Die Disziplin, die als „Juristische Methodenlehre“ bezeichnet wird, ist gegenwärtig chinesischen Juristen nicht fremd, sie stammt aber ursprünglich aus dem deutschen Sprachraum. In der Literatur finden sich auch verwandte Ausdrücke wie „Juristische Methodologie“, „Juristische Methodik“ bzw.„Methodenlehre der Rechtswissenschaft“. Seit Anfang des 21. Jahrhunderts wurde ihre Rezeption in China durch zwei Übersetzungen gekennzeichnet, nämlich die „rechtswissenschaftliche Methodenlehre“ (faxue fangfalun) und die „rechtliche Methodenlehre“ (falü fangfalun). Neben der herkömmlichen Methodenlehre entwickelte sich auch eine jüngere Theorie der juristischen Argumentation, die (...) die weltweite Aufmerksamkeit sogar außerhalb Deutschlands auf sich lenken konnte und deren Bestand in China einen ganz selbständigen Abschnitt verdient. Als Hintergrund dafür soll von vornherein ein Blick auf die Entwicklungen der chinesischen Rechtstheorie und Rechtsphilosophie nach 1978 und demzufolge auf die Entstehung der Methodenfrage in der chinesischen Rechtswissenschaft geworfen werden. This essay surveys the main objections to aesthetic hedonism, the view that aesthetic value is reducible to the value of aesthetic pleasure or experience. Hedonism is the dominant view of aesthetic value, but a spate of recent criticisms has drawn its accuracy into question. I introduce some distinctions crucial to the criticisms, before using the bulk of the essay to identify and review six major lines of argument that hedonism's critics have employed against it. Whether or not these arguments suffice (...) to refute hedonism decisively, I argue that its privileged status, as the sole contender in aesthetic value theory, is detrimental to downstream research on aesthetic phenomena. The essay concludes with an overview of current work and promising avenues of inquiry into non-hedonic alternatives. (shrink)

I here defend historical entitlement theories of property rights against a popular charge. This is the objection that such theories fail because no convincing account of original appropriation exists. I argue that this argument assumes a certain reading of historical entitlement theory and I spell out an alternative reading against which it misfires. On this reading, the role of acts of original appropriation is not to justify but to individuate people’s holdings. I argue that we can identify which acts count (...) as original appropriation against the background of a general justification for a practice of property rights. On this view, what I will call ‘natural’ acts of original appropriation are acts by which a person begins to satisfy the general conditions for justified ownership. Finally, I offer an interpretation of John Locke's theory of appropriation along these lines and argue that it provides an attractive reading of his view. (shrink)

Stuart Kauffman has, in recent writings, developed a thought-provoking and influential argument for strong emergence. The outcome is his Theory of the Adjacent Possible (TAP). According to TAP, the biosphere constitutes a non-physical domain qualitatively distinct from the physical domain. The biosphere exhibits strongly emergent properties such as agency, meaning, value and creativity that cannot, in principle, be reduced to the physical. In this paper, I argue that TAP includes various (explicit or implicit) metaphysical commitments: commitments to (1) scientific realism, (...) (2) downward causation and teleology, and (3) modal realism. If TAP is to hang together as the kind of robust philosophical thesis it evidently aspires to be, it needs an account – an account that is currently absent – of its metaphysical commitments. It is however unclear how such an account can be developed since various dilemmas present themselves when one explores how subscribers to TAP might do so. (shrink)

This article presents a comparative theory of subjective argument strength simple enough for application. Using the axioms and corollaries of the theory, anyone with an elementary knowledge of logic and probability theory can produce an at least minimally rational ranking of any set of arguments according to their subjective strength, provided that the arguments in question are descriptive ones in standard form. The basic idea is that the strength of argument A as seen by person x is a function of (...) three factors: x's degree of belief in the premisses of A; x's degree of belief in the conclusion of A under the assumption that all premisses of A are true; and x's belief in the conclusion of A under the assumption that not all premisses of A are true. In Spheres of Justice, published in 1983, Michael Walzer gives his views on a negative income tax, which is a variation on and an implementation of the idea of a universal basic income. His relevant statements, which are included in the chapters “security and welfare” and “money and commodities”, are ambivalent. This paper discusses the idea of a universal basic income from the perspective of Walzer’s theory of distributive justice. This discussion presents both arguments for and against this idea.

William Whewell’s philosophy of science is often overlooked as a relic of 19th century Whiggism. I argue however that his view – suitably modified – can contribute to contemporary philosophy of science, particularly to debates around scientific progress. The reason Whewell’s view needs modification is that he makes the following problematic claim: as science progresses, it reveals necessarily truths and thereby grants a glimpse of the mind of God. Modifying Whewell’s view will involve reinventing his notion of necessary truth as (...) the pragmatist notion of superassertibility. And, if scientific progress does not uncover necessary truths, then it does not reveal the mind of God. The result is an outline of an account of scientific progress that is piecemeal and fallibilist in nature, yet at the same time maintains key Whewellian themes of consilience and the unity of science. This article asks whether states have a right to close their borders because of their right to self-determination, as proposed recently by Christopher Wellman, Michael Walzer, and others. It asks the fundamental question whether self-determination can, in even its most unrestricted form, support the exclusion of immigrants. I argue that the answer is no. To show this, I construct three different ways in which one might use the idea of self-determination to justify immigration restrictions and show that each of these (...) arguments fails. My conclusion is that the nature and value of self-determination have to do with the conditions of genuine self-government, not membership of political society. Consequently, the demand for open borders is fully consistent with respect to self-determination. (shrink)

I identify two versions of the scientific anti-realist’s selectionist explanation for the success of science: Bas van Fraassen’s original and K. Brad Wray’s newer interpretation. In Wray’s version, psycho-social factors internal to the scientific community – viz. scientists’ interests, goals, and preferences – explain the theory-selection practices that explain theory-success. I argue that, if Wray’s version were correct, then science should resemble art. In art, the artwork-selection practices that explain artwork-success appear faddish. They are prone to radical change over time. (...) Theory-selection practices that explain theory-success in science are however not faddish. They are mostly stable; that is, long-lived and consistent over time. This is because scientists (explicitly or implicitly) subscribe to what I will call the testability norm: scientific theories must make falsifiable claims about the external physical world. The testability norm and not psycho-sociology explains the theory-selection practices that explain theory-success in science. Contra Wray, scientific anti-realists can then maintain that the external physical world (as expressed in the testability norm) explains theory-success. (shrink)

Several complexity theorists draw a sharp and ontologically robust distinction between (merely) complicated systems and (genuinely) complex systems. I argue that this distinction does not hold. Upon fine-grained analysis, ostensibly complicated systems turn out to be complex systems. The purported boundary between the complicated and the complex appears to be vague rather than sharp. Systems are complex by degrees.

Paul Cilliers has developed a novel post-structural approach to complexity that has influenced several writers contributing to the current complexity literature. Concomitantly however, Cilliers advocates for modelling complex systems using connectionist neural networks (rather than analytic, rule-based models). In this paper, I argue that it is dilemmic to simultaneously hold these two positions. Cilliers’ post-structural interpretation of complexity states that models of complex systems are always contextual and provisional; there is no exclusive model of complex systems. This sentiment however appears (...) at odds with Cilliers’ promotion of connectionist neural networks as the best way to model complex systems. The lesson is that those who currently follow Cilliers’ post-structural approach to complexity cannot also develop a preferred model of complex systems, and those who currently advocate for some preferred model of complex systems cannot adopt the post-structural approach to complexity without giving up the purported objectivity and/or superiority of their preferred model. For more than one decade, Andy Clark has defended the now-famous extended mind thesis, the idea that cognitive processes leak into the world. In this paper I analyse Clark’s theoretical justification for the thesis: explanatory simplicity. I argue that his way of justifying the thesis leads into contradiction, either at the level of propositional attitude ascriptions or at the theoretical level. I evaluate three possible strategies of dealing with this issue, concluding that they are all likely to fail and that (...) therefore, as regards explanatory simplicity, the burden of proof is on Clark’s side. The paper divides into two main sections: in “Simplicity and Coherence”, I define the two concepts that are important in this context (simplicity and explanatory coherence). In “How to Cope with Coherence”, these two concepts are applied to the central thought experiment, the Inga/Otto case. It will be shown that justifying the extended mind thesis by reference to simplicity may cause trouble, because ‘extended’ behavioural descriptions are likely to yield rather complicated explanations. Most treatments of territorial rights include a discussion (and rejection) of Locke. There is a remarkable consensus about what Locke’s views were. For him, states obtain territorial rights as the result of partial transfers of people’s property rights. In this article, I reject this reading. I argue that (a) for Locke, transfers of property rights were neither necessary nor sufficient for territorial rights and that (b) Locke in fact held a two-part theory of territorial rights. I support this reading by (...) appealing to textual and contextual evidence. I conclude by drawing a lesson from Locke’s views for current debates on territorial rights. (shrink)

The idea that law claims authority (LCA) has recently been forcefully criticized by a number of authors. These authors present a new and intriguing objection, arguing that law cannot be said to claim authority if such a claim is not justified. That is, these authors argue that the view that law does not have authority viciously conflicts with the view that law claims authority. I will call this the normative critique of LCA. In this article, I assess the normative critique (...) of LCA, focusing predominantly on the arguments presented by its most incisive proponent Philip Soper. I defend a twofold conclusion. First, LCA, understood roughly along the lines put forward by Joseph Raz, is part of the most attractive analysis of law. Second, proponents of the normative critique, and in particular Soper, are committed to accepting LCA. (shrink)

The most discussed of architectural marvels tend to be the Temple of Zeus at Olympia, the Mausoleum at Halicarnassus or the Parthenon at Athens, supposedly because they are the ones we happen to have nominated ‘world wonders’; but that doesn’t mean all the rest of temple-type sites to be found across the greater Mediterranean area have less wonder about them. On the contrary; when wanting to explore and explain the role temples played in the lives of their ‘subscribers’ and a (...) temple site’s place as often the nucleus of a community, the Serapeum at Alexandria is as excellent a piece of architecture to examine as any. Bestaande literatuur over Knoet de Grote zijn troonsbestijging, zoals dat van vooraanstaand 19e-eeuws historicus Edward Augustus Freeman, zou een ‘geromantiseerd’ beeld hebben geschetst van de kwestie. In this paper I respond to Bernd Krehoff’s article ‘Legitimate Political Authority and Sovereignty: Why States Cannot Be the Whole Story’. I criticize Krehoff’s use of Raz’s theory of authority to evaluate the legitimacy of our political institutions. Krehoff argues that states cannot (always) claim exclusive authority and therefore cannot possess exclusive legitimacy. Although I agree with his conclusion, I argue that the questions of legitimacy and (Razian) authority are distinct and that we need to focus more on the former (...) in order to really support and defend Krehoff’s conclusions. Does the moral badness of pain depend on who feels it? A common, but generally only implicitly stated view, is that it does not. This view, ‘unitarianism’, maintains that the same interests of different beings should count equally in our moral calculus. Shelly Kagan’s project in How to Count Animals, more or less is to reject this common view, and develop an alternative to it: a hierarchical view of moral status, on which the badness of pain does depend on who (...) feels it. In this review essay, we critically examine Kagan’s argument for status hierarchy. In particular, we reject two of the central premises in his argument: that moral standing is ultimately grounded in agency and that unitarianism is overdemanding. We conclude that moral status may, despite Kagan’s compelling argument to the contrary, not be hierarchical. (shrink)

In this first of two essays written on the topic of ancient greek inscriptions, I will briefly explore and discuss the role of the written word and of visual language within the cult of Asclepius at Epidauros, by both looking at the creation and function of the Epidaurian sanctuary's healing inscriptions—also called 'iamata'. Throughout the essay I have made use of J.L. Austin's Speech Act Theory to better contextualize the meaning of the inscriptions dealt with.

Quantum leaps happen in texts, too. This reading of the role of the quantum leap in Karen Barad's agential realism is necessary, because arguing that the diffractive reading strategy proposed by Barad's ethico-onto-epistemology mirrors the physical phenomenon of diffraction would indeed be representationalist. Reviewing how Barad—in her own oeuvre—has transformed diffraction into an innovative reading methodology that could not only potentially challenge the epistemological underpinnings of the canonization process that is at work in feminist theory, but could also radically change (...) the canonization practice of feminist oeuvres itself, our article embarks on a detailed examination of the ways in which the oeuvres of Simone de Beauvoir and Luce Irigaray have been mistakenly categorized and canonized in a hierarchical and Oedipalized manner. This conflict-based narrative has not only paralyzed the oeuvres of Irigaray and Beauvoir, but also has had a negative impact on the canonization of sexual difference philosophy as a whole in feminist theory. By (re)reading the oeuvres diffractively, this article brings the feminist philosophies of Beauvoir and Irigaray together by invalidating the idea that the feminist canonization process always has to run along the lines of discontinuity, Oedipalization and dialectization. In this paper we propose and analyze a game-theoretic model of the epistemology of peer disagreement. In this model, the peers' rationality is evaluated in terms of their probability of ending the disagreement with a true belief. We find that different strategies---in particular, one based on the Steadfast View and one based on the Conciliatory View---are rational depending on the truth-sensitivity of the individuals involved in the disagreement. Interestingly, the Steadfast and the Conciliatory Views can even be rational simultaneously in (...) some circumstances. We tentatively provide some reasons to favor the Conciliatory View in such cases. We argue that the game-theoretic perspective is a fruitful one in this debate, and this fruitfulness has not been exhausted by the present paper. (shrink)

The hypothesis that approaches the use of humour throughout the ages as something approximating a coping mechanism, has been subject to a long-standing discussion in what is known as humour studies. In this particular essay, by looking through the spectacles of one of the discipline’s theories, called relief theory, I will attempt to find out whether humour was used to lighten the weight of oppression in Imperial Rome, and can thus corroborate this hypothesis.

This essay will attempt to inspect and discuss what ‘efforts’ have been made to recover from the apartheid regime, to explore the status quaestionis of peacebuilding and conflict transformation theories that have been formulated and consulted to advance and assess these efforts and to consider the reasons for the impact—or lack thereof—that these efforts have had on South Africa's recovery from apartheid era policies and transgressions. The central question towards which these points of focus are directed, is: are South Africa’s (...) various recovery and reconciliation initiatives to be considered more of a success than a failure or vice versa? Einer der stärksten Einwände gegen diese These stellt das Argument der Nichtabgeleitetheit von Frederick Adams, Ken Aizawa und Jerry Fodor dar. Dieses Argument setzt voraus, dass genuine mentale Repräsentationen nichtabgeleitete Gehalte haben – ihre semantischen Eigenschaften sind also nicht durch Absichten, Wünsche oder Konventionen konstituiert. Repräsentationen mit nichtabgeleitetem Gehalt finden sich jedoch, so das Argument weiter, nur innerhalb der körperlichen (...) Grenzen mentaler Wesen. Ich werde dafür argumentieren, dass das Argument der Nichtabgeleitetheit scheitert, da es insbesondere bei Tieren externe Repräsentationen gibt, deren Gehalt nichtabgeleitet ist. Dies folgt jedenfalls aus der aussichtsreichsten Theorie nichtabgeleiteter Repräsentationen, der Teleosemantik, und es gibt gute Gründe anzunehmen, dass auch andere naturalistische Gehaltstheorien dieselbe Implikation haben. Durch genomweite Analysen werden vielfältige gesundheitsrelevante Informationen über eine Person gewonnen. Solche Informationen können die Behandlung von Krankheiten verbessern. Sie ermöglichen aber auch Vorhersagen, ob eine Person und deren Verwandte in Zukunft möglicherweise erkranken werden. Der neuartige Charakter des Informationseingriffs und sein prädiktive Potential bedürfen der ethischen, juristischen und ökonomischen Reflexion, damit diese Technologie zum Wohl der Patienten, der Familienangehörigen und der Solidargemeinschaft eingesetzt werden kann. Die vorliegende Schrift leistet mit ihren interdisziplinären, vom BMBF finanzierten Analysen dazu einen Beitrag. (...) Ziel der Untersuchung ist zu zeigen, inwiefern Hegels Charakterisierung des Schönen als ‚das sinnliche Scheinen der Idee‘ auch für die Deutung des Naturschönen Erklärungswert hat. Vorausgesetzt ist die für den Idea- lismus Hegelscher Prägung zentrale Doktrin, derzufolge der Natur Ideel- les zugrunde liegt. Schön sind dann Naturphänomene, in denen jener ideelle Grund der Natur durchscheint. Das Erfassen von Ideellem scheint ein Privileg geistiger Wesen zu sein. Dem stehen evolutionsbiologische Argumente entgegen, die dem Schönen einen positiven Selektionswert, etwa bei der sexuellen (...) Partnerwahl, zusprechen. Auch der Mensch hat stammesgeschichtliche Wurzeln, die in ihm weiter wirken. Doch sobald der Geist auf der evolutionären Bühne erscheint, herrscht das Biologische nicht länger mit der uneingeschränkten Macht, die es im Rahmen natürli- cher Selektion hat. Hegels Deutung des Schönen, auch des Naturschönen, ist wesentlich bezogen auf den Geist. Ich verdeutliche dies an einigen Exempeln (Schneekristall, musikalische Harmonie, Abendhimmel, Ge- birgslandschaft, organische Blüten- und Körperformen). Aber wodurch sind Naturschönheit und Kunstschönheit dann voneinander unterschie- den? Die Hervorbringungen der Natur sind lediglich Zufallskonstellatio- nen. Allerdings, so Hegel, hat der Zufall es ‘recht’ gemacht, d.h. hat er etwas reizend Stimmiges gefügt, gewahrt der Geist darin das im Sinnli- chen durchscheinende Ideelle. Eben darin wird, mit Adorno gesprochen, die gemeinsame Wurzel des Kunstschönen und des Naturschönen erkennbar. Wer das Naturschöne preist, begebe sich „an den Rand der Afterpoe- sie“, des Kitsches, meint Adorno. Gleichwohl sei es wahr zu sagen, „die Landschaft der Toscana sei schöner als die Umgebung von Gelsenkirchen“ (Adorno 1993, 110, 112). In der Tat. Doch was meinen wir, wenn wir Landschaften, Blumen, Sonnenuntergänge ‘schön’ nennen, und welche Kriterien bringen wir dafür in Anschlag? Im Folgenden möchte ich darle- gen, inwiefern Hegels Charakterisierung des Schönen als „das sinnliche Scheinen der Idee“ diesbezüglich erhellend und klärend ist. Hinweise auf Adornos ästhetische Theorie ergänzen diese Überlegungen. Dem stehen evolutionsbiologische Argumente entgegen, die zunehmend Einfluss auf die ästhetische Diskussion gewinnen. (shrink)

The purpose of this paper is to review and discuss Luciano Floridi’s 2019 book The Logic of Information: A Theory of Philosophy as Conceptual Design, the latest instalment in his philosophy of information (PI) tetralogy, particularly with respect to its implications for library and information studies (LIS) .

Purpose – To review and discuss Luciano Floridi’s 2019 book The Logic of Information: A Theory of Philosophy as Conceptual Design, the latest instalment in his philosophy of information (PI) tetralogy, particularly with respect to its implications for library and information studies (LIS). Design/methodology/approach – Nine scholars with research interests in philosophy and LIS read and responded to the book, raising critical and heuristic questions in the spirit of scholarly dialogue. Floridi responded to these questions. Findings – Floridi’s PI, including (...) this latest publication, is of interest to LIS scholars, and much insight can be gained by exploring this connection. It seems also that LIS has the potential to contribute to PI’s further development in some respects. Research implications – Floridi’s PI work is technical philosophy for which many LIS scholars do not have the training or patience to engage with, yet doing so is rewarding. This suggests a role for translational work between philosophy and LIS. Originality/value – The book symposium format, not yet seen in LIS, provides forum for sustained, multifaceted and generative dialogue around ideas. (shrink)

Does ethics have adequate general theories? Our analysis shows that this question does not have a straightforward answer since the key terms are ambiguous. So we should not concentrate on the answer but on the question itself. “Ethics” stands for many things, but we let that pass. “Adequate” may refer to varied arrays of methodological principles which are seldom fully articulated in ethics. “General” is a notion with at least three meanings. Different kinds of generality may be at cross-purposes, so (...) we must not expect theories to be general in sundry senses. “Theory,” for that matter, is itself ambiguous. Some thinkers say that ethics cannot have theories, while others deny it. We doubt whether opposing parties are talking about the same things.No wonder, then, that controversies in ethics are long-lasting and unproductive. We hope that the methodology we have presented will alleviate some of them. The examples we chose show that this is feasible. Views such as Hare's and Jonsen and Toulmin's which are seemingly wide apart, show convergence if we put them in a methodological perspective.Our analysis also suggests that many alleged differences between science and ethics could fade away if methodology is brought to bear on them. Specifically, the idea that ethics compares poorly with science in view of limited generality, or poor means of justification, is unfounded. Those who defend this view over-rate the powers of science. (shrink)

Zusammenfassung: Gegenstand der Arbeit ist das Konzept der metaphorischen Be-deutung, soweit dessen Ursprung in der analytischen Philosophie zu finden ist. In der Ein-leitung der Untersuchung werden jedoch auch ältere Theorien der Metapher vorgestellt, die aus der Perspektive der metaphorischen Bedeutung relevant sind oder als relevant be-trachtet werden können. Allen diesen Theorien liegt die Definition zugrunde, dass in der Metapher etwas als etwas anderes gesehen wird. Daher kann von einer Wahrnehmungs-metaphorik die Rede sein. Das erste Kapitel meiner Arbeit behandelt die Frage, (...) wie Metaphern in der Sprache zu erkennen sind. Es wird die Schlussfolgerung gezogen, dass eine Metapher, anstatt erkannt zu werden, vielmehr als solche akzeptiert werden muss. Im zweiten Kapitel werden zwei der bedeutsamsten zeitgenössischen Theorien der Metapher, nämlich von Max Black und Donald Davidson, erörtert und kritisch ausgewertet. Der Argumentation Davidsons zufolge muss die metaphorische Bedeutung als etwas All-gemeines verstanden werden, das nicht einer bestimmten Metapher, sondern der Metapher überhaupt zukommt. Dabei bleibt Davidson aber der Wahrnehmungs-metaphorik verhaftet, die bei ihm wie bei Black keine Erläuterung findet. Gegen Ende des zweiten Kapitels und hauptsächlich im dritten Kapitel werden drei Arten des Herangehens an die Wahrnehmungsmetaphorik vorgeschlagen: Sie kann entweder verworfen oder interpretiert oder aufgehoben werden. Die zwei letztgenannten Zugänge werden anhand der Schriften von Ludwig Wittgenstein, José Ortega y Gasset und Wallace Stevens weiter ausgearbeitet. -/- Abstract: This thesis investigates the concept of the metaphorical meaning originating in analytical philosophy. Also, in the Introduction are considered older theories of the meta-phor, which can be seen from the perspective of the metaphorical meaning. All these ac-counts are based on a definition that in the metaphor is something seen as something else. Therefore, all our understanding of the metaphor issues from a visual perception. But that’s a metaphor, too. Chapter I. examines the question, how to detect metaphors in lan-guage. It is concluded that metaphors must be accepted instead of detected. The chapter II. aims at introducing and criticizing the two nowadays prominent analytical theories of metaphor given by Max Black and Donald Davidson. The consequence of the argumenta-tion by Davidson is that the concept of the metaphorical meaning has to be applied to the metaphor as such, not to any particular one. In their theories, Davidson and Black are still likening the metaphor to the visual perception but this simile or rather metaphor remains unexplained. The final chapter III. presents three approaches how to deal with the visual perception metaphor in explanations of the metaphor: it can be rejected, interpreted or sublated. The last approaches are elaborated on the basis of writings by Ludwig Wittgen-stein, José Ortega y Gasset and Wallace Stevens. (shrink)

In the Transcendental Dialectic (KrV, A 599-560/B 627-628), Kant presents the argument of the hundred talers as a concrete example of his general claim against conceiving existence as a real predicate. According to Kant, the content of concepts can be completely determined as merely possible content; in the existential judgment, the subject then relates the completely determined content of his internal thoughts with perception: it is only through perception that the subject knows the content of his concepts as real things (...) of the world. Thus, although in his epistemology conceptual activity plays a crucial role in perceptual activity, Kant still offers an empiricist account of empirical knowledge. Hegel criticizes Kant´s theory of perception by distinguishing representation (Vorstellen) from comprehension (Begreifen) and by developing on that basis a more complex theory of the relation between concept, existence, and empirical knowledge. From the standpoint of representation, concept and existence, being-determined and being-real exclude each other; in comprehension, on the contrary, representation and perception are no longer unilateral forms of knowing: for the mind that comprehends what it perceives, the existence of what it perceives is –when abstractly considered as such– only a collateral product of the way it knows the real world. According to Hegel, comprehension develops the internal necessity of the contents of knowledge and, by doing so, grasps the individual objects that constitute our world. (shrink)

Harsanyi und Rawls haben zu der Frage, wie die wichtigen Güter in einem Staat verteilt sein sollten, zwei sehr ähnliche Theorien entwickelt, kommen aber zu unterschiedlichen Schlüssen. Harsanyi plädiert für eine utilitaristische Regel, Rawls dagegen für eine Regel, die sich auf diejenigen konzentriert, denen es in der Gesellschaft am schlechtesten geht. Die fast fünfzig Jahre andauernde Diskussion zwischen den beiden wird hier systematisch dargestellt und analysiert. Erstens wird gezeigt, dass sich unter Berücksichtigung von Abneigung gegen Risiko und abnehmendem Grenznutzen die (...) auf dem Urzustand beruhenden Argumentationen weitaus ähnlicher sind, als den Autoren bewusst ist. Allerdings gibt Harsanyis Theorie wahrscheinlich den Armen im Gegensatz zu Rawls nur relative und keine absolute Priorität. Zweitens wird allerdings die Argumentation über den Urzustand infrage gestellt. Dabei sprechen außerhalb des Urzustandes mehrere praktische Erwägungen tendenziell für Rawls’ Differenzprinzip. Die philosophischen, traditionellen Ansätze zur Moral beruhen hauptsächlich auf metaphysischen und theologischen Konzepten und Theorien. Unter den traditionellen Ethikkonzepten ist die göttliche Befehlstheorie die prominenteste (DCT). Gemäß der DCT gibt Gott der Menschheit moralische Grundlagen durch ihre Schöpfung und durch Offenbarung. Moral und Göttlichkeit sind seit der fernsten Zivilisation untrennbar. Diese Konzepte tauchen in einen theologischen Rahmen ein und werden hauptsächlich von den meisten Anhängern der drei abrahamitischen Traditionen angenommen: Judentum, Christentum und Islam: dem bedeutendsten Teil der menschlichen Bevölkerung. Die (...) göttlichen Befehlstheorien halten den Glauben und die Offenbarung für ihre Grundlage und unterliegen nicht strikt der Demonstration. Die Gegner der Gottesbefehlskonzeption der Moral, gegründet auf der Unmöglichkeit der Demonstration ihrer metaphysischen und religiösen Annahmen, haben seit vielen Jahrhunderten (obwohl erfolglos) versucht, ihre Bedeutung zu devalvieren. Sie hielten das Argument, dass es keine materiellen Beweise und logische Kohärenz zeigt und aus diesem Grund nicht für wissenschaftliche oder philosophische Zwecke berücksichtigt werden kann. Es ist nur ein Glauben und sollte daher verstanden werden. Abgesehen von diesen extremen Gegensätzen widersprechen viele andere Konzepte den Theorien des göttlichen Befehls, in der einen oder anderen Weise, teilweise oder vollständig. Von der klassischen griechischen Philosophie bis heute behaupten viele Philosophen und Sozialwissenschaftler, dass Moral nur ein Konstrukt ist und somit kulturell relativ und kulturell bestimmt ist. Dies führt jedoch zu vielen weiteren Diskussionen und stellt die Herausforderung dar, die Bedeutung der Kultur, welche Elemente der Kultur moralisch bestimmend sind, und schließlich die Grenzen dieser Relativität zu bestimmen. Moralischer Determinismus behaupten, dass alles, was mit menschlichem Verhalten zusammenhängt, einschließlich der Moral, bestimmt wird, sobald der freie Wille nicht existiert. In jüngerer Zeit haben moderne Denker argumentiert, dass es eine strenge Wissenschaft der Moral gibt. Doch trotz der Erklärung mehrerer Tatsachen und Beweise kann die wissenschaftliche Methode allein nicht den gesamten Inhalt und die volle Bedeutung der Ethik erleuchten. Das Verständnis der Moral erfordert eine breitere Wahrnehmung und eine Einigung unter den Philosophen, die sie nie erreicht haben. Diese Fragen haben viele verschiedene Konfigurationen, abhängig von jedem philosophischen Strang und beginnen komplexe Analyse und endlose Debatten, solange viele von ihnen gegenseitig widersprüchlich sind. Das Universum und die Atmosphäre, die diese Forschung beinhaltet, sind die Herrschaften all dieser konzeptionellen Konflikte, die aus objektiver und evolutionärer Sicht beobachtet werden. Ungeachtet dieser Umstände und ihrer intrinsischen Bedeutung sind diese Fragen jedoch weit entfernt vom methodischen Ansatz einer analytischen Diskussion über objektive Moral, die in der Tat das Ziel und den Umfang dieser Arbeit ist. Wir sollten diese prominenten traditionellen Theorien kurz überprüfen, weil diese Arbeit eine vergleichende Studie beherbergt, und ihre Annahmen unterscheiden sich zumindest tief von allen herkömmlichen Theorien. Daher wird es notwendig, dem Leser direkte und spezifische Elemente des Vergleichs für gültige Kritik anzubieten, ohne unterbrechende Forschung. Doch auch wenn wir die traditionellen Theorien für diesen vergleichenden und kritischen Expositionszweck überdenken, werden sie als „aliena materia" an der Seite unserer primären Anliegen gehalten werden. Unabhängig von der Gültigkeit eines oder aller der Elemente dieser Diskussion und ihrer Bedeutung als philosophisches Universum unserer Forschung, ist der Zweck dieses Werkes, dass die Existenz und die Bedeutung der prähistorischen moralischen Archetypen, die direkt aus den grundlegenden sozialen Bedürfnissen und Anstrengungen für das Überleben demonstrierten Archetypen sind, die Definition der wesentlichen Grundlage der Ethik, ihre Aggregation in das kollektive Unbewusste und die entsprechende logische Organisation und Übertragung auf die evolutionären Stadien des menschlichen Genoms und verschiedene Raum-Zeit-Beziehungen, unabhängig von jeder zeitgenössischen Erfahrung der Individuen. Das durch diese Archetypen definierte System bildet ein evolutionäres menschliches soziales Modell. (shrink)

It is often claimed that the theory of function levels proposed by Frege in Grundgesetze der Arithmetik anticipates the hierarchy of types that underlies Church’s simple theory of types. This claim roughly states that Frege presupposes a type of functions in the sense of simple type theory in the expository language of Grundgesetze. However, this view makes it hard to accommodate function names of two arguments and view functions as incomplete entities. I propose and defend an alternative interpretation of first-level (...) function names in Grundgesetze into simple type-theoretic open terms rather than into closed terms of a function type. This interpretation offers a still unhistorical but more faithful type-theoretic approximation of Frege’s theory of levels and can be naturally extended to accommodate second-level functions. It is made possible by two key observations that Frege’s Roman markers behave essentially like open terms and that Frege lacks a clear criterion for distinguishing between Roman markers and function names. How should civil society deal with radical actors such as populists? Should democrats engage in an open dialogue or avoid confrontation? Should they listen to them, let them speak and try to expose them argumentatively, or should they deny them any kind of public platform? Rather than providing a normative answer to these questions, this article analyzes and systematizes responses that are already circulating in public discourse. In particular, we focus on reactions to the invitations of the AfD politicians Alice (...) Weidel and Marc Jongen to the Oxford Union (2018), the Zurich Theater Gessnerallee as well as the Hannah Arendt Center in New York (both 2017). We will show that the debates gave excessive weight to fundamental questions of democratic theory while marginalizing the specific context factors of the events. Because of this, the populists eventually gained the moral victory. (shrink)

Nelson's Proof of the Impossibility of the Theory of Knowledge -/- In addressing the possibility of a theory of knowledge, Leonard Nelson noted the contradiction of an epistemological criterion that one would require in order to differentiate between valid and invalid knowledge. Nelson concluded that the inconsistency of such a criterion proves the impossibility of the theory of knowledge. -/- Had the epistemological criterion had a perception, then it would presume to adjudicate on its own truth (thus epistemological circular argument). (...) However, if one were to assume that the criterion is not knowledge, one would then have to justify how this is a criterion for truth - yet this would only be possible when it may be considered as an object of knowledge. One would equally have had to predetermine the criterion in order to determine the truth of this knowledge, thereby providing another circular argument. Ostensibly, every criterion of truth fails at its very own test since it cannot guarantee its own truth, just as Munchausen, contrary to his assertion, could not draw himself out of the swamp by tugging on a tuft of his own hair. -/- Nelson proposed a solution of the epistemological problem (the question of the differentiation between valid and invalid knowledge), that based on Jakob Friedrich Fries' differentiation between proof and deduction. Proof, according to Nelson (in reference to Fries), can be defined as derivation of truth from one statement from another statement. Thus, from the truth in the statement that "all men are mortal", one is then able to say that "Socrates is a man" and thence extrapolate from the truth of the statement that "Socrates is mortal." If knowledge were to be considered somewhat judgmental (in a statement), then an attempt at proof (i.e. recourse to previous judgments) would inevitably lead to an infinite regression in justification, since each judgment would necessitate a further justification from another judgment. Every attempt to prove an epistemological criterion is thus also confronted by this regression in justification. -/- Nelson's attempt at a solution rests on the assumption of the existence of an immediate knowledge as a justification of the truth (mediate) of knowledge. Nelson considers immediate knowledge to be non-judgmental knowledge. These include intuitions (e. g. seeing-the-red-roof) and also philosophical knowledge that pre-exists in his opinion before a judgmental reflexion (immediate) in our reason (e. g. the principle of causality). -/- Proof of the truth of mediate knowledge can be effected by showing its compliance with attendant immediate knowledge (rational truth = correspondence of mediate knowledge with their immediate knowledge). Nelson considered this as a resolution of the circular epistemological argument. In regard to philosophical knowledge, Nelson sees these as subject to deduction and not proof. Abstract. Kant's political philosophy in general is characterized by two aspects which sometimes compete with each other and sometimes supplement each other: an individualist element on the one hand and a social or "communitarian" element on the other hand. This paper deals with Kant's theory of private property. It attempts to show something that is usually overlooked in the secondary literature: that Kant has two, not just one argument for property. One is based on his theory of freedom and expresses (...) the individualist aspect of his thinking. The other argument is based on Kant's principle of right and expresses the social aspect of his political thought. Despite some problems with his arguments the complexity of Kant's theory remains impressive. (shrink)

English title: The Fundations of Normativity by Kant and Spener. In one of the chapters in Conflict of Faculties, Kant presents so-called “Spener’s problem”. Kant refers to the conception of the 17th century theologian Philipp Jakob Spener, concerning the problem of radical moral transformation of individuals. Spener became famous as one of the founders and main exponents of pietistic theology, which in the 18th century became one of the most significant intellectual trends at the University of Königsberg and about which (...) one may assume, that it could influence the evolution of Kantian philosophy. The goal of the article is to compare the main assumptions of Spener’s theology with Kantian theory of moral motivation. The analysis focuses on the possibility of describing the phenomenon of normativity in both conceptions. (shrink)

Inwieweit vermag sich der ehemalige explanative Erfolg nicht mehr anerkannter Theorien auf die Geltung derjenigen Teilaussagen, die Nachfolgetheorien übernommen haben, zu stützen? Zur Klärung dieser Fragestellung können die Ergebnisse von Machs Untersuchung zur mechanistischen Auffassung des Energieerhaltungssatzes herangezogen werden. Indem er sich in seiner Kritik an den ontologischen Annahmen des Mechanismus auf die Wissenschaftsgeschichte beruft, steht er einer heutigen realismuskritischen Argumentation nahe. Andererseits mißt er den hypothesenfreien Theoriebestandteilen einen Geltungscharakter zu, der in seinem Wahrheitsanspruch durchaus mit einer heutigen realistischen (...) Behauptung theorieübergreifender Bestände der wissenschaftlichen Erkenntnis vergleichbar ist. Daß Mach mit einer quer zur gegenwärtigen Terminologie liegenden Analyse einen Beitrag zur Entschärfung gegenwärtiger Kontroversen leistet, läßt eine erneute Vergegenwärtigung der Schrift von 1872 und den sich daran anschließenden Überlegungen Machs lohnenswert erscheinen. The question of what ontological insights can be gained from the knowledge of physics (keyword: ontic structural realism) cannot obviously be completely separated from the view of physics as a science from an epistemological perspective. This is also visible in the debate about 'scientific realism'. This debate makes it clear, in the form of the importance of perception as a criterion for the assertion of existence in relation to the 'theoretical entities' of physics, that epistemology itself is 'ontologically loaded'. This (...) is in the form of the assumption that things in themselves (independent of cognition, in an autonomous way) exist as so-and-so determined ones. This ontological assumption is not only the basis of our (naive) conception of knowledge, but also its indispensable premise, insofar as this conception is a fundamentally passive, 'receptive' one. This is true to the full extent of metaphysics, and to a not much lesser extent of epistemology. The interpretation of knowledge in the sense of 'description' seems to be without alternative. In the philosophy of science, this view is reflected in the emphasis on 'objectivity' as the essence of science, in the belief in 'induction' as the traditional method of science, and (ex negativo) in the problem of the 'theory laden nature of observation'. To these paradigms of epistemology, however, a further aggravating factor is added, namely the criterion of 'subjective certainty' as evidence of 'real' knowledge (only meaningful on the basis of the ontological premise mentioned above). Thus, due to its 'expertise' in matters of knowledge, epistemology becomes the 'prima philosophia'. But what is even more important, the real, holistic cognitive situation is transformed into a linear cognitive relationship, with the consequence of the 'transcendence' of the objects. Now, on closer inspection, however, there is not too much in the expertise of epistemology, because it basically consists only of paradigms which, from the point of view of the holism of the real cognitive situation itself, are nothing more than relatively simplistic interpretations of this situation. However, we do not yet know what another conception of knowledge might look like (which is not surprising given the position of the phenomenon of knowledge in the hierarchy of phenomena according to their complexity). 'Certitude' as a criterion of cognition is thus excluded from the outset, and thus the linear relational model of cognition also appears as what it is, a gross distortion of the real, holistic situation of cognition. The significance of this argumentation with regard to physics is that the linear epistemological model of cognition itself is a major obstacle to an adequate epistemological understanding of physics. This is because it is fixed 'a priori' to an object-related concept of knowledge, and to 'description' as the only mode of ('real') knowledge. The acceptance of the real, holistic epistemological situation is therefore, in my opinion, the condition for an adequate understanding of physics' heuristic access to objects, its transcendental, generalizing epistemological concept, as well as its ontological relevance and dimension. This paper explores the form of Marx’s and Engels’s critique in German Ideology. Against traditional claims, it argues that Marx and Engels, working on the manuscripts of 1845–47, were not concerned with establishing their own theory of society and history, but with the quarrel with Young-Hegelians and “true socialists” instead. Focusing on the polemical character of German Ideology, one is able to trace the working process of Marx and Engels. For this purpose, it is analysed how the concept of ideology (...) and the scheme of something acquiring independent existence are used throughout the manuscripts. Hence it becomes clear that Marx’s and Engels’s critique is not coherent, but has internal frictions. Utilising concepts and schemes of argumentation in the way of tools, varied in detail by context, they formed their own assumptions and critical replies. Marx and Engels developed the polemics of German Ideology in a strikingly dynamic manner. (shrink)

In order to explain Wittgenstein’s account of the reality of completed infinity in mathematics, a brief overview of Cantor’s initial injection of the idea into set- theory, its trajectory and the philosophic implications he attributed to it will be presented. Subsequently, we will first expound Wittgenstein’s grammatical critique of the use of the term ‘infinity’ in common parlance and its conversion into a notion of an actually existing infinite ‘set’. Secondly, we will delve into Wittgenstein’s technical critique of the concept (...) of ‘denumerability’ as it is presented in set theory as well as his philosophic refutation of Cantor’s Diagonal Argument and the implications of such a refutation onto the problems of the Continuum Hypothesis and Cantor’s Theorem. Throughout, the discussion will be placed within the historical and philosophical framework of the Grundlagenkrise der Mathematik and Hilbert’s problems. (shrink)

In der Diskussion um personale Identität nehmen die einflussreichen Arbeiten Derek Parfits eine Sonderstellung ein, insofern Parfit nicht bestrebt ist, eines der gängigen Identitätskriterien zu verteidigen, sondern vielmehr behauptet, dass unsere alltäglichen wie philosophischen Vorstellungen von personaler Identität unrettbar inkohärent sind und deshalb aufgegeben werden sollten. In seinem Beitrag beleuchtet Sascha Settegast die verschiedenen Argumente, die Parfit für diese provokante These vorbringt, und unternimmt insbesondere den Versuch einer systematischen Dekonstruktion der wichtigsten Gedankenexperimente Parfits, die zeigen soll, dass sich diese Gedankenexperimente (...) auf eine Weise auflösen lassen, die unsere alltäglichen Intuitionen über personale Identität intakt belässt. Settegast entwickelt dabei die Grundzüge einer Konzeption personaler Identität, die sich einerseits von den gängigen neo-lockeanischen und animalistischen Ansätzen abgrenzt und andererseits bewusst an den zeitgenössischen Neo-Aristotelismus in der Ethik anknüpft, wie er etwa bei Philippa Foot und Michael Thomp-son anzutreffen ist. Die diachrone numerische Identität menschlicher Personen gründet nach Settegasts Auffassung darin, dass der Verlauf ihres Lebens eine zeitliche Einheit aufweist, die dadurch bedingt ist, dass ihre Lebensführung die menschliche Lebensform auf eine individuell charakteristische Weise exemplifiziert. Insofern dies aber nur durch Kultivierung der Tugen-den zu erreichen ist, handelt es sich laut Settegast bei personaler Identität letztlich nicht um eine Tatsache, die einfach vorliegt oder nicht, sondern um eine Aufgabe, die uns als Menschen gegeben ist und wesentlich darin besteht, in bewusster Orientierung auf das gute Leben hin ein stabiles, sich zeitlich durchhaltendes Selbst allererst auszubilden. In this article, a new, idealizing-hermeneutic methodological approach to developing a theory of philosophical arguments is presented and carried out. The basis for this is a theory of ideal philosophical theory types developed from the analysis of historical examples. According to this theory, the following ideal types of theory exist in philosophy: 1. descriptive-nomological, 2. idealizing-hermeneutic, 3. technical-constructive, 4. ontic-practical. These types of theories are characterized in particular by what their basic types of theses are. The main task of this (...) article is then to determine the types of arguments that are suitable for justifying these types of theses. Surprisingly, practical arguments play a key role here. Hegel definiert „Vernunft” als die Einheit der Objektivität und der Subjektivität. Diese Definition bedeutet nicht, dass für Hegel nur das Subjekt existiert, welches sich das Objekt dementsprechend nur in seinem Inneren vorstellt; eine solche Definition bedeutet nämlich nicht, dass es für Hegel keine Außenwelt gibt, sondern eigentlich, dass es für ihn nichts gibt, was als solches unvernünftig ist. Als Einheit des Subjekts, das erkennt, und des Objekts, das erkannt wird, umfasst die Vernunft für Hegel alles, was es gibt und geben (...) kann. Jene Definition bedeutet eben: Es gibt nichts außerhalb dessen, was das Subjekt erkennt und erkennen kann. Mit dieser These verneint Hegel selbstverständlich nicht, dass es Sachen gibt, die das Subjekt noch nicht kennt bzw. von deren Existenz es noch nicht weiß, und auch nicht, dass es keine Sachen gibt, die das Subjekt noch nicht verstanden und begriffen hat, sondern eigentlich nur, dass es keine Sachen gibt, die prinzipiell nicht erkannt und begriffen werden können. Dass etwas existiert, impliziert für Hegel, dass es eventuell erkannt und fernerhin begriffen werden kann. Sein, Erkennbarsein und Begreifbarsein sind für Hegel ein und dasselbe. (shrink)

The paper defends the following thesis: the intentionality passage from Brentano’s Psychology from an Empirical Standpoint (1874) can be interpre- ted from two perspectives: intentionality as the most salient distinguishing feature separating the mental from the physical, and intentionality as a the- ory of the way in which mental acts, with their contents, are related to ex- tra-mental objects. Fundamentally, the theory of intentionality from 1874 is an example of the former. Its role is that of allowing the establishment of (...) psychology as a science. However, it can also be understood as a theory of intentionality in the second sense through a clarification of the relations it entails between the content and the object of the act. For this reason, it could be said that the act–content–extra-mental object distinction was already achieved in the 1874 work, at least at the level of sensory acts. The distinction between the psychical act, the content, and the object presen- ted through this content was already made in the EL 80 Logik manuscript from 1869/70 at the level of nominal presentation, which provides a fur- ther argument for the above thesis.
