination theory fails. (shrink)

Both Kymlicka and Patten argue that the equal treatment of different national groups require that the state officially recognize the right of each to create its own autonomous government. After carefully examining their arguments, I show that they both make the false assumption that, in a multinational state, the state belongs only to the majority group but not the minority, and that a multination state can never treat minority groups equally. Both claims are inherently anti-pluralistic. Thus, the equal treatment of (...) different national cultures does not require that each be granted the right to self-government. (shrink)

This book examines some possible ethical principles to resolve moral dilemmas involving water. Existing problems in current water management practices are discussed in light of these principles. Transformation of human water ethics has the potential to be far more effective, cheaper and acceptable than some existing means of “regulation”, but transformation of personal and societal ethics need time because the changes to ethical values are slow.

The principle of national self-determination holds that a national community, simply by virtue of being a national community, has a prima facie right to create its own sovereign state. While many support this principle, not as many agree that it should be formally recognized by political institutions. One of the main concerns is that implementing this principle may lead to certain types of inequalities—between nations with and without their own states, members inside and outside the border, and members and nonmembers (...) inside the same nation state. While these inequalities may arise, I shall argue that they are not unjust. These worries are partly the results of confusing two types of interests that a national group may have—in cultural affairs and in political affairs. While a national community should enjoy rights over their cultural affairs, this does not grant them authority over other non-cultural, political affairs. Once the distinction is drawn, we can see that there are constraints on the implementation of this principle. Consequently, these inequalities justify setting limits to a group’s right of self-government, although they do not conclusively refute the right itself. (shrink)

Recent psychological research shown that the places where we live are linked to our personality traits. Geographical aggregation of personalities has been observed in many individualistic nations; notably, the mountainousness is an essential component in understanding regional variances in personality. Could mountainousness therefore also explain the clustering of personality-types in collectivist countries like China? Using a nationwide survey (29,838 participants) in Mainland China, we investigated the relationship between the Big Five personality traits and mountainousness indicators at the provincial level. Multilevel (...) modelling showed significant negative associations between the elevation coefficient of variation (Elevation CV) and the Big Five personality traits, whereas mean elevation (Elevation Mean) and the standard deviation in elevation (Elevation STD) were positively associated with human personalities. Subsequent machine learning analyses showed that, for example, Elevation Mean outperformed other mountainousness indicators regarding correlations with neuroticism, while Elevation CV performed best relative to openness models. Our results mirror some previous findings, such as the positive association between openness and Elevation STD, while also revealing cultural differences, such as the social desirability of people living in China’s mountainous areas. Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

This article sheds light on the diversity of meanings and connotations that tend to be lost or hidden in translations between different conceptualizations of nature in East and South-East Asia. It reviews the idea of “nature” in Chinese, Japanese, Vietnamese, Filipino, Tagalog, Cebuano, Lumad, Indonesian, Burmese, Nepali, Khmer, and Mongolian. It shows that the conceptual subtleties in the conceptualization of nature often hide wider and deeper cosmological mismatches. It concludes by suggesting that these diverse voices need to be represented in (...) global reports on sustainability, which can be fostered by the direct involvement of experts from diverse traditions of thought who have access and interpretative knowledge of sources in languages other than English. To take into consideration the diversity of conceptualizations of nature can lead to better decisions about sustainability and improve the acceptability and efficiency of environmental policies in each local context, as well as internationally. Solutions and policies on the ground must be designed based on the local conceptual and cultural frames. (shrink)

There are two kinds of time-bias: near-bias and future-bias. While philosophers typically hold that near-bias is rationally impermissible, many hold that future-bias is rationally permissible. Call this normative hybridism. According to arbitrariness objections, certain patterns of preference are rationally impermissible because they are arbitrary. While arbitrariness objections have been levelled against both near-bias and future-bias, the kind of arbitrariness in question has been different. In this paper we investigate whether there are forms of arbitrariness that are common to both kinds (...) of preferences, and hence whether there are versions of the arbitrariness objection that are objections both to near-bias and future-bias. If there are, then this might go some way towards undermining normative hybridism and to defending a thorough-going time-neutralism. (shrink)

We describe a strategy that is being used for the horizontal integration of warfighter intelligence data within the framework of the US Army’s Distributed Common Ground System Standard Cloud (DSC) initiative. The strategy rests on the development of a set of ontologies that are being incrementally applied to bring about what we call the ‘semantic enhancement’ of data models used within each intelligence discipline. We show how the strategy can help to overcome familiar tendencies to stovepiping of intelligence data, and (...) describe how it can be applied in an agile fashion to new data resources in ways that address immediate needs of intelligence analysts. Many philosophers have become sceptical of the use of thought experiments in theorising about personal identity. In large part this is due to work in experimental philosophy that appears to confirm long held philosophical suspicions that thought experiments elicit inconsistent judgements about personal identity, and hence judgements that are thought to be the product of cognitive biases. If so, these judgements appear to be useless at informing our theories of personal identity. Using the methods of experimental philosophy, we investigate whether (...) people exhibit inconsistent judgements and, if they do, whether these judgements are likely to be the source of cognitive bias or, instead, sensitivity to some relevant factor. We do not find that people’s judgements are sensitive to any of the factors we investigate (relevant or irrelevant), nor that people have inconsistent judgements across cases. Rather, people’s judgements are best explained by them having a very minimal account of what it takes for a person to survive. Since this pattern of judgements is no reason to think that we are subject to cognitive bias, we see no reason, as things stand, to be sceptical of our judgements. (shrink)

In this paper I provide an ecological, Schelerian-based description of the aesthetic experience that, without being exhaustive, may account for its complexity, perspective character and stratifications. Aesthetic enjoyment, aesthetic object and the creative process of the artistic type are all specific and necessary moments of an experience – an aesthetic experience – shared by different experiential “individuals”, who also contribute to its formation process. The content of this experience grows and develops in conformity with its own laws, like a living (...) being so to speak, able, as such, to turn its own gaze to the others’ gaze at the same time as they turn to it. In other words, I will deal with the dynamics of the artist’s interactions with the spectator, of those of the spectator with the artist and of those of both with the work of art, which, created by the artist, or rather, “brought to light” by the artist, becomes an object– a quasi-sujet in Dufrennian terms – unique to the spectator. In this context, I will try to rehabilitate the axiological virtues of beauty, not in the sense of a metaphysics of beauty, but in a sense nearer to our experiences of “seeing something in a new light”. Neben der Darstellung der Kerninhalte der beiden Debatten wird die Frage „Wen liebe ich?“ philosophisch problematisiert. Dabei soll aufgezeigt werden, was unter einer philosophischen Herangehensweise zu verstehen ist und wie sich dies konkret im Fall der angeführten Frage niederschlägt.

Eine weit verbreitete Auffassung über die wissenschaftlichen Naturverständnisse besagt, dass ihre historische Entwicklung von einer zunehmenden Abgrenzung gegenüber der Magie begleitet gewesen sei. Ursprünglich eng mit der Magie verbunden, hätten sich die wissenschaftlichen Naturverständnisse in einem langwierigen Prozess immer weiter von der Magie entfernt, bis sie ihre heutige amagische Gestalt erhalten hätten. Mein Beitrag diskutiert einige Argumente zur Stützung dieser, wie ich meine, plausiblen Auffassung. / A whitespread view of the natural sciences holds that their historical development was accompanied by (...) a constantly widening gap between them and magic. Originally closely bound up with magic, the sciences are supposed to have distanced itself from it in a long-drawn-out process, until they attained their present magic-free form. Carine Defoort, Mario Wenning, and Kai Marchal offer three ways of engaging with Chinese and Buddhist Philosophy in Early Twentieth-Century German Thought and the philosophical, hermeneutical, and historical issues it attempted to articulate and address.1 This work is historical with a contemporary philosophical intent: to reexamine a tumultuous contested epoch of philosophy’s past in order to reconsider its existing limitations and alternative possibilities. Il s’agira de montrer pourquoi et comment la place que tient la vegetation joue un role mediateur fondamental en tant que principe de premiere importance, y compris et surtout ici pour la vie humaine decrite par Watsuji. Ce faisant, l’objectif est double. D’une part, montrer, a la suite d’Augustin Berque, la coherence de la visee mesologique initiale de l’auteur (...) en donnant un fondement theorique a ses exemples vegetaux. D’autre part, se recentrer sur le role mesologique de la vegetation permet de relativiser la place du climat et donc du determinisme environnemental souvent surevalues dans beaucoup de traductions et commentaires de Fūdo. This chapter considers the presence, in digital games, of experiences of dwelling. Starting with an engagement with the philosopher Edward S. Casey's distinction between hestial and hermetic spatial modes, the chapter argues that the player's spatial engagement with digital game worlds has tended to align with the hermetic pole, emphasizing movement, traversal and exploration. By contrast, hestial spatial practices, characterized by centrality, lingering and return, are far less prevalent both in digital games themselves and in discussions on spatiality in the (...) game studies discourse. To counter this lack, this chapter draws upon philosophical work on space by Casey, Martin Heidegger, Yi-Fu Tuan and Christian Norberg-Schulz, using these as a conceptual lens to identify spatial structures and practices in digital games that diverge from the hermetic mode. Attention is paid to games that invite pausing and lingering in place, games where the player's relation to place is structured around practices of building, the phenomenology of home and dwelling in games, and familiarity and identity as experiential characteristics of being at home. Minecraft and Animal Crossing: New Leaf are examined in detail as case studies, though the chapter also refers to examples from other games. (shrink)

Es gibt Staaten und Fußballmannschaften, Fakultäten und Punkbands. Und mansollte meinen, daß diese Entitäten etwas gemeinsam haben, daß sie zu ein und derselben ontologischen Kategorie gehören. Und daß sie sich unterscheiden von Elektronen, Tischen, Grizzlybären, einem Zehn-Euro-Schein, dem neuen Präsidenten, der Amtseinführung des neuen Präsidenten und der Tatsache, daß ich einen Vortrag halte. Mein Ziel ist es, zu zeigen, daß die Kategorie, die alle Beispiele der ersten Gruppe umfaßt, aber keines der zweiten Gruppe, die Kategorie der vereinten Pluralpersonen ist. Um (...) diese These stark zu machen, muß ich zunächst eine Reihe ontologischer Unterscheidungen diskutieren. Zunächst werde ich die Begriffe des Statusobjekts und des Pluralobjekts einführen, zwei relativ neue ontologische Kategorien. Sodann werde ich die traditionellen Kategorien der Substanz und der Person diskutieren, wobei ich mit Hilfe der zuvor eingeführten Begriffe des Statusobjekts und des Pluralobjekts verschiedene Arten von Personen unterscheiden werde. Die natürlichen Personen bilden nur eine dieser Arten, wenn auch die Art von Personen, zu der wir selber als Individuen gehören. The controversy that between 1908 and 1912 saw Benedetto Croce and Giovanni Gentile opposed, on one side, and Federigo Enriques, on the other, did not actually have a conclusive episode, but its end was perceived, for its results on culture, on society and teaching in Italy, as a "defeat" of Enriques. A more careful examination of the events and of the historical context in which it took place seems, however, to clearly demonstrate that we can speak not of a personal (...) defeat of the great mathematician from Livorno, but rather of a defeat of the commendable attempts at cultural and social modernization of Italy in an international perspective, of which Enriques was not the only actor but certainly the most exposed. Such intentions were crushed by the myopic provincial conservatism of the Italian neo-idealism, favored by the fascist regime, concerned only with affirming in the world an alleged autarkic national cultural superiority, based on the traditional literary-humanistic culture, ignoring the progress of the new technical-scientific thought, placed in an international context. Sunto_ La polemica che dal 1908 al 1912 vide contrapposti da una parte Benedetto Croce e Giovanni Gentile e dall’altra Federigo Enriques non ebbe, in realtà, un episodio conclusivo, ma la sua fine è stata percepita, per i suoi esiti sulla cultura, sulla società e sull’insegnamento in Italia, come una “sconfitta” dell’Enriques. Un esame più attento delle vicende e del contesto storico nel quale si svolse sembra, invece, dimostrare chiaramente di poter parlare non di una sconfitta personale del grande matematico livornese, quanto piuttosto di una sconfitta dei lodevoli tentativi di ammodernamento culturale e sociale dell’Italia in una prospettiva internazionale, di cui Enriques non fu l’unico attore ma sicuramente quello più esposto. Tali propositi furono schiacciati dal miope conservatorismo provinciale del neoidealismo italiano, favorito dal regime fascista, preoccupato unicamente di affermare nel mondo una pretesa superiorità culturale nazionale autarchica, basata sulla tradizionale cultura letterario-umanistica, ignorando il progresso del nuovo pensiero tecnico-scientifico, per sua natura, invece, inserito in un contesto internazionale. Nell'alto medioevo vi erano tre possibilità per il filosofo che volesse difendere l'esistenza degli universali: in primo luogo ante rem, seguendo la linea platonico-agostiniana degli universali trascendenti e questa è la via teologica; in secondo luogo la via post rem, cioè la via del concettualismo, conosciuta oggi come astrattismo, per cui gli universali sono il prodotto dell'astrazione della mente e questa è una via logica; la terza via è quella in re e difende gli universali immanenti che esistono negli universali (...) ed è una risposta ontologica. La seconda via fu difesa da Boezio nel secondo commento a Porfirio. La prima teoria è stata generalmente accettata da tutti i filosofi dell'alto medioevo eccetto Abelardo, mentre la terza via, quella degli universali immanenti, che ha come fonti antiche l'Isagoge di Porfirio e le Categoriae di Aristotele, fu difesa principalmente da quattro autori: Giovanni Scoto Eriugena, Anselmo d'Aosta, Odone di Cambrai e Guglielmo di Champeaux. Das Wiskott-Aldrich-Syndrom (WAS), ein genetisch bedingter Immundefekt mit klinischer Manifestation im Kleinkindalter, wird voraussichtlich in näherer Zukunft erstmals versuchsweise durch eine somatische Gentherapie behandelt werden. Im vor- liegenden Beitrag werden die wichtigsten medizinisch-naturwissenschaftlichen Fakten dieses Krankheitsbildes sowie die bisherigen Erfahrungen mit somatischen Gentherapien bei anderen Immunmangelsyndromen ausführlich dargestellt. Sodann erfolgt eine ethische Analyse eines möglichen gentherapeutischen Eingriffs bei WAS-Patienten, bei der die spezifischen Aspekte des Wiskott-Aldrich-Syndroms – insbesondere die fast ausschließliche Betroffenheit von Kindern sowie die unterschiedlich aussichtsreiche Alter- nativoption einer (...) allogenen Knochenmarktransplantation–wesentliche Aspekte der Beurteilung sind. Im Ergebnis zeigt sich, dass ein gentherapeutischer Eingriff im vorliegenden Fall nicht im Rahmen einer Forschungsstudie, d.h. als Humanexperiment, gerechtfertigt werden kann, sondern allein als individueller Heilversuch. Gleichwohl las- sen die besonderen Risiken und die Innovativität eines solchen Eingriffs es notwendig erscheinen, diesen Heilversuch – anders als andere Heilbehandlungen mit bislang unerprobten Mitteln – in streng kontrollierter Form durchzuführen. Der neuartige Gedanke eines kontrollierten individuellen Heilversuchs zeichnet sich daher für den vorliegenden Fall, und womöglich auch für vergleichbare risikoreiche Behandlungsansätze namentlich im Bereich der Gentherapie, als geeignetes Instrument der Konzeption und Beurteilung ab. Hermanns Lotze (1817–1881) hat nachweislich einige der bedeutendsten Philosophen des fin de siècle beeinflusst: (i) die britischen „Neo-Hegelianer“; (ii) Husserls Phänomenologie; (iii) Diltheys Philosophie des Lebens; (iv) die Neukantianer; (v) die frühere analytische Philosophie. Das angegebene Ziel seines dreibändigen Mikrokosmos (1856–1864) war „die Reflexion über den Sinn unseres menschlichen Daseins“. Die Aktualität dieser Aufgabe war eine Folge der wissenschaftlichen und industriellen Revolution Mitte des 19. Jahrhunderts. Sie veränderte die Art, wie sich die Menschen das Universum vorstellten. Lotze sah Gefahr in (...) den zahlreichen Versuchen seitens einiger philosophisch interessierter Wissenschaftler in Deutschland, zu beweisen, dass das menschliche Sein nur mechanisch und materialistisch zu verstehen ist. Er machte es sich zur Aufgabe, den Menschen das Gefühl von Heimat in dieser stark veränderten Welt zurückzugeben. Dies erklärt auch, wieso Lotze seine Untersuchung in „völlig populärer Form“ darstellte. Lotzes Mikrokosmos war jedoch nicht nur ein Werk der populären Philosophie. Sie fußt auf fundierten theoretischen Überlegungen. Man kann Lotzes Werk als einen gewagten Versuch betrachten, die sich abzeichnende Spaltung zwischen akademischer und populärer Philosophie zu überwinden. (shrink)

Ich rekonstruiere und kritisiere Hans Drieschs Argumentation für die Behauptung, daß biologischen Prozessen nur eine substanzdualistische Ontologie der belebten Materie (Vitalismus) gerecht werden kann. Meine Diagnose lautet, daß Drieschs Argumentation zwar logisch schlüssig ist bzw. durch leichte Modifikationen in eine logisch gültige Form gebracht werden kann, aber von empirisch unbegründeten, metaphysischen Prämissen über die Möglichkeiten eines energieumwandelnden Mechanismus ausgeht.

L’Ipotesi del Continuo, formulata da Cantor nel 1878, è una delle congetture più note della teoria degli insiemi. Il Problema del Continuo, che ad essa è collegato, fu collocato da Hilbert, nel 1900, fra i principali problemi insoluti della matematica. A seguito della dimostrazione di indipendenza dell’Ipotesi del Continuo dagli assiomi della teoria degli insiemi, lo status attuale del problema è controverso. In anni più recenti, la ricerca di una soluzione del Problema del Continuo è stata anche una delle ragioni (...) fondamentali per la ricerca di nuovi assiomi in matematica. Jean Baudrillards Kulturphilosophie läßt sich durch die Behauptung charakterisieren, daß die Medien in der modernen Kultur vorherrschend geworden sind. Seine These, die Medien hätten jeden Bezug zu einer von ihnen unabhängigen Realität verloren, haben zahlreiche Autorinnen und Autoren nihilistisch genannt. Das Zutreffende dieser Kennzeichnung verdankt sich im Wesentlichen einem eingeschränkten, auf das 19. Jahrhundert zurückweisenden Begriff des Nihilismus. Allerdings nimmt Baudrillard auf Phänomene Bezug, die er historisch später verortet und die sich ihrer Struktur nach kategorial von den Funktionen der Medien (...) im 19. Jahrhundert unterscheiden. Es gelingt ihm hierbei nicht, den allgemeinen Realitätsverlust, den er vor allem auf den wachsenden Einfluß von Wissenschaft und Technik im 20. Jahrhundert zurückführt, überzeugend nachzuweisen. -/- Als wolle er diesen Mangel beheben, führt Baudrillard in späteren Schriften weitere Struktureigenschaften der kulturellen Mediendominanz ein. Zu diesen Fortentwicklungen gehört die durch Medienmacht erzeugte „Transparenz“, die nicht zuletzt die restlose Durchsichtigkeit aller Zustände und Prozesse meint. Es ist dieses Merkmal, das Baudrillard 1981 selbst mit einem Nihilismusbegriff in Verbindung bringt. Der Nihilismus der Transparenz beansprucht, das spezifisch Neue der Sinnlosigkeit in zunehmend wissenschafts- und technikbestimmten Gesellschaften zu erfassen. Obwohl sich die Schwächen der Medientheorie in seiner Auffassung des Nihilismus reflektieren, gelingt es ihm, Phänomene der Nichtigkeit zu beschreiben, für die man gute Gründe hat anzunehmen, daß sie sich durch keinen Werte- oder Einstellungswandel mehr aufheben lassen. Um diese Einsicht zu begründen, muß man Baudrillards Medientheorie allerdings gleichsam vom Kopf auf die Füße stellen. Nicht auf einen evidenten, alles umfassenden Realitätsverlust, sondern umgekehrt auf einen Teil der vermutlichen Realitätsgehalte der Medien läßt sich die drohende Ausdehnung der Transparenz zurückführen. Die Frage nach der Verantwortung für globale Armut laesst sich auf mindestens zwei Weisen stellen – als Frage nach der (retrospektiven) Verantwortung für das Auftreten dieses Problems oder als Frage nach der (prospektiven) Verantwortung für dessen Behebung. Dieses Kapitel wird sich vor allem auf die zweite Frage konzentrieren: Inwiefern sollte die Verantwortung, Armut zu bekaempfen, als kollektive Verantwortung verstanden werden? Für viele von uns werden diese Pflichten nur im weiten (schwachen) Sinne kollektiv sein, naemlich in dem Sinne, dass die kollektive (...) Ebene für die Entscheidungsfindung und die Handlungsbewertung primaer ist. Kollektivitaet von Verantwortung im engen Sinn erfordert hingegen staerkere epistemische Verknüpfungen der Gruppenmitglieder sowie eine Bekenntnis zum gemeinsamen Ziel. Wo diese bereits bestehen, da koennen wir von kollektiver Verantwortung in diesem starken Sinn sprechen und entsprechend von den Mitgliedern dieser Gruppen einen groesseren Einsatz für das Endresultat erwarten. La “Magia Naturalis” di Giovan Battista Della Porta fu uno dei testi più diffusi fra XVI e XVII secolo. Attorno ad esso ruotò per decenni un ampio dibattito, che spaziava (...) dalla magia alla scienza, dalla filosofia alla teologia. -/- Popular imagination has always been fascinated by the possibility that arcane secrets were hidden among the pages of ancient manuscripts, the revelation of which could confer occult powers. Books that required enormous sacrifices, which had been a reason for living for their authors and, at the same time, the source of a thousand dangers. Giovan Battista Della Porta's “Magia Naturalis” was one of the most widespread texts between the 16th and 17th centuries. Mit dem Terminus 'ursprünglicher Raum' wird der Raum bezeichnet, der Kant innerhalb der transzendentalen Ästhetik als reine subjektive Form der Anschauung des äußeren Sinnes bestimmt. Man könnte ihn auch den 'ästhetischen Raum' nennen. Auf jeden Fall muss er vom (proto-)geometrischen Raum unterschieden werden, da letzterer eine Einheit voraussetzt die auf einer Synthesis beruht, und dadurch – weil bei Kant alle Synthesis unter den Kategorien steht – weniger ursprünglich zum Anschauungsvermögen gehört. Es ist diese Unterscheidung zwischen dem ursprünglichen Raum, der „Form (...) der Anschauung“ ist, und dem (proto-)geometrischen Raum, der „formale Anschauung“ ist, auf die Kant in einer bekannten Fußnote im §26 der transzendentalen Deduktion der B-Auflage anspielt. -/- Die Bedeutung der Unterscheidung zwischen (proto-)geometrischem und ursprünglichem Raum liegt unter anderem darin, dass sie stipuliert, dass das ursprüngliche Wesen des Raumes vor und unabhängig von dem erreichbar ist, was durch jedwede Mathematik der Ausdehnung von ihm ausgesagt wird. Das bedeutet nun aber nicht, dass diese Unterscheidung uns zwingt, anzunehmen, dass das ursprüngliche Wesen des Raumes auch von uns erreichbar ist. Und nehmen wir mal an, dass wir tatsächlich über eine Art Zugang zu diesem Wesen verfügen, dann noch stellt sich überdies die Frage, ob ein solcher Zugang sich innerhalb der Sphäre der Erkenntnis befindet, mit anderen Worten: ob das ursprüngliche Wesen des Raumes vom Philosophen auch wirklich erkannt – das heißt: in Erkenntnisurteile gefasst und ausgedrückt – werden kann. One of the interpretive devices that Ch'eng-kuan (澄 觀) is famous for having employed to distill the essence of the vast Mahāvaipulya Buddhāvataṃsaka Sūtra (Tafang-kuang fo-hua-yen ching 《大方廣佛華嚴經》 was a series of variations on the contemplative theme (kuan-men 觀門) of the complete interfusion (yüan-jung 圓融) of the scripture's three chief protagonists (san-sheng 三聖) ── the Buddha Vairocana (Pi-lu-che-na 毘盧遮那) and the bodhisattvas Mañjuśrī (Wen-shu-shih-li 文殊師利) and Samantabhadra (P'u-hsien 普賢). By aligning these three powerful sacred persons with a number of philosophical (...) categories that he believed to be central to the sūtra ── categories like "cause" (yin 因 ), "fruition" (kuo 果 ), "faith" (hsin 信 ), "understanding" (chieh 解), "insight" (chih 智), "practice" (hsing 行), "principle" (li 理), etc. ── he provided a focal point at which the rich and vivid meditative and liturgical lives of Hua-yen devotees could be made to converge with their philosophical reflections. -/- Although Ch'eng-kuan invoked this device in several of his writings, his most concerted development of it is a short essay entitled San-sheng yüan-jung kuan-men, which appears to have been written relatively late in his long career. Like many important Hua-yen texts, this essay seems to have been lost in China not long after its author's death. However, it was preserved in Korea and Japan and from the latter country was reintroduced to China in the last years of nineteenth century. Neither in China nor in the West has it yet been adequately studied. -/- The core of the present article is a critical edition of the Chinese text of the essay based on a careful comparison of all available versions and presented together with a copiously annotated English translation. The edition translation are preceded by a brief interpretive introduction and followed by an appendix in which are given: a detailed discussion of the work's textual history, detailed accounts of its various editions, and descriptions of its several surviving paraphrases and commentaries. Die anhaltende Popularität von juristisch geprägter Literatur zeigt, dass das Ringen um die Gerechtigkeit im Recht ein brisantes Thema ist, das gesellschaftliche Aufmerksamkeit auf sich zieht, provoziert und immer wieder neu zum Nachdenken herausfordert. Zeitgenössisch sind es Autor*innen wie Juli Zeh, Bernhard Schlink, Georg Oswald oder Ferdinand von Schirach (sogenannte Dichterjurist*innen 1 ), die die Frage nach Recht und Gerechtigkeit literarisch verbinden und deren Problemkontexte beleuchten. Juli Zeh lässt ihrem Roman Spieltrieb die Erzählerinstanz sprechen: „Das Recht ist kein Kreißsaal für (...) die Gerechtigkeit […]“ (2013, 518). Auch Ferdinand von Schirach bemüht sich herauszustellen, dass für ihn Recht nicht gleich Gerechtigkeit bedeutet. Als Strafverteidiger sagt er über die Justiz: „[W]ir sprechen […] nicht Gerechtigkeit, sondern Recht“ (Heise 2009).3 In seinen Bestsellern (angefangen von z. B. Der Fall Collini über Terror bis zu seinem neusten Stück Gott) provoziert er das Gerechtigkeitsempfinden seiner Leser*innen und lässt sie am Ende gerne selbst das Urteil fällen. In Terror (2016) soll das Publikum als Jury selbst entscheiden, ob der Kampfpilot das entführte Passagierflugzeug, das auf ein voll besetztes Fußballstadion zugesteuert ist, hätte abschießen dürfen. Hier geraten u. a. die Gewissensentscheidung des Piloten und die Rechtsgrundlage in einen Konflikt. Nicht selten macht er den Leser*innen das Recht schwer erträglich, wenn er z. B. wie im Erzählband Schuld (2017) auf brutale Weise beschreibt, wie eine minderjährige Kellnerin auf einem Volksfest von einer Gruppe von Männern vergewaltigt wird, aber aus Beweismangel letztendlich keiner dieser Männer schuldig gesprochen werden kann. In der Literatur werden vielfältige Zugänge zum Verhältnis von Recht und Gerechtigkeit eröffnet – wie kann sich die christliche Sozialethik positionieren? (shrink)
